A

nualmente se entrega en la ciudad de Omaha una serie de galardones a profesionistas jóvenes que trabajan destacándose por su liderazgo, su pasión y compromiso comunitario. Se trata de los Jaycees, en cuya lista hoy brilla el nombre de un latino que ha hecho una carrera en la lucha por los derechos legales de los inmigrantes indocumentados: Emiliano Lerda, director ejecutivo de Justicia para Nuestros Vecinos.

Por más de 84 años, los premios Jaycees han honrado a personas entre las edades de 21 y 40 años que de manera ejemplar están mejorar la comunidad de Omaha, a través de actividades altruistas, al paralelo de una sobresaliente carrera profesional.

Para Emiliano, fue una sorpresa recibir la llamada telefónica que le anunciaba su candidatura, continuando luego con una serie de filtros en los cuales se destacó la entrevista personal con un panel evaluador de 9 jueces, para finalmente lograr figurar en la tradicional lista de los 10 galardonados.

No fue sorpresa enterarse que Lerda había cruzado los filtros sin problema, considerando la trayectoria profesional que ha cultivado en la ciudad. Tampoco fue sorpresa descubrir la calidez humana y el compromiso por el servicio social que abandera su personalidad, pues solo así uno puede entender el éxito que está logrando laboral, social y comunitariamente.

“En el 2011 comencé a trabajar en Justicia para Nuestros Vecinos, cuando solo éramos 3 empleados”, expuso Lerda, quien venia de trabajar en la asociación de productores de maíz del estado de Iowa.

Con las ganas de generar un impacto en su nuevo puesto, Emiliano enfrentó meses de incertidumbre ante el posible cierre de la organización, porque no eran muy fuertes a nivel organizacional. Sin embargo, su meta estaba planteada y sus ganas de servicio le sirvieron de motor para mantenerse con firmeza.

“Yo era nuevo en la comunidad de Omaha y no tenía la confianza de las fundaciones. Sin embargo, poco a poco el tiempo me permito ganármela, con ayuda de gente muy capaz que conocí y que se convirtieron en bendiciones, al formar parte de equipo de Justicia para Nuestros Vecinos”, dijo.

Determinado en lograr una organización de impacto social y comunitario, por encima de la sustentabilidad, comenzó atendiendo, junto con su equipo, 250 casos anuales.

Hoy, con una plantilla laboral de 19 personas, reportan haber ayudado en 2,600 casos, en el 2016.

De acuerdo con Emiliano, “el crecimiento se dio cuando las organizaciones interesadas en ayudarnos fueron evaluando el buen trabajo que estábamos realizando, aunado a las necesidades de la comunidad. Actualmente, prestamos

servicio a todo el estado de Nebraska y al sureste de Iowa, convencidos de que nuestro valor no está medido en base al número de casos que tenemos, sino en la responsabilidad moral de ayudar a cualquier inmigrante indocumentado”.

Esto fue parte de lo que reconocieron en Emiliano Lerda los directivos de los premios Jaycees, conocidos también como Omaha Junior Chamber of Commerce, por estar afiliados a la Cámara de Comercio Juvenil de los Estados Unidos y la Cámara Juvenil Internacional.

Hay que resaltar que esta es la organización de profesionistas jóvenes más antigua del área metropolitana de Omaha, encargada de crear líderes desde 1921. Cuenta actualmente con más de 100 agremiados, del condado de Douglas, Sarpy y condados circundantes.

Son una ventana para conectarse con profesionales de todo el mundo, porque tienen capítulos en más de 175 países, con gran variedad de campos profesionales.

Lerda tiene un bachillerado en ciencias de la comunicación, culminó la carrera de abogacía y una maestría en derecho.

Es esposo y padre de familia. Gustoso de las actividades al aire libre, en especial de las competencias de maratón.

Sencillo en su trato, firme en sus decisiones y análisis técnicos, amante del servicio social, comprometido con su profesión y latino de sangre y corazón. Hoy Emiliano no se conforma y busca seguir avanzando para lograr que el impacto de Justicia para Nuestros Vecinos llegue a un nuevo nivel.

Más aún, luego de recibir el premio citado. Porque como el mismo lo expresa: “Recibir este galardón ha sido diferente a los anteriores que eran otorgados como organización y hoy es directamente a mi persona, lo cual me deja con una fuerte responsabilidad al saber que las expectativas en mi trabajo serán más altas”.

Con humildad, Emiliano explica su éxito profesional diciendo: “Yo solo soy el resultado de todas las personas que en algún momento de mi vida decidieron ayudarme”.

Actualmente está enfocado en el nuevo plan estratégico de Justicia para nuestros vecinos, arrancando programas pilotos de ayuda.

“Seguiremos siendo una organización de servicios legales migratorios, pero creemos que en la ayuda legal migratoria que brindamos podemos también prestar servicios de insole familiar, laboral y de salud, para hacer un trabajo más integral. Y así lo haremos por los próximos tres años”, señalo.

De esta forma, Emiliano Lerda se sigue colocando en el ojo público, y comparte lo siguiente: “Como inmigrantes no debemos olvidar el privilegio que hemos tenido de estar en este país en el que podemos darle más oportunidades de éxito a nuestros hijos. Creo que todos podemos hacer algo para ayudar a los demás, porque en algún momento nosotros también hemos recibido ayuda de alguien. Además, creo que cuanto más das la vida te devuelve esos favores. Por lo pronto, todos los días yo sigo creciendo, desafiándome como persona y como profesional, buscando siempre la oportunidad de hacer algo que impacte a mi comunidad”.

E

very year a series of awards are bestowed in the city of Omaha to young professionals who excel thanks to their leadership, passion, and commitment to the community. They are the Jaycees, and today the name of Emiliano Lerda, a Latino individual who has worked hard to fight for the rights of undocumented immigrants, and Executive Director of Justice For Our Neighbors.

For over 84 years, the Jaycees have honored people between 21 and 40 years of age who

have done great work to improve the Omaha community through altruistic activities, along with having an outstanding professional career.

For Emiliano, receiving the call that announced he was up for the award was a surprise. After that, a series of review processes took place, including a personal interview before a panel of nine judges, and he finally ended up as part of the list of ten winners.

Con las nuevas prioridades establecidas por la administración Trump, los lugares donde las personas indocumentadas y documentadas corren el mayor riesgo no son tan predecibles como en el pasado; sin embargo, los lugares donde usted puede correr el mayor riesgo típicamente son: 1. Aeropuertos y fronteras porque necesariamente va a encontrarse con oficiales de inmigración si viene o viaja dentro de los EE.UU. 2. INTRODUCTION: While there is much uncertainty regarding the new President’s current and future immigration enforcement policies, the Guide provides information and resources on the following ways to assert your rights and protect yourself/your family, NOW:

Don’t panic, understand your rights, and don’t be afraid to assert 2. Know your options under the law by speaking to a qualified immigration attorney or DOJ representative; 3. Create a safety plan and be prepared in the event you are arrested, detained or removed; 4. Know that there are resources available and advocates standing with you in this time of uncertainty!

How Do You End Up in the Deportation Process?

With the new priorities in established by the Trump administration, places where undocumented and documented people run the most risk are not as predictable as in the past; however, the places where you may run the highest risk typically are: 1. Airports and borders because you are necessarily going to run into immigration officials if you are coming into or traveling within the U.S. 2. While trying to obtain immigration benefits, such as residency or citizenship. Do NOT apply for any immigration benefit without consulting with your immigration attorney or DOJ representative as you run the risk of being detained if you fall within the priorities mentioned above.

The priorities are very broad, so each and every person soliciting immigration benefits should consult with an immigration attorney or DOJ representative before submitting any immigration application.

3. Raids at home, work, or on the street. ICE agents can approach you at each one of these locations. Remember you have rights, regardless

of whether you are a U.S. Citizen, documented or undocumented person. Use them!

4. Courthouses and Jails. ICE agents can go to criminal courthouses to arrest undocumented or documented people who are a priority for enforcement, regardless of the charges being presented in your case. ICE agents are usually dressed in casual clothing and interact with the person they are looking for in the court hallways or inside the courtroom. When a documented or undocumented person is arrested, they are fingerprinted and this information is shared with ICE. If this person is deemed a priority for deportation, ICE requests transfer of the person or notice of when that person is released. In Nebraska, we have some counties who have refused to honor these ICE detainers, including: Douglas, Sarpy, Hall, and Lancaster counties. The policy of those counties may change in light of the new executive orders requesting cooperation of local and state police.

5. When stopped by the police. Pursuant to the new executive order, local and state police are encouraged to work in conjunction with ICE and enforce immigration law— that is, apprehend, detain, and investigate documented and undocumented immigrants who are a priority.

Where am I safe?

ICE has a policy that it will not enforce immigration actions (such as arrests, interviews, searches, or surveillance) in certain “sensitive locations” including: 1. Schools (including pre-schools, primary schools, secondary schools, post-secondary schools up to and including colleges and universities, and other institutions of learning such as vocational or trade schools); 2. Hospitals; 3. Churches, synagogues, mosques or other institutions of worship; 4. Site of a funeral, wedding, or other public religious ceremony; and 5. Public demonstration sites, such as marches, rallies, or parades.

Note: ICE should abide by this policy until repealed or contradicted by a future executive order. There is no guarantee that ICE will not search for you in the above-mentioned places.

It is also unclear whether or not the Trump administration’s new executive orders contradict or “repeal” this ICE policy. This is why it is so important that you know your rights when confronted with the Police or ICE regardless of where you are located.

Sanctuary Cities Sanctuary cities, counties, or states are jurisdictions that have adopted a policy of protecting undocumented immigrants by refusing to cooperate with ICE and federal immigration law in detaining, apprehending, or investigating undocumented immigrants.

No cities or counties in Nebraska have vowed to be sanctuary cities.

Also, the Trump administration has ordered that the Attorney General and DHS not provide Federal grants to sanctuary jurisdictions and vows to punish those jurisdictions that fail to work in conjunction with ICE. How to Know if You Are in Removal Proceedings or if You Have Been Deported?

If you have an immigration identification number, usually starts with an “A#” (located on an immigration document, work permit, or green card), you can check if you have been removed or if you have been deported by dialing the Executive Office for Immigration Review hotline at: 1(800) 898-7180. You will not be able to speak to a representative via this line.

CONSTITUTIONAL AMENDMENT FOR VOTER ID

MEXICAN CONSULATE states it is ready to defend Mexicans in Omaha

I

n a recent inauguration event at the Mexican Consulate in Omaha, Mexican Consul Guadalupe Sanchez Salazar had this to say: "We are ready and are capable of defending our fellow countrymen."

This happened during the inauguration of the "Centro de Defensoria" (Advocacy Center), a project from the Mexican government that is being replicated in all 50 Consulates to provide legal aid to Mexican immigrants in the United States.

The aforementioned initiative has been established due to the uncertainty generated by the changes from President Trump to immigration, changes that are hitting immigrants hard - immigrants among which there is a large number of Mexicans.

The Consulate called for a meeting of community leaders and other members who want to participate in helping vulnerable immigrants, and they all joined Consul Guadalupe Sanchez Salazar during the inauguration event.

Consul Sanchez talked about the goal of the Mexican government. It is a big public effort from the Consulate after months of actions against immigrants in Omaha and the rest of the country.

The task of the Advocacy Center is not an easy one considering the current immigration and deportation laws are constantly evolving.

The Mexican Consulate now has a bigger workload with hundreds of daily visits which are twice as large as the statistics for previous months.

Unfortunately, this means there's a need for more staff and more lawyers to provide legal aid for those who need it.

The legal panorama isn't clear even for those providing legal aid. Their availability and desire to help means they have to be ready for any chances on a day-to-day basis.

Emiliano Lerda, executive director for Justice for Our Neighbors, had this to say: "We have also seen an increase in the number of people who seek our legal services and we are ready to continue providing our support to the community with free legal aid."

Mariana Santa-Maria, supervisor of the Common Sense Parenting program at Boys Town Nebraska/Iowa, showed her solidarity with the Mexican's Consulate initiative.

In front of the uncertainty over the personal information that might be leaked to Immigration and Customs Enforcement agents, Santa-Maria said that, as is the case for the Mexican Consulate, "the information of our clients is confidential and protected. It will never be provided to anyone outside of our organization."

The meeting ended with a commitment from those in attendance for continuing to protect undocumented immigrants.

After the comments from experts, we can summarize things by saying that the best ally for us immigrants at this critical crossroad is knowing that we have human and process rights no matter our immigration status.

Unicameral lawmakers are looking to change the way Nebraskans vote. Senators listened to testimony last week on a proposed constitutional amendment, requiring voters to show identification before they cast their ballot.

Those in support say it's about keeping the election process safe from fraud, voting is a precious right and should be protected as such, and added that other states have actually seen increased voter turnout as a result of similar bills.

The measure is largely viewed as an attempt to suppress low-income and minority voting since there is almost no evidence of voter fraud. Those against the measure say there is not a voter fraud problem in Nebraska.

Jean During-Clinchard said the penalties are enough to discourage voter fraud, including being subject to a class4 felony, a fine of up to $10,000 and 5 years imprisonment.

Katie Larson, from the Heartland Workers Center, said she has been a bilingual poll worker in a primarily Hispanic community for 5 elections and she has never had any issues with voter fraud or voter impersonation, and never had any issues with an undocumented person or a person with legal resident status making an attempt to vote.

Gweldolen Hines added this would only make it more difficult for people to have their opinions heard by adding onerous voting restrictions.

The final product, if it makes it to the floor, will go on the general election ballot in November 2018. This bill does have a few more steps before you could see it on the ballot.

The committee must vote it to the floor - where all senators will get to have a say on it.

IMMIGRATION HELPLINE AT CONSULATE OF MEXICO The Mexican consulate in Omaha kicked-off its latest immigrant help plan last week. It’s part of a 50-state effort providing extensive free services, legal recommendations and informational seminars about Know Your Rights.

National Public Radio reported last week that the Government of Mexico assigned $16 million to diverse consulates in the US to support this program.

Among the help offered, there is an app for smartphones with essential information, MiCONSULMEX-SRE, and a 24-hour helpline, 855.463.6395, free of charge, from the information and help center CIAM. For more information, call the Consulate of Mexico to make an appointment at 402.595.1841. Their offices are located at 7444 Farnam St., Omaha, NE 68114.

NEW PROPOSAL TO DETER IMMIGRANT FAMILIES FROM CROSSING TO US Women and children crossing together illegally into the United States could be separated by U.S. authorities under a proposal being considered by the Department of Homeland Security, according to three government officials.

Part of the reason for the proposal is to deter mothers from migrating to the United States with their children, said the officials, who have been briefed on the proposal.

President Donald Trump has called for ending "catch and release," in which migrants who cross illegally are freed to live in the United States while awaiting legal proceedings.

The policy shift would allow the government to keep parents in custody while they contest deportation or wait for asylum hearings. Children would be put into protective custody with the Department of Health and Human Services, in the "least restrictive setting" until they can be taken into the care of a U.S. relative or state-sponsored guardian.

About 54,000 children and their guardians were apprehended between October 2016, and January 2017, more than double the number caught over the same time period a year earlier. Currently, a federal appeals court ruling bars prolonged child detention.

CONSULADO MEXICANO Se dice listo para defender a mexicanos en Omaha POR BERNARDO MONTOYA

E

n una resiente inauguración ocurrida en las instalaciones del consulado de México en Omaha, la titular del consulado, Guadalupe Sánchez Salazar, dijo: “Estamos listos y tenemos la capacidad para defender a nuestro compatriotas” Esto surgió tras una inauguración en la que se hizo oficial el “Centro de Defensoría”, un proyecto lanzado por el gobierno de México, replicado en los 50 consulados, con la finalidad de brindar orientación legal a los inmigrantes mexicanos en suelo estadounidense.

La iniciativa mencionada surge luego de la inquietud que están generando los cambios migratorios establecidos por el presidente Trump, cuya repercusión esta golpeando fuertemente a los inmigrantes, en los que se encuentra un gran número de población mexicana.

Se convocó por parte del consulado a una comitiva de líderes comunitarios y miembros participativos en pro a los inmigrantes en situación de vulnerabilidad, quienes acompañaron a la cónsul Guadalupe en la inauguración mencionada.

Hoy, Guadalupe Sanchez transmite la intención del gobierno mexicano.

Este es otro esfuerzo público y abierto que lanza el consulado, luego de meses de acciones en contra de inmigrantes en Omaha y el resto del país.

La tarea que se busca asumir con el Centro de Defensoría no vislumbra ser nada fácil, considerando que las actuales leyes migratorias y de deportación están en una evolución constante.

Actualmente, el consulado mexicano esta trabajo a un nivel mayor, por cientos de visitas diarias que duplican las cifras en comparación a meses pasados. Lamentablemente, esto supone un aumento aun mayor, lo cual se suma a la tarea asumida de defensora legal, exigiendo más personal, más infraestructura y abogados.

El panorama legal no esta claro incluso para los mismos miembros de la abogacía defensora. La disponibilidad y deseo de ayuda exige estar atentos diariamente a los nuevos cambios.

Emiliano Lerda, director ejecutivo de Justicia para Nuestro Vecinos, mencionó el respecto: “Nosotros también hemos tenido un incremento de personas que buscan nuestros servicios legales y estamos dispuestos a seguir apoyando a nuestra comunidad con servicios gratuitos en materia legal”.

Por su parte, Mariana Santa-Maria, supervisor del programa de sentido común para padres, de Boys Town Nebraska/Iowa, se mostró también solidaria a la iniciativa presentada por el consulado mexicano.

Ante la incertidumbre que se expuso sobre ver filtrada la información personal de los clientes que su institución maneja, por parte de los agentes de ICE, Santa-María dijo que, al igual que el consulado de México, “la información de nuestros clientes es confidencial y esta protegida . Jamás será puesta a disposición de ninguna persona ajena a nuestro organización”.

Al final, la reunión culminó con un compromiso de seguir avanzando el la protección de los inmigrantes indocumentados, por parte de los aliados presentes.

Tras la réplica difundida por expertos, se puede resumir que el mejor aliado del inmigrante en esta coyuntura crítica es saber que tenemos derechos humanos y procesales independientemente de nuestra condición migratoria. Conozcamos esos derechos.

ENMIENDA CONSTITUCIONAL PARA VOTAR CON IDENTIFICACIÓN La Cámara de Senadores está proponiendo en un cambio en la manera de votar en Nebraska. Los senadores escucharon varios testimonios la semana pasada sobre la propuesta de enmienda constitucional, la cual requerirá que los electores presenten una identificación para votar.

Las personas a favor que el ejercer el voto es un derecho muy apreciado y debería estar protegido contra el fraude. Agregaron que otros estados han incrementado la participación electoral como resultado de una propuesta similar.

Sin embargo, la mayoría ve esta medida como un intento de impedir que los electores de bajos ingresos y las minorías puedan ejercer su voto ya que no hay evidencia de fraude y no hay evidencias de un problema de fraude en Nebraska.

Jean During-Clinchard dijo que las multas eran suficientes para desalentar el fraude electoral, las que incluyen un cargo criminal clase 4, una multa hasta $10,000 y 5 años de cárcel.

Katie Larson, del Centro Laboral, dijo que en las pasadas 5 elecciones, donde ha participado como trabajador electoral dentro de las casillas, nunca ha presenciado que una persona sin documentos o con residencia legal atente participar con su voto en la elecciones.

Gweldolen Hines agregó que esta medida solo va hacer mas difícil escuchar la opinión de la gente, al agregar barreras o restricciones.

El producto final, si llega a ser escuchado en el salón del senado, será agregado en las boletas electorales de Noviembre 2018. El comité debe votar después de escuchar lo que los senadores tengan que decir sobre esta propuesta.

LÍNEA DE AYUDA EN INMIGRACIÓN DEL CONSULADO DE MÉXICO El Consulado de México en Omaha lanzó al público su reciente plan de ayuda en inmigración la semana pasada. Este plan forma parte del esfuerzo de 50 estados al promover extensos servicios legales gratuitos, recomendaciones y seminarios informativos sobre el conocimiento de derechos civiles.

La Radio Pública Nacional reportó la semana pasada que el Gobierno de México que asignó $16 millones de dólares a diversos consulados dentro de los Estados Unidos para apoyar el programa.

Entre los servicios que ofrecen, se encuentra una aplicación para teléfonos inteligentes con información esencial, MiCONSULMEX-SER, y una línea de ayuda 24 horas al día, 855.463.6395, libre de cargo, directa del centro de información y ayuda CIAM. NUEVA PROPUESTA PARA DESALENTAR EL CRUZE A LOS ESTADOS UNIDOS

Mujeres y niños al cruzar juntos ilegalmente la frontera de los Estados Unidos podían ser separados por autoridades, de acuerdo con una propuesta a consideración del Departamento de Seguridad Nacional.

Parte de la razón, es desalentar a las madres de inmigrar a los Estados Unidos con sus hijos, según fuentes oficiales.

El Presidente Trump ha pedido terminar con el “atrapar y dejar ir”, en el cual, quienes cruzan la frontera de forma ilegal son liberados para vivir dentro de los Estados Unidos hasta que llegue la fecha de su proceso.

La política podría permitir al gobierno detener a los padres mientras esperan proceso de deportación o asilo político. A los niños los pondrían bajo custodia del Departamento de Salud y Servicios Humanos, en un lugar “menos restringido” hasta que puedan ser enviados con sus familiares o guardianes en Estados Unidos.

Cerca de 54,000 niños y sus guardianes fueron aprendidos entre octubre del 2016 y enero del 2017, más del doble del número de detenidos en el mismo periodo el año anterior.

Actualmente una regulación del tribunal de apelación federal prohíbe la detención de menores de edad.

ita importante la que tiene el Real Benitez en su próxima fecha en Elkhorn, donde se verá las caras con el Deportivo de Pepe Mendez en busca de un triunfo que le permita acercarse a su objetivo de acabar entre los tres primeros y alejar de manera casi definitiva las posiciones de descenso.

Antes de jugarse este partido, aplazado de la jornada 11ª, son ocho los puntos que separan a los amarillos del 10º puesto y nueve si se registra un empate, por lo que la victoria cobra especial relevancia para poder afrontar el último tramo liguero con opciones reales de poder conseguir aún el objetivo trazado a inicio de temporada.

Por lo pronto, el Real Benitez rompió el pasado fin de semana su horrible racha de cinco derrotas seguidas, que en verdad eran seis incluyendo la polémica ante el Déportivo México de diciembre.

Futbolistas como Ramiro Tellez, Bryan Navarro, Álex Moreno, Jonas Sanaría, y Andres Borrego fueron titulares que dieron notoriedad al equipo en el pasado.

Sin embargo, abandonaron la cuadrilla por cuestiones educativas fuera de Omaha y hoy sigue sin lograrse un cuadro deportivo que permita recuperar con firmeza la gustada posición de liderazgo.

Pero, aún hay esperanzas y el juego no se termina hasta cerrarse la temporada.

El Deportivo no gana un juego precisamente desde que lo hizo el 21 de diciembre del año pasado ante el Chivas en la Copa (3-1). Una semana antes había derrotado a Omaha Unidos (2-0) y en el choque anterior, goleado a la Real Sociedad (5-1).

Hoy, su técnico dice tener mayor concentración de sus jugadores y dos nuevas promesas en la delantera que le habrán de permitir mejores lugares en la tabla.

Por lo pronto, nada queda escrito hasta ver los resultados de su próximo encuentro, el cual habrá de darles la última oportunidad de ascenso, considerando que ya están al limite de la cuerda floja, según evaluación de espertos en la materia.
