ore than 150 workers showed up at a Westchester County Board of Legislators meeting March 11 to express support for a bill that would require companies purchasing large commercial or residential buildings to retain the building’s maintenance and security workers for 60 days. Legislators held the public hearing for the Displaced Building Service Workers Protection Act with a line of workers on Martine Avenue in White Plains snaking around the block. The bill applies to residential buildings with more than 75 units and commercial buildings of more than 75,000 square feet and to workers who make less than $25 an hour. They include janitors, groundskeepers, cleaners, superintendents and window cleaners. New building owners would be required to retain all workers for 60 days at a salary of the owner’s discretion, though workers could still be fired for cause or overstaffing during that period. After 60 days, the owners would be free to keep or lay off the workers. “This legislation will help improve standards for workers and ensure stability and continuity of services for our clients who are commercial property owners,” said Jeremy Bressler, vice president of

Despite opposition from state and local business groups, New York state is close to passing an increase in the minimum wage. After a wage hike was overwhelmingly approved in the Democratic-controlled Assembly, lawmakers in the Senate are negotiating an increase to New York’s current minimum wage of $7.25 an hour. The majority coalition composed of Republicans and independent Democrats, including state Sen. Jeffrey Klein, have proposed increasing the minimum wage this year and
gradually increasing it over the next three years, though they have not specified by how much. Republicans are looking for $2 billion in tax breaks for businesses to offset an increase. The bipartisan coalition introduced the bill last week as part of negotiations on the state budget. The Assembly approved a bill to increase the minimum wage to $9 an hour, with automatic increases tied to inflation. while Gov. Andrew M. ecent changes in the book industry— including the bankruptcy of Borders Group Inc.—have impacted local bookstores, but not necessarily in a bad way. That’s the message that the American Booksellers Association (ABA), based in White Plains, wants to get out. Oren Teicher, CEO of the association, said the popular narrative is that independent bookstores are struggling. “The perception is that independent bookstores either got swallowed up by the big guys—like Barnes and Noble and discount stores including Sam’s Club and Wal-Mart—or found they could not compete with Amazon. But like Mark Twain once said, rumors of our death have been grossly exaggerated.” He points to sales figures. The association’s 1,600 members reported an 8 percent jump in book unit sales in 2012 over the previous year. The Village Bookstore at 10 Washington Ave. in Pleasantville is one ABA member that has seen its sales increase. Roy Solomon bought the 40-year-old bookstore with his wife Yvonne van Cort in 2003. He said sales steadily increased until 2011. “That January Borders was in bankruptcy and they started to sell books at deep discounts.” His store began to suffer. Between the bookstore giant’s liquidated merchandise and the growing popularity of eBooks, The Village Bookstore’s sales fell nearly 13 percent. When Borders in Mount Kisco was shuttered in October 2011, he said, some reports said former patrons of the megastore would be forced to use Amazon as their only alternative. But Solomon said he wasn’t willing to wave his white flag. He forged ahead and in time the Pleasantville store, which also sells greeting cards, rebounded with an 8 percent increase in sales. Solomon credits part of the success of

the 1,000-square-foot shop to its proximity to the Jacob Burns Film Center across the street. The center brings in “lots of foot traffic” that contributes to the bustling atmosphere of Pleasantville’s main avenue. Both a resident of Pleasantville and an invested merchant, Solomon understands the importance of embracing the neighborhood. Likewise the community has embraced the bookstore. When Solomon and his wife were considering buying the store, friends and neighbors helped convince them to make it happen. “A friend, a civic-minded guy, said it would be very good if the bookstore could stay alive,” he said. “People were really interested in what happened to the store.” That built-in customer base helped sell Solomon on taking ownership. He said he enjoys talking to the patrons of the shop, many of whom know him and his wife by name.
The same can be said for Eugene Sgarlata, owner of Bronxville’s 75-yearold mainstay Womrath Bookshop. Just as Solomon is known in Pleasantville, Sgarlata is a familiar face in the village. An Armonk resident, Sgarlata bought the store at 76 Pondfield Road 28 years ago. He said in that time he’s witnessed the impact of the book industry’s evolution. His bookstore has suffered from some of the changes. “There is the consciousness of the new customer shopping online,” Sgarlata said. “The e-reader takes another slice out of the pie because it’s cheaper.” He doesn’t discourage the e-industry but he wants people to acknowledge the problem. “When they don’t support the brick and mortar store, what happens to their downtown?” Womrath, is at the center of the village’s most popular retail strip. Sgarlata said it
contributes to the “flavor of things” in Bronxville. The bookstore is one of the more nostalgic shops on Pondfield Road. It’s surrounded by a running store— where a toy store used to be—a camera store and bakery. He said it’s important to him that the bookstore help maintain the downtown charm. So he has made changes to adapt to the new downtown customer. Womrath Bookshop, which occupies roughly 2,000 square feet of retail space, started carrying toys and reading glasses, items that Sgarlata said contributes to the “synergy” of his shop and also appeals to the evolved consumer who may want more than just books. And his sales have stayed consistent. Sgarlata agrees with Teicher that embracing the community is key to having a thriving bookstore business. “I’m not retiring anytime soon,” he said. “But people still say to me, don’t leave, you can’t leave. It’s a good feeling.”

Beechmont Man wings it to White Plains marriage. “It took a little working on it.” In 2010, Leona bought the place where he and his wife began their own intimate history. Last year, he went searching in Westchester County for a venue where he could repeat what he said has been the Beechmont’s simple recipe for success: “cold beer and wings. That’s kind of what we push here. Forever, the big thing at Beechmont was the wings.” The sauce recipe, of course, is secret. “I was looking for a small enough location in a big enough city to do what we do,” said Leone. He found it at a Silverman Realty Group

avern owner John Leone is endowed with the imposing bulk of a bar bouncer or a discus thrower – both of which he was during his undergraduate years at Iona College. “That’s how I got started in the business, as a bouncer on North Avenue,” said the 32-year-old Dobbs Ferry resident, who majored in business management at Iona on North Avenue and competed in track and field for the Gaels as a shot put and discus thrower. “I wanted to get involved in one of my own one day.” “Greeter” is the less intimidating, more customer-friendly title that Leone prefers for his former moonlighting job in New Rochelle and his occasional service at the door of his new establishment in downtown White Plains, Beechmont Tavern. The business at 213 E. Post Road is the second of his that bears the Beechmont name. Its painted mascot is Beechmont Man, a handlebar-mustached barman in sleeve garters and a red pinstriped shirt that bespeak a bygone era when Buffalo wings had not yet become a staple of every American bar with a deep fryer out back. The same Beechmont
Man is the iconic stained-glass image that greets guests inside the door of the original Beechmont Tavern at 750 North Ave. in New Rochelle. A popular student hangout, the brick-faced tavern opened in 1928 under another name, said Leone. Singer-songwriter Don McLean, a graduate of nearby Iona Preparatory School, immortalized it as “the Levee” in his 1971 folk rock ballad “American Pie.” “I became familiar with the Beechmont from going to Iona,” said Leone. “I loved the history of the Beechmont and what it stands for. “My wife and I met at the Beechmont. We were just two students hanging out. It took me a pursuit to get her to consent” to
property in downtown White Plains at the eastern end of the row of restaurants and bars that has sprung up in recent years along Mamaroneck Avenue and East Post Road. Beechmont Tavern opened on the eve of Thanksgiving Day last year after a six-month renovation in space vacated by Korova Milk Bar. The tavern employs five workers, as does the original Beechmont. Will Beechmont Man appear in other Westchester cities? “We always keep our options open,” said Leone. “We definitely look forward to growing the Beechmont name.”

New York job growth offset by rise in unemployment BY SAM BARRON sbarron@westfairinc.com
N
ew York’s Labor Department announced last week that 29,600 jobs had been added in January, the 17th consecutive month with private sector job growth, a record. January saw 166,000 jobs created nationally, meaning one in five jobs created was created in New York. Despite the job growth, New York’s unemployment rate rose from 8.2 percent to 8.4 percent. The number of unemployed New Yorkers increased from 787,100 in December 2012 to 806,200 in January 2013. The Westchester-Putnam-Rockland region saw private sector jobs increase by 2,900, a 0.6 percent increase year-to-year. Year-to-year, professional and business services and educational and health services gained the most jobs in the state, 32,900 and 32,400 respectively, while government shed 11,800 jobs and manufacturing shed 9,500 jobs. Year-to-year in the WestchesterPutnam-Rockland region, professional and business services gained 2,800 jobs to

99,300, an increase of 2.9 percent, while education and health services gained 4,300 jobs to 188,000, an increase of 2.3 percent. In the Westchester-Putnam-Rockland region, government shed 2,300 jobs to 156,400, a decrease of 1.4 percent, while manufacturing lost 800 jobs to 46,600, a decrease of 1.7 percent. Construction lost 1,500 jobs to 37,700, a decrease of 3.8 percent. Information jobs decreased 5.9 percent from 18,800 to 17,700. On a month-to-month basis, the Westchester-Putnam-Rockland region lost 13,600 jobs, which was expected, given seasonal employment around the holidays. Manufacturing shed 500 jobs, while professional and business services shed 2,600 jobs. Education and health services lost 3,300 jobs. The Westchester-Putnam-Rockland region ranked 9th out of 14 counties in private sector job growth. Westchester had an 8 percent unemployment rate, up from 7.1 percent in December and 7.6 percent in January 2012. Westchester’s unemployment rate is tied for 5th in the state. Putnam is at 2nd at 7.3 percent, while Rockland is 3rd at 7.5 percent. Overall, the area has an unemploy-

Tarrytech touts being managed service provider BY SAM BARRON sbarron@westfairinc.com
W
ith more than 50 information technology (IT) companies in Westchester alone, it’s become increasingly difficult for such businesses to establish themselves. Tarrytech Computer Consultants separates itself by being a managed service provider (MSP), marking its 11th year in business. Tarrytech, at 828 S. Broadway in Tarrytown, employs 11 people and provides IT support and network services throughout the tristate area. MSPs provide unlimited service for companies for a flat monthly fee, while other IT companies get paid only when clients need assistance. “There’s not a lot of value in that,” said James Kudla, president of Tarrytech. “They aren’t doing anything preventatively or proactively. The best companies are MSPs.” At Tarrytech, Kudla offers a core set of services and preventative maintenance, along with reactive support and network administration. At the companies he provides support for, he considers himself the “VCIO” – virtual chief information officer. “We help you be smarter with technology and improve efficiency and stability,” Kudla said. “We offer better customer service and a better product than break-fix companies. It’s great for the client; they know the end result.” He said businesses often struggle with the instability of using break-fix companies for IT support, which are paid anytime services are needed – one month shelling out $10,000 and another month maybe only paying $2,000 – versus the flat fee Kudla charges. Kudla said that by using a break-fix company, businesses leave themselves open to viruses and other issues that lead to unproductive employees. Kudla declined to go into specifics about his company’s fees, saying it depends on the size of the client. “A company’s biggest cost is its employees,” Kudla said. “You want employees to be able to get their work done. Morale will be better. With an MSP, you have somebody to help you plan for the future and make smart decisions about technology that allow you to prolong the life of your equipment. You see the benefits of technology rather than a cost.” Tarrytech has been an MSP longer than anyone in Westchester, and Kudla said that his company has perfected it. “I have taken my hardware and software, my process and honed it over the last seven years,” Kudla said. “You can’t decide to just become an MSP and deliver what I perfected.” Kudla’s company also specializes in help-
ing businesses connect with cloud computing. Cloud computing uses hardware and software delivered as a service on a network, usually over the Internet. Cloud computing has picked up steam over the last 18 months as Kudla has been putting a lot of his clients on the cloud. “Rather than writing a bit fat check for new equipment every two to three years, you go to the cloud and pay for it over time,” Kudla said. “Whether you do it today or in three years, some part of your network is going to be on the cloud. We evaluate all new technologies and where it makes sense, we
implement them for our clients.” Kudla said IT companies that aren’t proficient in the cloud or have not adopted a cloud strategy are going to be out of business. To stay proficient in the latest technologies, Kudla is a member of several industry groups and attends eight conferences a year. “If you’ve been doing this long enough, it’s easier to keep up,” he said. “There isn’t as much of a steep learning curve.” While other industries have struggled during the economic downturn, Kudla said that his business is recession proof. “There are always companies that really
need IT services,” Kudla said. “You can’t go without it. Companies realize the value of technology and that we deliver it in a costeffective fashion. Break-fix companies are suffering.” For businesses, Kudla said it doesn’t make sense for them to hire a full-time IT employee. An MSP is cheaper, since it doesn’t require benefits, or take sick or leave time. He said compared with having one IT employee, if there’s a problem, he can have three employees on it, and a company will not have to deal with the impact of employee turnover.

operations for the Connecticut/Westchester region for Guardian Service Industries Inc. “This has helped responsible contractors like us remain competitive. This legislation has not caused disruption to the industry.” Edwin McCormack, communications director for County Executive Robert P. Astorino, said the county executive has a number of concerns about the bill. If Astorino were to veto it, it is unlikely a veto override would have enough votes among the lawmakers. “We are always concerned with bills that have unintended consequences. This could distort the labor market in a way that will hurt employment,” McCormack said. Workers at the meeting spoke about being displaced from jobs when building ownership changed hands. Argenis Lorenzo, an Ossining resident, worked as a cleaner at a research facility in Ossining for five years, only to be fired when a new contractor took over. “We were given only a few days notice,” Lorenzo said. “This caused lots of stress and financial hardship for my family. Without steady employment it was almost impossible

follows President Barack Obama’s call for Congress to increase the federal minimum wage from $7.25 an hour to $9. “The Senate recognizes the need to raise our state’s minimum wage,” said Klein, whose 34th District includes the Bronx and part of Westchester. “By working on a bipartisan basis, we will enact a minimum wage increase that will take effect this year.” The number of New Yorkers making minimum wage is at its highest level in a decade. Amy Paulin, the Scarsdale Democrat, who co-sponsored the bill in the Assembly, said that increasing the minimum wage would have a positive economic impact on the state. “Many people who have full-time jobs at the current minimum wage don’t make nearly enough money to support themselves, let alone a family of three or four people,” Paulin said in a statement. “Other states have been positively impacted by the increase and it has helped economic growth. Why not have those benefits in New York while positively impacting the lives of nearly two million people?” State and local business groups have expressed opposition to a minimum wage increase, fearing it would cause compa-

It really raises a lot of questions.” Annunziata also questioned how the county could enforce the legislation. He said a bill like this would give unions tremendous opportunity to unionize employees during the 60-day period. “The legislature needs to be very careful,” Annunziata said. “There are so many unanswered questions and potential implications for employers. This bill arbitrarily favors labor over management without being mindful of the repercussions. This hasn’t been properly thought out.” After the hearing, the bill went back to the

This has to be done responsibly. The voices of the business community have to be heard.” Westchester County Association (WCA) President William Mooney said he did not think a minimum wage increase would have much of an impact in Westchester, but would impact upstate communities more. “Most businesses already are paying

Cleaning up your credit line Our credit line has an annual requirement to “get out of the line” for 30 days, and that timeframe is nearing. I’m not confident we can clean up the credit line within the 12 months, as our bank requires. What should I do?
Thoughts of the Day: Credit lines are meant to be used periodically, not constantly. Consider a term loan. Plan out your financial needs for the coming year; as the business ramps up, cash flow is likely to dry up. Plan for it. Credit lines are designed to help a business manage through ups and downs and to back-stop cash flow cycles. Appropriate uses of the credit line might include getting over a short-term uptick in account receivables and acquiring inventory or services in advance of billing it out on a new contract. As with all credit instruments, credit lines should be used in anticipation of greater profits downstream. In other words, use the
credit line to boost invoicing opportunity and to manage expenses and cash flow until that money comes in. Using a credit line to manage losses is a bad idea. Borrowing to smooth over losses only leads to more problems later on. Now you owe both principal and interest. Losses mean you don’t have the funds to pay off your obligations. One option for dealing with the cleanup period is to ask the bank to term out the line. This means you won’t have to come up with all of the funds to get out of the credit line right away. Before you ask for help from the bank, take a look at this past year’s performance. Has the business been profitable overall? Is it likely to be profitable in the coming year? If so, ask the bank to work with you. Discuss converting the credit line to a two, three, or four-year term loan. That way you can make regular payments every month while increasing the amount of time you have to pay down the principal. The advantage of a term loan is that you can work your way out of the principal your company owes over time. You will have to go through another application process to get a term loan,

though. Be prepared to present personal and business financials and tax returns. Stop struggling to manage a credit line that is no longer being used for short-term borrowing needs. Instead, show the bank you are proactively managing the company’s financial responsibilities by making arrangements to pay down the principal owed.
Using a credit line to manage losses is a bad idea. Borrowing to smooth over losses only leads to more problems later on. The bank wants you to be predictable and responsible. Be ready to show them your growth plan, forecast of prospects in the cue, as well as your budget and forecast revenue for the upcoming year. Show them how your company plans to pay off the loan by increasing revenue and managing its loan obligations over time. Keep in mind that as any business ramps
up sales, cash flow can dry up. Advance payments for additional staff, inventory, services, equipment, et cetera all tie up funds. Clients are waiting for you to finish work before they will accept and authorize payment on final invoices. Once invoices are authorized, some buyers may stretch out payment for another 30 to 60 days or more. Meanwhile, the bills continue. However, once the work is completed there should be more than enough profits to pay off all obligations and to put aside reserves for the future. Make sure this is the scenario you’re dealing with. Chappaqua Crossing gets zoning extension
The New Castle town board voted March 12 to grant Chappaqua Crossing and other multifamily planned developments unlimited six-month zoning extensions to get site plan approval from the town planning board. Chappaqua Crossing is the only development in New Castle to be currently impacted by the new law. Previously, developments only had a year, followed by two six-month extensions to get site plan approval, after which the zoning permit would lapse. Chappaqua Crossing had exhausted its extensions. Its current extension expires Oct. 11. Summit/Greenfield L.L.C., the developer of the property, earlier this year dropped two lawsuits it had filed against the town in exchange for the creation of a retail zoning district that would allow the developer to put in a supermarket and other retail outlets. Summit/Greenfield, a partnership of Summit Development L.L.C. and Greenfield Partners L.L.C., both real estate services and investment companies based in South Norwalk, Conn., bought the 114-acre property for $59 million from Reader’s Digest Association in December 2004. They had initially proposed building 348 units of age-restricted condominiums and townhouses. The town eventually approved 111 units of condos and townhouses, 20 of which are affordable housing.

Former Borders site in foreclosure
A Florida-based special servicer seeks a foreclosure sale of the downtown Mount Kisco retail property vacated by Borders Books and Music after the owner of the building at 162 E. Main St. defaulted on a $6.3 million mortgage loan. An affiliate of LNR Partners L.L.C. in Miami Beach filed the foreclosure suit late February in state Supreme Court in White
Plains against Mount Kisco Associates L.P., the borrower in the 2007 mortgage deal, and Support One L.L.C., the loan guarantor. Both companies are based in the Wilton, Conn., office of Property Group Partners L.L.C., formerly the Louis Dreyfus Property Group Inc. Borders vacated the approximately 21,500-square-foot building in September 2011 when the company declared bankruptcy and closed all of its locations. A broker for the property and Mount Kisco village officials have said they expect a new tenant will replace the downtown retail anchor this year.
Commercial tax appeals dipped last year
Owners’ legal appeals of tax assessments on commercial properties in Westchester County declined in 2012 for the first time in six years, according to the county clerk’s office. Tax certiorari filings in state Supreme Court in Westchester totaled 4,067 last year, a nearly 5 percent decline from 2011. The appeal proceedings have risen steadily since 2006, when 3,288 tax certs, as the property assessment challenges are called, were filed in White Plains. In the largest year-to-year increase since the recession and real estate market crash in 2008, owners’ tax appeals jumped from 3,683 in 2009 to 4,151 in 2010, an approximately 13 percent increase. The filings peaked last year in the county at 4,268, a 3 percent rise from 2010. “As our local economy struggled, many businesses looked at this process as a way to take advantage of declining property values and to save money,” Westchester County Clerk Timothy C. Idoni said when releasing the figures. “A decline in 2012 tax certiorari proceedings will hopefully be welcome news to local municipalities and school districts faced with tight budgets and declining assessment rolls.” The county clerk, added, though, that as appeals continue to be resolved in court and varying levels of refunds are paid by municipalities to commercial owners, “It may still be a few years before the overall impact of the decline is felt.”
Yonkers drug developer ready for human trials
Contrafect Corp. a 5-year-old biotechnology company based in Yonkers, is ready to begin clinical trials of its first infectionfighting drug product with humans. Robert Nowinski, co-founder and CEO of Contrafect, told shareholders that the company has submitted to the U.S. Food and Drug Administration (FDA) its investigational new drug application (IND) for CF-301, a new therapy to treat staphylococcal bloodstream infections. Drug-resistant staphylococcus, or
MRSA, is one of the most serious bacterial infections afflicting hospital patients. A recombinant protein, CF-301 was licensed by Contrafect from The Rockefeller University in Manhattan. Nowinski said the company over the last year performed required manufacturing, safety and efficacy testing in animals in both Contrafect’s laboratories at 28 Wells Ave. and with third-party contract organizations. Following an FDA review of its IND application, Contrafect will begin Phase 1 clinical trials with 80 healthy volunteers, said Nowinski. Phase 2 trials will be conducted at 45 sites in the U.S., where CF-301 will be given to 125 patients with staph bloodstream infections. Nowinski said pivotal Phase 3 trials to determine the drug’s effectiveness at the intended dose will be carried out with 200 patients at 90 sites worldwide. Following the three-phase trials, Contrafect expects to seek marketing approval from the FDA. Launched in Manhattan, Contrafect in 2011 opened its downtown Yonkers headquarters in the i.park Hudson office and manufacturing complex.

Janney Montgomery Scott L.L.C., a financial services firm headquartered in Philadelphia, has moved its Westchester County office from Tarrytown to Purchase. Janney executives were joined by Harrison business leaders and elected officials at a recent ceremonial ribbon-cutting at the company’s 5,087-square-foot office at 3 Manhattanville Road in The Centre at Purchase office park. The company relocated from 660 White Plains Road in Tarrytown in late February. Janney operates more than 100 branch offices primarily along the East Coast. The company traces its roots to 1832.
Druggists charged with Medicaid fraud
Two pharmacists were arrested and charged with stealing more than $500,000 in prescriptions that were improperly paid for by New York state’s Medicaid program. Shaeen Begum, a 57-year-old New City resident and Syed Rahman, a 62-yearold Briarcliff Manor resident, were charged with grand larceny in the second degree, a felony, and face sentences of five to 15 years if convicted. According to the criminal complaint filed in Rockland County Court, Begum and Rahman allegedly conspired to use Rahman’s pharmacy in Briarcliff Manor to bill Medicaid for prescriptions filed by Begum, after Begum’s pharmacy in New City was barred by the state from doing business with Medicaid. A state investigation in 2008 revealed that Begum and his Kwik Aid Pharmacy were guilty of unpro-
fessional conduct. Begum owned and operated Kwik Aid Pharmacy in New City and Haverstraw Pharmacy in Garnerville, while Rahman owned Prescription Plus in Briarcliff Manor. Begum allegedly conspired with Rahman to submit claims for payment under Prescription Plus’adMedicaid provider1 Davis Erie-WBJ:Layout number for prescriptions that Begum continued to accept and process at Kwik Aid. Begum and Rahman allegedly engaged in the same scheme with Begum’s Haverstraw Pharmacy, which had never been approved as a Medicaid provider.
Peekskill picks group to run Paramount
Red House Entertainment L.L.C. was chosen by the Peekskill Common Council March 11 to take over the closed Paramount Center for the Arts. The council unanimously selected Red House and will now negotiate a lease agreement. Red House was the expected choice after a six-person review committee that included Peekskill Mayor Mary Foster and Councilwoman Kathleen Talbot unanimously selected the company at a Feb. 19 meeting as the best choice to run the theater, which closed in October 2012. Tarrytown Music Hall and Paramount Phoenix, a group run by Peekskill restaurateur Arnold Paglia, were the other two finalists. Red House was the only of the three bidders that would run the theater as a forprofit venture, with a nonprofit subsidiary attached. Red House was recently formed for the purpose of running the Paramount. The company is owned by Garrison sound engineer Kurt Heitmann, who owns CP Communications, an Elmsfordbased production equipment company. Red House and Peekskill expect to share ticket sale revenue, with the company estimating $1.8 million in revenue and $370,000 in its first year of running the theater. Paramount Center for the Arts Inc., the nonprofit that ran the 1,024-seat theater, dissolved in November 2012 facing a $300,000 budget shortfall. Red House’s bid was praised for being high-tech and forward thinking with a solid operating structure and financial plan.
Tappan Zee Bridge $1.5b loan moves ahead
The project to build a new Tappan Zee Bridge is one step closer to receiving a $1.5 billion federal loan. Gov. Andrew M. Cuomo announced March 9 that the loan process is moving forward, as part of the Transportation Infrastructure Finance and Innovation Act
(TIFIA). If the loan is approved, it will lower any potential toll increases. The U.S. Department of Transportation (DOT) will conduct a credit review of the project prior to finalizing the TIFIA loan. As part of the next step of the TIFIA process, New York state is required by U.S. DOT to pay $100,000 for financial advisors to review 12/5/12 7:42 the PM project. Page 1 In addition to the potential funding from the TIFIA loan, the state continues to seek additional financial support to reduce costs from federal, state and local sources, and will use the Toll Task Force to identify alternative financing sources and keep tolls low. The Toll Task Force will examine a
series of options to keep tolls low once the final financing on the project has been established, including expanding discount programs, seeking financial mechanisms that lower the cost of credit and borrowing, and ensuring any increase in tolls on the bridge goes solely to the bridge and regional transportation. The new Tappan Zee Bridge will include eight general traffic lanes plus emergency lanes and extra-wide shoulders for immediate express bus service, and will be transit-ready for bus rapid transit, light rail or commuter rail. – Sam Barron and John Golden

group of parents and school administrators are bombarding state legislators with letters to urge them to consider easing some financial requirements that are weighing down school budgets. Some school districts in Westchester claim they are having a difficult time managing mandates imposed by the state that lack the funding needed to implement and support them. One mandate that school districts claim is costly is the requirement that they provide public school transportation for private school students. The Lower Westchester Education Consortium (LWEC), which is made up of 12 school districts, claims many districts have already seen challenges brought on by the costly requirements. Some school districts have had to scale back extracurricular activities to compensate. And in the Ardsley Union Free School District, 20 teachers have been laid off in three years as well as 17 full-time teaching assistants and aides. “We’re forced to spend money on things we find to be less valuable,” Ardsley Superintendent Lauren Allan said. “The new state assessment for students requires us to use computers instead of paper and pencil.” She said part of the problem with using that technology is the state requires students to take the exact same test at the exact same time. “We have 200 fifth-graders. We do not have 200 computers.” Allan, one of the superintendents that initiated the letter-writing campaign with parents, said the consortium wants to address four topics: Annual Professional Performance Review (APPR), 2 percent tax cap, local control and unfunded mandates. The APPR requires school districts to give an annual evaluation to the performance of its teachers. Allan said the 2 percent tax cap was introduced during the recession limiting taxes on residents and the amount of money school districts can receive. In 2011, the state proposed a plan to offer relief to school districts in an effort to offset the tax cap. Gov. Andrew M. Cuomo’s administration put together an 11-member mandate relief council charged with reducing the financial burden on local governments and school districts. The council released a report in December 2012 detailing what they determined would be a good plan of action. The state would offer “significant relief,” according to the report, on mandate relief for Medicaid, pen-
sion reform and early intervention. Yet the consortium said their four core issues are still a huge financial burden. They believe that’s because their voices aren’t being heard. The lack of recognition bleeds into the other issue of local control. School districts recognized how little control they had over what their funds are used for. “It almost feels like taxation without representation,” said Tracy Pyper, advocacy chair for the Westchester/East Putnam region PTA and chair of the consortium. “We have so little control over what’s being imposed on our local school districts.” She added, “We’re paying these very high taxes yet we’re being told our money has to go into programs that we don’t necessarily support.” Pyper, a resident of Hastingson-Hudson and parent of two high school students, added that the mandates, coupled with APPR and the tax cap is “financially unsustainable” for school districts like hers. That sentiment is shared by the 12 that make up the consortium: Ardsley, Irvington, Dobbs Ferry, Eastchester, Edgemont, Elmsford, Hastings-on-Hudson, North Rockland, Rye Neck, Tarrytown, Valhalla and Yorktown Central. Additionally, Long Island has also initiated a letter-writing campaign that Allan said is in step with the LWEC. State Sen. George Latimer is empathetic to the plight of the LWEC. He said he gets “tons of letters” from school districts about myriad issues. Regarding the LWEC, he said understands their concerns because some of the points are valid. One issue Latimer, a Democrat who represents Rye, said deserves to be re-evaluated is mandatory testing of which he said he is “not big fan.” Yet Latimer contends that little can actually be done to change things. “Everyone in the state capital has come to the same understanding.” He said the challenge is for legislators who represent vastly different communities to agree on relevant concerns when they come together in Albany. If the concerns of one district have little or no impact on another district it’s a hard to come to a consensus. Still Latimer believes the letter-writing campaign is important. “I think it’s worthwhile. Leadership needs to see the level of depth of parental support.” The consortium is moving forward with the campaign. Allan said within the next week they hope to get 500 letters per district to legislators. “That would be a good saturation,” she said. “The powers that be have not been listening to teachers, superintendents and the school boards,” Pyper added. “We’re hoping that parents will turn the tide.”

T
uckahoe developer Philip Raffiani set about transforming his village’s Main Street corridor a decade ago when his company built Viva Bene, a 10-townhouse development whose brick design shaped the look the avenue shows today. Two more projects over the next four years added rental apartments and retail space to Main Street in a village that occupies less than one square mile ¬– exactly 0.68 square mile, Raffiani noted – in southern Westchester County. “It took me seven months” to obtain the needed municipal approvals “to get the original building built,” he recalled recently in his office at Mirado Properties Inc., the commercial and residential development company he and two partners started in Tuckahoe in 1999. “We had tremendous resistance. Nobody wanted anything built.” “The second and third buildings took me two months each” to clear the approval process. “Once they saw the first project, nobody resisted it anymore.” In a booming housing market, Raffiani and partners had plans to redevelop two more parcels in tandem on Main Street. One, a 33,000-square-foot property at 150 Main St., was built in 1927 as a Coca-Cola bottling plant. It was last occupied by Westcon Group Inc., an international computer and communications equipment distributor that Raffiani
co-founded in 1985. When the business was sold and relocated to Tarrytown in 1999, it had grown from seven to 250 employees. The Tuckahoe property, unwanted by Westcon’s new owner, was acquired by Raffiani’s company. In 2005, Mirado Properties acquired 160 Main St., a 65,000-square-foot property across Midland Place from the former Westcon office. The two properties occupy about 2½ acres at the corner of Main Street and Midland Place. In 2007, village officials approved his company’s plans for an 88-unit condominium development on the two sites. But the county’s heated real estate market was about to turn frigid. “Then the way the economy went, it wasn’t going to get built,” Raffiani said. At lending banks that had been throwing money at developers, “The doors just slammed shut. …It was really crazy.” “The banking community just stopped lending,” said Glen M. Vetromile, a Bronxville resident and managing partner at Glenco Group. His real estate investment and development company capitalized on the market’s swift reversal five years ago when some developers were driven into bankruptcy and condominium and other projects came to a halt in the metropolitan area. In Mount Vernon, Vetromile in 2010 teamed with a family-owned Mamaroneck company, Petro Real Estate Development
Corp., to buy at bankruptcy auction a property in the Fleetwood neighborhood where construction of a 70-unit condo tower was about 70 percent completed when abandoned in 2008. Revived and marketed as a luxury rental development, The Horizon at Fleetwood is fully leased, he said. With an eye on Tuckahoe’s Main Street, Vetromile three years ago approached Raffiani “knowing that the project had stalled, with the concept of a rental” development in place of the approved condo plan. A project partnership was struck, with Glenco Group and Mirado Properties forming Tuckahoe Development Partners L.L.C. For the Tuckahoe project, Vetromile also has partnered with New Jersey-based Roseland, the real estate development and management company acquired in October by Mack-Cali Realty Corp. at a price of approximately $135 million. Roseland Partners L.L.C. had been the developer selected by General Motors Corp. to redevelop GM’s 97-acre former automotive plant site in Sleepy Hollow before pulling out of the long-delayed mixed-use project about five years ago. The Tuckahoe partners in 2011 had site plans approved for a 121-unit residential development in two buildings on Main Street. To end a legal challenge brought by residents concerned that the project would swell student enrollment in the Tuckahoe Union Free School District, Vetromile said
the partners a year ago agreed to reduce the size of the project to 108 one-bedroom and two-bedroom units. The project will include 3,500 square feet of ground-floor retail space at 150 Main St. “We’d like to have a bank” as tenant there, Vetromile said. The partners also will pay for landscaping, fencing and recreational improvements at the village’s Main Street Park across from the development site. Raffiani said the project will cost $40 million to $45 million. Demolition work has begun at the two sites. Construction is expected to be completed in about 20 months. “We think it’s going to lease up very quickly,” Vetromile said. He said the partners expect to draw “couples, singles, people in transition and empty nesters” to an apartment complex whose amenities will include a yoga studio and fitness center, an expansive outdoor terrace with gardens and fountain sculpture, a freestanding stone fireplace pit and an outdoor kitchen for private entertaining. “The demand for rental units in lower Westchester is outstanding,” Raffiani said. A scarcity of land in southern Westchester for developments of this size could make living and renting in Tuckahoe all the more attractive. “With the exception of Yonkers, there are no municipalities that have properties of any size” to offer developers, Vetromile said. ince the real estate bubble burst, many Westchester and Fairfield County homeowners continue to wonder if the value of their homes will increase to “what it once was” and beyond. The state of the global economy and fiscal policy and deficit decisions facing U.S. lawmakers will continue to impact both real estate investors and those in search of a new home. The question is, how does one approach the big decision of whether to buy or sell in the current environment? Typically, a home represents the largest asset that people own. Unlike the stock market, a daily valuation cannot be obtained. The decision to buy or sell is often reached after considerable thought and research. School districts, the daily commute, amenities and resale value all need to be evaluated when considering the purchase of a home. Since the boom and bust, have we really reached the bottom? Is this the time to buy? With borrowing rates near historic lows and values far below their peak, those certainly are good questions. As a financial advisor, not a week of meet-

ings goes by for me without a client asking whether he or she should consider moving. A number of headlines have suggested a rare buying opportunity. While data might be helpful, many individuals make financial decisions emotionally, with fear of losing a job or going bankrupt often preceding a sale. Conversely, there are buyers out there that will lowball sellers until they find a proverbial steal. For most people, the question of timing is uniquely personal. Yet being aware of the economic issues still remains critical. The bulging deficit will clearly contribute to slow overall growth here domestically. The recent change in income tax rates will also have an impact as all individuals must stick to a budget and less net income means lower amounts payable to debt service. Two areas worth paying close attention to when thinking long term about real estate are interest rates and inflation. Historical data show that home prices tend to rise with interest rates. So, for homeowners who are locked into low, long-term rates on their current mortgages, moving could turn out to be expensive if interest rates rise. Lenders have moved from a “free money”
pre-recession climate to very stringent guidelines. Pre-bubble, obtaining a mortgage was a given and most thought the value of their homes would continue to rise. In the past few years, many had a tough time qualifying for a loan or were unable obtain one altogether. Worse yet, many stretched their budgets to afford homes and pay larger mortgages than their homes are worth. One big byproduct of our struggling economy and large deficit is the limited number of new jobs. In order to make a home purchase, a borrower needs to feel confident about the prospect of repaying the loan. Recent estimates reveal 12 million Americans are out of work and nearly 9 million aren’t able to work the hours they desire. To increase profits, corporations have merged and have laid off employees, and job opportunities remain stubbornly lean. The result is a lack of confidence that a good-paying job is around the corner. Many are concerned about the future of their current position and have seen countless friends lose a job. Real estate values suffer when buyers become scarce. The large number of available homes to purchase coupled with fewer buy-
ers and tighter lending has been a “perfect storm” for home values. Inflation’s impact on home values is tricky. In higher inflationary periods, the prices of assets rise, whether it’s bread, milk, rent or home values. If you were certain of inflation approaching, then buying a home would make great financial sense. However, as inflation climbs, theoretically more people would be forced to sell. Naturally, the decision to rent or buy has been on the forefront. According to the Census Bureau, the home ownership rate dropped from 69 percent in late 2006 to 65.5 percent in late 2012. While there is still too much uncertainty to predict the real estate market in suburban New York, if your personal plans call for buying or selling, then a home can be a great long-term investment. Locking in at today’s low rates can protect you from inevitable higher rates and trying to time the market is best left to those with a crystal ball. Christopher P. SnAPSHOT PurChase College-suny was selected by Gov. Andrew M. Cuomo to host his State of the State and Budget Message March 7. Cuomo unveiled plans at the Purchase College Performing Arts Center to stimulate job and economic growth, establish a world-class education system and maintain fiscal integrity and discipline.
