he importance of Westchester County Airport to the area’s business community was highlighted on June 6 when the National Business Aviation Association held a regional forum there. The NBAA has about 11,000 corporate members and is a major nationwide force in promoting business aviation and lobbying to
protect the industry. One of the airport’s runways was closed for an exhibit of hundreds of millions of dollars worth of the latest corporate aircraft that had been flown in for the event. The new hangar at fixed base operator Million Air was turned into an exhibition hall where the latest aviation technology was on display and education sessions were held. Airport operations continued despite the presence of several thousand visitors and hundreds
of cars parked on an area of the grass between the runways and taxiways, with airport personnel and Westchester County Police handling security. In a welcoming speech, Peter Scherrer, manager of the airport, said there are 1,900 people employed there. “Most of them are full-time jobs,” he said. “They rely on business aviation, because business aviation at this airport is a lion’s share of my revenue.” He » AIRCRAFTS

STEINER SPORTS MEMORABILIA FILES CLOSING NOTICE; SALE REPORTED BY PETER KATZ pkatz@westfairinc.com STEINER SPORTS MEMORABILIA INC., WHICH GREW from a one-man startup in 1987 to become a powerhouse in the sports collectibles field, has filed a plant closing notice with the New York State Department of Labor. Its closing date is Oct. 29 and all 60 of its employees will be affected. Steiner is headquartered at 145 Huguenot St. in New Rochelle and has additional locations in
Brooklyn, Garden City and Manhattan. The closing notice coincides with reports that many of Steiner Sports’ assets have been acquired by Fanatics Inc., a global sports merchandise operator. The reports say that Steiner Sports employees were notified about the sale to Fanatics during the weekend of June 1. Westchester IDA approves $1.7M subsidy for Simone medical building BY BILL HELTZEL bheltzel@westfairinc.com

he Westchester Industrial Development Agency granted final approval last month for $1.7 million in tax exemptions to convert a vacant Harrison office building into medical offices. Simone Development Cos. plans to spend $61 million on renovating and expanding 104 Corporate Park Drive for a pediatric medical center and cancer treatment center for adults and children. Montefiore Medical Center will lease the pediatric center for 20 to 30 years, according to project documents, and Simone is discussing a deal with Montefiore and White Plains Hospital to lease the oncology center. The IDA granted a $1.3 million exemption on state and local sales taxes on an estimated $18 million in construction materials. It approved a mortgage tax exemption of nearly $420,000. A Simone subsidiary bought the 6.5-acre property last year for $14 million from an affiliate of HistoGenetics of Ossining. Simone mortgaged the property to M&T Bank for $11.6 million and

petitioned for a $150,800 mortgage recording tax exemption. The $420,000 exemption, according to the IDA resolution, is based on about $42 million in mortgage financing that includes a construction loan. Simone is also negotiating
with Harrison for a property tax abatement. The property is across from a Wegmans grocery store under construction, and near the Life Time Fitness gym and proposed apartment buildings. The pediatric center will use three floors of the four-story, 115,000-square-foot structure. It will include facilities for urgent care, imaging, labs, behavioral health, maternal fetal medicine, sports medicine, infusions, rehabilitation and other specialties. The first floor will be used for oncology services and include
a 5,000-square-foot addition to house a linear accelerator for radiation treatments. Health care facilities require more infrastructure, according to Simone’s IDA application, including larger elevators, redundant mechanical systems and higher capacity water and electrical systems. A three-level, 200-car parking garage will be built and a new roof will be installed. Simone’s in-house contractor, MCG Construction, will be the project manager. The company has no project labor agreement with the area’s Building and Construction Trades Council, and it is not committed to using union labor, paying prevailing wages or hiring a particular percentage of local workers. The developer will evaluate subcontractor bids on their ability to execute in a timely manner, quality of work and price, according to the IDA application. “Where appropriate,” Simone states in the application, it will hire local labor. Construction is expected to take 24 months and employ about 100 workers. The facilities are expected to create 250 permanent health care jobs and 65 positions for doctors.

he New Rochelle Industrial Development Agency has granted preliminary approval for two apartment projects that would give developers at least $23 million in tax subsidies. Huguenot Partners LLC proposed a 28-story structure at Huguenot Street and Centre Avenue at the May 29 IDA meeting. Mill Creek Residential Trust LLC presented plans for an eight-story structure at 24 Maple Ave. The projects are expected to cost $241 million and create 619 dwellings. The Huguenot project would be built by Fuller Development Co., a subsidiary of the Cappelli Organization of White Plains. The

applicant, Huguenot Partners, is affiliated with DHA Capital of Manhattan. Huguenot Partners initially proposed two 14-story towers but now wants to build one, 240,000-square-foot, 28-story tower. It would have 285 apartments, an indoor swimming pool, fitness center, lounge, yoga room, game room, parking garage and 1,000 square feet of retail space. The $100 million project would be marketed to empty nesters, young professional couples with no children and professional singles, according to the IDA application. The developers hope to begin construction in August and finish by late 2021. The project would employ about 300 construction workers and then 15 full-time employees. The IDA board agreed to a
$3.6 million sales tax exemption and $2.1 million mortgage tax exemption. The developers also want property tax abatement for 20 years, but the preliminary IDA application does not include a schedule of payments in lieu of taxes that would disclose the size of the subsidy. The previous proposal for two 14-story buildings asked for property tax abatement worth $11.5 million over 20 years. The Maple Avenue developer — Mill Creek Residential Trust — is based in Dallas. The apartments would replace a vacant Catholic school on property owned by the adjacent Church of the Blessed Sacrament. The $140.6 million, 310,499square-foot structure would include 334 apartments, a fitness center, home offices, clubroom, rooftop lounge,
indoor parking, three courtyards, a public “art alley” and a 2,400-square-foot nonpublic parish hall for Blessed Sacrament. The project would employ about 700 construction workers and then 10 full-time employees. The developer hopes to begin work by the end of the year and finish in the fall of 2022. The proposal calls for an $843,612 mortgage tax exemption, $3.7 million sales tax exemption and 20-year tax abatement deal that would cost $19.3 million in payments and save $12.7 million in property taxes. The vacant school property pays no property taxes. Both proposals will be evaluated by the IDA’s economic consultant, National Development Council, and presented at public hearings before the agency considers final approvals.

acy’s, which has been a fixture at the Galleria shopping mall in White Plains, has sold the site it occupies to the owner of the mall, WP Galleria Realty LP of El Segundo, California, an entity of Pacific Retail Capital Partners, for $27 million. Macy’s held title to the property it has been occupying since it moved into the Galleria from its former standalone site at the corner of Mamaroneck Avenue and Main Street, which eventually was torn down
to make way for developer Louis Cappelli to build the City Center. The property had been in the name of Macy’s Retail Holdings Inc. of Cincinnati. A spokesperson for Macy’s told the Business Journal, “As part of its real estate strategy, Macy’s Inc. has been reviewing its real estate portfolio across the country to see if there are opportunities to improve the use of our assets. After careful consideration, Macy’s has decided to sell the White Plains store. We will continue to operate the store under a lease and the store will operate as it does today.”
Pacific Retail Capital Partners told the Business Journal it "has purchased the Macy’s store that anchors the east end of the Galleria at White Plains from the retailer, positioning it for future growth and master planning opportunities. Macy’s will continue to operate the department store which spans the block between Main Street and Martine Avenue. This investment demonstrates Pacific Retail’s ongoing commitment to the White Plains community and the Galleria, which has been a signature element of the city’s downtown since opening almost 40 years ago.”

BRE, the real estate services and investment firm, has announced that two new leases have been signed for space in Bridge Street on Hudson, a commercial office complex on the Hudson River waterfront in Irvington. The office buildings carry the addresses One and Two Bridge St., Three W. Main St. and 50 Buckhout South Street. The property had been a century-old warehouse/factory before being converted into office buildings.
One lease was signed by PECO Pallet, which offers pallet rental services and logistics, for 7,000 square feet on the third floor of 50 Buckhout South St. The Nantucket Project, which stages a four-day event on Nantucket Island off the Massachusetts coast, signed the second lease. It has taken 12,100 square feet at Two Bridge St. Past presenters at its event have included wellknown figures such as Tony Blair, George W. Bush, Julie Taylor, Neil Young and Jennifer Garner. Brian Carcaterra and Michael McCall of CBRE
are the property’s exclusive leasing agents. Kevin Langtry of NKF represented The Nantucket Project, which decided to move from Greenwich, Connecticut, to Irvington. Average rents at Bridge Street on Hudson range from $24 to $48 per square foot. The buildings contain a total of 350,000 square feet. The complex is adjacent to the Metro-North train station in Irvington and offers amenities such as a riverside outdoor patio and an on-site café. The restaurants MP Taverna and Red Hat on the River are located at the complex.
I recently consulted with a 92 year-old who had never executed a Last Will and Testament and/ or any other form of estate or longterm care planning. I asked her why she waited so long to see an attorney and she stated that “I’ve been very busy the last 91 years.” While it is true that life often seems to pass by at lighting speed, I still believe that in 91 or so years she could have (and should have!) found an hour or so to consult with an attorney. When I looked across the table at the client’s daughter, she shrugged and said that she had been asking her to do it for at least 20 years. For many, approaching a parent about whether or not they have done estate and or long-term planning can be an uncomfortable and intimidating task. As a practicing attorney for almost 35 years, I know full well that some parents never discuss their personal finances and planning with their children. It is something they feel is no one’s business. However, I also know that this can often be quite unfortunate for both the parent(s) and the child(ren). The lack of knowledge about the parent’s finances often becomes problematic especially if a parent is taken ill, rendered incapacitated and/or unexpectedly passes away. Under said circumstances, the family is often hampered in its ability to gather the necessary financial information and documents to apply for Medicaid, and/or take the necessary steps to protect one’s assets from the cost of long-term care. Additionally, when the parent passes away, children are often left scampering to try and piece together information relevant to the decedent’s finances for the requisite estate and tax filings. Clearly, if a child is unsure as to whether the parent has done any planning it is best for the child to raise the issue with the parent. The child can directly ask the parent whether or not he or she has done any longterm care planning and if not, recommend that they consult with an experienced elder law attorney. However, if this approach is not effective, the child(ren) may need to resort to a more creative approach. Some of the tactics used by children that have helped their parents are as follows: (a) Taking steps to educate one’s parent(s) about the advantages of engaging in long term care planning. For example, providing them with articles about the cost of long-term care (nursing homes/ home care), the use of a Medicaid Asset Protection Trust to protect assets from said cost and Medicaid eligibility requirements. It is not unusual for a parent to be poorly informed about the devastating impact
that long term care costs can have on his or her finances if they are unable to become eligible for Medicaid. Articles are available on our website at www.esslawfirm.com; (b) Inquire with your family and friends about the issues they have faced when a parent and/or grandparent has been taken ill or been diagnosed with dementia. This is especially relevant if they have a family member that needs home care and/or nursing home care. Share these stories with one’s parent. There is nothing better than real life stories by a member of one’s family or friends to motivate a parent into taking action; (c) Offer to pay for the parent(s) initial consultation with the elder law attorney. I have found that in some instances children who are willing to finance the cost of the consultation, and in some cases even pay for the planning can help a parent who is reluctant to spend for a plan is of significant assistance in helping the parent to act. This would of course require the consent of the parent; (d) If the parent(s) still resist any attempt to engage in long term care planning, such as creating and funding a Medicaid trust, gifting of assets and/or purchasing long term care insurance (if insurance is an available option); a step that could prove to be very helpful in the event of the parents incapacity is to have the parent execute a Durable General Power of Attorney with broad provisions that allow the agent to engage in Medicaid/ Long term care planning for the parents. Whether a client is 65 or 90 years of age, their taking requisite steps to protect their life savings from cost of long-term care is better than not taking any steps to do so. It is always better to be late than to have never planned at all when it comes to long term care and/or estate planning. *Anthony J. A
Mamaroneck company claims that a UK beverage maker fabricated problems to cancel their distribution deal. Brands Within Reach LLC sued Belvoir Fruit Farms Ltd. on May 28 in federal court in White Plains for $2.5 million. Belvoir, the complaint states, believed “it could make more money on its beverage products — which BWR (Brands Within Reach) had spent years introducing, branding and distributing in the marketplace — by cutting out the distributor.” Belvoir did not respond to an email request for comment. Brands Within Reach owns the marketing and distribution rights to several food and beverage products, such as Evian water, Illy coffee and Nestea teas. Mamaroneck resident Olivier Sonnois, a former Danone executive, founded the company in 2003. Sonnois has agreed to sell Brands Within Reach to New Age Beverages Corp. of Denver for an undisclosed price, according to a New Age news release. Belvoir, based in Leicestershire in the English Midlands, produces fruit cordials, pressés and mixers. In 2012, the companies negotiated a deal for Brands Within Reach to market and distribute
Belvoir’s beverages in the U.S. and Canada. The deal automatically renewed in 2017 for three years. If the deal were to terminate without cause, the complaint states, Belvoir would have to pay Brands Within Reach $5 per case of products sold from the beginning of the agreement, or reimburse Brands for all of its overhead, marketing and regulatory costs. Belvoir recently tried to renegotiate the terms, according to the complaint, to remove the termination fee. When Brands Within Reach refused, Belvoir allegedly claimed that Brands had breached the agreement by, for example, failing to make payments on time and misstating the sales volume. All six alleged breaches are “phony,” the complaint states. Belvoir notified Brands Within Reach on May 8 that it was canceling the agreement and demanding £320,341— about $404,605 — for outstanding invoices. Brands Within Reach is asking the court to declare that Belvoir has breached the contract and to order Belvoir to pay a $2,462,835 termination fee. Brands Within Reach is represented by Anthony M. Rainone of Brach Eichler LLC of Roseland, New Jersey. Brands Within Reach’s new owner, New Age Beverages, promotes itself as a one-stop shop for healthy beverages. Cab drivers hacked off with Westchester County Taxi Commission BY BILL HELTZEL bheltzel@westfairinc.com

ocally licensed taxi drivers and the Westchester County Taxi & Limousine Commission, according to an attorney, “are fighting a mini-war.” The TLC issued $15,400 in fines over a 70-day period, when some cabbies tried to pick up customers at the Westchester County Medical Center. Arrow Taxi, Splendid Taxi and five drivers represented by attorney Jeffrey I. Klein claim that the TLC has no legal authority to regulate local taxis. They petitioned Westchester Supreme Court last month to dismiss the tickets and stop county police from issuing the summonses. Spokeswoman Catherine Cioffi said the county does not comment on pending litigation. The tickets can be burdensome, as traditional taxi drivers are seeing their incomes drastically curtailed by competition from lightly regulated services such as Uber and Lyft. A White Plains taxi medallion that cost $80,000 two to three years ago now costs $20,000, Klein said, “because nobody is making any money.” Forty-nine summonses were issued to the petitioners at the hospital. Janet Pajares owns a Toyota Prius
licensed by White Plains and bearing a taxi medallion sticker. County police issued six tickets on March 4 totaling $1,475 for not having valid county permits and other violations. On April 9, she wracked up seven more tickets and $1,600 in fines, and on the same day, N.F. Gonzalez-Salom, driving another Toyota Prius owned by Pajares, was fined $825 for five alleged violations. Cab drivers Gustavo Q. Alvarado, MD Bulbul Ahmad and Miguel Angel Puin, also licensed by White Plains, have been ticketed under similar circumstances. Locally licensed taxis, according to Klein, may drop off passengers at the Mount Pleasant medical center, but they get tickets for picking up passengers there. The petition claims the TLC is violating its own regulations. The TLC may regulate “for-hire vehicles” — motor vehicles used to transport fewer than 20 passengers on a prearranged basis — anywhere in the county. But the regulation “shall not apply,” according to the county code, “to taxicabs, buses or wheelchair accessible vehicles.” Taxis are defined as motor vehicles that carry no more than five passengers that are licensed by a local municipality or by the TLC. Locally licensed taxis, according to the petition, “are expressly exempt from regulation by the … TLC.”

n appeals court has affirmed a $2.4 million judgment against Armonk businessman Harris Schwartzberg for failure to pay a loan he personally guaranteed. Companies controlled by Schwartzberg had defaulted on a $5.4 million loan from an Encore Nursing Center Partners limited partnership to operate nursing homes. “A written agreement that is complete, clear and unambiguous,” the second Appellate Division in Brooklyn ruled last month, quoting a legal precedent, “must be enforced according to the plain meaning of its terms.” Schwartzberg is CEO of The Schwartzberg Cos., a private investment

firm in West Harrison that focuses on health care and real estate. Encore is associated with Seavest Investment Group, a White Plains-based venture capital and real estate investment firm that specializes in health facilities. Richard D. Segal of Rye is the founder and CEO. In 2006, Encore and the Schwartzberg affiliates set up a deal to run seven nursing homes in Florida, Illinois, Kansas, Missouri and Texas. Encore would own the properties and the Schwartzberg affiliates would operate them. Encore loaned $5.4 million to the Schwartzberg entities to use as working capital with Harris Schwartzberg personally guaranteeing up to $1.4 million. The debt was supposed to be repaid by the end of 2009, but the borrowers defaulted on their obligations.
Schwartzberg’s companies filed for Chapter 11 reorganization in 2015. They had concluded by 2013, according to a bankruptcy document, that it was “no longer prudent to continue to operate the facilities.” Encore sued Schwartzberg in 2015 in Westchester Supreme Court. Schwartzberg’s companies had stopped paying rent for the nursing homes, according to the complaint, and had failed to pay any of the $5.4 million loan. Encore demanded that he pay the $1.4 million he had personally guaranteed. Schwartzberg responded that Encore had misrepresented the financial, physical and operational conditions of the nursing homes, and that he would not have guaranteed the loan had he known the true conditions.
His lawyers also argued that Encore had filed the lawsuit too late, and they asked the court to declare the loan and the guarantee unenforceable. Westchester Supreme Court Justice Alan D. Scheinkman granted Encore’s motion for summary judgment in 2016 and dismissed Schwartzberg’s defenses and counterclaims. In 2017, he ruled that Schwartzberg owed Encore more than $2.4 million, for the guarantee, 9 percent interest, attorneys’ fees and other costs. The four-judge appellate panel agreed with Scheinkman. The statute of limitations began when Schwartzberg defaulted at the end of 2009. Encore had six years to file a claim and it had beat the clock. Schwartzberg had “failed to raise a triable issue of fact,” the appellate justices ruled, “with respect to a bona fide defense.”

said one corporate airplane based at Westchester creates five full-time jobs and about $1 million in spending. “To this county, the economic impact is about $750 million, huge for not only Westchester but for Fairfield County,” he said. “The thing is, aviation moves business and without the jet aircraft and the business aircraft we’re not doing business.” Joan McDonald, director of operations for Westchester County, told the visitors, “We value the role aviation business and our airport play in our county both as a vibrant transportation hub and as an economic development driver.” She’s familiar with the economic impact of aviation in both Westchester and Connecticut as a result of her time spent as the transportation commissioner for New York state. She said a report done by her state staff found that aviation contributed “more than $50 billion of annual economic activity, which equals 4.4% of the gross state product and over 400,000 jobs.” She said more than 6,300 jobs are related directly or indirectly to Westchester’s airport. Marsha Gordon, president and CEO of The Business Council of Westchester, attended the event and told the Business Journal, “It’s the multiplier effect associated with the airport that creates activity, and just think of all the people here today that are staying in Westchester, that are coming here, that are eating here, that are staying in hotels and enjoying Westchester County and all the Hudson Valley has to offer.” Roger Woolsey, CEO of Million Air, told the Business Journal that aviation in America is a $1.6 trillion industry and having the event at his facility highlights what Westchester is doing right. “We really believe that our real job is to be the first impression of the community,” he said. “When a corporation’s coming to Westchester County or New York City and they’re coming here for invest-

ments or they’re looking at a business, we want to make sure that our building, the welcoming mat, our hospitality really represents the local flavor and the quality that we have to offer in our community.” Ed Bolen, president and CEO of the NBAA, said business airplanes are good for companies because “they allow you to turn your travel time into productive work time. They allow you to go places where other modes of transportation don’t go. They allow you to move flexibly. They allow you to move products that are too big to go in an overhead bin or are too sensitive to go in a cargo hold.” He said NBAA holding its event at the Westchester County

there to help and our country depends on that.” While visitors to the exhibits could see demonstrations of various products, the display of business aircraft on a temporarily closed runway afforded the opportunity to examine jets, propeller planes and helicopters and visit with sales representatives before deciding whether to put down a deposit on a $58 million Falcon 8X jet, a 19-passenger Gulfstream G650 at $65 million or a Sikorsky S76D helicopter at $9.9 million. Among those at the event was Janine K. Iannarelli, an aircraft broker who operates Par Avion Ltd., an international business aircraft marketing
firm specializing in the sale of pre-owned business jets such as Cessna Citations, Falcons and Hawker jets. “My particular sweet spot is working with the entrepreneur, private individuals who had privately held companies,” she told the Business Journal. “Some of the people that I work with are going to buy the aircraft privately, yet they lead publicly traded corporations.” She came to Westchester from Houston for the event because “it is really important to reconnect with peers, to see the wares that are being offered today because technology is changing rapidly in the aviation industry, so I want to see what’s on the cutting edge.”

A
proposed mid-rise apartment building aimed at bringing 82 units of affordable and workforce housing to Peekskill moved closer to becoming a reality at the city’s Planning Commission meeting May 14 when the commission gave site-plan approval. The development is designed to serve households with income levels ranging from 40% to 80% of the area median income. It is to be financed through the New York State Housing Finance Agency and Westchester County. The New York State Housing Finance Agency is a public benefit corporation created in 1960 to finance low- and moderate-income rental housing. The building is to be located at 645 Main St. in Peekskill’s Inland Waterfront Zoning District. The site is a
1.91-acre undeveloped property with frontage on Main Street and Central Avenue. During the review process, planning officials with both the county and city of Peekskill raised various issues, including items related to the site’s topography, drainage as well as vehicular and pedestrian flows. “It’s a complicated development. The city has been very good to work with, which is an important factor because the property required zoning amendments, a special permit and site-plan approval,” William G. Balter, president of the project's applicant, Wilder Balter Partners, Inc. (WBP), told the Business Journal. “Our expectation is to be in the ground in the third or fourth quarter of 2019.” The application lists the owner of the project as Indian Brook IG, LLC, located in Garrison. Balter’s company is located in Chappaqua and has

been active on Long Island and the Hudson Valley for about 30 years. It has a construction management and general contracting firm, Griffon Associates, Inc., which specializes in residential construction. It also has a management arm, WB Residential, which reports managing the 32 WBP properties with more than 3,200 apartments. Balter said workforce housing generally is aimed
at the demographic whose income is greater than 70% of the area median income. “We’ve done market-rate developments where we have a percentage of units that are affordable, and we’ve done developments that are 100% affordable. In the case of Peekskill, it’s affordable and workforce. In New Rochelle, we’re doing a development that’s 75% market, 25% affordable. We like the market-rate development as well.” The New Rochelle project is the first phase of a 550-unit development in two 27-story towers at 14 LeCount Place. Construction recently began on the first phase, which will have 379 units and extensive amenities, including an outdoor pool. WBP has
also recently begun site work on a 42-unit affordable housing community in Lewisboro featuring one-, two- and three-bedroom rental units and the second phase of the Hillcrest Commons senior affordable rental development in Carmel. Phase one, which offered 76 units, was completed in 2012. Phase two would add 74 units. Balter explained that there are differences in designing a project for an urban setting such as Peekskill as compared with more rural locations. “Urban areas have tighter sites with zoning that allows denser developments. Our urban developments are often just a train ride away from job centers, have local services that

our residents are seeking, are walkable and have less reliance on cars. Northern Westchester and the rest of the Hudson Valley tends to have low-density zoning so our developments there are spread out, often on 10 to 40 acres. These larger developments tend to have multiple buildings with on-grade parking in the development. In Peekskill, our site is just under two acres so our site requires us to build parking under our building.” He placed importance on gathering local support for affordable, workforce and even market-rate housing developments early in the application process. “We typically talk to the stakeholders in the municipality in which we're working and we sort of see what is desired and workable with the funding available,” he said. “Usually, very early in the process, we try to get the stakeholders in a community to visit projects that we've done in other municipalities.” As to factors that help produce needed local support, “I think it's a combination of people seeing the developments and talking to the people who live there and, at times, talking to the community leaders where we've completed developments.”
Connecticut, Illinois attorneys general probe data breach at Westchester-based AMCA BY PHIL HALL phall@westfairinc.com

onnecticut Attorney General William Tong has teamed with Illinois Attorney General Kwame Raoul on an investigation into the data breach at Westchester Countybased American Medical Collection Agency (AMCA) that could impact the personal information of nearly 12 million patients of Quest Diagnostics and 7.7 million Laboratory Corporation of America
(LabCorp) patients. The breach occurred between Aug. 1, 2018, and March 30, 2019, but was not publicly disclosed until June 3 by Quest Diagnostics, although the company said it first heard of the breach from AMCA of Elmsford on May 14. The attorneys general sent letters to American Medical Collection Agency, Quest Diagnostics and LabCorp seeking the total number of patients impacted by the breach, as well as the specific number of Connecticut and Illinois res-

idents that were affected by the breach. They are also requesting data on the categories of personal information that might have been compromised, as well as information as to how the companies plan to inform those affected and prevent future data breaches. The office of New York Attorney General Letitia James is conducting an independent inquiry into the matter. The attorneys general of Michigan, Minnesota and North Carolina are also pursuing their own probes.

A
g ro u n d b re a k i n g ceremony was held June 5 in New Rochelle for a six-story apartment building that will include an art gallery and some retail space. The construction site is at 387 Huguenot St., near the intersection with Main Street and within walking distance of the Metro-North train station. One of the factors that distinguishes this building, known as The Huguenot, from most other projects underway in the city is that the building uses modular construction. Designed by Doban Architecture, which is based in Brooklyn, the building will contain 60 units in a mix of 57 studio and one-bedroom apartments and three two-bedroom units. It is to contain two ground-floor retail spaces totaling about 2,400 square feet, about half

of which will be used by the city for an art gallery. There will be a lower level garage using a mechanical carousel parking system. Keystone Structural Group of Scranton, Pennsylvania, structural engineer for the project, said the building’s footings are on bedrock and the steel-framed park-
ing structure goes up from there. The parking structure’s framing supports wood framing for the modular units. Keystone shows the construction cost at $10 million. The total project cost is estimated at $23 million. “This groundbreaking of The Huguenot marks yet another significant step for-
ward in our efforts to build an economically and culturally vibrant downtown,” said New Rochelle Mayor Noam Bramson. “The Huguenot’s automated parking and community art gallery are particularly exciting elements that highlight New Rochelle’s commitment to technology and creative expression.”
Frank Chechile, president of developer CAC Realty Group based in Rye, said, “We’re very excited about this project. Our family has been involved in the New Rochelle business community for years.” Susan Doban of Doban Architecture described the building as part of the gate-
way to the city’s downtown. “The Huguenot extends the vibrancy and growth envisioned in the overlay zoning district from the center of the downtown towards the intersection of Huguenot and Main,” she said. The building is designed to appeal to millennials and empty nesters. Doban has been active in New Rochelle development with more than 20 projects in the city. Her firm designed Locust Hall, a modular building at 26 Locust St. for Monroe College containing 96 units of student housing. It opened last September. The firm has done other projects for Monroe, including the mixed-use building Gaddy Hall, Allison Hall and adaptive reuse projects such as the Culinary Arts Center, Milavec Hall and the Academic Center. Amenities at The Huguenot will include a dog-washing facility, dog run on the roof, fitness center and common spaces for social gatherings.

ight years after the Metropolitan Transportation Authority first sought a partner to turn a commuter parking lot into a transit-oriented development, officials broke ground June 5 on Avalon Harrison. The development, a partnership with developer AvalonBay Communities, the town of Harrison and the MTA, will feature 143 units in three residential buildings. There will be 76 one-bedroom apartments, 59 two-bedroom apartments and eight three-bedroom apartments. It will have approximately 5,000 square feet of interior amenities, including a fitness center, community room, game room, lounge and lobby. Two landscaped

public plazas will connect to the Metro-North Railroad station. A new 27,000-square-foot park-

ing garage will almost double the commuter parking, holding roughly 751 total spaces, including 475 for
commuters, 90 spots for commercial spaces and 186 for residential. In return for building the garage, the
railroad will deed the land to Harrison. The estimated cost of the project is $76.8 million. Rent for a one-bedroom apartment will be $2,455, for a two-bedroom $3,650 and for a three-bedroom $5,300. Christopher Reynolds, director of development for AvalonBay, said there will be up to 13 retail tenant spaces. “The development will create about eight fulltime equivalent property management jobs associated with the residential component of the development,” he said. AvalonBay anticipates that the opening of the first two residential buildings will occur in January 2021. The commuter parking garage is expected to be completed by December 2020. The third residential building and retail/commercial space will follow a
year later. Catherine Rinaldi, president of Metro-North Railroad, said, “When it’s completed, this green project will create a vibrant, walkable community, both reducing reliance on cars and enhancing the existing village hub, and our customers will certainly have a much easier time finding parking at the station.” Transit-oriented development is a rapidly growing trend in producing sustainable communities, according to Janno Lieber, chief development officer of the MTA. “Mass transit combined with rational community development is a sure way to protect a community’s future,” Lieber said. The goal is to keep older residents in town while attracting newcomers, he said.

OUR TOTAL SERVICE COSTS ARE GOING UP EACH YEAR AND IT FEELS LIKE IT’S GETTING OUT OF HAND. I RECOGNIZE THERE’S A TIME TO DO FREE SERVICE, AND THERE’S A TIME TO NOT DO THAT. WHERE AND HOW DO I DRAW THE LINE? THOUGHTS OF THE DAY: Free service is a slippery slope. Give customers an alternative. Make sure your service terms are spelled out up-front. Standardize terms and enforce them with staff and customers. Consider a restocking fee as protection from the handling costs. Offering generous returns and service is often good for business. But some customers may start to lean on those policies too much, some not even realizing they’re pushing the boundaries.
Keep in mind that a return policy, first and foremost, is designed to reassure customers that your company is in it for a long-lasting relationship, not just the transaction at hand. Your company wants a topshelf quality rating. You’re willing to provide customers with a remedy if something goes wrong. Make sure your company extends this policy to customers who deserve that paradigm. Tell customers who ask for something that there
will be a charge for fulfilling the request. Don’t get into defending the reason for changing past practices. Give the customer alternatives if you know of a cheaper way to get the work done. Tell your customer where to go to find out more about that option. You can also tell your customers they can do the work themselves. Whether they do try on their own or just think about what it would take to do it, they’ll probably end up realizing why there’s value in asking your company to do the work. Check what’s in the written policies given to customers at the start of a project. Is it clear what is covered and what is chargeable? Back up to the quote or estimate you provide as part of your proposal to take on additional work. Any mention of war-
ranty policy and limits in that document? Make the time to write a standard warranty, service and returns policy. If you’re not sure what’s appropriate gather input from employees and customers. Look at what your competitors offer and compare policies vs. overall performance to get insight. Most warranties, service contracts and return policies are in place to reassure customers. Make it clear that the product or service works as stated, and that what is sold is robust enough to survive any stress related to shipping and installation. That’s the usual limit. Any service request or return beyond that limitation is an excess benefit to the customer, will likely cause deterioration in profits if exercised by the buyer and should be avoided. However, if it is noted that
customers have been trained (whether by your company or your competitors) to expect an overly generous policy, increase pricing to account for that convention. Or offer customers a reduced price for a more limited service guarantee. And promote the lower fee as a price advantage as well as a testament to the trust your customers place in your company, because they have no need to ask for a more extensive post-sale guarantee. If you do allow returns, implement a restocking-fee policy for any return related to anything other than damage. When the goods are returned and it’s agreed they’re in good condition, issue a refund less the cost to handle the shipping and handling related to returning the goods to the shelf. In other words, if the customer isn’t going to do business
with your company, make sure your company covers its costs related to taking and then losing the business. or more than four decades, the Elisabeth Haub School of Law at Pace University has been an innovator in legal education in Westchester and beyond. As we serve the needs of our students, the community and the legal profession, we continue to develop cutting-edge scholarship and special programs that anticipate, explore and influence evolving areas of the law. school’s earliest graduates credit our former evening program with making them the lawyers they are today. With this in mind, this spring, the law school announced our Flex J.D. The Flex J.D. is a new expanded part-time option available to our J.D. students. The Flex J.D. makes law school more accessible to working professionals, allowing parttime law students to take all of their required classes on Tuesday and Thursday evenings, as well as on Saturday mornings and online. would prevent them from enrolling in a typical fulltime J.D. program. The Flex J.D. is the newest addition to a range of scheduling choices available to students studying at the law school. consulted with a 92-year-old who had never executed a Last Will and Testament and/or any other form of estate or long-term care planning. I asked her why she waited so long to see an attorney and she stated that, “I’ve been very busy the last 91 years.” While it is true that life often seems to pass by at lighting speed, I still believe that in 91 or so years she could have (and should have) found an hour or so to consult with an attorney. When I looked across the table at the client’s daughter, she shrugged and said that she had been asking her to do it for at least 20 years. For many, approaching a parent about whether or not they have done estate and or long-term planning can
be an uncomfortable and intimidating task. As a practicing attorney for almost 35 years, I know some parents never discuss their personal finances and planning with their children. It is something they feel is no one’s business. However, I also know that this can often be quite unfortunate for both the parent(s) and the child(ren). The lack of knowledge about the parent’s finances often becomes problematic especially if a parent is taken ill, rendered incapacitated and/or unexpectedly passes away. Under said circumstances, the family is often hampered in its ability to gather the necessary financial information and documents to apply for Medicaid, and/or take the necessary steps to protect
one’s assets from the cost of long-term care. Additionally, when the parent passes away, children are often left scampering to try and piece together information relevant to the decedent’s finances for the requisite estate and tax filings. If a child is unsure as to whether the parent has done any planning it is best for the child to raise the issue with the parent. The child can directly ask the parent whether or not he or she has done any longterm care planning and if not, recommend that they consult with an experienced elder law attorney. However, if this approach is not effective, the child(ren) may need to resort to a more creative approach. Some of the tactics used by children that have helped
their parents include: • Taking steps to educate one’s parent(s) about the advantages of engaging in long-term care planning. This can include providing them with articles about the cost of long-term care (nursing homes/home care), the use of a Medicaid Asset Protection Trust to protect assets from said cost and Medicaid eligibility requirements. It is not unusual for a parent to be poorly informed about the devastating impact that long-term care costs can have on his or her finances if they are unable to become eligible for Medicaid. ent has taken ill or been diagnosed with dementia. This is especially relevant if they have a family member that needs home care and/ or nursing home care. Share these stories with one’s parent. There is nothing better than real-life stories from a member of one’s family or friends to motivate a parent into taking action. • Offer to pay for the parent’s initial consultation with the elder law attorney. I have found that in some instances children who are willing to finance the cost of the consultation, and in some cases even pay for the planning, can help a parent who is reluctant to spend for a plan. This would, of course, require the consent of the parent. • If the parent(s) still resist any attempt to
engage in long-term care planning, such as creating and funding a Medicaid trust, gifting of assets and/or purchasing longterm care insurance (if insurance is an available option), a step that could prove to be very helpful in the event of the parents’ incapacity is to have the parent execute a Durable General Power of Attorney with broad provisions that allow the agent to engage in Medicaid/long-term care planning for the parents. high school and Cabrini University. She has served on the Board of Trustees of Cabrini of Westchester for over 10 years and volunteers her time teaching children at Cabrini Immigrant Services. For more than 50 years, Joan’s husband, William M. Mooney Jr., has been a force in the metropolitan region’s business and banking community. He is president and CEO of the Westchester County Association.

Graves III, P.E., has joined The Chazen Companies in Poughkeepsie as a geotechnical project engineer for its geotechnical engineering group located in Nashville, Tennessee. Millie Jasper, executive director of the Holocaust & Human Rights Education Center in White Plains, was elected to the board of the Association of Holocaust Organizations (AHO). An international organization, AHO is dedicated to Holocaust education, remembrance and research and brings together hundreds of Holocaust organizations within the U.S. and 27 countries. Its annual conference held this June serves as a hub for celebrated scholars and others devoted to Holocaust remembrance to discuss the lessons of the past and advancements for education surrounding the Holocaust and human rights issues. The Holocaust & Human Rights Education Center’s mission is to enhance the teaching and learning of lessons of the Holocaust and the right of all people to be treated with dignity and respect. It encourages students to speak up and act against all forms of bigotry and prejudice. Some of its programs and initiatives include a Speakers Bureau, comprised of Holocaust survivors and liberators; curriculum with key lessons from the Holocaust for educators to use in fulfilling the New York state mandate; and it trains thousands of middle and high school students in its human rights institutes.

Westchester’s urban centers are in the midst of a renaissance. New residential projects are transforming Yonkers, New Rochelle, Mount Vernon and White Plains, bringing new residents, new jobs and new opportunities. But proposed Prevailing Wage legislation in Albany would radically increase the cost of private construction projects and could bring all of this to a crashing halt! Westchester County’s most prominent developers have joined with The Business Council of Westchester and other leading business organizations to strongly oppose state legislation to require the payment of Prevailing Wages on any private construction project receiving any form of state funding support. The Westchester Coalition to Save Smart Development has been formed to speak with a unified voice against the legislation and protect private investment in our communities.

Simply put, imposing Prevailing Wage would drastically inflate the cost of construction projects and deal a crippling blow to private development in Westchester, particularly in our urban centers that for the first time in decades are enjoying a significant revival. Major projects will not go forward, resulting in billions of dollars of lost investment, jobs and residential opportunities. Prevailing Wage is not Minimum Wage. Rather, it is the term used for wage rates applied to government “public work” projects such as highway, bridge and tunnel construction. Applying this to private construction projects would add a minimum of 30 percent to overall project costs. For example, a laborer would be paid $100 per hour and employee benefits would be covered 100% by the developer. We can’t afford to make New York any less competitive.
