Yorktown open for business Developers find Route 202 inviting BY SAM BARRON sbarron@westfairinc.com

A

long-vilified section of Yorktown, notorious for its traffic issues, is finally getting its due thanks to a change in political leadership and renewed interest by developers. Route 202, the gateway to Yorktown, now has $150 million worth of projects in the pipeline with more than $300 million in projects planned across the town. Costco Wholesale Corp. is working on its final environmental impact statement for a $60 million project

that would bring a 151,000-square-foot store to the site of the former Yorktown Inn next to the southbound side of the Taconic State Parkway. Pending approvals, Retail Store Construction Co., an affiliate of Breslin Realty Development Corp. in Garden City, L.I., hopes to break ground this year. Costco has pledged to spend $3 million in traffic improvements on Route 202, which goes along with $7 million in traffic improvements that the state Department of Transportation is spending to improve the road and fix flooding issues. his is a great way to start the week,” Mayor Thomas Roach observed on a recent Monday morning in a downtown office building in White Plains. At 150 Grand St., the mayor joined landlord Reckson and business leaders from the Westchester County Association (WCA) to welcome a young and fast-growing tech company to the city. Doing business as PlanGuru, the 3-year-old company develops and markets budgeting and financial planning software for businesses and nonprofits. It’s the first business to be vetted by and receive financial and services support from the Blueprint Accelerator Network L.L.C., a private-sector partnership started by the WCA last year to aid entrepreneurs and early stage companies that commit to remain in the county. The network, whose partners represent more than $275 million in debt financing and in-kind services, is a key element of the WCA’s Blueprint for Westchester initia-

tive to spur economic development and fill some 3 million square feet of vacant office space in the county. PlanGuru’s decision to open a headquarters office downtown also bolsters the city’s campaign to attract young professionals to live and work in White Plains, Roach noted. “This is an awesome, awesome location,” said Christian H. Wielage, a former IBM employee and CEO of PlanGuru. Until recently a largely virtual company that operated from Wielage’s White Plains apartment and shared office space, PlanGuru is leasing 1,635 square feet of renovated space at 150 Grand St., a six-story, Class A office building that Roach remembered for its drab, dilapidated interior before Reckson, the suburban division of SL Green Realty Corp., paid nearly $7 million to acquire it. Reckson in the last three years has spent $5 million to $6 million in greenbuilding renovations there, said John Barnes, Reckson senior vice president and senior director of SL Green’s suburban portfolio. Reckson is among 19 companies that are the accelerator network’s principal investors. Network, page 6

In the shadow of a new Yonkers, retailers wait and worry BY JOHN GOLDEN jgolden@westfairinc.com

n New Main Street off Getty Square in downtown Yonkers, business owner Kim Young is distressed and looking glum and haggard after sleepless nights. His Sun Fish Market will be forced to close when his five-year lease at 137 New Main St. expires at the end of this year, and Young fears he’ll be forced into bankruptcy and lose all that he’s earned from 20 years of hard work as a Korean immigrant to the U.S. Young questions why an endangered small business like his does not receive financial assistance from the same state funding pot from which the city of Yonkers is paying downtown landlords for their properties. Young and neighboring retailers on New Main Street now pay rent to the city as their new landlord. River Park Center, the mixed-use redevelopment project of the city’s downtown and waterfront master developer, Struever Fidelco Cappelli L.L.C. (SFC), for several years has cast a shadow over small businesses like Young’s in the vicinity of Chicken Island, the city parking lot and project site, even though no work has begun there in the four years since SFC’s site plans were approved. The development team’s solvency has been questioned by some Yonkers officials and residents since Baltimore-based Struever Bros. Eccles & Rouse Inc. dropped out of SFC during the company’s financial collapse in 2009 and as the continued financial struggles of SFC’s former leading partner, Cappelli Enterprises Inc., have effectively sidelined developer Louis Cappelli and his Valhalla company since the recession. But SFC has regrouped this winter. Led by New Jersey-based Fidelco Realty Group, the renamed SFC Yonkers L.L.C. is negotiating the details of a scaled-back commercial center at Chicken Island, said Peter Klein, vice president at Fidelco Realty Group and project manager for SFC Yonkers. He said principals of the reorganized SFC will be announced soon. The city and SFC could have an agreement on the revised first phase of the SFC project by the end of February,

Klein said. Young and other retail tenants on New Main Street unexpectedly felt the impact of the slumbering River Park Center project in December, when New Main Street Development Corp. (NMSDC), a development arm of the city that has been idle and unfunded since its creation in 2008, began acquiring New Main Street properties between Nepperhan Avenue and Ann Street. For 10 years, “It was just a rumor,” Young said of the redevelopment plans, “and then all of a sudden they started.” The city is using an $8 million state grant in 2012 from Empire State Development to acquire six properties that will be demolished

to make way for the uncovering or “daylighting” of the Saw Mill River and construction of a riverwalk and public park there, said Wilson Kimball, deputy commissioner of the Yonkers planning and development department. The project at River Park Center, which would be the third phase of the city’s Saw Mill River daylighting at downtown sites, was previously estimated at $41 million. Klein said SFC’s scaled-down commercial center at Chicken Island, estimated at $125 million to $150 million, will be built at the same time as the city’s daylighting project. Kimball said the city, not SFC, will be on the hook for daylighting construction costs unless Yonkers receives additional state

or federal funds. The city’s NMSDC in December paid approximately $2.7 million to two landlords for three property parcels on the New Main Street block. Kimball said if the owners of three remaining properties slated for demolition do not agree to a sale price by Jan. 31, the Yonkers Industrial Development Agency will be asked to begin eminent domain proceedings to condemn the properties on behalf of NMSDC. Young and two other New Main Street business owners said city officials in December told them the city will not financially assist their relocation.

“We have no idea what’s going to happen,” said Hassan Abutin, who has three to four years remaining on his Main Street Department Store lease at 151 New Main St. City officials told the retailers none of their leases will be renewed and their businesses on New Main Street cannot be sold. “And when the lease is finished, get out of here,” said Abutin. “We don’t know what we’re going to do,” said Areli Moran, co-owner with her brother of J & M Party Supplies on New Main Street. She said their 8-year-old business has fed off the success and customer traffic of her former employers and Mexican compatriots across New Main Street at La Pinata Bakery. “We don’t want to go too far from them,” she said. “We just want something fair and keep doing business” in Yonkers, said Moran. City officials told the tenants “they’d try to help us find a place, but nothing moneywise.” “They said the city doesn’t have any money,” said Young, who moved to Yonkers from Atlanta, Ga., four years ago when he bought the Sun Fish Market business. “Who has any money?” Young pointed to stainless steel coolers, freezers and display cases and commercial kitchen equipment in his store. The fixtures are worth about $200,000, an investment Young said he’ll lose when his store closes if the city does not compensate him. “I’ve been here 20 years in America,” he

said. “I lose everything. I’m going bankrupt.” Young said he recently tried to meet with Kimball at her city office to request a “couple months” of free rent to help him save money for his business move. He said his request was denied, though Kimball would not meet personally with him. “I’m in shock now. What can I do?” he said. The $8 million grant used to fund the city’s New Main Street purchases “is state money,” Young noted. “That money only goes to the landlord.” He said the grant also should be used to assist store owners with relocation and fixture replacement costs. “They think we are garbage.” Young said. “I’m the city people too. What is my small business for? We pay tax.” Regarding the smaller River Park Center project being negotiated with the city, Klein said, “The scale will be transformational for the downtown.” Construction of new municipal offices and a municipal garage at Cacace Justice Center on Nepperhan Avenue, another element of the SFC redevelopment initially estimated at $1.6 billion, also is being discussed, he said. For River Park Center, “The economic reality is we were unable to assemble properties needed” for the previously proposed mixed-use development, Klein said. He said the developer hoped to add commercial and residential development in a second phase, “growing the project closer to its original design.”

On the Hudson River waterfront, Klein said SFC plans to begin construction this year of Palisades Point, a 436-unit tower complex of rental apartments. Before the recession, SFC planned to build luxury con-

dominiums there. He said SFC is finalizing a redesign that “enables us to get out of the ground this year.” “We continue to be bullish on Yonkers in general,” Klein said.

Winged Foot Golf Club to host U.S. Open in 2020

inged Foot Golf Club in Mamaroneck will be the site of the 2020 U.S. Open Championship

U.S. Open. The U.S. Golf Association (USGA) hoped to return to the elite Westchester County course in 2015, but after a series of negotiations with Winged Foot leadership and its membership, they determined 2020 would be appropriate. The U.S. Open was last held at Winged

Foot in 2006 when the world watched the historic collapse of PGA Tour golfer Phil Mickelson, a winner of four PGA major golf championships. The drama of that memory is part of the lure for the USGA to return to Winged Foot. It’s one of the most relevant clubs in the country without adding anything to the courses’ landscapes, said Thomas J. O’Toole Jr., USGA vice president and championship committee chairman. Regarding preparation for the major tournament, “You don’t want to do too much to the Mona Lisa,” said O’Toole. “That’s why it’s so great to come back here because it can test

the greatest players in the world.” The 14-year gap between the last time Winged Foot hosted the U.S. Open and the next time the club will play host is directly related to the sacrifice that ties any club to a major. John Schneider, who began his oneyear term as Winged Foot club president in January, said the challenge that comes with hosting a June tournament is the time constraint. “It takes them a month to get off the property,” he said. “Now you’re in the middle of July, which is not a great growing season. Even though we do the restoration and we sod the fairways and work on the drainage,

it’s still going to be fall … before we can play on all 18 holes,” said Schneider. Despite the difficulties, “It’s something we feel is our heritage and the bylaws of the club to hold national championships,” Schneider said. “We’re excited. You look at the tradition of Winged Foot – you’ve got (Robert T.) Jones, (Billy) Casper in his day, Hale Irwin playing championship courses better than anybody at that time, Fuzzy Zoeller. You have a chance of adding to the history of the books and it’s cherished by the membership.” And the monetary value of hosting such an event is substantial. In the past, the U.S. Open has brought in roughly $150 million to regions that have held the four-day event, according to the USGA. O’Toole said it’s hard to speculate on how big that number might be in 2020, but he said from a corporate hospitality perspective, the U.S. Open is the largest production of golf in the world. “And this is a great region to produce our national championship in New York for a lot of reasons – corporate America is here, vibrant New York golf fans,” said O’Toole. “So there will be a significant economic impact, one that will be great for the club and great for Westchester County.” Between now and 2020, Winged Foot Golf Club will have time to come up with a game plan. Schneider said the club also has work to do on the course itself. A few months ago, the legendary golf course was visited by Hurricane Sandy. “We did lose a couple of trees that we’re replacing and we might relocate a couple of bunkers,” Schneider said, but added that would pretty much be the extent of it. The club prides itself on general upkeep, which helps it remain among the most prestigious golf courses in the nation. Ideally, Winged Foot will have nine holes available on its West Course for members to continue their play immediately after the U.S. Open ends, said Schneider. The tournament is scheduled for June 18-21, 2020. Other issues are also being investigated, including shuttling fans to and from the event. But Schneider and O’Toole agree they have sufficient time to come up with needed solutions. O’Toole said the USGA is happy they found “the right balance” of time for Winged Foot members, and added “we look forward to coming back.”

hoppers who have been clamoring for more retail stores and improved traffic flow at Midway Shopping Center may soon be getting their wish. The owner of the plaza at 1001 Central Ave. in Greenburgh is proposing building two additional structures to keep up with customer demand. The 246,981-square-foot shopping plaza, managed by Greenwich-based Urstadt Biddle Properties and owned by Lyle Steinberg, would also make it easier for cars and pedestrians to get around. It would be the first major parking renovation in 20 years at the shopping center, which was built in the 1950s. The parking area would be reconfigured to provide improved traffic flow as well as better pedestrian access by closing one driveway that provides access to Central Avenue. Shoppers had complained of congestion and difficulty maneuvering vehicles in a cramped parking lot. “We want to improve the overall traffic circulation,” Willing Biddle, president of Urstadt Biddle Properties said. “We want to make the lot more user-friendly.” The shopping center, which has 15 retail stores and restaurants, is anchored by a 69,000-square-foot Shop Rite supermarket

that opened in June 2010. “We always have a lot of requests from shoppers for different kinds of stores and we’ve had inquiries by tenants looking for space that we can’t accommodate,” Biddle said, noting the shopping center is currently 100 percent leased. “We are looking to improve the tenant mix to better serve the shoppers of the area.” The first building proposed to be constructed would be a 10,800-square-foot structure on the northwest corner, with 5,400 square feet of ground floor retail and 5,400 square feet of second-floor restaurant space with outdoor seating. Another 3,500-squarefoot restaurant/retail space would be built near the southeast corner of the shopping center. Urstadt Biddle declined to disclose a cost for the project. However, Midway Shopping Center recently received a $32 million mortgage from NorthMarq Capital L.L.C. Financing was based on a 15-year term with two five-year options and a 25-year amortization schedule, according to NorthMarq. Plans were recently submitted to the town, with hopes of construction beginning sometime in the summer or fall. Construction is expected to take six months. Midway will request a parking waiver, as renovations would leave 1,182 parking spaces, instead of the 1,481 required at the site.

It has been widely reported in the past several years that the lack of strong corporate governance practices contributed to the demise of several large corporations. Small and medium sized businesses can greatly benefit from lessons learned by their public counterparts. In a broad sense, corporate governance refers to the way in which an organization conducts its daily operations, starting with the value it places on ethical behavior and transparency and the means by which those values are communicated throughout the organization. Effective corporate governance policies that are monitored and enforced will help to mitigate the risk of fraud and misappropriation of assets, and will enhance and protect the strength and reputation of a company. If you think that strong corporate governance practices are only applicable to large publicly traded companies, think again. With continued economic uncertainty and ongoing regulatory and compliance issues, now is the time to appreciate that even the smallest businesses can realize significant benefits from understanding and implementing corporate governance policies that are scaled to the size of the organization. Private companies may not be as complex or face the level of scrutiny of a public company, but they face similar challenges and concerns. The following questions can help identify areas of opportunity to strengthen your company’s corporate governance: Does your company have an advisory board? • An advisory board will provide objective oversight and advice for small and medium sized companies. Ideally, an advisory board should consist of trusted professionals (bankers, attorneys, and accountants) as well as industry experts. • If your company already has an advisory board, does the management team meet routinely with the board to assess risk (including the risk of fraud) and opportunities facing the organization, and brainstorm ways to mitigate those risks or take advantage of the opportunities? • Does the management team, with the help of the advisory board, develop realistic goals for growth, and plans for monitoring and achieving those goals? Is your current management team structure appropriate? • Does the current management team have the appropriate skill set and expertise to develop and achieve company goals?

• Are management compensation arrangements appropriate? Do company policies stress the importance and value of ethical behavior? • Does the management team proactively communicate the importance of ethical behavior and zero tolerance for non-compliance with company policies? • Do policies include a means by which employees can report unethical behavior in a non-threatening manner and without fear of retribution? Is your current organizational structure appropriate? • Does the company have the right number of employees in place? • Does the company have the right employees in place (are they competent and adequately trained)? • Are roles, responsibilities and job expectations clearly defined and communicated to employees, and are employees held accountable for their performance? • Are departments and responsibilities structured to best achieve segregation of duties in key financial cycles? Being able to answer the above questions will help to identify possible weaknesses and areas of improvement for your organizational structure and will strengthen your company so it can: • Identify and react to business risks and opportunities more efficiently; • Enhance the reliability of financial reporting so that management can make better informed decisions and assessments of profitability; • Ensure compliance with applicable laws and regulations; • Reduce the opportunity for public scandal, which can result in harm to the company’s reputation; • Safeguard assets and prevent the opportunity for fraud; and • Foster a culture of individual responsibility and accountability. Effective corporate governance policies need to be continuously monitored and enforced. Implementing such policies will enhance and protect the value and reputation of your company. efits in Costco coming into Yorktown. “Route 202 has been a nightmare since I was a kid,” Murphy said. “If you look at the Costco site, it’s appalling. It’s a dilapidated building with graffiti and holes in the ceiling. This is an opportunity for the town.” Supervisor Michael Grace, who took office in Jan. 2012, said that traffic on Route 202 is problematic and has kept businesses on the south side of the road from being successful. “It’s difficult to make left turns into or out of the south side of the road,” Grace said. Costco claims 200 jobs and $800,000 in tax revenue would be generated by the store. “Hopefully Costco will trigger a better and higher scale of commercial development for that corridor,” Grace said. “It really is the town’s last method of potential commercial growth. Approving Costco makes a statement that we are looking toward orderly proper development of that corridor and that Yorktown is receptive to development.” Just down the road, Fieldhome, an assisted-living facility at 2300 Catherine St. behind McDonald’s restaurant, is planning a massive $90 million, 297,400-square-foot continuing care facility with construction set to begin next year. Fieldhome would be the third continuing care retirement facility in the county and feature 102 one- to two-bedroom independent units and a 96-bed nursing home. The project needs approval from the state Department of Environmental Protection

and from the state Health Department. The planning board approved Fieldhome’s plans in August. The town has also been in contact with Charles Monaco to develop 100 acres of undeveloped land that he owns on Route 202. Monaco has proposed a 140,000-squarefoot big box store such as Target or Lowe’s, along with 60,000 square feet of additional retail. Monaco’s proposal would also include the installation of a traffic light and widening Route 202. The land would need to be rezoned from residential to commercial. Monaco would also donate 52 acres of open space to the town. Town officials said they are pleased with all the development on Route 202, and said the town has changed its tone with developers. “We’ve gone from being resistant to any development to welcoming creative and innovative development,” Grace said. “On a case-by-case basis we try to facilitate good commercial development.” Developments are not just happening on Route 202. Over on Route 6 in Yorktown Heights, the Jefferson Valley Mall, owned by Simon Property Group Inc., has been in discussions with the town about a $45 million update that would add retail stores, a restaurant and renovate the façade. The mall has not officially filed any building plans with the town and a spokesman declined comment. The mall has lagged behind other malls in the area in regard to upgrades, with residents choosing to go to malls in White Plains or Danbury, Conn. The town recently passed new parking

regulations that require four parking spots per 1,000 square feet of space instead of five. While some residents accused the town of doing this to accommodate Costco, the town board exempted Costco from the regulations and said it was done primarily to help the Jefferson Valley Mall’s renovations.

You have to have a happy medium. You have more of a building, less of a parking lot, and more trees and shrubs. It’s a no-brainer, a simple thing.” Murphy said that Jefferson Valley Mall was having trouble attracting tenants without knowing the specific parking requirements. Grace said it is important to have regulations and laws that are helpful to business development.

Reckson will provide the space rent-free for one year and the tenant will receive a 50 percent discount on secondyear rent. Wielage said the company will save nearly $4,000 in monthly rent this year. Marissa Brett, WCA executive director of economic development, said the total package of rent breaks and professional services the network will provide is valued at about $200,000. Harrison Edwards Inc., the Bedford Hills public relations and marketing agency, will provide PlanGuru with pro bono marketing services. Search Smart Marketing in Valhalla will provide free search engine optimization services. Brett said the company also will receive legal and accounting services from network partners and mentoring from top executives in the county as well as access to the county’s wealth of colleges and universities. Wielage said the company in 2011 launched an entirely rewritten version of

We’re hopeful this message has gotten out loud and clear.” One positive aspect to all the commercial development is that it would improve the town’s commercial tax base, offsetting the property tax burden on residents. A town the size of Yorktown should have a 25 percent commercial tax base, but Murphy estimates that it is as low as 10 percent. Through all this proposed development, the town has had to grapple with its motto, Progress with Preservation. Few municipalities in Westchester are as committed to preserving open space as Yorktown, which strives to keep its rural Northern Westchester character with the need for an expanding tax base. Costco has attracted fierce opposition from many residents who fear that it would create additional traffic problems and be an environmental nightmare that is out of character with the town and will drive out small businesses. A group, Concerned Citizens for Yorktown, have set up a website, nocostco.com. “We’ve preserved more than 3,200 acres of open space,” Murphy said. “We have preservation, now we need progress.” “You can’t afford to just do preservation,” Grace said. “Preservation requires progress. We’re not looking to develop undeveloped virgin land. These are areas that have already been developed and have become dilapidated. There’s an obligation to manage open space, but we can’t do that without a vibrant commercial tax base.” about folding up the company,” he said. Wielage said the Blueprint Accelerator Network offered the early stage company a solution and reason to locate in White Plains after “a very difficult process to find space that would fit us at a price we could afford.”

ounty Executive Robert P. Astorino pledged to protect taxpayers at the Westchester County Association’s annual breakfast at the Westchester Marriott in Tarrytown. Astorino, whose first term expires this year, said that county spending has been reduced by 5.2 percent since he took office, while taxes have decreased by 2 percent. Astorino also pledged to protect the county’s reserve fund, saying it was critical to maintaining the AAA bond rating from Moody’s. The county executive also addressed this year’s budget process, which saw two Democrats vote with their Republican counterparts to approve the budget after other Democrats walked out. “We had a bipartisan coalition this year,” said Astorino. “It wasn’t elegant, but it got the job done. They reached across the aisle and showed political courage. This budget was compromise without compromising.” Mandate relief is necessary to keep Westchester sustainable, Astorino said. Pension costs have risen to $91 million, up from $35 million in 2008, while county taxpayers pay $7.3 billion in Medicaid costs. According to Astorino, 85 cents of every dollar in the county budget is spent on an unfunded mandate.

New Rochelle gets new development chief

Luiz C. Aragon has been appointed as New Rochelle’s new development commissioner, City Manager Charles B. Strome III recently announced. Previously, Aragon served as planning commissioner of Sullivan County. Before that, he was deputy commissioner of preservation and development for New York City. Aragon is considered an expert in community development, economic development and revitalization, housing, planning, and environmental management. As a member of the Mid-Hudson Regional Sustainable Consortium, Aragon helped develop a renewable energy plan to create jobs and lower costs in the region. “The development commissioner is integral to the advancement of our city, and we conducted an extensive search to find the best candidate,” said Strome. “Aragon has a distinguished record of accomplishments and I look forward to him joining our staff.” Aragon will assume his new position Feb. 11.

“Legislators promised mandate relief when they approved the tax cap,” he said. “No one checked to see if their fingers were crossed. Comprehensive mandate relief needs to be achieved.” Astorino said the county is a year ahead of schedule on building affordable housing units to settle a 2008 anti-discrimination lawsuit with the U.S. Department of Housing and Urban Development (HUD). oday’s technology has made doing business a lot easier, but for many old souls, it can also be very intimidating. Cathleen Page, who runs Page Integrity Inc., a business technology consulting firm, recently opened The Learning Lounge at the Peekskill Hat Factory at 1000 N. Division St. to give clients firsthand help with all the gadgets in the marketplace, as well as hosting daylong seminars on subjects like job interviews and business continuity. “Technology has caused everything to be so integrated,” Page said. “You just can’t avoid it.” At The Learning Lounge, Page, who grew up in Croton-on-Hudson, aims for a relaxing environment that allows people to feel at ease while they get down to business. The office space resembles a funky New York City loft with a large mural, couches and soft lighting. Page’s office also features a 50-inch Smart Board to play videos and the latest computer and technological equipment. Page began renting the space in 2009 and spent three years making it just right for her clients. “It is often hard to make time for fun,” Page said. “At The Learning Lounge, we’ve created a comfortable space where people can learn what they need and want to know. Leave your stress at the door. It makes people want to be here.” Page said that many businesses, particularly ones that have been around for years, are often reticent to adapt and are scared by tablets and smartphones. Page showed a moving company how they could use a tablet to calculate estimates and invoices for customers on the spot, rather than doing everything back at the office. Before starting Page Integrity in 2005, Page spent 16 years in corporate technology and business management. “I can use my experience to really help people,” Page said. “I’ve worked with the smallest of businesses to Fortune 500 companies. Business owners have to be able to bring something to the table.” Page said that business owners don’t need to know everything about the latest technology, or own the latest iPad or Android to be successful, as each business is unique with its own business plan. Businesses simply need to learn what technologies benefit their business and how to successfully integrate it. “I don’t want to throw technology right at their face,” Page said. “I have people who have been in business for 50 years and are skeptical – ‘What does this woman offer us?’” Her clients include a diverse group of

businesses throughout the Hudson Valley and Fairfield, from architects to Realtors. Page’s love affair with technology started while she was a student at Croton-Harmon High School and the school began offering a technology program. While Page’s grades didn’t qualify her for the program (an A+ average was required, she averaged an A-), she was persistent and ended up taking the program after school, two days a week. “I may not have fit the profile for the class, but I wanted to learn,” Page said. “It was enlightening. It sculpted who I am today. They said I can’t do the program, I said ‘I can, I will, and I will master it.’” One of Page’s hallmark workshops is her eight-hour course called Nail the Interview, to help prospective employees impress employers while remaining true to themselves. “It’s really important to teach them how to be real people,” Page said. “Job interviews should go like conversations in a coffee shop. That’s really big.” Page also works with teachers and schools on how they can use technology to better the classroom environment, and how teachers can get the most out of Smart Boards. “Our teachers often don’t have the tools,” Page said. “You need to keep it interactive; it helps keeps their minds working.” Page has also worked with area nonprofits and with the New York State Veterans’ Home in Montrose, helping veterans get acclimated to the latest technologies so they can more easily find work upon returning home. Page, who describes her background as eclectic, has worked for companies like AAA and United Defense Industries. “I think it has made me successful,” Page said. “I have learned what works and what doesn’t work. I’m business savvy and I’m tech savvy.” At The Learning Lounge, Page has learning partners who help teach her clients and lead her seminars. Page said her business experience lets her know quickly if someone is technologically capable and willing to learn. “People feel like that they have to be perfect, but it’s all about comfort,” Page said. “You have to feel like you can relax and take a load off. It’s how you learn best.” Some of Page’s upcoming workshops include “iPhone Mania: What is the Hype and Do I Need to Have It?” and “Thinking Inside the Dropbox: Ten Cool Things You Can Do With This Software to Simplify Your Life.” “For us, it’s all about meeting people’s needs in many aspects,” Page said. “In our techsavvy age, technological stress is very real.”


Rethinking retirement and succession plans

Thinking about how I might retire from owning this business is giving me a headache. I don’t have enough money to walk away and not work again. I haven’t been able to fund retirement for the last two years, although things are getting better now. No one can run this business in my absence. And I have no idea who I’d sell it to or why they would buy it.

Thoughts of the Day: Building an out is every business owner’s responsibility. It’s easier to plan if you think in long time frames. Defining needs is a good place to start. Work on options to sell and reasons for buyers to engage in buying the business. Lots of business owners get into the business without a clear idea of how to get out. They get caught up in the day to day, working “in” the business rather than “on” it. Or they confuse planning for exit with planning for their own mortality, which may be a subject they’d like to avoid at all costs. Let me propose an alternative approach to thinking about exit. It’s the reason the business exists – to have a future. Build for a robust business future without being tied to the owner and the business will survive. Make the business dependent on the current owner and it has little chance of continuing on past the current shareholders. There are a number of tools that will help the business survive the long haul. Involve managers in the future planning and measurement of current results to help them better understand how the business runs and where it’s going. That way they can step in and take on more responsibility. Succession plans for the owner and other key managers will help the business weather a transition and minimize disruption. Trying to do it last minute makes it nearly impossible to do the transition well. Finding the right people to come in and take over is a special deal. Not everyone is right for the job. Be clear what it is that you want out of the business. How much money do you need in order to retire? Do you want to retire cold turkey or would you like the option to work part time? How important is it to secure the future jobs for employees who have helped you get this far? If you know what kind of money you want to take out of the business, you can then figure a number of other answers. How much money do you expect to get for selling the

business? How big and how profitable would the business have to be to achieve that sale price? How much does the business need to grow in order to achieve the optimum exit? Get what you want from an exit strategy by working backwards, building a plan and giving the plan enough time to come to fruition. Once you’ve laid out the planning parameters of size, profit/year and time frame to exit, you can plot out how many employ-

ees you need to add, how many clients, how many additional products and services. Do you have the right people on board to help you see this through? Getting people invested in planning for the future without you is going to be critical. Teaching people to see this as an opportunity to secure their futures in building a company that someone else would want to buy. Unlike the first few years, where your

An app-etite for data-gathering This is the second of two columns. The first appeared in last week’s edition.

I

f a mobile app does not collect any information from a mobile device, no disclosure policy is required. However, once any information is collected, the Federal Trade Commission (FTC) requires the presence of a disclosure document. For children under 13 years old, this disclosure document requires the signature of a parent or legal guardian. This is in accordance with the FTC’s enforcement of COPPA (Children’s Online Privacy Protection Act). For 13-year-olds and older, no signature is required. However, a disclosure policy is still required. In many cases this information in question consists of geodata, email information and phone ID, although it can extend far beyond this to include calendars and pictures. According to Chris Librandi, an attorney with the law firm Levett Rockwood P.C. in Westport, whose practice includes digital security matters, the FTC looks very differently at companies with a weak disclosure policy versus one without any policy.

To avoid any difficulties with the FTC and watchdog groups, the disclosure should list all the different types of information that are being collected. However, for various reasons – including ignorance of the law and it being bad for business, the majority of companies collecting data do not have any disclosure policy. Most adults consider this surreptitious acquisition of information to be extremely intrusive. According to a July 2012 report on mobile phones and privacy, “78 percent of the U.S. consumers surveyed considered the information on their mobile phones at least as private as that on their home computers.” Furthermore, “92 percent of the respondents said that they would ‘definitely’ or ‘probably’ not allow the use of their locations to be used to tailor advertising for them.” A Pew study reported that 54 percent of the respondents refused to download an app because of its data acquisition capabilities. Interestingly, these findings are in sharp contrast with the excitement being expressed by advertisers and marketers concerning the “new frontier” of mobile advertising. According to a mobileSquared study, “70 to

80 percent of brands that are active in mobile are now inquiring about how they can capitalize on the location element that mobile delivers.” Thrust into the middle of this argument is the consumer and the FTC. It is the FTC’s responsibility to monitor the disclosure policies of every app that collects data. However, with more than 600,000 apps currently available and increasing daily in number, it is an overwhelming task for the FTC’s 2,500 investigators to examine all of the apps that collect data. According to Librandi, the current state of the FTC is reactionary. It is largely dependent on whistleblowers, people and watchdog groups that test the apps and then notify the FTC that there is a potential problem. Even then, change can happen slowly. Following a yearlong investigation, the FTC discovered that 60 percent of the apps they studied were transmitting information acquired a their mobile device to the developers, analytics companies, ad networks or some other third party. Only 20 percent of the apps had a disclosure policy. The obvious solution is to require every

app developer that captures information to have a disclosure policy detailing what data they are transferring. Laws may be changed to require this level of detail. However, since this flies in the face of Internet marketing, it is subject to considerable pushback from such powerhouses as Apple and Google which are very protective about this potentially highly lucrative revenue stream despite direct negotiations with the FTC. Without an industrywide agreement, the FTC – with limited power and resources – can only focus on individual companies with the most common result being a requirement that the app manufacturer have some type of disclosure policy even if it is misleading or insufficient. Will most app manufacturers include a detailed disclosure policy? It’s doubtful, particularly since it can cost them business. Instead, they either ignore the disclosure requirement, claim ignorance or merely copy an existing nonspecific disclosure document. Are there apps that can block such companies as Apple from tracking you? Yes, there are a few including one called Jailbait, but Apple may void your warranty if you load it. Newman, page 12

In Yonkers, downtown loans unpaid

Struggling in a downtown whose planned redevelopment stalled in the recession, several bar and restaurant and retail store owners have defaulted on their small commercial loans from the city of Yonkers. Six of 11 owners receiving loans from the previous administration of Mayor Philip Amicone are in default for approximately $366,000, the city’s inspector general, Kitley S. Covill, recently reported. And the owner of a South Broadway discount store is delinquent in repaying a $25,000 loan balance. The largest debtor in default, Body & Soul Essentials Inc., owes approximately $149,964 on a 10-year, $150,000 loan made in 2010 by the city’s former economic development office. Mayor Mike Spano in 2012 folded that office into the city planning department. Body & Soul operates the Wholesome Goodness Market at 66 Main St., a 170unit luxury apartment building that that has drawn young professionals to downtown Yonkers since opening five years ago. The owner of a fitness center at 66 Main, Retro Fitness Funding Yonkers L.L.C., has kept current on its $300,000 loan, the city’s largest outstanding commercial loan, according to the inspector general. Covill noted that that all of the loans were to small businesses “that were starting or maintaining a business in a challenged economic area of the city. As such, the loans were risky and were given to encourage viable small businesses.” The inspector said the city’s commercial loan files were incomplete and included “haphazard” communications between city employees and banks and attorneys regarding loan status and litigation. Often loans remained in default with no collection effort for years, she said.

Although Connecticut and New York are among the 10 states to prohibit surcharges on credit cards, retailers in most states are now allowed as of Jan. 27 to charge customers a checkout fee for using a credit card. The fee is a part of a July settlement between Visa, MasterCard and nine banks, allowing store owners to pass along the cost of the transactions to customers. The fee can be up to 3 percent of the total purchase price and doesn’t apply to debit cards. Many major retailers, including Walmart, Target and Macy’s, have said the agreement is bad for both stores and consumers and isn’t a solution to Visa and MasterCard’s “unfair” fees.

Westchester program promotes new testing for brain tumor patients

The Westchester Brain Tumor Program is offering a new testing option that could

extend the life of patients suffering from complex brain tumors. The testing, which profiles individual tumors at the molecular level, identifies biomarkers specific to an individual patient’s tumor and pinpoints the best treatment options. “By comparing a patient’s tumor’s information with data from published clinical studies by thousands of the world’s leading cancer researchers, molecular testing can help identify potentially effect drugs, and eliminate ineffective treatments,” said Dr. John Abrahams, founder and director of the Westchester Brain Tumor Program. “This is a major step forward in our efforts to develop personalized cancer therapy.” Molecular profiling testing is specifically recommended for patients with recurrent, complex brain tumors. Construction council awards $45K in scholarships

oder Real Estate Equities L.L.C, the potential owners of the Legionaries of Christ property in New Castle, is hoping its third residential development proposal is the charm. Representatives of Montclair, N.J.-based Soder presented their third proposal to the New Castle Town Board at a Jan. 15 meeting to develop the 97-acre property at 773 Armonk Road. Soder plans to build a 30-room hotel and 54 two-bedroom residential condominiums all in one existing building. A spa, restaurant, fitness center and small theater would also be built on the site. The spa and restaurant would be open to the public. The condominiums would be geared toward empty nesters, though there will be no age restrictions. The property is in the Bedford Central School District. The development would preserve the existing building on the property, which was built in the 1920s. Unlike the previous two proposals, there will be no additional housing constructed. David Steinmetz, of Zarin & Steinmetz, the White Plains law firm representing Soder, said that the condominiums would be far away from neighboring residential units and that the proposal preserves the magnificent views on the site. It has also had some successes including forcing Viacom to pull its SpongeBob app that was directed at children while surreptitiously acquiring and transmitting email addresses. After all of this discussion, the relevant question to ask as a consumer is, “How do I know if my app is transmitting my information (which I consider confidential)?” And right now, unfortunately, the answer is that you don’t. Nothing but the tooth, for dad and daughter

D

rs. Kenneth Magid and Sabrina Magid-Katz are not only partners of Advanced Dentistry of Weschester but also father and daughter. But in their Harrison office, that family relationship doesn’t cloud the work at hand. As Magid-Katz said, “I call him Doc. It’s not Dad here.” The family bond, though, is a thread that runs through the practice, which Magid founded 41 years ago. The partnership of some four years got off to a smooth start and continues to thrive – by design. “I know of a number of family businesses that are disasters,” Magid said. “I know of a number of family dental businesses that are disasters.” So Magid took steps, including consulting a psychiatrist, to ensure their relationship – and the business itself – would not be harmed by the move. That led to a very specific move that made all the difference. “She came in as a partner, not as an associate,” he said. “I kid about the fact I couldn’t find a partner that would live up to my standards so I cloned me. She looks like her mother, but she’s very much like me.” And both are clearly driven. Magid, who received a Bachelor of Arts degree from Hunter College and a doctor of dental surgery from New York University College of Dentistry, is director of Pre Doctoral Laser Dentistry and associate clinical professor at the NYU College of Dentistry. He continues to be a respected author, clinician and holds a number of patents. Magid-Katz, who got her undergraduate degree from Duke University and her doctorate of dental medicine from the University of Pennsylvania, completed her residency at New York Presbyterian-Methodist. Though she calls herself a fourth-generation (“if you count my mother’s side, as well”) dentist, Magid-Katz was not set on the family business all along. “I was always inclined to do the medical field,” she said. “I really wanted to find what I wanted to do.” She decided on dentistry during her junior year in college.

Magid said he never suggested his only daughter follow in his footsteps. “I did not encourage her,” he said, as he had seen too many who “are pushed into it and hate it.” And for him, it has been especially rewarding to have his only child join him at work. “I’m extremely proud of her,” he said. “I love having her here.” And that appreciation is mutual, as Magid-Katz said: “He’s an amazing mentor. And I wouldn’t get that anywhere else.” Often, coming into a new business situation there is a period of adjustment, a time to build up trust. But for Magid-Katz, she was already ahead of things, or as she summed it up: “He’s my dad.” Magid-Katz said the family bond is something many patients recognize and appreciate.

“It’s comforting for patients, to some extent, as well,” she said. It helps, they agreed, that they each have their specialties. “We each have carved our own niche in the practice,” Magid said. “I do the surgery. That’s my thing.” Among so many other specialties, he’s especially proud of his work detecting oral cancers, as well as screening for and treating snoring and sleep apnea. Magid-Katz has created a thriving specialty, offering services tailored for the deaf and hard of hearing. Across the board, the practice is known for its cutting-edge procedures and offering the latest technologies. Magid-Katz said she often hears from friends that she must have had to introduce her father to the world of computers. “He takes a computer apart for a hobby,” she said with a laugh.

The company indeed has a well-developed website (ADofW.com), but she did add a number of things. “Now I’ve taught him Facebook,” MagidKatz said. When it comes to dentistry, though, Magid said “This is a very unusual practice,” Magid said. “It’s extremely high-tech.” As he is involved in the creation of so many technologies and procedures, when things are touted as new, Magid has already been working with them for years. “We get to use these things beforehand,” he said. “That’s the fun of being on the cutting edge. You get to do that.” And for Magid-Katz, it’s a practice she’s proud to be a part of. “It’s a good way to treat people,” she said. “I hate to be biased, but as far as I’m concerned, it’s an optimum level of care.” For Magid, it’s all proven successful. “We prepared well,” he said. Technology changing the face of plastic surgery

r. Scott Newman marks his 20th anniversary in private practice this year. The plastic surgeon who specializes in breast surgery and other forms of body contouring lives in Scarsdale, with offices in Westchester, Manhattan and Long Island. Over the years, Newman has seen many changes. “To me, I think the biggest change or biggest evolution over time in my practice is embracing the fact technology is playing a big role in what we do,” he said. Ongoing improvements in equipment and ever-advancing procedures mean there’s always a need to stay current. “That’s what my practice is all about, staying on the cutting edge, not just surgically but technologically,” he said. “A lot of people who practice aesthetic medicine do within the confines of their offices.” Newman, though, is out teaching, talking to colleagues and attending seminars. “You have to stay current,” he added. And these days, the requests for procedures seem to be on the rise, which Newman said happens when times get tough. “I think a lot of this might have been

economy-driven.” People are scrambling to secure, or keep, jobs, often competing against much younger candidates. “Sometimes you don’t get the job because you just don’t look the part anymore,” Newman said. Too often, he said, people seem tempted by quick fixes and want fast results at good prices with as little downtime as possible. “That’s what the world has demanded,” he said. But he urges people to really think about what they might be getting. Westmed plans fifth polyclinic

Westmed Medical Group, the 250-physician multispecialty practice based in Purchase, has announced plans to open its fifth full-service polyclinic in Westchester County by 2015. Dr. Simeon Schwartz, WESTMED’s founding president and CEO, said the 85,000-square-foot medical office likely will be in Harrison, though no lease has yet been signed. An office lease deal is expected to close by March or April. The new facility’s outpatient services will include primary and specialty physician care, an Urgent Care Center, a clinical laboratory and radiology services. “We’re happy to have the confidence and support of the community, and we need space for more doctors to meet the needs of patients,” Schwartz said in the announcement. Ardsley biotech company awarded Army contract

A research contract newly awarded to Westchester-based Acorda Therapeutics Inc. could spur development of a drug used to treat spinal cord injuries in combat veterans. Officials at Acorda’s Ardsley Park headquarters in Greenburgh said the U.S. Army Medical Research and Material Command has awarded the company a $2.67 million research contract to support development of AC105, a proprietary magnesium drug formulation being studied as a treatment for acute spinal cord injury (SCI). Acorda will conduct a Phase 2 clinical trial primarily to assess the safety and tolerability of AC105 in patients. The company plans to open enrollment for the study in the first half of this year. “Spinal cord injuries often result in severe, lifelong disability, and primarily occur in young people,” Dr. Anthony Caggiano, vice president of research and development at Acorda, said in the announcement. “This leads to long-term care and quality of life issues for the person with the injury, as well

Some places simply set up shop and patients flock. “Some of it’s become almost silly a little bit,” he said. “If someone can get their hands on something, they can use it. … It’s not hard to give somebody an injection.” And that multitasking, such as a gynecologist giving Botox, scares him. “You know, this is your body, not your car,” he said. “You would think that we would take a different perspective on it.” At his offices, Newman prides himself on one-on-one consultations where the focus is beyond the basic and equipment is ready to pursue any avenue. “They’re coming in for help with what they see in the mirror,” he said. His office, he said, is ready. “Whatever that is out there, I have access to,” he said. “I really have every piece of technology that exists.” It’s the same way, he said, his experience helps him understand the nuances of what a patient is really after. “Sometimes what they think is bugging them really isn’t what’s bugging them,” he said.

as for their family and the health care system as a whole.” Caggiano called it “a privilege for us to be working on a therapy that may help those who have been injured in the line of duty.” In preclinical studies, the drug product showed neuroprotective properties and improvement of locomotor function in spinal cord injury when therapy was begun within several hours of injury. The U.S. Food and Drug Administration (FDA) granted fast-track approval for AC105 as a therapy to improve functional recovery of acute SCI patients. Acorda expects to apply for FDA orphan drug designation for AC105, a designation that can ease market approval and encourages development of drugs that treat rare medical conditions and have a limited commercial market. The company also will explore orphan drug designations in Europe and in other parts of the world. Citing the National Spinal Cord Injury Statistical Center, Acorda officials said approximately 270,000 persons in the U.S. live with a spinal cord injury. Those traumatic injuries primarily affect young males, with 50 percent to 70 percent occurring in persons aged 15 to 35.

Newman said training and staying active in the field can only add to a doctor’s success. Newman attended New York Medical College, was chief resident during his time at the Mount Sinai Medical Center in New York City and has been acting as clinical assistant professor of plastic surgery at the Albert Einstein School of Medicine and chief of the Division of Plastic Surgery at St. John’s Riverside Hospital. Newman is also certified with the American Board of Plastic Surgery and belongs to professional organizations including the American Society for Aesthetic Plastic Surgery and the American Society of Plastic Surgeons. It all adds up to years of expertise developed through a thriving practice. “It’s a matter of not just understanding how to do things, but how to do them well,” he said. And he wishes more patients would take time when deciding on their next procedure. “A lot of it today is buyer beware,” he said. “It doesn’t mean that I’m wonderful. It just means I’m determined to put together a (practice) that’s appropriate.” For him, the patient is never out of the forefront. “Making sure your patient has realistic expectations is still the most important part of all this.”

One voice for suburban hospitals

Two Long Island and Hudson Valley hospital associations have realigned their joint lobbying efforts in Albany and Washington, D.C. under the umbrella of the Suburban Hospital Alliance of New York State L.L.C. Advocacy for all 51 hospitals represented by the Nassau-Suffolk Hospital Council (NSHC) and the Northern Metropolitan Hospital Association (NorMet) will be directed by the Suburban Hospital Alliance. NorMet and the NSHC retain their respective boards and remain two distinct associations representing hospitals in their regions. Kevin Dahill leads both regional hospital associations as their president and CEO and is principal of the Suburban Hospital Alliance. The suburban alliance includes 27 hospitals in the seven-county Hudson Valley region and 24 hospitals on Long Island. NorMet and the NSHC in 2006 began working informally on joint advocacy activities and formally organized their lobbying efforts in 2011 under the Suburban Hospital Alliance. acanelli’s New York Italian kicked off the new year with a new million-dollar look. Until recently, the former Pizza & Brew restaurant at 851 Central Park Ave. in Greenburgh was closed while undergoing a $1.2 million dollar renovation. The family said it’s the most significant change since the restaurant opened its doors in 1974. The new model of the established family business aims to please area customers and pay homage to the Racanelli restaurant tradition in Westchester County. More than 40 years ago, Martino Racanelli, a native of southern Italy, ventured into the restaurant business with his brothers Frank and Gennaro “Gino” Racanelli. They cofounded the original Pizza & Brew at 85 Knollwood Road in Greenburgh in 1971. Later they added the location on Central Avenue and a restaurant group, SDB Holding Company Inc., grew from there. Eventually the Racanelli family ran 12 restaurants within the metropolitan area. Early on, Martino’s sons were called on to work in the family business. “It was great way to grow up,” said John Racanelli, one of Martino’s sons and co-founder of the newly formed First Generation Hospitality L.L.C. said. “We learned life lessons and the value of the dollar.” Martino instilled a hard work ethic in his sons, an asset they applied in other professions before returning to the family enterprise. John went into the commercial real estate industry, worked under billionaire hotelier and casino developer Steve Wynn in Las Vegas, and then became president of Racanelli Development, a real estate development company based in New York. His brother, Martin “Marty” Racanelli, became an attorney specializing in corporate law, intellectual property, management, and finance and information technology. Their brother Alex Racanelli never left the family restaurant business. Alex helped run the Racanelli-owned restaurants. He said he treasured the experience of receiving daily knowledge from his dad. “It was an honor to be with him. Respecting him in the new restaurant is important,” Alex said. He said he knew his dad planned to upgrade the Central Avenue eatery, but in April 2011, Martino died unexpectedly. His sons Marty and John returned to the business to help maintain their father’s legacy. But the extended family, left with multiple restaurants and differing opinions about what to do with them, had to resolve disputes over family members’ ownership stakes. Rose Racanelli, Martino’s widow, and three of their four sons sued in state Supreme Court in Westchester to dissolve the extended family’s several restaurant companies and recoup for the late founder’s estate any misappropriated funds. The case was settled out of court in 2012. “Over the years the family evolved,” John Racanelli said of the lawsuit. “That happens. You create your own identity and after 10, 20, 30 years it’s difficult to keep going in the same direction.” In late 2012, the family sold the upscale Spiga Ristorante business and property at 718 Central Ave. for $2.85 million. Ownership of the family’s first restaurant on Knollwood Road went to Frank and Gennaro Racanelli, while the second generation of Racanelli brothers took over the Central Avenue eatery. With the ownership issue settled, the brothers decided a

fresh start was exactly what the family and restaurant needed. They signed a new 25-year lease for Racanelli’s New York Italian and moved forward with the plan to renovate. The fixtures the original restaurant was known for were removed. The old dining booths and the vintage Tiffany light fixtures are gone, along with the tabletops covered with dated newspaper clippings. The new interior creates a more sophisticated setting with reclaimed wood, updated lighting and wall sconces and a new bar. The Racanelli brothers took great care to honor their father throughout the revamped space. Old photos of Martino as a boy hang in the restaurant entryway and at the bar. Some of the founders’ original décor, including a 40-year-old Pizza & Brew sign and the original restaurant’s familiar striped stools have been kept as carefully placed interior accents. They also reassure old customers that the Racanelli family is still there. When the brothers took over Racanelli’s New York Italian, they brought in Mount Vernon native Nick Mautone as an investing partner. A former managing partner of Gramercy Tavern in Manhattan, Mautone was familiar with the Pizza &

Brew brand. He and the Racanellis formed First Generation Hospitality L.L.C. “The concept is honest with who we are, New York Italians,” said Mautone, who had a large part in creating the new artisanal-themed Italian menu. “That’s a clear distinction.” The new brand, he said, aims to clearly define the difference between Italians in New York and other ItalianAmerican enclaves such as Chicago or Boston. Patrizio D’Andrea, a native of Florence, Italy, is head chef and Tony Diaz, who started working at the Pizza & Brew 30 years ago, remains as pizza chef. The new owners are watching to see how customers react to the change. Racanelli’s New York Italian is a “prototype,” said Mautone. The partners plan to launch another restaurant in the tristate area within the next year and eventually expand as a national chain into southern and western states. “We studied the market and no one is expanding that Italian-based concept,” John Racanelli said. He said they want their new restaurant group to reach a level “somewhere between Mario Batali and Olive Garden.” WCBJ • February 4, 2013
