The Cherry Creek Bruins and the Valor Christian Eagles arrived at the 5A state championship football game at the Neta and Eddie DeRose ThunderBowl on the campus of CSU-Pueblo, holding the first and second-place rankings in the league and with undefeat-

ed seasons. In the semi-finals the week before, Creek (1) defeated Pomona (4) 35-7 and Valor (2) defeated Legend (3) 45-0. It was anybody’s game. Throughout the contest, Cherry Creek Bruins running back James Walker II did most of the ground work for the Bruins moving the ball a few yards at a time. But it was

senior Myles Purchase, “the kid” who does it all, who took the ball in for touchdowns on wildcat plays in Creek’s first touchdowns of the game. In between those two series, Valor Christian star running back, junior Gavin Sawchuk, caught and brought back the kickoff return to Valor’s 31yard line, then ran it on seven

quick-tempo plays before his teammate, junior Zach Wiley, had an unfortunate fumble and Creek got the ball back. Starting out on Creek’s 38-yard line, Walker caught a pass from QB senior Julian Hammond, who will play basketball at CU in the fall, and ran it to the Creek 48-yard line. There was five minutes left

But as a human, citizen, and fellow business owner there isn’t much I wouldn’t do to protect my family, my employees and my livelihood. I understand their pain and argue that all they want is a chance to run their business, which they have been doing successfully (albeit strained) for the past six months.

I write to you as an elected official that is strongly advocating for our community to have small businesses and restaurants return to their normal operations with precautions that have repeatedly been stressed by all - masks, social distancing, hand washing and reduced indoor capacity to comply with social distancing.

Business owners have bent over backwards to provide safe environments for their customers to experience their business. The current restrictions have placed the foundation of our economy in peril. The frustration has not changed since April, when Costco, Home Depot and King Soopers were packed with customers doing their best to interact in a safe way - without masks. Now even with masks these businesses continue to be allowed to operate in a manner where hundreds of customers are interacting on a daily basis, yet small businesses where tens of customers interact are being unfairly targeted. These businesses who employ approximately 15% of our overall workforce across our community take great personal risks to do so. It is these businesses that pay employees out of their own pockets to ensure that they have financial security at personal risk to their own families. It is these businesses that you are telling to give up their life savings and their homes for a benefit that is untraceable within our community.

On November 17, Governor Polis announced that as of November 20, 15 Colorado counties, including Arapahoe, Douglas, Denver, Jefferson, Adams, Broomfield, and Boulder, would be restricted to outdoor dining, pick-up, and delivery service. In other words, no patrons could eat inside their facilities. Many have done valiant work to accommodate outside diners, but it’s December. The weather is a definite factor. On December 5, 15 local elected officials sent a letter to Governor Polis asking him to “please consider revising the public health order” keeping restaurants from serving patrons inside their facilities. Signing the letter were the mayors of Centennial, Greenwood Village, Cherry Hills Village, Littleton, and Parker, three out of five Arapahoe County commissioners, four members of the Centennial City Council, and three members of the Aurora City Council. Although all but the three county commissioners ran on a non-partisan basis because they are city officials and city elections are non-partisan, all the officials who signed the letter are Republicans. Why were prep football state championships played in Pueblo? BY FREDA MIKLIN GOVERNMENTAL REPORTER

T

he 2020 state prep football championships were played on December 4 and 5 at the CSU-Pueblo Thunderdome in Pueblo. As late as 10:00 p.m. on December 4, many were still questioning the decision to hold the games there, including Molly Lamar, mother of Cherry Creek Bruins linebacker Henry Lamar, who was part of the 5A championship game. After it was announced on the Wednesday evening before Thanksgiving that, instead of the 700 fans per team that had been previously approved for Pueblo, no fans would be permitted to attend the championship games. Ms. Lamar started an online petition on November 29 to pressure the state for a variance that would allow parents to attend their children’s championship game. Nearly 10,000 people signed. It only took one day to get results, but the variance that was granted was for only 75 fans per team per game. That translated to one parent per student athlete, something that Ms. Lamar and other parents found unsatisfying and unfair. Appearing on 9News

on December 4, she said, “This is such a positive thing for our kids. The kids have been robbed of so many experiences. We’ve been working with parents from every single high school that’s going to be participating in these (five) games. I’ve fought tooth and nail. Everyone is crushed.”

Adding to the frustration of families is the fact that on game day, COVID-19 statistics were worse in Pueblo than in Denver. On December 4, Colorado Department of Public Health and Environment (CDPHE) reported that Pueblo County had had 2,073 new cases of coronavirus

in the past two weeks and a two-week average positivity rate of 15.8%. On the same date, CDPHE reported that Denver had had 982 new cases of the virus during the prior two weeks and a twoweek average positivity rate of 9.8%. Although the Colorado

High School Activities Association (CHSAA) oversees prep football in Colorado, the Colorado Sports Hall of Fame (CSHOF), based at Empower Field, has hosted the 4A and 5A championships for the past

Common sense lacking in game location Congratulations to the Cherry Creek High School Bruins for a repeat victory of the state 5A football championship 21-0 Saturday night in Pueblo. They defeated a top ranked Valor team that has achieved eight state titles. Coach Dave Logan just has that masterful touch of developing talent, team management, and smart decisions. He would indeed make a great coach for the Denver Broncos. The 5A game was played in Pueblo at 6 p.m. Saturday night with each team allowed a meager 75 tickets. That means that many family members did not have the opportunity to watch their athletes perform. Yes, we have to fight Covid-19 but it seems strange to me that we would send athletes confined on a school bus for a 270-mile

round trip to Pueblo. They played the last game of a full afternoon schedule. Presuming that the teams all used the same locker rooms, were the locker rooms cleaned before and after games? It is commendable that CHSAA commissioner Rhoda Blanford-Green allowed the football season to continue and to even have the state playoff games anywhere. These games mean many college scholarships for the outstanding football players on all teams before college scouts and video screening films. As Freda Miklin outlines in a sports story in this Villager issue, the use of Mile Hi Field was Covid-19 related and had economic challenges. There were many other venues that could have been utilized in the Metro area besides the trek to Pueblo.

Cherry Creek high school and Valor are two of the most outstanding schools in the state, both in academics and sports. It seems very inappropriate that these two teams were placed at greater risks traveling to Pueblo to play before a sparse crowd of parents. Those who attended the game also encountered the major highway construction project and concrete roadblocks between Castle Rock and Colorado Springs. A very treacherous stretch of highway for local football families. CHSAA calls the shots and it is probably unwise for the participating schools to complain in fear of retaliation or having the games canceled for many reasons. Kudos for the games being scheduled. A thank you to CSU/Pueblo for hosting the event, to the weather for dry

roads, and mild weather. My grandson Sean played on a state championship game several years ago and at least 16 family members cheered his team, the Elizabeth Cardinals, walloping the undefeated Glenwood Demons. I can still remember the excitement and memories of his linebacker participation. I would have hated to miss that game. His father Mike Dorrance and uncle Ted both played at Creek under coach Fred Tesone. The 5A game was streamed for $11 so savvy fans were able to view the game, but no live television coverage. It seems that money was more of an issue because of Covic-19. Money shouldn’t decide where, and when, championship games are ever played. It was a win, win, for Creek fans, but not for many parents and fans that wanted to watch the two great teams play ball live at a local stadium.

Congratulations to Cherry Creek High School coach Mike Logan, team members, fans, and parents. Cherry Creek has a great football legacy going back to the days of Coach Tesone with so many victories on the gridiron. Great talent was displayed by both Creek and Valor. Many players will be heading to top U.S. football teams. *** The Broncos made themselves proud Sunday night in Kansas City. The team lost 23-16 to a 10-1 reigning Super Bowl team that looks headed for a repeat. QB Lock is learning fast, needs a faster release but is showing promise. Finally, an entertaining performance and players performing well. The spread was Broncos losing by 13 points while we only lost by 6. Denver bettors won the money. *** We note some longtime friends who have succumbed to illnesses recently. A surprising loss is the death of Joyce Schuck,well-known wife of Steve Schuck. Longtime Coloradoans will remember Steve and Joyce’s quest as he sought to become Colorado’s governor from

their home in Colorado Springs. The couple have been strong advocates for Charter schools. Steve once proposed trading eastern slope businesses for western slope water. It was a fine idea. No formal services are planned at this time. State Representative Phil Pankey, 91, passed away in Manzanillo, Mexico in September where he has been retired. Phil was an active Rotarian for 60 years. He served in the State Legislature from 1982 until 1998 from Douglas County and owned and operated a Ford dealership on Arapahoe Road. Another longtime friend, Sally Rippy, passed away November 11. She had many Metro friends. Her husband Gordon Rippy was an advertising agency stalwart for decades. Sally became Executive Director of the Adolph Coors Foundation for a decade where she won many awards, including chair of the first National Philanthropic Day. What I remember most about Sally was always her laugh and glowing smile. She had a great personality along with a keen mind. *** My experience of the week was driving by Centen-

nial City Hall and spotting the sign for a free Covid-19 test in the nearby Center Park. There were very few cars at mid-morning so I thought, “Might as well get a test.” I think before long in order to travel or board a flight one will have to show a Covid test result and probably a vaccination card. Here’s how it worked. First you receive a sheet listing the drill by attendants to fill out. You can use your phone or give them your driver’s license to process the form. Another attendant picks up the form and brings back a small receipt used for their records. A young man came to my rolled down window, had me pull my mask down over my mouth, exposing my nose. He took the swab and ran it up both of my nostrils and while it tickled it was painless. He put the swab in a test tube and gave me a sheet on how to obtain my free test score in four days. That was it, in less than 20 minutes I was on my way. It’s been four days with no score yet but feel fine and glad to have experienced the test procedure. *** A big reminder to shop locally. Online shopping has become very popular during Covid-19. You can shop

online with the majority of local merchants. You can purchase gift cards for family and friends. It is critical that we support our local merchants and keep employees and business doors open. The holiday season has arrived. I see that the Monaco Optimist Club has already sold all of their 300 Christmas trees and are closing the lot. It does look like the end of the pandemic is approaching with vaccines and the cruise ships, airlines, and casino stocks rising rapidly. A good indication that travel will resume rapidly as Covid recedes with people very tired of staying home. *** Way back in history, the Central City Weekly Register Call reports that 151 years ago on November 25. 1870, “Mr. C.H. Sweetser was advertising a big supply of buffalo meat having been received in his market.” The miners were hungry for fresh meat and we must have had herds of buffalo still roaming Eastern Colorado. There wasn’t any refrigeration in those days and meat was kept in canvas bags to ward off flies and cooled at night. ***

Legislature approves $340 million in COVID-19 relief BY FREDA MIKLIN GOVERNMENTAL REPORTER

In advance of the 2021 regular session of the general assembly, state lawmakers met in a special session called by Governor Polis for three days beginning November 30 to consider how to provide some economic relief for Colorado businesses negatively impacted by the coronavirus pandemic as everyone waits for action from Washington, D.C. In the spirit of bipartisan cooperation, the legislation that was passed had both Republican and Democratic sponsors. Funding for these initiatives will come mainly from sales and income tax receipts received by the state since July 1, the beginning of the fiscal year, in excess of what was expected and budgeted last June as the pandemic was taking hold in Colorado. These bills were approved and sent to the governor for signature, some starting out in the House and some in the Senate. Governor Polis has announced he will sign them all. SB1. $57 million for small businesses and arts organizations suffering negative economic impact from capacity limits, of which $4 million must go to minority-owned businesses. Individual grants are limited to $7,000 and businesses that do not comply with state-imposed capacity limits can be refused. The amount allocated to this pro Continued on page 8

Lawrence said his group has donated about $1 million to youth sports organizations over the past 15 years. The coronavirus pandemic of 2020 changed everything. On November 11, CHSAA held a press conference where it was announced that the 1A through 5A state championship football games would be held at the CSU-Pueblo Superdome in Pueblo. Arrangements had been made by Dan DeRose and his 501(c)

(3) organization, Friends of Football, a non-profit group that supports student football focused on CSU-Pueblo. Tom Lawrence explained, saying, “We tried everything we could to still be able to host the games this year…The biggest thing was just the mere costs of the health protocols that the governor has put out to have it here at Mile High Stadium (Empower Field). Our costs at this stadium would have doubled. In a normal year, we need about 9,000 in attendance (at $15 each) just to break even. With the additional costs (for PPE, etc.) that

would have probably doubled… The Broncos got a special variance to have 5,700 fans per game for the rest of the year and they’re not even sure that they’re going to be able to finish out the season having fans.” (That prediction came true when the Broncos announced on November 20 that no fans would be allowed at their games at Empower Field after November 22 for the rest of the season.) Lawrence expressed appreciation that Dan DeRose, who serves on the CSHOF board of directors and has hosted the 2A and 3A state championship games

at CSU-Pueblo in previous years, “stepped in and figured this out so the kids would have a place to play,” adding, “Even if we would have had a variance letting us have 1,700 fans at Mile High (Empower Field), it is just totally cost prohibitive, we could not have done it. We hope things will be back to some kind of normalcy next year and we can host it next December 4, 2021 and get back on track. Trust me, I’m very sad, but things are what they are. Creek wins second consecutive title Creek started the ensuing series with a penalty, followed by a Hammond pass that was broken up and nearly intercepted by Valor senior Jackson Zimmerman, who plays on both sides of the ball. Hammond’s next pass was completed to Creek senior wide-receiver Chase Penry for a whopping 38-yard gain. Six plays later, a Valor penalty gave Creek 15 extra yards and they were inside Valor’s 15-yard line. After a time-out, Hammond overthrew Penry, who was wide open in the end zone. Then Creek picked up two consecutive penalties. It was 2nd down and 29 yards to go when Hammond and Penry connected in the air for Creek’s third touchdown to go up 21-0 with just under six minutes left in the first half. Valor tried everything, including some trick plays in the second half, but with temperatures below freezing, both teams made their share of mistakes leading to penalties as the evening wore on. Valor got all the way down to the Creek 17-yard line during the third quarter but was stopped by a fumble. Statistically, Cherry Creek had 434 yards of total offense, the largest chunk coming from James Walker, who got 110 yards. QB Julian Hammond threw 26 passes, 19 of which were caught with one interception. Reliable receiver and CU-commit Penry caught eight passes from Hammond for 112 yards. Ten Cherry Creek graduating seniors were four-year lettermen: Julian Hammond, Myles Purchase, James Walker, Chase Penry, Gunnar Helm, Gus Zilinkas, Arden Walker, Enoch Woolfork, Domingo Prince II, and Branden Jackson. At least three of them will move on with extraordinary career statistics. During their high school careers, Julian Hammond threw for over 4,000 yards, Chase Penry had 167 catches and 2,200 yards, making him tied for 10th place in Colorado history, and Myles Purchase had 16 interceptions and 19 touchdowns. They came from rushing, punt and kick returns, and interception returns. It was Cherry Creek’s 11th state championship, with the 10th coming in 2019, and Coach Dave Logan’s third state championship since coming to Cherry Creek in 2012. Logan has been N

gram is what the governor had recommended. SB2. $60 million for renters who can’t pay their landlords and landlords who can’t pay their mortgage holders. This is more than the governor had requested. The money must be used by June 30, 2021. SB3. $5 million to be paid directly to energy utilities on behalf of customers who are not able to keep up with their energy bills. While slightly different in form than what the governor outlined, the amount is consistent with his request. SB4. $100 million to spend as needed to ensure that the state can fulfill emergency needs in the area of public health-related expenses. The state expects money spent in this category to be reimbursed when additional COVID-19 relief passes the Congress. HB1. $20 million for the state education department to provide grants for local education providers to increase broadband access where needed for both students and staff to equalize students’ ability to benefit from online learning. This, too, is the amount recommended by Governor Polis, although the use is for a more limited purpose. HB2: $45 for existing child care providers to keep their businesses solvent and to increase their size to add to the number of children they are able to service. HB3. $5 million to fund a program administered by the state’s Department of Human Services to help food pantries who apply for grants, as well as food delivery organizations. HB4. This bill will allow restaurants, bars, and food trucks to keep up to $2,000 per month in state sales taxes they collect from November to February. Although there is no cash being paid out directly to these businesses, this is an indirect grant from the state. New oil and gas rules take effect January 15 BY FREDA MIKLIN GOVERNMENTAL REPORTER

On November 23, it was announced that new oil and gas regulations adopted by the Colorado Oil and Gas Conservation Commission (COGCC) will take effect in our state on January 15, 2021. On April 16, 2019, Governor Jared Polis signed Senate Bill 19-181 which changed the state policy for oil and gas regulation from one focused on fostering development of oil and gas resources efficiently to one of regulating “the development and production of the natural resources of oil and gas…in a manner that protects public health, safety, welfare, the environment and

wildlife resources.” Since then, COGCC has held multiple public meetings to create rules to best fulfill its mission. The commission had originally hoped to issue the new rules this past summer, but the COVID-19 pandemic interfered with that schedule and new rules were finally adopted on November 23. The most noteworthy of the new rules requires that new wells be set back from schools and homes by 2,000 feet. The previous setback requirement was 500 feet. Routine flaring and venting to rid wells of excess natural gas was also banned. Another significant rule change was adopted in the environmental arena. The location for new wells must consider the impact they will have on the

protection of wildlife, avoiding critical habitats, and protecting wetlands, watersheds, and migration corridors. Common Sense Institute (CSI) of Greenwood Village studied the broader economic impact of an earlier version of the rules for protection of wildlife. Simon Lomax, CSI free enterprise fellow, told The Villager, “Before the publication of the CSI study, the COGCC was under pressure to make setbacks from wildlife habitats and other restrictions as rigid as possible, without room for exceptions, and with very little idea about how this could impact jobs, tax revenues and the broader state economy.” Lomax continued, “When the potential economic impacts were brought to light,

some flexibility was built into the rule. Looking ahead, the real question is how the COGCC will use this discretion when reviewing permit applications for new oil and gas projects. Because Colorado is a major energy producing state, the entire state economy has a lot riding on what the COGCC does next.” Dan Haley, president and CEO of the Colorado Oil and Gas Association said that, “This has been a long, exhaustive and exhausting process for all involved... contentious, tedious, illuminating and frustrating, but ultimately, we were grateful to take part in the process, to engage stakeholders throughout our great state and to work toward reasonable solutions.” He

concluded that, “Colorado now undoubtedly has the toughest oil and natural gas development regulations in the country.” Kelly Nordini, executive director of Conservation Colorado agreed, saying, “Colorado is once again a national leader in protecting public health and safety thanks to today’s new oil and gas rules.” Current members of the COGCC, all appointed by Governor Polis as full-time professionals in July, are Jeff Robbins, chair, Bill Gonzalez, Karin McGowan, John Messner, and Priya Nanjappa. What are some of your hobbies and passions? I enjoy art, Yoga and walking in nature. I taught Yoga at the YMCA’s of metro Denver for years however COVID put an end to that. Luckily, I have been able to teach chair Yoga to a very eager group of seniors at RiverPointe.

What would surprise someone meeting you for the first time? That is always a hard one. I think I am an open book. Two that come to mind: My car and I were extra’s in the movie “The Hand” starring Michael Caine. In my Junior year of high school, I qualified for Junior Olympics and Nationals as an All-Around Gymnast.

What do you enjoy about your job? What most excited me about coming to RiverPointe 18 years ago was the variety of work that was mine to do and that it would NOT be a desk job. I have too much energy for that. The incredible span of people I meet and the stories I hear as well as watching how our residents meet obstacles head on! Our residents have been the ones who have given me strength for these uncommon times. They have also encouraged me to learn the ins and outs of Zoom, of delving into my creative passions long ago buried, and how to help others

What is your favorite restaurant? Angelina’s on Santa Fe. The first time I dined there was right after a two-week holiday in Tuscany. It tasted just like the delicious food I experienced on my trip! One of our RiverPointe residents had lent me books about the Etruscans prior to visiting. It certainly helped to enrich my travels to that beautiful historic land.

Do you have a pet? We had a darling Japanese Chin-Pomeranian mix for 16 years. We are now looking for a rescue pup. They are all so cute I am having trouble choosing just one!

Favorite movie or series? Favorite movie is Braveheart and I am a little embarrassed to admit that GOT (Game of Thrones) is my favorite series.

Governor removes restrictions on worship services BY FREDA MIKLIN GOVERNMENTAL REPORTER

Despite the fact that Arapahoe, Denver, Douglas, Adams, Jefferson, and Broomfield Counties, among others, remain at Level Red on the

state’s COVID-19 dial, the Colorado Department of Public Health and Environment (CDPHE) has relented on its policy to limit the number of people who can attend indoor religious worship and life cycle events.

On December 7, the CDPHE office of communications announced that effective immediately, restrictions have been removed on the number of people who can attend worship services and ceremonies such as weddings and funer-

als, which are now classified as essential. This means that Coloradans participating in those activities “must do their best to follow public health recommendations but may exceed recommended capacity caps if they cannot conduct their essential activity within

those restrictions.” It was also announced that “museums, aquariums, and zoos may open indoors up to 25% or 25 people per room, whichever is fewer,” so that they may perform their educational functions. Fmiklin.villager@gmail.com

Business Chat – Tax Credit Potential: 50% of $10,000 Per Employee

I speak with Colorado business owners throughout the year and in 2020, stories run the gamut, which of course is not surprising. My discussions range from “having my best year ever” to “I’m struggling to remain open but am going to fight like ‘you know what’ to keep things going”, although the latter is unfortunately more prevailing. While 2020 business is down significantly for a large number of owners and likely will continue into 2021 to some extent, there are bright Steve Estle spots for those businesses which can weather this storm. Often times, it helps to remind myself and others how truly blessed we are to live in Colorado which has both a vibrant and resilient economy as well as exceptionally strong inflow demographics with no signs of waning (per dola.colorado.gov: our state’s population grew over a million since 2006 and last year alone up nearly 70K). So where am I going with all this you might be asking? Before I delve into a strategy which potentially can benefit businesses in 2020, I want to clarify something – myself and my extended team at Stryde provide specialized tax remediation services for business owners and real estate professionals, but we are not traditional “tax advisors (CPA, EA, etc.)”. To be clear, our consulting strategy is to partner and work side by side with tax professionals since we’ve chosen to focus in “specialized tax incentives” landscape. So let’s touch on one potentially beneficial strategy… One new federal incentive program (passed as part of Cares Act in 2Q2020) which received little to no media coverage, is the new Covid-19 Employee Retention Tax Credit (ERTC). If eligible, the employee retention tax credit is a broad based refundable tax

credit designed to encourage employers to keep employees on their payroll. The credit allows 50% of up to $10,000 in wages paid by an employer whose business is fully or partially suspended because of COVID-19 or whose gross receipts decline by more than 50%. The credit is eligible to all employers regardless of size including tax exempt organizations. Unfortunately, due to the newness and overall coverage/ demand for stimulus programs, ERTC is often overlooked as a potential benefit, but when applicable can significantly help to offset payroll taxes. Our team has expertise assessing eligibility. Quick example - I’m currently working with local dry cleaning client which has been in business 40+ years and meets all the qualifications which could provide much needed cashflow relief given the significant impacts Covid has had on their business. Episode #3 will delve into additional strategies designed to potentially offset prior year taxes. Many business owners, even though struggling in 2020, had some highly successful recent years between 2015-2019. Pancreatic cancer, the third-leading cause of cancer-related deaths, has historically been among the most difficult to treat. Despite the difficulties of hosting a major event during a pandemic, the annual Kingsbury Open Golf Tournament, held in September, sold out and raised a record-breaking $30,000 for Wings of Hope for Pancreatic Cancer Research, a Colorado nonprofit that funds a range of groundbreaking research at the University of Colorado Cancer Center. itable years ever?” Goodman said. “This brings our grand total to over $160,000 in six years.” Maureen Shul, a former Castle Pines mayor, founded Wings of Hope for Pancreatic Cancer Research after losing her mother and brother to the disease within several months of one another. Shul says she is grateful that local supporters have not forgotten the need for important cancer research, even as the nation struggles with a very different health crisis. “While nearly every facet of our lives has been impacted this year, what does not stop is the number of people being diagnosed and treated for pancreatic cancer,”

she said.” The research is so vital in finding early diagnostic methods and more effective treatments. That the Kingsbury Open has joined efforts with Wings of Hope to raise funding for pancreatic cancer research has made a significant difference in moving the research forward on this relentless disease.” Funds raised by Wings of Hope through its year-round events have supported a range of ongoing pancreatic cancer research at the CU Cancer Center on the Anschutz Campus in Aurora. “Due to Covid, Wings of Hope had to cancel most events this year,” Shul added. “For the Kingsbury Open to still be held, sell out, and be such a success is tremendously gratifying in terms of raising funding for pancreatic cancer research.“ Next year’s Kingsbury Open is scheduled for Thursday, Sept. 2, 2021. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF GREENWOOD VILLAGE, COLORADO: Section 1.The definition of “tangible personal property” in Section 4-330, Definitions, of the Greenwood Village Municipal Code is hereby amended to read as follows: Tangible personal property means property other than land or buildings that can be one (1) or more of the following: seen, weighed, measured, felt, touched, stored, transported, exchanged, or that is in any other manner perceptible to the senses, including digital product, software programs, software license fees, and software maintenance agreements. Section 2.The definition of “telecommunications services” in Section 4-3-20, Definitions, of the Greenwood Village Municipal Code is hereby amended to read as follows: Telecommunications service means the service of which the object is the transmission of any two-way interactive electronic or electromagnetic communications including but not limited to voice, image, data and any other information, by the use of any means but not limited to wire, cable, fiber optical cable, microwave, radio wave, voice over internet protocol (VoIP), or any combinations of such media, including any form of mobile twoway communication and television and entertainment services. Section 3.Section 4-3-40 of the Greenwood Village Municipal Code, Imposition of Sales Tax, is hereby amended to read as follows: Sec. 4-3-40. - Imposition of sales tax. (a) Levy. There is levied and there shall be collected and paid a sales tax on the full purchase price paid or charged for tangible personal property, including digital product, software programs, software license fees, software maintenance agreements, and taxable services sold at retail or leased by every person exercising a taxable privilege in the City by the sale or lease of such property and services. The sales tax is levied on all sales and leases of tangible personal property or taxable services except those specifically exempted, and is collected by the retailer or lessor and remitted to the City. (b) Taxable transactions and items. The sales tax shall apply as follows: (1) On the purchase price paid or charged for all sales and purchases of tangible personal property, including digital product, software programs, software license fees, and software maintenance agreements at retail. (2) On the total amount due under a lease or contract when the right to possession or use of tangible personal property, including digital product, software programs, software license fees, and software maintenance agreements is granted therein and such transfer of possession would be taxable under this Article if an outright sale were made. (3) In the case of retail sales involving the exchange of property, on the purchase price paid or charged, including the fair market value of the property exchanged at the time and place of the exchange; excluding however, from the consideration or purchase price, the fair market value of the exchanged property, provided that such exchanged property is to be sold in the usual course of the retailer’s business. (4) Upon telecommunication service, television and entertainment services, carrier access services and upon telephone and telegraph services, whether furnished by public or private corporations or enterprises, for all intrastate telephone and telegraph services. (5) Upon the entire amount charged to any person or persons for lodging services. (6) Upon the amount paid for all meals, and beverages and cover charges, if any, furnished in any restaurant, hotel, club, hospital, nursing home or other place at which meals, food or beverages are regularly sold. (7) Upon the purchase price of tangible personal property, including digital product, software programs, software license fees, and software maintenance agreements acquired with the purchase of a business for use in the operation of such business as such purchase price is documented in the bill or contract of sale, but in no event shall the tax be based upon a valuation of property less than its fair market value. If the purchase price of the property is not itemized in the bill or contract of sale, the tax shall be based upon the book value that the purchaser uses for income tax depreciation or upon the fair market value of the property if no book value has been established.

Regardless of the method used to value the property, no deduction shall be made on account of any outstanding liabilities acquired by the purchaser of the business and property. (c) Exemptions. The following shall be exempt from the sales tax: (1) All sales of automotive vehicles properly titled and registered to an address outside the City. (2) All sales of tangible personal property if all of the following conditions exist: a. The sales are to those who reside or do business outside the City; b. The articles purchased are to be delivered to the purchaser outside the City by common carrier or by the conveyance of the retailer or by mail; and c. The articles purchased and delivered are used outside the City. (3) All sales of gasoline or motor fuel which are taxed under Title 39, Article 27, C.R.S. (4) All sales of goods manufactured in the City and sold by the manufacturer thereof directly to the ultimate consumer when delivery of such goods is made by common, contract or commercial carrier or by conveyance of the retailer or purchaser to a point outside the City for use outside the City. (5) All sales to the United States or any state, or departments, institutions or political subdivisions thereof, and all sales to the City and any department thereof when made in the exercise of their governmental functions, provided that such purchases are supported by official government purchase orders or charged to the governmental entity’s credit card account and are paid for by draft or warrant drawn on the governmental entity’s bank account or such purchases are made pursuant to a written agreement with the governmental entity in which the purchaser is to make such purchases on behalf of the governmental entity. (6) All sales to charitable organizations of tangible personal property or services to be used in the conduct of the organization’s regular activities to foster its expressed charitable purpose and that possesses an exemption certificate from the City.

Included in the $29 million uncommitted general fund balance is $1.7 million intended to be used for open space acquisitions, should the opportunity present itself, along with $3.1 million listed as being available for traffic safety improvements.

This category was created in 2019 when it became apparent that GV was collecting significantly more revenue from photo red light tickets then it was expending on the cost of collection of fines generated by those tickets, which was contrary to the city’s previously announced policy of the activity being revenue-neutral. Although there is no city ordinance that puts any legal restriction on the use of this money, the city council decided as a matter of policy to keep track of it in a separate line item in the city budget. Volkswagen has been making the Jetta SEL for decades and it is known for good fuel economy and spirited performance. The old manual transmission has given way to the eight-speed “Tiptronic” transmission linked to the 1.4L, 4-cylinder turbo-charged engine. The combination of the fuel injected engine made in Brazil, and the transmission from Japan, make for an international vehicle with final assembly in Puebla, Mexico. Volk-

swagen has become one of the largest car companies in the world. The combination of parts and labor make this Jetta price very competitive with
