C
onsolidated Edison Inc. released a 94-page report May 14 detailing its response efforts to two major March nor’easters that caused some of the most significant outages in the company’s history. Despite customer criticism and an ongoing state review of its performance, the company defended its power restoration efforts while acknowledging breakdowns in customer communications. New York law requires utilities to file a report reviewing storm preparation and restoration performance any time an emergency causes an outage of three days or more. For Winter Storms Riley
and Quinn, which hit Westchester County in back-to-back weeks to start March, thousands of customers experienced power outages that lasted close to a week. Con Edison’s report, filed with the state Public Service Commission on May 11, said the storms caused the second-most damage in the company’s history. The storms brought a torrent of criticism to the utility from customers and elected officials. Westchester County Executive George Latimer called for the top executives at Con Edison and NYSEG to step down. Gov. Andrew M. Cuomo asked the state Public Service Commission to conduct a full review of the storm response by Con Edison and other regional utilities. » CON EDISON

he development team planning a residential community at the Hampshire Country Club celebrated a small milestone earlier this month in the review of its proposal to build 105 luxury homes on the course. Hampshire Recreation LLC, the owner of the golf course and club, announced on May 11 that
the public comment period has closed on the draft environmental impact statement for its proposal to build homes on part of the golf course. The developer now moves into prepping its final environmental impact statement, which will be reviewed by the village’s planning board. It’s a small step in the project’s review and the proposal is still a long way from the putting green. But, to the developer, the move is a “step forward” for plans that have hooked and sliced in the
face of community and municipal opposition over the eight years Hampshire Recreation has owned the golf course. The latest proposal calls for 105 residential units on 29 acres of the 116-acre property, including 64 carriage homes that will target empty nesters looking for low-maintenance property ownership. or many parents, the process of discovering new activities for their children is both difficult and time consuming. “Parents are busy, whether you’re a working parent, whether you’re a stay-at-home parent, you’re busy,” said Olivia Leon. “You want to find great activities for your kids and you want to find activities that they will love and enjoy.” To help with that search, Leon and her business partner, Amanda Cole, launched Pretzl, a website that helps parents quickly and easily find activities for their children. “Our mission is to help parents find great activities for their kids, whether it’s a six-week summer camp around coding or it’s Friday night and (they want to) find something fun,” Cole said. Pretzl allows parents to search, discover and book classes for their children, all on one site. “Amanda and I were talking, and we were sort of commiserating about how difficult it is as two busy working moms to find great activities for our kids,” Leon said. “You’ll hear about this great new multisport class from another mom in your child’s school, but it’s already started, or you’re too late to sign up, and then you go on to Google and you try to look it up, but it’s hard. We just felt like there has to be a better way.” Their new website features more than 5,000 local activities, classes, camps, events and parties for children. “You can search for ballet and have all these different dance studios come up with all different philosophies,” Leon said. “Whether you want something really structured that will train your child to be the best possible dancer or you’re looking for something more freeform, they’re all there together.” “Or you don’t care about what the philosophy is, you just want something that’s a minute from your son’s taekwondo class,” Cole added. On Pretzl, activities or other offerings can also be found by searching for keywords or subject matter. “My son is just getting into Star Wars, so you can go onto the site

and type in ‘Star Wars,’ and you’ll get a Star Wars Minecraft class, a Star Wars Lego class,” Leon said. “Parents don’t have to search for things just in a traditional category set. It’s helping parents find great activities and activities they never knew their kids always wanted to try.” Activities range from horseback riding to sailing and can be filtered on the site by type, price, age, date or location. The site is free for parents or other customers and there are no added fees for booking through Pretzl. Instead, if a vendor’s class is booked through the Pretzl site, that organization would pay a commission fee to Pretzl. Vendors also have free access to Pretzl’s scheduling system. Cole said the site also serves as a solution for businesses and facilities looking to fill their unsold inventory. “Our partners are looking for new ways to get the word out,” Cole said. “Moms are on their phone all the time. The circular they may have toted around for years, times are changing. I think they’re really excited to test this and to experiment with new advertising avenues.”
Following the purchase of a class, parents will be able to manage their children’s’ schedules on Pretzl through their smartphone or computer. “You can purchase on the spot, it’s not redirecting you, you can do everything there,” Cole said. This is not the first business venture for Cole. In 2009, she launched Yummy Mummy, a “onestop shop” for breastfeeding mothers and the largest durable medical equipment provider in the country specializing in breast pumps. “I recognized a need of a store where you could buy everything for breastfeeding and get all the supplies you needed, and also take classes or join support groups,” Cole said. The business has a retail store at 1201 Lexington Ave. in Manhattan, along with a significant mail-order business. “We ship breast pumps all over the country,” Cole said, adding that the company sends out roughly 1,000 pumps per week. Leon, who has a background in marketing, came on board at Yummy Mummy in 2014 as director of marketing. “I knew we would be a great team launching this new business
together,” Leon said. For their newest venture, the duo decided to start Pretzl in Westchester County. In the future, the company may look to expand farther into Connecticut or Long Island. “It’s my backyard,” Cole, a Hartsdale resident, said of Westchester. “There are so many amazing options here that I don’t think people know about. It felt like a really good playground, so we said, ‘Let’s do this right, let’s launch here, and let’s make this perfect.’” The duo also has plans to launch a loyalty points program and a mobile app. “Our focus right now is just getting this right,” Cole said. As for the name of their website, the business partners said that according to some historians, the earliest pretzels were dubbed “pretiolas,” a Latin word that translates to “little rewards.” With Pretzl, Cole and Leon said they hope to give children the reward of great experiences, while also giving parents “the reward of easily finding and booking those experiences.” The name also has another meaning for Cole and Leon. “Wherever there’s fun and kids there’s usually pretzels,” Cole said.

Hotel could be coming to South Broadway in Yonkers BY ALEESIA FORNI aforni@westfairinc.com
T
he city of Yonkers could see the construction of another hotel later this year. Broadway Hospitality has filed plans with the Yonkers Planning Board to build a 54-room hotel at 189 S. Broadway. Called the Broadway Hotel, the new 39,000-squarefoot facility would sit at the corner of Herriot Street and South Broadway, with the south end of the hotel facing Astor Place. Plans also call for the construction of additional third and fourth stories above the existing two-story brick structure. The project would also include 42 parking spaces. The new building would mark the first hotel along South Broadway and

would replace a two-story commercial building that is now being used as an auto-repair shop. That shop is near a mostly residential area along Caroline Avenue and Astor Place and adjacent to a Caridad & Louie’s Restaurant. The proposed hotel would
be two blocks from St. Joseph’s Medical Center at 127 S. Broadway. According to Westchester County land records, Broadway Hospitality bought the property for $2.5 million in August. The company owns and manages a number of other hotels
and motels in Westchester County, New York City and on Long Island, including The Yonkers Gateway Motel at 300 Yonkers Ave. in Yonkers and the Apple Motor Inn at 775 Saw Mill River Road in Ardsley. Construction of the project is expected to begin
in December, according to documents filed with the Yonkers Planning Board. Interior alterations, including demolition, would begin in February and last nearly two years. Facade restoration and site work would continue into 2020 and the project could be completed
by August 2020. If approved, the hotel would join a number of other new hotels in the city. In 2015, Hyatt Place, a 155unit hotel, opened at 7000 Mall Walk in the Cross County Shopping Center, and a 150-room Hampton Inn & Suites opened at 555 Tuckahoe Road the following year. Boston-based hotel management company Pyramid Hotel Group opened the doors of the Courtyard Yonkers by Marriott at 5 Executive Blvd. last spring. The 154room hotel features more than 2,800 square feet of meeting space split between two conference rooms and was constructed to target to the burgeoning business community. Officials representing Broadway Hospitality could not be reached for comment.

From there, Girard went on to work at Brooklyn Brewery before becoming head brewer at Rockaway Brewing Co. in Long Island City in 2014. He also taught homebrewing classes at the cooking school The Brooklyn Kitchen. In his newest position, Girard said the co-owners of Yonkers Brewing, John Rubbo and Nicholas Califano, have given him the flexibility to experiment with different brews. “It was kind of like, ‘Go for it,’” he said of starting at Yonkers Brewing. “So I just hit the ground running.” Girard will follow in the footsteps of Dave Hartmann, a 25-year veteran of the craft beer industry who joined the company in 2017 and departed earlier this year. Rubbo said Hartmann helped to increase the company’s beer ratings during his tenure. Now, John hopes to let Girard have a bit of fun in the brewery. “He has his finger on the pulse,” Rubbo said. “He knows exactly what every beer consumer wants, and that’s not easy. And he has great connections to the local beer community.” Girard plans to take advantage of those connec-
tions and said he has plans to collaborate with other local breweries in the future. “Our goal is to be accessible and approachable, but we also want to be innovative,” said Rubbo, who co-founded the company in 2012. “So, this is Ray’s lab.” The new hire is just one of the changes Yonkers Brewing has seen in recent months. The company earlier this year expanded its wholesale business into Stamford, New Canaan and Greenwich. It also teamed up with The Roger Sherman Inn in New Canaan to host a beer dinner featuring its flagship brews, the 914 Vienna Lager and the Hop Runner IPA. “Yonkers is mostly known for the tougher areas,” Rubbo said, but noted that the city has a “very eclectic community.” “That’s part of the reason why we wanted to call it Yonkers (Brewing),” he said. “To sort of promote our hometown.” He added that the company will likely expand its reach into New Jersey in the near future, though he expects the brand will stay within the tristate area. “We have plenty of beer drinkers around here,” Rubbo said.

here’s something new brewing in Yonkers. Or more accurately, someone new is doing the brewing. Yonkers Brewing Co., the brewery and restaurant at 92 Main St., has added a new head brewer to its roster. Longtime beer aficionado Ray Girard joined the ranks of the 6-year-old brewery last month. “Yonkers is its own place,” said Girard, who moved to the city from Brooklyn after accepting his new position. “You’re right there next to New York City, but it’s its own thing. People have different tastes here, so I want to make something people here would really enjoy.” One of the first brews Girard introduced was his namesake Ray’s IPA, a beer he describes as a bridge between a West Coast-style and New England IPA. “That beer was a way for people to get to know my name and see my first stamp on the brewery,” he said. Other brews include a Beaux-Art Saison, named after the architectural style used in designing Untermyer Gardens, and a Utopia Parkway Pilsner, a nod to his former home in Queens. “So far, it’s been challenging in a good way,” Girard said of his new position. “I’m finding out what brews are working for people and what’s been popular.” Girard said he owes his initial attraction to the beer industry to his father, who was a brewer himself. “He was into homebrewing when it wasn’t as popular as it is now. I always found it interesting,” he recalled. “I’d ask him, ‘Do you want me to help clean bottles? I’ll do anything.’” Later, Girard secured a position with Barrier Brewing Co., a brewery and taproom in Oceanside, New York. “It went from just a passion to me taking it one step further,” he said.

“Con Edison faced many challenges during Winter Storms Riley and Quinn,” company officials wrote in a summary of the report. “While the company was able to work through these operational and restoration challenges, Con Edison recognizes, and has acknowledged, that the accuracy of the outage and restoration information provided to many customers did not meet our, nor our customers’ expectations. While Con Edison restored many customers consistent with our initial estimate, other customers received incorrect information.” The two storms disrupted electric service to nearly 210,000 customers, the company said in the report. That marks Con Edison’s second-largest outage ever, behind only the 1.1 million customer outages caused by Hurricane Sandy in 2012. About three-quarters of the outages from Riley and Quinn for Con Edison happened in Westchester County. The company racked up a bill of about $106 million to repair or replace equipment and restore electric customer service interruptions, Con

courts and swimming facilities, would remain. The course would continue to operate as a country club with about 50 acres of the property preserved. The golf course, on Cove Road, borders Delancey Cove on the Long Island Sound. The country club has operated on the land since 1944, though the course was designed in 1928. Financial troubles forced the sale of the country club property to Hampshire Recreation for $12.1 million in June 2010. Daniel Pfeffer, one of the principals of Hampshire Recreation, said the location in Mamaroneck is scenic and is a quick commute to New York City. “The size of this property provides an opportunity to design a significant number of beautiful and efficient homes in an area that has mainly older housing stock,”

Edison said in the report. Winter Storm Riley hit much harder than initial forecasts anticipated, Con Edison said, and Winter Storm Quinn’s arrival five days later exacerbated the situation. The company said virtually all the damage to its distribution system came from downed trees. Con Edison officials wrote in the report that the company’s “response went beyond restoring customers, in many areas we had to rebuild the electric distribution system.” Con Edison said it completed more than 7,000 separate repair and rebuild jobs to restore power to the region following the storms. The company compared that to Hurricane Irene in 2011, which left about 204,000 people without power but required 2,500 repair jobs.

Con Edison’s CEO John McAvoy acknowledged in a March press conference that a malfunction in the company’s storm notification software led to customers receiving false information on their power restoration status. The new report put a number to
the issue: the company estimated that 49,000 customers received incorrect notifications on when or if their power had been restored. Part of the issue came in the utility’s use of a predictive model to assume the locations of outages that customers don’t report to the company. Following Winter Storm Quinn, Con Edison officials determined that its system was over-predicting outages in some areas and provided inaccurate restoration estimations to customers. A week after Winter Storm Quinn, Con Edison
he told the Business Journal in an email. “In addition, integration of walking and bicycle paths will add to the appeal of this location.” This proposal is a shift from the company’s initial plans. An earlier proposal to the village asked its board of trustees to rezone a portion of the property to allow for condominium development. Different plans would have had either 96 or 121 condo units on a smaller portion of the property. The golf course would have been preserved as 18 holes. Hearing opposition from neighbors, the village board denied both zoning change requests. Hampshire Recreation sued in 2014, claiming the village board had acted improperly in the review. The case was eventually dismissed by a federal appellate court in 2016. A separate lawsuit filed by Hampshire Recreation claiming the village board violated New York open meetings law while denying its zoning
request is still in the courts. The developer said the current plan is permitted under Mamaroneck’s residential zoning code, meaning it would only require site plan approval from the village planning board. The condominium plan is included in the project’s draft environmental statement as an alternative proposal for the site. But the planning board would be unable to approve the condominium plan without the village board agreeing to rezone a portion of the course. Neighbors of the site and other village residents, led by the Mamaroneck Coastal Environment Coalition civic group, have pushed back against both residential proposals at the course. David Wenstrup, secretary of the environmental coalition, said the group isn’t opposed to development on the site. But the developer has not presented a plan the group views as compliant

acknowledged its communications failures and offered reimbursements to some customer for spoiled food and medicine. Individual customers who lost power for three consecutive days or more up could receive up to $225, or $515 with receipts. Business owners qualified for food spoilage reimbursements up to $10,200, also with receipts. As of the date it filed the report, Con Edison said it had settled 5,889 claims for $1.7 million. The company also said in the report that the region-
al nature of the storm made required mutual aid workers difficult to come by. “Because Winter Storm Riley impacted the entire Northeast, from Virginia to Maine, many companies were also requesting assistance and others were not releasing resources,” the report noted. That required a response from crews from as far away as Canada, New Mexico, Texas and Arizona. In total, Con Edison said it received about 1,372 utility workers through mutual assistance and contractor firms. Con Edison wrote in its
report that it still restored 90 percent of power within its initial estimate of four days. The company acknowledged, however, that “obtaining mutual assistance support sooner would have enhanced our ability to execute on work packages and restore customers faster.” The report will be reviewed by the state’s Public Service Commission. If the commission decides the company did not follow its state-approved emergency response plan, the PSC can levy financial penalties on Con Edison or other utilities affected by the storm.
with the village’s regulations. “They’re trying to create this false choice, they’re trying to say, ‘Well which proposal is better?’” Wenstrup said. “The reality is that neither is as-of-right. Both have enormous problems.” The coalition has argued that the new home construction is in a flood zone that has flooded as recently as Hurricane Sandy. Building homes could increase the flood risk for neighbors and run afoul of village law, the opponents have argued. The Mamaroneck Coastal Environment Coalition has also argued the proposal goes against the village’s comprehensive plan, could overburden its schools and increase traffic. In its draft environmental impact statement, the development team said the project’s proposed grading changes would allow all new buildings and roadways to be located outside the 100year and 500-year flood-
plains on the site. A flood analysis by the developer’s engineering team found there would be no impact to neighboring properties. “These houses will be the only residences in the area designed around the new FEMA standards,” the project’s attorney, David Cooper, said at a public hearing in April. “They’ll be elevated two feet above even the most conservative of estimates for sea-level rise.” The environmental coalition has described the analysis as inadequate. To address traffic and school concerns, the developer stated that the carriage homes will likely appeal to empty nesters who generate less traffic and have fewer school-age children. The DEIS estimates the new homes would add 57 schoolage children to the village’s school district. Hampshire Recreation has argued the residences would have a beneficial
impact on the village, citing an expected tax increase of $4.8 million a year and the addition of new housing options for downsizing residents. Pfeffer said the updated, smaller golf course concept should attract a larger membership. “A nine-hole course is appealing to many since it requires less time to play,” Pfeffer said. “The integration of the nine-hole course into the overall development plan will be an attractive feature for many prospective home buyers who may enjoy the benefit of walking out their front or rear doors and playing a few holes after a long day at work.” The final public hearing on the draft environmental impact statement lasted just under four hours. With the close of the public hearing, Hampshire Recreation will next respond in writing to the written comments by residents and the village planning board.

remium Point Investments LP inflated the value of assets in its hedge funds, according to criminal indictments and a Securities and Exchange Commission lawsuit filed on May 9, with the help of two Westchester County men. Amin Majidi, a partner in the Manhattan firm who is accused of operating the scheme, was arrested at his home in Armonk. Ashish Dole of White Plains, a former chief risk officer and trader, pleaded guilty to securities fraud and wire fraud in November. His indictment was kept secret until May 9 because he was providing investigators with detailed information. If his cooperation became known before others were charged, an assistant federal prosecutor wrote in a November application to seal Dole’s court records, “there would be a substantial risk that those targets would destroy documents or harass or threaten the defendant who remains in contact with certain subjects.” The criminal and civil cases also name Anilesh “Neil” Ahuja, the CEO and co-founder of the firm, and Jeremy Shor, a trader. Premium Point was established in 2008 and it was once considered a top trader of residential mortgage-backed securities, the indictment states. It posted double-digit annualized returns, and at its peak it managed more than $5 billion in assets. But by 2015 performance was deteriorating and major investors were asking for redemptions. “We cannot take more NAV hits,” Majidi allegedly told Shor in July 2015, in referring to the net asset value of its bonds. “We need to show performance,” he said. “We’re like the bottom third of hedge funds.” Ahuja and Majidi analyzed the performance of funds that used similar investment strategies, the SEC complaint states, and they expected their funds to track or exceed the competition. They set high-asset value targets, the feds claim, and inflated the reported value of their portfolio every month. One method was to enlist the help of corrupt brokers like Frank Dinucci Jr., who provided false bond prices. Dinucci has pleaded guilty to securities and wire fraud for his role in the scheme. He had resisted at first, the feds say, but there was a quid pro quo. Dinucci earned commissions on trades that Premium Point steered to him. “Tell Ashish dog to chuck me a damn trade,” Dinucci wrote in an encrypted WhatsApp message to Shor, “if I keep marking up all his bonds.” The scheme benefited the firm in a couple of ways. Premium Point could charge higher management and performance fees and it could forestall redemptions. It also sewed the seeds of failure. In 2016, an auditor declined to complete the 2015 audit over concerns that assets were overvalued. Premium Point publicly restated the
securities at the inflated prices. Four funds that were incorporated in the Cayman Islands are in voluntary liquidation proceedings there. Ahuja, Majidi and Shor were accused of criminal conspiracy, securities fraud and wire fraud charges that carry maximum sentences of five to 20 years and maximum fines up to $5 million or twice the gross gain or loss from the offense. The SEC is seeking court orders requiring the men and the firm to “disgorge all ill-gotten gains” and pay civil penalties. Dole is scheduled to be sentenced in 2019.

Next gen takeover requires discussions

Our parents are getting ready to retire, but I sense they’re not ready to trust that we can take over. There are four of us in the next generation. We have been in the company for a while. One of us is more serious about making something of the business and one of us has mixed feelings about sticking around to see this through. Two seem like they’re coming along for the ride. I get that our parents may have concerns, but at some point we have to move forward with having the next generation take over. How do we get there? THOUGHTS OF THE DAY: Figure out what each player wants. Set goals and document an action plan that describes what you and your parents want to accomplish with the company. Have open and frank conversations with your siblings about what each is and is not prepared to commit to. Decide if you need help negotiating details between generations. Meet with each member of the fam-
ily to find out what they want from the business. For your parents, that will mean a payout for the business they’ll be handing over and assurance that they will actually get paid if they give up control. They also probably want assurance that the next generation is prepared to step up and manage the business properly. You and your siblings need to think
about whether or not you can each be passionate about and committed to the jobs you’re taking on within the company. Life is too short to spend time doing a job one hates, so don’t put the obligation on anyone to stick around if they don’t want to. Keep in mind that the business probably cannot afford weak links and no-show employees, especially among the future owner team. Make it clear that anyone who stays with the company will have to learn about the business and play a meaningful role. If that is an expectation that doesn’t work for anyone, now’s the time to step away. Set members of the next generation on a pathway to success by ensuring that working in the company is the right thing for them or helping them to move on to what may be right for them if the company is

not a best fit. For those who decide to stay, make sure each has a training program and finds a mentor to guide their personal growth and development. Accomplishing goals and checking off “done” items on an action plan can build everyone’s confidence that progress is being made. Use those two key development tools to get both generations looking forward to the future of the business. Make sure that the goals include significant revenue and profit growth over time. While the business has provided a living for many years for your parents, you now have four owner-families to take care of in this generation, plus paying off your parents. That’s going to require much greater profits than were realized under your parents’ management. If you can’t figure out how to achieve the kind of growth needed to serve the needs of the incoming generation, deal with the problem now. Look at acquisitions. Build a strong sales team. Reduce the number of families depending on the business. Do everything you can now to fix the problem. It can be challenging taking on serious conversations about the future with family members. If you’re not prepared to do it, or you’re not getting anywhere, consider bringing in outside help. Look for experts who have successfully navigated these waters with other families. LETTER TO THE EDITOR A PEACE PLAN:
First you must know that I am an ardent Zionist. Everything I will say after this is predicated on the love of the Jewish people and of Israel. So here we go. I believe that most people simply want to live their lives in peace, earning enough money to feed themselves, their wife and their family and perhaps have some money left over for some enjoyment. Being hungry, not having a job is a recipe for problems. I remember in the early ’80s, the United States and more specifically,
the New York area was going through a recession. The people who were most affected were the uneducated minorities. They had no financial cushion. As a result of being hungry, they broke into buildings to steal copper wiring and plumbing to get enough money to feed themselves. Not a good situation. This is the plight of many Palestinians. The West Bank has in excess of 35 percent unemployment. What are they to do? Indeed, some of them are so desperate that they volunteer to be suicide bombers in exchange for $25,000. So my thinking has been evolving. My first thought was to do microfinancing. Help the Palestinians establish a business of their own where they could then employ other people who then would go out and spend money by purchasing all sorts of things. By doing this other businesses would grow, thereby enabling the Palestinian economy to grow. My next thought was similar to the Marshall Plan whereby Israel and/or the United States, etc. would help build/
rebuild the Palestinian economy. After all, it worked for Germany and Japan where after the war America came in and helped rebuild their economies where today Germany and Japan are two of America’s closest allies. The Palestinian man I am dealing with, Sam Bahour (look him up) didn’t pick up on this idea. We then began to talk about skills that the Palestinians have, for example, software development, programming, furniture manufacturing, tile and marble textiles, etc. I began to think about ways of marketing skills like this into the United States. After all, for two of our companies, my son Jason used software development people from Russia. After some conversation, Sam mentioned that there is an accomplished furniture manufacturing business there. I said, great, this is something specific and I felt/feel that I know how to market this in the United States. We are currently getting brochures on what type of furniture they manufacture and what is their capacity to
manufacture in quantity. Another conversation that Sam and I had involved water to Janine. Although there are restrictions on drilling wells, there are no restrictions on water conservation, recycling or water purification. Eighty percent of all the water used in cities in Israel is recycled and then used for irrigation. Until recently, the last 10 to 15 years, Israel did not have desalination. All it’s growth was supported by water conservation, etc. This is something that we’re now looking into. It is my hope, my dream and my belief that when people are satisfied with their lives, have water to drink and food to eat they’re not like to want war. estchester County developer Martin Ginsburg has landed a $120 million loan to help finance his vision for a new “City Square” in downtown White Plains. Avison Young’s New York Capital Markets group announced that it has arranged a $120.3 million loan for the acquisition and redevelopment of the Westchester Financial Center near the Metro-North train station. The buyers are a joint venture of Ginsburg Development Cos. and Robert Martin Co. Ginsburg’s company will lead a mixeduse redevelopment of the two-property office complex, which includes 571,000 square feet of office space in separate buildings at 50 Main St. and 1-11 Martine Ave. Plans announced in April by the company would combine the two office properties with a 124-unit apartment building on the same block, at 34 S. Lexington Ave., to create City Square, a concept that includes apartments, green space, restaurants, retail and renovated offices. Mack-Cali Realty Corp. sold GDC and Robert Martin the two buildings last month for $83 million. Ginsburg’s GDC bought the separate apartment building for $35 million last year. Avison Young said the new financing will cover the purchase price of Westchester Financial Center, residential conversion costs, tenant improvements, capital expenditures, closing fees and other financing costs for the project. The Avison Young release did not disclose the lender, but the Commercial Observer reported earlier this month that the financing comes from Bridge Investment Group, a Salt Lake City-based real estate investment and property management company.

A
state task force created to address the impact of the planned closing of Indian Point Energy Center is asking the nuclear plant’s owner and operator to consider opening up parts of the site to development. The recommendation was one of several in a 280page annual report the Indian Point Closure Task Force released May 9. The task force was created last year by Gov. Andrew M. Cuomo shortly after he announced a state settlement with Entergy Corp. that would fully shut down the company’s Indian Point nuclear plant by 2021. The annual report is the first of six the task force will release through 2023 addressing challenges the closing of the plant will create in the village of
Buchanan, town of Cortlandt and Westchester County. A call for redevelopment of the plant follows the New York State Energy Research and Development Authority commissioning a reuse study last October from D.L. English Consulting Inc., a South Dartmouth, Massachusettsbased firm focused on the energy industry. The state panel included a finalized version D.L. English’s report in its annual filing. “The task force recommends that, based on the D.L. English report on possible reuse opportunities at the plant site, Entergy agree to release segments of the Indian Point property as soon as practicable to the appropriate development entity,” one of the conclusions in the report read. Entergy has said it’s waiting to finalize its own decommissioning plan before making any decisions. But in the meantime, the state is exploring possibilities for the land.

The D.L. English report identifies three separate parcels on the 240-acre site that it says are capable of being reused relatively soon. The parcels are referred to as “non-impacted” land, meaning it’s suitable for near-term use. The first such parcel, identified as Parcel A, is a 50-acre tract on the southeast side of the property near Broadway. The land has a training facility for Entergy. The best use of the land,

according to an appraisal included in the report, is to either repurpose the training facility into an office or data center, or clear the site for manufacturing and heavy industrial use. The second, Parcel B, includes about 50 acres of undeveloped land on the north side of the property. The site is wooded, rocky and potentially home to endangered animal species, the report notes, limiting potential redevelopment scenarios. “If the state and local laws did not impact the near-term development of this parcel, it would support non-energy production/commercial and energy production opportunities,” the consulting firm wrote in its report. “Renewable energy production is likely to be restricted to wind.” A separate 17-acre parcel across Broadway from the main campus could also support near-term development similar to the uses suggest-
ed for Parcel A, according to D.L. English. The report noted that the site’s limited acreage and a natural gas transmission line that runs through it would likely limit the scale of any future opportunities. The report’s suggestions are meant more as a starting point for future discussion on the land’s redevelopment. In the conclusion to the report, D.L. English officials said their goal is only to provide facts to help guide the decision making of the state task force, Cortlandt and Buchanan. The task force’s annual report also attempts to address concerns about lost tax revenue after Indian Point’s closing. Buchanan is set to lose $3.5 million per year, a little less than half its annual budget. The Hendrick Hudson School District, meanwhile, could lose $23 million per year, about onethird of its annual budget. Cortlandt will lose $900,000 per year in revenue without Indian Point, about 2 percent
of its budget. The report recommends the Hudson Valley Regional Economic Development Council set aside funds to focus on attracting economic development to tax jurisdictions affected by Indian Point’s closing. It also notes the $30 million the state appropriated in its 2016-17 fiscal year budget to the Electric Generation Facility Cessation Mitigation Program, created to support communities affected by the shutdown of a power plant. Another $24 million was added to the fund in this year’s budget at the urging of state Sen. Terrence Murphy and Assemblywoman Sandy Galef, who each represent areas affected by the closing. The task force said in the report that it will focus on finding “new economic development opportunities in the affected taxing jurisdictions that can help to replace lost PILOT (payments in lieu of taxes) revenue.”

Latimer lays out plans for discussing future of Westchester County Airport BY ALEESIA FORNI aforni@westfairinc.com

ounty Executive George Latimer announced at a press conference on May 16 the next steps his administration would take with regard to the Westchester County Airport. “We are laying out a process, without presuming what the final product will be, that results in a combination of citizen input, legislative discussion, executive branch review, input from professionals who run the airport and ultimately public policy that is set by my office and the board of legislators,” Latimer said. “This is what I believe has been missing in terms of dealing with airport issues.” Latimer said he planned to encourage the county legislators to “explore the
issue” of bringing in an outside firm to operate the airport. Last year, Macquarie Infrastructure Corp. was selected by then-County Executive Robert P. Astorino in a $1.1 billion public-private partnership. Latimer said that the selection of Macquarie was made without sufficient discussion by the board of legislators and members of the public. To help remedy the issue, community members are invited to give their input at a meeting to be held on June 11 at the Hergenhan Recreation Center in Armonk. “At that meeting, we’ll begin the process to hear public opinions about whether or not we should change the governance of the airport,” Latimer said. Latimer hoped a decision regarding the operation of the airport would be made by mid-October.

Administration (FAA) to develop a master plan for the airport, a document that has been in the works since 2013. The last airport master plan dates to 1987. The FAA has given the county a deadline of July 15 to submit a new master plan. Latimer said that in order to comply with that deadline, the county must submit the master plan that was developed for the Astorino administration by aviation consulting firm DY Consultants. The county paid DY Consultants $1.4 million to craft that master plan, though it was met with opposition from many community members. Latimer said his administration plans to immediately begin work on a supplement to the master plan. The county will host a meeting June 6 at the Rye Brook Village Hall to “begin the process of a master plan supplement discussion.”
“We know there’s a great interest in this issue and we intend to make this as open and as public a dialogue as is possible,” he said. The county will also conduct a review of the airport’s operations. A public meeting covering that topic will be held on June 25 at the West Harrison Senior Center. “I want to make sure that we have a public discussion about those operational issues,” Latimer said. “I want to make sure we hear directly from the public on exactly what those problems are.” The county will also appoint new members to the Airport Advisory Board next month. “The change of the airport advisory board in principle is so that we get a group of individuals who are prepared to deal with these issues on an ongoing basis,” Latimer said.

he approved plans from Wegmans Family Markets Inc. to build the grocer’s first Westchester County store in Harrison will be back in front of the town’s planning board this month for a slight amendment to the site layout. At its May 22 regular monthly meeting, the Harrison Planning Board is expected to review an amended site plan proposal from Wegmans. The amendment moves a smaller, standalone retail structure closer to the larger grocery store. In August 2017, the Harrison Town Board gave final approvals to a plan from Wegmans to build a 125,000-square-foot grocery store on the site of three vacant office buildings — 106, 108 and 110 Corporate Park Drive. The plans also include an 8,000-square-foot satellite building for an additional retail use. The approved site plan places the structure on the northeast

side of the property near Corporate Park Drive. Wegmans officials are now asking the planning board to approve an amended plan that has the additional retail space abut the north side of the grocery store. The square footage remains the same for both the main grocery store and the additional retail structure. “We’d like to move the retail outparcel next to our store as a practical way to improve parking lot safety, traffic flow and convenience for our customers,” a Wegmans spokesperson said in an email. he owners of diners in Yonkers and Hawthorne said they were forced to file for bankruptcy because of an $837,000 federal fine that was assessed last year for paying workers less than they had earned. American Classic Broadway Diner in Yonkers and American Classic Executive Diner in Hawthorne filed for Chapter 11 reorganization on May 2 in federal bankruptcy court in White Plains. “It is the debtor’s intention to immediately seek mediation and reach a settlement” with the U.S. Department of Labor, vice president Gulam R. Khan
said in an affidavit, “that will enable the debtor to successfully emerge from Chapter 11.” Both diners list a Labor Department judgment for $837,356, that they characterize as disputed, as their greatest unsecured debt. The diners filed bankruptcy petitions under their corporate names, Chrisevan Corp. for the Yonkers restaurant and American Diner Group Inc. for the Hawthorne location. The restaurants are operated by four brothers who share the same first name, Gulam, or spelled Gulan in some documents. Their middle names are Haider, Rabbani, Usmani and Zilani. The owner of record for both businesses, according to court records, is Rabbani
yet to identify a tenant for the space, “but we anticipate it will be a complementary format to our business.” Wegmans officially closed on its $26.5 million purchase of the property in January. A visit to the Corporate Park Drive site on May 16 showed the three office buildings have been mostly removed from the site. While it’s unclear what the site plan amendment means for the store’s construction timeline, Wegmans officials estimated construction of the project would take 18 months in the company’s filing to the planning board.

Khan’s wife, Suhela Khan. The family has operated the diners for 12 years, with 30 employees in Yonkers and 23 in Hawthorne. The Labor Department accused the Khans of requiring workers to routinely work six days a week for 10 hours or more, according to a complaint filed in 2016, and of not paying the minimum wage or overtime to 29 workers. Some busboys, for example, worked 55 to 66 hours a week for $25 a day. Even with tips of $200 to $300 a week, the agency charged, busboys often earned less than the $7.25 hourly minimum. The Labor Department also accused the Khans of creating false payroll records, paying people in cash and off the books and directing workers to lie to investigators. The Khans did not formally respond to the accusations.

BRIEFLY AFFORDABLE HOUSING PROJECTS RECEIVE $37M FROM STATE

About $37 million in state funding will help build affordable housing in the mid-Hudson Valley region, Gov. Andrew M. Cuomo announced. The governor's office said $37.2 million will go to the region as part of a $200 million state effort to build more than 28,000 affordable apartments across New York. The funds were made available through New York State Homes & Community Renewal's 2017 Unified Funding Application, which developers can use to apply for the federal Low Income Housing Tax Credits the state distributes, as well as low-interest loans for affordable multifamily developments. The state has committed $20 billion to a five-year housing plan, Cuomo said. The plan aims to make housing more accessible and combat homelessness. In Westchester County, Elmsford-based developer Wilder Balter Partners Inc. will receive $5.2 million in state funding toward a 42-apartment development in Lewisboro. Called Lewisboro Commons, the project would provide affordable housing for families and individuals in a residential neighborhood near the Goldens Bridge Metro-North train stop. The project will receive about $1 million in low-income housing tax credits and $4.2 million from the state's Housing Trust Fund program. The town’s planning board is reviewing the proposal.

Other Hudson Valley projects include: • $6.3 million for RUPCO Energy Square in Kingston. The 57-unit mixed-income, mixed-use building from nonprofit developer RUPCO, includes nine units for persons who are homeless, seven of which will receive services and operating subsidies through Gov. Cuomo’s Empire State Supportive Housing Initiative. The Energy Square project was also awarded $1 million in New York State Energy Research & Development Agency funding to incorporate technologies and energy savings features that will enable it to reach net zero energy performance, meaning the project produces as much energy as it uses. • $4.5 Million for West End Lofts in Beacon. The project, from Kearney Realty & Development Group Inc., involves construction of 73 affordable apartments for middle-income families and individuals, including 11 units for persons with physical disabilities/traumatic brain injury. The development is in close proximity to the Beacon’s Metro-North train station.
SALSA FRESCA ROLLS OUT NEW FOOD TRUCK

Salsa Fresca Mexican Grill, a popular chain of restaurants in New York and Connecticut, plans to bring its fast-casual concept to the road. The eatery announced that it will launch a new food truck program. The truck will be brought on site at special events in New York and Connecticut and will also be available for private events. “Our fresh, never-frozen ingredients have always been a big factor in our success and popularity,” said Marc Miles, co-founder of Salsa Fresca Mexican Grill. “We've seen tremendous excitement around every
new location, and the popular food truck trend gives us another opportunity to serve built-up demand in many other locations and at special events throughout Connecticut and New York.” The food truck will carry a selection of Salsa Fresca's offerings, including tacos, burrito bowls and nachos. The news follows the chain’s announcement of plans to franchise its brand, with a goal of creating 100 new stores in the next five years. HUDSON RIVER ESTUARY TO RECEIVE $350,000

New York is offering additional funds to projects that protect natural resources along the Hudson River. The New York state Department of Environmental Conservation announced that $350,000 in competitive grant funding is available to projects in communities in the Hudson River Estuary watershed. The money will help fund projects that increase resiliency to flooding, enhance natural resources and protect water quality and wildlife. The grants are administered through the DEC’s Hudson River Estuary program, which has awarded 495 grants totaling more than $19 million since 1987. The estuary program focuses on the Hudson and its adjacent watershed from Troy to the Verrazano Narrows in New York City. The minimum grant award is $10,500 and the maximum award is $50,000. WALKING DOGS FOR A CAUSE The 2018 SPCA of Westchester Walk and Pet Fair was held at Franklin D. Roosevelt State Park in Yorktown Heights on May 6 to raise funds for the organization. There were exhibits and vendors, and teams and individuals with dogs walking a scenic 2.5-mile path. The event, a fundraiser supporting the organization’s mission of protecting animal welfare by providing shelter, rehabilitation, adoption services and help in locating lost pets. More than 25 employees from the White Plains-headquartered company Pentegra, that has an office in Shelton, Connecticut, were among those participating. Pentegra
CEO John Pinto explained that they were honoring Erica Farland of Ossining. The White Plains native worked at Pentegra and was an animal lover. She died in 2017 at age 27. Pinto said, “We wanted to walk in Erica’s memory for this cause that was not only special to her heart, but also an initiative that we at Pentegra deeply believe in. We have done other animal-adoption-related work, particularly wanting to pair retirees – our clients – with adoptable dogs. Plus, my family has several of our own rescue dogs. So, our involvement with this SPCA walk was special for us on many levels.”

HONORS CONFERRED BY MHA Diane Russo, CEO of the CoveCare Center in Carmel, was honored by the Brewster-based Mental Health Association in Putnam (MHA) during a breakfast event at the Putnam County Golf Course in Mahopac. She was presented with the Rabbi Solomon B. Acrish, Ph.D. Humanitarian Award for her 20 years of professional service to improve the lives of those facing mental health and substance use-issues. Megan Castellano, executive director of MHA, said, “I admire her steadfast dedication to the community and her commitment to improving the lives of the most vulnerable among us while demonstrating leadership, compassion and kindness to everyone she meets.” Armanda Famiglietti of the organization Locally Sourced was honored for her efforts to inform and support those in the community with mental health needs. The staff of HH Wells Middle School in Brewster, represented by Jeanmarie Mullen, was honored for its fundraising efforts to help MHA.

The Crusaders Men’s Club at Archbishop Stepinac High School in White Plains recognized three members of the school’s athletics program for their contributions during a dinner at the school attended by 250 members of the school’s parent organization and Stepinac staff. The name Crusaders is used for the school’s teams. The honorees were Matthew Hogan, Jon Demarco and Max Anderson. Hogan is head coach of the school’s varsity hockey and golf teams as well as a member of the faculty. He’s been with the school 16 years and coached the hockey team to the 2017 league championship victory. Demarco, is defensive coordinator of the varsity football team that he has helped coach for the past 12 years. Anderson is the athletic trainer and physical therapist. Earlier this year, he saved the life of a teenage basketball player by administering CPR after the boy fell and hit his head on the gym floor.

UNITED WAY PROMOTES THINKING ABOUT CHANGE It was a sold-out house of more than 600 at the DoubleTree in Tarrytown on May 7 for the United Way’s daylong summit for nonprofit thinking and change. There were addresses by New York Lt. Gov. Kathy Hochul, Congresswoman Nita Lowey and Westchester County Executive George Latimer. The day also included morning and afternoon breakout sessions covering change in the world of philanthropy and nonprofits. Breakfast keynote speaker Vu Le, an author and executive director of the Seattle-based Rainier Valley Corps, reminded those in attendance that it’s easy to lose sight of what’s important in the daily flurry of events. Both Lowey and Latimer lauded the work of nonprofits as community partners with indispensable skill sets and vision. The luncheon keynote speaker Bridget Gavaghan, director of the National Human Services Assembly’s National Reframing Initiative, said nonprofits need to steer away from unproductive messages that trigger cultural and individual biases. Alana Sweeny, president and CEO of the United Way of Westchester and Putnam, said, “Navigating change is not easy, nor always comfortable – and we hope that people were able to take away some valuable ideas that will strengthen their organizations.”

LISTEN UP: IT’S THE SARAH AWARDS Sarah Lawrence College in Bronxville has teamed up with Audible, a subsidiary of Amazon, for the Sarah Lawrence International Audio Fiction Awards (The Sarahs), that honor the best in audio fiction. Spoken-word recordings, audio books and radio dramas have been growing in popularity. The competition considered more than 200 works from around the world representing a variety of audio works from science fiction to bilingual dramas. The winners were announced during an event at The Player’s Club in Manhattan. “This year’s entries produced the most international field of audio fiction we have had since The Sarahs launched,” said faculty member Ann Heppermann, who along with
Martin Johnson of Stockholm created the awards three years ago. First place went to “Jayne Lake” by Russel Finch of the United Kingdom for his story about Meggie who lost her sight in an acid attack. It was produced by BBC Radio 4. The second place award went to Canadians Mira Burt-Wintonick and Cristal Duhaime for their version of “Romeo & Juliet.” Other award winners were from the U.S. and Croatia. This year’s judges were: Berry Sykes of Podcasts in Color; Nicholas Quah of Hot Pod and Vulture; Julie Shapiro from RadioTopia; Andrea Silenzi of Stitcher and Panoply, and Carola Haupt of Radio Papesse in Florence, Italy.

CST EVENT RAISES $415K More than 300 guests gathered at the Willow Ridge Country Club in Harrison to celebrate the 40th anniversary of Cancer Support Team (CST), the Westchester-based home care services provider. The nonprofit is dedicated to helping patients and their families at no cost and without regard to insurance. The cocktail reception and dinner, that included a silent auction and Fund-A-Need live auction, raised more than $415,000 for CST. CST’s 40th Anniversary Legacy Award was presented to Betty Wald and the Lee family to honor the memory of CST’s co-founders, Dr. Arnold M. Wald and Gayle K. Lee, a registered nurse, for their efforts to enhance the quality of life of individuals and families affected by cancer. Legacy award recipients also included Tony Sibio and Frank Webers, both of the Long Island Sound chapter of Swim Across America, a nonprofit organization that has supported CST for the past 20 years.

LIONS CLUB SUPPORTS HIGH SCHOOL EXCHANGE CLUB At a time when summit conferences, shifting international alliances and conflicts between nations dominate news headlines, international understanding is being built one person at a time in local schools through activities such as foreign exchange clubs. One example: Horace Greeley High School’s Foreign Exchange Club, with the support of the Lions Club of Pound Ridge, has been running a student exchange program between Horace Greeley in Chappaqua and Carey Baptist Grammar School in Melbourne, Australia. Now in its eighth year, the exchange offers four students from Horace Greeley the opportunity to explore Australia for six weeks, and four students from Carey to do the same in Chappaqua. This is a direct, reciprocal exchange, which means that participating students will live in each other’s houses while in the foreign country. The exchange has been sponsored by the Lions Club of Pound Ridge since its inception. The Carey students, their high school hosts and other members of the exchange club, came to a recent Pound Ridge Lions Club meeting to share their gratitude and experiences. In addition, the students presented more than 50 pairs of used eyeglasses that they had collected by setting up donation boxes in all six Chappaqua Schools for the Lions Club’s Eyeglass Recycling Program. The students travel to Melbourne in early July.
RAND RECEIVES NEWSMAKER AWARD Joseph Rand, general manager and chief creative officer of Better Homes and Gardens Rand Realty has been named winner of the 2018 RISMedia Real Estate Newsmakers Award. The broker is headquartered in Nanuet and has 28 offices serving Westchester, Rockland, Orange, Putnam, and Dutchess counties in New York, as well as Bergen, Passaic, and Morris counties in New Jersey. An award ceremony and dinner at the National Press Club in Washington, D.C., was scheduled to coincide with the National Association of Realtors Legislative Meetings & Trade Expo taking place in the nation’s capital. This is the first year for the awards, designed to recognize those individuals making headlines for their newsworthy contributions to the real estate industry. Rand’s recently published book, “Disruptors, Discounters, and Doubters: Five Key Changes the Real Estate Industry Can Make to Improve Client Experiences and Protect Our Future” reflects how the real estate industry must embrace change in order to meet consumer’s demands.

UNITED HEBREW’S COMMUNITY SERVICE AWARDS United Hebrew of New Rochelle honored two top executives and a New Rochelle artist at the organization’s Seventh Annual Community Service Awards. “It’s been said that it is easy to sit up and take notice – what’s extraordinary is the way these three individuals stand up and take action,” said Rita Mabli, president and CEO of United Hebrew. Honored were Jeff Menkes, president and chief executive officer at Burke Rehabilitation Hospital, Eileen Davidson, president of The Ursuline School, an independent all-girls Catholic college preparatory school in New Rochelle and Charles Fazzino a popular and highly collected pop artist based in New Rochelle. At Burke, Menkes leads the inpatient hospital and outpatient division as well as Burke’s educational and community programs. Davidson in 2012 was appointed as the first lay president of The Ursuline School. She focuses on strategy, global education and the fiscal health of the school. Fazzino is known for his silk screen serigraphs in a pop-art style. His artwork has been exhibited in hundreds of museums and galleries in more than 20 countries.
