i esposo me golpeo desde el primer año de matrimonio. En mi pueblo [Querétaro México], era costumbre que la mujer tenía que aguantar eso y mucho más. Incluso cuando nos venimos a Estados Unidos no me atrevía a denunciarlo, hasta que un día le hice caso mis hijos y busque ayuda, pero mi abogado nunca hizo nada. Tres meses después me arresto migración y termine en la cárcel, sola, sin saber qué hacer y alejada de mis hijos”.

María Hernández inicialmente había sido víctima de una mala asistencia jurídica en el estado de Iowa, por lo cual su abogado jamás se molestó en comprobar el abuso físico y psicológico al que la sometía marido.

Para su mala suerte, a los tres meses de este hecho, autoridades de la División de Inmigración y Control de Aduanas (ICE) del Departamento de Seguridad Nacional ingresaron a la matanza y empacadora de

carne Agriprocessors Inc., donde ella trabajaba en Postville.

“Hubo muchos gritos y la agente corría.

Yo me espante porque incluso se escuchaban helicópteros… Me jalonearon y me dijeron que por ser indocumentada me iban a deportar. Yo lloraba y gritaba por mis hijos que estaban solo… Y al final termine en la cárcel”, narro con tristeza María, quien hoy sabe que había sido parte de una de las mayores redadas de migración realizada en los Estados Unidos, el 12 de mayo del 2008, en la cual detuvieron a 389 personas.

“En menos de una semana me condenaron por fraude de documentos. Me encerraron por varios meses y luego me deportaron. La verdad es que nunca supe bien lo que estaba firmado o aceptado. El abogado que me toco me decía que lo mejor era que aceptara salir del país y que ya después viera el modo de que mis hijos me alcanzaran…”

Nuevamente, María había sido víctima de una mala asistencia jurídica.

Lamentablemente, en Omaha y en todo Estados Unidos existe ejemplos persistentes y generalizados de violaciones a los derechos jurídicos y humanos, muchas veces agravados y/o impunes ante la mala o nula aplicación de la asistencia jurídica.

“Esto no significa que las autoridades locales, estatales o federales tengan políticas destinadas deliberadamente a reprimir a grupos concretos o a violar sus derechos”, dijo Margaret Waddington del Centro de Asistencia Legal de Inmigración en Lincoln, agregando: “Lo que si es preciso reconocer es que, en diversas dependencias o jurisdicciones, persisten prácticas que tienen como consecuencia abusos reales y graves. Y en aquellos que brindan ayuda jurídica hay muchos que tienen desinterés y les falta ética profesional”.

De acuerdo con Amnistía Internacional, algunas de estas malas acciones son resultados de conductas individuales que son indebidas y que son fomentadas por la costumbre institucionalizada de proteger al empleado o funcionario, he incluso por no exigir responsabilidades a los funcionarios.

En el peor de los casos, se deben a una negativa abierta a reconocer o respetar normas internacionales para la protección de los derechos humanos, civiles y jurídicos de las personas, sin importar su edad, sexo, color, preferencias sexual, estado migratorio o creencia religiosa.

En el caso de María, el abuso de autoridad y la mala asistencia de un abogado fueron lo que elimino toda posibilidad de haber salido mejor librada del calvario que la llevo a estar separa de sus hijos por 5 años. y continúa en la página 5

“Casos como el de María son una tragedia. Para nosotros, las víctimas de la violencia doméstica se consideran una alta prioridad porque son uno de los grupos más vulnerables en Nebraska”, dijo Waddington, cuya dependencia brinda servicios legales de inmigración accesible para inmigrantes y refugiados en Nebraska.

Pero, que pasa cuando la ayuda legal que se necesita no es de inmigración?

De acuerdo con Lutheran Family Services, antes, las personas que requerían asistencia debían ir de una sitio a otro dependiendo el tipo de ayuda que buscaban. Había que llenar varios formularios de admisión e incluso los clientes con casos delicados, como los sobrevivientes de la violencia doméstica o el tráfico, a menudo tenían que contar los detalles de su tragedia varias veces para cada lugar que se visitaban.

Este era un proceso largo, tanto para el solicitante como para los proveedores de servicios y las personas que necesitan ayuda.

Por ello, resulto grato saber que Lutheran Family Services se unió con Justicia Para Nuestros Vecinos-Nebraska, Servicios de Asistencia legal de Inmigración y con Caridades Católicas para crear en el 2013 un sistema de admisión generalizado, llamado: Línea de Asistencia Legal de Inmigración de Nebraska (1.855.307.6730) Gracias a la línea telefónica, la gente puede encontrar representación legal rápida, en diversos asuntos.

Por otro lado, desde hace 48 años Nebraska Legal Aid, ha proporcionado ayuda legal civil. “Nosotros nos enfocamos en los más desfavorecidos para representarlos en diferentes tribunales. Tenemos la humanidad y

el profesionalismo de dar ayuda a gente en albergues centros de minorías, refugiados y nuevos americanos. Lo que buscamos es fortalecer a la comunidad con una buena defensa, representación legal y asesoría, para evitar casos como el de María”, dijo Mike Farnam, en dicha dependencia.

En tanto, desde 1993 la escuela de derecho de la Universidad de Creighton estableció su Clínica Legal, para ofrecer ayuda legal gratuita en asuntos civiles para los residentes de pocos ingresos del condado de Douglas (402.280.2700).

Otra organización que lucha por la justicia y oportunidades para todos en el estado, es Nebraska Appleseed. Su enfoque es sistemático ante los problemas complejos, tales como el bienestar infantil, la política de inmigración, atención sanitaria accesible y la pobreza, realizando su trabajo tanto en el juzgado como en la cámara estatal o en la comunidad (402-438-8853).

Dentro de las acciones más recientes que se han puesto en funcionamiento para garantizar una asistencia jurídica adecuada, el pasado 22 de febrero se firmó un documento, llamado memorándum de entendimiento, entre funcionarios del Consulado de México y la Procuraduría de Justicia de los EUA para el Distrito de Nebraska, confirmando su compromiso por brindar protección a las víctimas del delito, sin importar su situación migratoria.

Con esto, Nebraska se convierte en el tercer estado de la unión americana en firmar dicho acuerdo, con el que se busca motivar que los mexicanos se acerquen a denunciar cualquier delito, para recibir asistencia jurídica adecuada.

Sobre este hecho, la Fiscal Deborah Gilg dijo: “Tenemos una buena relación con el consulado y estamos comprometidos a hacer que las víctimas del crimen tengan acceso a la justicia”.

Por su parte, la cónsul Guadalupe Sánchez expreso: “Este es un instrumento que nos permitirá fortalece la relación de colaboración entre nuestras instituciones, y nos proporcionará una herramienta para promover las garantías que la ley confiere a los mexicanos que haya sido víctimas de algún delito en el estado de Nebraska”.

Subrayó la necesitad y la importancia de crear y promover una cultura de prevención y cooperación para el cumplimiento de la ley.

Cabe mencionar también que desde el año 2000, en los consulados mexicanos existes un Programa de Asistencia Jurídica a Mexicanos a Través de Asesorías Legales, para brindar asesoría y/o representación legal a connacionales en Estados Unidos mediante abogados y firmas legales.

Con este programa, el consulado de México en Omaha y el resto de oficinas consulares mexicanas en los Estados Unidos reciben recursos extraordinarios para poder realizar contratos con abogados y/o firmas legales y así poder brindar orientación, asesoría y/o representación legal a los connacionales ubicados en sus respectivas zonas de operación.

La cónsul Guadalupe Sánchez reportó que en el 2015 su oficina atención aproximadamente a 16,000 personas, 40 de ellas manifestaron haber sido víctimas del delito, siendo el más recurrente la violencia doméstica.

Sobre el mismo tema, Kathy Belcastro, capitán del recinto sureste del Departamento de Policía en Omaha, dijo que el primer

lugar al que una persona debe acudir para denunciar un delito es a la policía, llamando al 911, acudiendo al recinto (25 y Vinton) o a cualquier oficina policiaca.

Subrayo que en su dependencia se han esforzado mucho por demostrar a la comunidad que ellos están ahí para mantener el orden y protegerles. Hablo de los múltiples eventos que en el sur de Omaha se han hecho para que las personas se acerquen a los oficiales y los vea como amigos que trabajan e incluso viven en el mismo vecindario.

“De hecho, en el recinto sureste se puede hacer una denuncia o pedir asistencia en español y no importa el estado migratorio de las personas para levantar un reporte”, afirmó segura de estar brindando una correcta asistencia a las personas.

Por lo pronto, el tiempo no ha frenado su curso en la vida de María, quien se arriesgó nuevamente a cruzar la frontera de forma indocumentada, para lograr estar con sus hijos y formalizar su divorcio. Desde el 2013 vive en Council Bluffs.

Sobre su experiencia narrada, dijo de manera concluyente: “Quizá si yo hubiera llamado al consulado de México o si hubiera buscado un abogado de esas organizaciones que ayudan a los latinos, no hubiera sido deportada. Pero nunca es tarde para aprender y saber que quizá cometimos un error por entre sin permiso a este país, pero al final todos tenemos un motivo especial y eso no impide que perdamos nuestros derechos o que alguien nos de una mala asesoría legal, como a mí me ocurrió. Por eso hoy estoy más informada y con el favor de Dios voy a salir adelante junto a mis hijos”.

El Memorándum de Entendimiento beneficiara a los mexicanos del estado de Nebraska, motivando la denuncia del delito, sin importar la situación migratoria.

“M

y husband started to hit me since the first year of our marriage. At my town [Queretaro, Mexico], women had to live with that and more. Even after we came to the United States, I didn’t have the courage to report him, until one day I finally listened to my sons and searched for help, but my lawyer never did anything. Three months later I was arrested by immigration and ended up in jail, all alone without any idea of what I had to do, away from my sons.”

Maria Hernandez had initially been the victim of some bad legal assistance in Iowa, which is why her lawyer never bothered to prove the physical and psychological abuse she suffered at the hands of her husband.

Her situation became even worse when, three months later, authorities from Immigration and Customs Enforcement (ICE) of the U.S. Department of Homeland Security entered Agriprocessors Inc. at Postville, where she worked.

“There was a lot of screaming and people were running all over the place. I got very scared because we could even hear helicopters... I was grabbed and was told that since I didn’t have the proper legal documentation, I was going to be deported. I was crying and screaming because my sons were going to be all alone. When all was said and done, I ended up in jail,” said Maria, who today knows she had been part of one of the largest immigration raids in the United States, when 389 people were arrested back on May 12, 2008.

“In less than a week I was convicted of document fraud. I was locked up for several months, and I was then deported. The truth is I never knew what I had signed or accepted. The lawyer I had said that the best thing I could do was to accept leaving the country and that I could later find a way to make it possible for my sons to join me later.”

Once again, Maria was the victim of bad legal assistance.

Unfortunately, in Omaha and all of the United States there are many examples of many violations of people’s human and legal rights, and many times they are left unpunished due to a bad or nonexistent legal assistance.

“This doesn’t mean that local, state and federal authorities have specific policies for repressing specific groups or violating their rights,” said Margaret Waddington of the Center for Legal Immigration Assistance in Lincoln. “What we do have to acknowledge is that in many agencies or jurisdictions there are many actions that as a consequence, end up in

real and grave abuse. And when people are provided with legal assistance, said people lack the drive and professional ethic to do a good job.”

According to Amnesty International, some of said incorrect actions are a result of the improper behavior of some individuals and which are encouraged by a habit of protecting the employee or government officers, or sometimes even because they don’t hold said government officers responsible for their actions.

In worst case scenarios, it is because of an open refusal to acknowledge or respect international laws and regulations for the protection of the human, civil, and legal rights of people, no matter their age, sex, color, sexual preferences, migratory status or religious beliefs.

As for Maria, the abuse of the authority and the bad legal assistance from her lawyer was what destroyed any chance she had of reaching a better outcome for her situation, so she ended up being separated from her sons for five years.

“Cases similar to Maria’s are a tragedy. Victims of domestic violence are a high priority because they are one of the most vulnerable groups in Nebraska,” said Waddington. Her office provides affordable legal immigration services for immigrants and refugees in Nebraska.

But, what happens when the help that is required has nothing to do with immigration?

According to Lutheran Family Services, it used to be that people who required some assistance had to go to different locations depending on the type of help they required. They also had to complete several admission forms, and even clients with very delicate cases –such as those who were survivors of domestic violence or human trafficking – usually had to expose all the details of their tragedy several times, one place at a time.

This was a very long process for the people requesting the services and in great need of help as well as for those who were providing said services.

Because of that, it is great to know that Lutheran Family Services has since 2013 been working together with Justice for Our Neighbors-Nebraska, the Center for Legal Immigration Assistance and with Catholic Charities to create a general admissions system: The Nebraska Immigration Legal Assistance Hotline (1.855.307.6730) Thanks to the hotline, people can quickly find the legal assistance they require for many different situations.

Another institution we must mention is Nebraska Legal Aid, who for over 48 years

now has provided civil legal aid assistance: “We focus on helping the less fortunate so that we can represent them in court. We have the humanity and professionalism to help people in shelters, for the minorities, working with refugees or with new Americans.

What we try to do is empower the community with a proper defense, legal representation, and counseling, so that we can avoid having cases similar to Maria’s,” said Mike Farnam, of Nebraska Legal Aid. And back in 1993, Creighton University established a Legal Clinic to offer free legal assistance on civil matters to low-income residents of Douglas County (402.280.2700).

Another organization that fights for justice and opportunities for all in the state is Nebraska Appleseed. Their focus is systematic or complex problems such as the wellbeing of children, immigration policies, affordable health care and poverty itself, working hard in court, in the state chamber or the community (402-438-8853).

Among the recent actions implemented in order to guarantee a proper legal assistance, on February 22 a document was signed – called a Memorandum of Understanding – by members of the Mexican Consulate and the U.S. Attorney General’s Office for the District of Nebraska, to confirm their commitment to protecting victims of crimes, no matter their migratory status.

With this, Nebraska becomes the third state in the United States to sign such an agreement, thus trying to motivate Mexican individuals to report all crimes so that they can receive the proper legal assistance they require.

On that note, U.S. Attorney Deborah Gilg stated: “We have a very good relationship with the Consulate, and we are committed to making sure that victims of any crime have access to justice.”

Consul Guadalupe Sanchez had this to say: “This document will allow us to strengthen the way our institutions collaborate, and it will provide us with a tool to promote the rights that the law bestows upon Mexicans who have been the victim of any crime in the State of Nebraska.”

She also highlighted the need and importance of building and promoting a culture of preventing crimes and cooperating so that the law is obeyed.

We must also mention that since the year 2000, Mexican Consulates have something called the Programa de Asistencia Jurídica a Mexicanos a Través de Asesorías Legales (Legal Assistance for Mexicans Through Legal Counseling) in order to provide legal counseling and/or representation to

Mexicans in the United States thanks to the work of many lawyers and legal firms.

With this program, the Mexican Consulate in Omaha and other Mexican Consular offices in the United States receive extraordinary resources to hire lawyers and/or legal firms to provide legal guidance, assistance and/or representation to Mexicans located in their respective areas of operation.

Consul Guadalupe Sanchez reported that in 2015 her office provided its services to approximately 16,000 individuals, 40 of which expressed having been victims of a crime, with the most recurring one being domestic violence.

On that subject, Captain Kathy Belcastro of the Southeast Precinct of the Omaha Police Department stated that the first place where someone must report a crime is the police, either by calling 911, by visiting the precinct (at 25th and Vinton Streets) or at any police office.

She highlighted that her office has placed a lot of effort in showing to the community that they are there to maintain the public order and protect them. She talked about the many events in South Omaha that have taken place so that people can be close to police officers and see them as friends who work and even live in their same neighborhood.

“In fact, in the southeast precinct you can place a report or ask for assistance in Spanish, and it doesn’t matter what your migratory status is because anyone can file a report,” she said, happy to be able to provide the assistance that people need.

Time has not slowed down in Maria’s life, and she took a chance and managed to once again cross the border without the proper documentation so that she could be with her children and formalize her divorce. She’s been living in Council Bluffs since 2013.

About her experience, she said: “Maybe if I had called the Mexican Consulate or if I had searched for a lawyer at one of the many organizations that help Latinos, I wouldn’t have been deported. But it’s never too late to learn and understand that we might have made a mistake by entering the country without permission, but in the end, we all have a special reason, and this does not mean we lose our rights or that we won’t run into someone who might give us the wrong legal advice, as was my case. But today I’m properly informed and, God willing, I’ll be able to continue with my life and stay together with my sons.”

ASESINADA EN HONDURAS LA LÍDER INDÍGENA BERTA CÁCERES, GANADORA DEL PREMIO AMBIENTAL GOLDMAN POR DEMOCRACY NOW, DEMOCRACYNOW.ORG

L

a líder indígena y activista ambiental hondureña Berta Cáceres fue asesinada en su casa en La Esperanza, su ciudad natal. Cáceres era una de las más destacadas activistas en favor de los derechos de los indígenas sobre la tierra en Honduras.

En 1993 cofundó el Consejo Cívico de Organizaciones Populares e Indígenas de Honduras (COPINH), organización que desde hace año enfrenta amenazas y represión.

Según Global Witness, Honduras se ha convertido en el país más peligroso del mundo para los defensores del medio ambiente. Entre 2010 y 2014, 101 activistas ambientales murieron en dicho país.

En 2015, Berta Cáceres ganó el Premio Ambiental Goldman, el máximo galardón mundial en temas ambientales. Al otorgar el premio, el comité del Premio Goldman declaró: “En un país donde la desigualdad socioeconómica y las violaciones a derechos humanos van en aumento, Berta Cáceres organizó a las comunidades indígenas lencas de Honduras y emprendió una campaña de base que logró presionar con éxito a la compañía constructora de represas más grande del mundo para que se retirase del proyecto de construcción de la represa de Agua Zarca”.

Cáseres apareció en un reporte de Democracy Now! sobre las elecciones presidenciales hondureñas de 2013, denunciando la represión y afirmando que “la política de Estado [en Honduras] es infundir terror y persecución política.

Con esto se busca castigar al pueblo hondureño para que no elija otro camino y para que no busque cambios en la situación económica, política y la militarización”.

Así mismo, en 2014 Democracy Now! entrevistó a Oliver Courtney, activista de Global Witness y autor del informe “Medio Ambiente Mortal: El dramático aumento de los asesinatos de defensores del Medio Ambiente y de

la Tierra”, quien afirmaba que “hay muy poca protección para estas personas. A menudo están operando y protestando en zonas remotas y muy peligrosas, y entrando en contacto con intereses muy poderosos y con importantes conexiones. Todo se reduce a que los gobiernos y las empresas se aseguren de que este problema se supervise mucho mejor y que los crímenes, cuando son descubiertos, sean procesados”.

A continuación reproducimos el comunicado del Comité de Familiares de Detenidos Desaparecidos de Honduras (COFADEH), distribuido por la organización SOA Watch.

El Comité de Familiares de Detenidos – Desaparecidos en Honduras, COFADEH, condena el asesinato político de la coordinadora general del COPINH, Bertha Cáceres, ocurrido aproximadamente a las 11:45 de la noche del miércoles 2 de marzo en La Esperanza, Intibucá, su ciudad natal.

Nos unimos en coro a las voces de indignación nacional que provoca este crimen, y hacemos nuestras las afirmaciones de sus familiares más próximos.

“Este es un hecho que ocurre en un gobierno despótico, porque ella se había movido a una casa de seguridad tratando de protegerse de los militares y los secuaces de los inversionistas de las represas de ríos que la buscaban para matarla por su lucha en defensa de la vida, de los pueblos indígenas y de las mujeres”. “Mataron a mi hermana por su lucha de frente después de sus denuncias de amenazas a muerte por esos malditos de DESA y SYNOHIDRO, que han asesinado a una luchadora sin guardaespaldas y que vivía sin riquezas ni ostentaciones, por eso hoy reclamamos a un Estado incapaz de cumplir las medidas de protección cautelar que tenía Bertita desde la OEA y de la ONU”. “Quieren asustar a la población con este crimen político cometido por sicarios de grupos fácticos ligados al Estado y al modelo económico en contra de una mujer que defendía a los bienes comunes de la naturaleza y que había resistido a la explotación de sus derechos ancestrales dentro de los territorios. Son responsables de este asesinato las fuerzas oscuras que han renunciado a la razón, al diálogo y hacen uso de la fuerza, la criminalización y el odio, y el gobierno tiene la obligación de investigar porque han enlutado al movimiento de mujeres y a los pueblos indígenas de Honduras”. “Con este asesinato de Bertha Cáceres hemos llegado al máximo nivel de indefensión en el país y así el nivel de seguridad de las personas e instituciones que luchan contra las transnacionales extractivistas, pasa a un nivel extremista. Por eso, suplicamos al gobierno de EEUU, a la ONU, a la MACCIH y a la comunidad internacional en general que conviertan la investigación de este asesinato en su máxima prioridad”. El COFADEH concluye esta primera comunicación con un llamado público a los bancos internacionales, a las financieras multilaterales y a los gobiernos que cesen su apoyo a esa coalianza perversa del sistema económico transnacional, las fuerzas militares, policiales y sicarios locales que asesinan a las y los defensores de los bienes de la naturaleza que pertenecen a los pueblos originarios.

Son excesivos los hechos violatorios reportados a este Comité desde los departamentos donde el Estado de Honduras ha concedido territorios a empresas represadoras, eólicas, mineras y arqueológicas, cuya característica principal es el uso de la violencia para imponer sus sucios negocios. ¡Esto debe parar ya!

Pregunta: Si yo soy víctimas de un crimen (y no tengo un estatus legal), ¿qué debería hacer?

Capitan BelCastro: El departamento de policía recomienda que todas las víctimas informen de cualquier crimen del que hayan sido víctimas. La denuncia de los delitos se puede hacer llamando al 911 en caso de emergencia, o bien lo pueden hacer marcando el teléfono 402-444-4877. Si usted lo prefiere puede acercarse con toda confianza a cualquier recepción del departamento de policía.

Pregunta: El departamento de policía respeta los derechos de los mexicanos que han sido víctimas de un crimen?

Capitan BelCastro: El departamento de policía se enorgullece de nuestras relaciones con la comunidad y quiere asegurarse de que nuestros miembros tienen una comunicación abierta y de confianza con nuestros oficiales de policía. HONDURAN INDIGENOUS LEADER BERTA CÁCERES ASSASSINATED, WON GOLDMAN ENVIRONMENTAL PRIZE

H

onduran indigenous and environmental organizer Berta Cáceres has been assassinated in her home. She was one of the leading organizers for indigenous land rights in Honduras.

In 1993 she co-founded the National Council of Popular and Indigenous Organizations of Honduras (COPINH). For years the group faced a series of threats and repression.

According to Global Witness, Honduras has become the deadliest country in the world for environmentalists. Between 2010 and 2014, 101 environmental campaigners were killed in the country.

In 2015 Berta Cáceres won the Goldman Environmental Prize, the world’s leading environmental award. In awarding the prize, the Goldman Prize committee said, “In a country with growing socioeconomic inequality and human rights violations, Berta Cáceres rallied the indigenous Lenca people of Honduras and waged a grassroots campaign that successfully pressured the world’s largest dam builder to pull out of the Agua Zarca Dam.” Statement from SOA Watch: HONDURAS–At approximately 11:45pm last night, the General Coordinator of COPINH, Berta Caceres was assassinated in her hometown of La Esperanza, Intibuca. At least two individuals broke down the door of the house where Berta was staying for the evening in

the Residencial La Líbano, shot and killed her. COPINH is urgently responding to this tragic situation.

Berta Cáceres is one of the leading indigenous activists in Honduras. She spent her life fighting in defense of indigenous rights, particularly to land and natural resources.

Cáceres, a Lenca woman, grew up during the violence that swept through Central America in the 1980s. Her mother, a midwife and social activist, took in and cared for refugees from El Salvador, teaching her young children the value of standing up for disenfranchised people.

Cáceres grew up to become a student activist and in 1993, she cofounded the National Council of Popular and Indigenous Organizations of Honduras (COPINH) to address the growing threats posed to Lenca communities by illegal logging, fight for their territorial rights and improve their livelihoods.

Berta Cáceres and COPINH have been accompanying various land struggles throughout western Honduras. In the last few weeks, violence and repression towards Berta Cáceres, COPINH, and the communities they support, had escalated. In Rio Blanco on February 20, 2016, Berta Cáceres, COPINH, and the community of Rio Blanco faced threats and repression as they carried out a peaceful action to protect the River Gualcarque against the construction of a hydroelectric dam by the

internationally-financed Honduran company DESA. As a result of COPINH’s work supporting the Rio Blanco struggle, Berta Cáceres had received countless threats against her life and was granted precautionary measures by the InterAmerican Commission for Human Rights.

On February 25, 2016, another Lenca community supported by COPINH in Guise, Intibuca was violently evicted and destroyed.

Since the 2009 military coup, that was carried out by graduates of the U.S. Army School of the Americas, Honduras has witnessed an explosive growth in environmentally destructive megaprojects that would displace indigenous communities. Almost 30 percent of the country’s land was earmarked for mining concessions, creating a demand for cheap energy to power future mining operations. To meet this need, the government approved hundreds of dam projects around the country, privatizing rivers, land, and uprooting communities. Repression of social movements and targeted assassinations are rampant. Honduras has the world’s highest murder rate. Honduran human rights organizations report there have been over 10,000 human rights violations by state security forces and impunity is the norm–most murders go unpunished. The Associated Press has repeatedly exposed ties between the Honduran police and death squads, while U.S. military training and aid for the Honduran security forces continues.

QUESTION: If I’m victims of a crime (and i dont have a legal status), what should I do?

CAPTAIN BELCASTRO: The police department recommends that ALL victims report their crimes. Crime reporting can be done by calling 911 for emergencies, the Telephone report unit at 402-444-4877 or by coming to any police department front desk.

QUESTION: The police department respects the rights of Mexicans who have been victims of a crime?

CAPTAIN BELCASTRO: The police department takes pride in our community relations and wants to ensure that our members have open communication and trust of our police officers. Public safety is real and we want to make certain that we not only know about crime and other quality of life issues but that we investigate them.

COMETER FRAUDE AL PRESENTAR SUS IMPUESTOS PUEDE AFECTAR GRAVEMENTE SU CONDICIÓN MIGRATORIA SEGÚN EXPLICÓ YANNINA STEFFES POR MARINA ROSADO

nualmente el 15 de abril marca la fecha límite para presentar la declaración anual de impuestos y Yannina Steffes en la oficina de Tax Plus Financial Services, está recibiendo a los contribuyentes que trabajaron durante el 2015, quienes por ley deben reportar todos sus ingresos.

Steffes tiene 12 años de experiencia en materia de impuestos y durante 25 años trabajó para la banca, siendo gerente de instituciones financieras. Junto a su esposo fundó Tax Plus Financial Services con el deseo de compartir sus conocimientos y educar a la comunidad hispana sobre sus finanzas.

Tax Plus Financial Services estuvo localizada cerca del sur de Omaha, pero hace tiempo se mudó a la zona centro, para atender más convenientemente a los numerosos clientes que llegan de otras ciudades aledañas.

Muchos de esos clientes son hispanos que desean procesar el Número de Identificación Personal del Contribuyente (ITIN, por sus siglas en inglés), que desde su creación en 1996 es asignado por el Servicio de Impuestos Internos (IRS) a los inmigrantes que desean reportar sus ingresos, pero que por su situación legal aún no son elegibles para tener un Número de Seguro Social.

“Tramitamos muchísimos ITINs – explicó Steffes -, y tenemos el orgullo de tener agentes de aceptación del gobierno en la oficina y eso significa que cuando el contribuyente viene con nosotros, el contribuyente o la esposa o el esposo no tienen que mandar sus documentos originales (actas de nacimiento o pasaporte) al gobierno y entonces se minimiza el riesgo de que puedan perder sus originales. Lo que hacemos nosotros es un estudio forénsico de la documentación, la aprobamos en la oficina y nosotros mismos transladamos ésa presentación al gobierno”.

Además de dicha ventaja, Tax Plus Financial Services se ha especializado en atender a nego-

cios hispanos, aunque el proceso para que éstos declaren sus impuestos es más extenso, sobre todo si los empresarios no tienen a un profesional que les lleve la contabilidad de sus gastos y el reporte de sus ganancias. En ése sentido, Steffes se enfrenta constantemente a un error muy común que consiste en no declarar algunas cantidades por considerarlas “pequeñas” y creer erróneamente que se pueden dejar hasta el siguiente año: “La ley del gobierno dice que todo el ingreso que recibes durante un año, lo vas a reportar durante ése mismo año”.

El desconocimiento entre la población hispana es muy frecuente y desafortunadamente “hay mucha actividad predatoria contra la comunidad hispana en las oficinas de impuestos, y estos son los casos mas frecuentes y más tristes que vemos”.

Casos en los cuales las personas deben contratar abogados para aclarar su situación pues han firmado sus declaraciones de impuestos sin revisarlas e incurriendo en fraudes que los dejan bajo la mira del gobierno, lo cual puede afectar su estatus migratorio si es que estaban en el proceso de obtener sus documentos de residencia.

“Estar en el país sin documentación legal es un crimen civil para lo cual existen perdones – señaló Steffes-, pero el hacer fraude en tu preparación de impuestos es un crimen federal, por lo cual no existen perdones”.

Argumentar ignorancia “no es defensa para el IRS”, por lo que Steffes aconseja informarse bien antes de acudir a cualquier oficina para realizar su declaración y no solamente creer que un preparador que promete un reembolso mayor, necesariamente está declarando lo que es más óptimo para cada persona dentro del marco legal: “Si nuestros impuestos están hechos correctamente, todos los preparadores deben arribar a la misma cifra”.

Llenar las formas con información falsa o incorrecta para obtener una cantidad mayor a toda costa, es una invitación al fraude: “Y cada

penalidad por intento de fraude es de 8 mil dólares. A parte, cuando el contribuyente firma (su declaración), está jurando que todo lo que está ahí es verdadero así que la responsabilidad (si se descubren anomalías) cae sobre el contribuyente no necesariamente ante el preparador, a menos que él ya esté siendo investigado”.

De ahí que Steffes haga énfasis en la necesidad de “siempre revisar los papeles, preguntar si se tienen dudas y especialmente, nunca firmar un documento federal, si no se comprende bien de qué se trata”.

Además de educar a la comunidad sobre el tema de los impuestos, Steffes así mismo se preocupa porque la gente aprenda a manejar sus finanzas pues como ella dice “hay personas que vienen a los Estados Unidos jovencitos y al final de su vida, después de muchos años de trabajo, cuando se quieren retirar a los 60 ó 70 años, descubren que están en la misma posición que cuando llegaron”, ya que nunca supieron cómo ahorrar para su jubilación ni cómo proteger a su familia en caso de fallecimiento.

RESULTADOS DEL CAUCUS DEMÓCRATA EN NEBRASKA Bernie Sanders ganó en Nebraska con 19,120 votos en 57.1 por ciento de los distritos electorales, contra 14,340 votos que recibió Hilary Clinton en 42.9 por ciento de los distritos electorales, durante el Caucus Demócrata, el pasado sábado, 5 de marzo.

De acuerdo con los resultados publicados por la Prensa Asociada, Sanders ganó el 54 por ciento del Condado de Douglas con 6,322 votos a favor, a comparación de Clinton con 5,387. En el Condado de Sarpy, Sanders obtuvo 1,620 votos a favor y Clinton obtuvo 1,099 votos. También, en el Condado de Lancaster, Sanders ganó 61.7 por ciento de los distritos electorales. Clinton ganó por un pequeño margen en condados como Dodge, Colfax, Platte, Polk y Gage.

El Caucus es menos formal que las elecciones primarias que se celebran en la mayoría de los estados. Vecinos se reúnen por precintos en escuelas públicas, centros para ancianos, y en iglesias, luego se dividen en grupos dependiendo de su preferencia con el candidato presidencial. Los representantes de cada campaña dan sus discursos para persuadir a los asistentes para que cambien de parecer y apoyen a su candidato. Los votos se usan para elegir delegados que representen a los candidatos presidenciales de la convención de condados y después de la convención del estado.

Las primarias republicanas en Nebraska se celebrarán el 10 de mayo durante las elecciones primarias, bajo las nuevas reglas de GOP, donde el ganador se queda con todo, diseñado para acortar el tiempo que lleva a los candidatos a ganar la nominación presidencial.

SESIÓN DE COMENTARIOS Y EVALUACIÓN PARA OPD El Departamento de Policía de Omaha tendrá una evaluación como parte del programa para lograr acreditación para verificar si cumple con los requisitos profesionales estándar.

Administrado por la Comisión en Acreditación para Agencias de Orden Público o CALEA, por sus siglas en inglés, el programa de acreditación requiere que las agencias cumplan con los estándares estatales en cuatro áreas básicas: políticas y procedimientos, administración, operaciones y servicios de apoyo.

A FRAUD ON YOUR TAX RETURN COULD GREATLY AFFECT YOUR MIGRATORY STATUS - YANNINA STEFFES

this, Steffes usually runs into a very common mistake where some people don’t declare some amounts because they consider them to be “too small” and believe they can declare them during the next year: “The law states that all income received during the year must be reported in the same year.”

A large part of the Latino population is unaware of this and, unfortunately, “there are a lot of cases against the Latino community at tax offices, and, unfortunately, those are the most common cases we see.”

Sometimes people even have to hire a lawyer to help them because they have signed tax returns without reviewing them and have committed a fraud that grabs the full attention of the government, and this can affect their migratory status if they were in the process of getting their residence documents.

“Being in the country without the proper legal documentation is a civil infraction for which there are pardons,” said Steffes, “but fraud on your tax return is a federal crime, and for that there are no pardons.”

Pleading ignorance “is not a valid defense before the IRS,” which is why Steffes advises that people properly inform themselves before they go to any office to work on their tax return, because they shouldn’t just believe the word of someone who promises a bigger tax refund for some reason: “If our taxes are done right, then all tax preparers should end up calculating the same amount.”

Completing the form with fake or wrong information to obtain a bigger return no matter what is an open invitation to fraud: “Each penalty for attempted fraud is $8,000.

On top of that, when the taxpayer signs it (his tax return), he/she is swearing that everything in that document is true, so if any anomalies are found, the taxpayer is the one

very year April 15 marks the deadline for tax returns, and Yannina Steffes of Tax Plus Financial Services is currently working with taxpayers who by law have to report their income.

Steffes has 12 years of experience on taxes, and she worked in banking for over 25 years, managing financial institutions. Along with her husband, she funded Tax Plus Financial Services with a desire to share her knowledge so that the Latino community could learn more about their finances.

Tax Plus Financial Services was first located close to South Omaha, but it later moved to the downtown area to work with the many clients who arrive from nearby cities.

Many of said clients are Latinos who wish to obtain an Individual Taxpayer Identification Number (ITIN), a code that, since its creation in 1996, has been assigned by the IRS to immigrants who want to report their income, but who due to their legal status are still not eligible for a Social Security number.

“We process many ITIN,” explained Steffes, “and we are proud to have government acceptance agents at our office. This means that when a taxpayer comes to us, the taxpayer or the wife or husband don’t have to send their original documents (birth certificate or passport) to the government, and this minimizes the risk of losing said original documentation. What we do is a forensic study of the documents, approve them at the office and we, in turn, inform this to the government.”

On top of said advantage, Tax Plus Financial Services has specialized in working with Latino businesses, although the process for them to present a tax return is a bit longer, especially if said entrepreneurs don’t have a professional taking care of their accounting to report their profits. responsible for everything, not the tax preparer, unless said individual is already under investigation.”

Because of this Steffes emphasizes the need to “always review all documents and present any questions you might have, especially if you don’t understand something since you’re signing a federal document.”

On top of educating the community on taxes, Steffes also works hard so that people learn how to handle their finances because “there are young people who come to the United States and, at the end of their life, after working for many years, they want to retire in their 60s or 70s, and they find out that they’re in the same spot as when they arrived here,” since they never learned how to save for their retirement or how to protect their family in case they pass away.

NEBRASKA DEMOCRATIC CAUCUS RESULT Bernie Sanders has won Nebraska with 19,120 votes and 57.1 percent of precincts against Hilary Clinton who got 14,340 votes and 42.9 percent of precincts, during the Democratic Caucus, last Saturday, March 5.

According to the results provided by the Associated Press, Sanders won 54 per cent of the precincts in Douglas County with 6,322 votes, against Clinton with 5,387. In Sarpy County, Sanders got 59.6 per cent of the precincts with 1,620 votes, against Clinton with 1,099. Also, in Lancaster County, Sanders won 61.7 per cent of the precincts.

Clinton won by a small margin on Counties like Dodge, Colfax, Platte, Polk, Saline and Gage.

The caucus is much less formal than the primaries held in most states. Neighbors gather together by precinct in public schools, senior centers, and houses of worship, then, separate into groups based on the presidential candidates they favor. Representatives from each presidential campaign typically give speeches and try to sway caucus-goers. The “votes” that are taken are used to then elect delegates representing the presidential candidates to the county convention and, later, the statewide convention.

The states that hold caucuses instead of primaries in addition to Iowa and Nebraska are Alaska, Colorado, Hawaii, Kansas, Kentucky, Maine, Minnesota, Nevada, North Dakota, Utah, Washington and Wyoming.

Candidates will seek to win delegates in each state contest to capture their party’s nomination for the presidency, during the caucuses and primaries.

The Nebraska Republican Primary will take place on May 10 during the primary elections, under the new GOP rules it is winner take-all for delegates, designed to shorten the length of time it takes a candidate to win the presidential nomination.

OPD ASSESSMENT AND PUBLIC COMMENT SESSION The Omaha Police Department is scheduled for an on-site assessment as part of a program to achieve accreditation by verifying it meets professional standards. Administered by the Commission on Accreditation for Law Enforcement Agencies, Inc., CALEA, the accreditation program requires agencies to comply with state-of-the-art standards in four basic areas: policy and procedures, administration, operations, and support services.

As part of the on-site assessment, agency employees and members of the community are invited to offer comments at a public information session Monday, April 4, at 6 p.m.

The session will be conducted in the Omaha Police Department Headquarters Auditorium located at 505 South 15 Street, Omaha, Nebraska.

Agency employees and the public are also invited to offer comments by calling 402.444.5612 on Tuesday, April 5, from 1:30 and 3:30 p.m. Comments will be taken by the Assessment Team.
