lans are moving forward on the new $750 million Bridgewater Associates headquarters within Stamford’s Harbor Point development project.

The initiative is primarily a tool for economic growth, but it’s also another opportunity to develop the waterfront, developers at Building and Land Technolo�y say.

“We’ve tried to make this a win-win for Stamford and I think we’ve done it,” said John Freeman, general counsel and spokesman for BLT. “We’re really excited to present our plans, allow people to see it, review it and continue to work on it.”

BLT officials are in the process of seeking approval from city planning, zoning and finance boards. Construction could begin as soon as the fall with a move-in date of 2016.

The 850,000-square-foot building is slated to stand five stories tall and includes a public walkway around the waterfront, which is currently closed to the public.

The 14-acre site is currently the site of a working boatyard, which BLT plans to replace with a new marina.

In an agreement with the city, the developer has agreed to spend an additional $5 million on public improvements, which includes the marina, the restoration of the East Creek estuary and upgrades at Kosciusko Park. The estuary’s historic, tidal salt marsh will be restored and BLT plans to build a fishing platform and kayak launch sites in the park.

Rates released for health exchange

T

he Connecticut Department of Insurance released a first look at how much health care plans will cost on the state’s health insurance exchange, Access Health CT. A part of the Affordable Care Act, the exchange is an open marketplace for individuals and employers to shop for health care plans beginning Oct. 1.

Depending on the level of coverage, initial premiums for individual policies range from $215 to $347 per month. For employers with one to 50 employees, monthly premiums range from $271 to $435.

Phil Boyle, an Access Health CT business outreach manager, said the long-awaited rates were actually lower than he expected, given the way rates have increased in the last few years.

“I was pleasantly surprised, quite frankly,” said Boyle, a former insurance broker. “It’s not lower than the market would bear. But the state DOI and actuaries did a great job analyzing the rates and holding the insurance companies feet to the fire to stay in check.”

To help pay for the premiums, federal subsidies will be offered to individuals earning up to $44,680, or families of four earning as much as $94,200. And for small businesses, employers with less than 25 employees will be eligible for tax credits to cover up to 50 percent of the cost. Additionally, all small business owners will be able to write off a portion of their health care plan expenses in their taxes, Boyle said.

Businesses with more than 50 employees however, will be required to offer employees health care, or will face a $2,000 penalty per employee.

If an employee at a large company

receives a tax subsidy to purchase a plan off the exchange, the employer will face a $3,000 fine per employee with a subsidy.

A main goal of the Affordable Care Act is to increase the affordability of health care. But Boyle said he believes it will take time for consumers to see additional health care savings. For now, insurance companies are still “wrapping their arms” around the new regulations, Boyle said.

Insurance companies set to participate in the exchange include ConnectiCare Benefits Inc., Anthem Health Plans Inc., HealthyCT Inc. and United Healthcare Insurance Co. Aetna Life Insurance Co. withdrew its rate filing Aug. 2 after an agreement couldn’t be reached between the company and the insurance department, which said Aetna’s rate was too expensive. Similar to changes the depart-

ment made on other companies’ rates, department officials wanted Aetna to remove its risk adjustment and lower expected service increases to 8.5 percent from 10 percent.

Boyle said it was very surprising to see Aetna drop out of the exchange at the last minute. The company was one of the first supporters of the Affordable Care Act and officials were attending regular meetings at the exchange.

With the withdrawal, Lt. Gov. Nancy Wyman said the decision would not affect the state’s overall goal of offering affordable health care plans.

“The bottom line is that this is a business decision by Aetna that changes nothing for Connecticut consumers and businesses,” Wyman said in a release. “People will still be able to choose from a very comprehensive range of quality, affordable coverage options.”

Missing funds fuel station battle

A

longtime businessman in the region’s gasoline industry is fighting in a state court in White Plains to regain control of a Fairfield County service station business from which he removed more than $860,000 last month. The withdrawal came soon after a judge ordered him replaced as manager by the partner with whom he has been embroiled in dueling lawsuits over their Shell station businesses for two years.

Sammy El Jamal, owner of Wholesale Fuel Distributors in Thornwood, N.Y., and his Purchase, N.Y., attorney, Bruno V. Gioffre Jr., want to reargue the Connecticut case before New York Supreme Court Justice Joan B. Lefkowitz and have El Jamal restored as manager while the case continues.

His legal opponents, meanwhile, want El Jamal cited for contempt of court for removing the company funds.

Gioffre in a court filing said the money was used by his client to pay his personal income taxes.

The judge at a July 31 court hearing did not issue the temporary restraining order that would have given El Jamal managerial control three weeks after

his removal. Another court session was scheduled Aug. 9.

ager of two companies that lease and supply fuel to six Shell service stations in Fairfield County. El Jamal owns 95 percent of the businesses, Connecticut Dealer Stations L.L.C. and Wholesale Fuel Distributors-CT L.L.C., and Silverman holds a 5 percent stake.

A Silverman-owned company is those two companies’ landlord.

Silverman and his investor group paid approximately $19.9 million in 2008 to acquire the stations from Shell’s retail real estate arm as Shell began to sell off its service stations and exit the retail business.

Jamal, a gasoline retailer and wholesaler with 20 years in the industry. El Jamal also was point man and a minority owner in the $43.3 million acquisition in 2009 of 88 Shell stations in Westchester County, New York City and Long Island by an investor group led by Silverman and Scarsdale investor James A. Weil.

Their business relationship soon deteriorated. In 2011, Silverman and Weil acted to to remove El Jamal as managing member of their New York operations, claiming his mismanagement and frequent absences threatened their investment. El Jamal went to court to stop their effort and to prevent a possible sale of their Shell holdings.

A New York Supreme Court judge last year ruled in favor of Silverman and Weil, who removed El Jamal as manager and moved their business headquarters from El Jamal’s Thornwood office to a Silverman building in White Plains.

In the Connecticut case, Silverman and White Plains attorney Marc S. Oxman claimed the operating agreement between Silverman and El Jamal provided that Silverman would become sole manager of their jointly held businesses if El Jamal defaulted on mortgage payments. They claimed that provision should take effect after their company

last spring defaulted on an approximately $13.5 million acquisition loan that matured with GE Capital Solutions, leaving the company in financial jeopardy.

Judge Lefkowitz agreed and named Silverman sole manager of Connecticut Dealer Stations and Wholesale Fuel Distributors-CT. Three days after the judge’s ruling, El Jamal removed $863,000 from company accounts.

Seeking to reargue the case, El Jamal and Gioffre claim that Silverman was responsible for failing to refinance or pay off the mortgage on the service station properties he owns and leases to the companies in which El Jamal holds the majority interest.

El Jamal in an affidavit claimed he faithfully made monthly mortgage payments of more than $100,000 as required by their agreement in addition to monthly rental payments totaling approximately $3.3 million since the fallen-out partners struck their lease deal about five years ago.

El Jamal told the court the Shell businesses have been consistently profitable under his management. Silverman in his short time as manager has left business operations “in total chaos,” he said.

Grants boost Darien water, Sherman stage, Bethel sidewalks

eventeen municipalities — three in Fairfield County — are to be awarded grants targeting capital improvements under the state’s Small Town Economic Assistance Program (STEAP).

The sites include Sherman, Bethel and Darien, which netted a total $719,000.

Other sites are in Canaan, Canterbury, Clinton, Colebrook, Deep River, Ellington, Glastonbury, Litchfield, Montville, North Canaan, Salisbury, Seymour, Wallingford and Westbrook.

“STEAP grants give us the opportunity to invest in quality of life improve-

ments in small towns across our state,” Gov. Dannel P. Malloy said.

Darien received $400,000 to construct an aquatic habitat and remove sediment within the Goodwives River watershed from Upper Pond. Upper Pond empties into Gorham’s Pond, which, in turn, leads into Long Island Sound.

The town of Bethel will receive $250,000 to replace and construct sidewalks at several locations. The project also includes replacing stairs at several entrances to the CJ Hurgin Municipal Center.

State Sen. Bob Duff, D-Norwalk, said, “Protecting our natural resources and maintaining Darien Harbor is essential to the health of the environment and

local our economy. This STEAP grant is a smart investment that builds on our prior efforts, and I thank Gov. Malloy for his support.”

“Long Island Sound and its many tributaries are the defining characteristics of our region, and protecting them is in everyone’s interest,” said State Sen. Carlo Leone, D-Stamford. “The Goodwives watershed is a local landmark and all of Darien will be appreciative of this wonderful investment.”

“As a longtime conservationist, I am very pleased to hear that Gorham’s Pond will be receiving funds to remediate and restore it as well as protect it for the future. Many thanks to the governor’s office for this appropriation and

investment,” State Rep. Terrie Wood, R-Darien, Norwalk, said.

Sherman received $69,000 for repairs and upgrades to the Sherman Playhouse. The playhouse has hosted productions for more than 100 years.

Sherman First Selectman Clay Cope said, “With these funds, the historic Sherman Playhouse will have much needed updated facilities for both patrons and staff.”

State Sen. Michael McLachlan, R-Danbury, said, “Thanks to this funding, the playhouse will now undergo necessary repairs and upgrades that will allow this cultural landmark to continue entertaining for many generations to come.”

CBRE finalizes a $39 million deal

The recently renovated property is an approximately 130,000-square-foot class A office building. Existing tenants in the building include Marc Fisher Footwear and Musden Financial.

‘Cautious, but rising, credit demand’

C

onnecticut’s credit conditions continued to strengthen through the first three months of the year, according to the “First Quarter 2013 CBIA/Farmington Bank Credit Availability Survey,” which began gathering data in April. Demand for credit among the state’s businesses remained tempered, with 29 percent of those surveyed indicating they sought financing, a 3 percent increase over the previous quarter.

“The bottom line is that modest economic growth is now translating into cautious, but rising credit demand, despite the tenuous nature of the state’s economic recovery,” Connecticut Business & Industry Association economist Peter Gioia said.

Connecticut businesses were more successful securing credit in the first quarter of the year, with lenders also showing more aggression in their efforts to provide financing.

The Farmington Bank Credit Availability Index (FBCAI) was at 35.8 points in the first quarter, compared with 30 in the previous period, hitting its highest level since the second quarter of 2008.

The FBCAI’s future expectations component, which measures credit availability three-to-six months from now, improved to 36.5 points, or almost five index points higher than the previous quarter.

Some 17 percent of respondents rated current credit conditions as either good or excellent in the most recent survey, while 50 percent said they were average.

“The good news is that area businesses seem to be securing the credit they need in order to meet payrolls and bolster inventories while positioning themselves for long-run growth,” said Don Klepper-Smith, chief economist and director of research at DataCorePartners.

“The bad news is that this is not ‘your father’s economic recovery’ and that profound structural changes have altered demand for labor. Clearly, Connecticut businesses are navigating a new economic normal.”

Of those who sought financing, 57 percent were seeking less than $100,000, while 27 percent wanted between $100,000 and $500,000.

Only 7 percent of respondents sought financing in excess of $1 million, a decline of two percentage points over the previous quarter.

More than one-third (34 percent) said they would needed financing for working capital, while 14percent planned machinery or equipment purchases, and 7 percent wanted to expand existing plant or office space.

The Q1 survey was emailed to some 1,900 Connecticut businesses in April. A total 221 responded, for an 11.6 percent response rate and a margin of error of +/- 6.7 percent.

ROAD TRIP THE PULSE OF BUSINESS ALONG U.S. ROUTE 1

he Fairfield County Business Journal recently staked its claim to the great American summer tradition: the August road trip.

The plan was to drive the length of U.S. Route 1 — the Boston Post Road — from the New York border to the Housatonic River and plumb the business mood on one of America’s most famous roads.

The coast-hugging byway dates to Colonial America and likely further back to Native American trails that it coopted. It runs a total 2,369 miles from Maine to Key West, Fla., but the nation’s No. 1-designated highway nonetheless goes by a dizzying array of names.

Within Fairfield County, Route 1 is Putnam Avenue, King’s Highway, Tresser Boulevard, Cherry Hill Road, Boston Avenue, Van Buren Avenue, Connecticut Avenue, Belden Avenue, North Avenue, West Avenue and Barnum Avenue.

Those street signs notwithstanding, most people along its length are familiar with its two regional shorthand names: The Post Road and simply Route 1.

Occasional residential neighborhoods — as along the manicured stretch in Bridgeport — soon enough give way to commercial activity. That high-visibility commercialism attracts mom-and-pops, major corporations and national chains: a traffic jam of tony car dealerships in Greenwich, the World Wrestling Federation headquarters in Stamford, B.J.’ Wholesale Club in Stratford, Edge Fitness Clubs in Fairfield. It is a magnet for the likes of Home Depot in Fairfield, for Mitchell’s in Westport and for the A&P in Riverside.

A few spots might be called “gritty,” but nothing worse; there is no outright blight. Commercial activity, meantime, is everywhere.

Our 40-mile trip — leaving the Post Road only once, for a forced detour in Stratford — began at 6 a.m. at the Port Chester, N.Y., border and ended at 2 p.m. on the west shore of the Housatonic River.

MICHAEL DELVALLE has worked at Glory Days Diner, 69 E. Putnam Ave. in Greenwich, for 15 years and serves as occasional manager. He opens daily at 6 a.m.

“Over the last year business has been really good,” he said. “This for me is the best time of year because I have more time to spend with my customers. People are on vacations and it’s a little more relaxed.”

The florist dates to 1944; Ward, from England, has worked there three years. “We always do these slightly different versions of traditional flowers – slightly more unique and harder to find,” Ward said, noting the 1405 Post Road store and greenhouses constitute the largest flower conservatory in lower Fairfield County.

“Business has been great. Usually it slows down a bit, but this year it hasn’t.”

THE NEW NORWALK FIRE DEPARTMENT HEADQUARTERS broke ground April 10, 2012, and is on pace for completion later this year. The project was designed by upstate New York architects Pacheco Ross Architects P.C. It features 32,000 square feet of interior space. The city reports construction is on time and on budget ($13 million).

THE WAYPOINTE mixed-use development on West Avenue in Norwalk is bustling. The builder is Norwalk-based Pointe Builders. The $250 million Waypointe project envisions a total 774 apartments and 90,000 square feet of commercial space. Phase one features 444 apartments and 60,000 square feet of street-level retail and restaurant space. Work on the first phase should wind down in 2015.

LINDSEY CASSO is assistant manager at Riverview Bistro on the Housatonic. The restaurant is the first (or last) business in the county on The Post Road, though its address is 946 Ferry Blvd. “Business is good,” she said. “It’s been a really good summer.”

A box-store mall is across the street and, gesturing toward it, Casso said, “We anticipate a pickup from the overflow of back-to-school shoppers.”

“It’s a huge challenge, with all the industrial uses and private ownership of waterfront property,” he said. “Having the opportunity is difficult. But I think we’re very fortunate that the stars have aligned and that we have a state, city, community and developer that share the vision to make it happen.”

A mature forest will be planted on the north end of the building’s slanted rooftop and a fuel cell plant with solar panels will be installed along the southern half. The collection of solar panels is expected to be one of the largest in the state.

The city of Stamford estimates it will gain an additional $6.5 million in property taxes with the new headquarters, which is the equivalent of 91 teachers’ salaries. Additionally the city will receive $9.75 million in one-time construction fees.

The deal has come under scrutiny however as the public has criticized the governor for putting too much emphasis on large firms, as opposed to providing additional support for small businesses.

Competing for market share When you’re a small company, most high-end clients want to use a larger company – at least that’s what I’ve found. Do you have any suggestions on how to get around that concern?

THOUGHTS OF THE DAY: Check to see if you’re marketing to the right kinds of clients for your business. Build an identity that matches what your clients want to buy and make sure your company can live up to that. Look for marketing tools that appeal to your target customers. Make sure you’re calling on and reaching the right people within your clients’ organizations.

There are many reasons why a company might want to buy from a large company. Those reasons might include a perception of financial depth, R&D ability, continuity as staff turns over, board and other shared relationships, reciprocity purchasing (I’ll buy from you, you buy from me), ability to buy multiple products from one source. The list goes on, these are just a few of the reasons I’ve heard cited.

Reality is, most of these can be overcome by a small company. Build up reserves so that your company can afford the kind of float a large corporate or government buyer might demand. Know how much R&D your company can afford to invest in. Consider aligning with larger organizations that can supplement R&D and provide other forms of intelligence without being a competitor.

As a small business owner you have the ultimate in continuity. You are much more accessible than the CEO of a major competitor, the buck still stops on your desk and you aren’t likely to take off or get fired since you’re the owner.

When it comes to board and other relationships, think about whether you want to invest the time and ener�y on this one.

If you decide it’s worth pursuing, lay out a plan to get there, identifying the players you need to know. Social media platforms and annual reports can give you insight on who to know and how to get to them.

As for reciprocity, you’ll not be able to compete with most large volume buyers.

Instead, pitch your company as knowledgeable about its clients. Provide added value by helping customers solve problems. Make that added value worth more than any discount a client might get for bundling purchases with another vendor.

Find out what your large corporate buyers are trying to accomplish and to move their companies forward. What would be most valuable to help them

reach their goals. Then work backwards.

How can you put your company’s assets to bear to help your clients? Figure out what can be done to leverage your company’s knowledge, connections, ability to gather information, etc. on behalf of your clients.

Make your company indispensable to your clients and no one will care what size it is.

Don’t forget about nimble. No matter how powerful a major competitor may be, they are big, have more bureaucracy, and take longer to make and act on decisions.

Use that to your advantage. Your company can commit faster, escalate things to the top and get decisions made at a pace no large competitor can match.

When it comes to building organizational relationships, think about who you call upon. What’s their motivation for meeting with someone from your company? How do you get your message through to the people you want to meet with?

Maybe you need to send out information packages ahead of meetings, to inform participants of what your company brings to the table that will help them.

Follow up professionally. Courteous notes and emails, spell checked, grammar checked, to the point, summarizing each encounter, can go a long way to enhancing the perception of your company’s ability to perform.

Spend money to get a presentation in top-notch shape. You may invest a year or more getting just the right meeting. Don’t blow it by looking like you’re playing in the bush leagues. Learn how to use presentation tools on a laptop or tablet. Have fourcolor handouts. Save on printing costs by putting 6 slides on a page.

Practice your presentation until you know it cold. Think through every possible answer. Have someone drill you until you can look cool under pressure.

People still do business with people they know and like. Profile your clients and prospects. Use your CRM (Customer Relationship Management) system to document all the people you want to connect with, and to keep track of progress.

And get known throughout your clients’ organization and industries. Join industry associations and panels where you’ll gain access to otherwise hard-toreach individuals.

resident Obama’s proposals to lower the corporate tax rate and eliminate loopholes could affect more than just corporations.

On the positive side, it could make it slightly more attractive for companies to incorporate and minimize their liability, said William Conron, an accountant and partner at Citrin Cooperman in Norwalk.

On the other hand — if loopholes are eliminated across all business structures — middle-market companies could end up paying more in taxes, without the benefit of a lower overall rate.

It all depends on the company and on what actually passes in Congress, Conron said.

“Corporate America is going to benefit from this but a lot of the middle-market startups aren’t corporations so it’s not going to have an immediate effect them,” said Conron. “It’s a step in the right direction, but without clarity on what deductions could take place, I can’t say it’s going to be an absolute win for them.”

But just as many corporations are weighed down by a high corporate tax rate, numerous studies show dozens, if not hundreds of large corporations, pay little or no income taxes by taking advantage of tax breaks and loopholes.

A 2011 report on 280 corporations, conducted by Washington, D.C., think tank Citizens for Tax Justice, found that nearly a third surveyed paid no federal income tax, making the effective corporate tax rate closer to 18.5 percent on average.

Among the Connecticut companies examined in the study were GE, which paid no corporate taxes from 2008 to 2010; General Dynamics, which averaged a 27 percent effective rate; United Technologies, which averaged a 10 percent effective rate; and Pitney Bowes, which averaged a 30.4 percent effective rate.

To sell his program and to make it budget neutral, Obama has proposed to eliminate loopholes that allow compa-

nies to “unfairly” minimize their liability and that incentivize them to store cash abroad.

Without more detailed information, however, Conron said it is difficult to tell what loopholes may be closed or whether they’d be closed only for corporations or for everyone.

“If you take it from corporations, you’ll probably take it away from other entities too,” he said. “Neither (political party) has said what they’re willing to get rid of or the specifics.”

Conron said he’s talked to a number of company owners over the last year who have said they no longer want their companies in the United States because of the tax burdens. They’d rather relocate to China or other emerging markets with lower tax rates, he said.

Conron also stressed he doesn’t look at tax reductions as loopholes, but as rules.

“We need to lower the tax rate so we can be more completive — not losing jobs and having companies move abroad,” he said.

From secretary to magnetic particle inspection

dwina Lucenius was a successful executive secretary in New Jersey when family obligations brought her home to Stratford. There, she found her skills in low demand and she sought a different direction.

She found a very different direction.

Community College’s advanced manufacturing program, Lucenius today works for RBC-Heim Bearings in Fairfield where she is involved in the nondestructive testing of metals, specializing in magnetic particle inspection. She works with microscopes, hightech fluids and black lights.

Lucenius had been told manufacturing was a man’s world — she’s the first female to graduate the Housatonic program, which itself is a year old — but has found the reality more nuanced. She said, yes, manufacturing is dominated by men, but she also said, “Everything depends on the people. At Heim Bearings there is an incredibly open culture and an international mix of men and women.”

Lucenius praised the manufacturing program for its breadth, noting, “Although I found my niche, it’s reassuring to know I’m able to run any machine in the company.”

Heim’s bearings are used in airplanes and other critical parts for machinery.

“Of course I felt the pressure being the first female,” she said of the program. “But I can handle pressure pretty well. The class became like family.”

“We’re delighted that the program has opened up career opportunities for graduates like Edwina while providing area manufacturers with the skilled employees they need,” said Anson Smith, public relations coordinator for the college. “This is indeed a win-win situation.”

The state contributed $18 million last year toward establishing manufacturing programs at public colleges across the state.

Giving back in kind

A

ccounting firm Citrin Cooperman’s client roster includes industries from restaurants to hedge funds to auto dealerships. But that far from covers the population it serves. Beyond its accounting, tax and consulting services, the firm has a long history of community service.

“At the end of the day, everyone here is really striving to improve the lives of our clients and that’s what we’re trying to do with our service,” says Mark Fagan, managing partner of Citrin Cooperman’s Norwalk office. “We are trying to make a difference.”

When Fagan says “we,” he isn’t just talking about partners who contribute at black-tie fundraisers; he’s talking about each of the firm’s nearly 500 employees who volunteered in their communities for Citrin Cooperman’s second annual Day of Service June 3.

Each of its five branches in New York, New Jersey, Connecticut and Philadelphia closed for the day and employees went in teams to assist at local organizations.

Working in conjunction with The Salvation Army, the teams delivered food to needy families, served hot meals, worked with elementary and high school students, volunteered in shelters and helped rebuild homes in Yonkers, The Rockaways and Philadelphia. Participating organizations included the Boys & Girls Club of Stamford, Community Food Bank of NJ, Eva’s Village, Feed the Children, Habitat for Humanity, Interfaith Food Pantry, My Sister’s Place, New York Cares, Rebuilding Together Philadelphia, Ronald McDonald House, NY, and The Sharing Shelf.

“This year when we were handing out food, it was sometimes in a complete downpour,” said Fagan who volunteered in Norwalk. “It made things a little more interesting, but everyone persevered.”

In addition to the volunteer service, Citrin Cooperman’s five branches also donated a total of $125,000 to the organizations.

Though the multibranch firm loses hundreds of thousands of dollars in revenue from closing its doors for a day, the feel-good return pays out in spades, said Alan Badey, managing partner at Citrin

Cooperman’s White Plains, N.Y., office. Not only do volunteers benefit individually, it’s a boon to employees as a unified team.

“It really provides a team-oriented experience for our staff,” said Badey, whose branch also works closely with The Food Bank for Westchester. “They are working together doing something outside of the normal course of work. They’re seeing each other in a different light that is more of a family or team type of atmosphere and that creates different relationships even among the staff.”

Though the Day of Service is the firm’s marquee event, it’s just one example of its philosophy of giving that’s put in practice through Citrin Cooperman Cares, the firm’s program dedicated to charitable contributions through volunteer work and financial giving. And the group doesn’t just participate outside office doors; rather, opportunities for giving integrate seamlessly into work life.

Citrin Cooperman’s Jeans with a Twist program, for example, invites employees to wear jeans to the office on one or two Fridays per month with the requirement that they donate $5 to a select charity. The firm then matches the donation.

“What’s nice is that because there are so many ( Jeans with a Twist Fridays), we can pick charities that are special to us,” said Fagan. “Our philosophy is to get as many people involved in the office as we can and do something that’s really local.”

The ongoing program has sent tens of thousands of dollars to local charities, and not just the big names, but organizations close to employee’s hearts. One Friday, funds went toward a scholarship named for a partner who suddenly passed away.

Scholarships, in fact, are another Citrin Cooperman service specialty. For several years, the firm has offered a grant program for college-bound local high school students who will be majoring in business.

“We had a (scholarship recipient) one year who spent three or four months of her school year living in a homeless shelter,” Fagan says. “She was pulling all AP (advanced placement) classes and had a 104-percent average.”

“For juniors and seniors in college that are in the scholarship program, we’re looking to get them in here for internships during tax season,” Fagan said. “We tell them that if they ever have any questions during their college career about their major or things like that to come in and spend an hour or so to talk.”

Though the dedicated outreach will likely build new business leaders, the Citrin Cooperman team says their philosophy of giving doesn’t necessarily have to do with demonstrating leadership. Says White Plains partner Badey, it has everything to do about serving one another.

Mark Fagan “As business owners, we all have so many worries on our mind about our business and oftentimes we forgot about all the needy people in our community,” Badey said. “I don’t think we look to lead in any way, I think we just look to do what we think is right.”

Citrin Cooperman doesn’t only provide service themselves but recognizes others who do so as well.

The Above the Bar awards, now in its eighth year, honors local attorneys who excel in their field and in their contributions to their community. Doesn’t the accountant do that?

company’s controller receives an anonymous note saying the manager of the accounting department is “stealing” from the company.

A quick and quiet investigation reveals that the address of one of the hundreds of vendors engaged by the company matches the address of the accounting department manager. The invoices in the file do not provide extensive detail and nobody recognizes the name or purpose of the vendor. Although no single invoice is substantial, a quick tally shows that hundreds of thousands of dollars was paid to this “vendor” over the past few years.

In such situations, thoughts quickly turn to who is responsible and inevitably, the company focuses on the outside accountants. After all, “they are the auditors; they should have caught this!”

That, however, is often not the case.

Indeed, as innumerable accounting malpractice lawsuits have revealed, clients and accountants often have a different understanding of the accountant’s role, which is to the detriment of both.

The difference between what a client

believes the accountant’s responsibilities to be and what the accountant’s responsibilities actually are is sometimes called the “expectation gap,” which at its heart is caused by ineffective communication between the accountant and the client.

The accountant did not effectively convey to the client what his or her role and limitations would be and the client did not understand the scope of the accountant’s responsibilities.

The most popular misconception is that the accountant is “responsible for the money,” and if any is missing, the account is liable. Typical financial statement audits performed by an outside accountant (the type of audits required by creditors and investors) are not designed to uncover fraud or embezzlement and cannot be relied upon by management to do so. Further, an outside CPA that does little more than prepare a company’s tax returns, even if there is some write-up work involved, is not responsible for verifying the accuracy or propriety of the information used to prepare those tax returns. Simply put, the outside CPA is not usually in the best

position to monitor the financial activity of the client or prevent fraud.

If an accountant is not “responsible for the money,” what is the accountant responsible for?

Financial statement audits If the accountant is conducting a financial statement audit, it must be done in accordance with generally accepted auditing standards such that the firm can opine whether or not the company’s financial statements are prepared in accordance with generally accepted accountings principles and are free from material misstatements. Nowhere in that engagement will one find support for the idea that the accountant “should have or will” uncover each and every fraud.

This is not to say that the auditor will not bring such discoveries to the attention of management — indeed an auditor should. However, a typical audit is not designed to uncover fraud and should not be relied upon by management to do so.

Fraud audits and integrated audits If management is interested in an audit designed to uncover fraud or

weak internal controls, then management should engage an accountant to do just that. A “fraud audit” is an engagement designed to uncover fraudulent activity and an “integrated audit” is a typical financial statement audit with added procedures designed to test and evaluate internal controls. Both types of engagements go beyond a typical audit in both scope and cost, but they can give management comfort that the likelihood of fraudulent activity is very low.

Scope of services Understanding the outside accountant’s role and responsibilities puts company management in a better position to understand the limitations of each type of engagement and plan accordingly.

Relying on the typical audit or outside accounting services can put the accountant’s role and management’s responsibilities at odds.

Best practices for training webinars

ebinar technolo�y is rapidly growing in both usage and capability. Although webinar sales are expected to exceed $3.4 billion by 2014, it is its rapid growth and adoption in other areas that is so noteworthy.

One of the areas experiencing such rapid growth involves education and training. Largely because of significant savings in time and money, companies are increasingly turning to online technolo�y for education, product demonstrations and training. Even when training is performed by an outside company, it increasingly utilizes online instruction. This in turn has radically altered the training landscape by reducing the number of in-person training opportunities, instead requiring the creation of a wide range of online courses.

Online education courses can be lucrative for several reasons: • Most importantly, they adhere to the basic webinar premise: the one-to-many capability. For roughly the same amount of time and ener�y that you expend to train one person, with a webinar you can train any number of people.

• Although they are usually less expensive to attend — making them more attractive, they are also more profitable because they require fewer personnel and overhead.

• Educational webinars can be easily modified or tweaked, as needed.

• They provide continuing education credits making webinars highly attractive, particularly if attendance is during non-working hours.

So how do companies generate revenue with training-based webinars? Often, it’s by simply charging a one-time attendance fee. Some of the more successful companies are now bundling several of their training webinars together to form a series or curriculum and awarding a certificate of completion to attendees who attend all the requisite webinars.

When a company sets up a fee-based webinar, it must consider the following: • Determine what is of speci�ic interest to its target audience. What will they pay money for?

• How in-depth can you make your presentation? For free webinars, your audience will show some tolerance with the level of your content. However, for paid educational webinars, they are far less tolerant. Regardless of the price, they demand and expect outstanding content.

• Your promotional materials must strongly reflect your content. If a well-

known speaker is providing the webinar, be sure to promote him or her. A big name can significantly increase the number of attendees. Testimonials or endorsements by well-known attendees or organizations can also be extremely beneficial.

• Eliminate any marketing and sales in the webinar except for a brief call to action at the end for any additional services or products you may offer. People

already paid for your webinar. They will not tolerate their time being wasted by an additional pitch. Your primary sales tool — your credibility — will be the quality of your webinar. Whether your attendees decide to sign up for additional webinars from you will largely depend on that quality of your material and presentation and whether or not they believe they received a high return on investment.

• Make sure you have a follow-up pro-

gram in place that will enable you to get feedback and remain in front of your audience.

Bradley H. Olsen-Ecker – living American artist People smile or laugh when they see that on my business card.

But I’m a firm believer that artists should be successful while they are alive and not 200 years after they’re dead.

Just to cover my bases, though, I’ve asked my family to keep my work together for 200 years. Maybe they’ll get a lot more money.

Two years ago, I changed my style from Realism to Impressionism. I’m trying to capture the moment and mood and not get caught up in too much detail. I’m painting mainly seascapes.

Besides painting, my taste tends to be very exotic and varied. I have been creating scrimshaw with Japanese women in kimonos and encrusting them with diamonds, emeralds, rubies and other precious gems. I’ve also carved on emu and ostrich eggs and worked on slabs of turquoise, on which I created Halley’s Comet with 135 diamonds in various sizes.

I love to paint outdoors. There is no better light in the world than the sun.

I’ve been taking painting trips all over the country, including both coasts and the desert. I’ve been very fortunate to exhibit my work in SoHo, Chicago, Los Angeles, Texas and abroad. I’m showing in Greenwich at the Art to The Avenue and Bendheim and Flinn galleries. I also have wonderful friends in Sarasota, Fla., and exhibited at The Dancing Crane Gallery in Bradenton there.

Now selling the artwork, that’s another thing. The Culture Alliance of Fairfield County has helped me with forums on how to sell my art. From its website, I joined the Milford Fine Arts Council, Center for the Arts and have been exhibiting at the Firehouse Art Gallery. Fcbuzz.org is great for exhibit possibilities. The alliance has been wonderful to me.

I’m now using more social media.

An artist once said it takes all your life to become a great painter. So look me up when I’m in my 90s, and you’ll see some great stuff.

CAMPERS ROCK THE REVOLUTION AT WESTPORT HISTORICAL SOCIETY You probably never thought of the leaders of America’s break from England as rock stars, but youth motivational speaker Christina Frei does. From Aug. 19 to 23, Frei will lead a five-day camp at the Westport Historical Society based on her book “5 Rockstars of the American Revolution.”

And her Fab Five are indeed an all-star lineup — George Washington, Thomas Jefferson, John Adams, Benjamin Franklin and Paul Revere. Each camp day will focus on a different star, the idea being to help the kids tap their inner resources and engage in creative fun while learning a valuable lesson from one of these great Americans.

Frei, an animated speaker who has a degree in American

Studies from Wellesley and teaches and directs improv, says that in addition to learning the “juicy secrets and backstories” of the Founding Fathers, the kids will act out improvised stories based on their lives. Frei has most recently appeared on NBC’s “News 4 New York” and “Today” show.

DISCOVERY MUSEUM CELEBRATES ‘FIRST IN FLIGHT’ IN CONNECTICUT Is aviation history being rewritten? Now recognized by the internationally renowned publication “Jane’s All The World’s Aircraft” as the first to pilot a heavier-than-air aircraft two years before the Wright brothers, German immigrant Gustave Whitehead has captured the attention of Connecticut and the international aviation community as the debate over who was first in flight continues.

The Discovery Museum and Planetarium in Bridgeport is celebrating the 112th Anniversary of Gustave Whitehead’s historic flight on Aug. 17 and you’re invited to attend.

The free event will feature presentations by aviation historian John Brown, actor and Whitehead enthusiast John Ratzenberger of “Cheers” fame, and pilot and builder of the replica Whitehead airplane, Andy Kosch. Weather permitting, the replica of Gustave Whitehead Flyer No. 21, which Kosch successfully flew, will be on display.

Planetarium shows, model airplane clubs, educational demonstrations for children and a tethered flight of The Discovery Museum’s high altitude balloon are slated for a full day of family fun. Guests are invited to explore the new “First In Flight” exhibit, featuring period photographs, news articles and personal accounts of Whitehead and his 1901 flight on the beaches of Bridgeport.

The Discovery Museum’s more than 100 hands-on,

interactive exhibits will be open to the public. Event sponsors include Fairfield Museum and History Center and Stratford’s Connecticut Air & Space Center.

State Surplus ‘Gift’ Gets Better

I

t’s a Christmas gift that keeps on giving—but will disappear pretty soon. According to the state comptroller, when the books finally close on fiscal year 2013, Connecticut will have a surplus of $312 million— up from the previous forecast of $236.6 million.

The “gift” is the fact that late last year, with Bush-era tax policy set to expire, many of the state’s wealthiest people made significant transfers of that wealth in order to avoid higher gift tax rates as of Jan. 1, 2013.

Now, the comptroller is seeing a $428 million revenue windfall—more than double what officials had projected—from estate and gift taxes for the fiscal year that ended on June 30. Also coming in higher than projected are state income tax collections.

But as many are noticing, this increasingly generous revenue windfall is a one-time occurrence that’s not expected to return in the current fiscal year that began July 1.

There are signs that the national and state economies are beginning to recover. But these latest surplus numbers don’t necessarily relate to an economic-revenue turnaround upon which to base future budgeting.

For example, on the flip side of the FY 13 ledger, said the comptroller, sales and corporate taxes are underperforming by $189.4 million and $51 million, respectively.

And as the comptroller cautioned, “Despite the state’s improved financial outlook, the economic recovery proceeded at a slower-than-expected pace during Fiscal Year 2013.”

The state has recovered fewer than half of the jobs lost during the great recession—with the recovery period now up to 40 months. The state’s unemployment rate is 8.1%.

What’s more, personal income declined 1.7% in the first quarter of 2013, making the state 44th in income growth, and trailing all other New England states.

While about a third of the surplus is going to go into the state’s Rainy Day Fund, about two-thirds ($221 million) will be moved into this fiscal year to help shore up the budget.

As the national economy improves (165,000 jobs gained in July; 188,000 in June), it’s important to make sure that Connecticut also participates. Getting the state into better fiscal shape will have a lot to do with restoring the kind of business confidence that leads to greater investments in the state and more robust job creation. ➤ Read more at gov.cbia.com

Individual premium tax credits will be available to persons enrolled through the state’s individual exchange only. These tax credits are available to those with household incomes between 133% and 400% of the federal poverty level for their given family size who are not otherwise eligible for minimum essential coverage.
