CONSTRUCTION ON THE NEW $450 MILLION STAMFORD HOSPITAL is under way and on target to receive patients in two-plus years.

Steel beams three stories high are in place for a quarter of the future footprint and construction on a new central utility plant is nearly complete.

About 10 years in the making, the singlephase construction project is expected to finish by spring 2016. City and hospital representatives officially broke ground in May. “It’s amazing that this was something

that just started out as an idea,” said Michael Smeriglio, executive director of facilities management for Stamford Hospital. “It’s really just phenomenal to be a part of it and see construction start.”

Before putting on a hardhat and yellow construction vest over his suit, Smeriglio laughed as coworkers joked he’s spent his whole life working on the project. Original plans included a multiphase construction project that could have lasted as long as 15 years, as opposed to the current three-year plan.

“I think it’s going to be good for the community,” Smeriglio said, reflecting on the amount of detail going into the project plans. “They’re » Sutures, page 6

Tennis entrepreneur aces design-build game

ohn A. “Lex” Kessler’s ties to tennis, both business and personal, are abundantly evident in his one-man office in North Salem, N.Y. There’s the artful US Open poster that hangs in the lobby. There’s the hall of rackets — wall mountings that trace the evolution of the sporting weapon that Kessler watched Rafael Nadal and Serena Williams winningly wield at Forest Hills this month.

In the owner’s inner sanctum at Indoor Courts of America, tennis ball cans are stacked in one corner near a wire basket brimming with official US Open balls. Kessler, a former chairman of the U.S. Tennis Association’s technical committee, built the ball-testing lab at the USTA’s Platinum Mile headquarters in Harrison.

There’s the bright-orange collection of Wheaties boxes, the breakfast, or supplemental meal ticket, of box-cover champions like Pete Sampras, Althea Gibson, Arthur Ashe and Andre Agassi.

Beside his desk, there’s a framed signed photo of Agassi raising his racket in victory at the French Open. An autographed racket that Agassi carried in his bag that day overlays the portrait.

Speaking of Arthur Ashe: Kessler’s ICA company designed and built the USTA’s $65 million, 12-court indoor facility at Arthur Ashe Stadium in Queens. It’s one of several construction projects for which Kessler’s ICA company has won awards from manufacturers, builders associations and the USTA in a career that spans 30 years and the miles that separate Westchester County, where Kessler resides in Somers, from ICA headquarters in Olathe, Kansas. The plaques line a hallway wall of the ICA East office in North Salem.

This month, the 51-year-old Kessler added to his standing in the sports construction industry when the USTA recognized Sportime Randall’s Island, a cityowned public tennis facility in Manhattan that is home to the John McEnroe Tennis Academy, with its Outstanding Tennis Facility award. Kessler partnered as design-builder on the $19 million project with the facility’s operator, Long Islandbased Sportime.

Kessler expects that a current project of his, an indoor tennis facility at Trump National Golf Club in Washington, D.C., will win the USTA award next year. It is the Trump company’s first indoor tennis facility.

“I happen to be the only guy in the entire world who has made an adult career and living on just building these indoor tennis facilities,” said Kessler, who also is sole owner of Sports and Wellness L.L.C., which operates an indoor tennis club in Old Mystic, Conn., and a tennis and fitness club in Danbury. “We can do them anywhere in the world less expensively than a local guy.”

He estimated that Indoor Courts of America has done about 500 design-build jobs, including about 50 new facilities. His list of completed projects in Westchester alone reads like a Yellow Pages directory of tennis clubs and indoor facilities available here.

“New York’s the number-one indoor tennis market in the world,” he said.

“Within about two hours of New York (City), there are over 300 indoor tennis facilities.” The nation’s next largest market for Kessler’s business, metropolitan Chicago, has about half that number.

“I design-build,” he said. “That’s what I do. But I’m purely an entrepreneur. I’m not an architect. I’m not a designer. I’m not a construction manager.”

“I’m closer and more connected to the client than an architect or engineer or contractor could ever be.” Working through the concept, design, budgeting, permitting and construction management stages of a facility renovation or new development, “I’m constantly viewing the process from the clients’ eyes,” he said. ICA’s fee is 10 percent of project cost.

Growing up in suburban Kansas City, Kessler showed entrepreneurial skills at an early age. At 12, he started a neighborhood lawn and landscaping business with five employees. He got out of the business after about two years.

“When I could get my license, I went into house painting,” employing “about a dozen guys.” With savings from that, he bought his first house after moving out of his parents’ home at 17. The bank, though, would not close on his loan until he turned 18.

“I had less than zero interest in being in school,” he said. A day job at a bank for which he received high school credits “was my ticket out of school. It was like a work-release program.”

He started but soon dropped out of a community college in Kansas. “I was bored to death,” said Kessler, whose wall of awards includes a plaque from Mensa, the international society of persons with high IQs. The entrepreneur went to work as a roving installer for the insulation busi-

ness owned by his father, who had patented an insulation system. After three years, Kessler left to start his own installation business and add products from major manufacturers.

“When the beer companies in the ’80s started temperature-controlling their warehouses, we went on a run,” he said. His company, Insulation Corp. of America, also renovated “a couple hundred” AMC movie theaters. “We had these different runs when we started working for owners rather than for general contractors.”

Kessler’s specialty design-build company began in the early ’80s when he met the owner of indoor soccer teams in Kansas City and on Long Island. He traveled to New York to convert a tennis building into an indoor soccer field for the New York Cosmos in the short-lived North American Soccer league.

While here, Kessler was hired to renovate a tennis club on Cape Cod that needed a ceiling replaced in the wake of a fire.

“That’s what began the back and forth from new York and Kansas City, those two jobs,” he said.

The entrepreneur decided to market his services to other indoor tennis facilities. “Every job we did, we’d get like two more,” he recalled. “It was like mushrooms.”

“There’s a magic about great insulated ceilings and tennis courts,” Kessler said.

Recognizing that magic, in the early ’90s he patented a system for bouncing light off the ceilings his company insulated to cast more light for players on the face of an approaching ball.

“Fast-forward 20, 30 years, we’re on our third-generation lighting system,” he said.

With the advent of air conditioning in

tennis facilities, he later patented a system for ventilating the cavity above the insulated ceiling in a Butler building to eliminate the roof’s solar heat load, which lowers air conditioning costs by about 75 percent, he said.

With his businesses prospering, Kessler “semi-retired” at 40 and became a stay-at-home single dad to his son and daughter. But the recession and lingering economic malaise and the bankruptcy of the two Connecticut clubs in which he was a partner sent him back to work.

“I’m currently working 70 to 80 hours a week, and I will be for at least another year,” he said.

“From 1990 until 2009, we had a nice run.” But design-build jobs slowed after lenders tightened credit about five years ago.

“That hasn’t changed. We’re getting some nice clients, but it’s not what we were doing 20 years ago. Now you have to be gold-plated to get in the indoor tennis business.”

Kessler and his partners in Sport & Wellness L.L.C. in 2009 filed for bankruptcy protection for their Connecticut clubs, Mystic Indoor Tennis and Danbury Sport and Wellness. The company emerged from bankruptcy in 2010 with Kessler as sole owner.

“After three years, this is the first year we’re in the black,” he said. “It was starting over from scratch. That was after being in business for 10 years.”

The entrepreneur apparently hasn’t lost his touch since emerging from semiretirement. From 2010 to this year, membership at the clubs has grown from about 300 to 1,255, he said.

“We’re a success story in Danbury because of this three-year recovery,” Kessler said.

Doom, gloom cloud outlook

usiness leaders see Connecticut as a bad place to do business.

Some 80 percent of them have a somewhat to very negative view of Connecticut as a place to operate, according to a new survey by the Connecticut Business & Industry Association. That’s up 11 percentage points from last year, leaving the number of people who see the state in a positive light at a new low.

“There’s a lot of uncertainty over whether Connecticut is a business friendly place,” said Peter M. Gioia, CBIA vice president and economist. “You wonder how optimistic and good it could be if businesses thought it was super friendly here … It’s something we could certainly improve.”

At the annual CBIA Connecticut Economy conference in Rocky Hill, business leaders from around the state gathered Sept. 6 to review the year and discuss the state’s economy. There, in a partnership with BlumShapiro, an accounting, tax and business consulting firm, CBIA released its 2013 Survey of Connecticut

Only about one in 10 respondents have a very or somewhat positive opinion of the state.

At a time when states like North Carolina, South Carolina, Florida, Virginia and Texas are actively recruiting Connecticut companies to move, speakers at the conference stressed the state will need to do more to stay competitive.

Gioia admitted Gov. Dannel P. Malloy and Department of Economic and Community Development officials have made positive steps and seem to be listening to businesses concerns over energy costs and hiring. But he said more could be done stabilize government finances and to promote pro-businesses rhetoric.

About 65 percent of survey respondents say they are somewhat to very pessimistic that the state will have a vibrant, growing economy in the next five years.

Many say the state needs to control spending and balance the budget without additional taxes.

“I think we’re on the cusp of businesses being able to grow,” Gioia said, while announcing results of the 2013 Survey of Connecticut Businesses at the

conference. “But where they grow is the question.”

Roughly 377 businesses responded to the survey, now in its 12th year. Those responding constituted a 35 percent decrease from last year.

According to respondents, Connecticut’s quality of life remains one of its greatest assets, followed by its proximity to customers and major markets in New York and Boston. However this year, far fewer respondents said the state’s skilled workforce was also an asset.

usually identify skilled workers as a key asset, only 32 percent of respondents did so this year.

In a closer look, Thomas Devitto, a BlumShapiro chief marketing officer, said many respondents felt the state’s workforce skills were no better or worse than others, that there was a shortage of skills specific to their business needs and that skills overall had declined.

“This is a shame,” Devitto said. “This is the first time it’s fell below 50 percent … they don’t see a difference between our state and others.”

The burdens of being busy

he long-agreed-upon state of affairs in modern life is “busy.”

Some are busier and somewhere there is the superlative and lonely “busiest person on the planet.”

The organ of Harvard Business School, the Harvard Business Review, tackled the word recently and reported thinking of “being busy” as either cool or laudatory “is ridiculous,” because networking and life take a back seat to … being busy.

But who would dare answer the “how goes it” question with a “kickin’ back, chillin’ out” response? Even on days off we tear up the golf course, slam tennis balls, party hardy … busy, busy, busy. The last person to admit to napping every afternoon may have been Winston Churchill.

The American humorist Robert Benchley, for whom a haircut and clipping tropical fish pictures from magazines — “with the idea of someday buying myself one” — constituted hard work, addressed the issue in the 1940s.

Does satire die on Saturday night, like the critics say, or does a sharply barbed pen speak across the decades? Let the busy decide: “A great many people have come up to me and asked me how I manage to get so much work done,” Benchley wrote, acknowledging he was spreading himself too thin. “Hundreds of thousands of people throughout the country are wondering how I have time to do all my painting, engineering, writing and philanthropic work when, according to the newspapers, I spend all my time riding to hounds, going to fancy-dress balls disguised as Louis XIV, or spelling out ‘Greetings from California’ in formation

Benchley professes a half-hearted interest in writing his article, but is distracted by tropical fish. The world may be racing, deadlines may be approaching, but for Benchley, “One of the interesting things about the silver hatchet fish, I find, is that it has eyes in its wrists.

I would have been sufficiently surprised just to find out that a fish had wrists, but to learn that it has eyes in them is a discovery so astounding that I am hardly able to cut out the picture.”

With September, the idle times of August (if they existed) are history. Get busy. But don’t forget there’s a fish out there with eyes in its wrists that’s likely chillaxin’, wondering what all the hubbub is about.

Navigators docks in Stamford

and, ho! The Navigators Group Inc., a global insurance company, has officially docked at its new corporate headquarters in Stamford.

“We couldn’t be more delighted,” said Stanley A. Galanski, Navigators president and CEO. “Our preference was always to be in Connecticut, but the costs just didn’t work for us before.”

But with an $11.5 million state incentive package, Galanski said he’s happy to now call Connecticut home, spending an additional $13.5 million beyond the package to set up shop. Earlier this month employees left their previous offices in Rye Brook, N.Y., to settle into their new corporate headquarters at 400 Atlantic St.

The company is the 10th selected under Gov. Dannel P. Malloy’s First Five and Next Five initiatives.

The group has also has moved its global data processing center to Summer Street and added employees to an existing Danbury underwriting office. Among other services, the company specializes in marine insurance products.

“We’re really excited to be a part of the Stamford business community,” Galanski said, mentioning the city’s intellectual capital and public transportation. “So far it’s been everything we expected.”

The company is the 10th selected under Gov. Dannel P. Malloy’s First Five and Next Five initiatives, designed to attract and retain large employers. In March, Malloy announced the company

would be the latest to receive a $3.5 million grant and loan of up to $8 million, interest-free and forgivable after 10 years. In exchange, the company must maintain a Connecticut headquarters and create 200 jobs within five years.

The package is aimed to assist in relocation costs, facility upgrades and employee training.

Jim Watson, a spokesman for the Department of Economic and Community Development, said so far the company is on schedule in terms of moving and meeting its job targets. The roughly 100 employees it’s moved into the state so far count toward the 200 jobs goals. Though not all employees may live in or plan to move to, Connecticut, they’ll still pay state income taxes.

“We’ve been pleased with their progress on all fronts,” Watson said. The company’s presence will help replenish some of the jobs lost in the insurance and financial services sector during the recession.

“It’s another indication of the strength in this sector,” he said. “To have another headquarters in the state is a positive element.”

A commercial property and casualty insurance company, Navigators first began in 1974 as a family business in Manhattan, spun from Lloyd’s of London.

For nearly 30 years the company maintained its headquarters in the city, but after the 9/11 terrorist attacks, Galanski said he felt it would be safer to move farther north into Rye Brook as the company embarked on a new period of growth.

From 2001 to 2013 the company workforce nearly tripled to roughly 580 global employees. When the company originally moved out of the city however, Galanski said he had considered moving to Connecticut. He also lives in Ridgefield. But in the end, he said it seemed too expensive.

As the company’s lease came to a close at the Reckson Executive Park in Rye Brook however, Galanski said the group had entered into negotiations with the Connecticut DECD. “The insurance commissioner, governor and head of the DECD all made it evident they cared about us and valued us as a growing company,” Galanski said. “That went a long way. It feels good to be wanted.”

Once completed, the more than 640,000-square-foot building will stand adjacent to existing hospital buildings, some built as early as the turn of the 20th century. The 11-story, mostly glass building will double the size and number of rooms in the emergency department and provide all patients with private rooms and bathrooms. Hundreds of patients, employees and community members weighed in on the design, which follows nationally embraced patient-centered criteria.

The new building will displace old parking spaces, which are now relocated along the perimeter of the hospital, said Paul Nylund, a Skanska construction project executive based in Parsippany, N.J. About 45 single-family houses were purchased and demolished to expand the campus by 50 percent, he said.

So far, Skanska workers have finished grading the hospital site for construction and are finishing efforts to realign roads and reroute utilities from an existing boiler house to the new central utility plant.

Construction on the power plant began August 2012 and is expected to finish this winter. After steam and water pipes are rerouted this fall, steelwork will begin on the building’s remaining footprint. About 140 people are currently working on the site.

“I tell ya, there’s a lot of activity on this site,” Nylund said. “What’s paramount is that we keep the hospital going during construction without a hitch. So far we have.”

Given the age of the buildings, Stanley Hunter, project director of the facility’s master plan, said the new designs were more responsive to today’s health care industry.

Larger surgical suites will accommodate the latest technology; the intensive care unit will expand; and all Heart and Vascular Institute services will be in a centralized location, as will be mother-child services.

“There are a lot of things that are going to change how providers give care,” Hunter said. “It’s really responding to the needs of the city of Stamford and providing quality care to the community.”

ake a look at Mayor Bill Finch’s vision for Bridgeport and you might think you’ve put on a pair of green-colored glasses.

Since launching the BGreen2020 initiative, the mayor has introduced several new sustainability practices.

And while change does take time, at least one of the programs is already showing a dramatic improvement: recycling.

In just two years, recycling tonnage has increased 67 percent.

“We’re changing the mindset of a wasteful economy and making it more efficient and profitable,” Finch said.

“Our goal is to have everyone recycle.”

In the last year, ending in August, Bridgeport residents recycled 5,336 tons of material, which is the equivalent of nearly 890 P.T. Barnum elephants. To contrast, in 2011 residents recycled about 3,203 tons, which is roughly 356 fewer elephants.

Call it the Sandy effect. Once-unthinkable upheavals with bottom line-busting potential have become reality.

Almost as unthinkable is that a company might respond to power-killing emergencies in about the time it takes Usain Bolt to run a 100-meter dash.

Civic pride on the half shell Norwalk Seaport Association welcomes thousands

or Jerry Toni, co-chairman, along with Steve Nezas, of the 36th annual Norwalk Oyster Festival, 362 days of planning just came down to three days of events — Sept. 6, 7, 8 — and $1 million in revenue.

By end of day Sept. 8, 30,000 to 40,000 fairgoers would affirm Norwalk, sometimes called Oyster Town, as the Big Oyster.

The city could also lay claim to Big Heart Town, since volunteers came by the hundreds to help. The festival was expected to deposit $225,000 in the accounts of local charities.

Joe Dudek was there, along with 500 volunteers at the Exchange Club of Norwalk, where lobsters and lobster rolls were the order of the day. Over three days, Dudek hoped to serve 3,000 customers, with proceeds benefiting abused children and school sports programs.

Like other events that size, there

were glitches. On the last day, emergency responders reacted when the power failed on a ride, injuring patrons.

“We’re relieved to hear that there were no life-threatening injuries,” Norwalk Seaport Association Inc., the event organizer, said in a statement.

“Our understanding is that 12 of the 13 individuals who received hospital attention were seen and released. Our thanks go out to all of the first responders, who handled this incident so quickly and professionally, including Norwalk’s police, fire and EMT personnel, as well as mutual aid responders from surrounding communities.”

The Seaport Association and its 1,000 volunteers are solely responsible for organizing and financing the event.

The association manages the Sheffield Island Lighthouse and 49-seat, 49-foot catamaran ferry, both of which benefit from the festival.

At heart, Toni remains the local boy he once was.

“I fished these waters my entire life,” he said. “I have a great affinity for the water. The festival keeps a lot of us going; it’s a great way to give back. It’s win-win for everybody.” He sported a yellow event golf shirt and said the association had outfitted every volunteer with one, 1,600 total, although he acknowledged, “A few volunteers might have gotten two.”

The 29 victims of the 9/11 attacks with ties to Greenwich will be memorialized at Cos Cob Park, the new town park by the train station overlooking the Mianus River, with a pair of glass towers reminiscent of the towers of light that shone at night after the tragedy.

A fundraising campaign to bring the memorial to fruition within a year was launched this month at the Riverside Yacht Club. The goal is to raise $750,000 and to break ground April 2014 for a Sept.

11, 2014 formal dedication.

The names of the victims will be etched vertically on the towers so they will align across to spell the words freedom, liberty and forever. Stylized American flags will top the sculptures. The designer is Greenwich architect Chuck Hilton of Charles Hilton Architects.

Speakers at the fundraising launch included Dana Noonan, wife of victim Walter Noonan; and Demi Ferraris, cousin of victim Teddy Maloney.

Also speaking were U.S. Sen. Richard Blumenthal; Selectman David Theis; James Ritman, who heads Greenwich Community Projects, the nonprofit running the drive; and John Carlucci, project spokesman.

“We raised over $25,000 yesterday,” said Carlucci following the event.

Because of the broad nature of the attacks and the cross-border contacts of the victims, Carlucci said the hope is that businesspersons throughout the region would participate.

PARTNERSHIP REAPS EFFICIENCIES

Accounting, tax and business consultant firm BlumShapiro has teamed with the state’s Department of Revenue Services

(DRS) to launch a so-called “lean initiative” that has brought more efficiency to the state tax registration process.

The partnership has led to a quantifiably shorter tax registration period for businesses and has also allowed for a more productive reallocation of existing staff to eliminate a backlog of suspended return transactions and electronic applications, according to BlumShapiro.

BlumShapiro maintains offices in Connecticut, including in Shelton, Massachusetts and Rhode Island.

The implementation of “lean” techniques — private-sector implementation tools that are employed to simplify operations and improve efficiency — involved BlumShapiro working with a team of DRS employees to review the department’s daily operations “and then making recommendations to increase efficiency and quality of services.”

“The results of our being able to work with DRS have been dramatic,” said James Kerr, a strategic partner of BlumShapiro. “The completion time for paper registrations dropped from 15 to 20 days to one to two days, and similar improvements were seen with online applications; the wait went from 10 to 13 days down to between two and five days. DRS is now a great example of what can be accomplished with an appropriate application of private sector ‘lean’ approaches to government agencies.”

Kerr said DRS’s backlog of suspended return applications was significantly reduced via a tighter deadline for response from taxpayers who had not supplied complete information for their applications.

The right investment plan, part 1

A

Simplified Employee Pension I nd iv idu a l Ret i rement Arrangement (SEP-IRA) or a Profit Sharing Plan (PSP): Which plan is right for your client or business?

Both plans allow similar contribution limits, the lesser of 25 percent of compensation or $51,000 (indexed for 2013). However, differences exist in several aspects such as eligibility, vesting, design ability and other points discussed below.

Business owners are often advised to go the route of SEPs for their simplistic design, low startup costs and

ease of administration.

An SEP is an individual retirement account or qualified annuity. All contributions are made directly to each participant’s account or IRA by the employer. A profit-sharing plan (PSP) is a plan trust that holds all the plan assets also funded by the employer.

For a newly established business with few employees, an SEP design is attractive since there are no plan documents to be filed with the IRS. Nor are there annual administration and IRS 5500 filings required. There are no reporting requirements with a one-

person (or participant and spouse) PSP until assets exceed $250,000.

An additional benefit of a SEP is being able to establish and fund plans up until the date the tax return is filed, including extensions. So for example, an SEP can be established and funded through October of the following year in which the deduction is taken. PSPs have the ability to be funded until extensions are filed.

From a pure cost standpoint, SEPs may be more suitable in situations with a few employees. However, as a company grows and becomes more profitable and adds employees, the increased cost efficiencies from a more customized plan design can favor profit-sharing plans. These benefits can potentially outweigh the “simplicity” and convenience of the SEP design.

The following compares several differences between the profit sharing and SEP plan design: Maximize Contribution Both plans have similar funding formulas – the lesser of $51,000 or 25 percent of annual compensation (indexed for 2013).

However, only a PSP allows for the inclusion of a 401k arrangement. With that comes an additional $5,500 contribution if participant is over age 50 resulting from a catch-up provision and annual contributions of $56,500.

Permitted Disparity/Integration and 401K Design Permitted disparity or integration can lower the required contribution an employer needs to fund for plan participants.

SEPs allow for integration under section 408k (3)(d). However, it applies to all employees, owners included.

Which means the maximum annual plan contribution will lower by $6,480 from $51,000 to $44,519 (5.7 percent of $113,700 tax wage base). Integration in a SEP actually penalizes highly compensated employees. Importantly, integration in a SEP reduces the maximum contribution for those employees who would otherwise receive a contribution of $51,000.

There is no reduction in the maximum contribution in PSP due to integration.

Permitted disparity in a PSP allows those earning more than the Social Security taxable wage base to receive a higher contribution rate than those employees earning below the taxable wage base. Moreover, the owner may continue to receive a contribution of $51,000 unlike the SEP. For example, an owner earning in excess of $255,000 may receive a contribution of $51,000 in the PSP at an employee cost of approximately 16.8 percent of employee compensation for those employees earning less than the taxable wage base. This is compared with a contribution rate of 20 percent of pay if the PSP did not have permitted disparity or integration.

Further reduction in rank and file cost is possible from incorporating “new comparability” design to a profit sharing plan. This technique is not available in SEPs. New comparability is most effective when the demographics are such that the owners and or key people are older and earn more than the rest of the employees. adding 401(k) Design The ability to add a 401(k) feature to the PSP not only produces an opportunity to add $5,500 if over age 50, it can potentially lower employee costs.

The actuary can now use lower a lesser funding formula needed to fund an owner’s maximum contribution because the first $17,500 ($23,000 if over 50) comes from salary deferrals of the 401(k ) component. As a result of funding part of the $51,000 from $17,500 means now the balance or $33,500 can come from profit-sharing cost. This lowers the percentage of pay rate from 20 percent to 13 percent used to calculate employee contributions. Incorporating “new comparability” can further drive employee allocation rate between 5 percent to 7 percent.

No more drama in the workplace I cannot have drama in my office anymore. I mean slamming doors, not talking to people and holding grudges. one really valuable employee is creating a lot of disruption. I can’t let the person go — this one employee is too important to my company. But I also can’t ignore the problems the person is causing.

THOUGHTS OF THE DAY: Setting the ground rules for acceptable and unacceptable behavior in an office is essential. When people misbehave, look at what’s causing the stress. No one is above the rules. When

you put someone on notice, start looking for a replacement.

Take a look at the impact this person’s behavior is having on everyone else in the company. My guess is it’s having a big impact, whether or not people are saying anything directly. Fixing this situation now is critical, as bad behavior over time only tends to get worse.

Has this behavior been around for a long time or is it recent. If it’s recent, sit down for a chat to ask about what’s changed recently for this individual. If it’s longstanding, it’s time to change the rules of behavior for this person, and while you’re at it, to set the rules of what will and will not be tolerated from everyone in the

company.

Establishing a standard of acceptable behavior makes it easier for you and all the rest of your managers to address conditions that stray out of bounds. Consider implementing these simple rules: • Courtesy and respect for everyone, by everyone, 100 percent.

• Take time each day to tell others how much you appreciate their help.

• Recognize good work publicly, as often as possible.

• When providing correction, do it in private; don’t embarrass anyone publicly.

• If it’s unclear who is in charge or who should be in charge, call a meeting to discuss the situation, ask a manager to sit in to

• No one lives above the rules.

Some people have received less social grounding than others. Some people are poor observers of the impact they’re having on the world around them. Make sure that this individual is aware of how his/her actions are being perceived. Cite specific examples. Ask this person to discuss what else could have been done, that would have been more appropriate.

When someone acts out, it’s usually because of underlying problems. Where is the stress coming from for this person?

Home? Work? Combination of the two? And what can you do about it, if anything?

Time for a lengthy discussion. Keep it businesslike. You’re not a therapist. If there are personal issues, suggest the person seek professional help. Make it clear that behaviors have to change.

After the meeting, if you’re so inclined, you may want to do some research on resources this person could tap into to get help, whether the issue calls for financial counseling, social interaction modification or personal coaching. Many times when people are under stress, they are least likely to seek out help and most confused about what to do next. It’s not your place to tell them what to do, but you can make suggestions.

Make it clear that immediate behavior change is essential. Do put this person’s job on the line. You cannot risk losing the rest of your good employees because of one bad apple.

Put the person on notice and create a written agreement around what has to change. Ask this person to sign the agreement to acknowledge that they understand.

And stop hoping things will change: instead make plans in case they don’t. Post the job, interview candidates, line up two to three people who would be qualified to do the job. Having options will make it easier for you to hold this person accountable for making changes and will make the transition smoother if things don’t change.

Is it time to streamline your financial statements?

T

his past summer, the American Institute of Certified Public Accountants (AICPA) released “Financial Reporting Framework for Small- and Medium-Sized Entities” (FRF for SMEs). The organization’s intent was to ease financial reporting for smaller, privately held, owner-managed companies not required to follow Generally Accepted Accounting Principles (GAAP).

This development isn’t for every business, but it could benefit yours.

Just a suggestion The origins of the FRF for SMEs lie in the perceived need of business owners and other stakeholders for a more costeffective way to generate consistent, reliable non-GAAP financial statements.

Many small to midsized companies have seen their statements scrutinized and questioned in part because of how different their reporting methods are from those of GAAP-compliant entities.

Using a mix of traditional accounting methods and accrual income tax methods, the FRF for SMEs is intended to streamline the reporting process for businesses while providing added assurance to those who use the financial statements in question.

To be clear, however, the FRF for SMEs holds no authoritative status and adoption isn’t required of any business.

What’s more, the National Association of State Boards of Accountancy (NASBA), which works with accounting regulators and practitioners, has said it doesn’t support the FRF for SMEs. Instead, NASBA supports modifying GAAP through the Financial Accounting Standards Board (FASB) to meet the needs of private companies.

The AICPA has stressed that the FRF for SMEs isn’t a replacement for GAAP. Rather, it’s a carefully engineered alternative for companies that aren’t required to use GAAP and would like a clear-cut but less expensive means of generating reliable financial statements.

Crossbeams and supports If your company has ever tried to conform to GAAP or you’ve personally had some experience dealing with it, you know that the challenge of doing so is significant. GAAP includes complex, detailed and prescriptive standards and many, many disclosure requirements.

That said, at the end of the day, the information provided to stakeholders is substantial.

The FRF for SMEs, says the AICPA, delivers data in a much more streamlined format that will be less costly to owners of small to midsized businesses. It does so by focusing on the performance and creditworthiness of the subject company and its assets, liabilities and cash flows.

Specific measures in play include: • Pro�itability • Liabilities • Cash flows and cash available • Assets to cover expenses.

Like the literal framework of a house (albeit a modest, “simple” one), this one has several crossbeams and supports.

For example, it uses historical cost as its measurement basis, allowing users to avoid complicated fair value measurements. It also doesn’t require complex accounting for derivatives, hedging activities or stock compensation. These simplifications tend to reduce book-totax differences, eliminating multiple adjustments.

The FRF for SMEs allows much greater flexibility than GAAP in how the financial statement provider expresses relevant information to stakeholders based on those end users’ respective needs. It also makes clear that users may contact the issuer for more information.

Ideal candidates Small to midsize businesses are clearly the targeted entities of the AICPA’s efforts.

Yet because so many different types of companies may classify themselves as such, the organization didn’t want to get specific about who should adopt the FRF for SMEs. Instead, it set forth a few guidelines regarding “best fit” candidates.

As mentioned, to adopt the FRF for SMEs, a company can’t be required to use GAAP-based financial statements — either literally or essentially. The FRF for SMEs is also not intended for nonprofits, public or soon-to-go-public companies or businesses with foreign operations.

Again, the focus is on simplification, so ideal candidates will generally be businesses operating in industries that don’t call for complex financial transactions or highly specialized accounting guidance.

And, typically, the companies that use it will have “owner-managers” — that is, one person or group of people who both own and run the business.

Talk to your lender(s) before switching to the FRF for SMEs. And remind them that financial statements prepared using the framework can still be audited or reviewed by a CPA to provide added assurance.

A

couple of self-described country boys from Australia are remaking an exclusive property in Westport. It’s their first Fairfield County project, but they have opened a Stamford office for their company, Wellbuilt Co., to join already-established offices in Manhattan and Boston.

A conversation with Wellbuilt cofounders Scott Lumby and Mitch Kidd, both 30, revealed universals in their

industry that jumped the Pacific with them, notably project scheduling and budgeting, subjects they studied at the University of New South Wales.

Their core values also translate well between Australia and the U.S. and they drive them home in tandem: “Proficiency. Punctuality.

“Admittedly, Bridgeport had lower rates than other towns and now we’re trying to catch up,” Finch said. “We have to work a little harder to get our numbers up. But I look at it as an opportunity to show wealthier towns that if we can do it, they should be doing a lot better than us.”

To increase recycling efforts, the city employed several tactics. Most successful has been the city’s switch to a single-stream recycling system and partnering with Recyclebank, a rewards program for residents.

Single-stream recycling refers to automatic sorting efforts once trash is collected at a waste-management facility. Using magnets, fans and other sorting machinery, the city is able to automatically sort recycled material by paper, plastic, metal and glass. Now residents at home no longer have to hand sort the materials, making it more efficient and easier to try recycling.

But beyond system upgrades, Finch also said the city’s door-to-door education initiatives and rewards program have encouraged residents to recycle more. Since launching the Mayor’s Conservation Corps in 2009, groups of young adults have knocked on more

than 30,000 doors in Bridgeport, educating citizens about greener lifestyles.

One-on-one, residents are taught what’s recyclable, how to recycle and how to earn points for recycling, redeemable at stores such as Macy’s, Bed Bath & Beyond, Connecticut Science Center and Foot Locker.

Since 2011, the program has awarded more than $47,000 worth of points.

Mentioning the different material it takes to make a pencil — wood, graphite, metal — and all the different steps it takes to transport raw materials, Finch said recycling helps cut down on the amount of steps and energy it takes to produce even the simplest products.

“There’s 10 steps to every product; the most energy intensive are in the earlier stages (like) mining and extraction,” he said. “If you can eliminate those steps in the beginning of the cycle, you cut down on greenhouse gas emissions.

Plus, from our standpoint, it’s highly economical.”

Moving forward, Finch said the city hopes to start collecting recycling totes once a week, instead of every other week. He also would like to see more recycling enforcement in city apartments.

“We saw things could be done better,” Kidd said. “The company is based on core values and most of our customers are repeat. You only have to do one good job and people will recognize you.”

Their work portfolio includes projects in Australia, where their university scholarships were sponsored by one of the largest construction outfits in the country, St. Hilliers Construction Ltd., for which they worked after graduating.

They followed St. Hilliers with a five-year stint building upscale homes.

Beyond repeat customers, Lumby stressed the importance of repeat business with architects, designers and contractors. Wellbuilt employs 10 full time and expands to suit projects.

The company not only notices trends, it has to make them reality for its clients.

“Open plans centered around kitchens,” Lumby said of a current popular look. “A lot of blown-out walls.”

Kidd added, “Reclaimed wood is very popular.” The caveat: “Not in the whole house.”

Tieless and crisply attired in what might be termed business-rugged, the two men spoke in the Business Journal office. Both are from New South Wales.

Kidd is from Orange and Lumby is from Dubbo, an Aboriginal place name.

“I’d say 95 percent of our business is service oriented,” Lumby said. “A lot of people don’t know what they want.”

Wellbuilt offers design variations via Internet sites, he said. “And with our knowledge of pricing, we can offer three different options. It’s value engineering. It’s value designing. Even on the high-end projects, the clients want to hear ‘value.’”

Kidd nodded and said, “Sometimes even more.”

The Wellbuilt office in Boston is managed by Todd Rotondi, who is American.

“We can’t all be so lucky,” Kidd said with a shrimp-on-the-barbie laugh.

The move into Fairfield County

Houlihan Lawrence jumps the border HOULIHAN LAWRENCE, the well-known real estate brokerage in New York’s Westchester, Putnam and Dutchess counties, has opened its first Connecticut office in Greenwich. It is staffed by 17 topproducing regional agents, the company reports.

Previously affiliated with each of the top four brokerage offices in Greenwich, Houlihan Lawrence said the 17 have participated in home sales totaling more than $600 million since 2012.

“We have assembled a team that establishes Houlihan Lawrence as an immediate force in Greenwich,” said Houlihan Lawrence managing principal Chris Meyers. “Our Greenwich agents now have access to our existing brokerage network and our integrated marketing resources, enabling them to offer a superior level of service to their clients.”

Opening a Greenwich office has been a longtime strategic goal for Houlihan Lawrence, the company reported. The firm’s chairman, Nancy Seaman, and her brother, Chris Meyers, are longtime Greenwich residents. They run the firm with their brother, Stephen Meyers, president and CEO. “As Westchester County’s luxury leader, our brand of service is well-suited for the Greenwich market,” said Stephen Meyers.

The Greenwich office is managed by Greenwich resident David H. Haffenreffer, who joins from Prudential Connecticut Realty. He also worked in the Beverly Hills office of Sotheby’s International Realty.

U.S. News and World Report ranked the University of Connecticut as the 19th best public school, according to its assessment of public universities.

University of California at Berkeley took the top spot, followed by UCLA and the University of Virginia.

The ranking is the university’s highest so far, which officials say gives credence to its growing reputation among peer institutions. With major state investments underway — such as efforts to increase enrollment, build new facilities and create a thriving bioscience sector — UConn officials expect their ranking to continue to climb.

“The rankings are not a perfect measure of university excellence,” said UConn President Susan Herbst in a statement.

“That said, this is without question the most impressive position on the U.S. News

ranking that UConn has ever reached.”

The program benefits campus safety by allowing authorities to enter a message through one platform and have it delivered consistently across multiple devices, including television.

Prior to this program, Campus Televideo reported, EAS messaging to televisions required accessing a separate platform, creating potential woes with delivery time and consistency.

The TV notices will rely upon federal “common alerting protocol.”

SIKORSKY SELLS SECOND CHOPPER TO CHINESE COMPANY

Stratford-based Sikorsky aircraft recently penned a deal with China-based Yunnan Jingchen Group to purchase an S-92 helicopter for transporting corporate and government VIPs. Sikorsky is a subsidiary of United Technologies Corp., based in Hartford.

Yunnan Jingchen Group recently received Chinese government approval to establish a general aviation company named Ruili Helicopter Group. The new S-92 helicopter will become the second operated by Jingchen, after the first Sikorsky chopper was ordered in 2012 and delivered in June.

The newly ordered S-92 helicopter is scheduled for delivery November 2015.

“Jingchen is a new and already growing customer. We are excited to be able to support their expansion and are working closely to help ensure a smooth start to their operations by providing initial technical support on site,” said Ed Beyer, vice president of Sikorsky Global Helicopters, the commercial aircraft business of Sikorsky Aircraft.

PEOPLE’S UNITED BANK, with branches strung between New York and Maine – including in Fairfield County – is helping with regional back-to-school efforts, this year targeting the Empire State.

Public schools throughout New York are receiving new classroom supplies for the school year, thanks to a PEOPLE’S UNITED COMMUNITY FOUNDATION $100,000 grant to DONORSCHOOSE.ORG. People’s United Community Foundation joined DonorsChoose.org as a matching program partner, “supporting initiatives that improve the quality of education in low-to moderate-income school districts throughout the People’s United Bank footprint, from New York to Maine.”

Through the DonorsChoose.org website, teachers submitted project requests for materials and resources needed to enhance students’ learning experiences.

The People’s United Community Foundation grant provided 50 percent of the costs for eligible classroom projects, with the remainder donated by individuals, bringing the total campaign impact to $40,000.

NEW DIRECTOR MARY JOGGERST has assumed leadership of the CHILD GUIDANCE CENTER OF SOUTHERN CONNECTICUT’s Darien/New Canaan office, 972 Post Road in Darien. Prior to becoming director of the office earlier this year, Joggerst was a clinician in the center’s emergency mobile crisis program, providing services to some of the highest risk adolescents and children in the community.

As a member of the crisis team, Joggerst, who has a master’s in social work, provided assessment and stabilization services to children threatening suicide or violence, and to those suffering from post traumatic stress disorder. She also dedicated time to providing longerterm individual, group and family therapy to youngsters with a wider range of mental health issues to help them resolve problems and develop skills to more independently manage overwhelming feelings and challenging life circumstances.

“Knowing we are meeting such an intense need is extremely fulfilling,” Joggerst said. “Because we offer comprehensive services, we have the tools here to work with and help some very high-risk children and families.”

MANN AND KEYSTONE TEAM FOR A GOOD CAUSE DOROTHY MANN, the popular women’s clothing and accessories store in New Canaan hosted a charity event to benefit KEYSTONE HOUSE the evening of Sept. 11. The store allowed people to shop all the new fall fashions and accessories with 10 percent of purchases going to Keystone House.

Dorothy Mann, owner, opened the store in 1985 in Greenwich and eight years ago moved to Elm Street in New Canaan. The choice of Keystone as the beneficiary for the event came as the result of a longtime client, ELIZABETH P. BALL, president of TFI Envision Inc. in Norwalk.

State Spending, Obamacare, Taxes Impacting Economic Growth

hile Connecticut’s economy showed signs of growth in recent quarters, employers remain concerned about the state’s business climate and overall economic outlook according to a survey released today.

The 2013 Survey of Connecticut Businesses, published

by CBIA and the accounting, tax, and consulting firm BlumShapiro, identifies issues and trends within the state’s economic, fiscal, and regulatory climates.

The survey revealed modest improvement in private sector job creation, with 43% of companies having hired or planning to hire new employees in 2013 and 47% saying they will add jobs in 2014.

Speaking at the release of the survey results during today’s Connecticut Economy conference in Rocky Hill, CBIA economist Pete Gioia said he expected the state will see positive jobs numbers over the next 15 months, “maybe not as strong as we’d like.”

Manufacturing Growth?

For manufacturers, those job creation numbers jump to 48% in 2013 and 56% in 2014. Two-thirds of those companies adding jobs did report problems finding qualified workers to fill positions.

Employers cited state and national economic weakness, the state’s business climate, and labor costs associated with government mandates as ongoing barriers to private sector job creation efforts.

“We must redouble our efforts to make our state the best place for businesses to grow and create good jobs. If we fail to do that, our future will not be as bright as it should be for future generations.”

State’s Economy Tops Concerns Connecticut’s economy was the single greatest concern for 34% of businesses, followed by national economic uncertainty (21%), tax burden (14%), Obamacare (11%), and regulatory compliance costs (9%).

Looking ahead to 2014, when federal healthcare reform requirements take effect, the percentage of businesses that ranked implementation as their top concern doubled to 22%, second only to state economic issues (26%).

Thomas DeVitto, BlumShapiro’s chief marketing officer, said many companies were “planning for the worst” in meeting the Affordable Care Act’s requirements. Gioia added that businesses must get educated about the impact of Obamacare.

Just 11% felt the state was a positive place to do business, reflecting concerns over the pace of the state’s economic recovery and Connecticut’s ability to compete on a regional, national, and global basis.

Economic Competitiveness “There are fundamental reasons Connecticut lags the nation in recovery and these latest survey results underscore some of those key issues,” said Don Klepper-Smith, chief economist at DataCore Partners.

“There is an indisputable link between business vitality and state fiscal policy, which impacts our long-term economic competitiveness.”

Quality of life continues to be one of the state’s greatest business assets, cited by 54% of respondents, with proximity to customers and major markets nominated by 41%.

Exporting also continues to be an area of strength, with 79% of manufacturers and 32% of the state’s businesses overall engaged in international trade.

More than half (56%) of surveyed businesses expected to record a profit this year, down three percentage points from 2012. Twenty-eight percent expect to break even in 2013, a 10-point jump from last year.

“Despite the challenges businesses have identified with our economy this year, Connecticut companies continue to invest in their employees and infrastructure,” DeVitto said.
