TOLL QUESTIONS LINGER AFTER TAPPAN ZEE LOANS OK’D ANOTHER QUARTER OF A MILLION DOLLARS has been committed to the construction of the Tappan Zee Bridge replacement, but the seeming million-dollar question of how much the toll on the new bridge will cost remains unanswered. The state Public Authorities Control Board voted to approve $256 million in low-interest loans at its July 16 meeting, yet the majority of financing remains elusive for the $3.9 billion, twin-span bridge. The state received a $1.6 billion loan from the U.S. Department of

usiness and labor groups are lining up against a proposal by the state Department of Environmental Conservation to close Indian Point Energy Center during the spring and summer to protect fish in the Hudson River. The DEC is looking at options to protect fish and their eggs, which are killed when Indian Point sucks river water into its system for cooling. The state could require one or both of the Buchanan nuclear power facility’s generators to be shut down for 42-92 days between May and August, when fish are most likely to spawn but also when the electric grid is at its peak usage period. Arthur “Jerry” Kremer, chairman of the New York Affordable Reliable Electricity Alliance and a former state assemblyman, called the proposal “unquestionably one of the dumbest ideas to come out of a state committee in 50 years.” The proposal has been knocked by business advocates who say the outages would be detrimental to the local economy by causing electric rates to spike and reducing the reliability of the grid in the hotter months, when air conditioning use increases energy consumption. Industry representatives say Indian Point produces as much as a quarter of all the power used in the region and that the loss of that energy would mean the production has to be replaced by non-nuclear power in coal or fuel plants that could increase air pollution. Phelps Memorial Hospital Center in Sleepy Hollow sent the DEC a letter opposing the plan, saying it would cause increased air pollution and could have negative health impacts in minority communities downstate, where the majority of non-nuclear plants are located. “These communities are defenseless against toxic air emissions,” Keith F. Safian, president and CEO of the center, wrote. “Compounding these serious problems is continuing limited

Seasonal plan for Indian Point draws criticism

The Jay Meisel Story.” He has since relocated his business to his very full garage. “Basically, he does garage sales right now,” Anthony Desiato says of the man who inspired his second documentary film, Jay Meisel. We’re standing in an aisle at Alternate Realities, a comic book shop with a Scarsdale address in a Central Avenue strip mall. Desiato left his job in the admissions office at Pace Law School an hour early this July afternoon to meet us at Steve Oto’s store. A 2012 graduate of the law school that now employs him, 27-year-old Desiato worked at Alternate Realities through high school and college and here was mentored in the owner’s “Otoisms” – see the flattened squirrel metaphor above. Oto and his merry, highly talkative band of friends and customers were the subject of Desiato’s first fulllength documentary film three years ago. It began as a law school internship project. Desiato earned his J.D. degree – Oto, a former real estate attorney in Manhattan, had urged him to steer clear of law school – and passed the New York bar exam in the same summer that his documentary was shown at the Jacob Burns Film Center. He would like to practice someday in entertainment or intellectual property law, but now it’s his

own entertaining intellectual properties that Desiato aims to promote. “He won’t quit,” Desiato tells us. “It’s still something for him to do.” He is speaking of Jay Meisel, but he could be speaking of himself as a filmmaker who hasn’t yet made a dime at what he’s done. Meisel is another habitué of Alternate Realities and the tragicomic subject and profanityprone, outrageously opionated curmudgeon – with a generous soft spot for kids who can’t afford the price of a comic book – of Desiato’s new documentary short film, “By Spoon! The Jay Meisel Story.” Desiato with his Canon camera recorded the 77-year-old merchant’s final year and closing days at Port Chester’s Empire State Flea Market last year. Meisel, it should be noted, vociferously loathes a lot of things in modern life, including that word “flea” in the name of the market where he was a colorful fixture for more than three decades. Fleas and tasteful merchandise don’t much mix. “He curses at the television,” the livid curmudgeon’s wife, Alice, told the filmmaker on camera, with a spouse’s air not of long suffering but of long and easy familiarity with a tough New Yorker’s uncouth vocabulary of outrage. “He curses at the news. He curses everything. I think he curses the 21st century.” “---- technology!” her husband says into the camera on another slow day at the market. “---- the computer age!” A former social studies teacher in Spanish Harlem, Meisel brought a habit of good attendance to his flea market gig. “I’ve closed three weekends in 34 years,” he tells Desiato in the 32-minute documentary. “One weekend was my brother-in-law died. One weekend I was in the hospital, and one weekend I took my son to a rehab.” That interview took place before management at the Port Chester Shopping Center announced the flea market would close by the end of 2013. ended the world as he knew it for Jay Meisel – “It’s a ------’ life’s thing!” – but its closing and Meisel’s move to his garage – with the help of friends and fellow customers from Westchester’s comic shop subculture – add a poignant dramatic element to Desiato’s film. “It was handled disgustingly,” Meisel, who had no lease, says of the abruptly announced closing. “It shows the worst of capitalism once again.” “And I’m not going on eBay. ---- eBay!” “Today the market doesn’t end,” Meisel proclaims in the film as he clears out his shop. “The market will go on forever in the hearts and minds of everybody who resides in Port Chester.” Maybe so, but customers haven’t followed Jay and his decorative merchandise – movie posters and still photos, comic books, autographed materials and pop-culture collectibles – to the Meisel garage in Hartsdale. “It’s frustrating. It’s disheartening. It’s scary,” he says, before lowering the garage door to shut out the young filmmaker and his camera. As if to urge himself on through his own frustrations, Desiato has named his film company Flat Squirrrel Productions. “I like to think I apply that philosophy” – hesitate to act and you end up as life’s flattened roadkill, that is – “to the making of this movie, hence the name of the production company,” he says. The novice filmmaker thought the screening of “My Comic Shop Documentary” at Jacob Burns two years ago might connect him to the industry network he needed to

land a distribution deal and find a wide audience for his 72-minute film. “Somewhat frustratingly, that didn’t happen,” he says. “I was just trying to get the movie in front of the right eyes. I got a lot of press surrounding the screening, but it didn’t have the ultimate effect that I was hoping. I was hoping to cultivate more of a relationship with Jacob Burns and the Jacob Burns community. I guess they weren’t that into me, I don’t know.” Until recently, the filmmaker had resisted showing his movie free of charge online. But as it has too for Jay Meisel, a new reality has set in for Anthony Desiato. You can freely view his full-length feature on his company website, flatsquirrelproductions.com. It’s also posted on YouTube. A tantalizing trailer for his Jay Meisel film also can be viewed at the Flat Squirrel Productions site and on YouTube by searching “By Spoon! The Jay Meisel Story.” The first documentary has had nearly 5,000 views on YouTube in the last two months – not viral, but encouraging numbers for a lawyer-in-waiting who won’t quit on his other possible career. “At this point, I just wanted to make it as accessible as possible,” he says. “The quest to monetize what I do on the filmmaking side is definitely important. I feel the biggest thing right now is just reaching that audience.” The fimmaker recently was joined by Jay Meisel at a library showing of “By Spoon!” “I sat next to him in the screening,” Desiato says. “He was laughing the whole time.” “I think he really liked having an audience again.”

The library redevelopment was planned as a smaller downtown project of Struever Fidelco Cappelli L.L.C., the city’s former master developer for downtown and waterfront redevelopment. SFC eventually disbanded as two of its partners struggled with heavy financial losses in real estate developments in recent years. Fidelco Realty, based in Milburn, N.J., continued the project in partnership with the city, which had been awarded the state revitalization grant in 2010. Marc E. Berson, chairman of Fidelco Realty Group, in a press release called the Library Lofts opening “the proof of success demonstrating how public-private partnerships can have a tangible impact in stimulating community development. The forwardthinking approach has brought new residents and retail opportunities to Yonkers and new life for an historic but abandoned property.” Library Lofts adjoins the site of a city public works project to create the Mill Street Courtyard, a public plaza and dining and entertainment space, on a short, dead-end street behind the former library. evelopers from New Jersey’s Fidelco Realty Group were joined by Yonkers and state officials at a ribbon-cutting ceremony to mark the completion of Library Lofts, a $10.6 million mixed-use redevelopment of the former Yonkers Public Library building on downtown Main Street. The project, funded in part by a $5.45 million state grant from the Empire State Development Restore New York Communities Initiative, includes 23 rental loft apartments on the upper floors of the three-story building at 5 Main St. Deals Stores, a discount retailer affiliated with Dollar Tree Inc., leased and opened the project’s 9,000-square-foot ground-floor retail space about a year ago. The luxury lofts include studio and oneand two-bedroom apartments, the residents of which have use of an outside patio area, rooftop terrace and a fitness center. Built in the late 1920s on the former site of the Hamilton Theater and Marshall Mathewson Department Store, the building just west of Getty Square was first leased by Genung’s Department Store in 1933, according to historical accounts. The property stood vacant since 2002 when the central Yonkers library moved to the new Riverfront Library.

photo widely circulated on the Internet recently shows Steve Jobs in front of an IBM building in New York, giving the IBM logo the middle finger. That photo was taken in 1983, just ahead of the release of the original Macintosh computer, according to Andy Hertzfield, who started the spread of the photo by posting it to his Google Plus account. The companies spent much of the 1980s as bitter rivals, Armonk-based IBM Corp. representing the buttoned-up East Coast tech tradition and California-based Apple Inc. representing the rebellious West Coast movement. The rivals are now partners. “We are delighted to be teaming with Apple, whose innovations have transformed our lives in ways we take for granted but can’t imagine living without,” said Ginni Rometty, IBM chairwoman, president and CEO. “Our alliance will bring the same kind of transformation to the way people work, industries operate and companies perform.”
Although the comments may have been surreal to some today, and would have been entirely implausible two decades ago, analysts say the announcement isn’t as shocking as it may seem. The deal is the result of Apple’s ongoing mobile wars and IBM’s shift in development focus, experts said. In fact, the companies have worked together in the past, according to MarketWatch.com. The collaboration, announced July 15, will see IBM sell iPhones and iPads to business clients and help develop exclusive apps and cloud services. Apple will offer support services. Together, the companies will deliver “made for business” apps. IBM has shifted its focus to software and cloud technology, and the company will help develop software to reinforce data security and allow businesses to manage workflow and tabulate analytics. Tim Cook, Apple’s CEO, said in a statement, “For the first time ever we’re putting IBM’s renowned big data analytics at iOS users’ fingertips, which opens up a large market opportunity for Apple.” The move can help Apple keep its head above water in the mobile and tablet IBM, page 6

access to affordable medical treatment for these populations.” Labor groups have criticized the plan because it could reduce thousands of fulltime jobs at the plant into part-time jobs. James Slevin, president of the 8,000-member Utility Workers Union of America Local 1-2, criticized Albany for considering the proposal in a conference call with reporters this month. “I don’t know where their heads are,” he said. A DEC public hearing in Cortlandt on July 22 saw dozens of pro-business speakers, labor representatives and community groups bused in from New York City with members holding signs opposing the plan. John Ravitz, executive vice president of The Business Council of Westchester, was among the speakers. He said the forced outages would send “a chilling message to businesses” about state commerce. Al Samuels, CEO and president of the Rockland Business Association, said the forced closure of a private business at a high-revenue time of the year would discourage other businesses from relocating to the region for fear of over-regulation from the state.
“Why would you want to spend millions of dollars to move to New York from wherever,” Samuels said. He also noted the loss of weeks of operation would mean a reduction of the tax assessment of the property and in turn a loss of property tax revenue for the town and school district. The closures emerged as an option because Entergy Corp., which owns Indian Point, was resistant to the idea of installing a closed-cycle cooling system that would involve building towers so the plant would be less reliant on river water. Entergy has contested the science that using the river water and pouring warmer water back into the river has had any effect on aquatic life there. “All of these impacts might be worth considering if outages at Indian Point were actually necessary to protect fish and larvae, but they are not,” Fred Dacino, vice president of license renewal for Entergy, said. Entergy has said that Wedgewire screens are a better option to limit the effect on fish and their larvae. Those screens, which would be installed underwater, were rejected as a solution by the DEC. Marilyn Elie, from the civic group Indian Point Safe Energy Coalition, said she preferred the closed-cycle cooling system. That plan has been portrayed as requiring the construction of two cooling towers the size of Yankee
Stadium, but Elie said there were design alternatives that would make the installation more aesthetically palatable. Elie, a teacher, said the country needed to move away from its reliance on nuclear energy because of the radioactive waste that was being left for future generations. “There’s a selfishness and lack of morality when you don’t clean up your own mess,” she said. The DEC hearing also drew colorful criticisms from Sunny Armer, a member of the anti-Indian Point group Raging Grannies. Armer, speaking as a ventriloquist through a fish puppet, sang a song to the tune of “She’ll Be Coming ’Round the Mountain.” “Before we could trust uranium, we need holes in our cranium,” she sang. “We haven’t gone that far ’round the bend.” The DEC said its proposal would not take effect this year and it likely won’t make a decision until early 2015. In a separate matter, Indian Point is seeking to renew its operating license with the Nuclear Regulatory Commission for another 20 years. Environmental groups have looked at the proposed outages as a first step to easing the state off reliance on the plant. Gov. Andrew Cuomo is among those calling for the eventual shutdown of Indian Point.
Investors Service, which said the authority might not raise its tolls quickly enough to pay for the replacement bridge. No toll increases will take hold this year and there are none announced for 2015. The Thruway Authority said it would seek the balance of the $511 million next year. Thomas J. Madison, the authority’s executive director, said there were other projects that would need to be financed outside of the Tappan Zee replacement. Tolls would be the main source to fund all of the authority’s construction needs. “Going forward, in addition to the bridge and the revenue needs there … it’s fair to say there will be toll adjustments for the rest of the system as well,” he said. Yet even the $256 million already approved may face legal challenges from environmentalists or see the brakes applied by the U.S. Environmental Protection Agency. A regional director for the agency said in a letter earlier this year that the loan was an “unconventional” use of the clean water fund. Paul Gallay, president of the environmental group Riverkeeper, said litigation seemed increasingly inevitable. He said there had been a unified front of municipal groups, legislators and others opposing the loans.
“This unprecedented alliance for good governance warned Senate and Assembly power brokers: ‘This is bad business. Don’t go along with it,’” he said. “But they did just that, with barely a whisper of protest.” Pro-business groups praised the loan, saying it would help keep the cost of the toll down. The Cuomo administration said the funds were not being used simply for bridge construction but for environmental projects such as protecting oyster beds in the Hudson River. Ross J. Pepe, president of the Construction Industry Council of Westchester & Hudson Valley Inc., said anyone opposed to the loans was “fooling themselves and short-changing the public.” “Let’s do the math,” he said in a statement after the loans were first announced. “Higher environmental protection costs means higher tolls on the bridge. Lower loan financing costs means lower tolls on the bridge.” Marcia Bystryn, president of The New York League of Conservation Voters, said in a statement the project had “nothing to do with drinking water or wastewater systems.” “It is simply not true to say that the $255 million loan is ‘environmental’ funding, when the vast majority of that sum is for bridge construction and related work,” she said.

ficult if not impossible to vote in favor of the next one,” state Sen. John A. DeFrancisco, R-Syracuse, a board member, said at the meeting. DeFrancisco was alluding to another $256 million in loans that would represent the second half of a total $511 million authorized by the state Environmental Facilities Corp. in June. That amount, taken from a clean water fund, was cut in half by the control board amid a backlash from environmental groups and local officials who called the loans a misuse of money intended for water improvement and sewage infrastructure projects. According to budget projections for the state Thruway Authority, which will own and maintain the new bridge, $647 million in toll revenue is expected this year and that figure must grow to $952 million in 2017 to meet the needs of the agency. A large portion of those needs are the costs of the new bridge. Rockland County Executive Ed Day, a Republican, has said inflating the toll could discourage shoppers from crossing the bridge into Rockland, opting for destinations such as Yonkers’ Ridge Hill over the Palisades Mall. The Thruway Authority saw its bond rating reduced last year by Moody’s

Recent pushes from other companies, including Microsoft, have some experts saying the deal was necessary for Apple to strengthen sales with the business and government-employee set. Apple said 98 percent of the Fortune 500 and more than 92 percent of the Global 500 use iOS devices in their businesses. For IBM, the move may help give the company’s Watson cognitive system development a mobile destination for its apps, according to an analysis on zdnet. com. The move would give IBM a platform, allowing Apple to get the high-performing apps before they are developed for Android or other platforms. There are possibilities for IBM’s Watson in many business sectors. “Healthcare is one obvious vertical for Watson, but IBM has many more industries targeted,” the article stated. IBM has more than 4,300 patents in mobile, social and security, according to the company, and has 6,000 security researchers and developers in 25 labs around the world. According to the joint statement announcing the partnership, some of the cooperative effort will include: • Developing IBM MobileFirst for iOS Solutions, “made-for-business apps” that will target specific industry issues or opportunities. The apps will become available starting in fall and into 2015, focused on retail, health care, banking and travel and transportation. • Offering AppleCare assistance for IT departments through AppleCare for Enterprise, with on-site service for businesses provided by IBM. IBM is in the midst of a companywide staffing restructuring. It announced its second quarter earnings July 17 and noted continued declines in revenue. rivate-sector employment gains in June in Westchester County and neighboring Putnam and Rockland counties trailed job growth for the month in the greater Hudson Valley region, where job numbers rose 0.9 percent from May and 1.2 percent from June 2013, the state Department of Labor reported. Job growth in June in the Hudson Valley’s private sector trailed both statewide employment growth from a year ago, which amounted to 1.8 percent, and the nation’s 2.2 percent job growth in the private sector since June last year, according to the Labor Department. The seven-county region’s unemployment rate stayed at 5.3 percent in June from May and was down 1.4 percent from the region’s jobless rate in June 2013. The Hudson Valley had the third-lowest June jobless rate among the state’s 10 labor market regions, trailing only Long Island and the Capital region. The Putnam-Rockland-Westchester labor area had a 5 percent unemployment rate in June, the third-lowest in the state after the Ithaca and Long Island job markets. If we hire another salesperson, operations has to be able to deliver. People are already working hard within the constraints of their available hours – and they are worried about things they’re not getting done now. We don’t want to fail to deliver. What happens when sales picks up? THOUGHTS OF THE DAY: Look for systemsenhancement opportunities. Build the organization from the bottom up, adding extra hours at the lowest possible cost. Keep a lid on overtime, whatever you do. Work with sales to build in margin for things customers want. Reforecast weekly, with a 12-week look-ahead to stay on top of potential increases. Are there new or updated computer systems that will boost efficiency anywhere along the line, from order-taking to production, to delivery, invoicing and collections? Use leases of equipment and software to keep costs down and spread the investment out over time while pursuing efficiencies. Run a forecast of costs and savings to be sure upgrades will lead to improvements in the bottom line. Use processes to cut out waste and increase efficiency. Take a look at how routine and smooth all of the production work is. Ask employees to track and report on errors. Use those reports to find and fix problems and thereby reduce production costs. Consider sharing a portion of the cost savings with employees as one-time bonuses, as a reward for thinking about how to do things better. Most employees are looking for opportunity to boost their personal income. Eventually they’ll look for jobs outside the company if they can’t get big enough raises internally. Keep the best employees close by giving them opportunities to increase skill, responsibility and pay. Teach employees that raises beyond cost of living are earned and reward people who take the initiative to produce more, faster. Identify several areas of production that would benefit from upgrading skills and improving how things are done. Keep good employees fully employed in slack times by devoting a percentage of work time to education. Test out new ways of doing things when it’s not so busy so it’s clear where changes will deliver bottom-line results. It often seems easier to let employees earn a bit extra by letting them take on over-

It’s cheaper to take on a few hours of overtime than it is to commit to a full-time, or even a part-time, employee week in and week out. If things go beyond a few hours, the profits from additional sales can go right out the window. When production starts to pick up, put out ads for new hires and start interviewing. Line up several good production candidates. If things stay busy, once specific positions exceed 10 to 20 hours of overtime – which, at a time-and-a-half pay rate, is worth 15 to 30 hours of straight time – it’s probably time to make an offer to one or more qualified candidates. That has to change quickly, as increased production will use up old inventory and ordering new materials will probably cost more – and then there’s that overtime to pay for. Have a meeting each week to monitor backlog, delivery schedules, production snags, inventory status, workforce depth, sales pipeline, profit margin and hot customer and prospect needs. Have both sales and operations sit down to talk about what’s coming and brainstorm how to manage through any bubbles. Set up a flash report that helps identify trends as they flow through from pipeline to
orders to production and profit. Graphs are usually easier to read than raw numbers. Post information so employees can talk about results and contribute ideas on how to make things better. Mrs. Green’s rehires 8 fired workers; union still a possibility BY MARK LUNGARIELLO mlungariello@westfairinc.com

rs. Green’s Natural Market in Mount Kisco is putting eight fired employees back to work after sixth months of picketing and calls to boycott the store by a local labor union. United Food and Commercial Workers Union Local 1500 supported the fired workers, saying they had been let go as part of a union-busting effort by store owners after workers at Mrs. Green’s unsuccessfully attempted to unionize last year. The company said the firings were part of a reorganization under new management. The workers were receiving training and would be back on the job in the same or equivalent positions the week of July 28, according to the company. David Ramirez, one of the reinstated workers, said he hoped the discussion about labor relations wasn’t over now that he and his colleagues had their jobs back. “Our fight has been long, but it is not over,” he said. “We ultimately want and need protection at work, so we and all our coworkers don’t have to work in fear that if we ever stand up for our basic rights, we will be on a picket line for six months, fighting for what we all should be guaranteed at work.” The employees were rehired just ahead of a scheduled hearing with the National Labor Relations Board, Joe Fedele, a spokesman for Local 1500, said. The company named a new CEO, Pat Brown, this month, and the company said Brown’s appointment had more to do with the resolution of the dispute than the pending hearing. John Collins, a spokesman for Mrs. Green’s, said the market gives bonuses and discounts to hourly employees, which the company calls “associates.” It offers a profit-sharing program when the store exceeds its goal two quarters in a row. “Store leadership embrace these values and core principles and has stepped forward to do the right thing for its associates,” he said. Mrs. Green’s, an organic and sustainable product market, opened its first location in Briarcliff Manor in 1990. The company, originally owned by Harold and June Hochberger, grew to 11 locations by 2007, when it was bought by Planet Organic Health Corp., a Canadian company and owner of several supermarket chains looking to establish a foothold in the U.S.
organic market. Planet Organic declared bankruptcy in 2010, according to a November 2013 Chicago Tribune report on Mrs. Green’s expansion into the Midwest. After the bankruptcy, Planet was acquired by a private equity group called Catalyst Capital Group, the Tribune said. According to the labor union, new management took over at the Mount Kisco location in December 2012. The union said employees filed for a union election in May 2013 but lost by three votes. Although it was an anonymous vote, accusations later followed that ownership had illegally met with employees prior to the vote in an attempt to discourage them from voting in favor of a union. Charges were filed with the labor board and employees met with local elected officials and state Assemblywoman Sandy Galef about their treatment, according to a blog post from Tony Speelman, secretarytreasurer of Local 1500. In a settlement in November, Mrs. Green’s agreed to post for 60 days a notice of employees’ federal labor rights. During that posting period, according to protest organizers, 10 employees were fired. (Two of those employees have since moved on and did not seek to be rehired.) “The fired workers were not only leading supporters of the union in the election, but were the same workers who met with politicians in the Mount Kisco area for help,” Speelman wrote in his blog posting. The company said that during the same time span as the union vote and labor rights settlement, it conducted a nationwide storeperformance review and tagged the Mount Kisco location as “underperforming.” It invested $3.5 million to renovate the location and met with workers. Representatives said the firings were the result of that reorganization and that although several of the employees were later revealed to be union supporters, several of those fired had not been active in the unionizing effort. Mrs. Green’s is planning to expand in the next two years with a slew of new locations. The company has opened branches near Princeton, N.J., and in New Canaan, Conn., and will open its first New York City store in the West Village in the coming months. No date has been set for another union election for employees at store. If a second vote fails, by federal law another vote can’t be held for 12 months. Local 1500 represents workers at Pathmark, D’Agostino’s, Fairway and Stop & Shop grocery stores.
DEALS &DEEDS ACADIA REALTY BUYS BEDFORD SHOPPING CENTER
Acadia Realty Trust, a publicly traded real estate investment trust based in White Plains, paid $46.75 million to acquire Bedford Green, an approximately 120,000-square-foot shopping center on Route 117 in Bedford Hills. The retail center is anchored by a ShopRite supermarket. The seller, Diamond Properties L.L.C. in Mount Kisco, paid $36.1 million for the property in 2008. CBRE Group Inc., which announced the deal, said Diamond has made significant capital improvements to the center, including a new façade, storefronts and sidewalks, installation of Belgium block curbing and parking lot islands as well as complete renovations to many tenant suites. Jeffrey Dunne and David Gavin, of CBRE Group’s New York institutional properties team, represented the Diamond entities that owned the center and found the buyer. Acadia also owns the approximately 309,000-square-foot Crossroads Shopping Center in the town of Greenburgh, the
750,000-square-foot Cortlandt Town Center and the approximately 173,000-square-foot Cortlandt Crossing in the town of Cortlandt. Dunne in a press release said Bedford Green is well situated in an area of the county with average incomes of more than $147,000 for households within three miles of the center. “The center’s high-volume ShopRite coupled with its high-credit satellite tenants, including CVS and Chase, among others, will provide stable, long-term cash flow for Acadia,” he said.
BRONX LAUNDRY MOVING HEADQUARTERS TO YONKERS
Fast Linen Service Inc. will expand its commercial laundry operations and relocate its headquarters from the Bronx to 945 Nepperhan Ave., a former coffee distribution center in Yonkers, according to brokers at NAI Friedland Realty Inc. and New York Commercial Realty Group. The laundry company, which occupies a 6,000-square-foot warehouse on White Plains Road in the Bronx, paid $2.725 million for the approximately 32,500-squarefoot warehouse in Yonkers. The buyer was represented by NYCRG’s Frank and Michael Rao in the deal. Andrew Grossman, vice
president in Friedand Realty’s industrial division, represented the seller, B.R.P. L.L.C. Grossman said Fast Linen’s “ambitious and energetic owners” plan to refinish and remodel the building’s interior and exterior for their growing service company’s headquarters.
MOUNT VERNON INDUSTRIAL BUILDING SOLD
The new owner of an 80,000-square-foot industrial building in Mount Vernon plans to convert the two- and three-story structure at 750 S. Fulton Ave. into a mini storage facility, according to brokers in the recent $3.85 million deal. The buyer, 750 South Fulton Storage L.L.C., is based in State College, Pa. The company took out a $1 million mortgage with the property’s seller in Mount Vernon, Wampum L.L.C. Andrew Grossman, vice president at NAI Friedland Realty Inc. in Yonkers, represented both parties in the deal. The building has been used for retail, office and warehouse space. Grossman said the new owner wants to renovate it as a storage facility to accommodate the neighborhood’s growing need for space.

Ossining Union Free School District has leased 15,000 square feet of space for its new district offices at 400 Executive Blvd. in the Central Westchester Business Park in the town of Ossining. School administrators are relocating from the district’s longtime
headquarters in the Roosevelt School to open additional classroom space in the school on Croton Avenue, said Ossining commercial broker Jerry Gershner. Gershner, owner of Gershner Realty Services in Ossining, represented the school district in the relocation. He said the new office will allow the school district to consolidate several functions in one location while providing space for meetings, professional development and other functions. Steve Salamone, associate broker at the Houlihan Lawrence Commercial Real Estate Group, represented the building owner, a real estate investment group in Manhattan. New Rochelle considers business registry available but that the index would serve as a central resource. He also mentioned some information would be protected under a “trade secret exemption.” He said estimates of the number of businesses currently operating in New Rochelle range from 2,000 to as many as 6,000. “And everything in between,” he said. “It’s a guessing game really.” The registration, Aragon said, would help the city keep better records of what types of businesses exist and therefore better determine the needs of the industries that operate in New Rochelle. It also would enhance emergency services. A similar registry exists in the city for multifamily dwellings. The city first explored a business registry, officials said, to get a better understanding of if local businesses were filing sales taxes. Councilman Lou Trangucci, a Republican, said the registry might overstep that goal. “It seems like we’re going beyond where we wanted to go with this,” he said. The council discussed the possibility of a registry that would include only “brick and mortar” operations and not businesses that operate out of homes. City staff said they would analyze the concerns of elected officials and bring suggestions of parameters to the table at a future council meeting.

he New Rochelle City Council is considering whether to create a mandatory business registry that would index every business in the city and help determine if locally generated sales taxes are being properly filed with the state. Although discussions of the registry are preliminary, the directory would likely include all for-profit and nonprofit businesses licensed to do business in New Rochelle. The city would charge an annual fee to be on the registry, with early estimates at $35, and charge a 10 percent monthly fine for businesses that don’t register. Those who don’t pay or supply false information could face revocation of their registration. City staff expect to approve fee exemptions for nonprofits and government and religious organizations. An online portal to sign up would be made available in English and Spanish, according to the city. Councilman Barry Fertel, a Democrat, said he was concerned the registry could be used by solicitors. He also questioned if registry information, such as contact information or email addresses, would constitute an invasion of privacy for business owners. “My concern is it’ll be used for purposes you don’t even see,” Fertel said at the July 17 City Council meeting. Luiz C. Aragon, New Rochelle’s commissioner of development, said a lot of the information in the registry is already publicly

INBRIEF MUSEUM TO LEAD YONKERS PUBLIC ARTS PROJECT
The Hudson River Museum in Yonkers will use a $100,000 federal arts grant to collaborate with city officials and an urban environmental organization, Groundwork Hudson Valley, to produce two public artworks that draw on community input in downtown Yonkers. The museum was among 66 organizations nationwide recently chosen to receive Our Town grants from the National Endowment for the Arts. The awards totaled more than $5 million in the fourth year of funding for the NEA program. A permanent installation, “Sound and Light: Reflecting Yonkers and Its Rivers,” will be created at Van der Donck Park, site of the first phase of the city’s Hudson River Walk being built along newly uncovered segments of the Saw Mill River in its underground course to the Hudson through the city’s downtown. The $250,000 project, which will include cultural programs for Yonkers residents and visitors, will also be supported by a $150,000 contribution from the city of Yonkers for the light installation. Austrian-born artist Erwin Redl, known for his large-scale outdoor light installations, will produce the permanent installation in the park on Larkin Plaza. Sound artist John Morton will work with community residents to identify sounds that reflect Yonkers’ past and present and link them to Yonkers’ stories and history. Both artists will offer workshops so the public can interact with their works in progress. Redl and Morton will begin designing the installation in the spring, city officials said. By next summer, 15 arts workshops and 10 arts performances will be operating in the city under the direction of the Hudson River Museum. Programs will be targeted to the residents of Yonkers and visitors from other Westchester municipalities and New York City. “This exhibit will continue the growing arts movement in Yonkers while promoting Yonkers’ rich and diverse history, and contribute to making our downtown a desirable community in which to live, work and play for years to come,” Yonkers
Mayor Mike Spano said in the grant announcement. Noting the vital role the arts play “in building strong communities,” Michael Botwinick, director of the Hudson River Museum, said the museum’s long partnership with the city “is a model for how cities and arts organizations should collaborate. The NEA’s Our Town program is a powerful recognition of that.” Launched in 2011, the Our Town program supports arts-based community development projects throughout the country with grants ranging from $25,000 to $200,000. The NEA received 275 grant applications this year. Participants in the Sound and Light project include Blue Door Arts Center, Youth Theater Interactions, Yonkers Philharmonic, Sarah Lawrence College faculty, Riverfront Library, Yonkers YMCA, Municipal Housing Authority of Yonkers and Sarah Lawrence Colleges Center for the Urban River.
SCARSDALE MAN SENTENCED FOR $33M FRAUD SCHEME
A Scarsdale man has been sentenced to 10 years in federal prison after being convicted of wire fraud relating to a Ponzi scheme he ran through his Ardsley business. Eilat Lev, 65, admitted in a plea agreement filed in U.S. District Court in Frankfort, Ky., that he defrauded investors out of approximately $33 million between 2005 and 2008. According to an FBI press release, Lev solicited investments to finance the purchase of heavy construction equipment through his business, International Tractor Co. Inc., with the agreement he would arrange for the sale of the equipment and return the amount invested, pay interest on the amount invested and share the profit made on any sale with those who provided the financing. In 2005, an investor opened a line of credit with First Southern National Bank in Pulaski County, Ky., and used the line of credit to continue to finance transactions with Lev and his company. In order to draw from the line of credit, Lev was required to submit the same itemized documentation to the bank, which would
then transfer funds, by wire, from the investor’s line of credit to Lev’s account at Gotham Bank of New York. Lev admitted he perpetrated a scheme to defraud this investor, and others, by soliciting millions of dollars under false pretenses, failing to invest the funds as promised and misappropriating the funds without the knowledge of the investors. According to the FBI, rather than purchasing and selling equipment and returning the investment, interest and profit to the investors, Lev falsified purchase and sales documents and diverted new investor funds to pay prior investors their principal, interest and/or profits on prior transactions, creating the impression among investors that the business was successful, which enticed them to invest more money. Lev’s scheme unraveled in 2008 when he no longer had sufficient funds to repay investors. Under federal law, Lev must serve 85 percent of his prison sentence and will be under the supervision of the U.S. Probation Office for five years.
MARSHALL DENNEHEY FIRM OPENS RYE BROOK OFFICE
Marshall Dennehey Warner Coleman & Goggin P.C., a civil defense litigation firm headquartered in Philadelphia, has opened a Westchester County office at 800 Westchester Ave. in Rye Brook. It is the 52-year-old firm’s 20th office on the East Coast and in Ohio. The Rye Brook office is staffed by five attorneys formerly with Jones Hirsch Connors Miller & Bull P.C., a 25-attorney Manhattan firm that recently merged with Marshall Dennehey. James P. Connors, former partner at Jones Hirsch, has joined Marshall Dennehey as a shareholder and as the Westchester office’s managing attorney. The office also will be staffed by attorneys Daniel S. Corde, Charles T. Gura, William C. Brown and Angela M. Evangelista. ACORDA SUES OVER GENERIC MS DRUG
Ardsley-based Acorda Therapeutics Inc. has filed a lawsuit in federal court in Delaware alleging Mylan Inc. infringed on its patents for the multiple sclerosis drug Ampyra. Mylan, based in Canonsburg, Pa., notified Acorda by letter July 9 that it had filed an Abbreviated New Drug Application seeking approval from the Food and Drug Administration to sell generic tablets of Ampyra. In the complaint filed July 16, Acorda alleged the filing of the application constitutes infringement of five patents either held or licensed to Acorda. Acorda’s complaint seeks declarations that Mylan infringed on Acorda’s patents, an injunction against Mylan’s production, distribution, or sale of a generic Ampyra tablet prior to the expiration of Acorda’s patents, as well as attorney fees, costs and expenses.
LOWEY: TAPPAN ZEE GRANTS SHOULDN’T BE TAXED
Homeowners receiving windows and doors to reduce noise from the new Tappan Zee Bridge construction shouldn’t have to pay taxes on the grants to pay for them, according to U.S. Rep. Nita Lowey. Lowey, a Democrat whose district includes parts of Westchester and Rockland counties, sent a letter July 22 to John Koskinen, commissioner of the Internal Revenue Service. “It is essential that my constituents are not penalized by the IRS for taking advantage of grant funding to mitigate the construction of the new Tappan Zee Bridge,” Lowey wrote. The New NY Bridge Community Benefits Program is offering $1.7 million in grants for noise reduction for eligible homes in the vicinity of the as-ofyet-unnamed replacement bridge for the 60-year-old Tappan Zee. A recent report by The Journal News outlined that residents in the area were told they might have to pay taxes on the soundreduction measures because they represented receiving something of value. Although the IRS hasn’t ruled on the issue, a state liaison to the bridge construction project told the News that residents wouldn’t be taxed for the installations. – John Golden, Leif Skodnick and Mark Lungariello

Friends of Westchester County Parks (FWCP) has been awarded $10,000 from Hudson Valley Bank earmarked for Camp Morty, a sleep-away camp run by Westchester County under a contract with FWCP. The camp was created for the underprivileged boys and girls who receive services from the county’s Department of Social Services. FWCP funds the camp through membership fees, donations and funding from DSS and the county. “Camp Morty provides
our youth with the opportunity to gain the independence, self-reliance and selfconfidence that are crucial ingredients as they mature into adulthood,” said Joanne Fernandez, FWCP board chairman. The camp is at the 1,081-acre Sal J. Prezioso Mountain Lakes Park in North Salem. The camp is named in memory of Morton Hyman, who touched the lives of thousands for nearly 20 years as supervisor of camping for county parks.
MUSIC CONSERVATORY RECEIVES GRANT A $6,075 Quality of Life grant from the Christopher and Dana Reeve Foundation was awarded to the Conservatory of Westchester, a not-for-profit community music school in White Plains. The award was one of 73 grants totaling more than $537,550 awarded by the Reeve Foundation to nonprofit organizations nationwide that provide opportunities, access and daily quality of life for individuals living with paralysis, their families and caregivers. Conceived by the late Dana Reeve, the program has awarded 2,380 grants totaling

more than $17.6 million since 1999. The conservatory will use the grant for its Music Therapy Institute, which reaches nearly 2,000 children and adults with disabilities each year. Specifically, the school’s licensed therapists will utilize the power of music in working with children with disabilities, including those with paralysis-causing conditions, to help alleviate pain and stress, improve communication and language development, enhance social interaction and emotional expression and accomplish growth, learning, healing and change.

COLLEGE PROMOTES GEARY Colette Geary has been appointed senior vice president for strategic initiatives by The College of New Rochelle. This new position will support the implementation of a long-term strategic planning initiative across the college’s four schools and six campuses. A comprehensive institutional assessment process has identified core objectives that will comprise the priorities for the future. Geary served as vice president for student services at the college since 2010. Geary launched a multiyear strategic plan for the department of athletics, which capitalizes on the college’s award-winning wellness center. In the past year, Geary led a restructuring of undergraduate admissions to promote networking and communications about the
unique features of a CNR education and its academic programs. This led to a substantial increase in both applications and acceptances among high school seniors for the fall 2014 class. Colette Geary Before joining CNR, Geary was dean of students at Manhattan College in Riverdale. During 14 years at Manhattan, she also served as director of counseling and health services, as staff psychologist and taught in the school of education graduate program.
CNR NAMES VP OF STUDENT SERVICES Elaine T. White has been appointed vice president for student services at The College of New Rochelle. She will supervise the offices of campus ministry, career development, residence life, counseling and health services, student activities, student development, athletics and the wellness center. “I look forward to serving on the president’s executive team, where I will have the opportunity to impact all students across our six campuses in meaningful ways,” said White, who was dean of students at CNR since June 2012.
“Elaine has demonstrated a consistent ability to empower student leaders and challenge students to fully develop their individual talents. Her commitment to fostering a vibrant and engaging community supports student success and resonates deeply with the mission of our college,” college President Judith Huntington said. White came to the CNR from Manhattan College, where she was director of student development.
