A

redevelopment project conceived seven years ago as a $450 million transformation of 26 acres on New Rochelle’s Echo Bay will reappear for public review this month

much reduced in size and cost and adapted to new economic realities since the recession left it moribund five years ago. The developer, Forest City Residential Inc., an affiliate of Cleveland-based Forest City Enterprises, in February had its draft environmental impact statement (DEIS) for an approximately $90 million project accepted by the New Rochelle City Council. The council will hold a

public hearing on the DEIS at 7:30 p.m. March 12 at council chambers in City Hall. Chosen by city officials in 2006 as the developer to carry out the city’s mixed-use redevelopment plan for Echo Bay, Forest City initially proposed to build 710 residences, including 62 townhouses, 42 condos and 606 luxury rental apartments, in addition to 150,000 square feet of Project, page 6

A sports complex developer and town of Greenburgh officials have asked a state judge to dismiss a lawsuit brought by opponents in the ongoing legal battle over the town’s decision to lease the foreclosed Frank’s Nursery property on Dobbs Ferry Road. Game On 365 L.L.C. and the town have both filed motions in state Supreme Court in White Plains to dismiss a lawsuit brought by Elm Street Sports Group L.L.C. and Simon Cohen, a Greenburgh resident who founded Burst The Bubble, a group opposed to Game On 365’s plans to lease the vacant nursery property and redevelop it as a $6.9 million indoor sports facility, the Westchester Field House.

They contend that Elm Street Sports is trying to drag the town and Game On 365 through unnecessary litigation to delay the project and question Cohen’s role in the lawsuit. The motion focuses on contradictory statements made by an owner of Elm Street Sports. Elm Street Sports said it intends to withdraw its lawsuit, filed last October, since the town no longer plans to lease the property. The conpany’s lawsuit claims that leasing the property to Game On 365 was a violation of county law, which prohibits the leasing of town-owned foreclosed property. Greenburgh Town Attorney Tim Lewis said the town and Game On 365 will go forward with the motion unless Elm Street Sports withdraws its lawsuit with prejudice, meaning it can never file Game On, page 6

Station stop, fine dining

I

t used to be that you just passed through a train station on your way to work, maybe slowing to grab a coffee and newspaper. Today, more and more you can sit down and enjoy a glass of wine and a three-course meal. It’s a growing trend along the tracks of the Metro-North Railroad through the Hudson Valley. The Metropolitan Transportation Authority sees all that empty space in the historic structures as potential rental property. “Restaurants make a good addition,” said Aaron Donovan, a spokesman for the MTA. “They make good use of the space as long as it’s feasible for the infrastructure of the location.” Restaurants also encourage passengers to “linger” and spend time and money in a given location, he said. “We gain financially, which is what we’re seeking in the end.” At the Poughkeepsie train station, which underwent $40 million in renovations, the MTA is looking to entice a restaurateur to set up shop in a 2,500-square-foot section of the cavernous waiting room. The railroad is also offering up 900 square feet outside and another 100 square feet in the enclosed overpass. The MTA is seeking $60,000 in annual rent for the waiting room and overpass sites. In addition to Poughkeepsie, the MTA is seeking tenants at stations in Port Chester, Peekskill, Ossining and Tarrytown. The MTA doesn’t own all of the station sites along its rail lines. Some towns own the property, such as New Castle, which owns the Chappaqua train station. Town Administrator Penelle Paderewski said New Castle had been exploring options to expand the station’s food service to include morning and evening options. Last month, the town received a number of inquiries and two formal bids for the space. The town receives $1,400 a month in rent from current occupant Café Le Track. the north, Carla Gambescia took a chance on Mount Kisco where she opened her Italianinfluenced Via Vanti! Today she is bidding to takeover the Chappaqua stop. Although Gambescia would not disclose any costs associated with her proposal, the Chappaqua resident explained why she’s anxious for the opportunity. “I love train stations for functional practical reasons and for experiential reasons,” she said. “Obviously the location offers tremendous visibility and you have built-in awareness for a good percentage of the community.” She said she understands the value of the location to the community as well. The Chappaqua station has been on the National Register of Historic Places since 1979. Because Mount Kisco station is on the registry as well, Gambescia is familiar with the rules associated with operating in a historic building. As owner of the 2,000-square-foot Via Vanti!, Gambescia said she’s learned how to appeal to a very specific clientele. “What I’ve learned is that you can’t take your commuters for granted. Even though

you have this sense of immediate awareness, commuters are more interested in getting to their car than stopping to smell the garlic.” That’s something Vanessa Kalle is learning about. She is coowner of Station Café & Grille in Hawthorne, which celebrates its first anniversary March 12. Kalle’s partner and brother, Jerry Petraglia Jr., opened the restaurant after two and half years of negotiating with the town of Mount Pleasant, which owns the property. Kalle, who lives in Thornwood, said her brother wanted to branch out and explore the trend of railway eateries. “He also owns a construction company and he’s there full time,” she said. “We determined someone had to be here full time and so I joined in January.” She came with food service experience having owned and operated Scoops, an ice cream shop in West Harrison, for seven years. Still, Kalle thought it was important to do her own research. She looked at restaurants in Grand Central Terminal as well as train stops in the river towns, which she said “seemed to have more of a café feel.” She and her brother came up with a diner setting and began offering a diverse menu, including breakfast sandwiches and omelets, as well as lunch and dinner items like burgers, paninis and chili. Kalle said breakfast

is their most popular meal and brings in roughly 75 percent of their revenue. The family is still trying to figure out what works best. She said dinner, which is the least popular time of day, may be phased out. The 900-square-foot Station Café & Grille has three employees, not including the owners’ father, Jerry Petraglia Sr., who helps out at the restaurant and offers advice to his kids. “It’s a difficult process starting a restaurant,” Petraglia Sr. said. “We tried to do the upscale thing, but it’s not this community. This is more family-oriented. It’s different from places like Scarsdale.” Chappaqua has discriminating tastes, Gambescia said. If her bid is accepted she’s proposing a healthy Italian-influenced menu, including turkey meatballs. “What we’re proposing in Chappaqua is something called fine grazing” something akin to fine dining, Gambescia said. She said she would post the menu online so commuters could pick up their orders when they get off the train. Gambescia hopes this commuter-friendly approach coupled with the success of her Mount Kisco restaurant will appeal to officials in New Castle who will review the bids. As of now, the board is not scheduled to meet about the submitted proposals for a new restaurant. Kalle’s Station Café & Grille hopes to find the success that’s already come to Via Vanti! To help lure even more patrons from the surrounding community, Kalle said they will offer frozen yogurt and ice cream this spring. She said they’re hopeful that the subtle change will help make the restaurant an eating destination. “It’s only been a year so we’re still finding the best ways to serve the community.”

Chase expands program for affluent Westchester customers BY TARICE L.S. GRAY tgray@westfairinc.com

T

he success of the Chase Private Client program is behind a new push to expand its footprint in Westchester County. Since the program launched in 2007, the number of offices has grown. There are 56 offices currently within the county and four more sites are expected to open by the end of the year. “Westchester is a spot where we think it makes sense to present this type of offering to customers,” said Daniel Deegan, national director for Chase Private Client (CPC). “Obviously it’s not unique to Westchester; there are a lot of places throughout the U.S. where we’re located that we will offer Chase Private Client this year and beyond.” CPC offices in Westchester County can be found in Yonkers, Hartsdale, White Plans, Larchmont, Mamaroneck, Harrison, Scarsdale, Hastings, Hartsdale, Dobbs Ferry, Irvington, Chappaqua, Ardsley, Pelham, Yorktown Heights, Bedford, New Rochelle, Croton on Hudson, Tarrytown, Katonah, Bronxville, Somers, Peekskill, Pleasantville and Thornwood. The national program will have 2,000

locations by the end of 2013. In exchange for enrolling in the program, CPC customers, who have roughly $250,000 and $5 million in total wealth, enjoy benefits including waivers on non-Chase ATM fees and no charges on wiring money. Offices have CPC-designated areas to meet inbranch needs as well as expanded options for Internet and telephone banking and investment options, said Deegan. “From an investment standpoint, you get an opportunity to get exposed to some products that historically have only been offered through the Private Banking,” Deegan said. He explained the program is both a banking product and an investment product. Lauren Francis, spokesperson for JPMorgan Chase & Co., said the company understood affluent customers have different needs regarding banking products and services. Also, the wealth management industry is evolving and the company’s research has shown that 70 percent of Chase’s affluent customers want a primary provider to manage their entire financial relationship. Through the expansion of the program, Chase is responding to that specific need. “We really want to make sure we offer

the best thing for all our customers,” Deegan said. “Over time we realized that the set of customers who would benefit from working with Chase Private Client is an important subset of the existing customer base.” Deegan also said one size doesn’t fit all, and the goal is to find the right way to service the varying types of customers that rely on Chase. Chase serves more than 50 million customers, 2.4 million of who are considered affluent, giving customers an opportunity to manage more of their wealth from both investments and deposits.

So far the strategy of expanding the program is working, Francis said, as Chase has transformed the program from a concept to a working model with more than 1,200 locations and $65 billion in assets. The CPC base has grown from 15,000 to more than 100,000 customers since 2007. Francis said Chase hopes to continue to deepen relationships with CPC customers through helping them consolidate balances and becoming their primary investment adviser – all part of an effort to offer a “holistic” approach to banking, she said.

Health care reform a challenge to businesses, panelists say BY SAM BARRON sbarron@westfairinc.com

F

or employers, the Affordable Care Act (ACA) has been a maze of confusing legislation filled with penalties if they don’t adhere to the rules. The Westchester County Association (WCA) hosted “Surviving Health Care Reform: What Every Business Needs to Know Now” Feb. 28 at Abigail Kirsch at Tappan Hill Mansion in Tarrytown. It featured three panelists discussing the ACA, which was signed into law in 2010. The health care industry is Westchester’s largest economic engine, generating $10 billion and 30,000 jobs, more than the public sector. “Health care is a huge element of our society,” WCA President William Mooney said. The ACA is “a complex issue that’s extraordinarily expensive.” The 10,000 pages of legislation are constantly changing. David Rubenzahl, president of Maxon Administrators Inc., a third-party administrator of self-funded health plans and insured disability plans, explained the legislation and laid out the penalties for noncompliance. The legislation applies to employers with more than 50 full-time employees who work

more than 30 hours a week. Businesses owners face either the so-called sledgehammer penalty or tack hammer penalty depending on coverage offered, if at all. The sledgehammer penalty applies if a business does not offer minimal essential coverage to 95 percent of its full-time employees, and at least one of the employees receives a premium tax credit from a state-run health care exchange. A penalty would result, using a complicated formula involving the number of full-time employees multiplied by $2,000. Even offering employees coverage does not leave businesses immune to penalties. The tack hammer penalty applies if an employer offers coverage, but it is not affordable or does not provide minimum value and an employee receives a tax credit from the exchange. The employer is subject to a penalty involving the number of employees using the tax credit multiplied by $3,000. “Employers have to decide whether to pay or play and determine what the penalties are if they don’t offer coverage or offer minimal coverage,” Rubenzahl said. If dollars are the only consideration, Rubenzahl said, go with whatever costs less, but that is rarely the case.

“The employers with which I am familiar rarely purchase the cheapest plan,” Rubenzahl said.“They purchase the best combination of cost and plan design. Consider that health insurance premiums are deductible and you can require contribution. Penalties are not deductible.” James Schutzer, vice president of J.D. Moschitto & Associates, an employee benefits consulting firm, discussed the state-run health care exchanges that were put in place following the implementation of the ACA. Under the ACA, states were required to set up their own exchanges by October 2012 or have the federal government run it for them. The exchange is designed to enhance the marketplace and make it easier to buy health care insurance, Schutzer said. Exchanges must be fully operational by Jan. 1, 2014. New York became one of the first states to comply per an executive order from Gov. Andrew M. Cuomo. States such as Louisiana have refused to implement the exchange, while other states, like New Jersey, waited for the results of the election. “The goal is to get more people insured,” Schutzer said. “But the more people enrolled and using insurance will cause costs to escalate.” Last October, New York formally selected

Oxford EPO as its essential health benefits benchmark plan and has received more than $300 million in federal grants to set up the exchange. The state expects to select its insurers by July 15. “Will exchanges make health care more affordable?” Schutzer asked. “I don’t think we will see a tremendous decrease. Time will tell.” Robert M. Winton, a partner at Citrin Cooperman & Co. L.L.P., discussed the new taxes coming this year as a result of the ACA. The employee portion of Medicare tax will increase by 0.9 percent, currently at 1.45 percent, while there will be additional tax on combined wages/self-employment income in excess of $250,000 for joint filers. Winton also discussed the small business tax credit that was available beginning in 2010 to incentivize businesses to provide health insurance. Businesses are eligible if they have fewer than 25 full-time employees and their salaries average less than $50,000. Currently, the maximum credit is 35 percent of premiums paid and employers must contribute at least 50 percent of the premium cost. In 2014, employers will get two years of credits, but only health insurance purchased via the exchange is eligible. The credit will increase to 50 percent of premiums paid.

Reckson, a division of SL Green Realty Corp., recently signed three office leases totaling 101,082 square feet in Westchester County in a two-tenant deal that brought Xylem Inc. from White Plains to new headquarters at Reckson Executive Park in Rye Brook. The former water technologies division of ITT Corp., Xylem signed a long-term lease for 67,145 square feet of headquarters space at 1 International Drive on the Reckson office campus. The company has occupied temporary space at 1133 Westchester Ave. since its spinoff in 2011 from ITT, which is headquartered in the same White Plains building. Federal regulations require Xylem to separate its headquarters from ITT by Oct. 31. To free up space for the move, Reckson negotiated the relocation of a unit of Verizon Communications Inc. from Rye Brook to a 29,756-square-foot office at 500 Summit Lake Drive in Valhalla, where Verizon already is a tenant. Reckson said

that move raises occupancy at the Valhalla office building to 90 percent. The deal also included Verizon’s extension of an existing 4,181-square-foot lease at 1 International Drive along with an extension on 10,000 square feet of office space at 120 W. 45th St. in Manhattan. “This was a very complicated transaction with many moving parts,” John Barnes, senior vice president and managing director of Reckson, said in a press release. Xylem’s estimated $11.6 million relocation project will keep 106 high-salaried positions in Westchester. The company has pledged to add 15 positions at its new headquarters.

RIVER CRoSSING FoR KEYBANK EXECS

KeyCorp has relocated its KeyBank headquarters for the Hudson Valley/Metro New York district from West Nyack to 660 White Plains Road in Tarrytown. A KeyBank spokeswoman said the bank has leased about 9,000 square feet of space on the second floor of the building in Tarrytown Corporate Center, where it formerly occupied a fifth-floor office of about 3,000 square feet. The company said the move brings 43 KeyBank executives and administrative staff to Westchester County, led by Ruth Mahoney, president of the Hudson Valley/ Metro New York district

The new headquarters will house a state-of-the-art meeting center for district employees. “KeyBank’s recent growth in the Hudson Valley created the need for a centralized location that could house our expanding leadership and administrative team,” Mahoney said in a press release. “Our new space has the visibility, accessibility and convenience that will help us maintain a high profile and highlight Key’s commitment to growth in this region.” KeyBank’s West Nyack executive office at 1 Crosfield Ave. will continue to serve the Rockland County area of the bank’s sprawling district. Most of KeyBank’s 400 employees in the eight-county district work at in the bank’s 52 branches. Mahoney said KeyBank will hold a ribbon cutting and open house April 19 at the new headquarters. KeyBank’s parent company, KeyCorp, is headquartered in Cleveland, Ohio, and has approximately $89 billion in assets.

DEVELoPER PAYS $3.1m FOR YONKERS POWER PLANT

The developer of the former Glenwood power plant in Yonkers has closed on the $3.1 million purchase of the long-vacant property on the Hudson River. Glenwood POH L.L.C., headed by Ron Shemesh, owner and CEO of Excelsior Packaging Group Inc. in Yonkers, acquired

the property at 45 Water Grant from Kenneth I. Capolino, a White Plains building contractor, and Glenplace Equities. The developer secured a $2.2 million mortgage with the sellers. Glenwood POH in December was awarded a $1 million state grant that Empire State Development officials said would be used to stabilize buildings at the 240,000-square-foot, 106-year-old plant for an initial $50 million redevelopment project. Shemesh has proposed to create 256,475 square feet of hotel, restaurant and entertainment space using the existing historic buildings. The total project has been estimated at $175 million.

retail space and two 150-room hotels on an assemblage of city-owned and private parcels. The vacant city armory on East Main Street would be razed and replaced by a 20,000-square-foot community center. The City Council executed a memorandum of understanding for the project with the developer in May 2008. Forest City began preparing its required draft environmental impact statement that year “right before things went sideways,” said Abe Naparstek, the Brooklyn-based vice president in the Forest City Residential Group who directs the New Rochelle development project. The project was dormant until 2010, when Forest City reevaluated its plans in the cooled-down economy and resumed talks with city officials on a scaled-down development. “Previously the project was (spread) over a series of parcels,” Naparstek said. “Now we’re focusing on the center parcel” owned by the city. The revised development would be built on an approximately 9-acre site

the suit again. A court date has been set for March 13. The town has claimed that the lease was legal under state law, which supersedes county law. Last November, town residents by a 66 percent majority approved a referendum to allow the town to lease to Game On 365. Elm Street Sports runs House of Sports in Ardsley, which opened last year. In January, Game On 365 announced it would buy the nursery property from the town for $1.65 million to get around its opponents’ legal challenge. Elm Street Sports, which has offered $3.5 million to acquire the property, said it would sue the town again if the town accepted Game On 365’s proposal. “It doesn’t make sense for them to be negotiating with us while they are suing us,” Lewis said. Donald Scherer, CEO of Elm Street Sports, said he filed the suit simply because the lease was not legal. “Everyone knew it,” he said. “The fact that they decided that they didn’t want to lease the space because they didn’t like litigation is comical. Greenburgh lives off

on East Main Street that includes the city’s public works yard and a portion of the city armory parcel. The city yard would be relocated. The 36,575-squarefoot armory building, whose demolition was opposed by military veterans and other New Rochelle residents, would be preserved for new uses. City officials last year selected a proposal from Good Profit, a nonprofit group formed in 2011 that proposed to convert the armory space into a large urban food market. But the city’s agreement with Good Profit reportedly expired on Feb. 28 when the redeveloper failed to meet a deadline to pay the city a $50,000 fee and sign a letter of agreement for the project. Forest City now proposes to build a four-story mixed-use building with approximately 25,000 square feet of ground-floor retail space along East Main Street and 285 apartments totaling approximately 302,500 square feet of gross floor area. The residential mix would include 71 studio, 137 one-bedroom and 77 two-bedroom apartments. Twenty-nine apartments would be moderately priced for households with incomes not exceeding 80 percent of Westchester County’s median annual income. Forest City expects the project will bring 524

new residents to New Rochelle, including 22 public school students. The developer also would clean up and restore the Echo Bay shoreline at the project site and create an esplanade

His opponents claim that Burst the Bubble, the group Cohen founded to oppose the fieldhouse, is a puppet entity funded by Elm Street Sports. Cohen has denied any affiliation with Scherer’s company.

that’s what happens when you deal with unethical people.” Scherer said that his company has the purchase money ready and has proposed a smaller sports facility than the Westchester Field House to maintain the character of the neighborhood. “We will not need as many building variances or parking spaces,” he said. “There will be less traffic. We have really the only bid they can look at.” But Scherer said the bidding is “a scam” by Greenburgh officials. He said the town appraised the property based on values of comparable properties in Peekskill and Montrose, rather than in Greenburgh, where property values are higher. Scherer claimed the town wanted the assessed value to match Game On 365’s bid. Town Assessor Edye McCarthy said that to assess the property as a recreational facility, the town had to find similar properties, which required looking at properties outside of Greenburgh. She said the same process was used to assess House of Sports. The motion by Game On 365 claims that environmental concerns raised by Cohen and opponents of the property were concocted to taint the public’s opinion of the project. The motion questions why Elm Street Sports would want to buy a site that it

According to the lawsuit, Cohen is living rent-free in a 4,637-square-foot house next to the site owned by Irin Israel, Scherer’s brother-in-law and a principal in Elm Street Sports. Cohen did not respond to requests for comment. Scherer did not dispute the allegation. “It’s dirty and disgusting,” he said. “But

Say no to getting ‘yessed’ to death One of our key employees yeses us to death. She tells us what she thinks we want to hear. I don’t know how to get across to her that we need to know what’s going on – good and bad – so she and we can deal with it.

THOUGHTS OF THE DAY: Make sure you’re emphasizing the right things. Set up a process for identifying and solving problems. Log and prioritize issues. Reward employees who seek to improve. It can be scary to admit that something’s gone wrong or that one is in over her head. It’s natural to avoid risk. How you lead your employees will speak volumes about your company’s ability to make progress on big and little issues – now and in the future. When things go wrong, how do you react? Do you get upset? Or do you put on a game face and embrace opportunities to make the organization better? It takes time to change. People have to be able to step back and look at what’s going on. If they’re already overbooked, an interruption

is a burden that leads to more overtime, less productivity and more blaming when work doesn’t go out on time. Who wants to deal with that? It’s not better to ignore the problem and hope it goes away. Instead, set up an environment where change can happen. Look at workload. If employees don’t have some free time during the day to work on improvements, if they’re always behind, fix it. Look at how work flows through that area. Reorganize tasks and get additional staff. It may seem like it costs more, but until you make time to deal with problems at the root, they just keep costing you time, money and energy. Even with extra time in the day, it’s impossible to deal with everything at once. Set up a log where everyone can record things that need to be worked on. Schedule work sessions to review the log. Assign people to work on items and review outcomes. Report companywide about improvements that are being made. Teach employees to consistently approach problem solving. Step one: identify the problem. Step two: define the problem. Step three: make a list of all possible causes. Step four: decide who else to involve in the problem-solving process. Step five:

brainstorm possible solutions. Step six: try out solutions. Step seven: evaluate results. Step eight: assess outcomes. Step nine: make adjustments. Step 10: write it up for future reference. Teach employees how to look for root causes. Talk about the importance of investigating why something went wrong, rather than fixing the surface. Make sure employees understand that permanently getting rid of problems requires tracing things back to their source of origin. Sound like a lot? So is overlooking things that need fixing. A systematic approach to problem solving will lead to better outcomes and more permanent solutions. And long term, that means less stress, higher productivity and bottom line savings. Make it clear that as problems come up, they are to be solved, not ignored. Make that a core value of the company. Teach employees that they contribute the most when they look to build better outcomes. Look at what happens when employees come forward with issues. Are they promoted or penalized? Are they recognized for being outspoken or shoved to the side as always complaining or challenging the status

Jeremy Winter, a branch manager at TD Bank in Larchmont, was arrested for stealing $739,000 from clients. Winter, a Ridgefield, Conn. resident, allegedly began making large transfers in February 2012 from several bank customers’ accounts into a personal account and into a relative’s account. Westchester County District Attorney Janet DiFiore said Winter was charged with three counts of grand larceny, one count of forgery, one count of falsifying business records and one count of scheme to defraud, all felonies. Winter was employed at TD Bank at 107 Chatsworth Ave. in Larchmont. The district attorney said the money Winter allegedly stole was used to pay off personal loans and contractors he had hired to do home improvements. Winter managed to avoid detection initially because he would “rob Peter to pay Paul,” taking money from a new victim’s account and putting it into an older victim’s account. Bail was set at $100,000 and Winter is scheduled to appear back in court May 14 in Westchester County Court. He faces a maximum sentence of 15 years in state prison.

The Westchester County Board of Legislators unveiled a website that details the capital projects going on in the county. The Capital Projects Dashboard, launched in February, will allow residents and business to track the progress of the more than 330 projects approved by the county, totaling more than $1 billion and creating more than 11,000 jobs. In the Planning/Property Acquisition category, there are 60 projects for a total amount of $109 million and in the Roads, Bridges & Parkways category there are 61 projects totaling $102 million. oNE-StoP SHoP LAUNCHED FOR NY BEER, WINE AND SPIRItS INDUStRY

New York state is launching a one-stop shop to provide wine, beer and spirits producers with a single point of government contact for help with regulations, licensing, state incentives and any other industry-related questions or issues. At the state’s first Wine, Beer and Spirits Summit last October, manufacturers and wholesalers in the beer, wine and spirits industry raised concerns about the number of different state agencies that they must deal with not only to go into business, but to stay in compliance. These businesses, many of which are small and do not retain attorneys on a fulltime basis, often don’t know what agency to deal with for a particular issue and therefore can at times be subject to avoidable fines. The one-stop shop is part of the Empire State Development, New York’s economic agency. The one-stop shop provides staff from agencies involved in regulating manufacturing and licenses to respond to inquiries, host programs and resolve problems. AttoRNEY GENERAL: INtERNEt FRAUD toP ComPLAINt

New York Attorney General Eric T. Schneiderman released a list of the top 10 consumer fraud complaints his office received in 2012. Last year, there were 4,096 Internetrelated complaints, which topped the list. Credit-related complaints reached 3,200 involving debt collection, credit card billing and identity theft. Of all the credit-related complaints, 1,760 of them were filed against debt collectors who illegally threatened and harassed consumers. Rounding out the list of complaints in Region, page 9

NYPA RAtES REDUCED IN WESTCHESTER

The New York Power Authority (NYPA) board of trustees approved a 3.2 percent rate decrease, estimated to total $1.14 million, for NYPA’s 103 Westchester government customers, which include the county, municipalities, schools and housing authorities. The new rate took effect March 1. NYPA also lowered rates for its government customers in New York City. The estimated rate decrease for Westchester government customers reflects projections for lower purchased power energy costs, primarily due to lower natural gas prices and decreased operations and maintenance costs. In 2012, NYPA completed energy efficiency projects in New York City and Westchester for an installed cost of more than $55 million and annual savings of $2.7 million. The upgrades will also reduce annual greenhouse gas emissions by 11,800 tons.

Technology creates new worlds

A

lthough the ancients could feel the wind in their face as they paddled their small boats and later rowed larger vessels, it took millennia to develop the technology of the sail. Even though they witnessed steam coming from water held over fire, the technology to harness that power took many centuries to develop. Each advance created a radically new world. There have been five major technological events in the last 250 years that have totally changed the way we live. Each destroyed old business models and created vast opportunities for those willing to change. What can we learn from the past and what new opportunities await you? Carlota Perez, author of “Technological Revolutions and Financial Capital,” says each major technological event greatly enhanced the quality of life for all by making the delivery of information and products or services faster and cheaper. Perez, a visiting scholar at the London School of Economics and research associate at Cambridge Finance, states that our most recent technological revolution began in 1971 as Intel announced the microprocessor. That birthed the age of information and telecommunications. It has already produced new industries, including microelectronics, computer software and digitized telecommunications. Everything from satellite tracking of packages and trucks to digital products like text messaging and e-books are bringing new ways to capture and communicate information and drive down costs – all because of Intel’s microprocessor. Although new opportunities and industries are born, many others are threatened or perish. The traditional publishing industry and postal service as well as the music and television industries continue to struggle to maintain market share. What Perez calls “the big bang” of the industrial revolution began in 1771, when Arkwright’s mill opened in Cromford, England: “The industrial revolution, by creating much cheaper goods, led to a growth in trade, which fostered rapid development of roads, bridges, ports and canals.” But usage of water wheels to power the new machinery began to diminish in 1829 when “The Rocket” steam engine won the LiverpoolManchester contest. That ignited the age of steam and railways. New companies were born to build railways and utilize steam power by many industries, including textiles. Telegraph lines crossed continents by following railroads and shipping ports were developed to accommodate larger and faster steamships.

When Carnegie opened his Bessemer steel plant in 1875, the age of steel, electricity and heavy engineering began. Cheap steel allowed for the construction and deployment of steel steamships, taller buildings, more efficient and reliable steam engines and stronger rails on which the trains could travel. Commerce increased as canals, bridges and tunnels were built to speed up shipping.

Where will the technology that started with Intel’s microprocessor of 1971 ultimately lead us? Perez says, “It always leads to the massive replacement of one set of technologies by another, either by substitution or through modernization of the existing equipment, processes and ways of operation.” Seize the opportunities that always exist as technology continues to create new and better worlds.

ollaborative law is an alternative to resolving your business disputes in court. Traditional methods of resolving conflict through litigation are not always best. Protracted litigation depletes financial resources, disrupts lives and destroys relationships. This is usually the case when individuals believe that only they are right or that the most important issue is to “win.” This mindset has been changing as more business people are turning to attorneys who are trained in the collaborative law process to assist them in resolving their differences. Rather than battling in court and having a court impose its decision, the business owners resolve their differences together. The motivation for businesspeople to use the collaborative law process is to effectively utilize finances, keep their issues private, preserve business and personal relationships and protect reputations, while allowing both parties to “win.” The collaborative law process encourages parties to resolve their legal, business and personal disputes with less conflict and without court intervention. It allows them to make decisions in a confidential meeting rather than in open court. In the instance of a business partnership, each partner retains a collaboratively trained attorney to advise and provide legal counsel. The partners and their collaboratively trained attorneys work closely with a team, which includes a neutral financial professional with an expertise in taxes and/ or business valuation and a communications facilitator who assists the parties in expressing their concerns and in being heard. The collaborative team will assist the parties in making informed decisions in a safe and confidential environment. A goal of the collaborative law process is to assist disputing parties to resolve their differences and to structure an agreement that represents each party’s interests. Many businesspeople prefer this because it is the parties themselves and not the court or a third party, who are the decision makers.

Benefits of collaboration The benefits of an agreement created by the parties in the Collaborative Law process rather than through litigation include:

• Creating a more durable agreement that addresses the needs and realities of the parties in the context of their business and personal lives; • Allowing for business and personal relationships to be preserved; • Providing the potential to minimize the economic and emotional costs; • Cutting costs by agreeing to neutral experts rather than each party retaining an expert to represent each of their separate interests; • Scheduling that is flexible and takes into consideration participants’ schedules as opposed to court appearances and hearing dates that are dictated by the court’s calendar; • Decreasing the chance of disruption to the business because it encourages ongoing constructive communication so that the business can keep running; • Protects reputations by avoiding negative publicity and maintaining privacy; and • Allowing you to be involved in defining the terms of your agreement and avoiding the uncertainty of having the court decide for you. The dissolution of a business can be as stressful as a divorce and in many cases is quite similar. Most small businesses do not have a written business agreement, leaving their disputes to be settled by state laws. When establishing a business many individuals avoid these discussions, fearing that any disagreements may end up delaying or hindering the formation of the business. If business partners do not specifically outline each of their rights and responsibilities, they will not be equipped to settle conflicts when they arise and misunderstandings may erupt into full-blown disputes.

Making a case for collaboration Take the case of Jerry and Paul. They had been friends for a little over two years, having met each other at various business networking functions and mixers. After a while they, with their spouses and children, began to meet socially. Everyone got along so well that Paul and Jerry decided to join forces and join their businesses. They had heard from others that having a business partnership agreement would be a good idea since they were combining their separate businesses. But Jerry and Paul agreed that they could just sit down and discuss whatever issues might come up at

the time. A business was formed without a partnership agreement. Everything went well for about 10 years until Paul began experiencing marital problems. Paul’s work suffered and Jerry did his best to support his partner. However, things got worse when Paul’s wife asked for a divorce and wanted her marital interest in the business. Jerry tried to sit down to discuss the impact of Paul’s personal life on the business but discussions always ended in arguments. Jerry decided that there were two options. Either they address the potential impact of Paul’s divorce on the business, discuss each partner’s work responsibilities and develop a business partnership agreement to try to keep things together, or they discuss the breakup of the partnership and determine how to divide clients and equipment, how to share the profits or losses and how bank accounts and tax matters will be handled. Jerry and Paul both agreed that they did not want to waste time and money or increase their stress. Nor did they want their customers impacted by their dispute, fearing that they would take their business elsewhere. Paul and Jerry each met with a collaborative attorney to discuss their situation. After those meetings, they each agreed to retain a collaborative team to address their concerns and assist them in moving forward.

Steps to take If you are faced with a business or partnership dispute, the dissolution of your business or are in the formation stages of your business, you and your partner or partners should consider using collaboratively trained professionals. Steps to take include: 1. You and your partner should each meet with a collaboratively trained attorney to see if the collaborative law process is right for you. All parties must then agree to take part in that process. 2. Once collaborative attorneys are selected, there will be an analysis of what other professionals will be part of the process and will join the team. As discussed, the team is generally comprised of a neutral financial expert and communications facilitator in addition to the collaborative attorneys. 3. The business partners will be required to sign a participation agreement that specifies the rights, expectations and obligations of all parties. It includes a provision that your

collaborative attorneys and other collaborative professionals cannot represent you if you or your partner decide to litigate your differences. This provision is key to the process as it allows for open and candid negotiations and avoids threats of going to court. During the collaborative law process you will examine the issues, discuss interests and concerns, look at options and begin negotiations. Discussions may include topics such as relevant areas of law, tax ramifications of proposals, business valuation and personal interests and concerns. When the parties reach a resolution that addresses their interests, a settlement agreement or business partnership agreement is drafted.

Picking your team When selecting collaborative professionals, ensure that all of them have received training in the collaborative law process, as this safeguards that they are of the same mindset during negotiations. Verify that all professionals are agreeable to withdrawing from the case if the case leaves the collaborative law process. Without this provision, negotiations may not be open and candid and there may be an underlying threat of going to court. If any of the professionals are not willing to fully participate in the collaborative law process, you should consider selecting a different professional who is committed to successfully resolving your matter collaboratively. A business dispute does not have to end the business, your ongoing ability to earn a living or your relationships. If you are forming a business, having the proper agreement in place that is negotiated in an open and thoughtful manner can strengthen the success of your business now and in the future. Attorney’s opinion continues Playland process BY SAM BARRON sbarron@westfairinc.com

T

he redevelopment of Rye Playland is in the hands of the Westchester County Board of Legislators. County Attorney Robert Meehan issued a legal opinion on Feb. 22 that said that any material improvements made to Playland must be approved by the legislators. Meehan’s opinion was made in response to requests from legislators Catherine Borgia (D-Ossining) and James Maisano (R-New Rochelle) for an opinion on the legislators’ authority to review and approve a contract for the amusement park. “The ordinary day-to-day maintenance and operation of a building is an

administrative function not subject to specific legislative authorization,” Meehan wrote. “However, significant material changes such as complete demolition of a building or the addition of a new wing or floor would not ordinarily be considered ordinary maintenance and operation.” In October 2012, County Executive Robert P. Astorino selected Sustainable Playland to take over the park, which was losing $3.4 million a year. Astorino was expected to sign a contract next month. Sustainable Playland had pledged to invest more than $34 million in the amusement park and make an upfront payment of $4 million and minimum annual payments of $1.2 million to Westchester County. While Astorino was in the process of finalizing an agreement, Democratic

legislators expressed skepticism about the deal, concerned that taxpayers would still be on the hook for Playland’s debt. On Feb. 13, 2013, the board invited Sustainable Playland along with three other bidders – Central Amusements International, Standard Amusements and Padia Company/Legoland – to the Westchester County Center to present their visions for park. Meehan said that Astorino can exclude the legislators only if the agreement does not allow Sustainable Playland to move rides, alter parking lots, build fields or make any other changes. Ned McCormack, Astorino’s communications director, said that the board of legislators has always been involved with the redevelopment of Playland.

Meehan’s opinion “is consistent with what we’ve always said,” McCormack said. “It’s very consistent with the separation of powers and different roles and responsibilities.” McCormack said the county executive’s office is working through a contract, and will follow a path consistent with Meehan’s opinion. He said they hope to have a contract done this month. Peter Harckham, majority leader for the board of legislators, said he hopes this spurs both sides to work together on the future of Playland. “This is an exciting possibility to reinvent a park,” Harckham said. “You don’t often get that opportunity. I look forward to working with the ninth floor as we go forward. We are doing our due diligence in a public, transparent manner.” Geoff Thompson, a spokesman for Sustainable Playland, said that Sustainable Playland has been working cooperatively on the management agreement. Thompson said he hopes the legislators’ review is completed soon after. “We’ve been very cooperative with the board,” Thompson said. “We’ve established a good working relationship and have participated in the process. Once everyone agrees that Sustainable Playland is the right approach and is viable, then we can come to an agreement.” Once an agreement is signed with the county executive and approved by the county Board of Acquisitions and Contracts, Sustainable Playland hopes to streamline the process with the legislators by getting a master plan approved, rather than constantly going back for approvals. Thompson said he was not surprised by the lengthy review process for Playland. “Playland is a cherished facility in Westchester,” Thompson said. “Many people have strong emotional ties to it. It’s a very important property in Westchester. Public-private partnerships are not the easiest thing to work out, and this is a significant partnership on a high-profile property.” In addition to losing $3.4 million last year, Playland’s revenues have fallen 4.6 percent since 2010 with attendance dropping to half of what it was in 2005. As the process continues, Playland readies for its 85th season. Although the Ice Casino and sections of the boardwalk remain closed due to damage incurred by Hurricane Sandy, opening day for the park is May 11.

Driving the point home

A

ny business, at its core, is a collection of people working to provide goods and services that meet clients’ demands while generating profitable returns. In order to realize and maximize those returns and internal efficiencies, CEOs and other top executives must be actively engaged in the strategic planning process. The previous installment of the CEO Evolution series discussed the need for those top executives to have less of a hand in dayto-day operations and a greater role in the development and implementation of strategies that can drive business growth. In other words, CEOs must start by managing through key business drivers. Key business drivers are indicators that

each have a major impact on the performance of your business, something that is measureable and can be compared to a standard – such as a budget or last year’s figures or an industry average and perhaps most important, something that can be acted upon. There are certain key business drivers that vary from industry to industry, but many apply across the board. They include: Revenues: It’s important to separate revenues by location, employee and/or product, etc. That breakdown of revenues should then be analyzed on a monthly and annual basis, allowing management to see which part or parts of the business are growing, which are contracting, and why.

Gross profit: Likewise, before you can maximize profits, you have to know where the problems and opportunities are. Being able to determine and report profit at the lowest level of activity for your company (by location, employee, product, customer, etc.) will give you that ability. If you can’t, you’re operating with a blindfold. Customer growth: The ability to attract new customers is the lifeblood of a business, and is where everything originates. So who is bringing in these new customers? What is your best product? Which location is consistently adding to the client base? Why do some people and products fail, while others succeed? The flip side is customer attrition.

Customer loyalty is tested in tough economic times, but attracting new customers is more expensive and time consuming than holding onto existing clientele. Finding out why a repeat customer has chosen to take their business elsewhere is critical. Inventory turnover: If your business involves the sale of goods, you know inventory levels represent a double-edged sword. Capital converted to inventory may give you something to sell and purchasing or producing large lots may be more profitable. But, once that conversion is made, your product is at risk to lose value – not to mention the space and personnel required to store and manage inventory. You need to understand your inventory requirements, lead time and volume discounts on a product-by-product basis and track them monthly. Accounts receivable turnover: Cash is king and customers easily become conditioned. If you allow them to pay for products in 60, 90 or 120 days, that is exactly what they will do. They will use your company as a line of credit (interest free)! As you can see, it’s a common theme: Most business drivers need to be identified and reported at the lowest level of activity. Your company’s revenues could be growing rapidly, but if, upon closer inspection, that growth is the result of one or multiple salesmen giving the farm away, your gross profit could take a hit. Having the ability to get a clear determination of the performance of your employees will help you put the appropriate people into the appropriate positions, and will ultimately help motivate them to improve. The caveat? The important word here is “key.” Realistically, management can’t track 15 to 20 key drivers on a weekly or monthly basis; something in the range of five to eight might be more achievable. And as was stated in the first installment of this column, your success will depend on your ability to delegate to the management. If you have someone who heads up an office or division, that person should monitor the key indicators for his or her office and report back to you. Mark L. MAKING WISHES COME TRUE

The Hudson Gateway Association of Realtors (HGAR) recently presented a check for $9,480 to Make-A-Wish Hudson Valley, the nonprofit group that grants the wishes of children who are suffering with life-threatening medical conditions. HGAR raised the funds from a cocktail party held at the Falkirk Estate and Country Club in Central Valley. Since 1986, Make-A-Wish Hudson Valley has granted more than 2,000 wishes to children. The organization is working on 160 wishes with the average cost of a wish ranging from $7,500 to $10,000.

Noble Pies has opened a new location at 38 Main St. in the village of Warwick. The bakery first opened in 2010 at Warwick’s Meadowcrest Shopping Plaza. It all began when Leslie Noble and her husband, Tom Herman, turned their simple pie stand on the side of the road into a retail bakery offering more than 40 kinds of pie and other types of baked goods. The new store, called Noble Pies Café, will feature baked goods that are all made from scratch using local fruits and vegetables and no preservatives. TWO FOR THE SHOW

“Romanticism,” an exhibition of paintings by two German artists, Andrea Hanak and Frank Hutter, curated by Sean Scully opens March 23 at The Riverside Galleries at Garrison Art Center. For the exhibition, Scully has chosen two painters who live and work in Munich and are husband and wife. Hutter was a successful graphic designer early in his career. In 1998, he began his studies in painting at the Academy of Fine Arts in Munich with Scully as his professor and mentor. Hanak also studied at the Academy under the guidance of Günther Förg, and in 2006, she received the Villa Romana Prize, the oldest art prize in Germany. Both Hutter and Hanak exhibit their work widely in Germany and have both shown in New York City. For this show, Romanticism, Scully has selected a deeply rich body of work from each of the artists that calls to


mind German Romanticism of the late 19th and early 20th centuries. eing able to consistently capture the attention of an increasingly sophisticated and discerning online audience is the goal of most digital marketers. While these goals may vary enormously, they almost always involve some aspect of generating attention and driving business toward a website or landing page. One of the most effective methods of generating business is through the use of a content marketing campaign. It allows a company to differentiate itself from its competition and communicate with its target audience by providing insights and highly useful information. Content marketing does not involve hard-core sales strategies. Instead, it relies on great content to attract the attention of its targeted audience and motivate those audience members to take action. Think about the process that makes you first go to a website and then take some action such as signing up for a newsletter. It could originate from a discussion on LinkedIn where one of the participants strongly recommends an article or from a post in Facebook

or any other social media platform. You follow the link to the website and then read the article. If you like the article, you will look more closely at the website. If you like the website and its content and if the website offers a free newsletter or white paper, you’re much more inclined to sign up for it. There are no direct sales involved in this process, only great content. The better the content and the better it is targeted toward its market, the better the results. According to the Content Marketing Institute, B2C marketers emphasize mobile content and apps along with print newsletters and magazines to reach their audience, while B2B marketers utilize case studies, webinars and white papers as their primary content-marketing vehicles. One of the most important aspects of these content-based, customer acquisition and retention campaigns is brand awareness. Branding is becoming an increasingly important part of online marketing. In fact, one of the major goals of almost 50 percent of all webinars relates to some aspect of branding. It is one of the reasons why many top market-

ers frequently present content-based webinars (that almost always include a Call to Action). According to a 2013 CopyPress study, 62.2 percent of content marketers reported that the highest return on investment (ROI) was for featured articles followed by video (51.9 percent) and white papers (45.6 percent). Although video can be difficult and time consuming to create and edit, when done properly, it can dramatically improve results. Given the recent developments in video products and equipment, I believe this ROI percentage will dramatically rise within the next few years. According to a December 2012 study by the Interactive Advertising Bureau, digital ad spending alone is expected to increase from $2.93 billion in 2012 to $8.04 billion by 2016 and a significant portion of this will involve video and images. The most effective content marketing campaigns are the ones that utilize multiple tactics across several social media platforms. In general, and assuming your audience is properly targeted, the more people you can reach, the greater the response. Furthermore,

if one tactic doesn’t work, perhaps another method will elicit a stronger response. Repurposing great content across different platforms is a highly effective strategy that motivates people and drives them toward a website or landing page. This year, 34.8 percent of marketing professionals listed content marketing as the most important marketing strategy surpassing social media, SEO and all other types of online marketing for the first time. By incorporating content marketing into a social media marketing campaign across multiple platforms, most companies will be able to improve their brand recognition and increase sales. ORANGE REGIONAL MEDICAL CENTER (OrMC) recently announced that thanks to the generosity of four organ donors, 13 patients’ lives were saved in 2012. The hospital had four organ donors in 2012 from whom eight kidneys, one pancreas, three livers and two hearts were recovered. The recipients of the organs ranged in age from 17 to 70 years old.

ORMC was recognized by the Donate Life Group, a community-based volunteer group working under the auspices of the New York Organ Donor Network of Orange County, for its outstanding support of its mission. “D

on’t ever lease a car.” Debra Jacoby looks up from her slow-starting computer – it says “Teacher” on the screen – to advise male students before the start of their Sports and Entertainment Marketing class in the computer lab at Ossining High School. One’s in the market for a new ride. It’s the sort of practical, worldly, extracurricular advice she dispenses with a business teacher’s omniscient authority in the course of the school day. When “Miss Jacoby” speaks, kids look up from their omnipresent smartphones and listen. At the high school on the hill in Ossining, Jacoby embodies the business department; she is the business department. The courses she teaches – four subjects in five 41-minute bursts of pedagogical energy per day – are electives. Accounting. Career and Financial Management. Entrepreneurship. This morning the kids in her marketing class will work in teams at writing film scripts. “This school has a tremendous amount of electives,” she says. “It’s really an opportunity” for students to explore potential college majors and career choices. But teaching electives can be risky business, especially in the current state of the state of New York, with its fledgling property tax cap squeezing school budgets. “There’s no state mandate for business (education),” says the teacher who two years ago saw her accounting students take first place in the Business Skills Olympics hosted by the AfricanAmerican Men of Westchester. “Business is one of those that you can just cut.” “Here they would be cutting the whole business program. I’m hoping they see the importance of it. I think they do.” “Miss Jacoby” (in fact she is married and the mother of three boys) knows well the sting of budget cuts. For six years, she was one of 10 teachers in the business department at North Rockland High School across the Hudson. Get laid off, as she did, and you learn the value of self-marketing as a hedge against extended unemployment. You welcome the guy from the Business Journal to your classroom when he calls. You host the county executive, Rob Astorino, when he asks to address your business students. When the state Department of Education and the Business Teachers Association of New York State cite your business program in Ossining as “an outstanding model for other school districts to follow,” you get out the news that sparks the interest of the county executive’s office. “Let’s take a step back,” she tells her class of scriptwriters. “What is the incentive moment?” “The climax?” one student shakily asks. “No, the climax is later.” “Guys, one of the things about your incentive moment: If your incentive moment doesn’t happen, the rest of the movie never happens.” Teacher’s incentive moment? Having moved in her teen years from Brooklyn to Freeport on Long Island, Debra won an accounting scholarship to Long Island University “because of the accounting class I took in high school. Which is why I teach it – because of the teacher I had in that accounting class.” First, though, she spent a decade in the business world as a C.P.A. Her career path took her from internal auditing at a bank to a small accounting firm to a midsize firm and then to Ernst & Young. From there she moved on to exclusive work for a client and consulting. “Teaching was always in the back of my mind,” she says. After

moving back to New York from California, she decided she’d go back to school to study business secondary education “and see if it works out. If it didn’t work out, I’ll still be a C.P.A.” At her previous teaching post, the school’s Academy of Finance started a tax preparer class to train students as volunteers in the Internal Revenue Service income tax assistance program. In her fourth year in Ossining, she contacted her old boss at North Rockland High for guidance on how to start an e-filing program at her school. “Especially in this community, we get a lot of low-income residents who especially could benefit from the tax program,” she says. Her students in this tax-filing season have teamed with IFCA Housing Network in Ossining to provide the volunteer service. All 18 students in her accounting class qualified as advanced preparers in IRS testing. “If someone came in who sold stock” to be reported on a return, “we could do that. If we had someone come in who did an itemized Schedule B, my kids could do that.” “It was slow last night.” Two residents showed up at the school with tax documents to hand their student helpers. After the first two weekly sessions of the new program, her students had electronically filed 10 returns for residents. ••• “Do you have a passport?” It’s a business teacher’s extracurricular query. At the start of her financial management class, a senior named Keith and a friend talk of plans to vacation in Colombia, and never mind the kidnapping risks. “Oh no!” Keith tips back in his chair in shocked dismay. He does not have a passport. In the six weeks’ time it normally takes to get one, his family could have paid a handsome ransom and he’d be safely back in Ossining dealing with a spring case of senioritis. “You can get it express. I think it costs $150,” his teacher counsels. Today’s class lesson for her 22 students: how to calculate percentage changes in the consumer price index, inflation, returns on investment.

A teacher’s passion points kids to business

“Let’s go, motley crew,” she tells the Colombia-bound vacationers. “Let’s get this done.” Keith uses his iPhone calculator and quickly masters the lesson. “I can’t wait to get to college,” he proclaims. “I’m fighting for you,” says Miss Jacoby, who has written a college recommendation for the bright underachiever. “You’ve got to step it up, dude.” ••• “If someone were to steal one $25 cap per day from Modell’s, how many hats would have to be sold to replace the loss?” It’s teacher’s opening question to 12 students in her entrepreneurship class. They will pair off to research types of crimes against businesses and what a business owner can do to detect and prevent them. “You didn’t tell your mom you’re going to Colombia?” Keith takes back-to-back classes with Miss Jacoby. “She’ll be OK with it,” he says casually. “Let’s work on these crimes, not kidnapping,” says his teacher, returning to the day’s lesson plan. “You should have more than one way to prevent this crime. There should be several for each one,” she tells her Internetsearching students. ••• “Some of them, they don’t know in high school what they want to do,” Debra Jacoby says over a bag lunch. “After they take my class, they say, now I know what I want to do. For a lot of kids, it just sparks something.” The teaching spark that drives her classroom sprints can burn out in the course of a school year. “You couldn’t do it if you didn’t have that summer break,” she says. “It’s so all-enveloping.” “This is my passion. This is what I love. If I didn’t teach this, I don’t know that I’d want to teach.” In the Ossining school district, “The budget comes out on Wednesday.
