he independent coordinator (IC) hired by the Puerto Rico Energy Bureau (PREB) to advance the use of renewable energy sources announced it will request proposals for renewable energy and energy storage resources for the Puerto Rico Electric Power Authority pursuant to Tranche 2 request-forproposal projects. Accion Group wants to procure up to 500 megawatts (MW) of renewable resource generating capacity and 250 MW of energy storage capacity. The IC and the PREB will host a stakeholder webinar tentatively scheduled for Jan. 28. All interested potential market participants and interested persons are urged to register for the webinar through the IC website, according to a notice published Tuesday on the web page of Accion Group, a mainland firm. “This RFP will be administered and evaluated by the Accion Group LLC (Accion), the program Independent Coordinator,” the notice said. “Accion hosts a website that serves as the required vehicle for all RFP communications. Interested respondents and each interested party must be registered on Accion’s website to view all associated information related to this RFP.” The notice advised against approaching the PREB directly, warning that all bids and communications are to be submitted online through the website. The notice said that attempts to contact PREB concerning

the RFP may result in the bidder being barred from participating in the RFP. Puerto Rico can help mitigate the high costs of fossil fuels by investing in renewables, but PREPA has been moving at a snail’s pace in reducing its dependence on those traditional fuels, according to the PREB. Because of problems and delays in the delivery of renewable energy projects, the PREB in November stripped PREPA of its oversight authority with respect to the requests for proposal (RFPs) for Tranche 2 renewables. The PREB said “the process conducted by PREPA in connection with the Tranche 1 RFP suffers from numerous shortcomings and failed to comply with important directives and milestones established in the Approved Integrated Resource Plan (IRP),” which is the island’s long-term energy needs plan. “If the Energy Bureau takes no further action, the implementation of the renewables procurement plan, as well as the integration of renewable energy into the Puerto Rico electrical grid system to meet the applicable Renewable Portfolio Standard, will be at risk,” the regulator said. “There is an urgent need to properly implement the Approved IRP directives regarding the integration of renewables in order to reform the electrical system and meet energy public policy goals.” Accion Group was hired to take charge of all Tranche 2 projects as an independent coordinator.

Fiscal board exploring options for ensuring pensions, benefits for retired police By THE STAR STAFF

he Financial Oversight and Management Board for Puerto Rico says it is evaluating alternatives for ensuring that police officers have adequate pensions and benefits when they retire. Oversight board chairman David Skeel, board member Andrew Biggs, and executive director Natalie Jaresko met with representatives of Puerto Rico’s police force and their unions to discuss retirement benefits for active police officers affected by Act 447-1951 and Act 1-1990, and healthcare benefits for retired police. “The Oversight Board fully understands the concerns expressed by the officers during the meeting about their future retirement benefits and health care coverage,” the oversight board said in a statement. “Ensuring police officers receive the benefits needed for a financially secure retirement is one of the Oversight Board’s priorities and the meeting on Tuesday afternoon was

it reached an agreement with the administration of Gov. Pedro Pierluisi Urrutia to work together over the next 60 days on

Further, the oversight board said it has agreed in principle to provide health coverage to certain retired police officers through the commonwealth’s state-runVital Plan and is in the process of working out the details of the coverage in the updated fiscal plan that the oversight board intends to certify soon. “Public safety is essential for the quality of life of every Puerto Rican and our police officers play a critical role in ensuring our security and well being,” the oversight board said. “The Oversight Board has supported and continues to support Puerto Rico’s police officers and their critical service to protect and serve the island’s residents and businesses.” The oversight board and the police representatives agreed to meet periodically and discuss progress made toward resolving their concerns about retirement benefits.

hrough an administrative order, Puerto Rico Supreme Court Chief Justice Maite Oronoz Rodríguez on Wednesday established in a written statement the measures that the island’s Judicial Power will take in attending to electoral matters related to Saturday’s special election to fill the vacant mayor’s seat in Guaynabo. On the day of the special election, the judicial centers of the judicial regions of Bayamón and San Juan will remain open from 9 a.m. to 3 p.m. to attend to any electoral matters that are presented. Likewise, the secretarial offices of the Court of Appeals and the Supreme Court will be open at the same time to receive any petition related to an electoral case.

The judges who will address electoral matters of a civil and criminal nature related to the special election were previously appointed by administrative order. Complaints in electoral cases of a criminal nature may be submitted through the Unified Case Management and Administration System. Likewise, lawyers must present electoral cases of a civil nature through the electronic platform as usual. People who appear in their own right may physically present their cases at the Bayamón and San Juan Judicial Centers. Meanwhile, according to the Electoral Code of Puerto Rico of 2020, cases in which the election is contested, as well as all appeals for review filed with the Special Election Commission, will be filed at the San Juan Judicial Center.

Couple that failed to turn in traveler’s health statement is arraigned By THE STAR STAFF

A

couple who on Jan. 2 failed to submit a traveler’s statement related to COVID-19, and who barricaded themselves with their children inside a car in Caguas to avoid arrest, were arraigned by a San Juan court Wednesday. Zulma Figueroa, 53, and Luis Ángel Colón, 44, failed to show up Tuesday at a scheduled court hearing in Carolina. The judge in the case issued an arrest warrant against them. When the police officers showed up, the couple and their children locked themselves in their vehicle in Caguas to avoid arrest. Both are accused of violating article 246 of the Penal Code (resisting or obstructing the exercise of authority), for which they face a six-month prison sentence. San Juan Court Judge Raiza Cajigas, through videoconference, scheduled the start of the trial for Feb. 8, but in the Carolina Court. During the ordeal Tuesday night, Figueroa, who has been dubbed the “Puerto Rican Karen” for refusing to obey the executive order on COVID-19 protocols, revealed her version of the events via social media.

“Here in my vehicle, where the Health Department, because now it is not the Police, it is the Health Department that believes it has jurisdiction to restrict freedom for citizens, men and women of this land of Puerto Rico,” she said. “I am not the legal person that was summoned with that lie that [the Secretary of Health, Carlos] Mellado is telling that I was summoned. I presented myself yesterday to the Legal Division of the Puerto Rico Department of Health and I left some notifications and clear laws and I am waiting for them. They were given five days to reply.” Meanwhile, Citizen Victory Movement Rep. Mariana Nogales proposed on Wednesday that all violations to executive orders be considered administrative violations with fines of up to $500. “We can’t continue to give blank checks to the executive branch, more so in a government that has been shown to be authoritarian and hate democracy,” the lawmaker said. “The system of checks and balances must be respected and we must protect people from abusive laws.” The courts have already determined that laws establishing limits to stop the spread of COVID-19 are constitutional.

T

he Puerto Rico Journalists Association, the Puerto Rico Photojournalists Association and the Overseas Press Club condemned the physical and verbal attacks against photojournalists and reporters on Tuesday night in Caguas while exercising their duties in the coverage of an intervention in which the Puerto Rico Police Bureau and the Department of Health executed an arrest warrant against citizens who had refused to complete the traveler’s information document at Luis Muñoz Marín International Airport in Carolina.

Several journalists were in the perimeter established by the police as protesters shouted insults, attempted to intimidate and even physically attacked the journalists, the press groups said.

Four photojournalists, three reporters, and a news producer were verbally and physically assaulted and unable to carry out their work when a score of protesters arrived in support of the suspects, who were identified in local press reports as Zulma Figueroa, 53, and Luis Ángel Colón, 44. The journalists were in the perimeter established by the police as the protesters hurled insults while chasing and trying to intimidate the journalists, the groups said. Some even caused damage to property and physically attacked the journalists. “This type of aggression is unacceptable, no matter who it comes from,” said Josian Bruno, president of the Photojournalists Association. “Freedom of expression is a constitutional right, but it cannot justify the attempt to restrict other rights such as freedom of the press. What happened there was a direct attack on journalists that could be observed live through images on television. The verbal and physical aggression against our colleagues is a reprehensible act.” In the same way that citizens have the right to demonstrate, journalists are also empowered by the Constitution to exercise their work free of coercion or intimidation, the three organizations said. “Reporters and photojournalists are like any worker. We understand and accept that our profession exposes us to finding ourselves in the midst of difficult and sometimes violent conflicts in which we can suffer collaterally,” Press Association President Damaris Suárez said. “What is unacceptable are the violent attacks specifically directed at our colleagues when they are only fulfilling their duty to inform the people.”

Luis Guardiola, president of the Overseas Press Club, said “we call on law enforcement authorities to take measures that allow the free exercise of our informative work, while safeguarding the rights of citizens to demonstrate guaranteeing the physical integrity, life and property of all.” He also called on news directors to raise a similar demand to the authorities and adopt security measures that protect their journalists in such situations. The three organizations reiterated that no incident will prevent the press from fulfilling its responsibility.

FAA allocates $8 million to boost capital improvements at airports By JOHN McPHAUL jpmcphaul@gmail.com

P

uerto Rico Ports Authority Executive Director Joel A. Pizá Batiz on Wednesday announced the awarding of a grant of over $8 million by the Federal Aviation Administration (FAA) to subsidize capital improvement projects in the island’s airport system. The award comes as a result of the congressional approval of the Bipartisan Infrastructure Law promulgated by the administration of President Joe Biden, which enabled about $2.9 billion for infrastructure projects in more than 3,000 airports around the United States. In keeping with the anticipated purpose of the grant -- whose parameters and final guidelines will be specified by the FAA shortly -- Pizá Batiz noted that Ports will propose to the FAA to use the funds to expand the capital improvement program at its airports. Specifically, the Ports chief announced his intention to request that the items be used for the expansion project of

At those airports, the possibility of improving parking lots and drop-off areas is under consideration. Transportation and Public Works Secretary Eileen Vélez Vega said “this is one more step in the right direction to achieve a Puerto Rico with better infrastructure at our airports.” “This allocation of funds is consistent with our priority to maximize federal funds and thus continue to generate the trust placed in our government to manage these important funds in a responsible manner and for the benefit of the people,” she said. “The awarding of this grant will allow us to continue advancing the commitment and public policy promoted by Gov. Pedro Pierluisi to optimize our airport assets in structural and operational terms for the enjoyment of all,” Pizá Batiz added.

FEMA stays focused on earthquake recovery By THE STAR STAFF

T

wo years after the series of earthquakes that hit Puerto Rico at the end of 2019 and beginning of 2020, recovery work continues with the help of over $523 million allocated by the Federal Emergency Management Agency (FEMA). The funds are being distributed among projects comprising the 14 municipalities of the southern, western and central parts of the island. Among the structures sustaining the most damage because of the earthquakes were the schools in the regions, many of which had the “short columns” structural problem, which makes them more vulnerable to seismic events. To repair those and other structural damages on more than 126 schools, FEMA allocated at least an additional $178.3 million in 2021 to the island Department of Education. “Puerto Rico’s history changed be-

cause of these earthquakes,” said José G. Baquero, FEMA’s federal disaster recovery coordinator in Puerto Rico. “As of today, more than 518 projects have funds from the agency, mostly for schools and municipalities. We seek to take advantage of this unique opportunity to strengthen the structures where public education is provided and additional spaces within the affected area.” According to FEMA, in addition to repair and reconstruction work for the schools, public buildings and roads, recovery efforts include private property debris removal. More than 86 residences in Guánica and Yauco have already been demolished, which will start the long-term recovery process for the affected families. In this journey toward recovery is Janet Vega Padró, resident of the Esperanza neighborhood in Guánica, who lost her home because of the earthquakes. “The first step has already been taken, which is the demolition,” she said, adding

that she expects to begin rebuilding her home with the funds she received from FEMA. Meanwhile, public buildings such as police stations, fire stations and judicial

centers also received federal allocations for repairs. One of those obligations to the Public Buildings Authority was for over $8.4 million to repair facilities in affected municipalities.

Biden’s longtime defense of Senate rules withers under partisan rancor By MICHAEL D. SHEAR

P

resident Joe Biden’s decision to call for changing the Senate’s rules to pass voting rights protections was a long time coming. Perhaps — in the view of his most disaffected supporters — too long. A self-proclaimed institutionalist who spent more than three decades abiding by those rules as a senator, Biden repeatedly defended the often-arcane procedures of the Senate, even as Republicans used them to block his agenda and he came under increasing pressure from liberal activists in his party to rethink his position. Those rules, he said with admiration more than a decade ago, were about “compromise and moderation,” a core part of his political identity. To support changing them would be to admit that the principles he so cherished had withered in a city now consumed by partisan rancor. On Tuesday, he made that admission. “The threat to our democracy is so great that we must find a way to pass these voting rights bills,” he said in an impassioned speech in Atlanta on the grounds of Morehouse College and Clark Atlanta University. “Debate them. Vote. Let the majority prevail. And if that bare minimum is blocked, we have no option but to change the Senate rules, including getting rid of the filibuster.” Biden said that he had been “having these quiet conversations with members of Congress for the last two months” in the hopes of reaching the kinds of negotiated agreements that he pursued as a senator. “I’m tired of being quiet,” he said. It is far from clear that Biden’s words will succeed in convincing the most prominent opponent of a rule change among Senate Democrats — Joe Manchin of West Virginia — to help break the Republican logjam on voting rights legislation. On Tuesday, Manchin said again that he opposed “getting rid” of the filibuster, which allows the minority party to block legislation that fails to garner 60 votes. Some of Biden’s closest allies said they remained deeply frustrated by the president’s willingness to lead from behind on the issue of voting rights. “We had hoped he would have used his bully pulpit a long time ago for voting rights and we wouldn’t be at this critical junction,” said Helen Butler, a Black Democrat who was removed from a local election board in Morgan

Democrats who are trying to prevent Republicans from blocking voting rights legislation said they were pleased that Biden had finally come around. And they are hopeful — but realistic — that his voice may help to convince a handful of senators to back a change in the filibuster rules in the days ahead. Sen. Tim Kaine, D-Va., who has been leading talks to amend the rules, said Biden came into office with a “particular obligation on his shoulders” — to stand up for voter rights in the wake of the violent assault on the Capitol in January 2021 as his election victory was being certified. “When somebody who understands the Senate and loves it as much as he does says it’s time to make a change to accomplish a paramount result that the nation needs, it does have an effect,” Kaine said. For some presidents, choosing to support a change in Senate rules to protect voting rights might also have foreshadowed a broader awakening to the realization that the Senate was no longer a place where partisanship could be put aside for the good of the country. That is certainly the view of many in his party, who assert that far-reaching legislation

like the president’s Build Back Better package and gun control proposals are doomed to falter without wholesale changes to the Senate’s rules. In effect, they argue that today’s intense partisanship has led to an ideological stalemate that justifies burning down the house in the name of progress on many fronts. “He should have made this much more a priority for his administration,” said Fred Wertheimer, the founder and president of Democracy 21, a group pushing for changes to the Senate rules. “But he still can make a critical contribution by speaking out and by actively and forcefully engaging in the battle.” Biden left no doubt that he has reached a breaking point when it comes to voting rights, lashing out at the holdouts in the Senate and

comparing them to some of the country’s most infamous racists. In doing so, he made no distinction between the Senate’s Republicans and a handful of Democrats who are standing in the way of the legislation. “Do you want to be on the side of Dr. King or George Wallace?” he declared, prompting some gasps from supporters in the audience. “Do you want to be on the side of John Lewis or Bull Connor? Do you want to be the side of Abraham Lincoln or Jefferson Davis?” But for Biden, the slow-moving evolution from protector of the Senate rules to a president open to getting rid of the filibuster to advance voting rights legislation hardly appears to be part of a wholesale transformation in his approach to governing in the modern era. Even as White House officials previewed Biden’s remarks on Monday night, they went out of their way to insist that he remained “an institutionalist,” an acknowledgment that his willingness to change has its limits. Kaine said the president viewed the need to protect voting rights as a special responsibility, separate from other parts of his policy agenda. “He probably wouldn’t be leaning into Senate rules, reform proposals on any other issue, even issues that he thinks are very, very important,” Kaine said. “I can’t imagine him probably, you know, making recommendations to the Senate about what we do with rules on any topic other than this.” As he left the White House to travel to Georgia on Tuesday, the president was asked what he risked by fighting for voting rights legislation, a reference to the political dangers of promising more than he can deliver. “I risk not saying what I believe. That’s what I risk,” Biden said. “This is one of those defining moments. It really is. People are going to be judged, where were they before and where were they after the vote. History is going to judge this.”

What to make of those soaring COVID counts

Comparing the average daily COVID case counts, state by state, since the pandemic’s beginning. By LAZARO GAMIO, LISA WAANANEN JONES and AMY SCHOENFELD WALKER

C

oronavirus case counts have reached record highs in the United States and continue to climb. Hospitalizations have surpassed last winter’s wave. Deaths are also beginning to rise. The overall pattern is familiar, but a fresh perspective on how to interpret these metrics may be necessary as a faster but less severe variant tears through the country. Here’s how to interpret the data in the coming days and weeks. Omicron still has room to grow In just a matter of days, coronavirus case counts have shattered previous records in the United States, as the omicron variant spreads rapidly just about everywhere, including in communities with high vaccination rates. All but eight states have seen record cases in January. While these case counts are staggering, experts say they are not as alarming as they might have been a few months or a year ago. Instead, they should serve as a warning for the country to adjust behaviors and policies to reduce infections and protect the most vulnerable. “The circumstances have changed, and we must adapt,” said Dr. Shama Cash-Goldwasser, a senior technical adviser at Resolve to Save Lives, a global health organization. “We have a less severe variant, plus many are vaccinated, but evidence suggests the vaccines are not as good at preventing infection with omicron as

they were against delta.” As high as the case counts are in many places, they are most certainly undercounted right now, as many omicron infections are asymptomatic or mild, and people may not know to test. Testing shortages are also limiting access, and experts say that a majority of results from popular at-home tests are not reported to public health departments. The sharp rise in cases in many states could be followed by sharp falls, as observed in South Africa, but experts caution that the sheer volume of cases could still lead to significant numbers of extremely sick people, even from a variant that overall gives people less severe disease. “We are going to have a lot of people sick, and even if a smaller proportion of those individuals have really horrible illnesses and adverse outcomes, it’s still a lot of people,” said Janet Hamilton, executive director of the Council of State and Territorial Epidemiologists. Hospitals are likely to strain further Because the omicron variant appears to cause less severe illness, hospitalization figures may tell us less about the disease and more about the strain on the health care system, which has consequences for everyone. Hospitalizations have not yet seen the same explosive growth as cases, but this metric tends to lag case counts, and it may be too early to gauge omicron’s full effect. What is clear is that the number of people hospitalized with COVID nationwide has already reached a single-day

record and is still rising steeply. Hospitals, emergency rooms, urgent care centers and doctors’ offices are overburdened and understaffed across the country. Hospitals in some areas are already shutting down elective surgeries and must treat even critical care patients in emergency rooms. And in parts of the country like the Midwest, hospitals may be in a more precarious situation — they were already under strain, having yet to recover from the delta surge before omicron-led illnesses began to rise. Hospitalization figures are not without flaws. “National data don’t allow us to distinguish between people hospitalized because of COVID-19 and those who happened to test positive while admitted for something else,” said Jason L. Salemi, a public health researcher at the University of South Florida, who tracks COVID data. These “incidental patients” may be more prevalent right now because omicron is so transmissible. Some hospitals are reporting that these patients may make up as much as half of their hospitalizations. Salemi noted that a coronavirus infection can still exacerbate the primary illness of incidental patients, pose a risk of infection to staff members and other patients, and contribute to the overall strain on medical centers. National hospitalization data notably does not include up-to-date measures of severe illness, such as the number of people on ventilators or their length of stay. (Federal data tracks some of this, but it is about two months behind.) “The absence of these details about hospitalizations in the available data just muddy the water as we try to understand omicron’s impact,” Salemi said. Public health experts suggest monitoring COVID patients in intensive care as well as intensive care unit capacity to better gauge COVID’s effect on serious illness. About 1 in 4 U.S. hospitals with ICUs recently reported that at least 95% of their critical care beds were full. Deaths may rise, but not skyrocket There is hope that vaccination coverage, improved medical treatment and the milder characteristics of the omicron variant will mean that fewer infections end in death. But the unprecedented number of cases may still lead to high levels of mortality. “Are we going to see deaths increase? increase in cases to see a resulting increase in deaths, which may explain why death counts have risen only slightly. Trends in deaths lag behind cases and hospitalizations by weeks because of the time it takes for people to become seriously ill and the time needed to complete and file death records. This lag varies by state and often becomes longer in times when there are more deaths, or when a case surge is overwhelming the public health system, as it is now. Already, there are some troubling early signs of death counts rising in some of the Northeastern states first hit with omicron, including New York, Connecticut, New Jersey and Massachusetts. Deaths can generally be predicted by looking at hospitalizations and counting backward by three weeks, suggesting that deaths will almost double in the next three weeks, said Dr. David Dowdy, a public health researcher at the Johns Hopkins Bloomberg School of Public Health. But it’s still possible that deaths will not rise as sharply as cases and hospitalizations have, he added.

Desperate search for those missing in Bronx fire: ‘We’re still waiting’ By JAZMINE HUGHES and SEAN PICCOLI

W

orshippers at a mosque in the Bronx sat shoeless in small groups along the edge of the carpeted floor. Services were still almost an hour away, but as coffee containers arrived and cups were poured, the imam tried to comfort people caught between anguish and grief. They were all relatives of people still missing more than 24 hours after a fatal fire in a Bronx apartment building that killed 17, including eight children. As many as 12 members of the MasjidUr-Rahmah mosque were believed to have died in the fire, the imam, Musa Kabba, said. “We give them the pictures. We give them the names. We give them the phone numbers. We’re still waiting for them to identify them,” Kabba said. OnTuesday night, the city released a partial list of the deceased. The chaos of the rescue and the striking number of victims complicated the identification process. On Sunday, more than 60 fire victims initially went to four different hospitals in the Bronx. Seventeen of them died within hours, all of the deaths attributed to severe smoke inhalation. About a dozen critically ill patients were stabilized at local hospitals and later transferred to facilities with specialized burn units in Manhattan, Westchester County and other parts of the Bronx. Many survivors were also treated for severe smoke inhalation, which can cause people to become unconscious from lack of oxygen. Not everyone carried identification, and some residents shared similar names to other family members. Multiple members of a single family were close in age, also adding to confusion. Features like tattoos, body jewelry, nail art and scars were used to piece together identities of the deceased, the medical examiner’s office said. The office has used DNA matching to confirm identities by obtaining DNA from relatives and notifying immediate family members after a match has been made, City Hall officials said. The deliberate process has contributed to a lag in releasing the names of the deceased, officials said. Shivonne Hutson, the city’s executive director of forensic investigations, said forensic examiners were also mindful of language and religious differences. Many of the building’s residents had relocated to the Bronx from Gambia, a small West African country with a largely Muslim population. “Observances — these things extend not just in life, but they carry on into death,”

Hutson said. Age, too, was a complicating factor: Without any identification or little previous medical history, the children posed a particular challenge. “Kids don’t have all the records,” like fingerprints or dental records, that adults may have, Hutson said. After the flames subsided and the fatal smoke dissipated, a new horror crept in: Other residents, family members and friends were left unsure about the status of loved ones. Hours rolled by, and many people across New York and Gambia spent hours in excruciating limbo, unsure who was alive or dead. Some families called every hospital in the area, searching for missing relatives. Others visited on foot, desperate for answers. Aid workers at Monroe College, which is serving as a temporary emergency response center, have been relying on an unofficial list of the dead, injured, missing and displaced, compiled by a local community board member. He has tried to write down the names, contact information and needs of every person who shows up at the college, in an ad hoc intake list. Gathering information is hard, in part because of language barriers, said Abdoulaye Cisse, a community outreach worker for CAIRNY, a group that advocates for Muslims. Some residents speak English, but others speak only various combinations of French and the many languages of West Africa. Fears of immigration authorities linger among some undocumented residents. And some families, he said, are deeply private or are in shock and not ready to talk about their situation. Dustin Jones watched television footage of the Bronx fire from his apartment in the Chelsea area of Manhattan, frantically calling a friend who he thought lived in the building. Luckily, he was mistaken — she lived a few blocks away — but his relief didn’t last long. He quickly learned he knew two residents of the building: Ramel Thompson, 44, and Dorel Anderson, 38, a couple. The three had met each other through a tight-knit disability community: Thompson and Anderson both have cerebral palsy, and Jones is an advocate for disability rights. After failing to contact the couple, Jones and about 100 others, many of them relatives of the couple and members of the disabled community, began a 24-hour search for them, much of it online. He also knew the couple lived on the 13th floor, and was particularly worried about Anderson, who uses a wheelchair. Jones said he never considered contacting the city for assistance. Instead, he amplified the

Anderson and Thompson were still being treated; Anderson’s wheelchair was missing. Mohamed Kamra, too, was working a shift as a taxi driver when he learned that his family was caught in the blaze. He and a relative frantically tried to locate their entire family. Soon, they found 6-year-old Jabu, 3-year-old Abubakary and baby Ceesay, not yet 1 year old. But it took hours for Kamra to locate his wife, Fatoumatia, or his eldest daughter, 8-year-old Mariam. Christina Kharem, a teacher and special education coach at Mariam’s school, spent her day on the phone with her principal calling hospitals around the city, trying to locate Miriam and her mother, while Kamra searched in person. He found Mariam and Fatoumatia by Sunday evening. Each family member was in medically induced comas and on ventilators. By Monday afternoon, Kamra had visited four of his hospitalized family members and was on his way to see a fifth. Relieved that he tracked down his family, he remained optimistic Monday night that they would recover. “For me, right now, it’s no bad

memory yet,” he said. But for some, hope diminished as the hours went by without news. Yusupha Jawara told CBS New York that he called 311 more than 40 times trying to learn the fate of his younger brother and sister-in-law, who lived in the building, a block from him. “We tried all they said,” Jawara, 47, said. “Nothing is working for us now.” He said he understood there were procedures to be followed. “But we need a closure on this to know whether they are alive or dead,” Jawara said. “That’s all we need. We are not asking for the bodies to be given to us right now. He’s alive or he’s dead. That’s all we need to know.” At about 4:30 p.m. Monday, Jawara texted a reporter that he had received word: His brother and sister-in-law perished in the fire.

Rise in real bond yields may slow but not stop stock market bulls T he sudden surge in inflation-adjusted bond yields this month rocked TINA, the thesis that “there is no alternative” to stocks, but if history guides us, stocks should resist this rise in real interest rates or even prosper. With 10-year inflation-adjusted U.S. bond yields below minus 1%, many investors view stocks as the only current asset capable of generating high returns. TINA is believed to have driven the nearly US $ 1 trillion inflows into global equity funds last year, a figure that BofA data shows topped the combined inflows of the previous two decades. However, with US inflation peaking at around 7% and the Federal Reserve likely to hike interest rates 3-4 times this year, real yields – the nominal interest rate paid by a bond minus the rate d inflation – are on the rise. Stocks fell after a spike in US yields. The impact has been particularly severe on the technology-intensive Nasdaq 100 index, where stocks trade on the principle of exceptional future earnings growth, making them particularly vulnerable to higher interest rates. . The Nasdaq is expected to experience its second worst start to the year since the 2008 crisis, coinciding with a 40 basis point jump in ten-year inflation-adjusted yields since December 30. But banks, including JPMorgan and Goldman Sachs, are still advising clients to buy the downside, arguing that real yields remain deeply negative around -0.8%, that higher interest rates are already being factored in and that corporate earnings are strong. Importantly, stocks have performed well in many previous bouts of rising real returns, provided economic growth holds. Bernstein notes, for example, that during the last five rounds of real rate “normalization” in 1975, 1980, 2012-2013, 2016 and 2020-2021, global stocks have returned between 2.3% and 51, 8%. “Historically, when real returns have gone back to zero from negative levels, stocks have had positive returns,” Bernstein strategists Sarah McCarthy and Mark Diver told clients. Separately, data from Truist Advisory Services shows that the S&P 500 has posted positive returns in 11 of 12 cycles of real rate hikes since the 1950s. Additionally, real yields are expected to rise at a more gradual rate and will not hurt markets or economic activity until they actually turn positive, JPMorgan said, forecasting year-end levels around -0.25%. Putin’s next move on Ukraine is a mystery. Just the way he likes it.

P

resident Vladimir Putin of Russia has spent months massing close to 100,000 troops near the Ukraine border. But Moscow says it has no intention of invading. What is Russia’s next move? No one knows, except perhaps Putin. And that is by design. The mystery surrounding the Russian leader’s intentions was thick as fog again this week, after a top Russian diplomat delivered a series of seemingly contradictory messages upon emerging from two days of high-stakes security talks with the United States. Moments after declaring the talks “deep’’ and “concrete,’’ Deputy Foreign Minister Sergei Ryabkov warned that failure to meet Russia’s demands could put the “security of the whole European continent” at risk. The gyrating, often ominous positions helped stump even some of those who make a living from decoding Putin’s intentions. “The expert opinion that I can au-

thoritatively declare is: Who the heck knows?” Fyodor Lukyanov, a prominent Russian foreign policy analyst who heads a council that advises the Kremlin, said in a telephone interview. Analysts said that not even members of Putin’s inner circle — let alone Ryabkov, who led Russia’s delegation at this week’s Geneva talks — were likely to know how seriously Putin is contemplating full-scale war with Ukraine. Nor would they know what U.S. concessions he is prepared to accept in order to defuse the crisis. Instead, Putin is likely not even to have made a decision, according to Russian analysts as well as U.S. officials. And he is relishing keeping the West on edge. “What matters is results,” Putin’s spokesperson, Dmitry Peskov, told reporters Tuesday, maintaining the suspense. “For now, there is nothing to say about any results.” The talks will continue Wednesday, when Russian officials will meet representatives of the United States and its NATO allies in Brussels, and Thursday at a gathering of the Organization for Secu-

rity and Cooperation in Europe, a 57-nation group that includes Ukraine as well as Russia and the United States. After that, Peskov said, Russia would decide “whether it makes sense” to move forward with diplomacy. Putin’s brinkmanship of recent months is a case study in his ability to use tension and unpredictability to seek high returns with what may seem like a weak geopolitical hand. Struggling with a stagnant economy and tattered alliances, Russia is also dealing with volatile situations on at least four borders — with Belarus, Kazakhstan, Ukraine and the Southern Caucasus. For years, Putin has fumed over NATO’s expansion eastward and U.S. support for pro-Western sentiment in Ukraine; now, by creating a new security crisis that threatens to complicate President Joe Biden’s agenda, he has succeeded in getting the issue to the forefront in Washington. “For the first time in 30 years, the United States has agreed to discuss issues that it was impossible to discuss even a year ago,” said Tatiana Stanovaya, founder of the political analysis firm R.Politik. Now that the Russian president has Americans at the negotiating table, he is pursuing another classic Putin strategy: putting so many potential moves on the playing field — pointing in so many different directions — that he leaves people guessing, allowing him to choose the tactics that best suit him as events evolve. Ryabkov, for instance, told reporters that he was making no ultimatums and foresaw no “deal breaker.’’ But he added that it was “absolutely mandatory” that the United States guarantee that Ukraine would never join NATO. He said Russia was imposing no specific timeline but that it needed a “fast response” to its demands. And while he said there was “no reason to fear an escalation scenario” in Ukraine, he warned that the West still failed to grasp how dangerous it would be to rebuff Russia’s demands. The contradictory messaging con-

tinued Tuesday when Peskov countered any positive assessments Ryabkov might have offered the day before. “For now, we do not see any substantive reason for optimism,” he said in his daily conference call with reporters. The problem with Putin’s approach is that it gives his diplomats next to no flexibility to negotiate on Russia’s behalf and sometimes leaves them struggling to maintain a coherent message. Stanovaya warned that even if diplomats did reach some kind of deal, hawks in Moscow who have more of Putin’s ear could soon help derail it. Analysts noted that Ryabkov, from the diplomatic side, most likely did not even know what military options the Kremlin was considering. The virusfree cocoon Putin has tried to establish around himself has meant that even confidants are forced to spend days in quarantine before being allowed into the same room with him, further reducing his connections with the outside world. “No one knows with 100% certainty whether Putin is ready for war, or whether this is a bluff or not,” Stanovaya said. While Putin may have succeeded in getting the U.S. to agree to talk — even though Moscow’s demands appeared to be nonstarters — Stanovaya and others warned that at this point, talks alone are not enough for him. As best analysts can tell, it is the demand that NATO offer some kind of formal assurances not to expand eastward and to cease military cooperation with Ukraine that is now most important for Putin. The U.S. offer in Monday’s discussions to negotiate missile placement and military exercises in Europe is also of interest to Russia, but Ryabkov indicated that these issues are a lower priority. NATO has repeatedly ruled out the idea that it would allow any other country to veto who can and cannot be in the alliance, creating what appears to be an impasse. Still, Lukyanov said the fact that the talks did not immediately collapse means that both sides may see some path — currently invisible to the outside world — to achieve a workable result.

Kazakhstan says Russian troops can start leaving this week By VALERIE HOPKINS and IVAN NECHEPURENKO

A

Russian-led military alliance will begin withdrawing its troops from Kazakhstan in two days, the country’s president announced Tuesday, saying it had fulfilled its primary goal of helping stabilize the Central Asian nation as it experienced the worst political crisis in its history. In a speech to senior government officials and members of Parliament, President Kassym-Jomart Tokayev said the withdrawal would take “no more than 10 days.” In Moscow, Russia’s defense minister, Sergei K. Shoigu, did not mention specific plans for the troops to withdraw, leaving it unclear when they would actually go home. Speaking at a meeting with the military top brass, he said that the Russian-led soldiers would “continue their mission until the situation fully stabilizes” but that it would be “up to the Kazakh leadership” to decide when that happens. So far, the military operation is regarded as a geopolitical triumph for President Vladimir Putin of Russia, who can present himself once again as an effective crisis manager for countries that Moscow considers within its sphere of influence. However, a slow withdrawal of the 2,500 Russianled troops may undermine that, given Russia’s record of sending “peacekeepers” to neighboring countries who do not leave. Troops that it dispatched three decades ago to a breakaway region of Moldova and the Abkhazia region of Georgia, for example, remain there. Ekaterina Shulman, a Russian political scientist often critical of the government, said troops overstaying their welcome could potentially cause an increase in anti-Russian sentiments in Kazakhstan. Speaking on independent Russian radio station Ekho Moskvy, she said, “So far, it seems like these days nothing of the kind is visible. But this is another thing to watch for.” Kazakhstan is part of an economic union with Russia, but because of its oil wealth it had been proud of retaining more autonomy than many other former Soviet states. A swift exit of the soldiers would most likely bolster Tokayev’s image, even if it exposed the vulnerability of postSoviet strongmen leaders, who have been forced to turn to Moscow when their rule is threatened. Daniil Kislov, an expert in Central Asia and editor of Fergana, a website that covers the region, said that by inviting the troops, “Tokayev gave a real gift to Putin.” “Putin is happy to use any opportunity to expand somewhere, be it Ukraine or some other unstable country where a good helping hand of Moscow might be needed,” he said. For Tokayev, the rapid dispatching of troops buttressed his grip on power at a time when it was most shaky. In his speech, Tokayev also announced steps to try to assuage anger at rampant economic inequality that was

at least part of the impetus for the protests. He announced a five-year salary freeze for top public officials and promised to destroy corrupt schemes that are widely believed to have benefited the country’s oligarchs. The crisis in Kazakhstan erupted last week after peaceful protests in the country’s west over a spike in fuel prices suddenly spread to the rest of the country. The unrest turned Almaty, the country’s biggest and most populous city, into a war zone with government buildings ablaze. More than 2,000 people have been injured so far, according to the government, and the health ministry issued, then withdrew, a statement Sunday saying that at least 164 people had died in the violence. Nearly 10,000 people have been detained, according to the government. Tokayev said he made the decision to seek help from the Collective Security Treaty Organization, the Kremlinled version of NATO for a group of former Soviet countries, at the time when the Kazakh government “could lose control over Almaty completely.” In another signal of the confusion that convulsed the capital last week, some Kazakh soldiers were seen wearing blue United Nations peacekeeping helmets — creating the erroneous impression that the organization was assisting in crushing the rioters. U.N. officials complained to Tokayev’s government about this misuse of peacekeeping equipment. Tokayev spent most of his career serving the state created by Nursultan Nazarbayev, the long-ruling former president who stepped down in 2019 and picked him as his successor. But in his speech, Tokayev seemed to lay the blame for his country’s upheaval squarely on his mentor’s shoulders. Without mentioning Nazarbayev by name, he denounced the country’s endemic cronyism and income inequality, and said that thanks “to the first president” a group of people “wealthy even by international standards” has emerged. “I think it is time they pay their dues to the people of Kazakhstan and help them on a systemic and regular basis,” he said. There is little serious political opposition in Kazakhstan, where protesters and activists face constant harassment or are pushed to leave the country. But Tokayev’s rare rebuke of his predecessor was indicative of the political infighting taking place at the highest echelons of power. Over the past week, Tokayev has reshuffled the leadership of Kazakhstan’s security forces. Karim Masimov, head of the main security agency who was widely seen as Nazarbayev’s close ally, was fired at the height of the crisis and later arrested on suspicion of treason. Several other high-ranking officials have been dismissed, local news media reported, citing government agencies. Djokovic admits false statement on Australia travel document

In a statement Wednesday, Novak Djokovic laid out what he said was the series of events before he received a positive coronavirus test. By YAN ZHUANG

N

ovak Djokovic, the top-ranked men’s tennis player, acknowledged Wednesday that a travel document he presented to Australian border officials last week contained false information, as the country’s authorities continued to investigate whether he should be deported. Djokovic also said that he had participated in an interview and a photo shoot last month in his native Serbia even after testing positive for the coronavirus, in an apparent breach of the country’s rules for infected people. Australian officials have said they are looking into whether Djokovic, who is unvaccinated, poses a risk to public health. The tennis star’s comments came in a statement he released on social media that he said was intended to “clarify misinformation” about the weeks before he arrived in Melbourne for the Australian Open. He was detained for days by Australian border officials before being ordered released on Monday

by a federal judge. But Djokovic’s statement did not fully resolve a range of questions that have swirled over his quest to remain in Australia and seek a record 21st Grand Slam title. Among them are exactly when he learned of the positive test result and how his travel documents came to falsely assert that he had not traveled internationally in the 14 days before his arrival in Australia. The statement posted on Instagram, which Djokovic said would be his last remarks about his ordeal in Australia, was released as the country’s immigration minister said he was still considering whether to exercise his personal powers to cancel the player’s visa again. Immigration officials were also investigating the discrepancies in the paperwork Djokovic presented as he tried to enter Australia last week with an exemption from a requirement for COVID-19 vaccinations. Australian tennis officials granted that exemption on the basis of what Djokovic had said was a COVID infection he had in mid-December. He had

come under criticism over images on social media showing him at events at the same time he was supposedly infected with the coronavirus. Djokovic said Wednesday that he had taken a PCR test on Dec. 16 after some people at a basketball game he had attended two days earlier tested positive for the coronavirus. Despite having no symptoms, he also took a rapid antigen test “out of an abundance of caution,” he said, and it came back negative. On Dec. 17, he said, as he was awaiting his PCR result, he attended a tennis event in Belgrade, the Serbian capital, where he presented awards to children. He said that he took another rapid antigen test before attending that event, which came back negative, and that his PCR test did not come back positive until after it had finished. On Dec. 18, he went ahead with an interview and a photo shoot with the French sports newspaper L’Equipe “to fulfill a long-standing commitment,” he said. “I felt obliged to go ahead and conduct the L’Equipe interview as I didn’t want to let the journalist down, but did ensure I socially distanced and wore a mask except when my photograph was taken,” Djokovic said. “While I went home after the interview to isolate for the required period, on reflection, this was an error of judgment and I accept that I should have rescheduled this commitment,” he added. It was not the first time Djokovic has had to apologize for dismissive actions he has taken during the pandemic. In mid-2020, as the virus raged in Europe and elsewhere, he held a tennis tournament after which he and several others tested positive. While Djokovic said in his statement Wednesday that he “had not received the notification of a positive PCR result” until Dec. 17 — after the event involving children — documents he provided to Australian officials as he tried to enter the country said that the result had been returned the day before. A copy of his medical certificate for his positive PCR test said that the test was taken at 1:05 p.m. on Dec. 16

and that the positive result was returned at 8:19 on the same day. In an affidavit provided to an Australian court, he said, “On 16 December 2021, I was tested and diagnosed with SARS-CoV-2 (COVID).” It was unclear when exactly he learned of his purported positive test. The Serbian prime minister, Ana Brnabic, said this week that had Djokovic known that he was positive for the coronavirus before attending the awards event on Dec. 17, he would have “clearly violated the rules” in Serbia. But more information was required, she added, saying, “I don’t know when he received the test result, when he read it.” When asked what would happen if Djokovic was found to have breached quarantine rules, she said the Serbian government would “deal with it.” In his statement, Djokovic also addressed questions about the declaration he made on his visa paperwork that he had not traveled to any other countries in the 14 days before arriving in Australia. The paperwork warns of serious penalties for false answers to the question. His declaration had seemed to be contradicted by social media posts showing him traveling between Spain and Serbia. On Wednesday, he said his agent had made an “administrative mistake in ticking the incorrect box.” “This was a human error and certainly not deliberate,” he said, adding that his team on Wednesday had “provided additional information to the Australian government to clarify the matter.” This means it is unlikely that the saga will be resolved quickly, with the immigration minister, Alex Hawke, indicating that he needed more time to consider the new information before deciding whether to cancel Djokovic’s visa again. A spokesman for Hawke said that Djokovic’s lawyers had made “lengthy further submissions and supporting documentation said to be relevant to the possible cancellation of Mr. Djokovic’s visa.” “Naturally, this will affect the time frame for a decision,” he added.

What Putin really wants from the Ukraine crisis By BRET STEPHENS

rave may have been the mistakes of Donald Rumsfeld, but George W. Bush’s first defense secretary did have a gift for memorable phrases. One of them — “weakness is provocative” — explains the predicament we again find ourselves in with Russia’s belligerence against Ukraine and NATO. Let’s recap how we got here. — In August 2008, Russia invaded Georgia and took control of two of its provinces. The Bush administration protested but did almost nothing. After Barack Obama won the White House that fall, he pursued a “reset” with Russia. In 2012, he cut U.S. force levels in Europe to their lowest levels in postwar history and mocked Mitt Romney for calling Russia our principal geopolitical threat. — In September 2013, Obama famously retreated from his red line against Bashar Assad’s use of nerve gas in Syria, accepting instead a Russian offer of mediation that was supposed to have eliminated Assad’s chemical arsenal. That arsenal was never fully destroyed, but Vladimir Putin took note of Obama’s palpable reluctance to get involved.

— In February 2014, Russia used “little green men” to seize and then annex Crimea. The Obama administration protested but did almost nothing. Russia then took advantage of unrest in eastern Ukraine to shear off two Ukrainian provinces while sparking a war that has lasted seven years and cost more than 13,000 lives. Obama responded with weak sanctions on Russia and a persistent refusal to arm Ukraine. — In 2016, Donald Trump ran for office questioning how willing America should be to defend vulnerable NATO members. In 2017 he tried to block new sanctions on Russia but was effectively overruled by Congress. The Trump administration did ultimately take a tougher line on Russia and approved limited arms sales to Ukraine. But Trump also tried to hold hostage military assistance to Ukraine for political favors before he was exposed, leading to his first impeachment. Which brings us to Joe Biden, who ran for office promising a tougher line on Russia. It has been anything but. In May, his administration waived sanctions against Russia’s Nord Steam 2 gas pipeline to Germany, which, when operational, will increase Moscow’s energy leverage on Europe. Since coming to office, the administration has done little to increase the relatively paltry flow of military aid to Ukraine. In the face of a Russian invasion, it will be as effective as trying to put out a forest fire by peeing on it. Then there was the fiasco of our withdrawal from Afghanistan. “In the aftermath of Saigon redux,” I wrote at the time, “every enemy will draw the lesson that the United States is a feckless power.” The current Ukraine crisis is as much the child of Biden’s Afghanistan debacle as the last Ukraine crisis was the child of Obama’s Syria debacle. Now the administration is doubling down on a message of weakness by threatening “massive consequences for Russia” if it invades Ukraine, nearly all in economic sanctions. That’s bringing a knife to the proverbial gunfight. Imagine this not-so-far-fetched scenario. Russian forces move on a corner of Ukraine. The U.S. responds by cutting off Russia from the global banking system. But the Kremlin (which has built its gold and foreign-currency reserves to record highs) doesn’t sit still. It responds to sanctions by cutting off gas supplies in midwinter to the European Union — which gets more than 40% of its gas from Russia. It demands a Russia-Europe security treaty as the price of the resumption of supplies. And it freezes the U.S. out of the bargain, at least until Washington shows goodwill by abandoning financial sanctions. Such a move would force Washington to either escalate or abase itself — and this administration would

almost certainly choose the latter. It would fulfill Putin’s long-held ambition to break the spine of NATO. It would further entice China into a similar mindset of aggression, probably against Taiwan. It would be to America’s global standing what the Suez Crisis was to Britain’s. At least Pax Britannica could, in its twilight, give way to Pax Americana. But to what does Pax Americana give way? What can the U.S. do instead? We should break off talks with Russia now: No country ought to expect diplomatic rewards from Washington while it threatens the destruction of our friends. We should begin an emergency airlift of military equipment to Ukraine, on the scale of Richard Nixon’s 1973 airlift to Israel, including small arms useful in a guerrilla war. And we should reinforce U.S. forces in front-line NATO states, particularly Poland and the Baltics. None of this may be sufficient to stop Russia from invasion, which would be a tragedy for Ukrainians. But Putin is playing for bigger stakes in this crisis — another sliver of Ukrainian territory is merely a secondary prize. What he really wants to do is end the Western alliance as we have known it since the Atlantic Charter. As for the U.S., two decades of bipartisan American weakness in the face of his aggression has us skating close to a geopolitical debacle. Biden needs to stand tough on Ukraine in order to save NATO.

Poitier and Bogdanovich: The defiant ones

L

ast week, the movies lost two giants — Sidney Poitier and Peter Bogdanovich — who each made history in his own way. Our chief film critics discussed the men, their careers and their legacies. Manohla Dargis: When Poitier and Bogdanovich died last week, you and I talked about how each had helped shape the periods in which they emerged. I’ve been thinking about that ever since. We know their careers briefly overlapped: Bogdanovich directed Poitier in the 1996 TV movie “To Sir, With Love 2,” a sequel to the 1967 film. For the most part, though, they had separate trajectories partly shaped by race, personal choices and what was happening both in the country and the industry. It’s fascinating to trace the arcs of these separate paths. Poitier’s begins first, with his big big-studio break, the 1950 drama “No Way Out.” He was working in Jim Crow Hollywood that he would later help overturn, but it took so long. In some ways, the pressures and contra-

dictions he faced came to a head at the end of the decade first with the release of “The Defiant Ones” in 1958, in which he has equal billing with Tony Curtis. A year later, though, Poitier is on his knees playing Porgy in “Porgy and Bess,” a role that he’d rejected but was effectively forced into taking. A.O. Scott: Bogdanovich was fundamentally a historian. Poitier was a history maker. When we started talking about them side by side, it wasn’t to compare their achievements, but to look at how their very different careers illuminated the changes underway in American movies after the studio era. Poitier came up in that system and had no illusions about its interest in racial progress. “Hollywood never really had much of a conscience,” he told an interviewer. “The social conscience that you’re talking about” — the durable myth of liberal Hollywood — “was always only a handful of men,” among them Joseph L. Mankiewicz, who made “No Way Out” and Stanley Kramer, who directed “The Defiant Ones.” “This town never was infected by that kind of goodness,” Poitier

said. He could never romanticize Old Hollywood the way Bogdanovich did. Dargis: Absolutely — among other things, I doubt that Poitier would have had access to all those at-times forgotten Old Hollywood veterans like John Ford and Orson Welles. Bogdanovich championed them in his writing and advocacy, and he learned about moviemaking through their conversations and by watching them work. I was looking at Bogdanovich’s anthology “Who the Devil Made It” and he was 20 when he did his first interview, in 1960, with Sidney Lumet. At that point, Bogdanovich had been studying acting with Stella Adler — presumably one reason he was fantastic with actors — and had worked in some 40 professional stage productions, one he directed. What a wunderkind! That year, Poitier turned 33 and started shooting “Paris Blues,” a film that I love despite its flaws, including his marginalization. Still, the film has Poitier and Diahann Carroll playing lovers and they’re beautiful, and shown as desiring and desirable. Poitier was disappointed with how the film turned out and said the studio had “chickened out on us” — he was always being sold out, it seems by the white powers that be, however ostensibly well-intentioned those powers. defense funds for the Rev. Dr. Martin Luther King Jr. It takes nothing away from Bogdanovich to say that Poitier lived in an entirely different reality. Scott: With Bogdanovich, it could seem that reality was defined above all by movies and his love for them. His cinephilia marks him as a charter member, along with guys like George Lucas, Martin Scorsese and Francis Ford Coppola, of what used to be called “the film school generation.” Not that Bogdanovich ever went to film school. “Generally I find film schools disappointing,” he told an audience at the American Film Institute. “They spend far too much time on production and not enough time showing the right films to students. Students need to see the classics.” Some of his best films — the modern-day screwball “What’s Up, Doc?” (1972); the black-and-white, Depressionset road movie “Paper Moon” (1973) — are full of that reverence for tradition. Some of the less good ones, too. In “Nickelodeon” (1976), he tried to bring some of the charm of early cinema into the New Hollywood, casting Ryan O’Neal as an accidental picture-maker and Burt Reynolds as a rough-riding screen idol. They spend the early 1910s scraping together two-reelers and battling industry consolidation, and wind up at the 1915 premiere of D.W. Griffith’s “The Birth of A Nation,” showing under its original title, “The Clansman.” In keeping with the dominant Hollywood origin story of the time, that movie is hailed as an artistic and commercial breakthrough — goodbye nickelodeons, hello movie palaces! — while its celebration of the Ku Klux Klan is brushed aside. The story of the late ’60s, early ’70s renaissance in American movies is conventionally told as a tale of heroic, rebellious white men. But as with the silent era, the truth is more complicated and more interesting. The period was also when Poitier (along with other Black pioneers like Gordon Parks, Ossie Davis and Melvin Van Peebles) turned to directing. He started out with a western, “Buck and the Preacher” (1972), set in the post-Civil War landscape familiar from so many


The San Juan Daily Star Ford pictures. He also starred in it, with Harry Belafonte and Ruby Dee. Do you think the choice of genre — and his treatment of its tropes — says something about his own relationship to the Hollywood past? Dargis: No doubt, though that relationship to genre was very different from that of those white directors, Bogdanovich included, who revisited (or were swallowed by) classic film forms in the 1960s and ’70s. In Poitier’s memoir “The Measure of a Man,” he talks about seeing his first film as a kid. It was a western and he was so wowed that he told his sister, “I would like to go to Hollywood and become a cowboy.” He didn’t know what Hollywood was; he thought people raised cows there — a child’s misapprehension that’s all the more poignant given how historically unwelcoming the town was to Black talent. One reason Poitier appeared in the western “Duel at Diablo” (1966), he said, was that it gave him an opportunity to create a heroic image for Black children who love westerns. He was apparently disappointed by this movie, as well, and his love for westerns and the complex iconography of the American cowboy were not yet in sync. Imagine the representational weight that his version of “The Wild Bunch” or a “Butch Cassidy and the Sundance Kid” might have carried in the late 1960s! Belafonte and Poitier had been interested in making a western but nothing came of this until they teamed up for “Buck and the Preacher,” which we both adore as much for its behind-thescenes story as the one on-screen. Scott: That story is a sign of how things were changing. Belafonte and Poitier were the producers. They didn’t see eye to eye with the first director, Joseph Sargent, and asked Columbia Pictures to replace him. Shooting had already started in Mexico, and Poitier offered to take over temporarily so the production could keep going while the studio looked for someone else. “Finally they called and said, ‘Why don’t you just continue shooting?’” Poitier remembered years later. “That’s how I started directing. I was just thrown into it.” Poitier went on to become one of the most successful comic directors of the next decade, playing straight man to Bill Cosby in the crime-caper trilogy “Uptown Saturday Night” (1974), “Let’s Do It Again” (1975) and “A Piece of the Action”

(1977), and steering Richard Pryor and Gene Wilder through the incarceration farce “Stir Crazy” (1980). Those were also Bogdanovich’s best years. We don’t have room to revisit all the dramatic ups and downs of his career, but I think there’s some perspective on that much-mythologized era to be gained by comparing how he and Poitier navigated the changes in Hollywood. It’s instructive, for example, that both were involved in attempts by groups of artists to take advantage of the waning power of the studios and assert their own independence. Poitier was a founder of First Artists, which brought together movie stars (including Paul Newman and Barbra Streisand) seeking creative control. Inspired by that example, Bogdanovich, with Coppola and William Friedkin, organized the Directors Company. Both experiments ultimately failed, which may say as much about Hollywood as the fact that they were tried in the first place. Dargis: Part of the pathos of the 1970s is that for all the great films made that decade — including by Poitier and Bogdanovich — the era laid the ground for the conglomeration, blockbuster-fication and Disney-fication of the industry. The two men traveled different roads, created tremendous work, won the industry’s highest honors and made a lot of money for a lot of people. But by the end of the 1970s, each one’s glory years were over. They kept working, on and off, with success and not, until they were the kind of faded greats the culture is happy to forget until they’re old enough to nostalgically venerate. I’m glad that at least we can do that, and watch their movies, too. The work is all over the place but it’s also immortal.

Cookies? Chips? Pizza? Here’s how to own your cravings. By TARA PARKER-POPE

F

ood cravings are a normal part of the human experience; studies show that more than 90% of people have them. (In fact, who are those unicorns who’ve never had cravings?) But how we deal with cravings can vary widely. Some people eat what they want and don’t worry about it, whereas others feel controlled by cravings and end up bingeing on favorite foods. When people surrender to a food craving, they often blame it on a lack of self control. But cravings are caused by a complex interplay of neurons in the brain’s reward center, appetite hormones, behavioral conditioning and easy access to tasty, pleasurable foods that reinforce the craving cycle. The power of cravings can be fueled by the senses, like the smell of fresh bread when we walk by a bakery, as well as situations and emotions. After a stressful day at work, for example, we might seek comfort by pulling up to a fast-food window. Good times can trigger cravings, too, like wanting popcorn or candy at the movies. And studies show that so-called “hyperpalatable” foods that offer a tantalizing combination of fat, sugar, salt and carbohydrates can interfere with brain signals so that we keep craving them even when we’re full. So what’s the solution for people who struggle with cravings? It turns out many people are dealing with cravings the wrong way by trying to restrict, avoid and distract themselves from tempting foods. They skip dessert when everyone else is eating it, walk away if a colleague brings doughnuts to the office and try to ignore their craving for the ice cream in the freezer. But increasingly, studies show that constant restriction and attempts at distraction can actually backfire for people who struggle with cravings and binge eating. Now scientists are studying surprising new strategies to cope with cravings based on brain science. These include accepting that food cravings are normal and inevitable and using mindfulness techniques to acknowledge and become more aware of your cravings and wait them out, rather than trying to ignore them. “It’s about understanding that these kinds of cravings are a natural part of being a person; we’re engineered this way,” said Evan Forman, a psychology professor at Drexel University in Philadelphia and the director of the university’s Center for Weight, Eating and Lifestyle Science. “You don’t have to make cravings go away, but you also don’t have to eat because of them. It’s accepting rather than pushing away or suppressing them.” How dieting can make cravings worse One of the earliest studies to show a link between food restriction and cravings was conducted in the 1940s by diet researcher Ancel Keys. In what is often referred to as a “starvation study,” Keys asked 36 men, who had been eating about 3,500 daily calories, to cut their food intake to about 1,600 calories a day. (By today’s standards, that calorie count is just another diet.) The restriction triggered a notable psychological change in the men, who became preoccupied with food. “They stopped doing anything except laying in their beds,

For the Eat Well Challenge, mindfulness techniques like “urge surfing” can help curb overeating without banning favorite foods. talking and thinking about foods,” said Traci Mann, who heads the health and eating laboratory at the University of Minnesota. She notes that the men even planned food-related careers like opening a grocery store or restaurant, and they stayed preoccupied with food long after the study ended. “These are men in the 1940s who probably never cooked a meal in their entire life,” Mann noted. “And they started cutting recipes out of the newspaper.” More recently, Mann and her colleagues used a tempting box of chocolates to study the effect of food restriction. The research included 142 chocolate lovers, half of whom were told to eat their regular diet while the other half went on a restricted diet. In a seemingly cruel twist, everyone in the study was given a box of chocolates and instructed not to eat it until after the 10day study. But to make sure every participant was consistently tempted by the chocolate, the participants had to open the box daily to find specific instructions. After 10 days, everyone was asked to send a photo of their chocolate box. The dieters had pilfered significantly more of the chocolates than those who weren’t counting calories. Acceptance vs. distraction At Drexel University, Forman conducted a similar study, but this time with transparent boxes of Hershey’s Kisses that subjects were required to carry at all times for two days. The researchers added a twist, advising some participants to ignore their cravings while instructing another group to notice and accept their cravings as something normal. A control group received no advice. At the end of the study, about 30% of participants in the control group had eaten the candy compared with 9% of people in the group instructed to ignore cravings. But among the participants taught to acknowledge and accept cravings, nobody ate the chocolate. In 2019, Forman published the follow-up results of a larger randomized controlled trial of 190 people, which found that participants who practiced acceptance and mindfulness strategies were twice as likely to have maintained a 10% weight loss after three years compared to those who focused primarily on resisting temptations and suppressing thoughts of food. “Surprisingly, there was a large benefit in people’s quality

of life that was somewhat unexpected,” Forman said. “It benefited their well-being and emotional state, too.” HOW TO COPE WITH CRAVINGS For this week’s Eat Well Challenge, try these acceptance and mindfulness techniques to focus on food cravings. (Times subscribers can sign up for the Eat Well Challenge through the Well newsletter and receive extra advice by texting the word “Hi” to 917-810-3302 for a link to join.) Practice “urge surfing.” Cravings are ephemeral, and some research suggests they peak around five minutes. “Urge surfing” means “riding the wave” of your thoughts, feelings and cravings rather than acting on them, and it’s a successful strategy often used to treat substance use. Follow these four steps. — Identify your craving. Use the phrase, “I’m having the urge to eat …” and fill in the blank. — Observe it. Notice how you feel as you crave the food. Do you feel it in your stomach? Are you distracted? Anxious? Do you feel the need to move or keep visiting the kitchen? — Be open. Don’t try to suppress or get rid of your craving. Accept the experience. — Pay attention to what happens next. Notice the urge as it rises, crests, falls and subsides. Note the intensity of a craving. “I’m having the urge to eat potato chips. It started as a 5, but now it’s a 7.” “Our cravings inevitably rise and fall, just like waves in an ocean,” Forman said. “Trying to fight that wave will never work. It doesn’t work if you are wishing for the craving to go away. You are accepting that it’s there, and even that it’s supposed to be there, and you are coexisting — surfing — with it.” Ask: How little is enough? There’s nothing wrong with eating a food you crave unless it becomes a problem for you. Dr. Judson Brewer, an associate professor at the Brown University School of Public Health, who created a mindfulness app called Eat Right Now, told the story of a patient who routinely ate a full bag of potato chips while watching a favorite TV show with her daughter. Instead of discouraging her from eating the chips, Brewer advised her to pay attention to every single chip she ate and to notice how many chips it took to feel satisfied. Just a few weeks later, the woman reported she had slowly reduced her chip habit, and now her craving was satisfied after the second potato chip. Find a bigger, better offer. Another strategy to deal with a craving is to focus on how a food tastes and makes you feel and then replace a problem food with a higher-quality food that satisfies the same urges. Brewer calls this “finding a bigger, better offer.” Brewer said he used to be “addicted” to gummy candy. To break the craving, he began to focus on how the candy really tasted and noticed it was sickly sweet. He looked for a better food to feed his craving and chose blueberries, which he discovered gave him even more pleasure than the candy. “Cutting ourselves off is not the way to go,” Brewer said. “We don’t want to live this austere life of not enjoying foods that taste good.”

The reason every NFL playoff team will lose By MIKE TANIER

T

here are no nigh-unbeatable 1972 Miami Dolphins or 2007 New England Patriots in this year’s NFL playoff field. Each team has at least one critical flaw. Opposing coaches have spent countless hours scouring game film and statistical breakdowns searching for those flaws. All you have to do is read the following capsules. Arizona Cardinals The Cardinals fumbled (“aborted,” in NFL parlance) 17 center-quarterback snaps this season. Per Football Outsiders research, that’s the highest figure in at least the past 12 years. Football players master the snap early in their Pop Warner careers, so learning that a playoff team botches an average of one per game is almost as stunning as discovering that players also occasionally get lost on the way to the stadium. Buffalo Bills The Bills finished third in the league in points scored and first in fewest points allowed, in part because they played what several analysts determined was the NFL’s easiest schedule. The Bills went 9-2 this season against opponents that failed to reach the postseason, outscoring them 318-144. The Bills went 2-4 against playoff-bound opponents, with a much more modest plus-10 score differential. The Bills are expected to face only playoff teams in the playoffs. Cincinnati Bengals Joe Burrow endured a league-high 51 regular-season sacks. Poor blocking was partially to blame, but coach Zac Taylor’s game plans also appear to consist largely of: a) spreading the formation so the Bengals’ offensive line gets no help from tight ends or running backs; b) sending rookie receiver Ja’Marr Chase as far downfield as possible; c) hoping Burrow survives long enough to throw the ball to him. Dallas Cowboys The Cowboys were penalized a leaguehigh 127 times in the regular season. They were also the beneficiaries of a league-high 121 penalties. Cowboys games are nearly unwatchable because they are often decided not by great offensive or defensive plays, but by 20-yard gains negated by holding fouls or 35-yard pass interference penalties when a defender nudges a receiver while chasing an off-target throw. That is more a flaw of the NFL’s officiating culture than it is the Cowboys, but it certainly is critical.

Tom Brady will be without a few of the Buccaneers’ top playmakers in the playoffs, with Chris Godwin’s injury and Antonio Brown’s departure leaving gaps in Tampa Bay’s receiving corps. Green Bay Packers The Packers have the NFL’s worst special teams units. Opponents averaged a leaguehigh 12.8 yards per punt return against the Packers and 25.7 yards per kickoff return (seventh in the NFL), while veteran kicker Mason Crosby missed eight field goals from inside the 50-yard line. The kicking game is completely outside quarterback Aaron Rodgers’ sphere of influence, of course, a fact he will be sure to remind us of if the Packers lose a playoff game on a punt return touchdown or missed extra point. Kansas City Chiefs Kansas City committed 25 turnovers, tied with the Tennessee Titans for the highest total among playoff teams. Also, nearly every turnover the team coughs up is a Rube Goldbergian series of improbable coincidences: The intended receiver slips before Patrick Mahomes delivers a side-armed pass, the ball ricochets off the receiver’s helmet and the antlers of a gazelle grazing along the sideline before landing in the hands of a defender, who bobbles the ball directly into the hands of a teammate, who nearly runs

for a touchdown before being chased down by the gazelle or by the slightly faster Tyreek Hill. Las Vegas Raiders It’s difficult to determine how the Raiders reached the playoffs, let alone which of their many flaws is the most critical. Los Angeles Rams Matthew Stafford threw 17 interceptions this season, tied with Jacksonville Jaguars rookie Trevor Lawrence for the league lead. He threw five of those interceptions from inside the Rams’ 20-yard line. It’s as if every time Stafford sees that he needs to drive more than 80 yards for a touchdown, he flashes back to his 12 seasons of Detroit Lions purgatory and becomes overwhelmed with despair. New England Patriots The Patriots’ offense is more of a family SUV than a sports car, and while rookie quarterback Mac Jones keeps his hands at 10 and 2 o’clock and signals before every turn, he’s not quite ready for rush hour on the turnpike. Jones’ efficiency rating on passes of 15-plus yards downfield of 58.4 ranks 27th among starting quarterbacks, per

Sports Info Solutions. Force the Patriots out of their running-and-defense game plan, and Jones looks more like another Zach Wilson than the next Tom Brady. Philadelphia Eagles The Eagles are the league’s best rushing team, averaging an NFL-high 159.7 yards per game. Unfortunately, coach Nick Sirianni likes to express himself artistically at the goal line with lots of intricate passing concepts instead of just hammering the ball between the tackles. As a result, the Eagles scored touchdowns on only 69% of their regular-season goal-to-go opportunities. Only the Cardinals had a lower success rate among playoff teams, perhaps because their signature goal-to-go play is a botched snap. Pittsburgh Steelers Ben Roethlisberger, who is expected to retire at season’s end, now throws and runs like a great-uncle playing a pickup game at a backyard cookout after three IPAs and two helpings of potato salad, and the Steelers’ offense looks like archival footage of a 1928 Pottsville Maroons-Dayton Triangles game played in a vacant lot during a downpour. San Francisco 49ers Even when Jimmy Garoppolo is healthy, his passes that travel more than 10 yards in the air have the trajectory, accuracy and velocity of a paper clip flung from a rubber band. He is currently dealing with a finger injury on his throwing hand, so coach Kyle Shanahan must either stretch the limits of nano-screen passing technology or give more opportunities to speedy, strong-armed rookie backup Trey Lance. The smart money, unfortunately and inexplicably, is on the nano-screens. Tampa Bay Buccaneers Tom Brady will be without top playmakers Chris Godwin (ACL tear) and Antonio Brown (check Instagram) in the playoffs. Injuries and absences did not appear to hamper the Buccaneers in their final games, but Brady could have beaten the New York Jets and Carolina Panthers simply by swaggering onto the field and posing heroically. Tennessee Titans Running back Derrick Henry’s imminent return from surgery on his broken foot is a mixed blessing, because the Titans may expect him to again rush 30 times per game, scan tickets at the stadium entrance and sing a halftime duet with Walker Hayes. Fortunately for Henry, the Titans earned a firstround playoff bye, giving him another week to soak his feet in Epsom salts, fancy-like.

Giants fire coach Joe Judge By KEN BELSON and VICTOR MATHER

J

oe Judge of the New York Giants on Tuesday joined the growing list of NFL coaches who find themselves out of a job two days after the end of the regular season. He joined Brian Flores of the Miami Dolphins, Matt Nagy of the Chicago Bears and Mike Zimmer of the Minnesota Vikings, who all were fired on the Monday after the end of the regular season, a perilous day to be a head coach. Vic Fangio of the Denver Broncos was dismissed Sunday. Jon Gruden of the Las Vegas Raiders and Urban Meyer of the Jacksonville Jaguars left their posts earlier in the season. The round of firings this year encompasses several organizational tear-downs, as the Bears and the Vikings also shed their general managers, and the Giants joined them after firing Judge and saying goodbye to general manager Dave Gettleman, who retired. Joe Judge, New York Giants The Giants waited a day or two longer than other teams, but Tuesday they fired their coach for the third time in the past six years. Judge’s departure came a day after Gettleman stepped down. While the team’s owners have traditionally valued stability, Judge’s 10-23 record in his two seasons was too much to ignore. The Giants lost their last six games this season, all by double-digit margins. The Giants haven’t made the playoffs since the 2016 season and haven’t won a playoff game in a decade. Gettleman deserved some of the blame for the Giants’ slide. He used the second overall draft pick in 2018 to select running back Saquon Barkley, who has battled injuries. He offered major contracts that backfired to offensive tackle Nate Solder and receivers Golden Tate and Kenny Golladay. He signed receiver Odell Beckham Jr. to a huge contract extension, making him the league’s highest-paid receiver, and then traded him to Cleveland for players — Jabrill Peppers, Dexter Lawrence and Oshane Ximines — who haven’t developed into stars. “It is an understatement to say John and I are disappointed by the lack of success we have had on the field,” Steve Tisch, who co-owns the team with John Mara, said in a statement Tuesday. Like other clubs, the Giants may focus first on finding a general manager before hiring Judge’s replacement.

Vic Fangio, Denver Broncos The Denver Broncos fired coach Vic Fangio after three losing seasons. Fangio was dismissed a day after the Broncos lost to the Kansas City Chiefs, 2824, and finished in last place in the AFC West with a 7-10 record. The Broncos were in contention for a playoff spot heading into the last quarter of the season, thanks to one of the league’s top defenses, but then lost their last four games. Denver has not made the postseason since their Super Bowl victory in the 2015 season. Fangio compiled a 19-30 record over three seasons. The Broncos’ general manager, George Paton, who took over that job when John Elway moved to director of football operations in January 2021, will start looking for a new coach. “George will have full authority to select the next head coach of the Broncos,” the team’s president and chief executive, Joe Ellis, said in a statement. “This is his decision and his program.” There may also be turmoil in the owner’s box, too. The odds that the franchise will be sold this year rose after a judge in Arapahoe County, Colorado, dismissed a lawsuit that contested the will of former owner Pat Bowlen, who died in 2019. Whoever takes over the team’s front office will inherit several top offensive weapons, including receiver Jerry Jeudy and tight end Noah Fant, and several top defenders, including safety Justin Simmons and linebacker Bradley Chubb. The team also has five picks in the first three rounds of the coming draft. Brian Flores, Miami Dolphins In a surprising move, the Dolphins dismissed Brian Flores on Monday despite a 9-8 season and a seven-game winning streak that nearly vaulted Miami into the playoffs. In his three seasons as head coach, Flores held a 4-2 record against the division-rival New England Patriots and Bill Belichick, his mentor over his decade as an assistant there. The Dolphins’ winning record in the 2021 season, like last year’s 10-6 finish, was not enough to get them in the playoffs, an absence that has stretched to five years. “I determined the key dynamics of our football operation weren’t functioning at a level I want it to be and felt that this decision was in the best interest of the Miami Dolphins,” team owner Stephen Ross said in a statement. “I believe we have a talented

The team announced that it would retain general manager Chris Grier. Matt Nagy, Chicago Bears The Bears dismissed coach Matt Nagy and general manager Ryan Pace on Monday. Nagy had a spectacular debut in 2018, as the Bears finished 12-4 and made the playoffs for the first time in eight years, earning him the Coach of the Year Award. But two 8-8 seasons and a 6-11 season followed. His tenure ends with a 34-31 overall record. Pace was at the club for seven seasons. He hired John Fox (14-34) and Nagy as head coaches and drafted quarterback Mitchell Trubisky (over Patrick Mahomes) in 2017. Although Nagy had been the offensive coordinator at Kansas City, the Bears never

developed a strong offense behind Trubisky. They turned to Andy Dalton and rookie Justin Fields this season with mostly poor results. Mike Zimmer, Minnesota Vikings The Vikings fired coach Mike Zimmer and general manager Rick Spielman on Monday. “It is time for new leadership to elevate our team so we can consistently contend for championships,” the team said in a statement. The Vikings have not made a Super Bowl since the 1976 season and have never won an NFL title. Zimmer was head coach for eight seasons, including three playoff appearances. The high-water mark was a 13-3 season in 2017 and a trip to the NFC championship. But the team was 7-9 and 8-9 the past two seasons. Zimmer finishes his tenure with a record of 72-56-1.
