any businesses in the area are still living under Hurricane Sandy’s cloud as they navigate the next phase of recovery: the insurance claims process. There are a suffocating number of business-related claims for those covered in the region. According to state government figures, in Westchester County alone, 265,300 businesses were impacted by the storm. Compare that with the 18,700 businesses that took a hit in Louisiana during Hurricanes Katrina and Rita and it becomes a huge issue for the insurance industry. The Stern Agency, an independent insurance firm with offices in Rockland County and New York City, has clients in Westchester, including The Capitol Theatre in Port Chester. The newly reopened theater took a financial hit after cancelling five shows scheduled for the week of and after the storm. Among other things, the company is claiming loss of business income. “It’s an insurable risk,” said Adam Stern, senior vice president of the family-operated agency. The Capitol Theatre is not alone. In fact, Stern says, the insurance industry is overwhelmed not just by loss of income claims, but flood and wind damage that have made it necessary for business owners to file property claims as well. Companies like Stern’s manage claims and 80 to 90 percent are Sandy related. “That’s the problem,” he said. “There’s such an abundance, we’re having a hard time getting adjusters. Adjusters for carriers are coming from Canada, even London, to handle claims.” The agency filters 90 percent of their claims for commercial clients mostly in the New York and New Jersey area. Stern said he remains hopeful that things will quiet down by the new year, but other insurance agents aren’t so sure. Insurance industry professionals are well aware of the mounting cost of the damage done by Hurricane Sandy. Gov. Andrew Cuomo’s office completed a detailed statewide

After Sandy, how smart is ‘smart growth?’

rom Yonkers to Ossining, Westchester developers are moving ahead this winter with plans to redevelop vacant industrial sites on the Hudson River for residential and retail uses. But is “smart growth” – as planners call the movement to redevelop properties near mass transit and existing infrastructure as high-density neighborhoods supported by new retail and commercial enterprise – looking as smart on the riverfront in the aftermath of Hurricane Sandy? Amid the flood stories swapped, that question hovered over discussions at a recent daylong presentation in Peekskill on revitalizing Hudson riverfronts in an era of global climate change. An event sponsor, Scenic Hudson Inc., in 2010 published “Revitalizing Hudson Riverfronts,” a report recommending conservation and development strategies for river communities that seems more urgent and timely as New York recovers and rebuilds from the late October disaster. Steve Rosenberg, senior vice president of Scenic Hudson, said this post-Sandy period is “an opportunity to make it right” in development on the riverfront, which he said New York state should view as “the goose that laid the golden egg.” Making it right will require a change in thinking, he said “We have to start thinking like we’re amphibians, perhaps,” Rosenberg said, and be prepared to “get wet once in a while” as sea levels rise and more frequent and severe flooding occurs with global warming. Rising sea levels and more intense storm events will create “amphibious zones” in 82 Hudson River communities with about 250,000 riverfront properties, said Sacha Spector, Scenic Hudson’s director of conservation science. Storm surges, which caused deaths and billions of dollars in property damage when Sandy struck the metropolitan region, “will be riding on top of a higher ocean” and inflict wider flood damage in coming

decades, she said. In Ossining, village planner Valerie Monastra said she has seen a change in Westchester’s planning and development community in the wake of Sandy. “Clearly in my personal opinion it seems to have had an effect on the way people are looking at waterfront development and waterfront design,” she said. “The last thing we want is to construct waterfront development that continually has flooding issues.” Most developers are willing to pay “slightly more” in construction costs “because they themselves don’t want to deal with flooding issues time and time again,” she said. Monastra said the village of Ossining in the last five years adopted measures that left it better prepared for major storms. The village in 2007 expanded its storm water control regulations, which had applied only to properties one acre or larger, to generally included properties of 2,500 square feet or more. In 2008, Ossining adopted new and stricter flood regulations

required by the state, she said. In 2009, the village revised zoning regulations to require a 50-foot setback for buildings on the waterfront. The village previously had no setback requirement. “I think between the new flood regulations, the storm water regulations and the new zoning code, that we are taking the proactive steps that we need,” Monastra said. “We’re not looking at stopping development on our waterfront,” the Ossining planner said. “It’s about creating the right development along the waterfront.” Developer Martin Ginsburg saw the Hudson surge over a newly built bulkhead at the riverfront site of Harbor Square, a proposed 168-unit apartment building and retail and restaurant development on which Ginsburg Development Cos. expect to break ground next spring. “It was a 750-year storm,” Ginsburg said of Sandy. “It’s very hard to plan for a 750year storm.” “However, since we’ve had this particular type of storm, we’re certainly going to

modify our plans to reflect what was the high-water level for this kind of storm.” Floodwater rose about four feet above what was projected as the high-water level for a 100-year storm, Ginsburg noted. Ginsburg said flood-exposed areas of the Harbor Square site will be designed to resist flooding “and any buildings will be above what we now have with the 750-year flood plan.” In Yonkers, business owner and prospective waterfront developer Ron Shemesh saw flood damage at his Excelsior Packaging Group plant at 159 Alexander St. Shemesh, though, has not been deterred in his plans to redevelop the long-vacant Glenwood Power Plant, which also sustained some flood damage on the Yonkers waterfront. His development company, Glenwood POH L.L.C., has a purchase contract on the approximately 1.48 million-square-foot power plant complex, whose twin red-brick smokestacks are landmarks on the lower Hudson. The Yonkers planning board is reviewing the developer’s proposal to create 256,475 square feet of hotel, restaurant and entertainment space in the existing historic buildings. The estimated $175 million project is expected to create 1,800 construction jobs and an estimated 955 permanent jobs. Yonkers residents at a recent planning board hearing objected to Shemesh’s proposal to build an underground parking garage on the site of Trevor Park, north of the power plant site, and build a new park atop the garage. The Glenwood project “presents a unique and extraordinary opportunity to expand and enhance Yonkers’ appeal as a destination, as well as raise its local, regional, national and international profile, “ the developer told city officials. “It will also serve as a national model for innovative architectural preservation and full adaptation of former power structures.” Whether that innovative model will incorporate flood planning that applies data collected in the recent storm is not known. Shemesh could not be reached for comment.

State adds almost 6,000 jobs, unemployment rate in HV increases BY SAM BARRON sbarron@westfairinc.com

T

he economy in New York state continues to improve, though unemployment in the lower Hudson Valley remains high. The State Department of Labor in its October job report announced that New York state added 5,900 private sector jobs in October and 110,300 private sector jobs in 2012. The unemployment rate fell 0.2 percent year to year to 8.7 percent. The number of unemployed fell by 17,500 to 830,600. New York’s private sector job growth was in line with the rest of the country, though its unemployment rate is 0.8 percent higher. The unemployment rate in the Westchester-Rockland-Putnam area rose from 6.5 percent to 6.9 percent year-to-year. For 2012, the region’s average unemployment rate is 7.1 percent, while 2011 averaged 6.7 percent. The Westchester-Rockland-Putnam region saw a 1.1 percent increase in job growth, gaining 6,400 jobs and 8,000 private sector jobs. Professional and business services

gained 52,600 jobs, while educational and health services gained 37,900, consistent with earlier numbers. Construction lost 12,400 jobs, while manufacturing lost 3,700 jobs. Information, which covers publishing, broadcasting and telecommunications, among other fields, lost 5,400 jobs. Westchester has 447,800 people employed and 34,000 people unemployed, both increases from last year. The overall labor force in the lower Hudson Valley has increased year-to-year from 681,100 people to 695,300 people. Johny Nelson, a labor analyst for the State Department of Labor, said that while the unemployment rate remains high, people are more confident about the job market. “The labor force has been increasing significantly,” Nelson said. “Industry data has been improving. Now that people hear the job market is improving, they are becoming more optimistic and flooding the market with resumes and participating again. We are trending positively.” At the recession’s peak, the unemployment rate in the lower Hudson Valley reached 7.9 percent in January and February 2010.

The lowest unemployment rate recorded was 2.7 percent in December 1999. Putnam and Rockland have two of the lowest unemployment rates in the state. Putnam is second with 6.5 percent unemployed, while Rockland is fourth at 6.9 percent. According to data released by the U.S. Bureau of Economic Analysis, per capita personal incomes in Westchester, Putnam and Rockland are also on the rise, but not back up to pre-recession levels. Westchester’s per capita personal income in 2011 is $75,855, an increase from $73,504 in 2010, but below its peak of $77,741 in 2008. Rockland’s per capita personal income in 2011 is $53,787, just below its 2008 peak of $53,682. In 2010, per capita personal income in Rockland was $51,544. Putnam also experienced a healthy increase, from $52,071 in 2010 to $53,781 in 2011. In 2008, personal income peaked at $54,037. In New York state as a whole, per capita personal income is at an all-time high, up to $51,126, from $49,119 in 2010. In 2008, income was $49,408.

ith more than half of the country experiencing drought conditions this year, a survey released by global water technology company Xylem Inc. shows that consumers are more concerned about water than ever before. Xylem, a company focused on developing improved water technology worldwide, marked its one-year anniversary last month, releasing a survey showing that people are more aware of water issues than ever before. The company is headquartered in White Plains and was spun off from ITT Corp. last year. The company released its 2012 Xylem Value of Water Index two weeks ago that showed 77 percent of Americans are concerned about the state of water infrastructure and 61 percent are willing to pay more to fix it – substantial increases over a similar survey Xylem conducted in 2010. “We launched the 2012 Xylem Value of Water Index because we want to determine exactly what people think about water and what they are willing to do to ensure they have access to this vital resource,” Gretchen McClain, Xylem’s president and CEO, said in a statement. “Keeping our water systems running efficiently to provide safe water to our citizens must become a national priority. This unseen crisis must become a shared responsibility.” According to the U.S. Drought Monitor (droughtmonitor.unl.edu), the High Plains have an exceptionally high drought level, while the West has severe to extreme droughts. Xylem said the water industry must play a leadership role in raising public awareness of the decaying water infrastructure and the company supports full water pricing and the development of conservation and reuse efforts. The survey is based on a telephone study of 1,008 American voters age 18 years and older. The margin of error is plus or minus 3.1 percent. The study was conducted between August 16 and 23. “The findings were consistent,” said Tom Glover, Xylem’s vice president of global public affairs. “Even in a difficult economy with people acknowledging that their water bills have gone up, people have said they are willing to pay a bit more to ensure ready access to clean water.” Glover thinks incidents like this year’s drought that plagued much of the country have made people aware of water issues. The Northeast was not impacted by this year’s droughts. According to the American Water Works Association (AWWA), for every $10 billion

spent on water-related projects, an additional 400,000 jobs could be created. For Xylem, advocating for improved infrastructure is another step for a company gaining its foothold in the industry. Xylem has more than 12,500 employees and in 2011 had revenues of $3.8 billion, doing business in more than 150 countries.

This unseen crisis must become a shared responsibility.” – Gretchen McClain In its most recent earnings report, Xylem’s third quarter produced $931 million in revenue, $557 million in expenses and $374 million in gross profit, with a net income of $72 million. The third quarter of 2011 saw revenues of $939 million, expenses at $574 million, gross profit of $365 million and a net income of $77 million. The third quarter of 2012 saw basic earnings per share at 39 cents, down from 42 cents in the third quarter of 2011. Year-to-date, Xylem has $2.8 billion in revenues, $1.7 billion in expenses, $1.1 billion in gross profit and a net income of $224 billion, with total assets of $1.8 billion. Xylem has also earned shareholders $1.20 this year, down from $1.23 at this point in 2011. “We’ve had a good first year with good operating results,” Glover said. “We’ve captured the enthusiasm of 12,000 employees who are united around water. It’s an interesting and exciting proposition.” Xylem has been building its brand through acquisitions. The company acquired YSI Inc., a developer of pH sensors for $350 million in September 2011, and in July 2012 acquired Denmark-based MJK Automation, which manufactures equipment for measurement and control of drinking water treatment for $12.5 million. Heartland Pump Rental and Service, an Illinois-based company, was acquired for $29 million. The company is projecting to spend $300 million to $500 million on acquisitions in 2013. ITT said spinning off Xylem and other brands put the company in better position to focus on key drivers to accelerate growth.

One is the loneliest number when it comes to sales There is no sales force. We’re not selling a product, we’re providing a bid service. I can crank out the bids with the help of my staff. Should there be more to sales or am I smart to keep things lean? Thoughts of the day: Responding to bids is highly competitive. Companies that want to grow margin learn how to get additional business without being the low bidder. The owner of a growing firm can’t be its only salesperson. In bidding, the greater fool theory takes hold. An enthusiastic optimist bids less in order to get the work. A qualified firm offers an unusually low price to keep cash flow going or to build their portfolio in a particular niche. An unqualified firm sneaks in and steals the show with a good bid. Over time, bid prices decline and margins deteriorate. There are advantages to pursuing work through bidding. Getting onto bid lists can increase a company’s pipeline of opportunity. Bidding can level the playing field, limiting a favored seller’s influence. Publication of bid results can reveal information about competitors. Once you company has submitted a number of bids, it’s time to evaluate results. Are you winning anything? Or, coming closer to winning? For example, are you moving from second runner-up to first runner-up? Can your company do the work at the winning bid’s price and make a profit? If you can answer “yes,” keep going with more bids. More than one “no” answer? Quickly change with your bidding process. Or, quit bidding – figure out what, when, why you lose – then avoid those kinds of bids. Losing bids means wasted effort. Redirect energy into more productive sales activities. Assign someone to working a list of targets. Look for companies that don’t typically bid or that have a reputation for working with key suppliers. Seek out buyers with unique and constantly evolving requirements that, when met, eliminate most other suppliers. Invest in getting to know those buyers. Find out which ones will purchase without going through sealed bids. Lead the market rather than following it. Be a problem solver and get favorable

sales treatment from forward-thinking prospects. Partner with buyers to develop custom solutions in exchange for preferred supplier status. Want to build exit value for your company? Commit to building a sales and marketing force. One reason most companies participate in a bidding process is because they don’t get enough work from other means. Break the cycle by thinking long term. It may take a year or more to build an effective sales and marketing team. The sooner you get to work ramping that up, the sooner you’ll see the results. And the less vulnerable your company will be, as it no longer depends on you, the owner, for the next sale. Think you can’t afford to invest in marketing and sales? Consider the margin your company leaves on the table through competitive bidding. Once you get through the ramp up cycle, a sales and marketing force will pay for itself in multiple ways. Your new team should produce higher margins, greater volume and a better match with ideal customers who are less difficult to service. If you don’t want to manage or can’t afford to build a full-time sales force, consider a rep network. Look for people who are already selling to your target market. Get them training and tools to help them sell your offerings. Help them to increase their income by expanding their portfolio. Resist the temptation to focus on operations. Business owners often work to perfect what they offer to the market beyond the point of optimum value. “If you build it they will come” doesn’t work nearly as well as “Be there, ready to serve, before the customer even knows they need something.” The former comes from operations, the latter from sales. Are we headed toward the Fiscal Cliff? BY MATTHEW KUCHINSKY, CPA CITRIN COOPERMAN A widely spoken about subject over the last several months is the “Fiscal Cliff,” which, if it occurs, beginning on January 1, 2013, will impose automatic across-the-board government spending cuts and dramatic tax changes affecting individuals and estates. The extent of these tax changes would result in unprecedented tax increases for most taxpayers. The question of the hour is: “Will those in power actually allow us to go over the Fiscal Cliff?” While we can only speculate the answer to this question, it is critical that taxpayers understand the possible implications to them. If nothing is done to avoid it, here is what will happen effective January 1, 2013: In 2001, Congress passed the “Bush Tax Cuts,” officially called the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA). These tax cuts are set to expire at the end of 2012. As a result of the expiring Bush Tax Cuts, tax rates on income, capital gains, dividends, and estates will increase, and the alternative minimum tax will spread to millions more Americans. The top statutory tax rate on all ordinary income will rise to 39.6%, up from 35%, and the top rate on longterm capital gains will increase to 20%, up from 15%. In addition, the top qualified dividend tax rates will increase from 15% to 39.6%. At the same time, provisions of the 2010 Healthcare Tax Act, kicking into effect in 2013, will impose on higher income households an extra 0.9% Medicare payroll tax and a new 3.8% percent tax on net investment income, effectively increasing tax rates even more. In 2013, investors will no longer be able to pay 0% on their long-term capital gains because there will no longer be a 10% tax bracket. With long-term

capital gains rates set to increase to 20% in 2013, investors should consider whether to sell in 2012 rather than waiting until 2013. Qualified Dividend Taxes: Currently, qualified dividends are taxed at the more favorable long-term capital gains rates. In 2013, both qualified and ordinary dividends will be taxed at ordinary tax rates. For some investors, this could result in tax rates as high as 39.6%. Here again, investors should consider the role that dividendpaying stocks play in their portfolio. Medicare Surtax: For higher income taxpayers, an additional 3.8% Medicare investment tax will be due beginning in 2013. The tax is calculated by multiplying the 3.8% tax rate by the lower of the following two amounts: • Net investment income for the year; or • Modified adjusted gross income over a certain threshold amount Modified adjusted gross income thresholds for the additional Medicare tax are: • $250,000 for married filing joint filers and qualifying widows or widowers • $200,000 for single and head of household filers Additional Medicare Tax: An additional .9% Medicare tax will be imposed to single taxpayers with modified adjusted gross income (MAGI) over $200,000 and married taxpayers who file jointly with a MAGI over $250,000. In light of all of these looming changes, taxpayers should consider whether they should accelerate into tax year 2012, earned income that otherwise would fall into 2013, such as wage bonuses, commissions, etc. Currently, the future tax picture looks bleak. However, the next coming months will be very telling as to whether public outrage, market fears and other political pressure finally force our politicians into action to prevent a potentially harsh and somewhat unintended tax increase from being unleashed into an already weary economy. Hotel ­— six-story hotel and an approximately 120-space underground parking garage. The eight-story building will rise on the site of a former A&P supermarket demolished last year. The groundbreaking in White Plains will kick off construction of three Cambria Suites hotels in the metropolitan market; the other two will be built in Manhattan. A spokesperson for Choice Hotels said the three projects will create more than 1,000 construction jobs and represent a $140 million investment. Michael Murphy, senior vice president of Cambria Suites, said the upscale business travel brand is making its entry in the New York market after opening 19 hotels in secondary and tertiary markets across the country. The move into primary markets will include hotel construction in Washington, D.C., and a Cambria Suites opening at Miami International Airport in 2013. “I’ve been in this business 30 years and this will be the first time I’ve ever gone through an experience like this,” Murphy said of his company’s triple groundbreaking in a 24-hour span. “Our company wants to get into New York City. Our company wants to get into White Plains, for obvious reasons.” The White Plains market “has a perfect blend for business (customers) on weekdays and leisure on the weekend side,” said Murphy. Business travel from Sunday night through Thursday night will be the hotel’s main focus, he said. “In the travel industry, the upscale segment of the hotel industry is the highest-demand segment today,” said Murphy. “We see that growth continuing for the next 20 years.” The White Plains hotel will employ 30 fulltime workers, said William Meyer, chairman of Meyer Jabara Hotels, the joint venture partner that will operate the hotel. Meyer Jabara, with offices in West Palm Beach, Fla., and Danbury, Conn., also owns and operates a Holiday Inn in Mount Kisco and the Stamford Marriott Hotel & Spa in Connecticut. Meyer, a Harrison native, said the White Plains project is his company’s first venture with Choice Hotels International. Meyer Jabara,

though, had worked on several deals with the president and CEO of Choice Hotels, Stephen P. Joyce, during his prior executive stint at Marriott International Inc. “There were a lot of people who took a look at this deal,” said Meyer, whose company is not a partner with Choice Hotels in its two Manhattan projects. “Choice was the most aggressive of all of the franchisors. We thought the marriage was a good one.” All Cambria Suites units include both bedrooms and living room-workspace areas. The downtown hotel, which also will have an indoor pool and 11,600 square feet of meeting space, will accommodate both overnight and extended-stay guests, said Meyer. “It’s an upscale experience,” he said. For hotel franchisors, “The allure of White Plains is that it happens to be an excellent hotel market both in terms of occupancy and average

rates” for room rentals, said Meyer. He said there is “no question” the hotel market in the county seat has rebounded from the recession, posting increases in both occupancy and average rental rates. Retail tenants also have been drawn to the Main Street block where the Metropolitan Plaza

For business owners in particular, it’s an unfair process, Rey said, “but insurance companies don’t write blank checks. (Businesses) have to substantiate how much they’ve lost. So while they try to recover, they also have to get their receipts together to get something back.” The slow-moving process has a ripple effect, making it difficult to tell when the industry will be able to whittle down the heap of Sandy-related insurance claims. Stern believes the effects of Sandy will be

felt in the insurance industry long after the last claim is paid out. “After 9/11, prices for carriers went way up – they doubled,” he said. Right now, carriers are able to exclude things like flood insurance, Stern added, but he predicts the government will step in and make some drastic changes to the industry. Hurricane Sandy “will change our industry just like 9/11 did.” Insured businesses also face a potential increase in rates. As Rey put it, the insurance industry is “crying poverty,” which means it will continue to file for rate hikes “because the industry can.” Rey said she understands why the industry is asking for more money from clients and she’s seen

hikes across the board. It’s up to elected officials, however, to allow for a price increase. So far, Cuomo is siding with consumers. He has also attempted to make the insurance process better for Sandy victims, offering insurance assistance throughout the state and even waiving deductible costs for homeowners. Some business owners have benefited from new rules, even from special Sandy-related business loans, but most continue to plod through paperwork. Rey said the process is “frustrating” for everybody, and there’s no timetable for when it will get better. “The devastation is beyond words and the thing is there’s no one to blame. We need someone to blame.”

White Plains firm brokers top suburban lease

Howard Properties Ltd. has won the Lease of the Year award from the Connecticut and suburban New York chapter of the NAIOP Commercial Real Estate Development Association for representing the Wilson Elser law firm in its lease of 125,000 square feet of office space at 1133 Westchester Ave. in White Plains. The relocation deal, the largest office lease of 2011 in Westchester County, was brokered for the tenant by Howard E. Greenberg, president of Howard Properties in White Plains. Greenberg in a statement said the award confirms his business operating principle that a small boutique firm “can successfully compete and win the prize for the largest transaction in Westchester County.” He founded the firm in 1998. NAIOP, with a North American network of more than 15,000 members, represents developers, owners and investors in office, industrial, retail and mixed-use real estate.

Real Estate, who brokered the deal on behalf of MPAA, in a statement said, “Finding topquality office space at a reasonable price was imperative to maintaining MPAA’s presence in Westchester County, and I’m glad to have been able to work with Malkin Properties to achieve this goal.” A 20-year-old global organization, MPAA is an advocate of the U.S. motion picture, home video and television industries worldwide. Its members are of the six major U.S. motion picture studios: Walt Disney Studios, Paramount Pictures, Sony Pictures Entertainment, Twentieth Century Fox, Universal City Studios and Warner Brothers Entertainment. Newman represented the landlord in the deal along with Malkin Properties leasing associates Kimberly Zaccagnino and Tara L. Long.

eri Lamar spent the bulk of her professional life as an executive secretary. Never in those 30-plus years did she realize she was developing skills that would serve her so well in her second act, as the singer and all-around driving force of Teri Lamar & New Company. “I thank God every day that I was so organized, so businesslike,” she said. “Everything is contracted. Everything is right on schedule.” In a field sometimes known more for artistic temperaments than business savvy, Lamar has established herself as a performer in demand for everything from Friday nights at local bars and restaurants to Saturday-afternoon wedding receptions, from community concerts to holiday gatherings for private and corporate clients. “We are a holiday band,” she said. “We do a lot of parties.” Even with a busy December, capped by two engagements on New Year’s Eve, Lamar is still accepting bookings. “I book everywhere from last minute to a wedding that’s a year ahead. …I never have a slow season. Slow for us is only one to two gigs a week.” The pace is a good one for Lamar, who lost her corporate job in the wake of the Sept. 11 terrorist attacks and was figuring out her next move when she started her musical career. “I always liked to sing,” she said. “I knew I could carry a tune.” She tried an open-mike night and “people clapped.” That early encouragement led to teaming up with local musicians and soon she had a band that was being hired. “Apparently I was good at booking,” she said, adding she also had the drive. “I

had my heart in it because since I was 7, I wanted to be one of the Supremes.” At first, she said, people assumed she was an industry veteran. “So here I am, 50 years old and people look at you and say ‘You must have been doing this for years.’” She was a quick study and soon became known not only for her talent and versatility but also for her work ethic and professionalism. She frowns on drinking, smoking and drugs and encourages presentable dress. “We’re grown-ups,” she said, simply. And in today’s economy, these touches make a big difference when competing for nights at restaurants and bars that might yield just $75 to $110 per band member. “Bands have been forced to lower their prices because of the economy and because of the competition with DJs,” she said. Lamar performs as a duo up to a full six-piece band, with core band members including Frank Brenna on keyboards, bass and vocals, guitarist/vocalist Jamie Bannon and Greg Laruccia on drums. Lamar said her band’s repertoire – everything from Motown to Adele, Alicia Keys to Linda Ronstadt – keeps her current and in demand. “You have to include new stuff all the time,” she said. “You play to the crowd. That was something somebody taught me a long time ago – Know your audience.” And that audience is often found at venues such as Pete’s Saloon & Restaurant in Elmsford where Lamar has struck a chord with owner Peter Riekstins, a former full-time musician who makes live music a key element of his offerings. He remembers Lamar from those early days. “All of a sudden, she just started singing and sitting in with people who were here,” he said. “She really proved herself.” And Riekstins continues to book her on a regular basis. “She’s got a certain niche,” he said, describing it as a mix of pop-rock and dance music, something the “30- to 50-year-old crowd really appreciates.” Though the music keeps her busy, it’s not Lamar’s only job; she also works part time in child care and in security for area schools. All of her jobs, though, are flexible, which allows her to create her own schedule. “I spent a lifetime commuting and clocking in,” she said. “(Now), I’m on my own schedule.” And throughout that schedule she retains an enthusiasm that also sets her apart. “I’m the 58-year-old that’s not burned out from doing it 30 years.”


Landlord honored for generosity

hen Kid’s Kloset needed a hand, George Constantin came calling. Westchester Jewish Community Services (WJCS) honored Constantin with its Corporate Hero Award Nov. 20 for providing space at 4 Gannett Drive in West Harrison to Kid’s Kloset after it was displaced due to a fire. Constantin runs Heritage Realty Services L.L.C. and Heritage Realty Investment Management L.L.C., both based in New York City. “Mr. Constantin’s generosity of spirit has been a tremendous blessing,” said Stephanie Roth, Kid’s Kloset director. “WJCS is more than grateful that he recognized the void Kid’s Kloset fills in the community and provided us with a way to continue our mission.” Kid’s Kloset, at 170 E. Post Road in White Plains, is a service of volunteer drivers who pick up donations at people’s homes. The service was started in September 2011 and has provided a week’s worth of clothing to more than 2,000 children in need. Six weeks ago, a fire started in the air conditioning unit at Kid’s Kloset’s space in White Plains, making the space uninhabitable. With nowhere to

turn, Constantin offered the vacant office space. “The success of Kid’s Kloset is totally reliant on the generosity of others – people who donate children’s clothes, people who contribute time to sort and redistribute those items and people like Mr. Constantin who provide us with the all-important base of operation,” Roth said. “He is truly Kid’s Kloset’s hero.” Constantin, who was also recognized by Deputy County Executive Kevin Plunkett, said he was speechless upon receiving the recognition. “There is something very special about Westchester,” Constantin said. “There is a sincere spirit of community. Westchester has been very good to us. It’s sad to see such great people in need. People need help and I am glad I can help.” Constantin said that in an affluent area like Westchester, people don’t realize that there is poverty and people in need, and organizations like Kid’s Kloset perform a valuable service. “I was taken aback by the volunteerism that exists here,” Constantin said. “It’s very special.” Kid’s Kloset expects to be back in its original space in a few weeks. That space was donated by WJCS board member Roy Stillman, who runs Stillman Development International.

few years ago, Don Levy noticed a change in the world of consumer spending. “I remember it was common for people to write a check at the store,” he said. People would stand in line waiting patiently as they watched a person get their checkbook out, find a pen to write up the amount, show ID and complete their purchase. Levy, director of the Siena Research Institute (SRI) in Loudonville, said now that way of paying for things is unusual. “People run their cards through the omnipresent swipe machine.” It’s a big shift in consumer behavior, according to Levy, one that many are monitoring as the much-anticipated shopping season is underway. Black Friday didn’t exactly kick off the holiday spending season this year, as shoppers were introduced to Gray Thursday. Some stores opened on Thanksgiving hoping to lure shoppers away from the dinner table with big savings on the season’s popular items. In many ways that option has paid off. A National Retail Federation survey revealed 247 million people shopped in stores and on websites over Black Friday weekend and spent an estimated $59.1 billion. Throughout the state, retailers are reporting shoppers were not deterred by Hurricane Sandy, either. Seventy-four percent of store owners surveyed by the Retail Council of New York State said their numbers fared better than last year. Mobile apps revolutionize Black Friday

imple applications on mobile phones have changed the way that people shop, particularly over the Black Friday shopping weekend. Consumers with smartphones now have access to apps that allow real-time price comparison, helping them find the cheapest price for a product. Mobile apps include Amazon’s Price Checker, TGI Black Friday and Shopkick. Alyson O’Mahoney, executive vice president at Mount Kisco-based Robin Leedy Associates, a PR firm that specializes in social media, said that companies like Best Buy have become glorified showrooms. Customers go into stores like Best Buy, use their price scanners and then head home to a website and get a product for cheaper. “It’s helping shoppers, which is always a good thing,” she said. “Consumers have become smarter and savvier. I think for the person who is price conscious, it is important. It’s definitely changing the face of shopping.” O’Mahoney said companies have been

learning to adjust to the showroom effect and are pricing products accordingly. Sites often offer hourly deals to catch the attention of consumers. Many retailers like Best Buy will simply offer customers the product at the lowest price they find it at. Kristen Ruby, president of Mount Kisco-based Ruby Media Group, said that mobile apps are part of a broader look at how social media has really changed events like Black Friday. “With Facebook promotions and pages, a lot of retailers and businesses are getting the message out there,” she said. Small Business Saturday, which was started by American Express and held the day after Black Friday, is a shopping day designed to boost small businesses. It was created and made popular using social media. American Express provides retailers with Facebook posts and tweets to promote their small business. “A lot of small businesses see Black Friday for larger retailers – they can’t compete with stores that slash prices like Target,” Ruby said. “It’s too much. They offer smaller, but more consistent promotions. I would rather see a small business

seven times a year offer products at 10 percent off, rather than one day a year offer 70 percent off.” Ruby said that retail stores need to be better at training employees on how to handle customers who use mobile apps to find the cheapest prices. Though small businesses could find themselves priced out of the mobile app price wars, small businesses said they had little impact. Rob Woodrow, who runs Woodrow Jewelers in Rye, said that the Internet continues to have a negative impact on his store, as people use it to shop rather than going to his store. “We’ve tried very hard to establish an Internet presence,” Woodrow said. “We established a Facebook page. We want to let people know that we exist. It helps remind people about us.” On Purchase Street, where his store is located, Woodrow said that it was not busy on Black Friday or Small Business Saturday. “Small Business Saturday needs time to develop,” Woodrow said. “I think it’s a great idea. I like the idea of thinking about small

businesses and neighborhood stores.” Woodrow said the flock to the Internet has become a generational shift, and said he understands that his key audience is beginning to shrink. “We want to open ourselves up and do things that we have not traditionally done before,” he said. “Facebook is an avenue to that and is opening us up to a younger demographic.” Bill Flooks, president of the Pleasantville Chamber of Commerce, said he doesn’t think mobile apps made a big difference in the village, but that American Express did a good job of getting the word out about Small Business Saturday. “It went over pretty well,” Flooks said. “We got a robocall reminding us to shop local by American Express. There’s only so much local advertising that we can do.” Last weekend, Pleasantville hosted a holiday open house open to further boost sales and help small businesses. “When you come to Pleasantville, you’re coming for a specific reason to shop,” Flooks said. “We don’t have signature stores, so you are coming here for specific things.”

But this year, shoppers are also trying not to overspend and keep debt down. “Eighty percent (of those polled) say they intend to pay off credit purchases immediately,” he said. Carrying a heavy credit card balance is not a trend New Yorkers want to continue, Levy believes, and this time of year it’s easy to get saddled with more debt. Credit cards, he admits, make purchasing easy. Just after the start of the spending season, MasterCard Inc., headquartered in Purchase, announced big numbers tied to Black Friday deals. The company reported a 26.2 percent increase over last year in worldwide transactions processed over the MasterCard network. Although some shoppers use their debit cards with the MasterCard logo, the company promotes the perks of credit card use over the holiday spending season includ-

ing price protection, purchase assurance in case an item is damaged or stolen, and zero liability if a card is lost or stolen amid the hustle of the holidays. Despite MasterCard’s promotion of positive credit spending, some consumers simply can’t afford to be lured into the overspending net credit cards sometimes cast. Personal debt increased to $4,996 between July and September, according to TransUnion, a leading credit reporting agency. The agency also reported more cardholders had late payments heading into the holiday season. It’s a sign of the times, said Howard

Davidowitz, chairman of Davidowitz and Associates, a retail consulting and investment firm in New York City. He said today’s consumer is still much weaker than in the past. “You’ve got people in this country that have lost 40 percent of their net worth. That’s why retailers have spread the sale over a longer period of time. They have to, to make good.” Shoppers are more inclined to spend what they have, in other words, to use debit cards or cash, he added. That notion falls in line with a poll done by Litle & Co, a Massachusetts-based payments processing company. The company determined that

over 50 percent of shoppers were intent on using cash or debit cards to buy gifts. Only a third expected to use their credit cards for purchases. Davidowitz said that’s a nod to the fact that the economy “is going nowhere good.” Levy believes the slight uptick in spending “makes for a good holiday season” but he’s unsure if that’s enough to keep a smile on the face of retailers. He contends that New Yorkers are more adverse to debt than in the past, and that makes the retail numbers something to watch over the rest of the holiday spending season.

ARTSWESTCHESTER Throw a stone into the water and it ripples far and wide. The same is true about the arts. When you support the arts, the benefits ripple far and wide. As an illustration, when downtown White Plains was hurting in 1998, ArtsWestchester purchased the old Chase Manhattan Bank building and revived it as an arts incubator. Doing so brought some 70 jobs, arts and music programs and classes to the community and helped to revitalize downtown White Plains, giving the city a vibrant cultural destination. The ripple of benefits from Westchester’s film centers, music halls, dance studios, performing arts centers, theaters, galleries and outdoor venues includes more vitality and dynamism in our communities, more new and restored buildings, more tourists, more restaurant goers and more people and businesses moving into Westchester because it’s an appealing place to live, work and play. atrick L. Vaccaro is at his desk in his 15th-floor corner office at Jackson Lewis L.L.P. with a panoramic view over downtown White Plains. He is reminiscing, about career and family, decisions made and risks taken, with a visitor and an old friend and colleague. Prominent behind his desk is a framed photo of Vaccaro chatting with Gen. David Petraeus at the scandalensnared military leader’s confirmation as CIA director. “We were talking about ties,” says the 73-year-old Vaccaro, who steps down at the end of this month as national managing partner at Jackson Lewis, having guided the labor and employment law firm through six impressively successful years. Petraeus didn’t shop much for neckwear before his transition to civilian life. He liked the lawyer’s tie. “He was one of my strong idols – and still is,” says Vaccaro, whose accent is a tough New Yorker’s out of working-class New Rochelle. Another idol of his, Ronald Reagan, beams from a photo frame on a side shelf. Two other conservative leaders of the western world, Winston Churchill and Margaret Thatcher, also rank in the lawyer’s personal pantheon. Add to that list Maurice Trotta, an author writing on labor issues, attorney and management professor who hired and mentored Vaccaro during his undergraduate years at New York University. Were it not for Trotta, Vaccaro might not be appending “Esquire” to his name. He might not have had the distinguished professional career that recently earned him induction in the New Rochelle High School Alumni Hall of Fame. “I was pretty much set to go to NYU School of Business,” he recalls. “He directed me to go to law school.” All the key decisions on labor issues are going to be made by lawyers, Trotta advised. “I had no interest in law school.” It showed in his law studies. “I hated it,” says Vaccaro, who had finished in the top 10 percent of his undergraduate class at NYU. “I was a terrible student.” “There were no jobs in labor law when I got out of law school.” Labor litigation was rare and the chief employer of labor lawyers, the National Labor Relations Board, “had a freeze on,” Vaccaro remembers. “There was nothing.”

His labors grew a law firm

In Manhattan, “Jackson Lewis was one of the few firms at that time that was looking for young attorneys. They were looking to grow.” In 1966, Vaccaro was “the sixth or seventh or eighth” attorney to join the boutique firm. “There were times that I didn’t know I’d have a job in those first four or five years. The five or six of us that worked under the partners literally knew every case that was in the firm. …We would share work just to stay busy.” Vaccaro’s father was a union sheet metal worker and construction supervisor in New Rochelle who moonlighted as an amateur welterweight champion with a 48-times-delivered knockout punch. The son was raised in a household left financially bruised by occasional labor strikes. “Those were some of the most painful times,” he says. “My dad was a very proud guy – not much money coming in.” The son’s career has been largely spent facing union reps across the table on behalf of employers. In the early ’80s, Vaccaro opened the firm’s White Plains headquarters, where he was the office’s managing partner for about 25 years. In 2006, he was unanimously named overall managing partner at Jackson Lewis, succeeding a partner who had held the top job for 30 years. Vaccaro took over a firm with 21 offices and 369 largely homegrown attorneys. Jackson Lewis ended that year with $178.5 million in revenue. Six years later, Vaccaro’s aggressive strategy to grow the firm by hiring partners laterally from other law firms around the country has borne profitable results. While many firms have closed their doors or downsized in the recession, Jackson Lewis has expanded to include 49 offices and 735 attorneys. The firm’s projected revenue for 2012 is $353 million, a 98 percent increase from Vaccaro’s first year in the managing partner’s job. Jackson Lewis has incurred no debt in its Vaccaro-driven expansion. “Our growth is paid for from our revenue,” he says. Bringing “laterals” into a firm’s distinctive culture is, like marriage, a risky undertaking, says Vaccaro. “You don’t know until you marry them.” “It’s very collaborative. We share clients. We share credits. We don’t eat what we kill, we spread it around. …There are no Lone Rangers in this firm.” At most firms, “I’d be making three to four times more than I am making” for having led such marked growth, Vaccaro says. “I don’t make a lot more money” than before he took the top job. “We are a very flat compensation firm. Our compensation is very compressed. We don’t have any pigs

at the top.” Vaccaro functions at the top as the firm’s day-to-day troubleshooter and problem solver. On the previous day, he had driven to the firm’s 42-attorney office in Morristown, N.J., to plan a partner’s move to the managing partner position in the Philadelphia office. The busy New Jersey office will lose a valuable attorney, “but it was more important to get some stability in there in Philadelphia,” he says. Dropping in at regional offices as the firm’s oft-traveling overseer, “It’s just, how do we do better at what we’re doing? We try to shake things out and see how things are going. …We’re like 49 movable parts that come together for the whole.” “I don’t travel as much as I used to,” says Vaccaro. “When I was managing this office, it was three or four days a week. That I would not want to do again.” The top management job keeps him from practicing in the complex field of labor and employment law. “This is a full-

time job,” he says. “This firm, 750 attorneys in 49 offices, is too much to do on a casual basis.” “Being managing partner is not an awful lot of fun. Practicing law is fun. The real fun in being a lawyer is lawyering. I never went to law school to be an administrator. But here I am.” Vaccaro won’t give up the corner office on Jan. 1, when he hands the managing partner’s job and its “aggravation” to his firm’s national litigation director in Morristown, Vincent Cino. “He will rely very heavily on me, I know he will,” says Vaccaro, “to help him with the day-to-day stuff.” Vaccaro will focus on marketing. “Pat is at his core a marketer, a business developer,” says Clare Grossman, the longtime marketing director at Jackson Lewis and Vaccaro’s old friend. “I’m going to stay on another four years, possibly five years. After that, I think that will be it for me,” says the master at Jackson Lewis. WCBJ • December 3, 2012
