Drowsiness remains an elusive highway dilemma

Cars made in Brazil proven deadly

MINEOLA, N.Y. — It probably happens to most drivers. Heading home after an overtime shift and the eyelids flutter. Up all night with a sick baby and you rest your eyes for just a moment on the way to dropping off the kids at school. Drowsy drivers often make it safely to their destination, but for some, the consequences are devastating. “To this day I still hear my boys crying out, yelling for Daddy, when they were told the news,” says Jackie Califano, the widow of a New York police officer killed when a suspected drowsy driver plowed into his parked cruiser in 2011. “The pain we experienced is beyond description and continues to be.” More than 11,000 deaths were attributed to drowsy driving from 2000 to 2010, according to federal statistics. And experts say it’s a problem that can’t easily be solved by new laws because proving sleepiness behind the wheel is difficult, if not impossible. Authorities can easily determine how much alcohol is in a driver’s blood, or whether someone has used illegal drugs, or even if someone has been texting while driving. But quantifying drowsy driving is not an exact science, prosecutors say, and laws banning commercial truck and motor coach operators from driving more than 11 hours a day and requiring 10 hours between shifts are flawed because they often rely on the drivers to report those hours themselves. In a drowsy driving case late last year, a tour bus driver was acquitted of manslaughter and negligent homicide in a 2011 Bronx

crash that killed 15 people. A jury rejected prosecutors’ arguments that Ophadell Williams was so sleep-deprived from working another job that it affected his reflexes as much as if he was intoxicated. That verdict influenced a Long Island prosecutor’s decision this year to drop negligent homicide charges against the truck driver involved in a fatal crash that killed Califano’s husband. Ultimately, the truck driver pleaded guilty to a misdemeanor reckless driving charge and paid a $500 fine. “If you are going to try and make fatigue — sleepiness — a criminal legal issue in a motor vehicle accident, you have a lot, lot more to prove,” said Patrick Bruno, who defended Williams in the bus crash case. Maureen McCormick, who heads the Nassau County vehicular crimes bureau, explained that to obtain a conviction in the police officer’s death, she would have had to prove “serious blameworthiness,” ‘’moral blameworthiness” or “dangerous speeding,” a standard she said is impossible to meet. “Drowsy driving is something that generally has happened to everyone,” McCormick said. “The question is what do we do as a society when that feeling starts to come?” New Jersey is the only state that has successfully passed legislation addressing drowsy driving, according to Dan Brown, an Atlanta attorney and member of the National Sleep Foundation board of directors. But he noted that “Maggie’s Law” doesn’t fully solve the problem because prosecutors must show that a driver had been awake for 24 consecutive hours to prove possible recklessness, which is often a difficult proposition.

SAO PAULO — The cars roll endlessly off the local assembly lines of the industry’s biggest automakers, more than 10,000 a day, into the eager hands of Brazil’s new middle class. The shiny new Fords, Fiats, and Chevrolets tell the tale of an economy in full bloom that now boasts the fourth largest auto market in the world. What happens once those vehicles hit the streets, however, is shaping up as a national tragedy, experts say, with thousands of Brazilians dying every year in auto accidents that in many cases shouldn’t have proven fatal. The culprits are the cars themselves, produced with weaker welds, scant safety features and inferior materials compared to similar models manufactured for U.S. and European consumers, say experts and engineers inside the industry. Four of Brazil’s five bestselling cars failed their independent crash tests. Unsafe cars, coupled with the South American nation’s often dangerous driving conditions, have resulted in a Brazilian death rate from passenger car accidents that is nearly four times that of the United States, according to an Associated Press analysis of Brazilian Health Ministry data on deaths compared to the size of each country’s car fleet. In fact, the two countries are moving in opposite directions on survival rates — the U.S. recorded 40 percent fewer fatalities from car wrecks in 2010 compared with a decade before. In Brazil, the number killed rose 72 percent, according to the latest available data. D r. “The gravity of the injuries arriving at the hospitals is just ugly,” he said, “injuries that should not be occurring.” Automakers in Brazil point out that their cars meet the nation’s safety laws. Some said they build even tougher cars for the country because of its poorly maintained roadways and rejected any notion that cost-cutting in production leads to fatalities. But the country’s few safety activists perceive a deadly double standard, with automakers earning more money from selling cars that offer drivers fewer safeguards — a worrisome gap for new middle-class households, whose surging spending power has outpaced consumer protections taken for granted in more developed countries. The problem extends beyond Brazil, with economic forecasts showing the majority of global growth in auto sales taking place in emerging-market nations as the world’s auto fleet doubles to 1.5 billion by 2020. “Entry-level cars in Brazil are incredibly dangerous, it can’t be denied. The death rate from accidents is far too high,” said Maria Ines Dolci, coordinator of the Rio de Janeiro-based consumer defense group Proteste. “The manufacturers do this because the cars are a little cheaper to make and the demands of the Brazilian consumers are less; their knowledge of safety issues is lower than in Europe or the U.S.” Manufacturers earn a 10 percent profit on Brazilianmade cars, compared with 3 percent in the U.S. and a global average of 5 percent, according to IHS Automotive, an industry consulting firm. Only next year will laws require frontal air bags and antilock braking systems on all cars, safety features that have been standard in in-

dustrial countries for years. The country will also have new impact regulations on paper, at least; Brazilian regulators don’t have their own crash-test facility to verify automakers’ claims about vehicle performance, nor are there independent labs in the country. Experts say those requirements alone are not sufficient to meet basic safety standards. Some models sold in Brazil, like the Chinese-made JAC J3, scored only one star in a recent crash test despite having air bags and antilock brakes. An independent pilot effort known as the Latin New Car Assessment Program has run initial tests of Brazil’s most popular car models, and the results are bleak. The cheapest models of four of the five top-selling cars, made by General Motors, Volkswagen and Fiat, received a one-star rating, out of five stars, while other top sellers also scored poorly. Such a rating means cars provide little protection in serious head-on wrecks, compared to four- or fivestar rated cars, which are virtually the minimum that consumers in the U.S. and Europe buy. “The difference is you’re talking about somebody dead in the vehicle or dying very quickly, or somebody being able to get out of the vehicle themselves,” said David Ward, director general of the London-based FIA Foundation for auto safety, which supports the Euro and Latin NCAP programs. “It’s definitely a difference between life and death.” The squat Ford Ka hatchback sold in Europe scored four stars when it was tested by Euro NCAP in 2008; its Latin American version scored one star. Ford acknowledged that particular Ka is built on an outdated platform, and said it cannot be compared with the European version of the

same name — it’s that different. The company said it aims to have all its cars produced in Brazil built on updated, global platforms by 2015. The Mexico-produced Nissan March compact sold in Latin America received a two-star rating from Latin NCAP, while the version sold for about the same price in Europe, called the Micra, scored four stars. The crash tests found the Latin American model had a weak, unstable body structure that offered occupants little protection in even non-serious wrecks. In an emailed statement, Nissan said the March sold in Brazil is “practically the same model” offered in Europe. “The difference in the results achieved in Europe and Latin America is due to variations in the NCAP tests applied in different parts of the world.” Not so, said Alejandro Furas, technical director for the Global NCAP crash test programs. “We perform the frontal crash test exactly in the same way as the Euro NCAP,” he said. “The March and Micra were tested in the same lab, with the same type of crash test dummies, under the same conditions with the same people running the laboratory.” The Euro NCAP tests are more complete. They include side-impact and other tests, while the Latin American version only records front-impacts. Each type of impact test is individually scored on a 16-point scale. The March sold in Brazil obtained a 7.62 rating in its frontal-impact test. The Micra fared much better, 12.7 points. Italian automaker Fiat said in an emailed statement that “in general, Brazilian projects receive more reinforcements” within the cars’ bodies to fortify them against the nation’s “harsher roads and terrain.”

2013 Ford Fusion: The third generation Fusion is poised to continue the model’s run as a top-10 seller. The popular family midsize vehicle has added technology, plug-in powertrain options and a fresh look. The four-door sedan and its unitized steel body is built in two locations — Hermosillo, Mexico, and Flat Rock, Mich. — and it keeps an international flavor by offering three engines built in locations around the globe. The 2013 Ford Fusion no longer offers a six-cylinder engine. Instead, the Fusion offers three four-cylinder engines with a range of horsepower and fuel economy ratings. All three are built in foreign lands: the 2.5-liter inline-4 is built in Mexico; the 1.6-liter EcoBoost inline-4 is built in the U.K. and the 2.0-liter EcoBoost inline-4 is built in Spain.

Bold new exterior Featuring a sleek silhouette and fresh face, the allnew Fusion incorporates a bold grille, angular body and increased dimensions while offering more frame rigidity and improved driveability. The 2013 Fusion SE has been re-imagined. The new wheelbase is 112.2 inches, a gain of nearly 5 inches over Gen-2. This larger wheelbase accommodates an increase of an inch in length to 191.7 inches, seven-tenths of an inch of increased width to 72.9 inches and nearly an inch-and-a-half in height to 58.1 inches. Curb weight for my Bordeaux Reserve (Black Cherry) 2.0-liter version was 3,526 pounds, a weight gain of about 180 pounds. Interior dimensions also gained in the re-build with first row headroom of 39.2 inches (a gain of half-aninch) with 37.8 inches of rear headroom (the same as last year). Front legroom is now a comfy 44.3 inches compared to 42.3 inches in the previous Fusion, and rear legroom is 38.3 inches (a gain of 1.2

inches). Shoulder room is now 57.8 in front and 56.9 in row two, up about fourtenths of an inch in both locations. The new Fusion offers drivers a choice of gasoline, hybrid and plug-in hybrid alternatives, a pair of EcoBoost four-cylinder engines and a normally aspirated four-cylinder engine.

Economy under the hood The 2.5-liter engine puts out 175 hp and 175 lbs.-ft. of torque, the 1.6-liter is good for 178 hp and 184 lbs.-ft., and the 2.0-liter that powered my test Fusion galloped 240 horses and 270 lbs.-ft. In automatic format, the three engines get about 22 mpg in the city and between 31 and 32 on the highway. The manual 1.6 gets 25 and 37. My test 2.0-liter averaged 26.6 mpg in mixed-use tests. The 2.0-liter EcoBoost engine — paired with a paddle-shifted six-speed SelectShift Automatic transmission in frontwheel-drive was quiet and attentive in family sedan style. It tested out as a good highway cruiser and handled athletically for its niche. While it had moments of heaviness, in most maneuvers, Fusion showed little body roll, accurate steering and aggressive cornering. The independent front suspension with MacPherson struts and stabilizer bar, working with an independent multilink rear with stabilizer bar was confident and road-smoothing, and the ABS brakes were reliable and quick-stopping.

Interior surfaces are softer to the touch and interior and exterior gaps have been minimized, while extra care has been taken to upholster or cover each edge and every surface a customer can touch. When the trunk lid is opened, for example, a spring-loaded cover automatically conceals the trunk latch hardware. The standard interior Equipment Group came with six speakers, 10-way power driver’s seat with power lumbar, compass, outside temperature indicator, rear air conditioning ducts, rear center armrest with two cupholders, SecuriCode Keypad, Sirius XM Satellite radio and heated mirrors.

Safety was the plan Fusion is designed with customer safety in mind. Engineers increased its body strength by 10 percent, using more highstrength steels such as boron, and added dual first-row knee airbags and adaptive front airbags that vent and tether to conform to a specific occupant’s

size, position and seatbelt usage. The Fusion safety team targeted and gained topof-the-line ratings in each public domain safety benchmark, including National Highway Traffic Safety Administration ratings and the Insurance Institute for Highway Safety Top Safety Pick. The most prominent example of this engineering is Fusion’s front-end architecture, as the same car must face simultaneous — and seemingly conflictive — standards across regions. The car’s front end is equipped to meet head-on and offset barrier standards for North America while

still conforming to European standards for pedestrian protection. Ford engineers spent many hours of computer modeling and 180 validating crash tests to achieve the results. The new base Fusion starts at $21,900, up $1200 from last year, with the hybrid model starting at $27,200 (down about $1500 from last year), while the plug-in Energi starts at $38,700. My test Fusion came in three trims. The S was at the base price; the SE (my test ride) started at $23,830; and the upscale Titanium trim started at $30,300. Competitors to the GL include other large, luxury SUVs with three rows of seats, such as the 2013 Cadillac Escalade ESV. With a starting retail price of $67,340, the Escalade ESV has 403-horsepower, gasoline V-8, six-speed auto m a t i c t ra n s m i ss i o n , leather-trimmed seats and rear-wheel drive. With allwheel drive, the 2013 Escalade ESV starts at $69,890. Another competitor, the 2013 Infiniti QX56, has a starting MSRP, including destination charge, of $62,345 with rear-wheel drive, 400-horsepower, gasoline V-8, seven-speed automatic transmission and leather-trimmed seats. With four-wheel drive, the QX56 starts at $64,445. Neither the Cadillac nor Infiniti come with a diesel engine. The test GL was the die-

sel model, but passengers didn’t notice. The reason? The 3-liter, turbocharged, direct-injection, Bluetec diesel in the GL350 is amazingly quiet, with nary any diesel “racket” that oldtime diesels are known for. Instead, the GL350 sounds pretty much like a normal gasoline-engine vehicle, down to the confident, powerful engine sounds during acceleration. There was no diesel smell around the GL350, either. The only smell came at the filling station pump. And forget about diesel glow plugs and sensitive, special care. The GL350 is durably built with modern diesel technology and doesn’t need to be babied. Bluetec, by the way, includes special emissions filtering to contain diesel particulates. In the tester, there was just a hint of turbo lag now and then, but it was not worrisome or distracting. Zero to 60 mph in the diesel GL is estimated at an acceptable 8.3 seconds — not bad for a 2-ton vehicle propelled by a V-6 — and the transmission shifted smoothly. The best part of the GL is fuel mileage, which the U.S. government rates at 19 miles per gallon in city driving and 26 mpg on the highway. This puts the potential travel range on a single, 26.4-gallon tank at a noteworthy 523 miles, according to the feds. Given today’s average cost for diesel, filling that large a fuel tank can add up to more than $105. But the test GL350, driven 70 percent of the time in city traffic and the rest on highways, averaged just 18 mpg, for a driving range of 475 miles.
