arece que la política pública en los Estados Unidos nos está llevando de nuevo a la época dorada,” dijo John Kretzschmar, Director del Instituto de Estudios Laborales William Brennan de la Universidad de Nebraska en Omaha ( UNO ), agregando “tiene que parar.” La oficina del Kretzschmar recientemente patrocinó la Conferencia anual Promoviendo el Bienestar General en el nuevo Centro de Enlace Comunitario en UNO. Robin Clark Bennett, graduada de Yale y actualmente educadora laboral en el Centro Laboral de la Universidad de Iowa cautivó a la audiencia durante la primera sesión plenaria. “Este es realmente un momento crítico e histórico para el tema de la reforma migratoria y la inmigración en nuestro país,” dijo Bennett. La educadora laboral señaló que el año pasado el Senado aprobó la legislación más radical sobre la reforma migratoria en medio siglo, pero por desgracia, esta legislación está atascada en la Cámara, junto con otras prioridades de trabajo.

Bennett añadió que ahora muchos estados están tomando sus propias medidas las cuales tienes diferentes efectos en todo los Estados Unidos.

“En algunos estados están tomando medidas que están devastando a los trabajadores y los derechos

laborales y en otros estados están aprobando legislación que fortalece los derechos de los trabajadores,” dijo Bennett. En algunos estados como Arizona están tomando medidas extremas para reprimir a los latinos. Hay estados que han tomado acciones extremas como eliminar los programas de educación cultural para los latinos y han aprobado legislación que discrimina a los hispanos.

Bennett señala que los Estados Unidos tiene una historia complicada con el tema de la inmigración y ahora es el momento de actuar. “Todos los que no somos de pura sangre nativos americanos venimos de otras tierras, todos somos inmigrantes, ya sea los trabajadores irlandeses y chinos de los ferrocarriles, trabajadores afroamericanos esclavizados que trabajaron en las plantaciones de algodón y tabaco, ya sea los filipinos, japoneses y mexicanos que son trabajadores agrícolas, gente de otras tierras construyeron la riqueza de esta nación,” dijo Bennett.

La educadora laboral señaló que se necesitan grandes fuerzas para dislocar a los inmigrantes de lo que conocen. “Se necesita pobreza, guerra y el hambre para forzar a la gente de dónde se encuentren,” según Bennett. Ella Agregó que los Estados Unidos es uno de los muchos países a los que la gente está huyendo para encontrar una vida mejor para sus

familias. Lamentablemente, los empleadores en los Estados Unidos han ganado una gran cantidad de poder en los últimos decenios en relación a los trabajadores. “El poder que tienen las corporaciones grandes en los Estados Unidos hace que sea muy fácil para que ellos abusen de los trabajadores inmigrantes que huyen de sus países de origen, en busca de un nivel de vida mejor.

Bennett indicó que el Centro de Pobreza Meridional documenta una gran cantidad de casos de abuso.

Un caso más reciente que apareció en los encabezados de los periódicos involucró la compañía Signal International . Después del huracán Katrina esta empresa contrató a soldadores de la India. “Les dijeron a la gente ‘si usted paga $ 14.000 para esta oportunidad, le daremos una tarjeta verde, un buen trabajo, una oportunidad para que su familia se asiente en los Estados Unidos,’” dijo Bennett. Añadió que una gran cantidad de trabajadores de la India pusieron hipotecas en su casa y pidieron dinero prestado para tomar ventaja de esta oportunidad, sin embargo “cuando llegaron a los Estados Unidos descubrieron que solamente se trataba de una visa temporal , no una tarjeta verde para quedarse, se les pagaba menos del salario mínimo y fueron alojados en un campamento de alambre de espino donde no tenían acceso a nin-

guna otra persona y fueron obligados a trabajar,” dijo Bennett . Ella agregó que estos trabajadores fueron atrapados y se enfrentaron a una situación que era “muy parecida a la esclavitud.”

La oradora señaló que ahora los empresarios tienen mucho poder y manipulan la policía federal para su propio beneficio. Cuando los trabajadores pelean por sus derechos y dicen que las normas de estas empresas son injustas y abusivas, estas empresas le llaman a ICE. “ICE se utiliza como un destructor de las uniones por los empleadores, para eliminar a los activistas que luchan contra las violaciones,” dijo Bennett.

Según Bennett, los Estados Unidos está invirtiendo más en la ley de inmigración que en el resto de la aplicación de ley federal combinada, más que el FBI, la CIA, la ATF. “En el 2012, gastamos un total de $ 18 mil millones en la ley de inmigración y $ 1.6 millones de dólares en la aplicación de las normas laborales,” según Bennett.

Bennett señaló que ha llegado el momento que los Estados Unidos tome medidas porque nuestros métodos actuales no están funcionando. “Necesitamos un camino claro a la ciudadanía. Tenemos que reforzar los derechos de los trabajadores derecho a través de leyes laborales,” concluyó Bennett.

“I

t seems that public policy in the United States is taking us back to the gilded age,” said John Kretzschmar, Director of the William Brennan Institute for Labor Studies at the University of Nebraska at Omaha (UNO), adding “that has to stop.” Kretzschmar’s office recently sponsored Promoting the General Welfare Annual Conference at the new Community Engagement Center at UNO. Robin Clark Bennett, a Yale graduate and currently a labor educator at the University of Iowa’s Labor Center captivated the conference’s audience during the first plenary session. “This is really a critical and historic moment for the issue of immigration and immigration reform in our country,” said Bennett. The labor educator pointed out that just last year the Senate passed the most sweeping major legislation on immigration reform in half a century, but unfortunately it is in a log jam in the House along with other labor priorities. Bennett added that now many states are taking action of their own and it is having a lot of different effects all over the United States.

“In some states they are taking actions that are devastating for workers and labor rights, and in other states they are passing legislation that strengthens workers’ rights,” said Bennett.

Some states like Arizona are taking extreme steps to suppress Latinos. States have gone as far as eliminating cultural education programs for Latinos and passed legislation that discriminates against Hispanics.

Bennett points out that the United States has a complicated history with the issue of immigration and now is the time to take action. “All of us who are not full blooded Native Americans came from other lands, we are all immigrants, so whether that is Irish and Chinese railroad workers, enslaved African American workers who were working on cotton and tobacco plantations, whether that’s Filipino, Japanese and Mexican agricultural workers people from other lands built the wealth of this nation,” said Bennett.

The labor educator pointed out that it takes big forces to dislocate immigrants from what they know. “It takes poverty, war, and famine to force people out of where they are,” according to Bennett. She added that the United States is

just one of many countries where people are fleeing to find a better life for their families.

“Sadly, employers in the United States have gained a lot of power over the last few decades relative to workers.” The power big corporations have in the United States makes it very easy for them to abuse immigrant workers who are fleeing their native countries in search of a better standard of living.

Bennett indicated that The Southern Poverty Law Center documents a lot of cases of abuse.

A more recent case that made the headlines involved the company Signal International. After Hurricane Katrina this company recruited welders from India. “They told people ‘if you pay $14,000 for this opportunity we will give you a green card, a good job, a chance for your family to settle,’” said Bennett. She added that a lot of workers from India mortgaged their homes and even borrowed money to take advantage of this opportunity, however “When they came what they found out was that it was a temporary visa, not a green card to stay, they were paid less than minimum wage and housed in a barbed wired encampment without access to anyone else and

forced to work,” said Bennett, adding that these workers were stuck and faced a situation that was “very close to slavery.”

The speaker pointed out that in this day and age employers have a lot over people’s head and they manipulate federal law enforcement to their advantage. When workers speak up and call these companies out on their unfair and abusive standards they will call ICE on themselves. “ICE is used as a union buster by employers to weed out activists that are fighting against violations,” said Bennett.

According to Bennett the United States is investing more in immigration enforcement than in all other federal law enforcement combined, more than the FBI, CIA, ATF. “In 2012, we spent a total of $18 billion on immigration enforcement and $1.6 billion on labor standards enforcement,” according to Bennett.

Bennett pointed out that the time has come for the United States to take action because our current methods are not working. “We need a clear path to citizenship. We need to strengthen workers right through labor laws,” concluded Bennett.

“Falta de Información” Detiene a Inmigrantes Indocumentados Elegibles de Comenzar su Proceso de DACA

ynthia Tejeda se encontraba nerviosa y ansiosa mientras esperaba en línea en el Consulado Mexicano de Los Ángeles para hablar con un abogado de inmigración.

Originaria de Cuernavaca, Morelos México, Tejeda llegó a EE.UU. a la edad de nueve años, lo cual posiblemente la hace elegible para protección ante una deportación mediante un programa que permite a jóvenes indocumentados quedarse en el país temporalmente y con un estatus regularizado.

En 2012, el presidente Obama expidió una orden ejecutiva que es el programa de acción diferida para los llegados en la infancia o DACA el cual permite a inmigrantes indocumentados que califiquen bajo ciertos criterios, el permanecer en el país sin miedo a la deportación por dos años y a recibir un permiso de trabajo, sujeto a renovación.

Entre los requisitos el solicitante debe haber llegado a EE.UU. antes de cumplir 16 años y ser menor de 31 años en junio 15, 2012, fecha cuando se firmó la orden.

Tejeda, 27, le dijo a EGP que al principio ella se sintió “triste e impotente” por no tener dinero para comenzar su solicitud de DACA. Como madre soltera, el dinero que gana trabajando de mesera es para la manutención de sus 3 niños de 9, 2 y 1 años.

Tejeda es una de los aproximadamente 1.6 millones de inmigrantes indocumentados que se cree son elegibles para recibir el estatus de acción diferida. Sin embargo, de acuerdo a información de la oficina de Servicios de Ciudadanía e Inmigración de EE.UU. (USCIS), hasta el momento menos de la mitad han solicitado.

La semana pasada, el Consulado Mexicano en Los Ángeles ofreció un seminario para proveer información a quienes probablemente fueran elegibles y de tener la documentación correcta, comenzarían el proceso. Diecisiete abogados de inmigración ofrecieron ayuda gratuita, lo cual incluyó revisión de documentos para saber si tenían todo en regla o les faltaba algo.

Carlos M. Sada, Cónsul Mexicano General en Los Ángeles, le dijo a EGP que la falta de información, miedo a la deportación y “falta de recursos económicos” son motivos que han detenido a muchos jóvenes de comenzar el proceso. Algunos inclusive, temen que al llenar la solicitud su información pueda llegar a oficiales de inmigración

quienes podrían deportarlos [a ellos y/o a sus familiares] si su solicitud es negada.

Aparte de los requisitos de edad, los solicitantes deben mostrar evidencias de que ellos han estado en el país continuamente desde el 2007 o entraron a EE.UU. antes del 15 de junio del 2012 y estaban presentes en el país cuando la orden ejecutiva fue firmada; asisten a la preparatoria o se han graduado u obtuvieron un certificado de GED; no han cometido ninguna felonía o daños menores y no son una amenaza para el país; o veteranos honorables de las fuerzas armadas.

El estar informado de cuales son los documentos necesarios o considerados validos para demostrar elegibilidad es muy importante para completar el proceso, según dicen los abogados.

Y tener el dinero completo para los gastos de la solicitud.

Ahora, después de casi dos años de ahorrar, Tejeda pudo juntar los $465 necesarios para mandar su solicitud. Se sentía esperanzada de que pronto tendrá un permiso de trabajo, seguro social y una licencia de conducir.

“De verdad puedo ver un antes y un después con mis papeles”, Tejeda le dijo a EGP sobre la posibilidad que después de casi 19 años de vivir en el país indocumentada ya no tendrá que temer.

“Ahora si puedo estudiar…y darle una vida mejor a mis hijos”, dijo ella con lagrimas a punto de salir de sus ojos al no poder contener la felicidad.

Posiblemente Tejeda hubiera sido elegible para obtener ayuda financiera que le hubiera permitido mandar su solicitud mucho antes.

Sada le dijo a EGP que el Consulado Mexicano ofrece “hasta $1,000” para ayudar a mexicanos indocumentados para pagar sus tramites de abogado y USCIS, si no tienen recursos económicos disponibles.

“Es un esfuerzo que tratamos de hacer lo más permanente posible en la medida de los recursos que tengamos disponibles”, dijo Sada. “Los últimos dos años, 2012 y 2013, se han destinado $250 mil del gobierno federal [mexicano] para apoyar estos casos, por supuesto, siempre y cuando el muchacho no pueda realizar ese gasto”, agregó.

El Departamento de Protección del Consulado General, encargados de los recursos para DACA, le dijo a EGP vía email que hasta el momento el Consulado Mexicano ha ayudado a 261 jóvenes a pagar sus costos y actualmente están trabajando con seis

organizaciones no gubernamentales en México, para recaudar fondos y poder ayudar a más estudiantes.

Los solicitantes deben proveer información de cada año que han vivido en el país. Y cada año que pasa se vuelve mas difícil porque hay que agregar más documentos a la solicitud. Muchas veces las solicitudes son negadas o se demoran porque el solicitante no proveyó “evidencia suficiente de presencia continua” en el país, Nora E. Phillips abogada de inmigración le dijo a EGP. “Deben demostrar que han estado en Estados Unidos desde el 15 de Junio, 2007 hasta el presente, incluyendo junio 15 del 2012”, dijo Phillips. Mientras más tiempo pasa, más difícil se convierte el proceso, agregó.

“Muchos de ellos [solicitantes de DACA] vienen con muchos documentos y otros vienen sin nada”, dijo Phillips. Los abogados comienzan la solicitud con la información requerida pero quienes están faltos de documentos “les hacemos una accesoria rápida y los referimos a abogados de organizaciones no lucrativas” para que les ayuden más adelante, dijo.

De acuerdo a los últimos números de USCIS, hasta el 6 de febrero de este año, 521,815 solicitudes se han aprobado. De esas, 403,302 son inmigrantes de México, seguidos por 19,089 salvadoreños, 12,339 hondureños y 12, 410 guatemaltecos.

De acuerdo a la página de Internet de USCIS, cualquier individuo que cumpla con los requisitos para la solicitud de DACA es elegible para acción diferida aunque estén “en proceso de deportación con una orden final o con una orden de salida voluntaria, siempre y cuando no estén [ya] en un centro de detención”.

USCIS también menciona que es muy poco probable que individuos que solicitan, pero no son aprobados para acción diferida, sean deportados. “Si el caso no involucra ofensa criminal, fraude, o una amenaza para la seguridad nacional o seguridad publica, éste no será referido a ICE para proceso de deportación”, de acuerdo a USCIS. LACK OF INFORMATION AND FUNDS KEEPS DACA APPLICATIONS LOW

C

ynthia Tejeda was both nervous and hopeful as she waited in a long line at the Mexican Consulate Office in Los Angeles, last week, to speak with an immigration attorney.

Originally from Cuernavaca, Morelos Mexico, Tejeda was brought to the U.S. illegally by her parents when she was just 9-years-old, which could mean she is eligible for a reprieve from deportation through a special program that allows undocumented immigrants like her to stay in the country, at least temporarily.

In 2012, President Obama issued an executive order creating the Deferred Action Childhood Arrival or DACA program that allows undocumented immigrants who meet certain criteria to remain in the country without fear of deportation for two years, subject to renewal, and to receive a work permit. Among the requirements, the applicant must have entered the U.S. before his or her 16th birthday, and was under the age of 31 on June 15, 2012, the date the order was signed.

Tejeda, 27, told EGP she at first felt “helpless and sad” because she did not have the money to apply for DACA. The single mother said all the money she earns as a waitress goes to support her three children, ages 9, 2 and 1.

Tejeda is one of the approximately 1.6 million undocumented individuals who immigration officials believe are eligible to receive deferred action status. However, according to U.S. Citizenship and Immigration Services (USCIS) data, fewer than half of those who may qualify have applied.

Last week, the Mexican Consulate in Los Angeles opened its doors to would-be applicants, to help them with the process. Seventeen immigration attorneys provided free assistance, which at times included sifting through stacks of paperwork, only to discover that key records were missing or incomplete.

Carlos M. Sada, Mexican Consul General in Los Angeles, told EGP that a lack of information, fear of deportation and insufficient “economic resources” has kept many from applying. Some worry filing the application will lead immigration officials right to them and they will be deported, if their application is denied.

In addition to the age requirements, applicants must provide proof that they have been in the country continuously since 2007, and in the U.S. on June 15, 2012, the day the executive order was signed; are in high school, have graduated or earned a GED certificate; have not been convicted of a felony or serious misdemeanors, or pose a criminal threat to the country; or have been honorably discharged from the military.

Knowing what documents are required or considered acceptable for proving eligibility, is crucial to completing the process successfully, say attorneys. So is having the money to pay the application fee. After nearly two years of saving, Tejeda finally has the $465 she needs to file her application. She is hopeful that she will soon have a work permit, social security number and a driver’s license, as a result.

“I can really see a before and after with these documents,” Tejeda told EGP, referring to the pos-

sibility that after 19 year of being undocumented, she may no longer have to be afraid.

“I can finally study … provide a better life for my children,” she said, her eyes filling with tears as her emotions start to get the better of her.

But it’s possible that Tejeda was eligible for financial assistance that would have allowed her to apply much earlier.

Sada said the Mexican Consulate offers “up to $1,000” to help undocumented Mexicans pay attorney and USCIS fees, if they have no other resources.

“It is an effort that we are trying”… “for as long as we have available resources,” Sada told EGP. “In the past two years, 2012 and 2013, we allocated $250,000” to support cases where “the young one can’t afford the expense,” Sada explained.

Mexico’s Departamento de Protección (Department of Protection) told EGP via email that the Mexican Consulate has so far helped 261 Mexican students pay their fees. They are currently working with six nonprofit organizations in Mexico to raise money to help more students.

Applicants must provide proof for every year they claim to have been in the country. Each year that goes by means more documentation that must accompany the application. Many times applications are denied or delayed because the applicant did not provide “sufficient evidence of continuous presence” in the country, immigration Attorney, Nora E. Phillips, told EGP last week while assisting applicants at the Consulate’s workshop.

“You have to prove you have been in the U.S. since June 15, 2007 until the present, including June 15, 2012,” Phillips said. The more time that passes, the more difficult the process becomes, she said.

“A lot of them [DACA applicants] came with a lot of documents and a lot of them came with nothing,” she said. We start the application for those with the information required, but for those who do not have what they need, “we do a quick screening and refer them to attorneys at nonprofit organizations” for further help, she said.

According to USCIS’ latest numbers, as of Feb. 6 of this year, 521,815 applications have been approved. Of those, 403,302 were immigrants from Mexico, followed by 19,089 Salvadorians, 12,339 Hondurans and 12,410 Guatemalans.

According to the USCIS website, any individual who meets the DACA requirements is eligible for deferred status even if they are “in removal proceedings with a final order or with a voluntary departure order, as long as they are not [already] in immigration detention.”

USCIS also states that it is very unlikely individuals who apply, but are not granted deferred action, will be deported. “If your case does not involve a criminal offense, fraud, or a threat to national security or public safety, your case will not be referred to ICE for removal proceedings,” according to USCIS. “PAINTING IS LIKE MAKING A MOVIE,” SAID

or Filipino painter Jesse Medina, each day starts with a nice cup of tea: “It doesn’t matter which one. It can be green tea or any other type, but it’s the first thing I do to relax before I paint so that I can make the most of the available daylight.”

Originally from Manila, Medina arrived at the United States for the first time in the early 90s: “My idea was to find a city where I could live in order to develop my painting technique, and at first I ended up in San Diego. After that, I moved to Florida for a few years, and I then moved to Omaha, eventually settling at Council Bluffs (Iowa).”

Since 2010, Medina has lived at the historic Harvester belonging to Artspace, the non-profit organization that supports the art community with affordable housing, where artistic skills flourish.

With a calm voice, and a big laugh here and there, Medina explained that he’s the youngest member in his family, and even though some of his brothers pursued careers such as architecture and advertising, he’s the only one that found a way to express his emotions by painting: “I like to capture everything that gets my attention: landscapes, figures, people and animals, and then mix everything on the canvas.”

A fan of Filipino artists such as Juan Luna (18571899), whose sculptures and paintings are treasured at the National Museum of the Philippines and at the Metropolitan Museum of Manila, and of outstanding muralist Carlos Francisco (“Botong Fran-

cisco,” 1912-1969), Medina acknowledged that his work is also influenced by impressionist painters.

“I started to paint when I was in high school, so I’ve been doing this for 27 years now,” said Medina, while I browsed the thick album that documents the talented artist’s career, whose life changed when he won a national contest in his home country, where the first prize was a trip to Singapore.

One can’t deny the artist’s skills, and it’s easy to admire his work at his home where many pieces hang from the walls, as is the case of “Diwata” that evokes Philippine mythology, and which Medina illustrated in three 48x36 inch panels: “They’re oil paintings, and they took me months to paint because of the media since it takes a while to dry, thus making it a slow process.”

Another interesting piece is “El sueño de Dorothy” (Dorothy’s Dream), an oil painting based on the main character of the Wizard of Oz, which Medina started as a commission piece, but in the end a smaller piece in watercolors was delivered: “I don’t like to paint under the pressure of meeting a deadline, and even though I don’t like to work on commissions, there are some advantages to knowing what I need to create while, at the same time, having the freedom to create my own design in order to get there.”

What Medina definitely does not like, is selling his art: “For me, it’s very hard to put a price on my work, since I don’t create my art so that I can sell it, because painting is my life.”

Local Volunteer Opportunity

With this philosophy, Medina has participated in several community art projects, and one of his outstanding projects is the set of three benches showcased at different areas of Omaha, where he collaborated with a diverse range of writers, as is the case of Connie Lehman with whom he collaborated to interpret her motivational phrase “Put yourself in Motion to LIVE.” As I admire a statue made of wood that represents the Holy Family, which is next to beautiful paints of characters from Alice in Wonderland, several selfportraits, and of various drawings that showcase his great sensibility when drawing the human anatomy, Medina confessed: “I believe that I became a painter very late in this day and age because I like to paint the old-fashioned way, with brushes and canvas, without using technology to create my designs. Now that graphic designers have so many tools, I think this profession is slowly being left behind.”

Medina would never trade the chance to communicate his ideas with his paintings: “Painting is like making a movie, and when I paint I think like a director making a film, taking the time to choose each character for the story before I capture everything on canvas, the setting where I carefully select what goes where, and which will serve as a backdrop for everything.”

NOTICE TO THE PUBLIC Public Notice of Availability of City of Omaha Consolidated Plan Performance Reports including the CDBG, HOME, and ESG, Programs for FY 2013 On March 31, 2014, the City of Omaha submitted to the U.S. Department of Housing and Urban Development, the Consolidated Plan performance reports summarizing the City’s activities under the following programs during the 2013 fiscal year: 1) Community Development Block Grant (CDBG); 2) HOME Investment Partnerships (HOME); and 3) Emergency Shelter Grant (ESG). These reports summarize the City’s activities, accomplishments, and expenditures under these programs from January 1, 2013 through December 31, 2013. Activities were related to Neighborhood Development, Economic Development, Public Services and Facilities, Emergency Shelter Operations and Services, and Program Administration. These reports will be available for inspection at the City Planning Department, 1819 Farnam Street, Suite 1111, during regular business hours as of April 3, 2014.
