he Westchester County Association will merge with the Hudson Valley Economic Development Corp., the leaders of the two business advocacy groups told the Business Journal in an interview Jan. 28. The Westchester County Association has represented businesses in the county since 1950, while the
8-15-18 Poughkeepsie-based HVEDC focuses its programs in Rockland, Putnam, Orange, Ulster, Dutchess and Sullivan counties with some programming in Westchester as well. In merging the two organizations, longtime Westchester County Association leader William Mooney Jr. said it was time for the group to think regionally. “Not only here, but throughout the country, everything is much more on a regionalized basis,”

Prolific litigant sues Consumer Reports on behalf of the deaf BY BILL HELTZEL bheltzel@westfairinc.com
A
deaf man who has sued more than a hundred companies under the Americans with Disabilities Act has made Consumer Reports Inc. his latest target. Phillip Sullivan Jr. of New York City filed a class-action complaint against the Yonkers-based publisher on Jan. 15 in federal court in White Plains. He claims that Consumer Reports’ failure to use closed captioning with videos “excludes the deaf and hard of hearing from the full and equal participation in the growing internet economy that is increasingly a fundamental part of the common marketplace and daily living.” Consumer Reports did not respond to an email message asking for a response. The federal lawsuit is the 107th that Sullivan has filed in the Southern District of New York since April 2017. Many of the defendants are media companies such as CNN, Fox News, National Public Radio, Newsweek and The New York Times. Nonmedia defendants include organizations such as the National Rifle Association, Starbucks and Varidesk. He is represented by Lee Litigation Group of Manhattan, “one of the most active filers of class-ac-
tion lawsuits in the country,” according to Legal Newsline, an advocate of tort reform that is affiliated with the U.S. Chamber of Commerce. Defendants routinely settle the lawsuits quickly, Newsline said in a 2017 story, even before courts have certified cases as class actions. Sullivan tried to watch “Your Safer-Surgery Survival Guide” video on Consumer Reports’ website in December, the complaint states, but was unable to do so on his own because it has no closed captioning. Closed captioning consists of a transcription or translation of the audio portion of a video, without which, the complaint states, deaf and hard-of-hearing people cannot comprehend the videos. The lack of closed captioning is a barrier, the lawsuit argues, “just as buildings without ramps bar people who use wheelchairs.” About 36 million people are deaf or hard of hearing in the U.S., according to the lawsuit. Sullivan is suing under the federal Americans with Disabilities Act of 1990, which requires full access to public accommodations, and under state human rights and civil rights laws. He is demanding that Consumer Reports makes its website fully compliant with the laws. He is claiming that the class action damages amount to at least $5 million.
Hudson Valley job growth trails state, national levels BY BILL HELTZEL bheltzel@westfairinc.com

he Lower Hudson Valley added 3,300 nonfarm jobs in 2018, according to state Department of Labor estimates, but trailed state and national job growth. Employment in Westchester, Rockland and Orange counties grew by 0.5 percent last year, compared to 1.3 percent statewide and 1.8 percent nationally. The three-county region’s unemployment rate dropped to 3.3 percent in December, from 4.4 percent the year before. State and national unemployment at the end of 2018 were at 3.8 percent and 3.7 percent, respectively. The region’s civilian labor force grew to 825,800, an addition of 19,800 jobs, and there were 7,800 fewer unemployed people. Differences between the nonfarm employment and civilian labor force statistics are due to different methodologies. Nonfarm employment estimates are based on a survey of 18,000 New York employers. Unemployment rates are calculated with a U.S. Bureau of Labor Statistics model and based partly on a survey of 3,100 households. Using the nonfarm employment estimates, the region’s private sector
grew by 2,000 jobs, or 0.3 percent, while the smaller government sector grew by 1,300 jobs, or 1.2 percent. The largest private sector gains were in education and health services, up by 4,100 jobs, and professional and business services, up by 1,600. The greatest private sector losses were in trade, transportation and utilities, down by 3,000. The biggest gain in the region’s government sector was local government, up by 1,200 jobs. The federal government registered no change and state government added 100 jobs. The region’s best local unemployment rates were in Port Chester and Rye, at 2.7 percent, followed by Mamaroneck, Monroe, Ramapo and Spring Valley at 2.8 percent. The highest local unemployment was in Mount Vernon, at 4.5 percent, followed by Haverstraw at 4.4 percent.
MGM completes transactions for Empire City Casino purchase BY EDITORIAL STAFF

day after receiving the go-ahead from the New York State Gaming Commission, MGM Resorts International and MGM Growth Properties LLC announced that they have completed the transactions for the acquisition of Empire City Casino in Yonkers Following MGM Resorts’ acquisition of Empire City for approximately $850 million, MGM Growth Properties acquired the developed real property from MGM Resorts for approximately $625 million and leased it back to a subsidiary of MGM Resorts that will operate the property, according to a

statement by the companies. “What’s incredibly exciting is the amount of opportunity MGM Resorts will bring to the employees at Empire City, as well as Westchester County, the city of Yonkers and the state of New York,” said President and CEO of Empire City Casino Timothy J. Rooney, whose family has owned the track since 1972. “What’s more, the potential for growth at Empire City has absolutely no boundaries. MGM will truly provide Empire City employees and the property’s guests with the resources and opportunities to make the casino and track into something we haven’t even yet realized. I cannot wait to see what’s to come.”

MGM Resorts has also agreed to pay an additional $50 million if Empire City is awarded a license for live table games on or prior to Dec. 31, 2022, and MGM Resorts accepts such license by Dec. 31, 2024. In addition, MGM Resorts has agreed to give MGM Growth Properties a right of first offer with respect to certain undeveloped land adjacent to the property to the extent MGM Resorts develops additional gaming offerings and chooses to sell or transfer the property in the future. Empire City Casino currently has 5,200 video-lottery terminals and no table games.

White Plains Hospital planning $15.4M pediatric center The hospital also completed a $60 million project to expand its Center for Cancer Care to 70,000 square feet in 2016. In 2017, White Plains Hospital officials opened a $17.5 million renovation of hospital clinical space. The hospital’s parent organization, Montefiore, is also expanding its pediatric services in Westchester County. Across Interstate 287 in Harrison, the medical network has teamed with Simone Development Cos. on a project that would convert an empty office building into a four-level pediatric ambulatory care facility.

onstruction projects from White Plains Hospital continue, this time with new plans filed for a $15.4 million pediatric center within its main hospital building. Under the proposal, the hospital would shift around and renovate space on the second floor to create a 14,000-square-foot center that combines its pediatric services into a single unit. In a certificate-of-need filing with the New York State Department of Health, the hospital said the pediatric center would feature eight pediatric emergency department bays, 12 pediatric beds and a dedicated X-ray room. White Plains Hospital treats pediatric patients in multiple locations, including its emergency department, the hospital wrote in its state filing. While the pediatric center would start with 12 beds, the hospital said it could expand to 15 beds, if needed. Before then, the hospital would utilize three additional pediatric inpatient beds on the fifth floor, to be used by patients between the ages of 19 and 21. “We treat thousands of pediatric patients in our emergency department and inpatient unit every year. This project will co-locate these services into one dedicated pediatric unit that will provide a specialized and seamless experience for the unique needs of children,” White Plains Hospital told Crain’s New York Business in a statement. The new pediatric center would be built in space occupied by parts of the hospital’s emergency department as well as space occupied by both cardiology and ultrasound units. The hospital told the state that it would still have sufficient emergency department space while cardiology and ultrasound services could be performed at bedside locations or in other diagnostic areas. Should the hospital determine it needs additional emergency department space, hospital officials told the state they would seek approval for additional emergency bays on the first floor. The hospital told the state that the work would be funded through existing cash equity and be completed in phases over approximately 14 months. The application comes as White Plains Hospital is planning to embark on a $282 million expansion in the form of a new 9-story outpatient center on the corner of Longview and Maple avenues. That project would feature five stories of diagnostic and testing services space and four floors reserved as offices for doctors affiliated with White Plains Hospital and the affiliated Montefiore Health System. At 79 E. Post Road, the hospital is renovating a medical office building to relocate some of its professional offices from its main hospital, including its family health center and outpatient behavioral health programs.

he January uptick on Wall Street is giving way to a reminder of last year’s decline as investors have received their fourth-quarter retirement and investment account statements. But experts warn against an overreaction by people shocked and dismayed by the magnitude of their personal losses in the market. “Don’t panic, and for most people, stay put,” advised Pete Gioia, an economist who has served as economic adviser to the Connecticut Business and Industry Association (CBIA) in Hartford. “We know that consumer spending and consumer confidence in the [holiday] shopping season was great.” He cautioned that investors should expect market volatility. “There is concern that the Chinese tariffs will continue and lead to a perpetual trade war,” Gioia said. “I think that is overblown.”
Manufacturing activity in China has reached a twoyear low. “There is a lot of pressure on the Chinese leadership,” he said. “The Chinese need to find a way to do what Trump wants and save face. They don’t want to antagonize their biggest trading partner.” Last year was the first time since 1978 that the Dow Jones Industrial Average fell after gaining during the first three quarters. It was the second time in the Nasdaq’s history it failed to defend January-toSeptember increases. The S&P 500 and Dow lost 6.2 percent and 5.6 percent, respectively, in 2018. They posted their largest yearly declines since 2008, when they plummeted 38.5 percent and 33.8 percent, respectively. The Nasdaq shed 3.9 percent. The S&P 500 and Dow declined for the first time in three years as the Nasdaq ended a six-year winning streak. The Russell 2000 fell 12 percent. And for investors who didn’t live through Black
Monday, the recent turmoil should be viewed through the perspective of history. On Oct. 19, 1987, the Dow crashed as it lost 508 points, reaching 1,738.74. The decline was 22.61 percent. “If you are withdrawing money from your 401(k) you won’t be happy,” Gioia said. “People will say this is a buying opportunity as stocks are cheaper now.” A Westchester-based financial adviser is telling clients that if they have at least a five-year time horizon the prudent thing is to make sure the investments they own are suitable based on an investor’s age and time frame to retirement. The adviser, who predicts a flat market for 2019, said that since people are living longer they will need to own equities to outpace inflation, and made the point that for those who sold stocks between the end of 2008 and the start of 2009 they lost a significant amount of money. “Betting on the end of the world is a really bad bet,” the adviser said.
Volatility returns to the market; opportunities exist BY LISA SANTO

t’s back. Recent histor y suggests that we have returned to a period of stock market volatility. But that means it is critical not to allow emotion to dictate investment decisions. Investors can make money in an uncertain market. Depending on individual goals and expectations, some investors can adjust to the volatility by just holding firm and not panicking over short-term losses. Others may find reduced prices in solid securities, resulting in strong buying opportunities. Why have the markets been so volatile? There are a range of explanations over the returned volatility. Regardless, market volatility is becoming a norm. But perhaps the most

telling indicator is the fact that each time there is a major sell-off, it has been offset by a strong rebound. I believe this most likely has to do with the overall state of the economy, which is solid and growing better than it has in decades. So, what is an investor’s best course of action? One critical step, perhaps the most important one, is consideration of goals of the individual investor. Are you saving for retirement? For a second home? Children’s education? Are you nearing retirement or do you have some time? Goals-based investing is the key. If you have set financial goals stick to your objectives, but be mindful of potential changes in the performance of individual equities in your portfolio. If you are just starting out, make a plan for yourself.

Think about what you want to achieve and then stick with it. Typically, with any equity, if the balance sheets and earnings reports are solid and the firm in question is moving forward even in the most volatile of periods, it is reasonable to expect that it will emerge on solid footing in more predictable times. Of course, no one has a crystal ball and past performance in both increasing and decreasing markets is not a reliable predictor of future results. However, particularly during volatile times, you may even have the opportunity to scoop up more shares of your favorite company at lower prices, with some degree of comfort that profits seem reasonable down the road. Research remains important. What are analysts say-
ing about the company you follow? Do institutions own stock in your favorite company? Have insiders been buying or selling? What’s the dividend history? With the proper research done in advance, it becomes far easier to make decisions to take advantage of significant changes in the price of equities in your portfolio. We must be aware that high volatility makes everything happen far more quickly than in more stable times and we must adjust our awareness and potential for action accordingly. High volatility certainly can provide the opportunity for increased profits, but it also carries with it much higher risk. While some analysts suggest that the market may have additional declines in the future, at the same time they are
suggesting that utilities and consumer staples may be worthy of consideration. For those with a longer-term horizon, perhaps those saving for a youngster’s college education or couples with quite a number of years before retirement, these dips may well offer buying opportunities. Nevertheless, investors shouldn’t confuse increased risk with unnecessary risk. As long as we understand the level of risk we are dealing with and are prepared to deal with it accordingly, volatility can work for us rather than against us. We all just need to keep our goals in mind, whatever they may be and however they may change over the years. I’M TIRED OF WASTING ENERGY TRYING TO PULL EVERYONE TOGETHER. NEED SOME FRESH IDEAS ON HOW BEST TO UNIFY THE GROUP TO GET THE MOST OUT OF THEM AND HOW TO INCREASE THEIR SENSE OF SATISFACTION BY DOING THAT. THOUGHTS OF THE DAY: Strong, capable leaders are essential for any privately held company that’s committed to growing. Unify the team with goals. Organize functions to eliminate duplication and conflict. Hold regular planning meetings to gather input. Slow down enough to give people time to get on board. Use incentives to get the point across that collaboration is essential. As the business grows you as the business owner can’t do it all. You need people around you who are willing to make decisions, take actions and be accountable. You also need to bring all of those strong players together and get them on the same page. Do that by providing them with overall direction on where you want things to go but let them work through the details. Gather input from everyone on the management team as to what the company’s overall goals should be. Focus on growth of revenue, expansion of client opportunities, increasing awareness of the company’s products and services, providing clients with a great price-to-value quality proposition and ensuring that the company’s employees are well cared for and rewarded for outstanding performance. Ask your managers to define more specifically what each of those goals means to your company. Allow some debate, then decide on the goals, put them in writing and ask the team to get to work on how best to implement those goals. Divide up jobs so that your managers aren’t stepping on each other’s toes. You can organize by function — for example, sales and

operations. You can organize geographically if you’re in more than one location. Keep in mind that going with the geographic option may result in less uniformity in terms of policies companywide as different managers choose different routes to take to get to the end goals. Bring your managers together regularly to plan and share information. Ask for updates on what’s working, what’s not working and what’s coming up next. Think of yourself as the orchestra director, getting the various parts of the orchestra to play together by speeding people up, slowing people down and asking people to speak up or tone it down. Instead of making spurof-the-moment decisions, take the time to discuss next steps, debate best methods and allow managers to adjust to new suggestions. Getting multiple points of view usually adds to the quality of decisions being made, but
runs counter to the entrepreneurial mind-set of getting stuff done quickly. It’s an adjustment that every business owner benefits from making. Make sure that team members are held accountable for showing appreciation for each other, respecting that differences are valuable and for allowing each other to contribute. Unify your team by laying out a bonus plan that rewards everyone for achieving the overall goals. Eliminate geographic or vertical conflict that comes because individual managers get rewarded for individual performance without regard for how the company is doing as a whole. Set up a bonus pool. Businesses use succession planning to ensure that the key roles within the company remain filled throughout the life cycle of the organization. The goal of succession planning is to recruit, retain and develop the skills and knowledge of high quality employees in order to prepare for advancement into higher roles within the organization. Strong succession plans require active, ongoing planning to ensure that there are quality employees available to fill each level as the successors progress up through the chain of commands. Succession planning can be a labyrinth with constant challenges along the path such as turnover, changes in the economy, advancement in technology, etc. As difficult as it has always been to create a fruitful and well-fitted succession plan for a family business, there is a new challenge facing family businesses – millennial successors. Millennials, also known as Generation Y, were born somewhere between the early 1980s and the middle to late 1990s. Studies have found that when it comes to work, millennials will put their personal values and the need to be their authentic selves above such things as independence or prestige. Every generation has its own approach to life, family and work. To ignore the extensive differences between millennial successors and baby boomers currently in charge would be a detriment to everyone involved with trying to plan for future growth and the continuity of the organization. FAMILY BUSINESS SUCCESSION PLANNING Succession statistics show that only a few percent of all family businesses make it through more than one generational shift. To help increase the odds of keeping the family business in the family, special consideration when drafting the operating agreement should be made. A basic operating agreement will include the rights and responsibilities of members and officers, ownership percentages, details on how to distribute profits and losses and how to change owners. Additional items a family business may want to consider addressing in their operating agreement include the roles in which family and non-family members will be a part of decision-making processes of the company and an outline for how management and family members will be expected to communicate with each other. While some may object to putting parameters around things like how to deal with family conflicts in a written agreement, addressing these potential issues can help keep the business running smoothly should a conflict arise. In addition to a family business oriented operating agreement, the family should discuss openly and plan for areas that tend to result in the most concern for those putting their eggs all in the family basket. Sound financial planning will require not only the current needs of owners (such as cash flow and tax minimization strategies) but also future needs (including how different techniques to transfer ownership can help with both estate planning and minimize business interruptions). Company policies around compensation, working capital
BRIDGING THE GENERATION GAP Considerations specific to a family business when planning for succession become even more complex when the family business successors are from a different generation. As beliefs, values and goals evolve, generational differences can become a major factor as to why family businesses do not survive. Knowing that all individuals and family dynamics are different there are things that business owners can do to help bridge the gaps to help for a smoother transition to the next generation of owners. • Be transparent about succession plans. Millennials are the first generation completely immersed in technology from birth and social media is the way of life. With information immediately available at the touch of a fingertip waiting to see how the future of the company, (and their careers), are going to evolve will not be acceptable. Ongoing dialogues can keep successors engaged and excited about how they can influence what happens next. • Do not mistake a desire for flexibility for a poor work ethic. Reaching the conclusion that a potential successor is not fit for duty because they strategize how to get work done differently should be re-evaluated. Technology has allowed personal lives to intersect with work like never before. Families no longer own weeknights and weekends as technology allows us to get work done whenever and wherever needed. Answering client emails during a child’s sporting event is as common as texting a loved one from the office. The blurring of lines between work and leisure time demands more flexibility and studies have found that by providing flexibility, a characteristic held sacred by the millennial generation, the workplace will be more productive. • Focus on training and mentoring. Economic uncertainty is a common feeling for many millennials. Because of the high amount of educational debts coupled with the lack of opportunities available upon graduation, millennials are more likely to invest in themselves rather than show a loyalty to any one organization. A focus on training and a solid mentor program will help millennials feel as though they are investing in themselves while learning the ins and outs of the family business. While it may be wise to let family members learn from their own mistakes, a good balance is required to ensure that the family business employees, who may have worked in the organization since their successor boss was a child, accept future millennial bosses. A training program will boost the capability of the successor and the confidence of the employees with respect to transitions within the organization. • Create variation and be open to innovation. In both work and life, self-expression for millennials is a high priority. Put the entrepreneurial drive of millennial successors to good use by finding the right way for them to diversify the business and utilize their ideas to help think outside the current core business. For many millennials, finding a way to make a positive impact in a very connected world is imperative. Finding shared interests, whether it be a social purpose their family can support or how their family can build an environmentally responsible business model, can help sustain the family business whilst focusing beyond the business itself. Generation gaps are challenging. With a better understanding, core differences can be transformed into opportunities if both sides are willing to take advantage of the changes that are sure to come along with each new generation.

known statewide, capable of strengthening the HVEDC’s regional efforts. “Economic development has to be looked at as regional,” Oates said. “You have your programming and your initiatives from your own county — and we’ll work within those parameters — but you also have to look at the bigger picture. If a big company lands in Westchester County, employees can come from Rockland, Putnam and Dutchess, and vice versa.” The new organization will be led by Mooney as CEO and Oates as president until Sept. 1, at which point Oates will also assume the role of CEO. Mooney announced in 2018 his intention to retire from his leadership role at

firm and The Journal News. In 2017, the Manhattan-based Hospital for Special Surgery opened its first Westchester County outpatient center in a 50,000-square-foot building on the campus. Weisz told the council that the presence of an active office complex on the same property will make the apartments more efficient and productive. “The work-live concept is going to be brought to life in White Plains and this will be one of the first in the region,” Weisz said. “I think it will be a great experience because we can already see the benefits of having residential on the site: sharing some of the uses, sharing the parking, sharing the amenities.” The proposal comes to White Plains as Weisz is also pursuing a plan to build 150 apartments near his other marquee address in Westchester County: the 523,000-square-foot postmodern 800 Westchester Ave. building. Both plans could be interpreted as a longtime office landlord adapting once more to a changing market. Before 1133 Westchester was bought by RPW Group in 2006 for $76 million it was utilized solely by IBM. And before the company’s $40 million purchase of 800 Westchester the building was solely occupied

the WCA, which he has held for 12 years. But he said his impending retirement was not a factor in the decision to merge with the HVEDC. The Westchester County Association’s current chairman, William P. Harrington, a partner at the law firm Bleakley Platt, will be chairman of the new organization. The HVEDC’s board chair — Robert J. Levine, a founding member of the law firm Corrigan, Baker and Levine LLC — will assume the role of first vice chair of the new organization’s board. The HVEDC and the Westchester County Association announced in October that the two organizations had formed a strategic partnership, one where Mooney joined the board of the HVEDC and
by General Foods and, later, Altria Group. RPW Group added amenities and modernized each building, converting both to multitenant centers. Since then the company has spent more than a decade among the most prominent office landlords on Westchester County’s most prominent office corridor: I-287 in Harrison and White Plains, often referred to as the Platinum Mile. But that same office corridor is changing. Across I-287 in Harrison, a Wegmans grocery store will soon rise in place of three demolished office buildings. A 421-unit apartment building from Toll Brothers is already under construction where two other office buildings once stood. A separate developer has asked the town of Harrison for permission to tear down an additional office building to build 450 more apartments. Those projects targeted outdated buildings no longer viable for tenants. For its apartment proposals, RPW Group is instead targeting open space around its strong-performing office buildings. The Harrison apartments would rise on an empty lot off Webb Avenue that RPW bought along with 800 Westchester. The 1133 Westchester apartments would be built on a 20-acre part of the approximately 70-acre campus that includes

Oates joined the WCA board. Conversations about potential programs between the two organizations eventually turned to discussion of a possible merger. That conversation “took about two minutes,” Mooney said. The answer was yes. But the organizations have spent the past several months settling the details of the merger, a process Mooney said is ongoing. A name change is likely on its way. “I think what people are interested in, more than the name, is what we do and how we perform,” Mooney said, but he allowed that a new name announcement could come in the next few weeks. The two leaders said the joint organization will have more power to advocate for legislation and to build pro-
grams that help the business climate of the region. Both organizations have focused advocacy efforts in the local health care industry, including branding the region as a hub for innovation in the biotech and life sciences sectors. In the real estate sector, both organizations have pushed for policies that encourage so-called smart growth — focusing development opportunities in dense centers near transit, unlocking potential economic and ecological benefits. Each organization also runs workforce development efforts, which can now draw on a regional team of professionals and educational partners, Mooney and Oates said. In 2017, the Westchester County Association launched
Gigabit Westchester, a private-public partnership to bring high-speed broadband to White Plains, New Rochelle, Yonkers and Mount Vernon. Mooney said that effort will continue under the new organization. “We have to look at the digital challenges and broadband challenges as an important part of an infrastructure project as water is, as power is and that roads are,” Oates added. “We have to make sure that the Hudson Valley is prepared for the future and that includes a strong and smart broadband policy.” The Westchester County Association is a frequent host for educational and networking events for Westchester’s business community, including an annual winter breakfast and a real estate summit
each spring. Mooney said those events will continue, though there will be a challenge to shift their focus to the region. The HVEDC is a major host of events, including annual regional summits on real estate and health care. “We think this model and this new organization will attract additional investors and additional businesses who might not have been involved in the past,” Oates said. “They might want to … have a seat at the table and help drive the growth of the Hudson Valley for years to come.” Mooney said, “I feel very comfortable about passing the baton. On the other side of the coin you are always sad when you’re moving on from something. But this is one of the most exciting opportunities in my entire lifetime.”
units, 10 percent would be marketed at designated affordable rates as required by the city’s zoning code. The power supply would be offset by solar panels on the roof of each building, Gertman said. The project would take some of the existing parking on the site, which Weisz said is rarely used. There would be 523 parking spaces, about half of which are already on the site as extra office parking. The new spaces would bring the total parking spots — for both office and residen-
tial uses — to 2,512. Weisz said his company and NRP plan to add trees and other features to make the parking area “friendly and green.” The Cleveland-based NRP Group is among the top-20 largest owners of multifamily properties in the country, according to a list kept by Multi-Housing News. The company opened a Manhattan office last year focused on tri-state development, led by Gertman. In 2017, NRP pursued a 120-unit apartment building proposal in Mount Vernon before pulling out after Gertman said the city preferred a hotel for the site and derailed the project. This isn’t the first time Weisz has targeted this part of the property for redevelopment. The city approved a hotel development at 1133 Westchester Ave. about a decade ago, which was never built. Weisz told the common council that his company is more comfortable finding a partner for the apartments rather than building the hotel. “We think this is, in plain terms, a no-brainer,” Weisz said. “They can walk 100 yards to the office, you can drop off your baby at our day care center and then you can eat lunch in the cafeteria and exercise in the fitness center.” The White Plains and Harrison projects will require approvals from the municipalities before moving forward.

underutilized parking spaces and undeveloped space. “There are not too many 70-acre sites that can accommodate something like this,” he told the Business Journal. “We think the demand is there and all the zoning in Westchester has changed to allow this, so we think this is perfect timing for it.” By building on a portion of the property facing the golf course, Weisz told the council the project will have no visual impact on neighborhoods to the south of the office campus. Jonathan Gertman, a
vice president of development at NRP Group, gave the council a breakdown of the apartment proposal. Branded as The Flats at Westchester, the buildings would include a mix of 178 one-bedroom apartments, 115 two-bedroom and 10 three-bedroom apartments. Amenities for the apartments would include a fitness and business center, pool, dog spa and 12,000 square feet of outdoor recreational space that would connect to a walking path around the site. state appeals court has ruled that the Dobbs Ferry Zoning Board of Appeals acted properly in 2015 when it denied a developer’s application for site plan approval for condominiums. The Second Appellate Division reversed a decision by a Westchester Supreme Court judge who had ruled that the zoning board had exceeded its authority. Seven years ago, Livingston Development Group LLC bought the former Rudy’s Beau Rivage catering hall at 19 Livingston Ave., a 1.3-acre hillside site overlooking the Hudson River. The developer demolished the 160-year-old mansion and submitted a site plan to the Planning Board for two buildings with 12 condominium apartments. The
planning board recommended approval of the plan. The village Board of Trustees granted the site plan with conditions, including approval by the Architectural and Historic Review Board. The architectural board denied approval, according to court papers, because the project would block the skyline. Livingston submitted revised plans. This time, the architectural board saw no problem with the skyline but found that the proposed buildings were excessively similar to one another and excessively dissimilar to the neighborhood. The zoning board upheld the architectural board, finding that the buildings would block views of the Hudson for 150 feet. “This project by its very design significantly blocks open views of the Hudson River,” the zoning board found, “which is perhaps the most significant natural fea-
ture of the village.” The zoning board also found that the project would depreciate the values of two nearby properties. Livingston sued the zoning and architectural boards, arguing that the evidence did not demonstrate excessive dissimilarity to the neighborhood. The developer also argued that the zoning board had usurped the authority of the planning board, that architectural board members had violated the Open Meetings Law by meeting privately to coordinate their denial and that both boards succumbed to public opposition. Supreme Court Justice Barbara G. Zambelli said in a 2016 decision that she was disturbed by evidence that members of the architectural board collaborated to deny Livingston’s site plan before the public meeting. Even so, it was the zoning board’s actions that were being challenged, and there

The space is advertising itself as a place for commercials, event and modeling photography, feature films and special effects shots. Azure Stages was founded by Robert DePalma and Joe Piacentino. In an announcement for the space's opening, Piacentino said that “being in the production industry for many years, we saw a gap in this regional market outside of New York City. The area needed a professional space for video and film production, so we created Azure Stages.”

were no allegations or evidence that its members prejudged the application. But the zoning and architectural boards, she found, did not have a legal basis for annulling the planning board’s approval of the site plan. They had exceeded their authority by considering the views when the planning board, whose powers include compliance with
the village’s vision plan, had already analyzed the views. Appellate court justices William F. Mastro, Jeffrey A. Cohen, Joseph J. Maltese and Linda Christopher reversed Zambelli’s decision. Even assuming that the architectural and zoning boards usurped the power of the planning board by considering the views, they ruled, the zoning board
had also based its decision on the harmful effects of the project on the surrounding area. Livingston was represented by James W. Glatthaar and William P. The Windward School has a contract to buy the building but would first need the city to sign off on its plans to convert the property to a school. John J. Russell, head of school at Windward, said the former March of Dimes location offers an ideal space for the lower school. The school’s current location, on Windward Avenue off West Street in the city, is within a residential neighborhood, he said. It is less than a mile from the former March of Dimes property. “That has proven to be less than ideal because of the fact that the school has traffic
and buses,” Russell said. “We are constrained in our current location, so this opens up much more possibilities. It’s a much larger building and we need more space.” The larger building allows the school to move its fifth-grade students from its Westchester middle school to the lower school. Windward’s plans include a new 11,000-square-foot gymnasium as well as athletic fields but the school would otherwise repurpose the existing building. The school would host 350 students between the five grades as well as a staff of about 110. Parking on the property would be shifted to accommodate the new athletic fields with a total of 180 spaces. mated the project would cost between $20 million and $30 million. Windward needs the city to sign off on special permit and site plan approvals for the renovation and move. Typically approvals for a school proposal would be handled by the city’s Zoning Board of Appeals. The White Plains Common Council, however, voted to exercise its right to claim jurisdiction over any site plan approval process with “substantial public importance.” Windward representatives told the planning board in January that the school hopes to be operating from the building in time for school in the fall of 2020. If approved for the move, Windward would sell its lower school building on Windward Avenue. Russell said the school will not sell the property to another school operator as part of an agreement with the city. Windward offers instruction for students grades first through ninth. The school enrolls about 900 students in Westchester and Manhattan. Founded in New Rochelle in 1926, the goal for the nonprofit school, as Windward describes it, is “to develop in its students the skills and motivation necessary to realize their academic potential and function in mainstream settings.” Windward has operated its lower school on Windward Avenue since 1930, which it expanded in 1994 with a gymnasium and additional classrooms. Windward’s middle school on West Red Oak Lane in Harrison opened in 2002. The school’s Upper East Side Manhattan campus opened in 2016. The March of Dimes said last year that its move from White Plains was part of an organizational transformation. The nonprofit reported five straight years of net losses in tax filings from 2012 through 2016. The organization’s new office is a 28,000-square-foot space in Crystal City, Virginia, not far from where Amazon is locating part of its second headquarters. Arlington County provided a $150,000 economic development incentive grant to March of Dimes, subject to job creation and occupancy targets.

he Yonkers Industrial Development Agency (IDA) has given preliminary approval for three projects that would create nearly 1,000 rental apartments in distressed neighborhoods near downtown. The proposed projects would cost about $391 million and create nearly 1,300 construction jobs, according to the developers’ applications for financial assistance. The Yonkers IDA board approved $13.6 million in sales tax and mortgage tax relief for the developers. They are also asking for property tax abatement for 20 years, but the terms of those tax breaks have not been determined. Ginsburg Development Cos. in Valhalla has proposed two projects near the Ludlow Metro-North train station, which it is billing as gateways to downtown and the waterfront. The $200 million Ludlow Point project would include a promenade overlooking the Hudson River, connecting to a refurbished O’Boyle Park and to downtown. The $14 million 70 Pier Street project includes plans to apply for state grants to renovate Abe Cohen Plaza.
A new entrance to the train station would be built at Ludlow Street and Riverdale Avenue. Ginsburg also envisions artist housing, galleries and an event space at 116 Ludlow St. Ludlow Point would be built at 150 Downing St., where Ginsburg would buy a vacant lot from the city to supplement property it already owns. The project consists of two 10-story and two 11-story towers with 520 apartments and 10,330 square feet of retail space. Plans include a club lounge, fitness center, swimming pool, business center, indoor parking for 529 vehicles and outdoor parking for another 110. Most of the units would be rented at market rates and 52 would be offered at affordable rates. The project would take six years to build, beginning a year from now and finishing by the end of 2025. 70 Pier Street would be built next to Abe Cohen Plaza, south of the train station. Ginsburg acquired the property — a former Yonkers Parking Authority building — at a public auction. The plans call for a 4-story building with 36 apartments, indoor parking for 35 cars, a roof deck and a lounge.
FOCUS ON REAL ESTATE The apartments would be built in 16 months, beginning in April 2020 and finishing by July 2021. Ginsburg estimated that the two projects will create 19 permanent jobs for the buildings and 28 part-time retail jobs. The developer asked for more than $7.7 million in tax relief, according to its applications, including $5 million for sales and use taxes during construction and $2.7 million in mortgage tax exemptions. Ginsburg stated that it needs IDA financial assistance to make the projects economically feasible and attractive to private lenders. Rose Associates of Manhattan has proposed revitalizing a “now derelict and largely inaccessible” industrial area north of downtown. Rose’s $177.3 million project would be built at 57 Alexander St., which consists of five warehouses and a storage shed. The developer has an agreement to buy the property for $23 million by the end of the year from Altman Stage Lighting Co., the

occupant, Altman Holdings LLC and Ron Rob Realty Corp. The stage lighting company plans to relocate its business, according to Rose’s application. The developer proposes connecting the project to the waterfront with a public walkway along the Hudson. Plans call for a 7-story building with 440 apartments and parking for 443 vehicles. The structure would be built in 24 months, beginning in July 2020 and finishing by June 2022. Rose said the project will create 631 construction jobs and 10 permanent full-time jobs after the building opens. Rose asked for nearly $5.9 million in tax relief, including $3.8 million in sales and use taxes during construction and a $2.1 million mortgage tax exemption. The exemptions, plus a 20-year property tax abatement, “will help make the project financially viable,” Rose states on
its application. Ginsburg said it uses a blend of union and nonunion contractors, “subject to competitive bidding and market-rate wages.” Rose said it intends to solicit bids from union and nonunion contractors. Neither developer agreed to be governed by a labor agreement with the Building and Construction Trades Council of Westchester and Putnam Counties, which require contractors to hire union labor or require contractors to pay prevailing wages to nonunion workers. In granting preliminary approval for the projects, the Yonkers IDA board agreed to negotiate tax abatement deals and other terms. Each project must also be presented at a public hearing before being considered for final approvals.

GOOD SOULS DONATE GOOD SOLES Podiatrist Bruce Pinker, who has offices in White Plains and Nanuet, and others who worked on his shoe-donation program, extended the holiday-giving season to Dr. Martin Luther King’s birthday Jan. 21. That was when guests at Lifting Up Westchester’s soup kitchen at Grace Church in White Plains were invited to pick out shoes to take with them. For the past 11 years, Pinker has asked his patients to donate shoes, which still have a lot of life left in them. Enough were collected this time around to provide for the estimated 80 people who went to the soup kitchen and still have plenty to give to a nonprofit in Old Hickory, Tennessee, that distributes new and gently worn shoes to needy individuals around the country. Students at the Pleasantville Lab School at Westchester Community College helped sort through the donated shoes for serviceability. Anahaita Kotval, Lifting Up Westchester’s CEO, said, “From the clients of (Pinker’s practice) Progressive Foot Care to the students at WCC and Grace Church parishioners, this drive exemplifies what is possible when a group of dedicated individuals come together for a greater purpose.”

ArtsWestchester issued 60 grants totaling $105,000 in the Arts Alive program during a Jan. 25 event at its White Plains headquarters. The money will help support arts workshops, free concerts, theater performances, murals, film festivals and other projects and events in Westchester and Rockland. The state funds come through the New York State Council on the Arts. ArtsWestchester decides where the funding goes locally through a competitive process that includes
review by a panel of community members and arts professionals. Janet Langsam, CEO of ArtsWestchester, said, “So many exciting and vibrant cultural programs will come to life thanks to these grants, which will continue to foster community engagement, spur economic development and enrich our overall quality of life.” Arts Alive grants are awarded in three categories: Arts Alive Project Grants
($1,000 to $5,000) to provide county-based organizations and artists with financial and technical support for projects at a grassroots level; Arts Alive Artist Grants ($2,500) to support works that relate to the community in a significant way; and Arts Alive Education Grants ($1,000 to $2,500) to provide support for partnerships between individual artists or cultural organizations and local public schools (grades K-12).
TONY SOPRANO’S UNCLE SINGS AT WARTBURG The actor who played Tony Soprano’s uncle “Junior” in the Emmy-award winning show “The Sopranos” was featured at the inaugural performance of “Music Under the Stars” at Wartburg in Mount Vernon. Dominic Chianese has appeared in numerous films and TV shows in addition to the series, which focused on New Jersey mobsters led by the character Tony Soprano. Chianese is featured in “The Village,” a series currently being filmed, which is scheduled to air on CBS beginning in the spring. Portraying characters who order hijackings, murders and other mayhem is a just a small part of what Chianese has been doing. As an accomplished tenor and musician, he has spent more than 30 years spreading joy through music by performing in nursing homes. He founded the Joy Through Art Foundation, which hires professional artists to provide music to nursing home residents in the New York City area. “I had the pleasure of seeing Dominic in action while he sang to our residents,” said Angela Ciminello, vice president of development and marketing at Wart-

Tarrytown-based ENT and Allergy Associates LLP (ENTA), which has been enhancing its presence in Orange County with the renovation and expansion of its Middletown clinical office, has announced an addition to its team of physicians there. On March 1, board-certified surgeon Louis G. Petcu is slated to join that office following more than 30 years in private practice. David C. Wilkes, founder and owner of the Tarrytown-based Wilkes Law Group, has been elected president of the National Association of Property Tax Attorneys (NAPTA). Wilkes co-founded NAPTA and served in several leadership positions.
