Sales tax plan raises questions An ordinance providing for a 1 cent sales tax for the next 30 years was tabled Thursday evening after questions arose about its wording. Justice of the Peace Brian Tatum expressed concern that the ordinance did not spell out how the collected tax money can be spent. He said fire chiefs were agreeable to letting the 1/2 percent that would be split equally among fire departments be used to

pay off the library debt for the first year, but the ordinance did not specify that. It was thought, in general, that in year two of the tax, the fire departments and rescue squad would receive 1/2 cent; 1/4 cent would go to 911, emergency management, law enforcement and the jail; and 1/4 percent for hospital maintenance and costs. But that was not how the proposed ordinance read. JP Nickie Brown noted that the library

bond could be extended, and the lawyer who wrote the ordinance agreed. “It’s a very complex tax issue,” County Judge Dale James said. The ordinance was tabled. It will be revised and brought back before the Quorum Court at its December meeting. Plans still call for the ordinance to come to a vote in the March 2020 primary. Also at the November meeting, JPs ap-

proved the third and final reading on procedures to establish private clubs in Van Buren County. It was a unanimous vote, though Ester Bass stated that thinks “we have enough watering holes in Van Buren County,” but it’s good to have an established procedure. On another topic, Bass asked about the finances of the county’s aging program. It’s “in trouble,” James answered. Chairman of the Aging

Program Board Phillip Ellis said the biggest problem is that minimum wage is about to increase and that will add $14,000 to the already strapped budget. He said volunteers - even for four or five hours per week - could alleviate the problem a bit. Other ordinances approved unanimously at the meeting were: * To appropriate $4,000 into the sheriff’s office budget from a K-9 fundraising event.

* To transfer up to $12,000 as needed, to fund 911 for another month. This is money that may not be needed, James stated. It would provide funds for general operations and salaries. * To establish an additional motor fuel tax fund. The justices also approved a resolution to purchase a used Mack truck, 2012 model, from a Mississippi company, for up to $54,000.

Project close to the HeARt In 2015, a visit between two women gave birth to a ministry to make dresses for girls at an orphanage in Haiti. Tammy McElroy had just retired and she “did a bit of sewing,” so she agreed to the request from Shelia Mitchel of the Ozark Water Project, which would be drilling a well in Haiti in June 2016. McElroy said she soon realized she would need help, so she recruited some women from her church, Antioch General Baptist, and Dresses From the HeARt was created. (The AR in Heart is capitalized to emphasis the Arkansas connection.) By the time the water project left for Haiti, the ministry had 55 dresses ready to go. The supply ran out quickly, McElroy says, but by the second year, the ministry had 120

dresses ready. In July 2016, a Honduran village was added to the project and McElroy’s group had 125 dresses ready for them. Dresses From the HeARt has two different sewing days. On the first Wednesday of each month, the group gathers at the Maranatha Assembly of God in Shirley, Arkansas, and sews from 9 a.m.-2 p.m. Beginning in January, they will sew at Antioch General Baptist, Rushing, on the second Monday of the month from 9 a.m.3 p.m. The group’s oldest sewer is Grandma Alice, who is 87, and has made 50 little girl dresses. Programs aim to help at holidays It’s that time of the year to break

out the wallets and help provide some Christmas cheer to low-income children in Van Buren County. At least three organizations are accepting donations and applications for those in need of gifts for their children. The grandaddy of them all, the Angel Tree Project, has been around for more than 40 years. In 1978, Jo Nell Warren and Debbie Whillock started Friends of Special People, which provided gifts to a few families and has grown into a charity serving 450-500 families each Christmas. Deadline to apply for the program is Dec. 1. Their Angel trees already are up around town. Now in its 11th year, Shop With a Cop raised $25,000 last year to provide gifts to area children. Debbie Cooley, one of the organizers, says donations are down a little this year, but are still being accepted. She said the number of children who get to go on a shopping trip with local law enforcement officers depends on the amount of money raised. The program got its start in Van Buren County when three law enforcement officers - then-Sheriff Scott Bradley, Game and Fish officer Brian Tatum, and Arkansas State Police officer Ted Jones - each pitched in $500 to provide Christmas for some needy children. A third program is called the Guardian Angel Project, which aims to provide holiday cheer to foster kids and their families in Van Buren and Stone counties. They are looking for donations of money, food, clothes and toys. For more information about this program, contact Heidi Kottke at 253-6053.

She says the ministry needs some corporate sponsors. But costs aside, McElroy says she feels God has called her to use her talents to help the impoverished women. “Our goal is to let these females know that they are valued, and loved by God and by our organization,” she says.

Jury finds man guilty of rape A jury sentenced a Conway man to 25 years in prison for sexually assaulting a family member over a nine-month DeVault period. Joshua Adam DeVault, 35, was found guilty of rape and sentenced Friday in Van Buren County Circuit Court to serve 25 years in the Arkansas Department of Corrections. DeVault was accused of raping the underage girl in her bedroom after her mother noticed a change in her daughter’s attitude in July 2017 and questioned her, according to court documents. The girl confided in her mother who contacted the sheriff’s office. According to the teen’s statement, DeVault would sneak into her bedroom and molest her, and on July 5, 2017, DeVault “had sex with her.” Immediately after filing a report with the Van Buren County Sheriff’s Office, the victim was taken to the Arkansas Children’s Hospital for a sexual abuse exam. The rape kit indicated the presence of a male’s DNA and subsequent testing determined it to be that of DeVault, the court documents state. Along with the 25-year sentence, a protection order was also issued against DeVault, barring him from communicating with the victim.

Thanksgiving is really here and everyone is planing their dinner and looking forward to all of the company and visits. It is time to remind everyone this next Saturday will be the first Saturday of the month so we will have our First Saturday Breakfast. That will be December 7. We serve at 8 a.m. The cost is only $6.00 and this helps us with the utilities. We look forward to cooking each month and to using the building on a regular basis. We will also have our Christmas Dinner on the same Saturday night. Santa Will be there again this year. Santa will not have Corky the elf with him this year, but Santa will be there. Dinner starts at 6 p.m.The corporations usually provide ham, turkey and rolls. This is a potluck so bring your favorite foods and do not forget the desserts. I have heard some of the churches are planing Christmas programs and dinners but I do not have any of the details yet. Maybe next week. We have several families that have re-

Condolences go out to the family of James Goodman. After seeming to be doing good, he took a turn for the worse and passed away on Sunday, Nov. 17. He is Donna Sherrod’s brother and Ann Mann’s uncle. bowling team bowled in the Tri County tournament in Russellville. Our team got second place, which we were all surprised and awfully proud of. Glenda Collins and I got fourth place in doubles. That was also a good surprise. We missed bowling last Monday because of the threatening weather, so we had to bowl 3 make-up games on Monday and then 3 more for our regular bowling. I went to Conway on Tuesday to get an MRI and to see the gastroenterologist. Margie Pounds went with me, so we had to bowl a few more games on Tuesday also. I took Margie to the eye doctor on Wednesday. She got new glasses, so we had to pick out some frames. It will be my turn next month, so I went ahead and picked out some for me while we were there. We took JR to North Little Rock for a checkup on Thursday. It pretty much took the whole day again, so I am taking it easy for a few days. It’s been a long five days. God bless and have a good Thanksgiving.

Ruth got to see a lady that she hadn’t seen in about 40 years. She was happy she was with them. Nova got to see many of the people that she went to school with in Shirley. Nova gave Jimmy Murray a picture of Dal Caldwell, one of his classmates from grade school in Shirley. Shirley's Junior boys basketball team beat Greenbrier in a tournament at Marshall on Saturday with two overtimes. Way to go, boys. Wanda Poynor reports that her husband, Paul, who has been sick, is doing better. Visiting Jerel and Kathleen Brown over the deer season was their son, Jeremy Brown, and Wesley Price from Ruston, Louisiana, and Kevin Pratt from Thida, Arkansas. Asher Hensley spent Monday, Tuesday and Wednesday with his papa. He had a sinus infection and couldn't go to school with a temperature. Don and Norma Whaley went to Walnut Ridge Saturday to see both of their boys. They were doing well. They took the boys out to lunch at Don's Steak House for Dusty's birthday and they had a good visit. The Shirley Museum will be closed for the season at the end of November.

Religion Obituaries

Thanksgiving or complaining The attitude of gratitude is always in season. Thanksgiving is always appropriate. “In everything give thanks, for this is the will of God in Christ Jesus for you.” (1 Thessalonians 5:18) This is a thanksgiving article, but a negative one. Sort of. I want to register a complaint about complaining. Complaining is the exact opposite of thanksgiving. We don’t give thanks for all things, but we are to give thanks in everything. We don’t thank God for tragedies, but we can learn to give thanks in them. We will always have plenty of reasons to be thankful. We can believe that he is working everything out for our good. Romans 8:28 will forever be true: God works all things for the good of those who love him and are fitting into his purpose. Now, when are we to be giving thanks? Always and in everything. Every day of the year should be Thanksgiving Day. If you are not giving thanks, you are probably complaining. If ever there were a people who should have been thankful it was the Israelites who had been delivered by the mighty hand of God from 400 years of slavery in Egypt. But listed among the horrible sins that brought death on them in the wilderness is the sin of complaining: “neither complain, as some of them complained and were destroyed by the destroyer. Now all these things happened to them as examples.” What Israel did in the wilderness is expressly given to us as a bad example and a warning. One thing that caused the displeasure of God toward them was their complaining. It is never the will of God for us to complain. Some people have a spirit of complaining. Stay away from these people; they will influence you. Two ladies meet over the backyard fence: “It’s a beautiful day today, isn’t it?” “Yeah, but I bet it’s raining somewhere!” We can overcome complaining and instead get into the spirit of thanksgiving. Did you ever notice there always seems to be a reason to complain, but there never is. These ancient believers in Numbers 16 were complaining against Moses and Aaron. But it wasn’t Moses who opened the Red Sea; it was God. They were complaining about no longer being in Egypt, the place where their lives were “bitter with hard bondage.” Every occasion to complain is actually an oc-

casion to trust God and pray. God can handle whatever is wrong. He was about to give them bread, meat and water in miraculous ways. All complaints are against God! If He “works all things after the counsel of his will” then we need to see God involved in everything. Joseph saw God in the mistreatment by his brothers. Jesus saw that all the horrible things men were going to do to him were actually his Father’s will. If Joe and Jesus could see the hand of God in the worst possible situations, surely we should see it in the little things we complain about. God is never off the throne, so our complaints are always against God. The occasion to complain seems worse than it is. The past always looks better than it was. People look back at “the good old days” when they had to hitch mules to a wagon to go somewhere. When they were back there they complained and looked back at their good old days. The present always looks worse than it is. We look at the way things are now and complain about what is happening. There is a spirit of complaining and there is a spirit of thanksgiving. Choose thanksgiving. It seems your complaints are only heard by yourself or a few choice others, but … not so! God hears your complaints because they are against him. He knows the attitude of your heart. Others know it too, by your words. Complaining can make you miserable and ruin your relationship with others and with God. Wouldn’t you like to spend the rest of your life without ever complaining about anything? You can. It is the will of God that you do. By God’s grace you can live free of complaining and spend the rest of your days in everything giving thanks. This is God’s will. Practice this. Learn it and you could have the best year of your life. Be thankful. Even when you can’t understand God, by faith be thankful. It will make your life better and give him glory.

A time to mourn Fiction (Part 2)

Kip’s letter still lay on the table where she had placed it this morning. She picked up the page and for the third time, read it again. “My darling angel,” he wrote, his cursive writing slanted slightly upward at the end of each line. She brushed across the smooth page, willing herself to feel the warmth of Kip’s strong hands. Seven months had gone by since he’d boarded the plane for Iraq. The news constantly reported suicide bombings that filled her with anxiety. She must conceal her inner feeling from the children — she must stay strong for them. Evelyn’s words flashed back to her: “You still have him!” True, Kip was with her in spirit and in heart. Communication through letters, emails and an occasional phone call kept her spirits high most of the time. God willing, he would return home safely at the end of his tour of duty. Joe would not be coming back to Evelyn. Now, Tony may not come back either. How can Evelyn cope with her son’s disappearance? Candace shivered. She picked up the phone and dialed again. “Any word yet?” “Nothing!” Evelyn’s distraught voice replied. “How can he do this? He may be lying in a ditch somewhere . . . dead!” “You mustn’t think like that. Just know that this will work out.” Evelyn’s sobbing voice acknowledged that she’d heard, but Candace knew she was not convinced. Her sister needed to believe it, thought Candace, just as she needed to believe that Kip would make it home safely from Iraq. For a while, Candace dozed in her chair. The clock struck midnight, shattering the quiet of the room. She awakened, reached for the phone and dialed Evelyn once again. Still no word from Tony. Evelyn agreed that she must report him missing if

he did not come home by morning. He did not come home, Candace learned the next morning when she called once again to ask about him. She took the children and drove the short distance to her sister’s place, her heart ripping with a deep foreboding. Has something terrible happened to Tony . . . or to Kip? She kept her feelings to herself. She and the kids settled in to wait with Heather while Abbey went with her mother to file a missing person’s report. A week went by. Friends and family distributed flyers, made telephone calls and still there was no word from Tony. Joe Winfield had disconnected his phone, and no one could get in touch with him to tell him his son was missing, but surely, he would hear it in the news. Unless, he had traveled out of the country, as he sometimes did, to Mexico. When Kip phoned from Iraq, the kids squealed, each trying to be first to talk to their daddy. “Me talk!” Katie grabbed the phone from Sadie. “Aw wite,” Sadie said, releasing the phone, in her good-natured way. Jake stood patiently waiting his turn and when he finished talking, he handed the receiver to his mother. The joy of hearing Kip’s voice mingled with her sadness and disbelief that her nephew was still missing. Kip expressed concern for Tony as well as his love for Candace and the kids. Hidden tears threatened to overflow. Nobody ever told her she should not cry, but she wouldn’t cry in front of Evelyn or the kids, and certainly not when talking to Kip. Too soon, it was time to say goodbye. The click that disconnected their phones could never disconnect their hearts. Amid the chatter of the children, a horrifying loneliness overwhelmed her. Oh, Kip, darling . . . I miss you so much. (To be continued)

Jackets fall to Hornets The Yellow Jackets football season ended on a cold, rainy night in south Arkansas on Friday with a 4614 loss to Camden-Harmony Grove. Clinton’s normally high-powered offense stumbled against the Hornets in the second round of the playoffs, scoring only two touchdowns, both coming in the first quarter. The Jackets’ first touchdown was a 2-yard run on a quarterback keeper by Weston Amos. The second score was a 60-yard run by John Riley Hinchey. The Hornets answered with touchdowns of their own each time and the first quarter ended in a 1414 tie. As the clock ticked down in the second quarter, Harmony Grove racked up its third touchdown and the Yellow Jackets went into the locker room on a rare note - behind in the score. Ethen Drake struggles to keep his footing.

The Hornets busted the game open in the third quarter, scoring three more touchdowns, making the score 40-14. They added one more scoring drive in the fourth quarter making the final score 46-14. The Jackets were held to 203 yards rushing on 40 plays. They were one of seven on third down conversions. Hinchey had 130 rushing yards and end the season with over 1,000 yards. He added 11 tackles to his tally. The other leading tacklers were Kadance Sowell and Amos with 7 each; Austin Drake with 6; and Matt Gonzalez with 5. The senior class, with 33 career victories, is the school’s winningest class ever. The seniors are: Austin Drake, Weston Amos, Jason Patel, Ethen Drake, Ryan Jones, John Riley Hinchey, Justin Patel, Matt Gonzalez, Kadance Sowell, Cade Treadaway, Jayden Exzabe and Codey Edwards. Head coach is Chris Dufrene.

The report shall detail the (a) amount of highway revenue turnback revenues received; (b) expenditures made from the highway revenue turnback revenues received; and (c) projects funded using the highway revenue turnback. ORDINANCE NO. 2019-54 BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF VAN BUREN, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO ESTABLISH THE ADDITIONAL MOTOR FUEL TAX FUND (ACT 416 OF 2019); AND TO DECLARE AN EMERGENCY. WHEREAS: Article 1. Affirmation. It comes before this court that there is a need to establish a fund in the books of the County Treasurer as a sub fund of the County Road Fund #2000, to track the revenues and expenditures of the wholesale tax on gasoline and diesel as levied by Act 416 of 2019. This Court recognizes and affirms the need for such a fund to properly account for, control, and report expenditures of such in compliance with Act 416 of 2019, Section 6 and codified as § 26-64-104. WHEREAS: Article 2. Establishment of Fund. The additional Motor Fuel Tax Fund (Act 416 of 2019) is subject to all the normal County budgeting, appropriation and expenditure regulations of Title 14 and Title 27 in Arkansas Code Annotated. The fund is subject to annual reporting and disclosure requirements to be submitted to the Director of the Department of Finance and Administration. The report shall detail the (a) amount of highway revenue turnback revenues received; (b) expenditures made from the highway revenue turnback revenues received; and (c) projects funded using the highway revenue turnback. WHEREAS: Article 4. Emergency Clause. It is found by this Court that since revenues from this source will be received in December it is fundamentally necessary to establish the Additional Motor Fuel Tax Fund (Act 416 of 2019) immediately in order to track the revenue and expenditures in accordance with the precepts of Act 416 of 2019. (a) (l) a copy of the completed application the applicant intends to fil with the Arkansas Alcoholic Beverage Control Division: and (3) A nonrefundable application fee of $1500.00 (b) The Safety committee shall review the application at said meeting, and decide whether to place the ordinance on the next regular meeting of the Van Buren County Quorum Court allowing time for notice as required by section 1(c) of this ordinance in the event that Safety Committee determines that the applicant does not contain the elements required by this article, the Safety committee shall mark the application as DEFICIENT-NOT APPROVED and the application shall be deemed to. be denied as having not complied with the provisions of this article. (c) If placed on the agenda of the next Van Buren County Quorum Court meeting the applicant, not less than thirty (30) days prior to the meeting of which the request is to be heard, shall notify all property owners within five hundred (500) feet of the proposed location, by personal service or by United States Postal Service Certified Mail, return receipt requested and by duplicate sent by regular mail, informing the owner of applicant's intent to request an ordinance in support of an application for a permit to operate a private club. The notice shall include date, time, and location of the Quorum Court meeting in which the matter requested is to be heard. The notice shall inform each property owner of their rights to make their position in support or opposition known at the Quorum Court Meeting. (d) An applicant shall provide the Van Buren County Quorum Court with the following not less than fourteen (14) days prior to the Quorum Court meeting during which the matter is to be heard. i. SECTION 2. Establishment of Regulations. The following rules and regulations shall apply to all applicants in the unincorporated area of Van Buren County, Arkansas (a) Definitions: For the purpose of this ordinance the following definitions shall apply. Words and phrases not specifically defined shall have the meanings assigned by Title Three of the Arkansas Code Annotated and the Arkansas Alcoholic Beverage Control Division Regulations. 1) "Alcoholics or Narcotics dependency center" means a building primarily used for treatment of drug alcohol dependence. 2) "Assisted Living Center" means a building or system of housing that is primarily used for the care of senior citizens or individuals with developmental disabilities who need daily assistance. 3) "Church" mean building that is primarily used for religious worship. 4) "Daycare" means a building that is primarily used for the care and needs of people who are not fully independent, such as children or elderly people. 5) "Public Park" means a property used primarily as a public recreation facility. 6) "School" means a building that s primarily used for education. 7) "Youth Activity Organization" for the primary purpose of developing, promoting and regulating activities to minors. b. DISTANCE FROM CERTAIN ESTABLISHMENTS. No permit will be issued for an establishment that is less th one thousand five hundred (1500) to be measured from the nearest property line point to the nearest property line point of any School Church, Day Care, Assisted Living Center, Alcoholic or Narcotic Dependency center, Public Park or Youth activity Organization within the unincorporated area of Van Buren County, Arkansas (existing at the time of application). The applicant bears the responsibility of providing proof to the Safety committee that the premises of the proposed private club is not less than one thousand five hundred (1500) feet from the afore mentioned establishments. SECTION 3. The Van Buren County Quorum Court's approval of an ordinance

LEGAL supporting an application for a permit to operate a private club in the unincorporated area of Van Buren, County, Arkansas does not constitute final action nor does it guarantee the permit will be approved by the Arkansas Alcohol Beverage Control Division. The ordinance of the Quorum Court merely expresses support or lack of support of the governing body of Van Buren county, Arkansas. It provides no indication or whether the application complies with the appropriate alcohol regulations or laws. SECTION 4. The Arkansas Alcohol Beverage Control Division is not compelled to approve or issue a permit to operate a private club based on the Van Buren County Quorum Court's approval of an ordinance supporting the applicant's permit request. The Van Buren County Quorum Court members, individually or as a whole, are not compelled to approve or support an applicant’s permit request to operate a private club based on e acceptance of this ordnance or an applicant's fulfilling the requirements of this ordnance. SECTION 5. Repealer. Any ordinance which conflicts with this ordinance is hereby repealed to the extent of the conflict. SECTION 6. Severability. In the event that any provision of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this Ordinance which shall remain in full force and effect as if the portion declared invalid were not originally a part of this ordinance. SECTION 7. This Ordinance is declared to be a measure for the health, safety, and general welfare of the people of Van Buren County, Arkansas and therefore, this Ordinance shall be in full force and effect from and after the date of its passage. Gardening through the winter By Jeff Burgess

My friend, fellow organic gardener and healthy eating advocate, Lalla Ostergren, loved her fresh fruits and vegetables. Before we met, I was like many and let most of my garden die as winter approached. But Lalla wanted to have fresh produce year round. She was not satisfied with just factory greenhouse grown, store bought, winter produce. She wanted her own good energy mixed with plants grown at home that she knew were free of pesticide residues. Towards that end, her husband Richard built a greenhouse, out of mostly leftovers from their main house construction and salvaged materials. The 12 by 16 foot structure cost them less than $100. The biggest expense was running water and electric lines. That made me envious as I have neither in my greenhouse.

She knew that, so when she first went on hospice, she told me I could have it. Now in my third winter of use, there are tomatoes, beans, hot and sweet peppers, Swiss chard, kale and onions growing in there, and a whole lot of flowers. Lalla’s garden had to have winter color. Pansies and violas, along with ornamental cabbage, can make a winter garden famous. We’re fortunate to live in a climate that allows these flowers to thrive through most winters, without covering. They add a cheery note especially when the weather is dreary. Southern facing positions are most successful, especially with nearby thermal mass, like brick, concrete and stone. Daytime sunshine is absorbed in the rocks until night when the stored heat is released, creating a very small microclimate. These ideal conditions

will contribute to a robust and prolific winter flowerbed. And many cold weather vegetables benefit from similar assistance. Cold frames store heat from the sun and can assist many vegetables to be productive all winter. With no thermal support, collards can survive 15 degrees and some leek varieties can survive zero degrees. Some onions and garlics have similar high tolerance to cold. Even spinach, kale, cabbage, carrots, mustard, radish and arugula can all take various temperatures in the 20s. Add a cold frame or other protective season extender and many locations in Van Buren County can be harvesting fresh produce through much of the winter. Lalla didn’t think any growing project was too small to not benefit wellness. So she would promote small steps to those resistant to gar-

dening, like growing a few little pots of herb on a window sill. Possible choices include: sage, rosemary, thyme, chives, cilantro, parsley, oregano, dill, basil and tarragon. Kits are available and can make a great holiday gift. Whether you start with seed or seedling, you want your sunniest window and a little supplemental lighting during the depth of winter’s darkness. Have the containers you use fit comfortably on your windowsill. Use a good quality potting mix, and feed and water routinely. Lalla was convinced that being involved in plant growth and development contributed to her wellness before she ever benefited from eating the produce. So she wanted the growing process going on year round. To those who resisted gardening because of the dirt, she encouraged sprouting. No dirt and no dirty hands needed.
