he Pfizer-BioNTech COVID-19 vaccine that arrived in Puerto Rico on Monday will begin to be administered today in stages starting with health staff at hospitals and emergency personnel. Despite the fact that the COVID-19 vaccine will have no cost to the population, the Health Insurance Administration (ASES by its Spanish acronym) ruled that health care providers or doctors will have the right to bill for administering the injection. ASES Executive Director Jorge Malva said “providers will have the right to bill for application services, which includes not only inoculation, but also specific information on the preservation of the vaccine, patient orientation and tracking to allow the second dose.” Gov. Wanda Vázquez Garced said the vaccine will be distributed to the 65 hospitals in Puerto Rico, and will be administered Tuesday following what is stipulated by the U.S. Department of Health and Human Services. Her remarks were made after Ashford Presbyterian Hospital issued a statement Monday saying officials were going to start inoculation of hospital staff and doctors that same day. Later, the hospital’s manager of digital and social media, Jeffrey Martínez, retracted the statements, saying the vaccinations were going to start today. The STAR learned that doctors in private practice who also treat COVID-19 patients were unhappy because they will not be among the first to be vaccinated, but Víctor Ramos, president of the Physicians & Surgeons Association, said they will be among the first. He said the plan is to administer the vaccine in phases. In the first phase, the government will first vaccinate health professionals, hospital workers and emergency response workers, as well as people who work and live in shelters, nursing homes, and long-term care centers. Stage B of the first phase of the vaccination will first cover police officers, first responders, Department of Education employees and essential workers. Stage C of the first phase will cover individuals with chronic diseases such as diabetics, people with respiratory problems or heart conditions, kidney patients, and those whose immune systems are delicate. The second phase of the vaccination will cover people over 16 years of age and without health problems or pre-existing conditions. According to the established plan, this phase, which includes the majority of the population, would extend into the summer months. “The rest of the population is expected to undergo vaccination in three weeks,” Ramos said. Ramos said the vaccine, which will be administered

in all individuals over the age of 16, is safe. “Children will be vaccinated later, but there is evidence that the disease is mild in most children,” he said. Regarding the statements made by ASES, Ramos said health care plans will pay for the vaccine and that doctors have to charge for the inoculation because “they have to pay for the nurses and the record keeping.” “We charge for all other innoculations too,” he said. The Physicians & Surgeons Association will not only send out doctors to administer the vaccine, but may also use its own facilities to inoculate the population. ASES decided to establish a fixed rate for the different vaccines and dosages. The administration of the first and second doses of the Pfizer-BioNTech vaccine will cost $16.94 and $28.39, respectively. If the use of Moderna’s vaccine is approved, the cost will be the same. On Monday the governor held a meeting with Deputy Health Secretary and Incident Chief Commander Iris Cardona, Puerto Rico National Guard Adj. Gen. José J. Reyes, Puerto Rico Hospitals Association Executive Director Jaime Plá, and staff from Walgreens and CVS pharmacies to fine-tune immunization details. “All of us, both the government and the private sector and non-profit organizations, are working together to be able to distribute and administer the vaccines in order to eradicate this virus,” Vázquez Garced said. “That is everyone’s goal: to end COVID-19.” “From the beginning the people were told that it is to be an orderly process. At today’s meeting, where all the logistics components were present, it was agreed that, as part of the established plan, the vaccination would begin tomorrow, Tuesday, as also provided by the federal Department of Health [and Human Services],” the governor added. “We want the people to see the vaccination and have it give them confidence. This is a process of education and prevention.”

Employees of HIMA-San Pablo Hospital in Caguas demand Christmas bonus By THE STAR STAFF

mployees of the HIMA-San Pablo Hospital in Caguas on Monday demanded the payment of the Christmas bonus that the administration refuses to pay in a year marked by the coronavirus pandemic and by the tireless work done by health professionals. “Today the employees of the HIMA-San Pablo de Caguas hospital took to the streets to demand from this abusive and insensitive administration the payment of the Christmas bonus, which is so much deserved by these health professionals who during this year have worked tirelessly on the front lines of the battle against the coronavirus pandemic,” said Gerson Guzmán López, president of the General Workers Union (UGT by its Spanish initials), which represents hospital employees. Guzmán López said the hospital administration also “wants to eliminate rights and benefits for hospital employees.” “The pettiness of this employer is so great that it wants to eliminate

more benefits to these professionals who give everything for the health of all the patients who visit this hospital every day,” he added. The union leader stated that the union he leads has been negotiating for four months and 14 sessions with the HIMA-San Pablo administration, where the UGT Negotiating Committee has shown the greatest flexibility and openness. “Since September we have proposed to the employer, considering the extraordinary situation that the country is experiencing in the face of the coronavirus pandemic, to extend the current agreement for one year, under the same conditions, but to this day the response that we continue to receive from our proposals is the total resistance of the employer to agree to improvements in terms and conditions of employment,” Guzmán López emphasized. “In addition to this, the HIMA administration has not requested Hazard Pay as other hospitals such as Mutual Aid, San Lucas, Presbyterian and others have correctly done,” he said.

Island hospitals to receive $40 million as incentive for frontline health professionals By THE STAR STAFF

ome $40 million has been earmarked for assistance programs for public and private hospitals on the island under the federal Coronavirus Aid, Relief, and Economic Security (CARES) Act, Gov. Wanda Vázquez Garced and Omar Marrero, executive director of the Puerto Rico Fiscal Agency and Financial Advisory Authority (AAFAF by its Spanish initials), announced Monday. Vázquez said the authorized allocation is for hospital institutions to implement an incentive payment program for assumed risks or “hazard pay” to health professionals, who continue to be exposed to the novel coronavirus, which causes COVID-19. “We continue to do justice to our healthcare professionals. Once again, we recognize their sacrifice, as they are the ones who fight COVID-19 every day,” Vázquez said in a written communication. “With these allocations, the Private Hospitals Governor Wanda Vázquez

Assistance Program has received $315 million through the CARES Act and public hospitals $75 million.” Marrero Díaz noted that hospitals are responsible for implementing incentive programs for assumed risks and for determining which employees will be part of the program. However, those employees have to be first responders who perform functions that expose them to risk of infection from COVID-19. The head of AAFAF said $15 million will be allocated to the Private Hospitals Assistance Program and an additional $25 million to the Public Hospitals Assistance Program. “Our administration has made it its mission to provide the necessary tools to our hospitals and other economic sectors that fight daily against the pandemic,” Marrero Díaz said. “This management has been reflected in the operations of all the hospitals in Puerto Rico that have maintained uninterrupted service of excellence.”

Restaurants Assn. asks gov’t for CARES Act-funded relief By JOHN McPHAUL jpmcphaul@gmail.com

iting the severe impact of the measures taken locally to control the COVID-19 pandemic, the Puerto Rico Restaurants Association (ASORE by its Spanish initials) on Monday asked the island government to consider and approve a proposal presented in October by ASORE to create a new assistance program or incentives for the industry using federal funds from the Coronavirus Aid, Relief, and Economic Security (CARES) Act. “Certainly, the industry is increasingly hurt as a result of this pandemic and the more restrictions there are, the more it will be affected,” said Gadiel Lebrón, ASORE’s executive director. “Faced with this reality, we presented a proposal on Oct. 3 to the state government to use existing funds from the CARES Act, as other states have done, to give aid to the industry and be able to pay for the extraordinary operating expenses generated by the COVID-19 emergency. Likewise, we

refer the proposal to the resident commissioner Jenniffer González, who recently let us know that AAFAF [as the commonwealth Fiscal Agency and Financial Advisory Authority is known by its Spanish initials] is evaluating our request and there should be a response in the next few days.” According to the response from Resident Commissioner Jenniffer González Colón, sent directly to Gov. Wanda Vázquez Garced, it is necessary for the AAFAF to respond quickly, since federal funds from the Coronavirus Relief Fund expire on Dec. 31. So the time for approving and managing the use of the funds is limited. “Without a doubt, the new restrictions make this request one of greater urgency for our industry. The biggest concern we have at the moment is the jobs that may be lost, as we understand that after the current executive order many restaurants will not be able to bear the burden and will have no other option but to close their doors,” Lebrón said. “Our industry is one of the largest job generators on

the island, but some 30,000 jobs have already been lost; therefore, we do not want that loss to continue to increase.” ASORE’s proposal is focused on receiving aid that can be used to cover the cost of the measures taken by restaurants related to protection measures within the facilities, and the purchase of disinfection and protection equipment to guarantee the health of employees and diners.

According to the most recent survey of ASORE members, 40 percent of restaurants have experienced a drop of more than 50 percent in sales. Notably, the vast majority of restaurant owners and operators (98 percent) have invested in health safety supplies and technology to protect their employees and customers from COVID-19. The cost of that investment is estimated at between $5,000 and $25,000.

ith the purpose of helping ensure that those who have scheduled trips to Puerto Rico do so in a safe and responsible manner, the Puerto Rico Tourism Co. (CTPR by its Spanish initials) and JetBlue announced an alliance Monday that will facilitate access to COVID-19 molecular tests provided by Vault Health, JetBlue’s provider partner for polymerase chain reaction, or PCR, testing. The joint initiative consists of an effort dedicated to increasing the percentage of JetBlue customers who enter the island with a test conducted in advance, by providing access to molecular tests at home, through a process facilitated and supervised by the Vault company. The call to consider the trial alternative is extended to those who have confirmed a travel itinerary to Puerto Rico, since efforts to stimulate demand from travelers remain on hold considering the travel guidelines issued by the authorities. According to a written statement, JetBlue and the Puerto Rico government, through the CTPR, “are committed to helping protect the health of all and, at the same time, providing viable options for those who have to travel to Puerto Rico to do so safely and responsibly.” In order to protect both travelers and island residents, since July 15, the central government has implemented an executive order that requires every person traveling to Puerto Rico to show evidence of a negative molecular test result for COVID-19 in order to avoid the mandatory 14-day quarantine period. Since that time, JetBlue, the airline with the largest presence on the island, has continued to work with the Puerto Rico Tourism Co. to notify the nearly 200,000 passengers who have traveled to the destination about the entry requirements. In an unprecedented effort, the CTPR and JetBlue have used their alliance to launch an intense awareness campaign aimed at ensuring that the majority of travelers with

itineraries to San Juan in the coming weeks can complete the pre-COVID-19 testing process upon entrance, the statement said. The Vault company collaborates with its network of laboratories to provide a service that guarantees fast and highly reliable results. All JetBlue passengers using the Vault company service will have access to a direct phone line to receive support throughout the process. “JetBlue remains steadfast in its approach of using all the resources necessary to keep our travelers safe.The implementation of the use of tests for all those who decide to travel to visit friends and family this year-end season is a necessary measure to protect everyone and stop the spread of COVID-19,” said Joanna Geraghty, president and principal JetBlue operations officer. “This is our most recent initiative in partnership with destinations in the Caribbean region to promote safe travel through easy access to tests.” CTPR Executive Director Carla Campos said “[w]e are very proud to be able to join JetBlue in this collaborative effort that, through easy access to pre-trip testing, makes the health and safety of Puerto Rico’s crew, travelers, and residents our highest priority.” “Puerto Rico has been recognized internationally as a leader in the implementation of health and safety protocols designed specifically for the industry by organizations such as the World Travel and Tourism Council,” Campos said. “We

continue to be committed to being facilitators for an agile and responsible recovery of tourism, giving priority to the accessibility of pre-trip tests. During the next month many people will be traveling to our Island of Enchantment to visit their loved ones. Through this alliance we seek to increase the percentage of people arriving on the island with evidence from the test from 30 percent to 75 percent and make it possible for more families to share responsibly during this festive season.” The simple saliva test is performed through a video call facilitated by Vault, with a supervisor who helps ensure that the customer takes the sample properly. The sample is sent expeditiously to a laboratory to be processed in 72 hours or less. Pierluisi announces appointment of chief of staff, press secretary, among others By THE STAR STAFF

overnor-elect Pedro Pierluisi presented a part of his close team at La Fortaleza on Monday. “Today’s nominations are key to achieving that government of excellence that I have promised to Puerto Rico,” Pierluisi said at a press conference. “From La Fortaleza we will promote teamwork, we will put action where the words are and we will make sure that our government always responds to the people.” Among the announced appointments are: chief of staff, Noelia García Bardales; principal legal adviser, Isaías Sánchez Báez; director of the Office of Judicial and Executive Appointments, Ileana Borges Borges; director of the Office of Public and Programmatic Affairs, Rosemarie “Maí” Vizcarrondo; press secretary and spokesperson, Sheila Angleró Mojica; and administrator of the La Fortaleza administrator, Carmen Salgado Rodríguez. The governor-elect began the round of appointments for the day with García Bardales, as chief of staff. García Bardales has more than 20 years of experience in the Puerto Rico government, from the House of Representatives, the Senate, the executive branch, as well as in the municipalities and in Congress. She serves as executive director of the Convention Center District Authority, where she has been responsible for directing and developing strategies for the planning, financing, maintenance, marketing, administration and promotion of the District’s properties that receive close to two million visitors annually. In addition, García Bardales has worked in various industries, such as real estate, government, health and communications, focused mainly on administration, development of operational, legislative and public policy strategies. From 2007 to 2016 García Bardales worked as a consultant, completing important impact projects, such as the integration of 48 municipalities into the 911 emergency system. She has a bachelor’s degree in business administration with a concentration in marketing from the University of Puerto Rico (UPR). Pierluisi also announced attorney Sánchez Báez as principal legal adviser. In 2017, he joined the island Justice Department as deputy secretary, a position he currently occupies. Among the thousands of cases the department has dealt with, in United States

v. Vaello-Madero Sánchez Báez has been one of the main voices in defense of the equal rights of American citizens of Puerto Rico who need access to Supplemental Social Security benefits. Sánchez Báez had previously worked as a legal officer for Puerto Rico Associate Justice Mildred Pabón Charneco, and as a trial attorney in the private sector. Sánchez Báez earned his Juris Doctor, summa cum laude, from Inter-American University of Puerto Rico, where he had earned a bachelor’s degree in business administration, also summa cum laude. He was a teaching assistant to professor Carlos Gorrín Peralta, associate director of the legal journal and served as the summer legal officer of Judge Daniel Domínguez in the federal court in Puerto Rico. The governor-elect also announced that Borges Borges, a distinguished attorney with over 18 years of legal experience, will direct the Office of Judicial and Executive Appointments. Borges Borges was part of the United States delegation to the United Nations in the initiative to create a witness shelter in the Caribbean on behalf of Puerto Rico. She worked in the Department of Justice while Pierluisi was secretary and also with subsequent Justice secretaries. In addition, she worked in the Tourism Co., Telefónica de Puerto Rico, served as an adviser to several legislators and was assistant secretary for public initiatives and protocol at the island State Department. Since 2003, she has led a successful private practice in civil, family and inheritance law. Borges Borges holds a Juris Doctor from Inter-American University and earned a bachelor’s degree at UPR. Likewise, Pierluisi announced Vizcarrondo, a professional with 30 years of experience in both the private and public sectors, as director of the Office of Public and Programmatic Affairs. Vizcarrondo has been involved in public service for the past 20 years and served as the director of the Puerto Rico District Office of the Resident Commissioner during Pierluisi’s eight years in Congress. She was in charge of all the staff of the local office, directed the work of congressional public policy on the island, served as liaison with the private sector, municipalities and the commonwealth government, and coordinated all writing and public communication for Pierluisi and her office. Later, she was chief of staff and public affairs adviser to the Financial Su-

pervision and Administration Board, where she led the establishment of its local offices, the recruitment and supervision of personnel, the coordination with consultants and government liaisons, and the organization of public and executive hearings, among other responsibilities. In addition, Vizcarrondo has served as a strategic adviser since 2007 and participated in the development and communication of Pierluisi’s government platforms in 2008, 2012, 2016 and 2020. She earned a bachelor’s degree in architecture, cum laude from the University of Notre Dame in Indiana. Angleró Mojica, Pierluisi’s choice to be his press secretary and spokesperson, has 17 years of experience in the field of communications. A licensed public relations professional and a member of the Puerto Rico Association of Professional Relationists, Angleró Mojica began her career as a journalist for the radio and print press, covering events of a legislative, governmental, political and cultural nature. Later, she ventured into the field of public relations, developing communication strategies for clients in the private and public sectors. Most recently, she was a press and communications consultant to former Puerto Rico Senate Vice President Larry Seilhamer -- now the designated secretary of State -- for nine years. In the private sector she has provided communications consulting services to companies and small and midsize businesses. Angleró Mojica has a master’s degree in public relations and a bachelor’s degree

in journalism, summa cum laude, from the Universidad del Sagrado Corazón. Pierluisi also announced that Salgado Rodríguez will be the new administrator of La Fortaleza. She began her professional career in the Legislative Assembly as an adviser to the Government Committee, executive director of the Federal Affairs Committee, executive assistant to the Senate president and director of human resources in the Senate. Starting in 2000, she worked in the executive branch, occupying various career and trust positions in the administration and management areas. She served as deputy secretary of the Department of Consumer Affairs (DACO by its Spanish acronym) until 2011, when she was appointed and confirmed as head of the Advocates Administration Office, where she served until she returned to DACO in 2013. In October 2019, she was appointed and confirmed as DACO secretary, a post she currently holds. One of her main achievements has been the acquisition of the most advanced technological services and equipment to attend to the project of complaints hearings, mediations and consultations virtually, which has been very useful during the coronavirus pandemic, and includes an appointment and shift system so that consumers can request dates to be attended to in person at the DACO regional offices, providing consumers with greater access to services virtually. Salgado Rodríguez holds a Juris Doctor from the University of Florida School of Law and a bachelor’s degree with a concentration in English from UPR.

America begins its most ambitious vaccination campaign By JACK HEALY, AMY HARMON, SIMON ROMERO, NOAH WEILAND and MICHAEL GOLD

he first shots were given in the American mass vaccination campaign Monday morning, opening a new chapter in the battle against the coronavirus pandemic, which has killed more people in the United States than in any other country. Shortly after 9 a.m. Monday, the first known clinically authorized vaccination took place in Long Island Jewish Medical Center in New York City. The pandemic has scarred New York state profoundly, leaving more than 35,000 people dead and severely weakening the economy. “I believe this is the weapon that will end the war,” Gov. Andrew Cuomo said at the event Monday morning, shortly before the shot was given to Sandra Lindsay, a critical care nurse at the center. State officials said the shot was the first to be given outside of a vaccine trial in the United States. Lindsay, who has treated patients throughout the pandemic, said that she hoped her public vaccination would instill confidence that the shots were safe. “I feel like healing is coming,” she said. “I hope this marks the beginning of the end of a very painful time in our history.” Moments later, President Donald Trump posted on Twitter: “First Vaccine Administered. Congratulations USA! Congratulations WORLD!” Shortly afterward, Mayor Bill de Blasio of New York City said at a news conference that “To me, we were watching an incredibly historic moment, and the beginning of something much better for this city and this country.” The vaccinations started after the Food and Drug Administration’s emergency authorization of the Pfizer-BioNTech vaccine Friday night, and as the U.S. coronavirus death toll approaches 300,000, with a steady surge in new cases daily. On Sunday, trucks and cargo planes packed with the first of nearly 3 million doses of coronavirus vaccine had fanned out across the country, as hospitals in all 50 states rushed to set up injection sites and their anxious workers tracked each shipment hour by hour. But the rollout is less centralized in the United States than in other countries that are racing to distribute it. Across the country, according to Gen.

Gustave F. Perna, the chief operating officer of the federal effort to develop a vaccine, 145 sites are set to receive the vaccine Monday, 425 on Tuesday and 66 on Wednesday. A majority of the first injections given Monday are expected to go to high-risk health care workers. In many cases, this first, limited delivery would not supply nearly enough doses to inoculate all of the doctors, nurses, security guards, receptionists and other workers who risk being exposed to the virus every day. Because the vaccines can cause side effects including fevers and aches, hospitals say they will stagger vaccination schedules among workers. Residents of nursing homes, who have suffered a disproportionate share of COVID-19 deaths, are also being prioritized and are expected to begin receiving vaccinations next week. But the vast majority of Americans will not be eligible for the vaccine until the spring or later. On Monday afternoon at George Washington University Hospital in Washington, five of the first vaccinations are scheduled to take place at what the Department of Health and Human Services is calling a national ceremonial “kickoff event.” The five people were selected by an algorithm the hospital is using to assign the first doses, the result of a survey hospital employees filled out that asked about age, underlying medical conditions and the risk they carry in their jobs, according to a federal health official familiar with the planning who was not authorized to speak publicly. The event is intended to demonstrate the way many health workers will be vaccinated this week, the official said. The kickoff is part of what the official said will be a series of vaccination events featuring top health officials. The moves come just six days after Britain became the first nation to begin rolling out a fully tested vaccine. Since then, a handful of other nations have approved the same vaccine. In Canada, the first shipments of the Pfizer-BioNTech vaccine arrived Sunday, Prime Minister Justin Trudeau announced on Twitter, and the first shots could be given as early as Monday. Among the first to receive the vaccine will be residents of nursing homes in Quebec and front-line health workers in Toronto. As U.S. deaths approach 300,000, obituaries force reckoning with COVID

hen Kim Miller sat down in her Illinois house to compose her husband’s obituary, she could not hold back. Not about the coronavirus that had left Scott, her fit, healthy spouse who loved to swim, golf and putter in the garden, gasping for breath and unable to move his limbs as he stood at the kitchen counter. Not about what had killed him swiftly and cruelly in only a few days. “This disease is real, it is serious and it is deadly,” she wrote in his obituary. “Wear the mask, socially distance, if not for yourself then for others who may lose a loved one to the disease.” “I couldn’t just write that he lived and died and had two children,” said Kim Miller, a retired college professor, who wept as she spoke of her husband of 25 years. “I wanted

people to read this and really read this.” By Sunday, deaths from the coronavirus were approaching 300,000 in the United States, a toll comparable to losing the entire population of Pittsburgh or St. Louis. Reports of new deaths have more than doubled in the last month to an average of nearly 2,400 each day, more than any other point in the pandemic. The deaths have been announced in the traditional fashion, in obituaries and notices on websites and in newspapers that have followed the same format for decades, noting birthplaces, family members, jobs and passions. But in recent months, as the death toll from the coronavirus in the United States grows steadily higher, families who have lost relatives to the disease are writing the pandemic more deeply into the death notices they submit to funeral homes and the materials they share with newspapers’ obituary writers. They are crafting pleas for mask wearing, rebuking those who believe the virus is a hoax and

describing, in blunt detail, the loneliness and physical suffering that the coronavirus inflicted on the dying. “In the beginning, families wanted to keep COVID more private,” said Charles S. Childs Jr., an owner of A.A. Rayner & Sons Funeral Home in Chicago, where he has seen a surge of virus deaths in the last month. “That has changed. Now they want to make it public.” Over decades, families have often declined to write in an obituary how their relative died when there was anxiety or fear attached to the cause, whether it was AIDS, an opioid overdose or suicide. But as the public has grown more aware of once-unfamiliar infectious diseases, mental illness and drug addiction, the tendency to conceal has slowly given way to candor. After Shirley Flores, a postmaster and mother of three, died in Las Cruces, New Mexico, her family noted in her obituary: “She died a very painful lonely death because we weren’t allowed in to hold her hand and sit with her. Please take COVID-19 seriously, protect yourself and those you love.” Judy Fuller, 76, of Blue Grass, Iowa, died from the coronavirus in September, after she and her husband, Ron, fell ill at the same time. Judy Fuller was known for her bright smile, her love of fashion and the outdoors, and her devotion to her job handling staffing at the hospital, where she worked for nearly four decades. “In lieu of flowers or donations, we just ask to take the COVID-19 virus seriously and please spend time with your loved ones,” her family wrote. “Life is short, enjoy time with your family while you can.” Ron Fuller, who is currently nursing his son back to health after he contracted the coronavirus, said that he had wanted to send a quiet but urgent message in the obituary. In the weeks since his wife died, he has shopped at the small supermarket in town and seen customers not wearing masks. Most of the

people who work there don’t wear masks either. “We put that in there because it is serious, and people need to understand it’s a serious disease,” Fuller said. “A few people I’ve talked to, they called and they said they appreciated what they saw in the paper. And they agreed with what was in the paper.” With funeral services postponed, and burials often happening without public eulogies or words spoken in memory, the obituary has taken on heightened importance, the family’s turn to deliver their own unfiltered message to the community. That was how Kori Lusignan, a consultant in Lake Mary, Florida, saw her role in writing the obituary of her father, Roger Andreoli, who died of the virus two days after Thanksgiving. He was funny and vibrant, a specialeducation teacher, skilled carpenter and enthusiastic traveler who split his time between Wisconsin and Florida. Lusignan crafted the obituary to honor the person he was, and capture his humor and sweetness, as she would have done in a eulogy delivered at church. “Roger’s exuberance for life was infectious,” she wrote. “It would be impossible to list all of the organizations in which he participated; he jumped into living with both feet.” And she wanted to cleanly knock down misconceptions of who can die from the virus. Andreoli was 78 years old, but he was perfectly healthy and could have lived decades longer, she said, as many people in their family have. He died “peacefully and prematurely after his battle with COVID-19,” she wrote in the obituary, adding: “Roger’s family will not be holding services at this time in order to spare other families the trauma they experienced with COVID-19.” “We wanted people to know, this is why he died,” Lusignan said. “And we are not having a service because we are going through trauma. We didn’t want people to experience what we did.”

fter being shut for two months in the spring because of the pandemic, Maria’s Bistro Mexicano in Sunset Park found signs of optimism in the summer. Outdoor dining bolstered sales. Laid-off workers were rehired. The dining room eventually reopened, welcoming dozens of customers every week to tables spaced 6 feet apart. On Friday, however, the pandemic dampened the restaurant’s progress, as a surge in coronavirus infections prompted Gov. Andrew Cuomo to announce a ban on indoor dining in New York City restaurants. The workers at Maria’s will almost certainly have their shifts reduced if they are not let go, as the Brooklyn restaurant hastens to ramp up a delivery operation to survive. “It all happened just like that, and now we have to go through it again?” Christian Nacipucha, the general manager of Maria’s, said Saturday. He said the loss of indoor dining would be a “huge change.” “It’s a headache,” he said. “It’s a huge headache. We do as much as we can to comply with the rules and are still the first to go.” With coronavirus cases rising, this past weekend was the last time NewYorkers would legally be able to eat indoors at city restaurants for the foreseeable future, a reversal that reflected the worsening conditions of the pandemic. Now, thousands of restaurants face an uncertain future as they brace for brutal winter months that could reduce business to new lows. Restaurants across the city are moving to lay off waiters, servers and bartenders, throwing the workers’ lives in turmoil and presenting a new setback in New York’s economic recovery. Some restaurants will shut entirely for the winter months. Others, confronting daunting rent payments and mounting bills, wonder how, if at all, they will survive. “Shutting indoor dining in the winter, when outdoor dining is less feasible, presents an extraordinarily challenging financial situation, when we’re nine months into the pandemic and people have exhausted their personal savings, taken out loans, maxed out credit cards,” said Andrew Rigie, executive director of the New York City Hospitality Alliance. “They have significantly less resources than the small resources they even had after the initial shutdown.” A survey from the New York State Restaurant Association of 6,000 restaurant operators in the state found that more than half said it would be unlikely their restaurants would still be in operation in six months without any government aid.The survey found 78% expected more layoffs over the next three months. Evidence has grown that indoor dining can be risky, especially if seats are not spaced out, capacity is not reduced and air is not circulating. Recent recommendations from the Centers for Disease Control and Prevention described eating at indoor restaurants as a “particularly high-risk” activity. Serving customers at a reduced capacity provided a “sense of normalcy” for many restaurants, but it did not come close

to making up for the amount of business lost in the pandemic, said Jonathan Forgash, executive director of Queens Together, a restaurant group that has helped some businesses raise funds by preparing meals for people in need. The loss of indoor dining adds pressure to struggling restaurants that are already scrambling to find new ways to bolster business, he said. Some are reducing offerings on their menus to limit the cost of food supplies and labor, Forgash said, and others are trying to reach a bigger customer base through third-party delivery apps, despite the added cost of using the apps. Still others are repurposing their dining areas into markets. “People are literally throwing ideas against the wall and seeing what is sticking or working for now,” he said. Kenya Britain, the manager of Row House in Harlem, said he hoped that by partnering with a bar that invested in heaters in a large outdoor space, the restaurant would be able to serve enough customers to stay afloat through the winter. On Saturday, Row House had a half-dozen parties seated indoors and no one outdoors. After the restaurant shut down in the spring, it could at least count on more outdoor dining as the weather warmed, Britain said. “The difference this time around is people are more prone to staying home,” he said. “It’s going to be tough to get people to come out of their own home and come have a meal.” Sergey Nagorny, 35, and Marina Nagorny, 36, who were eating inside Row House on Saturday, said they had mostly been avoiding restaurants during the pandemic. But

the couple decided to go out before the end — again — of indoor dining. Sergey Nagorny said he doubted he would try outdoor dining this winter. “Your food’s going to get cold, your butt’s going to get cold, you might as well stay home,” he said. “You want to sit and take off your coat and take off your mask and enjoy yourself.” Britain, the manager, said he had relatives who died of the coronavirus and that he understood the need for more precautions. He said officials in New York had supported restaurants more than he had expected. “To their credit, I think they held off as long as they could, I think they tried to do their best,” Britain said. “Ironically, I didn’t think we would be open this long. I thought it would be over before Thanksgiving.” The ban on indoor dining, however, has also stirred frustration with public officials’ handling of the crisis. Industry groups have ramped up calls for federal or state financial assistance, which could be one component of a federal stimulus package, but agreement in Washington has so far proved elusive. Sisay Kassa, the owner of Lalibela Ethiopian Restaurant in Harlem, said he thought that keeping people 6 feet apart inside, with a reduced capacity of 25%, was relatively safe. “We’re not asking for 50%,” he said. “We are not expecting a lot.” He said the business was struggling despite the addition of cabanas where patrons could sit outdoors. “Nobody is going to make a profit right now,” he said. “It’s just surviving.”

Google delays return to office and eyes ‘flexible work week’ Reed Hastings, Netflix’s chief executive, has said that he has not seen “any positives” from working at home and that not being able to get together to discuss ideas in person is a “pure negative.” However, he said he expected the five-day workweek would become four days in the office and one day remote after the pandemic. Other companies may take their cues from Google, which has been a pioneer for many aspects of work life, especially at technology companies. Google’s open and casual offices established the blueprint for a generation of startups, while its office perks like free snacks and complimentary services have spread throughout the corporate world. As part of its more flexible workplaces, Google said it planned to put in place new office designs in areas with lower coronavirus risk. It plans to offer options to employees like booking collaboration places for up to a dozen people and securing outdoor spaces for larger gatherings. For employees in need of a quiet space outside the home, Google will offer reservable desks at its offices. Google also said it planned to keep developing new ways to help employees bridge the gap between the experience of working at the office and working from home, especially for employees who may not live in places well suited for remote work. ith the pandemic still in full swing and the first doses of a coronavirus vaccine just starting to ship in the United States, Google has pushed back the planned return to the office by a few months, to September 2021. But even as it extends the remote work period for most of its staff, Google is laying out a series of proposed changes that may substantially alter how its employees and people at other technology companies will work. In an email to the staff on Sunday night, Sundar Pichai, chief executive of Google’s parent company, Alphabet, said the company was testing the idea of a “flexible workweek” once it is safe to return to the office. Under the pilot plan, employees would be expected to work at least three days a week in the office for “collaboration days” while working from home the other days. “We are testing a hypothesis that a flexible work model will lead to greater productivity, collaboration, and wellbeing,” Pichai wrote in an email obtained by The New York Times. “No company at our scale has ever created a fully hybrid workforce model — though a few are starting to test it — so it will be interesting to try.” One thing not mentioned in Pichai’s email is whether the company will require employees to take the coronavirus vaccine before returning to the office. Google has said it

recommends that employees obtain the vaccine when their health care provider or local public health authority has told them it’s available to them, said Gina Scigliano, a Google spokeswoman. Google has said it is looking for opportunities in mid-to-late 2021 to help make COVID-19 vaccines available to its workers, but only after high-risk and high-priority people globally have received the vaccines. The timing of Google’s plan to roll out the flexible work schedules is still up in the air, because of the different state of the coronavirus in different countries. And the new schedules may not apply to some Google employees, like workers who spend lots of time with customers or employees at its data centers or labs. In March, Google was one of the first companies to tell employees to start working from home before other corporations had a grasp on the risks of working together in enclosed offices. It has repeatedly delayed the timing on when it expects employees to return to the office from January 2021 to July and now, September. After such a long period of remote work, companies are wrestling with how best to transition workers back into offices. Last month, ViacomCBS told employees that it expects most of its employees to divide their time between working at home and in its offices. In doing so, the company said a hybrid model would allow more flexibility for employees, while reducing its real estate needs and keeping costs down.

The tech giant’s popular apps — including Calendar, Gmail, Hangouts, Maps, Meet, Stadia and YouTube — crashed, halting work across the globe and sending angry users to Twitter to vent about the loss of services. Google disclosed the outages on a status dashboard that shares information about its various services. Downdetector, a website for tracking internet outages, also showed that Google was offline. Google’s search engine continued to work for some people. A Google spokesperson had no immediate comment about what was causing the outage. The incident quickly highlighted the world’s dependence on the Silicon Valley giant, as employees at companies that use Google for technology services could not send email or access documents stored on Google’s servers.

Wall St cheered by vaccine roll-out, mega M&A activity

all Street’s main indexes rose on Monday as consumer stocks surged on the launch of a nationwide COVID-19 vaccine campaign, while Alexion Pharmaceuticals jumped on a $39 billion buyout offer from AstraZeneca in one of the year’s biggest deals. The inoculations are seen as pivotal toward ultimately halting the COVID-19 pandemic, which has claimed more than a million lives around the world and brought economic activity to a halt. Consumer discretionary stocks were among the best performing sectors on the S&P 500 on Monday, while travel and leisure stocks, which are among the worst hit by the virus outbreak, also gained. Cruise operator Carnival Corp rose 0.8%, while American Airlines Group added 0.3%. Alexion Pharmaceuticals Inc was among the top boosts to the S&P 500 and the Nasdaq, surging 31.0% to a 4-1/2 year high after British drugmaker AstraZeneca said it would buy the U.S. biotech firm. Germany locks down before Christmas as coronavirus deaths rise By MELISSA EDDY

ermans will be forced into a strict lockdown over Christmas, after weeks of milder restrictions on public life failed to slow the spread of the coronavirus, leading to record numbers of new infections and deaths, Chancellor Angela Merkel announced Sunday. Starting Wednesday, nonessential stores, schools and hairdressers will be required to close, and companies will be encouraged to offer employees an extended holiday break or allow them to work from home. The number of people allowed to meet privately — including over Christmas — will also be further tightened. New Year’s celebrations outdoors will be all but prohibited, with the sale of fireworks and gatherings in public both banned. “All of this will impact the holidays, we know that, but we have been forced to take action and that is what we are doing now,” Merkel said at a news conference announcing the measures, which are to remain in place through Jan. 10. Germany earned widespread recognition for its success in halting the spread of the virus in the spring through an aggressive approach informed by science and carried out through contact tracing, early and aggressive testing and coordinated nationwide restrictions. But since then, the country has stumbled badly, allowing a false sense of complacency to set in. Leaders of Germany’s 16 states — responsible for implementing public health policy — have also been resistant to following calls from the chancellor and medical experts for another lockdown this fall. In late September, Merkel warned that if Germany did not take more radical action, the numbers of new infections could rise to 19,000 per day. Roughly one month later, the chancellor’s warning came to pass as the country experienced more than 21,500 new infections within a 24-hour period. Instead of falling in line with other European countries — including Britain, France and Ireland — that imposed hard restrictions as their numbers rose this fall, Germany’s governors squabbled over how far regulations should be allowed to go. The result was a raft of more flexible, softer measures nationwide — named “lockdown light” by the German news media — that closed bars, restaurants, theaters and cinemas but allowed small groups of people to meet and left nonessential stores, schools and hotels all open. The aim had been to reduce social contacts by 75%, Merkel said when they were announced in late October. Going ‘the extra mile,’ Britain and EU give Brexit talks more time

ritain and the European Union passed another door-die moment in their trade negotiations Sunday with neither a breakthrough nor a breakdown. But as the talks stretched on, there were distinct glimmers of hope that the two sides might at last find a way to bridge the gulf between them. Prime Minister Boris Johnson and the president of the European Commission, Ursula von der Leyen, agreed to extend the negotiations after what both described as a “useful” midday phone call. She dropped her previous admonition that Britain and the European Union were far apart on key issues. Johnson struck a warier tone, noting that the gaps remained significant and that Britain should prepare for a failure to reach a deal by the Dec. 31 deadline. But even he said that British negotiators would not walk away from the talks and reaffirmed, “There is a deal to be done, if our partners want to do it.” Tellingly, neither set a fresh deadline for the negotiations, although as a practical matter, the two sides have only until New Year’s Eve, which is when the transition period to hammer out a long-term trade agreement expires. After that, Britain and the EU would begin levying

tariffs on each other’s goods. Mujtaba Rahman, an analyst at the political risk consultancy Eurasia Group, said, “Today was the moment where it all could have gone wrong — and it didn’t go wrong.” “Both sides have committed to avoiding a cliff edge, which means the likelihood of an agreement has now risen substantially,” he added. At the heart of the talks is the thorny question of how the EU would respond if Britain diverged from the bloc in its industrial policy. Both sides initially staked out a hard line: Brussels insisting it had to be able to defend the single market from unfair competition from British companies getting state support; and the British declaring it was a matter of sovereignty to be free to chart their own course. In recent days, however, the EU has softened its stance, according to people briefed on the talks who requested anonymity to speak about behind-the-scenes negotiations. Rather than automatically impose tariffs to counteract British divergence, the two sides are negotiating other ways to resolve disputes over state aid and other competition policies. That could allow Johnson to claim a victory, which would help him sell a trade agreement to the Brexiteers in his Conservative Party. But Britain has given ground in

important respects as well. On Wednesday in Parliament, before he traveled to Brussels for a dinner meeting with von der Leyen, Johnson dismissed the EU’s position as an unacceptable infringement of British sovereignty. Brussels, he said, wanted to ensure that “if they pass a new law in the future with which we in this country do not comply or do not follow suit, they should have the automatic right to punish us and to retaliate.” Johnson’s use of the word “automatic” was noteworthy because it suggested there were other ways the two sides could resolve such disputes. Before that, British negotiators had refused to accept any other safeguards against future divergence except those in standard trade agreements, although they did commit not to water down existing rules on labor and environmental standards. “It seems as if the U.K. has conceded the principle,” said David Henig, director of the U.K. Trade Policy Project at the European Center for International Political Economy, a research institute. “There is a difference between having a difference on a point of principle and trying to find a practical solution that satisfies both sides.” There were other more subtle signals of progress. Von der Leyen delivered her statement after speaking to Johnson in English, saying, “We both think that it is responsible at this point in time to go the extra mile.” A week ago, after a less hopeful phone call with him, she spoke in French and German. None of this means the talks could not still run aground. Time is short, the two sides still need to work out a politically fraught deal on fishing quotas and negative blowback from pro-Brexit Conservative lawmakers could yet persuade Johnson to pull back from endorsing the difficult details. “If Ursula is optimistic, then that’s great,” Johnson said to Sky News. “But as far as I can see, there are some serious and very, very, very difficult issues that currently separate the U.K. from the EU.” Britain, he said, had made extensive preparations for a failure in the talks, after which its trade with the EU would default to World Trade Organization terms. Some analysts dismissed that as a calculated effort to take a tough posture before the inevitable compromises to come. Henig, the analyst, said the prime minister was under intense pressure from British business not to risk a trade war in January over Britain’s theoretical right to take measures for which it currently has no plans. That point was underscored Sunday when Mike Hawes, chief executive of the Society of Motor Manufacturers and Traders, appealed to the negotiators “to finish the job and agree the deal we all so desperately need, without further delay.” “‘No deal,’” he said, “would be nothing less than catastrophic for the automotive sector, its workers and their families and represent a stunning failure of statecraft.”

China’s combative Nationalists see a world turning their way By CHRIS BUCKLEY

n one Beijing artist’s recent depiction of the world in 2098, China is a high-tech superpower and the United States is humbled. Americans have embraced communism and Manhattan, draped with the hammer-and-sickle flags of the “People’s Union of America,” has become a quaint tourist precinct. This triumphant vision has resonated among Chinese. The sci-fi digital illustrations by the artist, Fan Wennan, caught fire on Chinese social media in recent months, reflecting a resurgent nationalism. China’s authoritarian system, proponents say, is not just different from the West’s democracies, it is also proving itself superior. It is a long-running theme, but China’s success against the pandemic has given it a sharp boost. “America isn’t that heavenly kingdom depicted since decades ago,” said Fan, who is in his early 20s and has described his style as “People’s Punk.” “There’s nothing special about it. If you have to say there’s anything special about it now, it’s how messed up it can be at times.” China’s Communist Party, under its leader, Xi Jinping, has promoted the idea that the country is on a trajectory to power past Western rivals. China stamped out the coronavirus, the messaging goes, with a resolve beyond the reach of flailing Western democracies. Beijing has rolled out homegrown vaccines to more than 1 million people, despite the safety concerns of scientists. China’s economy has revived, defying fears of a deep slump from the pandemic. “In this fight against the pandemic, there will be victorious powers and defeated ones,” Wang Xiangsui, a retired Chinese senior colonel who teaches at a university in Beijing, averred this month. “We’re a victor power, while the United States is still mired and, I think, may well become a defeated power.” The firm leadership of Xi and the party has earned China its recent success, say newspapers, television programs and social media. “Time to wake up from blind faith in the Western system,” said a commentary in the state-run China Education News last week. “Vicious partisan fighting has worsened in certain Western countries, social fissures have deepened, and a severe social crisis is brewing.” China’s current swaggering mood could add to the challenges facing Joe Biden when he takes office as president. President Donald Trump’s defeat in the election has done little to ease Chinese suspicion of the United States, said Liu Jianqiu, a businessman and online commentator, in a telephone interview. “I think China has gained the psychological edge,” said Liu, in his 40s, who described the pandemic as a turning point in his attitudes. “The performance of the West was completely out of my expectations and shifted my thinking even more — the facts prove that the American system really has no superiority.” Combative national pride surged in China in the runup to the Beijing Olympics in 2008, and after the United States bombing of the Chinese embassy in Belgrade, Yugoslavia, in

1999. Now there is a sharper sense that the Western powers are in perhaps irreversible decline, and that the pandemic has confirmed China’s ascent. “Most ordinary Chinese people previously were more admiring of the United States, but in recent years, the advantages of the Chinese system have become clearer to them,” said Jin Canrong, an international relations professor at Renmin University in Beijing who has become a popular commentator under the nickname “Commissar Jin.” “There’s greater self-confidence.” China’s diplomats and its state-run media have responded to criticism from Western governments with scornful disdain. Chinese supporters of a more muscular foreign policy call for hitting back against Western critics, especially in the wake of the pandemic. Le Yucheng, a Chinese vice minister of foreign affairs, said in a speech last week that China was not spoiling for fights, but he also warned other governments not to underestimate its resolve to push back against criticism. “Faced with this suppression and containment without scruples,” Le said, “we’ll never swallow our pride or stoop to compromise.” Online, Chinese commentators have plumbed the depths of history to capture the current moment. Some likened the United States to the crumbling British Empire of the last century, overstretched and exhausted. Others are reaching back further, comparing America

to China’s own Ming dynasty, which crumbled in the 1600s under the weight of corruption, insurrections and invasions. In this view that spread online this year, China should take the role of the “barbarian” Manchu armies who — in the commentators’ vivid, not-always-accurate retelling — swept over the Asian steppes, breached the Great Wall, and crushed the Ming rulers. Modern-day China must act like the Manchu forces, advocates of the analogy say, and prepare to “break through” a ring of geopolitical hostility by dominating vital seas around China. Geremie R. Barmé, a Sinologist in New Zealand who has followed the rise of “break-through studies” says the historical comparisons reflect anxiety “about China’s great nation status and its place in the world.” “The underpinning is that China is morally superior — we the Chinese people under the Communist Party — because we have none of the failings of America,” he said. China’s leader, Xi, has not commented on the recent pronouncements of American decline. But he sees China and the United States as locked in ideological rivalry. Since coming to power in 2012, he has called for Chinese schools, textbooks and websites to inoculate youth against Western values that could erode party rule and the country’s “cultural self-confidence.” “Our schooling must never nurture wreckers or gravediggers of socialism,” Xi said in a speech in 2018 that was recently published in a book of his comments on ideology.

Trump has never believed in democracy By CHARLES M. BLOW

onald Trump’s continued effort to overturn the result of the election — an effort buttressed by the support of many Republicans in Congress, it should be noted — is nothing short of an attempt at a bloodless coup. The only way Trump could achieve his aim of denying Joe Biden his rightfully earned victory would be if some people or entities — state legislatures, judges or the Supreme Court — were to agree to throw out millions of legally cast and appropriate votes. (It is also worth noting that many of the jurisdictions being disputed are heavily Black.) But a stinging defeat in the Supreme Court, packed with three justices of Trump’s own choosing, seems to have slammed the door on any legal path Trump might have had in his outrageous endeavor. The members of the Electoral College will meet on Monday and choose the next president. Barring any extraordinary and unprecedented developments, they will select Joe Biden, as the people already have. And yet, on Saturday Trump continued to insist on Twitter that “I WON THE ELECTION IN A LANDSLIDE,” and that the Supreme Court ruling

l juez superior Anthony Cuevas Ramos desestimó el lunes, un recurso de revisión judicial presentado por el alcalde de Guánica, Santos Seda Nazario “Papichy” en el que buscaba evitar que se validen los votos mixtos o llamados “pivazos”. “Tomando como ciertas las alegaciones del peticionario, el presente caso versa sobre la impugnación de una resolución que tiene el efecto de validar como votos mixtos aquellos que no cumplen con la definición establecida en artículo 9.10 del Código Electoral. Es decir, la resolución en cuestión presuntamente permite la adjudicación de votos que por su naturaleza son nulos por contravenir las disposiciones del Código Electoral. Tal determinación, a todas luces, no solo afecta al peticionario, sino que perjudica de todos los candidatos a la alcaldía de Guánica puesto que puede impactar el resultado final de dicha elección. Así, debemos concluir que los candidatos y aspirantes a la alcaldía de Guánica son partes adversamente afectadas conforme al artículo 13.2 del Código Electoral.

A pesar de que el peticionario presentó el recurso de judicial oportunamente, éste no notificó su presentación a los demás candidatos, dentro del término jurisdiccional de diez (10) días, incumpliendo de esta manera con el requisito de notificación a partes adversamente afectadas consagrado en artículo 13.2(1)(a) del Código Electoral. Sin duda, la falta de notificación en el término provisto incide sobre la jurisdicción de este Tribunal. No hay duda de que el peticionario no cumplió con lo allí dispuesto. La notificación tardía, fuera del término provisto por la ley, nos quita jurisdicción en el asunto. Sentencia. En vista de que carecemos de jurisdicción en el caso, no podemos entrar a dilucidar el resto de los planteamientos en las mociones dispositivas. Same-sex kisses under the mistletoe: Holiday movies rethink a formula

ill the adorable couple adopt a baby in time to celebrate Christmas with Mom and Dad and the neighborhood kids? Sounds like a delightful holiday TV movie. But this is disruptive 2020, so here’s the thing: The couple are Brandon and Jake and the channel is Hallmark. “The Christmas House” is one of six new original holiday films released since November with something rare: main characters in same-sex relationships. Others include Hulu’s “Happiest Season,” a lesbian comingout comedy starring Kristen Stewart; “The Christmas Setup,” a Lifetime rom-com starring real-life husbands Ben Lewis and Blake Lee; and “Dashing in December,” a drama on the Paramount Network about two men who fall in love on a ranch. More under the radar but still noteworthy are two indies: “A New York Christmas Wedding,” a drama on Netflix about a woman who has relationships with both a man and a woman, and the scrappy ondemand “I Hate New Year’s” (for rent on major platforms), a lesbian romance set on New Year’s Eve in Nashville, Tennessee. LGBTQ characters aren’t new to holiday movies,

and six films may not sound like a revolution. But so many leading queer love stories — and same-sex kisses! — is a sea change for Christmas cinema, a conventionally heterosexual universe with more stories about puppies than gay people. “It’s the start of something bigger,” said Clea DuVall, director and co-writer of “Happiest Season.” She added, “Networks and streamers are starting to see the value in telling these stories that have always been there but were not given the platform to get out to wider audiences.” According to Hulu, “Happiest Season” is the first holiday rom-com about a same-sex couple from a major Hollywood studio. Nicole Brown, president of TriStar Pictures, which sold “Happiest Season” to Hulu in October, called the queering of the Christmas picture “very organic.” So what took so long? “Film has always been under the assumption that the safest kind of characters are the way to go,” Brown said. “Our studio felt confident that the script and Clea’s vision and her ambition were aligned to make a commercial story, and that the quality of her storytelling would bring everybody in. When something’s great, it’s great.” This shift is most seismic for Hallmark, which has

become shorthand for “holiday movie.” “The Christmas House” is one of 40 new holiday films released this year on the Hallmark Channel and its sister network Hallmark Movies & Mysteries. What’s most striking about “The Christmas House” is that Brandon and Jake, played by Jonathan Bennett and Brad Harder, are unconditionally accepted as part of the family. LGBTQ people “work on a lot of these Christmas movies,” said Bennett, who is gay but has played straight in Hallmark films before. “For the first time we feel we belong at the holiday table.” Last December, the Hallmark Channel faced a firestorm when it pulled four television ads with kissing brides after a conservative group petitioned the network to “reconsider airing commercials with same-sex couples” and to refrain from adding LGBTQ movies to its schedule. Days later, Hallmark apologized for removing the commercials and said it would work with GLAAD, the media advocacy organization, “to better represent the LGBTQ community.” Michelle Vicary, executive vice president of programming and network publicity at Crown Media Family Networks, the parent company of the Hallmark Channel, said in an interview that her chief goal this year was to make “a bigger holiday table where people can see themselves on TV.” In 2021, Hallmark “will be moving forward, not backward,” she said, with more LGBTQ tales at Christmas and during the year. “We are really focused on continuing our commitment to the authenticity in our storytelling for all of our characters, and making sure that everyone can see themselves represented on Hallmark services,” she said. “It’s the right thing to do.” Lifetime, Hallmark’s biggest Christmas competitor, has featured original holiday films with LGBTQ characters in supporting roles and storylines before; last year for the first time it ran one with a same-sex kiss. But “The Christmas Setup” — one of 34 new holiday movies on Lifetime this year — breaks ground as the channel’s first such film with an LGBTQ romance front and center. Watched ‘Mank’ but never seen ‘Citizen Kane’? Here’s a primer By BEN KENINGSBERG

efore its reputation as the greatest film of all time was cemented, and even before it was released, “Citizen Kane” (1941) was a lightning rod. Its first-time director, Orson Welles, already known for his innovations in theater and radio, had gone to Hollywood in his mid-20s riding a wave of anticipation. By making his debut feature a thinly veiled portrait of newspaper tycoon William Randolph Hearst, he had chosen a target who could guarantee that the film would be shunned in the press. “Kane” hadn’t even opened when Louis B. Mayer, the production chief of MGM, hatched a plan to pay off RKO, the film’s studio, and have the negative destroyed. That didn’t happen, and today “Kane” lives on as a near-universally recognized masterpiece. It’s still an active subject of discussion: The new Netflix film “Mank,” about Herman J. Mankiewicz, who shared writing credit with Welles, deals at least partly with the making of “Kane.” But controversy alone doesn’t sustain a movie’s reputation for nearly 80 years. If you’ve watched “Mank” but have never seen “Kane” (which is available to stream or rent on major platforms), here are three examples of what made it revolutionary. Structure In the simplest terms, “Kane” is told in flashback beginning with the death of its Hearst stand-in, Charles Foster Kane (played by Welles), who in the first scene is shown uttering a mysterious dying word: “Rosebud.” Then, a sophisticated facsimile of a newsreel provides an overview of Kane’s life, touching on milestones (his sudden wealth in boyhood after his mother acquired a supposedly worthless mine shaft; his first marriage to a president’s niece; the scandal that derailed his gubernatorial ambitions) that cue viewers about what to watch for later, since what follows won’t be strictly linear. When the newsreel ends, its producer complains it needs an angle. Thompson (William Alland) is assigned to interview people who knew Kane to find out what Rosebud means. Each new Kane associate prompts a set of flashbacks, and it’s always interesting to look for where the narrating character is positioned within those scenes, which at times emphasize the subjective perspective. The flashbacks are broadly but not strictly chronological, so that the written memories of Thatcher (George Coulouris), the banker who became young Kane’s guardian, can end in 1929, when Kane’s newspaper empire suffers a crash-related setback, and the movie can double back, in a flashback related by Bernstein (Everett Sloane), Kane’s general manager, to his boss’ first day running his first paper. The story of Kane’s second wife, Susan Alexander Kane (Dorothy Comingore), and her disastrous debut

The making of “Citizen Kane” is one of the subjects of “Mank.” as an opera singer is related first by Kane’s friend Jed Leland (Joseph Cotten), and then revisited from Susan’s point of view. Few films have so fluidly intermingled the demands of character and story or shifted perspectives so deftly and economically. Nothing is ever unclear. Visuals Welles’ use of shadows and low angles have led some observers to categorize “Citizen Kane” as a film noir. But its most celebrated photographic device is deep focus, a technique that allows the foreground and background to be seen clearly at the same time, and that became closely associated with Gregg Toland, the film’s cinematographer. For example, a number of deep-focus shots show characters in the foreground discussing Kane’s fate as Kane — oblivious or powerless — is seen in the background. This happens early when Kane’s mother (Agnes Moorehead) signs over custody to Thatcher, and Kane as a child is seen in a distant window playing in the snow. It happens a few minutes (and 58 years) later, in the 1929 scene, when Kane is forced to relinquish ownership of newspapers to Thatcher. When Kane celebrates his complete acquisition of the staff of a rival paper, The Chronicle, Jed questions the news-

men’s loyalty to Kane’s brand of muckraking. “There’s always a chance, of course, that they’ll change Mr. Kane, without his knowing it,” he says to Bernstein, as Kane dances in the background, unaware of their conversation. Sound It’s also often noted that Welles brought his background in radio with him to the screen, and many of the most memorable leaps in time and location in the film are assisted by an inventive use of sound. “Merry Christmas,” a young Kane says petulantly — before the film cuts to Thatcher saying “and a happy New Year,” reading aloud from a letter he has written to Kane in advance of his 25th birthday. “I’m going to send you to Sing Sing. Sing Sing, Gettys! Sing Sing!” Kane shouts to the political boss Jim Gettys (Ray Collins) — and the words “Sing Sing” are cut off (almost echoed) in the sound of a car horn honking. As reporters in the finale sift through Kane’s belongings, their voices overlap and complement each other in a technique derived from theater and radio. This was also the first film composer Bernard Herrmann scored, and the foreboding brass and woodwinds over the movie’s first shots portend his future, indelible collaborations with Alfred Hitchcock.

Kevin Durant and Kyrie Irving shine in preseason homecoming By SOPAN DEB

t’s rare that an NBA preseason game is must-see television. But Sunday night’s matchup featuring the Brooklyn Nets and Washington Wizards might have been the most anticipated preseason game in New York basketball history. Steve Nash roamed the sidelines for the first time as head coach. But more important for Nets fans and the franchise, Kyrie Irving and Kevin Durant, one of the most talented duos in the league with a combined 16 All-Star selections, took the floor for the first time as teammates after injuries forced Durant to miss all of last season and limited Irving to 20 games. The Nets won, 119-114, at Barclays Center but what mattered was the product on the floor: Durant and Irving looked every bit the All-Stars they have been their entire careers. Let’s put in a caveat here: It was one preseason game. One. Preseason. Game. Players aren’t in shape yet. They are rusty. Coaches are still figuring out their personnel. But preseason or not, Durant and Irving mostly looked like the same players, and that alone is enough reason for Nets brass to be optimistic about their championship aspirations for the 2020-21 season. If this was what the rusty versions of Durant and Irving could do, what will the in-rhythm ones look like? It took all of 46 seconds to get Nets fans salivating, when Durant, who won the MVP award in 2014, drove along the baseline on the left side for an open dunk. It was his first basket in a game since Game 5 of the 2019 NBA Finals, when Durant tore his right Achilles tendon, one of the most serious injuries a basketball player can suffer. But Durant showed minimal sign of that injury. He made all three of his field goals in the first quarter and looked spry running up and down the court. like joy and a love for the game every day when he comes to work. So it’s beautiful to see him back on the basketball court. I think the world missed him out there.” Irving was not any different, matching Durant shot for shot early on. In the first half, Irving went 7 of 9 from the field for 18 points and added four assists before checking out for good. While Durant is one of the best shotmakers in NBA history, Irving is one of the best dribblers the league has ever seen. That ability was on full display Sunday night, as he easily made creative angles on jumpers. “That’s one of the perks of this position is you get to coach two incredible players,” Nash said. “Ky was super sharp and Kevin, after such an extensive layoff, was very good and close to being incredible. He’s going to keep building and getting comfortable. When you have that kind of injury, it’s kind of remarkable that he’s at the level he’s at.”

Entering the game, there was some intrigue over what kind of offense Irving and Durant wanted to run, as a result of an Instagram Live session the two held Saturday. During their talk, Irving argued that he should receive eight post-ups a game, because of the mismatch he thought it would create. This would be a highly unconventional use of a point guard, typically the quarterback of the offense from outside the 3-point line. Durant disagreed with Irving’s assessment, saying, “I don’t think that’s good for the continuity of our offense if our point guard always wants to be underneath the rim.” As they continued to debate the finer points of Irving’s proposal, Durant essentially ended the conversation with, “We’re going to see, though.” Irving did not receive the ball much under the basket Sunday night, like he had pitched. He didn’t need to. He got his shots off as he had his entire career: whenever and wherever he wanted. “Kyrie looked incredible,” Durant said. “I mean, he’s unstoppable. He’s a master at his craft. So he could do pretty much whatever he wants out on the floor. He set the tone for us.” Nets guard Spencer Dinwiddie said after the game that he was “not too surprised” by the strong play of Durant and Irving. “They’re phenomenal scorers, obviously,” Dinwiddie said. “And best friends. So I think the flow and the vibe that they’re going to have is going to be one of the best duos in the league, if not the best duo in the league.”

Cleveland’s baseball team will drop its Indians team name By DAVID WALDSTEIN and MICHAEL S. SCHMIDT

ollowing years of protests from fans and Native American groups, the Cleveland Indians have decided to change their team name, moving away from a moniker that has long been criticized as racist, three people familiar with the decision said Sunday. The move follows a decision by the Washington Football Team of the NFL in July to stop using a name long considered a racial slur, and is part of a larger national conversation about race that magnified this year amid protests of systemic racism and police violence. Cleveland could announce its plans as soon as this week, according to the three people, who spoke on condition of anonymity because they were not authorized to speak publicly on the matter. It is not immediately clear what Cleveland’s exact steps will be beyond dropping the Indians name. The transition to a new name involves many logistical considerations, including work with uniform manufacturers and companies that produce other team equipment and stadium signage. One of the people said Cleveland planned to keep the Indians name and uniforms for the 2021 season while working to shift as early as 2022. Cleveland spent much of the year before the 2019 season phasing out the logos and imagery of the cartoon mascot Chief Wahoo. One option that the team is considering, two of the people said, is moving forward without a replacement name — similar to how the Washington Football Team proceeded — then coming up with a new name in consultation with the public. The Cleveland baseball franchise has been known as the Indians since 1915, but Native American groups and others have for decades opposed the use of Indigenous names, mascots and imagery for sports teams, insisting they are demeaning and racist. Cleveland’s name and Washington’s old name were considered among the most high-profile examples and were the targets of widespread campaigns for change.

Shane Bieber won the 2020 American League Cy Young Award for Cleveland. The team already has uniform options that do not incorporate their former name. The Cleveland team did not immediately comment. Other professional sports teams, including the Atlanta Braves, the Kansas City Chiefs and the Chicago Blackhawks, have said in recent months that they have no plans to change their names. Many universities and high schools abandoned Native American names and mascots long ago, but efforts to address the names at all levels of sport in the United States have increased in recent months. For Cleveland, the process began when it announced it would retire its longtime mascot, Chief Wahoo, a cartoonish caricature that was seen as particularly offensive. Many applauded the decision, but insisted the team name must go, too. Then in July, just hours after Washing-

ton announced it would change its name (under pressure from key sponsors like FedEx, Pepsi and Nike), Cleveland said it would conduct a “thorough review” of its nickname. The team has consulted with many Native American groups, both in Ohio and nationally. “We are committed to engaging our community and appropriate stakeholders to determine the best path forward with regard to our team name,” the team said in a statement in July. Native American groups usually appear at Cleveland’s home opener each spring, sometimes in the face of withering verbal abuse from fans as they enter the stadium. In recent years, the team has worked with the protesters and police to help ensure the safety of demonstrators and

their right to free and peaceful expression. The club has said that the name was originally intended to honor a former player, Louis Sockalexis, who played for the Cleveland Spiders, a major league club, in the 19th century and was a member of the Penobscot Nation. Some have suggested that Cleveland adopt the name Spiders as a replacement. Cleveland’s name was long accompanied by the Chief Wahoo logo. Phasing the image out included removing the logo from uniforms and from walls and banners in the stadium. A block “C” was adopted in its place. “Our organization fully recognizes our team name is among the most visible ways in which we connect with the community,” the team’s July statement said.
