proposed $105 million redevelopment project at the Brynwood Golf & Country Club near Armonk that has sparked opposition from a neighborhood group faces an added hurdle raised by the developer’s campaign contributions this fall in support of two incumbents on the North Castle Town Board. The town board this fall is reviewing the developer’s project proposal.

Committee For A Better North Castle, a political action committee formed by country club owners Brynwood Partners L.L.C., contributed $78,000 in late August and early September to support the Republican primary campaigns of council members Diane DiDonato-Roth and John Cronin, according to financial disclosure filings at the state Board of Elections.

THE Two CaNDIDaTEs rUNNING for Westchester County executive are on opposite ends of the argument over whether or not to close Indian Point Energy Center, the Buchanan nuclear power plant.

Democrat Noam Bramson said he is in favor of creating a plan to reduce the county’s energy consumption, develop alternative power sources and eventually close Indian Point, which has often been

criticized for its location on the Hudson River, 25 miles outside of New York City and within 50 miles of the homes of 17 million people.

“A nuclear power plant should never have been sited in an area that’s so densely populated and which does not have adequate escape routes,” Bramson, who is the mayor of New Rochelle, said during an Oct. 2 debate in White Plains. “But I recognize that’s not something that can be accomplished overnight and therefore we have to establish this as a longer-term objective.”

Sales spark at area auto dealers

I

n a career that spans six decades, Robert Vail can recall the worst of times in the auto industry.

That was 2009, when General Motors Co., rescued from bankruptcy by the federal government’s $24.9 billion bailout of GM and Chrysler early that year, began closing dealerships across the country. In Harrison, Vail’s Chevrolet agency was shut down by the Detroit automaker, another victim of the Great Recession.

“That was probably one of the worst experiences in my life,” Vail said recently from his office at Vail Buick GMC in Bedford Hills, a dealership he has owned since 1991. “I let probably 20 employees go a couple weeks after our 27th anniversary” in Harrison.

The Harrison auto dealer also lost his Pontiac franchise in Bedford Hills that year after GM announced it would discontinue its Pontiac brand in 2010. Vail had started the Pontiac business in 1998 at the same location as his Buick GMC dealership.

“It’s a new day,” said Vail, whose 25-employee Buick GMC franchise this month held a grand re-opening in its newly renovated building at 606 N. Bedford Road.

“We were really hampered by the construction for three months,” Vail said. Yet his company’s sales are up 30 percent from the same period last year, driven by pent-up demand for GM product, which the dealer said is the best he has seen since he began selling GM vehicles in 1974.

At the Bedford Hills dealership, “2010 was a very strong year just coming off ’09,” he said. GM reported $4.7 billion in earnings in the year after its federal bailout. “It kind of leveled off in ’11 and ’12 and this year we’ve taken a jump ahead again.”

The industry’s post-recession sales recovery is borne out in an economic impact report recently released by the Greater New York Automobile Dealers Association, a trade group representing about 400 franchised new car dealers in Westchester County, Long Island and the five boroughs. Vail serves as its vice chairman.

In the nation’s largest vehicle sales market, metropolitan auto dealers saw $27.1 billion in sales in 2012, a 12.4 percent increase from 2010, according to the market research firm Auto Outlook Inc. The 429,000 new vehicles sold at retail in the metro area last year was an approximately 6.5 percent increase from 2010.

For the average dealership in the area, total sales in 2012 amounted to about $69.4 million, a 10 percent increase from 2010.

The 1,900 new and used vehicles sold on average by area dealers amounted to a 5.6 percent increase from 2010.

Dealership payroll in this market averaged $5.12 million last year, a nearly 23 percent jump from two years earlier. The average dealership in the region had 83 employees last year, compared with 79 in 2010.

In Westchester, dealers employed 5,179 workers last year, according to the report.

Employment in the county’s auto showrooms, offices and service centers trailed that in Long Island’s Nassau and Suffolk counties, where new vehicle dealers employed about 26,500 workers.

Vail’s $1 million renovation project is part of an estimated $245.7 million in capital improvements that metro area dealers are projected to make this year, when their capital expenditures are expected to peak before dropping to an estimated $183.3 million in 2014.

The area’s 390 dealers collected about $1.58 billion in state sales taxes in 2012 and paid $245.7 million in payroll, real estate and other taxes.

Nick Crispe, a spokesman for the 103year old Greater New York Automobile Dealers Association, said the economic impact report “is an important reminder to residents and local officials of Westchester County and beyond just how important auto retailers are to the communities in which they reside. They employ a lot of people, invest hugely in the local community, provide localities with huge tax revenues and they are big charitable givers.”

The industry “is kind of like a familytype business,” Vail said in Bedford Hills. At Vail Buick GMC, the owner and president was joined in business nine years ago by his son Gregory, company vice president.

“For someone new to get in the business takes an awful lot of capital,” said the younger Vail, a Fordham University graduate who worked a few years at a Manhattan auditing firm before carrying his family’s business legacy into a fourth generation. “It’s capital intensive.”

“I’m third generation in the car business,” said the senior Vail. “My grandfather started in Ossining with a Chevy dealership.”

That was in 1918.

Vail entered the family business in the ‘60s as a mechanic at the Ossining Studebaker dealership owned by his father and uncle, John and Peter Vail. For several years he sold GM’s products as general manager at the former King Oldsmobile in Croton-on-Hudson.

In Bedford Hills, the Vails this year bought a used car annex at 536 Bedford Road to expand their business. That supplements a revived and thriving trade in new car leasing, which was halted by GM and other automakers during the industry’s near-collapse.

“That hurt us tremendously during the recession,” Greg Vail said. “We’re just coming back from that.”

The Vails said leasing this year accounts for 60 percent to 65 percent of new vehicle deals in their business. That is higher than average for the metro area, where leases accounted for 52 percent of sales last year.

“The Westchester-Fairfield (Conn.) market and Long Island is one of the highest leasing areas in the U.S.,” Bob Vail noted.

I

n a tight race for dead last, New York topped New Jersey as the state with the worst business tax climate in 2013 in an annual index of state tax systems.

Wyoming, which levies no corporate or individual income tax, had the best tax climate for businesses last year, according to the Tax Foundation, a nonpartisan tax research group based in Washington, D.C. The index ranks the 50 states by corporate tax, individual income tax, sales tax, unemployment insurance tax and property tax.

New York ranked 49th in individual income tax; 45th in both unemployment insurance and property taxes; 38th in sales tax and 25th in corporate tax to reach its overall bottom ranking.

Though New Jersey had a better overall rank at 49, the Garden State and the Empire State are in “a virtual tie” for last place this year, the Tax Foundation reported.

tax; 48th in individual income tax; 46th in sales tax; 41st in corporate tax and 32nd in unemployment insurance tax.

Delaware has the most onerous corporate tax, the Tax Foundation found, while California has the highest individual income tax. Louisiana ranked 50th in sales tax, while Rhode Island’s unemployment insurance tax is the least favorable for businesses.

“The evidence shows that states with the best tax systems will be the most competitive in attracting new businesses and most effective at generating economic and employment growth,” according to the recent report.

Following Wyoming among the top 10 states with the best business tax climate were South Dakota, Nevada, Alaska, Florida, Washington, Montana, New Hampshire, Utah and Indiana.

Ranked above New York and New Jersey in the bottom 10 were California at 48th, Minnesota, Rhode Island, Vermont, North Carolina, Wisconsin, Connecticut and Maryland.

Perfect storm brewing for Sleepy Hollow

A

n eponymous and hot new TV show, a $60,000 state grant and the most evocative and perfect of holidays – Halloween. Call it a winning trifecta for the village of Sleepy Hollow.

Drawing on its historic ties to the legend of Sleepy Hollow and embracing American author Washington Irving’s tales about the Headless Horseman and Ichabod Crane, times are anything but sleepy for businesses.

Tourism has ramped up since the days when the municipality was known as North Tarrytown, before forward-thinking lawmakers in 1996 made the name change.

“Who want to be called ‘North’ anything?” asked Anthony Giaccio, Sleepy Hollow village manager.

Giaccio explained that after General Motors Corp. moved out of the village in 1999, it took 4,000 jobs and left the village’s economy and businesses in a state of disarray.

“GM was paying 50 percent of the taxes,” Giaccio said. “It used to be the life

Since 2002, General Motors has been looking to sell its vacant 96-acre site to a developer who can “get the property back on the village’s tax roll,” Giaccio said.

Businesses have slowly begun to recover as the village turned to creative strategies to help businesses generate more revenue.

Tourism was the diamond in the rough, which helped business entrepreneur Jeannie Galgano get back on her feet after she abandoned her brick-and-mortar gift shop in Tarrytown. Now she runs her gift shop at the base of the Old Dutch Church property on North Broadway rent free.

“Business has been excellent,” Galgano said. “We’re 40 percent ahead of last year, which is a noticeable increase. Business is starting as early as September, when it usually started in October.”

Galgano, who arranges her Headless Horseman gift shop on two long tables with a small tent overhead, sells items ranging from pewter statues to hoodies. She said the knitted caps with the Sleepy Hollow logo are the newest additions to her pop-up shop, and they’ve been “selling quickly as soon as the cold weather hit.”

Neighboring businesses have experienced an increase in sales throughout the Halloween season. One business owner at a pizza parlor on Beekman Avenue said Halloween plays an integral role in the success of her business. She added that she began decorating her storefront with Halloween ornaments months in advance.

“Halloween really helps our business because a lot of tourists come here from different towns and states,” said Kate GuzmanKastrati, co-owner of Hollywood North Pizza. “We’re hoping this season it will continue to move our business along.”

Rob Schweitzer, director of marketing for the Historic Hudson Valley, said each year the number of visitors for these three events have grown significantly. The Great Jack O’Lantern Blaze, the village’s largest pumpkin-carving event that began in 2005, has drawn 18,000 visitors over eight nights last year. This year, the village is on track to top 100,000 visitors over 25 nights. The Horseman’s Hollow, the village’s haunted maze which started in 2010, generated 16,000 visitors over 11 nights last year. This year, the event could draw at least 20,000 visitors over 13 nights, Schweitzer said. Sunnyside hosts myriad daytime programs ranging from celebrations with magicians and puppets to reenactments of the legend of Sleepy Hollow through displaying objects in the manor that relate to the stories written by Washington Irving.

One of the most popular tours operated independently of the Historic Hudson Valley group includes the Old Dutch Church, built in 1685, which was constructed from fieldstone and flat, yellow bricks from Holland.

The Old Dutch Burying Ground, which is the cemetery surrounding the church is about three acres wide and holds regular funeral services throughout the year and opens up to the public for tours around Halloween. New this year, the Old Dutch Church will bring in 48 5.5-ton bells forged in the Netherlands, which visitors can play from a keyboard set up at the base of the bell tower.

Tourism in Sleepy Hollow will continue to draw new businesses and developers in the area, said John Sardy, executive director of the Sleepy Hollow Tarrytown Chamber of Commerce “The brand is exploding,” said Sardy, noting the increased membership of businesses on the Sleepy Hollow Tarrytown Chamber of Commerce. “We’re attracting new businesses from Ossining, Mount Kisco and Elmsford.

The tourism is going to foster real estate. New construction for real estate is tremendous with high-end condos and homes coming in.

They’re building right on the Hudson River front.”

greyston taps into crowdfunding trend

reyston Foundation, the Yonkersbased organization known for its pioneering community development and services programs, has turned to crowdfunding to raise money for its bakery business on the city waterfront.

Greyston recently launched its first crowdfunding campaign to raise $25,000 for its bakery, the state’s first registered benefit corporation, where sales of brownies and other baked goods support its parent foundation’s social programs for low-income and underserved residents. The Alexander Street bakery turns out 30,000 pounds of brownie mix daily that is used in Ben & Jerry’s ice cream flavors.

Greyston CEO Steven Brown said the $25,000 that is the goal of the novel campaign will be used to buy new equipment that will allow the for-profit bakery to increase brownie production and add 15 jobs at the factory for low-income and underemployed Yonkers residents by 2014.

Greyston launched its campaign through Indiegogo, an international online fundraising platform based in San Francisco, Calif.

Crowdfunding is a means of raising money through small donations from large numbers of people on the Internet.

“We’re looking for ways to diversify our funding base,” Brown said. “Indiegogo is a way to advertise and market Greyston and buy packaging equipment used to package Greyston baked goods in order to efficiently expand our production capacity and sell more brownies online.”

The crowdfunding effort, which began in September, had raised $9,311 with 45 days left in the campaign.

Jonathan Greengrass, Greyston’s vice president of development, said the online crowdfunding tool does not limit fundraising to a specific geographic region and allows anyone around the world to support a cause.

“Good ideas transcend geographic boundaries,” Greengrass said. “I’m excited about Greyston doing this campaign because it’s spreading the word about our philanthropic aspect.”

Greyston’s move to crowdfunding could start a trend in the county, said Joanna Straub, executive director of Nonprofit Westchester, an umbrella advocacy group and resource provider in Tarrytown for the county’s nonprofits. Straub said she did not

know of any other organizations in the county using crowdfunding.

“It holds a great deal of promise for the sector and allows nonprofits to capitalize on their strengths – a faithful following of supporters who are willing to lend their support to the cause,” she said. “It is an innovative tool in that it easily allows current supporters to invite others to get involved in something about which they are passionate.”

Crowdfunding has become an increasingly popular approach for business ventures and most recently nonprofits, said Deborah Nelson, executive director of the Social Venture Network, a California-based nonprofit focused on helping businesses network.

“We’re seeing a growing trend in the nonprofit and for-profit businesses in crowdfunding, not just to generate revenue but to build brand awareness,” Nelson said.

Indiegogo users can easily tell their stories with a two-minute video that they can upload onto the crowdfunding page, she said.

Barbara DiGiacinto, an outspoken opponent of the Brynwood development, was the party’s top vote-getter on the September ballot.

The Brynwood action committee used the campaign funds for “flyers, mailing lists and a robocall,” said Megan Maciejowski, director of Corigin Real Estate Group in Manhattan, speaking on behalf of Brynwood Partners. She said the donations were not made directly to the Republican Party or any candidates.

North Castle Town Supervisor Howard Arden said Brynwood’s financing role in the campaign is being reviewed by the town’s ethics board and a special counsel. The supervisor described Brynwood’s effort to influence the election outcome as “throwing away money” and “muddying the process” of the town’s environmental review of the golf course project.

Arden said town attorney Roland A. Baroni found there were no violations of the law and the developers kept the financial contributions transparent.

Cronin said the town board will not further review the Brynwood project until it receives an advisory opinion about the campaign contribution. Brynwood Partners this month expects to submit its final environmental impact statement for the project to the town.

Cronin said he and DiDonato-Roth were not aware of the Brynwood campaign expenditures.

Addressing the town board Oct. 9, Brynwood principal Edward Baquero said he and Jeffrey B. Mendell, another Brynwood owner, decided to support the re-election of DiDonato-Roth and “oppose Barbara DiGiacinto” because she opposed the redevelopment “without ever meeting with us to better understand our position” or the “merits of our application.”

Cronin, who approved Brynwood’s draft environmental report at a previous town board meeting, said he was always neutral

on the project and voted to move the process forward to avoid a tax assessment challenge in court from Brynwood’s owners if they abandoned the project and closed the golf course.“The plan was to allow the project to go forward and let them come up with something that was acceptable to the residents,” he said.

Mark Weingarten, attorney for Brynwood Partners, said his client is confident the campaign financing issue won’t slow down the project.

“The clock starts once we submit our FEIS,” Weingarten said. “My client is confident that everything they did was legal. They proceeded with advice from a legal counsel who are experts in the field and think this will be resolved very quickly.”

The town has retained Keane & Beane P.C., a White Plains law firm, as special counsel to review Brynwood’s campaign contribution.

“At this juncture I have not seen anything that leads me to believe anything that was done was illegal,” said attorney Richard L. O’Rourke, a principal at Keane & Beane.

“As with any review of this, I’m awaiting the receipt of all the information I can get.

Then we will render a determination.”

Meanwhile, Brynwood Partners recently announced revisions to their proposed project, which includes 88 luxury condominiums on the 156-acre property. Key changes include: - Limiting construction to 49 condo units until planned renovations to the golf course and clubhouse are completed. The property is currently zoned to accommodate 49 residences.

- A guaranteed $500,000 annual property tax payment to the town for 10 years on the renovated golf course.

- A $1 million contribution to the local water district.

- Withdrawing a pending tax certiorari proceeding that could save the town $1 million.

- A 100-foot setback along Route 22 for the new buildings.

North Castle opponents of the Brynwood proposal in August collected more than 400 signatures of community residents on a petition opposing the project.

if Indian Point closed the infrastructure could meet the region’s energy demands and would only minimally affect energy bills, to the tune of roughly an extra $1 per month.

Bramson said in an email to the Business Journal that there is no reason the plant’s closing, if done over time, should have an impact on the local economy. “In fact, if we pair the gradual decommissioning … with a

strategy to build out our alternative energy infrastructure and promote smart growth and sustainable development, we can seize an opportunity to make broader investments in our county economy.”

Although the federal government has the final say on the operation of any nuclear facility, Bramson said the county executive could be an advocate for residents and local business owners and act as a leader in “green” planning. As mayor of New Rochelle, Bramson oversaw the creation of GreeNR, a sustainability plan which set 43 initiatives over 20 years to increase awareness of environmental impacts, reduce energy consumption and cut costs. “I want to take the same approach countywide,” he said.

The continued operation of the power plant has been a talking point in county executive races in the past. Democrats had accused Astorino of having a tightknit relationship with Entergy when he first ran for the seat in 2005 against incumbent Andy Spano and lost. In a 2009 rematch, Astorino won despite a 110,000 Democraticto-Republican registration advantage in the county.

Indian Point first went into operation in 1962. Its original reactor, Indian Point 1, is no longer in use. Indian Point 2 and 3 were added in the 1970s. Indian Point 2’s permit expired in September, but the NRC extended the old permit until a decision could be made on the relicensing. Unit 3’s permit expires in December 2015. Bramson said he favors a decommissioning that would not extend operation of the reactors another 20 years, but he does not think the plant should be immediately shuttered.

But Bramson’s opponent, incumbent Robert P. Astorino, said he wants to keep open the plant that produces about 25 percent of the electricity for New York City and Westchester. “To say, ‘Let’s close it down,’ and lose 25 percent of our region’s energy is nonsense,” he said. “I mean that cannot happen, that’s not reality. We must have clean energy and we do in nuclear power and so yes, I would support the continued operation.”

Entergy Corp., which owns Indian Point, is seeking to relicense the plant’s two reactors for another 20 years amid ongoing opposition from environmental groups and politicians including Gov. Supporters have said the region’s infrastructure couldn’t meet the area’s electricity needs if the plant were closed and emissions would increase because more fuelburning power plants would need to make up the deficit. The Business Council of Westchester, of which Entergy is a member, released a study last year that said closing the power plant would drain $11.5 billion from the local economy, cause electric rates to jump 6.3 percent and increase the likelihood of blackouts by 280 percent.

Content is currency

I

recently had an interesting discussion with a colleague about whether SEO (search engine optimization) is merely another form of content marketing. I must admit, I’m not sure they are very different at this point.

In its simplest form, SEO involves the generation of keywords and their repeated placement within titles, domain names (when possible), articles, websites, blogs, comments and links throughout the social media environment in the attainment of a higher ranking in most search engines, most notably Google.

(Keywords are generally defined as the search phrase consisting of one to five words that people use when utilizing a search engine.)

The goal of most SEO campaigns is to be found via an organic search at the top of page one on Google. Depending on many criteria, including the popularity of the keyword itself, this can be a very time-consuming and expensive proposition.

Content marketing is about the creation of compelling content and the continuing reinforcement of a brand. The most effective content-marketing strategies incorporate keywords and utilize a variety of different modalities including white papers, webinars, blogs, email marketing, social media, images, slideshows, podcasts, press releases and many other means to effectively reach a targeted audience. Since people respond differently to the various modalities, it is important to employ at least several of them as part of a campaign since what works for one person may not interest another. Additionally, by using several distinct approaches, you will not bore your audience – a frequent problem for the many companies who rely almost exclusively on email marketing.

Content marketing is about creating great content that people want to read and share. Its value substantially increases when people share it with other people in their social network. It generates followers on many social sites and provides a common thread that engages and ties together an entire audience. And its value – or currency – increases with every share.

Search engine optimization is truly a misnomer. You don’t optimize search engines; they perform their tasks regardless of any user’s activity. Instead, you optimize your content for search engines. And this content in actuality is your content marketing.

This is not to say that SEO and content marketing are the same; they are not and both are important. But they do significantly overlap each other. While their objectives differ: ranking and improved search performance versus the creation and sharing of compelling content, one might be construed as being almost a subset of the other. Without

great content, SEO will be largely ineffective.

Conversely, the lack of SEO will not render content creation unproductive.

I can even extend this reasoning to social media marketing. Despite its many platforms and forms, in large part social marketing requires the sharing of compelling content between followers and subscribers. It’s how you organically build your audience and reinforce your brand. What generates the

initial interest are great headlines but what creates followers is the content (particularly the first two paragraphs) that follows.

All of this does not lessen the importance of social media marketing and SEO. Rather, it denotes the importance of content marketing and the common role that it plays in both of these strategies. Most notably, it highlights the multifaceted purpose of the use of content as the key currency in digital marketing

and its importance in the creation of successful online campaigns.

The Center for Disaster Medicine at New York Medical College has been awarded a federal grant to study the impact of mold and other environmental hazards on response workers and homeowners in New York City neighborhoods hardest hit by Hurricane Sandy a year ago.

NYMC officials said the $561,054 grant from the National Institute for Occupational Safety and Health at the Centers for Disease Control will fund a two-year study comparing the health of 400 volunteers and homeowners who received safety training from the New York City Department of Health with 400 of their neighbors who did not receive training. The disaster medicine center in Valhalla will collaborate on the study with the city health department.

Dr. Michael J. Reilly, recently appointed director of the Center for Disaster Medicine, in the announcement said it is the largest research grant the center has received since its founding in 2005 as a division of the Institute for Public Health in the medical college’s School of Health Sciences and Practice. He said the study’s purpose is “to better understand the impact of mold and other environmental hazards on individuals who remediated storm-affected homes, and better anticipate the health needs of similarly impacted communities in the future.”

Dr. Edward C. Halperin, New York Medical College chancellor and CEO, said the research grant “demonstrates the commitment of New York Medical College’s faculty to simultaneously serve the public while generating new knowledge about the causes and prevention of human disease and disability. The public health consequences of natural disasters may, potentially, extend long after the acute event.”

Biotech company awards young scientists

Acorda Therapeutics Inc. in Ardsley announced the start of a weekly award program to recognize high school students in Westchester County doing independent research in science, technology, engineering or mathematics.

The biotechnology company’s Acorda Scientific Excellence Award is open to students at public, private and parochial schools as well as home-schooled students working on projects in the STEM subjects.

A winner will be announced each week during the 2013-2014 school year and will be interviewed on a new weekly radio program on WFAS-AM hosted by Lisa Wexler.

Applications will be evaluated by a committee that includes the broadcast host, scientists from Acorda Therapeutics, science teachers in the county and a representative from county government.

Applications are available at www. acorda.com. They will be accepted through March 31, 2014.

Acorda spokesperson Tierney Saccavino in the announcement said the award program “will spotlight some of the impressive scientific research being done by high school students throughout Westchester County. By encouraging and supporting the next generation of scientists, Acorda Therapeutics can play a role in helping to create the future researchers who could go on to discover the next generation of medicines.”

She said the company hopes its award “will encourage more young people to consider careers in science, engineering and related areas in the future.”

Winners will be announced weekly throughout the academic year. They and their schools will each receive a plaque honoring their achievement.

The Acorda Scientific Excellence Award radio program will air Sundays at 9 a.m.

Bond issue backs hospital expansion

The Westchester County Local Development Corp. this month agreed to issue $14 million in tax-exempt bonds to finance an expansion project at Phelps Memorial Hospital in Sleepy Hollow. The hospital will build a 20,000-square-foot surgical suite at the existing Medical Services Building and connect it to the main building with a new 200-foot long enclosed corridor bridge.

County Executive Robert P. Astorino when announcing the LDC’s support for the project said it will give county residents “more access to outstanding health care and our talented workforce of medical professionals will have more opportunity to find good paying jobs.”

Mortgage taxes recover

Westchester County’s mortgage tax receipts this year are at their highest level since 2008 and the start of the region’s recession-triggered real estate market slump.

The county clerk’s office collected nearly $5.6 million in mortgage taxes in this year’s third quarter, a nearly 36 percent increase from the same quarter last year.

in mortgage taxes, an increase of about $2.85 million or nearly 28 percent from the first nine months of 2012. It is the highest ninemonth total since 2008, when the county reported nearly $15.59 million in mortgage tax receipts after three quarters.

“The mortgage tax figures remain very encouraging and reflect a very robust third quarter real estate market,” said County Clerk Timothy C. Idoni, whose office oversees the collection of state, county and local mortgage taxes.

Idoni noted that fourth quarter tax collections typically slow down as seasonal activity drops in the real estate market. Still, “Even figures dropping to last year’s levels would result in a total collection of approximately $16.65 million, outpacing 2012 by just under $3 million,” he said.

RBS Citizens Financial Group Inc. has launched a program to assist its Citizens Bank customers left without income by the federal government shutdown this month.

The bank, based in Providence, R.I., announced the program will run through Nov. 4 or the end of the government shutdown, whichever comes first.

For eligible customers, the bank is offering help that includes rebates on certain checking account, savings account and credit card fees; easy access to certificates of deposit without incurring a fee and assistance with loan payments.

Customers can call the bank’s roundthe-clock contact center at (800) 922-9999 or visit a branch office to participate in the program.

“We routinely work with customers to help them manage financial challenges and

we also are committed to supporting local communities,” Brad Conner, vice chairman for consumer banking at RBS Citizens Financial Group, said in the announcement.

To be eligible for the program, individuals must have been a customer of Citizens Bank as of Aug. 15. They must also be a current employee of the federal government affected by the shutdown and be able to provide acceptable proof of federal employment.

grouP ConCerned over PePSiCo Palm oil

A recent report by California-based Rainforest Action Network said PepsiCo Inc. is one of 20 snack food companies whose use of palm oil products may be harming the environment.

To address the risks associated with purchasing palm oil, the environmental group

said it is visiting companies throughout the country and asking leaders to only buy palm oil that is “fully traceable,” “legally grown” and “sourced from verified responsible palm oil producers.”

Activists in the group have voiced their concerns to PepsiCo and other food giants as part of a national campaign to remove conflict palm oil responsible for rainforest destruction, human rights violations and carbon pollution.

The other snack food companies the group will target include Campbell Soup Co., ConAgra Foods Inc., Dunkin Brand Group Inc., General Mills Inc., Grupo Bimbo, Hillshire Brands Co., H.J. ausing web traffic gridlock and running into software dead-ends, millions of New Yorkers visited and more than 40,000 signed up for health insurance in the first week of business at the state’s online health benefits marketplace.

“It has been an incredible ride these last eight days,” John Ravitz, executive vice president of The Business Council of Westchester, told a breakfast audience at an Oct. 10 Business Council forum on navigating the Affordable Care Act. A former state assemblyman with long experience navigating government channels in Albany, Ravitz has led the county business group’s efforts to educate and assist small businesses at the start of the state health exchange that launched Oct. 1.

“This is a huge, huge new infrastructure,” he said. “I have never seen New York state government have to put together a program of this magnitude so quickly.”

Kelly Smith, director of the state’s Small Business Marketplace, which offers health insurance plans to businesses with 50 or fewer employees, said more than 40,000 individuals and a little more than 200 small businesses had registered on the exchange as of Oct. 10. More than 5,000 brokers have completed the certification required to do business on the New York State of Health exchange, she said.

When fully implemented by the end of 2016, about 615,000 individuals and 450,000 employees at about 100,000 small businesses are expected to be insured through the online exchange, she said.

Smith said state officials had projected about 3,000 visitor hits on the New York State of Health website on the first day of operation. Instead, “We were getting 3,000 hits per second.”

The unexpectedly heavy web traffic that locked up both the federal and several of the 14 state exchanges in the first week of business was not caused by cyber attacks, said both Smith and Shannon Pettypiece, a health care reporter at Bloomberg L.P. Pettypiece, keynote speaker at the Business Council forum, said some opening-day observers speculated that Tea Party opponents of Obamacare or cyberhackers had launched a “denial of service” attack on state and federal sites, flooding them with artificial traffic. However, “Nobody could really find any evidence of that,” she said.

However, “It’s really hard to assess whether we’re off to a good start because there’s really nothing to compare it to,” she said.

Though most enrollees to date are in their 50s and 60s, “I don’t get the sense that it’s just really sick people who are signing up.”

Most of the newly insured don’t appear to have major chronic illnesses, Pettypiece said.

The health care journalist noted that

when Massachusetts launched its health care exchange seven years ago, people on average visited the site 18 times before making a health plan purchase.

“It’s a big decision. It’s sort of like shopping for a car,” she said.

Pettypiece suggested a potential health care crisis looms as uninsured Americans obtain health insurance coverage mandated

by the Affordable Care Act. In New York alone, 1.1 million persons are expected to be insured through the state exchange.

“Maybe people will be able to get access to insurance, but will they be able to get access to a doctor? Good quality care could be hard to get,” Pettypiece said. “I think that’s still a big unanswered question that needs to be addressed.”

THoUGHTs oF THE DaY: The sales function of any company needs to do more than sell. Accurate sales planning coordinated with operations goals is essential. A good sales team sells what’s needed, keeps the company informed and educates current and future customers about what’s coming next.

Selling more this year than last year is a given for any company’s sales department.

Effectively managing sales also includes hitting macro and micro targets, based on continuous planning and review. A great sales department teams with its operations counterpart to regularly look at questions of quantity, dollar volume and profitability matched to present and future customer needs.

Sales must know what operations can deliver, now and in the future. It needs to inform operations about potential problems selling things that operations wants

to produce. Sales must take action when it sees that customers are likely to want something operations isn’t yet prepared to deliver.

Constant, collaborative information flow gets both parts of the company working toward the same realistic endpoint. That makes it easier for sales to do its job in the future.

Think of the problem this way: Sales decides to sell 1,000 units. Operations can only produce 800. Two hundred customers, or more, if there are delays in the production schedule, go away unhappy and are likely to complain about the company. Those complaints floating around the marketplace make it harder for sales in the future.

Alternately, operations produces 1,200 units, and sales can only find buyers for 1,000. Two hundred units go unsold. The cost of producing those excess units eats away at overall profitability. Customers may be happy that they received their orders on time, but may balk at future orders because sales prices had to go up to cover the lower profit on the previous cycle.

In both instances, customers suffer. Sales struggles to fill its future pipeline. Much better for everyone when sales builds goals in

concert with production.

Planning starts with one-year and fiveyear cycles. What does the company need to sell in the upcoming year in order to be profitable? What will the company look like in five years? What will alter regarding customer wants and needs? What modifications and transformations are anticipated in production methodology and raw materials? How will the economy and competitive threats affect both supply and demand?

Once there’s agreement to one- and fiveyear objectives, a quarterly review cycle comes into play. Were sales goals met last quarter?

How about profitability? Was delivery on time? What adjustments in sales would lead to a resounding “yes” to all of those questions?

Having analyzed the last quarter, it’s time to look forward. Adjust targets by answering the following questions: Increase volume or decrease? Switch around what’s being sold?

Have the right customers? Are customers paying in full? Is anyone asking for significant discounts, which can indicate pressure from competitive threats or selling on price instead of selling on value?

Get specific. How much of what is to be

sold? Delivered by when? Feed operations weekly, monthly and quarterly updates so it can plan and adjust.

Constantly assess sales capacity. Can sales meet the company’s upcoming goals with some capacity to spare? Or is sales stretched and barely hitting its targets? It’s essential to know when sales is under or over resourced.

Prepare for long-term success by asking sales to educate and assess the marketplace.

Make sure customers know what’s being done to meet their upcoming needs. Look for “right fit” prospects to fill the pipeline. Ask for today’s order and request commitments to future plans.

ost of us, whether as voters, consumers, managers or investors believe that valuable knowledge is concentrated in very few hands. We assume that the key to solving problems or making good decisions is finding the one right person who will have the answer. In 2004, that theory got blown out of the water.

Allstate understood that when a global ‘crowd’ of data scientists are all working on the same problem and the results are being posted in real time, the competition increases and the best algorithm becomes obvious.

A regional retail used-car company wanted to solve the problem of how to buy the best used cars and avoid the customer problems that come when someone gets a lemon.

According to the MIT Sloan Management Review, as the data scientists went through more than 2000 previous transactions they discovered that, among other things, the color of the car was a predictor of quality.

If the car had an uncommon color it was far less likely to be a lemon. The logic behind this predictive algorithm turned out to be that if someone bought an unusual color they had a tendency to take better care of it.

There is logic behind the behavior of everyone and, if you can determine it, you can gain a tremendous competitive advantage.

Just as with Allstate Insurance and the used car company you can open yourself to the benefits of predictive analytics to develop an algorithm that is already data tested … and get the best solution for any challenge.

The art of the deal

hen a visitor comes to his office for the first time, Joel Lever, founding partner of Kurzman Eisenberg Corbin & Lever L.L.P. (KEC&L), proudly points to and describes the creative features of Marc Chagall’s Bible Series prints that adorn his wall.

An avid art collector himself, it turns out that one of Lever’s specialties is representing artists and art publishers, collectors and merchants and handling a wide range of sophisticated art transactions. Just as he has an appreciation for what makes a work of art unique, the same can be said about the portrait he renders of what has made his firm stand out since its founding in 1985.

That is when he went into practice with his father-in-law Sam Eisenberg, former Mount Vernon City Court judge and a co-founder of the firm who passed away in September at the age of 98.

Making the most of financial gifts to grandchildren

T

he bond between grandparents and grandchildren is unique. Typically free of daily responsibility for them, grandparents can focus on fun – and making financial gifts can be especially satisfying.

In many cases, though, the recession has altered family dynamics. Parents may have lost their jobs. Retirement and college funds may have been raided to pay monthly bills.

The generations may even have moved in together. So gifting to grandchildren can have an added dimension and it’s more important than ever to ensure that kindhearted gestures have the intended results. At the same time, a little forethought can lower your taxes or help qualify you for Medicaid coverage of long-term care.

Think through your goals. Do you want to help cover the cost of education or a first car? Do you envision annual gifts or a lump sum? Be careful not to over-extend yourself and budget for the economic downturns that can play havoc with retirement savings. Don’t forget to factor in the possibility of long-term care expense, as well.

Cold cash Writing a check may be easy but, tax considerations come into play if you make gifts in excess of $14,000 (as of 2013) to an individual in a single year. That maximum doubles for gifts from married couples. In addition to the annual $14,000 exclusion, there’s a $5.25 million (indexed for inflation) lifetime limit to tax-free gifting. Your grandchildren will incur no tax liability in either case – unless the

money is invested and earns income.

You may, however, have misgivings about how the funds might be used. A teenager’s idea of money well spent may differ sharply from yours. In that case, you could consider covering education or medical bills. If payments are made directly to the service provider, there’s no gift limit.

If the child has disabilities, there’s an additional consideration, since your generosity could disqualify them for important means-tested government benefits. In that case, you’ll want to explore creating a special needs trust, a vehicle to hold funds benefiting someone with disabilities without affecting their eligibility for public programs.

makes it a favorite target for doting grandparents. Investment income generated by a 529 account is tax-free so long as the funds are used to defray college expenses. There are often state income tax breaks for contributions, as well. Some 529 accounts will enable you to pay today’s rates for tuition credits to be used at public colleges in the future.

Gifting maximums apply, and while such accounts can affect a child’s eligibility for means-tested public benefits, they generally won’t interfere with their eligibility for college financial assistance.

If your goals are broader than funding higher education, consider establishing a custodial account. If your grandchild is under 21 (18 in some states), such an account, regulated under the Uniform Transfers to Minors Act (UTMA) or Uniform Gifts to Minors Act (UGMA), will enable you to retain influence over how the assets are used until the beneficiary reaches adulthood.

UTMA accounts are offered by banks and brokerage firms and can be funded with a broad range of financial assets in addition to cash. One downside is that they are often considered when calculating the need for college financial assistance.

strings attached In contrast, naming yourself trustee of a gift trust places you squarely in control for as long as you wish. You determine how assets are invested, when they become available to the beneficiary and even, if you wish, how distributions can be spent. The trust can also be designed so that you assume tax liability for any income that it generates. This may reduce the overall taxes paid by you and the trust. Since there are many variations, it’s important to consult an experienced attorney who can structure the trust to comply with your specific goals.

Of course, you can always leave money to the grandkids in your will, but there are definitely benefits to bestowing your financial gifts now. Beyond witnessing the smiles on their faces, you’ll be reducing your heirs’ exposure to estate taxes and spending down your assets in case you need Medicaid assistance for long-term care. All it takes is a little planning to ensure that your good intentions will have the desired effect.

Court rules against Hampshire owners

H

ampshire Country Club’s tax bill won’t be reduced after a state Supreme Court ruling found in favor of the village of Mamaroneck’s tax assessments of several properties owned by the club.

The decision is significant in that it is a rare tax certiorari that was not settled before it went to trial and decision – the village says as much as 90 percent of all certioraris are settled before trial. Village Mayor Norman Rosenblum said Mamaroneck saw the case through because they viewed the matter as precedent-setting for other mega properties and because the two sides were so far apart in their numbers.

Hampshire Recreation L.L.C., which bought the properties from Hampshire Country Club in 2010 for slightly more than $12 million, contended that its more than 120 acres were over-assessed from 2010 to 2012. The company sought to reduce its assessment to an average of $4.5 million over the contested years. Joanna C. Feldman of White Plains’ McCullough Goldberger Staudt L.L.P. was the counsel for the village in court. Most of the club is within the village, but roughly 8 acres is in the town of Mamaroneck and Hampshire also contested the town’s 2011 and 2012 assessments.

As it stands, the properties pay roughly $76,000 a year in village taxes not including school taxes or taxes paid to the town of Mamaroneck. A ruling in favor of Hampshire would have meant not only a hefty back-tax payment, but a reduced assessment roll for the village and the need to increase taxes on other property owners in order to put together a balanced budget, according to the mayor.

“We would have had to pay some big bucks,” Rosenblum said. “The sad part is… if you don’t get it from one person, you get it from another.”

Tax grievances and certiorari proceedings have become increasingly common in Westchester County over the last decade as property taxes skyrocketed, the economy tanked and most assessments were exposed as outdated. Most towns and cities in the county haven’t been reassessed for 35 years due to its cost and potential political ramifications. Up-to-date tax rolls could mean higher tax bills for some residential homeowners who in turn could take their frustrations out on Election Day. Courts became backlogged with certiorari cases and big cases were tied up in the

legal system while municipalities felt pressure to settle the cases rather than drag out a lengthy and potentially costly process.

With no interest from Westchester officials to conduct a countywide reassessment and with the cost of certioraris and reduced assessment rolls having taken their effect on local budgets, many communities have undertaken town- and citywide reassessments. Among those are Rye Town and Mamaroneck Town, which Mamaroneck Village is located within. Although the village has its own assessment office, the community is likely to adopt the town’s 100-percent-market valuations. Rosenblum said Hampshire will act as a point of reference for other large village grievances and potentially have implications outside of

Mamaroneck as well.

In the Hampshire ruling, Justice Bruce E. Tolbert noted that the sale price of the property was the best evidence of the property’s value. When the club that originally owned the property became distressed, it set the asking price at $14.9 million. The village and town combined to put a bid on the property at $10.1 million, with the intention of running it as a self-sustaining enterprise fund similar in management to Rye City-owned Rye Golf Club and Eastchesterowned Lake Isle Country Club.

The property, with its 18-hole golf course and 35,000-square-foot clubhouse, has been tied up in controversy since it was sold. The current owners are seeking to build a 290,000-square-foot condominium

complex with more than 100 units and a parking garage with more than 200 spaces, a move that would require that the village shift the zoning in the area.

The Mamaroneck Coastal Environmental Coalition, a civic group, was formed by residents opposed to the proposal. The group’s members have cited traffic and environmental concerns among the reasons the village should nix the proposal. An alternative plan would be to subdivide the golf course for residential homes. That move seems to be within zoning regulations, but might see difficulty getting environmental permits approved in a coastal area that has been tagged as sensitive, particularly in regard to potential flooding.

Attorney general names chief of Investor Protection Bureau Attorney General Eric T. Schneiderman last week chose Chad Johnson to serve as chief of the Investor Protection Bureau.

Johnson, who has more than 20 years of experience litigating securities cases on behalf of both shareholders and financial institutions, will enforce New York state securities laws in his new post. He joined the executive division of Schneiderman’s office in 2012, initially serving as senior trial counsel and later as deputy attorney general.

“Chad has already successfully led a number of the most important and noteworthy matters in our office – from investigating the conduct that led to the financial crisis in 2008 to ensuring that no one has an unfair early advantage in the markets,” Schneiderman said in a press release. “Under Chad’s stewardship, I’m confident that the Investor Protection Bureau will continue to advance Wall Street reforms that promote fairness and a level playing field, as well as hold wrongdoers accountable for their actions.”

Johnson had been a partner for nearly nine years with Bernstein Litowitz Berger & Grossmann L.L.P. in Manhattan, where he represented shareholders – including both institutional investors and individual shareholders – in securities fraud and corporate governance litigations.

He is a graduate of Harvard Law School and the University of Michigan.

Pace teacher’s article cited by Liberian court

An article written by Pace Law Professor Alexander “Sasha” Greenawalt was cited by the Special Court for Sierra Leone when it upheld the conviction and 50-year sentence of former Liberian President Charles Taylor.

Taylor had been convicted of crimes against humanity that were committed in Sierra Leone during that West African country’s civil war in the 1990s.

The court cited Greenawalt’s article, “Rethinking Genocidal Intent: The Case for a Knowledge-Based Interpretation,” a piece he wrote in 1999 for the Columbia

State bar chiefs say cuts imperil federal courts

A

t the start of the federal government shutdown this month, the president of the New York State Bar Association and leaders of the bar in six other states urged their congressional delegations to end sequestration cuts imposed this year that “imperil” the federal courts.

Rochester attorney David M. Schraver, president of the New York bar, joined bar association presidents in New Jersey, Illinois, Ohio, New York, Wisconsin, Nevada and Florida in a letter addressed to members of Congress from their respective states. They warned that staffing cuts have slowed pro-

cessing of civil and bankruptcy cases in some courts, “causing individuals, small businesses and corporations not to have their disputes and matters heard in a timely manner.”

They called continued funding cuts to federal defender services “most troubling” because it directly affects a defendant’s constitutional right to effective assistance of counsel and a speedy trial.

The bar leaders also noted the greater threat to public safety posed by cuts and reductions for court security, drug testing, substance use disorder and mental health treatment programs as well as parole and probation services. “The failure to fund these programs and services places our judiciary and the public at risk and puts justice in jeopardy,” the lawyers wrote.

The letter included testimony last July before a U.S. Senate subcommittee by Julia S. Gibbons, U.S. Sixth District Court of Appeals judge from Tennessee. She told senators the sequestration cuts that took effect March 1 have had a “devastating impact” on federal court operations nationwide.

Gibbons said the 5 percent across-theboard cut resulted in a nearly $350 million reduction in judiciary funding. Though judicial leaders implemented emergency measures for the 2013 fiscal year, “Many of these measures have been painful and difficult to implement and reflect one-time reductions that cannot be repeated if future funding levels remain flat or decline.”

She said the current staffing level of 20,100 personnel in the federal courts “is the lowest since 1999 despite significant workload growth since that time.”

“The judiciary cannot continue to operate at such drastically reduced funding levels without seriously compromising the constitutional mission of the federal courts,” Gibbons warned senators.

The Court of Appeals judge noted the judiciary requested an emergency supplemental appropriation of $72.9 million in the 2013 fiscal year to meet critical needs in the wake of the sequestration cut. But she told the Senate subcommittee she is not optimistic that funding for courts will be restored in the 2014 fiscal year that began Oct. 1, given “the sharp disagreement” between the White House and Senate and the House of Representatives.

“We find ourselves in the midst of a funding crisis, yet we are caught in a disagreement between the other two branches,” Gibbons testified.

The seven state bar associations represented in the appeal to Congress together have more than 286,500 members.

Sound Shore medical residents to present at symposium

MILLICENT L. KAUFMAN of Scarsdale, has been elected chairman of the board of directors of the Westchester Philharmonic. Kaufman, a member of the board for 11 years and its former president from 2003 to 2006, succeeds Neil D. Aaron, who will continue on the board’s executive committee.

The longtime Scarsdale resident and community leader was elected unanimously at a recent meeting of the board directors.

“Being an integral part of the leadership team of the Westchester Philharmonic for more than a decade is a great honor.

I look forward to working with my dedicated fellow board members, our hard-working staff and all of our friends and patrons in the community in support of this incredible orchestra, which is such an indispensible aspect of our cultural life,” Kaufman said.

Written by award-winning Canadian playwright Vern Thiessen, “Shakespeare’s Will,” a one-act solo performance, will be performed at the Tusten Theatre in Narrowsburg at 8 p.m. Oct. 19.

The play sheds light on William Shakespeare’s wife, Anne Hathaway. Performed by North American Cultural Lab Theatre’s Tannis Kowalchuk, with music by Kurt Knuth, costumes by Karen Flood and directed by NACL resident director Mimi McGurl, the play looks through the eyes and heart of a woman and mother who spent a lifetime with and without the great playwright. This work is a celebration of a life unbowed by tragedy and unapologetic in the face of public scorn.

The drama begins with Hathaway arriving home after the funeral, holding a copy of Shakespeare’s will. She reminisces about her first meeting with Shakespeare, their courtship, their strained marriage, their children and his death from fever. In his will he leaves Anne with a big surprise. Kowalchuk premiered “Shakespeare’s Will” in Sullivan County last season at NACL Theatre, and will travel to Pontine Theatre in Portsmouth NH in 2014 to perform the play.

Kowalchuk is co-founder, actress, and artistic director of NACL Theatre and has created and performed in more than 18 original NACL productions.

The Tusten Theatre is at 210 Bridge St., Narrowsburg.

THE DELAWARE VALLEY ARTS ALLIANCE in Narrowsburg, is offering three grants to assist organizations and municipalities with cultural programming and one grant for an artist-generated community project. Grant deadlines run from Nov. 15 to Dec. 6.

BARBARA SMITH GIOIA, CALI GOREVIC and JAANIKA PEERNA are currently showing their work at the Garrison Art Center, 23 Garrison’s Landing. Gioia has been involved in the center’s education program as a teaching artist for nearly 10 years. She also manages the printmaking studio where she developed her unique silkscreen techniques.

Gorevic has been a vital voice at the center and is the founder of its annual juried photography show, PHOTOcentric. Although known for her black and white film photography, she is equally accomplished in all areas of photography.

Peerna, a teaching artist at the center, where she has taught experimental drawing classes for many years, is a multimedia creative force, expressing herself through drawings, videos and installations that address the theme of transitions in nature: light, air, water.

An exhibit of paintings by Richard Neal will run through Jan. 9 at the Breezeway Gallery at Camphill Ghent, 2542 Route 66, Chatham. The paintings include those inspired by a recent trip to deserts in Arizona and Utah, as well as representative works from the past few years.

Neal was born in Louisville, Ky., and began painting at the age of 15, inspired by Claude Monet’s Impression Soleil.

PARC director receives award

SISTER FRAN GORSUCH has been appointed executive of the board of trustees of the Catholic Community Services of Rockland, the Haverstraw-based nonprofit. Gorsuch is director of community initiative at Bon Secours Charity Health System.

Previously she was board secretary of the human services agency that serves non-Catholics and Catholics in the entire county under its mission banner “Meet the Need.” The agency provides food to Rockland’s hungry, helps families avoid eviction, assists in emergency utilities payments and provides resource services for immigrants. The agency has recently received accolades for its fresh-grown produce program for Rockland’s neediest.

RAND BRIDGET OTTEN, director of development and outreach for Putnam ARC, the leading provider of services for children and adults with developmental disabilities in Putnam County, received the Distinguished Service Award from the Putnam Community Service Network (PCSN) at its annual award breakfast.

Senior art director Kathryn Houghtaling, associate art director Emily Garozzo, senior web and graphic designer Kevin Green and designer MaryAnn Ellsworth were honored for their outstanding work in publication and Internet design.

The national awards, which are given out annually, recognize graphic design work across many categories, ranging from print and packaging to web and interactive design. This is the second consecutive year Graphic Design USA magazine has recognized the firm with awards.

The agency received awards for its work with three of its clients: Monticello Motor Club (publication design); Hudson Valley Economic Development Corp. (Internet design); and Judelson, Giordano & Siegel CPA, PC (Internet design).

The American Graphic Design Awards competition is open to all in the field of graphic arts and design, including advertising agencies, design firms, publishers and more. More than 8,000 entries were submitted from across the country; only 15 percent were recognized with certificates of excellence. Graphic Design USA is a publication for graphic designers and other creative professionals across the country.

The award-winning house at 577 Grant Road is the home of Rosa and Zachary Schulman. The almost 4,000-square-foot renovation included the redesign of the first floor and entranceway plus the addition of a second floor onto the original single-story ranch house. A second garage was added to accommodate an antique and classic car collection. The house is situated on a 10-acre site with seasonal views of the New York City skyline.
