estchester County Executive George Latimer said the county will invest millions of dollars and get little in return under the terms of a contract negotiated by former County Executive Rob Astorino’s administration to privatize management of the Playland amusement park in Rye. Latimer’s office released the findings of a new report on the park management deal to the media on May 7. At a news conference, Latimer criticized several provisions of the contract that Astorino signed with

Standard Amusements LLC to operate the park. Latimer said the deal was evidence the prior administration viewed the 30-year contract more as a way to get the amusement park off the county books, rather than improve Playland. “I think it is fair to say that there are individuals serving in the last administration who have said publicly ... they didn’t believe that we should have an amusement park,” Latimer said. “I think the lack of commitment to looking at Playland as an asset is what undermines this overall arrangement. Peekskill aims to redevelop property on Lower South Street BY ALEESIA FORNI aforni@westfairinc.com

ity officials have put a call out for developers to revamp a brownfield site near the Peekskill waterfront. The city issued a request for proposals in April to find an “experienced” developer to transform an 11.5-acre parcel

between Lower South Street and Route 9, south of Louisa Street and Travis Lane. “There’s been a dialogue ongoing between developers and also Realtors … that indicates that people are investigating the property,” said Jim Pinto, the city’s economic development specialist. The property, which serves as a parking area and offloading site for the city’s Department of

Public Works, sits along a mostly industrial and warehouse corridor that includes businesses such as BASF Corp. and South Street Sand and Gravel. The city received an initial appraisal of the property in January 2017 that valued the land between $3.5 million and $5 million. “It’s a big piece and it could really set the tone as the » PEEKSKILL

I

n December 1969, grocer Stew Leonard opened a samenamed store in Norwalk as a 17,000-square-foot retail dairy outlet with only eight items for sale. Today, the family-owned grocery chain operates three stores in Connecticut (Norwalk, Danbury and Newington) and three in New York (Yonkers, Farmingdale and East Meadow). Stew Leonard’s prides itself on fun, and the stores are packed with musical animatronic displays and employees dressed in barnyard animal costumes, and free samples are available for shoppers who prefer to taste before buying. The New York Times dubbed the store the “Disneyland of Dairy Stores,” and Business Insider crowned it “The Best Grocery Store in America.” In 1999, the company expanded into the wine and spirits retail business. Stew Leonard’s Wines is a network of independently owned retail stores in Connecticut, New York and New Jersey. As with the grocery store, in-store sampling has been a hallmark of this operation. Stew Leonard Jr., the president and CEO of the company and son of its founder, spoke with Business Journal reporter Phil Hall on the joys and challenges of running this distinctive food retail operation. When I �irst came to your Norwalk store in 1988, I was on an assignment for Supermarket News and I didn’t know what to expect. And this isn’t what I expected. For people who’ve not had the pleasure of shopping at Stew Leonard’s, what should they expect when they come here for the �irst time? “I hope people still say what you just said: When you come walking and go, “This isn’t what I expected.” We call that “the wow.”’ I think the way you would describe it is: it’s definitely unique. We make a lot of stuff here. We have a big bakery that my sister started, so we’re making all of the fresh bread and bagels. We’re dealing with about 150 local farms right

I think the most important thing you look for when you hire somebody is attitude. We look for that over skill-set, because you can always teach somebody the skills. — Stew Leonard Jr.

now — we have products just coming in from the farms. And we have lots of free samples. We kid around with people in the store, telling them we’re going to take the price tags off all of the products and just weigh customers on the way in and weigh them on the way out. We are proud of our people — we have very, very low turnover. It’s in the single digits, which is very unusual for retail. I think you meet a lot of friendly, nice people as you walk through the store and that’s unexpected.” Low turnover is extremely rare for food retailing. How do you make your hiring decisions? “I think the most important thing you look for when you hire somebody is attitude. We look for that over skill-set, because you can always teach somebody the skills. Let’s say I am walking upstairs when we are hiring somebody and one of the young people who just applied for a cashier job might, out of courtesy, hold the door for me. Now, they don’t know me because I have my jacket on — they were just taught to hold the door to show respect. Usually, to me, if they show that level of respect, I know they’ll

show it to the customers if they’re working at the register. So, we look for nice attitude, a nice smile, a good approach to their day. Once they start working here, we try to communicate a lot and not just with the person through performance reviews, which are done 30 to 90 days after they start. We get feedback from them instantly, because sometimes someone says, “Oh, I want to be a baker,” but when they go into the bakery, they come out and say, “Eh, I don’t really want to be a baker, this is a little different from what I thought.” Tell us about the newest Stew Leonard’s store. In September, we’re going open our next store in New Jersey. We have three wine stores in New Jersey, and Paramus is one of our best stores out there. The Sears department store closed out there and the mall developers came and said, “Hey, what do you think about opening a Stew Leonard’s right here?” It was a great offer for the space. And what is really cool is that we have a wine store in a Paramus and it would be great to sell wine and food together, » STEW LEONARD’S

Plan would convert former WestHELP shelter into senior housing BY ALEESIA FORNI aforni@westfairinc.com

A

n abandoned homeless shelter in Greenburgh would be transformed into 74 units of affordable housing for seniors under the terms of an agreement reached by town, county and development officials. The land is adjacent to Westchester Community College off Knollwood Road and is owned by the county and leased to Greenburgh. As part of the deal, Marathon Development Group would lease the property from the county for 65 years and pay $1.5 million to develop the site. Of that figure, $900,000 would go to the county and $600,000 would go to Greenburgh in exchange for the town relinquishing all rights to the property. The site would feature 60 one-bedroom, 8 two-bedroom and 6 studio apartments. There will also be a range of rents, starting “as low as $750 per apartment,” Mark Soja, president of Marathon, said during a press conference on Tuesday. “It’s a spectacular site,” Soja said. “The location is great. It’s secluded and removed from everything else.”

Soja said the site’s administration building would be converted into space for shared services, including a computer-learning center or an exercise room. Tenants would be chosen by a lottery. Applicants must be at least 62 years old and meet income criteria. The number of units on the property was increased from initial plans announced in October of 54 units. “Senior housing is a tremendous open-ended need,” County Executive George Latimer said at the press conference. “That

portion of the Westchester population is graying before us and there’s an additional need for this type of housing.” The 6-acre site is on property formerly occupied by WestHELP, an organization that offers housing for homeless families. WestHELP operated 108 studio apartments on the property for more than two decades before leaving the facility in 2008. The property has sat vacant since that time. “Seeing this as an abandoned building really broke my heart, because senior hous-

ing is a need,” said Margaret Cunzio, a Mount Pleasant Conservative and member of the Board of Legislators. Cunzio added that the redeveloped site would have “no impact on the Valhalla Central School District,” something that was critical for town officials and residents. The lease agreement will now be sent to the county Board of Legislators. Pending approval by the legislature, Soja said his Peekskill-based company would apply to the state for a financing program. “We should be planning to start construction within a year,” Soja said, adding that “I think our construction process is 18 months, from breaking ground to tenants in the building.” The agreement follows years of negotiations between the town, the county and the developer. Soja said he was first made aware of the project following a request for proposals issued by the town six years ago. “It’s been a long six years,” he said. Latimer agreed that this project is “many years in the making.” “What we’re trying to do with our new administration is to work cooperatively with everybody, both sides of the aisle, work with municipal governments, and solve problems to try to get to closure,” he added. “What we have today is closure and progress.”

Next year is your company’s 50th anniversary. Do you have any special festivities planned? You know, we don’t right now. We need to. It should be something fun and exciting. I wonder what would be really cool — it should be some tribute to the milk and the dairy and the heritage of the family farming. Maybe we can bring 50 cows into the stores — and a lot of shovels!

which you can do in New Jersey. Are you planning additional stores? We’re not. We don’t really have any grand strategy. We wait and see and move on — we’re not like we’re going to open X-number of stores in so many years. Right now, we’re just focused on Paramus. Within the food retailing industry, Amazon shook things up with its acquisition of Whole Foods. Does that have a major impact on the industry? I think it does. It has a huge impact. They have taken a number of prices and lowered them. From a price standpoint on certain products, they’ve made a splash. I don’t think they’re competitive across the board on a lot of products, but on certain items they are. Has it directly impact your business? Not really. You always react — that’s how retailers are. So, if they’re going to be 99 cents on Chobani yogurt, we’re going to be 99 cents. The business comes from somewhere. If Whole Foods’ parking lot is getting fuller, it’s coming from someplace. Your company recently sent out a press release that called attention to the success of its internal Health & Wellness Program. What’s this all about? We have trained our people in the store and will share some of the savings if they’ll shop for health care. We have all of the insurance professionals up at Cigna with their heads spinning because they can’t believe how we’ve not only been able to maintain but also decrease our health care costs just by shopping. I’ll give you a great example that happened to me this week, and I’m so glad it happened. My wife had to go in to get a colonoscopy. She went into her doctor and her doctor scheduled her. I just happened to see where the appointment was set up — I’m not going to say the name of it, but it was a colonoscopy place — and I said to my wife, “Have you checked the prices on how much colonoscopy costs?” And she said, “No I didn’t.” And I said, “Over at the store we have the value center and we give everyone incentives if they check the prices of what these procedures cost.” My wife comes over and looks it up, then comes home and says, “I just saved $2,000. That was the most expensive place I could have gone to. I found another place in Fairfield.” Now, there has been an incredible upfront cost to this and it was a big commitment by our family. The first thing we had to do was say everybody in the company has to go see a doctor every year — you’re not going to be on insurance plan unless you see the doctor. Of course, as soon as you see the doctor, you have to take blood pressure medication or you have to take diabetes medication, then our medicine costs go way up. But what we’re finding now is that we have a healthier population and they’re getting healthier and our costs are going down.

Looking back on nearly a half century in business, what is the company’s crowning achievement? All of the people we’ve developed over the years and are part of this place. And creating something unique to the community here. My in-laws are from Los Angeles and I go out there — there’s nothing like Stew Leonard’s out there. I miss the store when I’m out there and I want to come back and rip open one of those breads and eat one of those mozzarella balls. I think we’ve been able to bring cool food and wine to the communities we are in. I think that’s a unique accomplishment for the family.

Playland—

The deal between the county and Standard Amusements, a company backed by a Manhattan hedge fund, calls for the county to spend $33 million in capital investment, along with pool reconstruction costs of $9.5 million. Standard Amusements, meanwhile, is responsible for $27.5 million in investment, $14 million of which is earmarked for rides. The county is also required to make additional investments for the maintenance of the park. The county’s Board of Legislators approved the deal in May 2016. After Latimer took office at the start of this year, the county board called on his administration to review the deal. The report was led by Latimer’s Director of Operations Joan McDonald and County Attorney John Nonna. Among the complaints alleged in the investigation: • Standard Amusements still owes $1.25 million out of a $2.25 million upfront payment on the contract.

It could be just about anything.” The property is one of the largest available development sites in the city and officials hope to capitalize on its proximity to both the Hudson River and the Peekskill Metro-North station, which is less than a mile away. It is also less than a mile from the Holiday Inn Express & Suites on John Walsh Boulevard, along with restaurants near the train station and in downtown Peekskill. “It would certainly attract people to another part of the city,” Pinto said, “an area that’s easily accessible.” The area is zoned for a range of uses, from restaurants and retail to schools or personal offices. “The city is looking for uses that create jobs,” Pinto said. He added that the city is encouraging potential

• The Astorino administration allowed for five extensions on payments Standard Amusements owed to the county under the deal without prior approval from the Board of Legislators. • Neither the county nor Standard Amusements undertook a detailed assessment of the renovations needed to be done at Playland. The county estimates the park needs $125 million worth of renovations, which the report said could require the county to pay out between $65 million and $95 million beyond its initial commitments. • The county will not receive a share of the profits until Standard Amusements has fully recouped its initial payments of $2.25 million and capital investment of $27.5 million. By Standard Amusement’s calculations, noted in the report, that means the county would not receive any profit share until at least 11 years after Standard Amusements takes over Playland management. • Standard Amusements is in default on a material term of the contract: that the

ital investment only after the county has made half of its promised investment. “When the private entity doesn’t have skin in the game in the beginning, that’s not a great thing,” McDonald said. Nonna said there are three main legal issues

the county must address regarding the deal. First, has Standard Amusements met its financial obligations to this point, and can the company meet all future obligations? Second, if the contract is not beneficial to taxpayers, can it be renegotiated? “And finally, if we can’t renegotiate, can we terminate the agreement?” he said. “Is that more beneficial for the taxpayers? What is best for the taxpayers is our responsibility — and that is the way we have to look at the legal issues.” Latimer said the report was delivered to Standard Amusements and its attorneys. His office also plans to reach out to the company for a meeting. Asked to respond to the report, Standard Amusements Partner Nicholas Singer provided a short statement by email through a spokesperson. “We are pleased Westchester County has completed its review and look forward to engaging with the county to resolve any concerns as expeditiously as possible,” Singer said.

“We’re hoping to have possibly a sports center or a business center would be very popular today.” The city also owns another parcel of land

across Louisa Street that is used for parking and storage, one that officials may be open to redeveloping in the future. “With a latter phase of the project, we could possibly make those available if the developer is willing to relocate our facility,” Pinto said. The brownfield formerly served as a salvage yard for a number of companies for roughly a half century, Pinto said, and the city began to take over the property 15 years ago. The New York State Department of Environmental Conservation has already issued a decision document for the site, outlining the remediation plan for the brownfield. “It is ready to be taken over and worked on by a developer,” Pinto said. Pinto said the city is also open to developers partnering with another firm which has experience in brownfield cleanup. In order for the site’s developer to take advan-

tage of more lucrative tax credits under the brownfield program, the cleanup must be completed by the end of 2019. “Which is an aggressive schedule, but a manageable schedule,” Pinto noted, “which is why we’ve focused on brownfield experience in a development team, but also a feasible mixed-use proposal that would be compelling for the city to consider.” Responses to the RFP are due by May 24. Following the deadline, those proposals will be reviewed by the city, and presentations from developers to the Common Council are scheduled to start in mid-June. Pinto said he hopes the city will select a developer for the property by July. This is not the first time the city has requested feedback from developers regarding the land along Lower South Street. In 2012, the city issued a request for qualifications from developers interested in redeveloping the site.

he White Plains Common Council will not veto a recommendation to declare the former Good Counsel campus on North Broadway a local historic landmark. That decision could add another hurdle to a major redevelopment proposed for the site last year. A development team led by Manhattan real estate firm George Comfort & Sons Inc. has proposed a project that would add a mix of student housing, apartments and an assisted living facility to the historic campus. For 125 years, the 52 N. Broadway property was used by a teaching order of Roman Catholic nuns, Sisters of the Divine Compassion. But the teaching order closed two schools in 2014 and sold the 16-acre property in November 2015 for $16.3 million to WP Development NB LLC, a group of investors led by George Comfort & Sons. In 2016, WP Development applied to the city for a zoning amendment necessary for its residential redevelopment. The Common Council advanced the review of those redevelopment efforts at its regular monthly meeting May 7 when it accepted the developer’s draft environmental impact statement as complete and scheduled a public hearing next month for the environmental review and zoning amendment. But the Common Council also elected not to reject a recommendation from the city’s Historic Preservation Commission to designate the property a landmark. That means the project’s review will also be subject to the historic commission. “This does not mean there can’t be any development on the site, they will just have to go through the Historic Preservation Commission to get approvals,” said Councilman Justin Brasch at the hearing, who joined the majority in voting against a resolution to veto the landmark status. He said the designation “seems like a sensible approach to how we should balance preserving important pieces of property

like this and allowing for the proper development of sections that may or may not be appropriate for that.” WP Development’s original plans called for 400 rental housing units in two, 10-story buildings. A separate facility would have 70 units of graduate-student housing for the neighboring Elisabeth Haub School of Law at Pace University. Also included was a 90-unit assisted living facility with a care unit for residents with Alzheimer’s disease and other dementias. The project would preserve two historic buildings on the property — the Sisters of the Divine Compassion chapel and the Mapleton House, now used as an administrative office. Sisters of the Divine Compassion have a 50-year lease on the chapel. The Mapleton House would be moved to the north side of the chapel to make way for the assisted living facility. About 3 acres of greenspace on the site that abuts North Broadway would also be preserved — and open to the public. Geoff Thompson, a spokesman for the project, said in an interview following the Common Council meeting that the developer has offered an alternative to those plans. Submitted through WP Development’s draft environmental impact statement, the alternative plan preserves part of an additional historical building and scales down the size and units for the apartments buildings, student housing and assisted living.

ALTERNATIVE PLANS

WP Development’s proposal had drawn criticism from the site’s neighbors, including the Stewart/Ross Neighborhood Association. Neighbors have said the project would bring unreasonable traffic, damage air quality and cause disruptions through its construction. In its draft environmental impact statement submitted to the city last month, WP Development included an alternative development proposal that it said responds to concerns heard earlier in the review process. The alternative plan reduces the number of apartment units in the multifamily buildings from 400 to 370. It also reduces


the maximum height of the buildings by 30 feet. The residential portion would include a three-story townhouse section and residential building segments that ascend from four to 10 stories at the maximum before grading back down to six stories on the campus’ east end. The assisted living facility is reduced from 90 to 82 units in a narrower, four-story building with a smaller footprint. The student housing is reduced from 70 to 40 suites and moved to the northeastern corner of the site. The alternative proposal also preserves the westernmost wing of the historic convent building, along with maintaining the preservation of the chapel and relocated Mapleton House. Thompson said the alternative plan is the developer's preferred option. “We have listened carefully to public input, the historic commission’s input and a lot of people have expressed concerns and ideas,” Thompson said. “This alternative plan is the result of us processing all the comments and adapting the proposal to address issues that have been raised.” The Common Council will hold a public hearing on the proposal’s draft environmental impact statement, as well as the zoning amendment proposal, at its June 4 regular meeting.

LOCAL LANDMARK

In its report recommending local landmark status for the property, the commission said the complex has architectural significance as an example of a late 19th century religious and educational campus. The two co-founders of the Sisters of the Divine Compassion — Mother Mary Veronica Starr and Father Thomas Preston — are buried in a crypt below the site’s chapel. The commission noted the site’s history dates back to before Good Counsel was built. Using topographical maps of the Battle of White Plains, the commission concluded that George Washington stationed troops on the site in the 1776 battle against British and Hessian forces. The property was added to both the state and national Register of Historic Places in 1997. After the commission voted unanimously to bestow local landmark status on the site, the city’s Common Council had 45 days to either veto the decision or let it stand. The resolution to reject the landmark status considered on May 7 came from Councilman John Kirkpatrick and Council President John M. Martin. Martin said the commission should reconsider its inclusion of the entire property into the designation. Kirkpatrick argued that the city could open itself up to a legal challenge if it accepts the landmark status without first completing an environmental review of the project proposal. But the rest of the council supported the landmark designation, including Mayor Thomas Roach. The mayor said he respects the independence of the commission and saw no reason to overturn its decision. Thompson said WP Development has cooperated with the commission since the start of the project and will continue to do so.

Fieldhome sells portions of Yorktown campus for $28 million BY ALEESIA FORNI aforni@westfairinc.com

T

he owners of Fieldhome, an assisted living, nursing and rehabilitation facility in Yorktown, said that two portions of the organization’s campus on Catherine Street were sold to Personal Healthcare LLC for $28 million. “We are confident that Personal Healthcare and its owners represent values that are consistent with Fieldhome’s culture of dignity and respect as they share our mission, values and ethics,” said John R. Ahearn, Fieldhome’s CEO. The sale includes The Seabury and Field Home Holy Comforter. The Field Home Holy Comforter facility at 2300 Catherine St. features a 50-bed rehabilitation unit and a 75-bed long-term skilled nursing facility. The facility also offers an adult day care program and child care services. According to Fieldhome, that property sold for roughly $19 million. Built in 2003, The Seabury is an 80-bed assisted living and memory support residence that provides “upscale accommodations,” according to the organization’s website. A Fieldhome official said The Seabury was bought for approximately $9 million. “Needless to say, it was a difficult decision,” Ahearn said. “Unfortunately, the way the tides are turning in the health care industry, it became critical for us, because as a standalone operation, we couldn’t foresee the ability to be able to meet the financial challenges ahead of us.” Along with industry changes, Ahearn cited rising costs of maintaining the aging Fieldhome facilities. “The combination of those things, it made sense for us” to sell Field Home and Seabury, Ahearn said. Ahearn said Fieldhome aimed to find a buyer that would “maintain the beds, services and jobs in the community.” Ahearn added that there would be no displacement of residents as a result of the sale, and that the new owners would continue to operate the adult day care program and early learning center. “We are excited with the opportunity to join the local community in northern Westchester and continue the great legacy of quality care provided by Field Home,” Personal Healthcare CEO Ephraim Zagelbaum said in a statement. “We are looking forward towards working together with the residents, families, staff and local community to ensure the highest level of resident-centered care and services is provided at all times.” Personal Healthcare is based in Tarrytown and operates more than a dozen skilled nursing and rehabilitative care facilities in New York and Massachusetts. In a statement, the company said it aims to retain “as many of the Field Home Holy Comforter and The Seabury’s staff as possible,” adding that historically, the company’s facility acquisitions “have resulted in minimal turnover of staff members.” Requests for further comment from

Personal Healthcare were unreturned at press time. Fieldhome, meanwhile, will continue to operate on the property, though in a different capacity. The organization has retained its executive office building, Field Hall, and

will operate as the Field Hall Foundation, with Ahearn as its CEO. Proceeds from the sale of the Field Home and Seabury facilities will be used to provide grants to area programs that address the issues and needs of the elderly.

“We’re now in the process of organizing and ramping up the foundation so we can be able to hopefully make a grant later this year,” he said. Ahearn said potential grantees could include caregivers, church groups, a senior center that hopes to provide new programming but lacks funding or longstanding organizations like Meals on Wheels.” “There’s not an awful lot of foundations that are into geriatric support, and that’s particularly true in Westchester County,” he said. “This may prove to be a unique foundation in the sense that its primary purpose is going to be for geriatric care.” Along with the office building, the organization has also maintained about 18 acres of land. “At some point we may sell that land,” Ahearn said, adding that “right now, the plan is to get the foundation up and running.”

New York shoots down NRA insurance program BY BILL HELTZEL bheltzel@westfairinc.com

N

ew York has shot down a National Rifle Association insurance program for violations of state laws, in consent orders with the program’s underwriter and administrator. Chubb Group Holdings and its Illinois Union Insurance Co. subsidiary, consented to a $1.3 million penalty on May 7 and to stop underwriting the NRA’s Carry Guard insurance, in an agreement with the state Department of Financial Services. A week earlier, the Lockton Cos. consented to a $7 million penalty and agreed to stop issuing Carry Guard policies in New York. “Today’s action is another step in addressing the unlicensed and improper activity connected with the NRA’s unlawful Carry Guard program,” Maria T. Vullo, superintendent of the New York state Department of Financial Services, said in a press release announcing the Chubb agreement. She said her department would continue to ensure that “consumers are no longer conned into buying so-called “self-defense” insurance coverage. The NRA was not fined or made party to the agreements, but the gun rights organization is described throughout as an unlicensed marketer of insurance. An NRA spokesman put the blame on Lockton, stating that the organization had relied on the insurance company to comply with all state regulations. “The NRA acted appropriately at all times,” said William A. Brewer III, outside counsel for the NRA. He also depicted the Department of Financial Services’ actions as politically motivated and an

attempt to suppress free speech by blocking affinity-type insurance programs with the NRA. “This could fairly be seen as an attempt to restrict the NRA’s ability to operate in the political arena and marketplace of ideas,” he said. The Financial Services Department began investigating in October, and it imposed the sanctions after Gov. Andrew Cuomo directed the agency to put pressure on banks and insurance companies to consider ending their relationships with the NRA. “New York may have the strongest gun laws in the country,” Cuomo said in a public statement on April 19, “but we must push further to ensure that gun safety is a top priority for every individual, company and organization that does business across the state.” Vullo cited the killings of 17 students and staff at Marjory Stoneman Douglas High School in Parkland, Florida, in a memorandum to all insurers doing business in New York. She encouraged insurers to manage reputational risks “that may arise from their dealings with the NRA or similar gun promotion organizations.” Insurers were urged to “take prompt actions to managing these risks and promote public health and safety.” Carry Guard policies were issued to 681 New York residents from April through November 2017, according to the consent orders, and no claims have been submitted. The NRA describes Carry Guard as a two-pronged program that provides firearms safety training and insurance to mitigate financial and legal consequences of “armed encounters.” “Although millions of Americans are prepared to use a firearm in self-defense,” the NRA website

states, “very few families can withstand the financial consequences that may come next. The legal fees to clear your good name could be enormous. Likewise, the costs of defending and potentially losing a civil lawsuit could cripple your finances for the rest of your life.” Chubb and Lockton suspended their participation in the Carry Guard program in November, weeks after Department of Financial Services had begun its investigation. Chubb, the world’s largest property and casualty insurance company, based in Zurich, Switzerland, served as the Carry Guard underwriter through its Illinois Union subsidiary. Lockton, the world’s largest privately owned independent insurance brokerage firm, based in Kansas City, Missouri,

administered Carry Guard policies through its Lockton Affinity subsidiary. Carry Guard violated New York laws, according to the consent orders, by offering liability insurance to people who may be charged with a crime, who use firearms beyond reasonable force, who used the coverage for psychological counseling and for promoting insurance at the behest of an unlicensed entity, the NRA. Lockton improperly tied the insurance policies to free NRA membership for a year. Lockton had also provided insurance to 11 other NRA-endorsed programs, from 2000 through this past March, such as retired law enforcement officer self-defense insurance, gun collector insurance and gun show insurance. Lockton sold 28,015 policies since 2000 and

received $12.8 million in premiums and administrative fees. The NRA received $1.9 million, the consent agreement states. The insurance companies agreed to pay the penalties within 10 days, to not participate in Carry Guard or similar programs, to cancel the policies and refund their customers. They agreed to testify at hearings, trials and other proceedings, if asked to do so by the Department of financial Services, on matters related to Carry Guard. The NRA has sued Lockton in federal court in Alexandria, Virginia, accusing the company of breach of contract for rescinding regulatory guidance the organization had relied on, buckling under political pressure from the Department of financial Services and abandoning its obligations to the NRA and its members.

An employer’s guide to reference-based pricing A NEW APPROACH TO HEALTH CARE IS CROPPING UP ACROSS THE COUNTRY. HERE’S WHAT YOU NEED TO KNOW. BY JOSEPH D. MOSCHITTO

I

n the world of health care, nothing is ever static. The very nature of the benefits ecosystem — varying levels of competition, increasing prices, an always-evolving landscape of regulations — means that new approaches are constantly cropping up. (And that old approaches are constantly evolving or fading away.) Currently, one new approach to health care is quickly gaining momentum across the country: reference-based pricing. Traditionally, health care functions on a fee-based pricing model. That is, prices for medical treatment are negotiated by an insurance carrier: an entity like Aetna and UnitedHealthcare determine how much to charge for a visit to the orthopedist or sur-

gery in a hospital. Typically, this is anywhere from 250 to 400 percent of Medicare rates that are determined by the federal government. With referenced-based pricing, the reimbursement can be as low as 120 percent of Medicare. Under reference-based pricing, the insurance carrier isn’t in the equation. Instead, employers pay health care providers directly. In many cases, employers will work alongside reference-based pricing specialists to implement the model. A diverse set of industries are experimenting with this reference-based model, from engineering firms to manufacturers to municipalities. But perhaps your mind began to wander at “a new approach to health care is gaining momentum across the country.” Navigating the realm of health care can be

THE PERKS

Reference-based pricing wouldn’t be gaining momentum if it didn’t have perks. First, there’s more transparency into the health care process. Employers with the assistance of a third-party administrator can analyze a bill line by line and see the breakdown of prices: how much the procedure cost, how much the medication cost and so on. Normally,

employers would simply receive a single, monolithic bill from insurance carriers. Then there’s the potential for cost savings. With employers engaging with medical providers directly, eliminating the inflated reimbursement rates, prices will likely decrease and outcomes will improve. And over time, employers can build relationships with a network of physicians, eventually ironing out prices that both parties can grow used to — no surprises. There are companies that work with employers to implement reference-based pricing. And they report major health care savings for their clients — up to a 30 percent overall reduction or an average savings of $150,000 per 100 employees in the course of one year. CEOs and CFOs are frustrated with receiving a 10 to 20

percent increase every year on an already inflated number. Increased transparency and decreased costs aren’t just good news for employers, of course — they’re also good news for employees. Lower costs can mean fewer out-of-pocket expenses and less in employee-plan contributions. We give our clients the opportunity to treat their medical premiums like any other business expense.

THE PITFALLS

No system is perfect. While reference-based pricing brings positive change, there are also pain points. The issue: Without the buffer of an insurance carrier, when employers and providers disagree on a cost, employers may have to pay the higher fee — or face balance billing, which ultimately could lead to litigation if

not paid. Even if this never occurs, the prospect of not having an insurance middleman to absorb those costs can be daunting. However, the right third-party administrator can provide member advocacy and legal defense to protect members from balance billing or collection at no added cost. As reference-based pricing gains traction, hopefully this overview is helpful in determining if it’s the right fit for you and your organization. Navigating the realm of health care can seem overwhelming — but careful research and a reliable partner can uncover the best path forward for healthy employees and a healthy company. Joseph D. Need to do more in marketing than I have time for WE HAVE NO ONE TO WORK ON MARKETING. LOOKS LIKE I’M GOING TO HAVE TO PROJECT MANAGE IT MYSELF. BUT I DON’T HAVE THE TIME TO FOCUS ON IT. NOW WHAT? THOUGHTS OF THE DAY: Marketing does better when someone owns the department’s success. Make sure your marketing expectations are realistic. Look for someone who is already working in marketing who would like to pick up some additional work. Small-business owners wear a lot of hats, pitching in when and where needed. Unfortunately, marketing plans take longer to complete when there are interruptions. It’s also hard to consistently measure marketing ROI while handling all the other activities in the business. Make marketing a priority by scheduling time when you can give it your complete attention. Get away from the

office if necessary. If you can’t work from home, try the library. An hour a day dedicated to marketing can make a big difference. Let your employees handle the office while you work on the future, marketing the business. We often approach marketing on an all-or-nothing basis, either tackling a huge list, or not working on marketing at all. Instead, make a list of everything you want to work on and consistently chip away at it. If you can only afford one or two projects for the year, pick those that will get you the most visibility, or those that will lay a foundation for what comes next. If you have projects that are interdependent decide

which one needs to get done first, which comes second. Here’s a good example. Let’s say you want to work on upgrading your website, SEO (Search Engine Optimization) and SEM (Search Engine Marketing). If you commit to buying a bunch of ad words you want to know the right visitors will see your website. Ad words can raise your visibility on the internet, but only deliver meaningful results if visitors take the right actions once on your website. Visitors stay long enough to take action only if the website is inviting and paths to follow make sense to them. Clean up your website. Then research best-opportunity key words. Next spend on advertising to raise visibility. Wondering if you should work on web-related activities or support tools for sales? Another set of choices. Ask

your sales people what would help them get in more doors and close more sales. Create literature that answers basic questions. What makes a great customer for your company? Why should great quality prospects choose your company? Overwhelmed already? Then you need help. Ask an expert to evaluate your existing tools, giving each an effectiveness rating and priority rank. Ask for help making a plan of attack that you can follow to move from one project to the next. When it comes to finding someone to work with you in marketing, look inside your organization. Anyone around who has shown an interest? Anyone with marketing training in their background? Check with your sales team to see if someone there has an interest. Other option? Look for

an outsider, someone who is already working in marketing as a vendor who might want to pick up a few extra hours of work. Adding someone as a part-time expert will be cheaper than hiring full time. Set up time to work together each week to keep you focused on marketing. Worried about the budget? Think of marketing as your next salesperson. They used T-shirts that had been cleaned and tested for durability to make the toys that will be used for play, training and social interaction. At Temple Israel of New Rochelle’s 110th Anniversary Gala on May 5, Cantor Emerita Helene Shifrin Reps, the 12th woman to become an ordained cantor, was honored along with Beverly Hoffmann who received the Founder’s Award and educator and author Amy Bass who received the President’s Award. Rabbi Beth Nichols said the cantor’s “contributions to the well-being of our congregation are immeasurable and it is fitting that we honor her on this festive evening.” She studied at the Carnegie Institute of Technology, performed with the Pittsburgh Symphony, sang with opera companies and ensembles and taught music in the New York City schools. Hoffmann served on more than a dozen committees for the temple, including its board of trustees. She was part of the team that founded the Temple’s Kehillah School. Bass has been an educator, a radio host on WVOX, an Emmy-winning NBC researcher and is the author of four books. She chairs the temple’s library committee and serves on its board.

Linda Parry Murphy, CEO of Product Launchers, the White Plains-based company that helps introduce and market products, has been selected as a recipient of a Gold Stevie Award from the American Business Awards. She was named “Entrepreneur of the Year, Advertising, Marketing, & Public Relations.” The Stevie Awards competition receives more than 10,000 entries each year from organizations in more than 60 nations. The awards will be presented during an event at the Marriott Marquis Hotel in New York on June 11. Product Launchers works with startups and inventors from development to market. It also serves established companies as sourcing agent, distributor and in providing sales and marketing support. The myriad products on which Murphy’s company has worked range from seafood and coffee to model cars, cellphone accessories and fidget spinners. Product Launchers launched a spin-off operation named Unscripted that offers business development and sales generation services.

CareMount Medical has announced the promotion of Lisa Bardack to the post of associate medical director. Bardack, who is board certified in internal medicine, will continue to provide clinical services at CareMount Medical’s Mount Kisco office. Scott D. LEIFERT JOINS WHITE PLAINS FIRM Attorney John Leifert has joined the White Plains law firm Denlea & Carton LLP. His background is in complex litigation and he will be active in the firm’s health care litigation practice. Jeff Carton, a co-founder and managing partner of the firm said, “His breadth of experience working with physicians and his understanding of the nuances of health care law will allow him to make an immediate contribution to our practice.” Leifert comes to the firm from Heidell, Pittoni, Murphy & Bach LLP. ERA RECOGNIZES PERSONNEL

The Westchester Broadway Theatre in Elmsford has turned one of its spotlights on hunger in the county. It has a longtime association with food, being founded in 1974 as An Evening Dinner Theatre by co-owners Robert Funking and Bill Stutler. Their operation brought the dinner theatre concept to Westchester. Since the opening of its current show, “Sister Act,” the theater has been working with three nonprofits on a food drive. A collection point has been set up in the lobby where the public as well as theatergoers are invited to drop off canned and boxed food. The organizations, St. Bartholomew’s Soup Kitchen, Westchester Lifting Up and Our Lady of Mount Carmel’s Food Pantry feed the homeless and provide food for people in need. The food drive will continue through June 15. Among the requested items are canned soups, canned vegetables, boxes of pasta, coffee and tea.

MILES NAMED TO AACC BOARD Belinda S. Miles, the president of Westchester Community College, has been named to the board of directors of the American Association of Community Colleges (AACC). It is the nation’s leading association for the advocacy of community colleges. AACC is governed by a 32-member board that acts on behalf of the institutional members. “I am excited to join AACC in providing a voice for the more than 12 million students attending the nation’s (more than) 1,100 community colleges,” she said. Since arriving at WCC in January 2015, Miles has worked with faculty, staff and others to increase graduation rates, create new academic and workforce programs and expand resources that help more students transfer to four-year colleges or enter the workforce.

ELIZABETH SETON CHERISHES CHILDREN The St. Elizabeth Seton Children’s Foundation hosted its fourth annual Cherish the Child Luncheon on May 3 at Siwanoy Country Club in Bronxville. More than 150 guests attended the event that supported Home to Home, the center’s parent and sibling transportation program. “The concept of ‘home’ is integral to our care model,” said Barbara Rossi, director of institutional advancement. During the program, parent and pediatric center board member Rachel Amar shared how the Pediatric Center has been

her son’s home for the last 12 years and that she fears what will happen when Max “ages out” of the Pediatric Center when he turns 21 and must move on to a geriatric nursing home. Pat Tursi, Elizabeth Seton’s CEO, spoke after about her plan to address this crisis through the Pediatric Center’s next endeavor: the nation’s first residential program for medically complex young adults ages 21 to 35. PACE STUDENTS’ WORLD PREMIERE In our April 9 issue, we reported on the students at Pace University who produced a documentary about the hurricane recovery efforts in Puerto Rico. Now, that film has had its world premiere – a sold-out event at the Jacob Burns Film Center in Pleasantville on May 1. “Puerto Rico: Hope in the Dark” is the 15th student-produced documentary to come out of Pace University’s Media, Communications and Visual Arts department’s “Producing the Documentary” course. “I was so pleased at the attendance and the attention that the documentary received,’’ said Maria Luskay, the Pace professor who led the student filming trip to Puerto Rico. “Our hope is that more people reach out to help in whatever way they can and that the citizens of Puerto Rico get the assistance they so desperately need.”
