IN A THIRD ANNUAL ROUND of state funding awards in Albany, the mid-Hudson Valley region this month received a substantially smaller total award from a somewhat smaller state pot of capital grants, tax-free bonds and employer tax credits to spur job creation and economic development across the state. A best-plan winner in 2012 among 10 regional councils competing for state funds, the Mid-Hudson Regional Economic Development

Council this year received $59.6 million from state agencies for 87 public and private projects in the seven-county region, the second lowest total in the state. New York City was awarded $57.4 million. Last year’s top award winner, the Finger Lakes regional council, fared not much better than the mid-Hudson region this year, receiving $59.8 million as Gov. Andrew Cuomo announced $715.9 million in awards statewide at a Dec. 11 presentation in Albany. The mid-Hudson award share amounted to about 8 percent of the state total this year, Award, page 6

ew York manufacturers would receive income tax credits to offset the high property taxes they currently pay and businesses of all kinds would see their corporate income tax rate reduced to its lowest level in 45 years if the state adopts recent recommendations of a tax relief commission appointed last fall by Gov. Andrew Cuomo. The state would tap into $2 billion in state revenue realized from budget cuts and cost savings during the Cuomo administration to implement the relief measures for taxpayers. The commission, led by former Gov. George Pataki and former state Comptroller H. Carl McCall, also recommended a two-year rebate program to cover property tax increases for homeowners in qualifying municipalities that do not exceed the state’s property tax cap. Heather C. Briccetti, president and CEO of The Business Council of New York State Inc., called the proposed relief package “a significant, encouraging step forward” to improve the state’s economic competitiveness. Briccetti served on the seven-member commission that released its final report this month. She said the recommended measures when fully implemented would provide about $500 million in permanent, annual business tax relief. The commission reported that owners of commercial and industrial properties paid $15 billion, or 30.8 percent, of the real property taxes levied statewide in 2012. An additional $3.4 billion, or 6.9 percent of property taxes statewide, was paid last year by utility companies. Of all taxes paid by businesses in New York, property taxes account for the largest share, 37.8 percent, according to the report. While asserting that “business property taxes need to be reduced,” the commission also noted those taxes provide local governments with a large revenue base. Rather than a direct propTax, page 6

A former chairman of the private Financial Accounting Standards Board will head the newly created Center for Excellence in Financial Reporting at Pace University’s Lubin School of Business. Leslie F. Seidman will serve as executive director of the new center and guest lecturer at the business school on Pace campuses in White Plains and Manhattan. “Leslie Seidman’s depth of knowledge about accounting policy and her breadth of relationships across the profession are unsurpassed,” Neil S. Braun, dean of the Lubin school, said in the university announcement. “We are thrilled that Leslie has chosen to make Lubin her home for her thought leadership and continuing contributions to the field.” Seidman served as chairman of the Financial Accounting Standards Board from December 2010 through June this year. She previously was an auditor with Arthur Young & Co., a vice president of accounting policy with J.P. Morgan & Co., and a member of the FASB staff. Before joining the FASB, Seidman founded and managed a financial reporting consulting firm that served corporations, accounting firms and law firms. Pace officials said Seidman in her new role will stimulate discussion about current topics in financial reporting through conferences and other gatherings and lead other activities aimed at identifying best practices and promoting enhanced reporting. She also will mentor advanced accounting students at Lubin and consult with faculty on relevant research and curricular topics. Seidman in a prepared statement noted that Pace was founded as a school of accountancy and said the new center she heads will focus on “the enhancement of reporting practices for the benefit of the investing public.” Seidman was named 2013 C.P.A. of the Year by the American Woman’s Society of C.P.A.s. and was ranked among the top 10 most influential people in accounting by

The Yonkers City Council on Dec. 10 unanimously agreed to end the city’s redevelopment agreement with the defunct partnership chosen as the city’s downtown master developer seven years ago. The council’s vote ends the city’s four-year-old land disposition agreement with Struever Fidelco Cappelli L.L.C., whose ambitious multiphase plans for mixed-use development in the city’s downtown core and on its waterfront have been stalled since the recession. City officials said the Yonkers Industrial Development Agency can now pursue other developers for two of SFC’s planned downtown projects, River Park Center at Chicken Island near Getty Square and Cacace Center on Nepperhan Avenue opposite City Hall. The council also approved amendments to SFC’s leases at Accounting Today from 2010 to 2012. She authored the first three editions of “Financial Instruments: A Comprehensive Guide to Accounting and Reporting” and is a frequent speaker at conferences and universities. Seidman earned a master’s degree in accounting from New York University Stern School of Business and a bachelor’s degree in English from Colgate University.

Palisades Point on the Hudson River to allow SFC’s only remaining partner in Yonkers, New Jersey-based developer Marc Berson, to proceed with development plans on the waterfront site. The Federal Deposit Insurance Corp. has released two new videos in its ongoing series of technical assistance to bank directors, officers, and employees on regulatory issues and proposed regulatory changes. The new videos address flood insurance and appraisals and evaluations. The flood insurance video examines key regulatory requirements, strategies for building an effective compliance management system and frequently asked questions. FDIC officials in an announcement said it is intended for compliance officers, lenders, and other bank personnel with responsibilities for flood insurance compliance. A second newly released video addresses regulatory requirements and supervisory guidance for appraisals and evaluations, highlights when an appraisal or an evaluation is needed and discusses validating appraisals and evaluations. It also covers applying the appraisal regulation to particular situations as well as the review process for appraisals and evaluations. Doreen R. Eberley, director of the FDIC division of risk management supervision, said the video offers examples that answer questions commonly raised by community banks. FDIC officials said four additional videos to be released this month will cover fair lending, troubled debt restructurings, the allowance for loan and lease losses and evaluation of municipal securities. ounty lawmakers approved a $1.7 billion budget for 2014 that will keep the tax rate flat and restore a child day care program through $900,000 in subsidies. The Westchester County Board of Legislators agreed on the budget after 1 a.m. Dec. 10, following budget negotiations that stretched 14 hours from the previous afternoon and evening. The budget passed 16-1 with only Legislator Judy Myers dissenting. The Rye Democrat heads the board’s Budget and Appropriations Committee. Marsha Gordon, president and CEO of The Business Council of Westchester, commended lawmakers on the budget and said the county needed to continue its momentum to add jobs and help existing businesses grow. “By delivering this on-time budget in a bipartisan way, county leaders are showing that Westchester is indeed open for

business,” Gordon said. Board Vice Chair Lyndon Williams, a Mount Vernon Democrat, touted the budget for its dedication to safety net programs such as eviction prevention,

Unfreezing the program was a point of contention in previous budgets and the amount of subsidies to add to the 2014 budget was a point of debate between members of the board prior to the vote this month.

Democratic Majority Leader Peter Harckham said during the public hearings on the budget, residents and child care advocates sought to create more Title XX slots. “This will help to keep low-income parents working and contributing to Westchester’s economy rather than needing more expensive social services,” he said. County Executive Robert P. Astorino proposed the budget last month with a zero percent tax increase. The budget approved by the board added spending, but will still keep the tax rate flat and maintain the county’s reserve money, or rainy day fund, by trimming departmental budgets and adding higher revenues. Astorino has 10 days to sign the budget into law. He is expected to veto several additions to the budget, but the board will likely be able to override any veto. Whole Foods wants in at Chappaqua Crossing But town’s delays could kill grocery plans

lans by Whole Foods Market to open a grocery store by 2015 on the former Reader’s Digest property at Chappaqua Crossing could be thwarted by the New Castle town board’s delay in approving developer Summit/Greenfield’s retail plans for the property. Whole Foods has agreed to lease 40,000 square feet of space on Summit Greenfield’s landmark campus at 480 Bedford Road in New Castle. The agreement, though, includes a spring 2015 deadline for the store opening. Summit/Greenfield, the Connecticutbased partnership that acquired the 114acre Reader’s Digest property for $59 million in 2004, initially sought a zoning change by town officials to allow Whole Foods to occupy the iconic cupola building on the property and an attached facility. Last month, though, the landlord presented a revised retail plan to the town board to build a new freestanding structure on the south side of the commercial campus as requested by Whole Foods. Frustrated by the town’s lengthy process

to review successive plans to redevelop the property for office, residential and retail uses, Summit/Greenfield a few years ago sued the town in state and federal court, claiming the owners were prevented from making the Chappaqua Crossing property economically viable. The developer a year ago agreed to halt the legal action in exchange for the town’s approval of a retail zoning district. Summit/Greenfield also paid $1 million in fees the town said it was owed. Geoffrey Thompson, spokesman for the developer, said the town board agreed to meet certain milestones in its review of Summit/Greenfield’s plans. “Many of those deadlines slipped, and by the terms of the settlement, Summit/Greenfield can reactivate the lawsuits” if the town does not approve the project by the end of this year, he said. John S. Marwell, attorney for SummitGreenfield, recently urged the town board to approve his client’s revised retail proposal by Dec. 31 or face renewed legal action. The attorney warned that there are at least six years of pending tax certioraris filed by Summit/Greenfield on the Chappaqua Crossing property that could cost the town millions of dollars in tax refunds. He also

warned that the town could lose a major supermarket that would substantially increase the municipal tax base. The town board, however, referred Summit/Greenfield’s revised retail plan to the New Castle town planning board for review. The city’s planning board will hold a work session meeting to exchange comments about the revised retail plan on Dec. 17. Summit/Greenfield argued that the location change doesn’t warrant another environmental review process because “there really is no material change in moving a store from one location to another because it’s taking up the same size space in an area that’s already being used for retail,” Thompson said. He said the board “felt there were certain dynamics that needed to be addressed with the location change, including the traffic and visual impacts.” Summit/Greenfield’s retail plan could be further delayed as three newly elected town board members take office in New Castle on Jan. 1 – incoming supervisor Rob Greenstein and council members Lisa Katz and Adam Brodsky. All three in their election campaigns favored postponing the review of Summit/Greenfield’s retail proposal until the town’s master plan is

updated. “We know it’s something Summit/ Greenfield had wanted to develop for a long time and we’ll try to move as quickly as possible,” Greenstein said. “I’d like to bring Summit/Greenfield into the process. They are a major player. But the process should include not just looking at their piece of property but looking at everything in downtown Chappaqua together and figuring out how we can make decisions that benefit each other.” If the town board delays review of the retail plan until New Castle updates its master plan, Thompson said the developer and the town might lose Whole Foods as a tenant and taxpayer, given its hard deadline for a store opening. Thompson said preparing a new master plan “could take years. But the town can also just amend the zoning in its existing comprehensive plan and allow commercial retail to be on the site. I’ve seen master plans done. It’s a very lengthy, involved, and complex process. That’s not necessary for a retail store to come to Chappaqua Crossing.” The Chappaqua Crossing development plan is in its ninth year of review, Thompson noted.

s there a difference in the leadership styles of men and women? “Yes and no,” says retired Brig. Gen. Becky Halstead. While men and women may be different – men may lead a little more with their heads (generally) and women (generally) with their hearts – neither gender has a monopoly on character and competence, she says. Halstead knows a lot about these two key ingredients to leadership. She was the first female graduate of West Point (Class of 1981) to be promoted to General Officer and as the senior Commanding General for logistics in Iraq, the first female in U.S. history to command in combat at the strategic level. Her STEADFAST Leadership company was the subject of a 2011 Harvard Business School Leadership Case Study. And she’s the author of the new “24/7: The First Person You Must Lead Is YOU.” So when she delivered the keynote speech for the inaugural “Pearls

“Smart Start” program for at-risk elementary schoolchildren are designed to combat a sobering statistic – 44.8 percent of single mothers with children under age 5 in Westchester County are living below the national poverty line of $23,000 for a family of four. Halstead described herself as a “very ordinary girl” who grew up in the kind of small upstate New York town that had no traffic lights. She was in the top 15 in her class, she joked, because there were few more than 18 students. Her dream was to go to Ithaca College and become a physical education teacher until she heard that West Point was accepting women. Going there, she realized, would mean she was not only representing herself; she was representing her family and town as well.

It’s a sense of responsibility that has carried her through numerous assignments and postings, including leading more than 200 multidisciplinary units (20,000 soldiers and 5,000 civilians) as they provided supply, maintenance, transportation and distribution support to more than 250,000 personnel serving in Iraq. In 2006, Halstead became the first female Chief of Ordnance and Commanding General of the Army’s Ordnance Center and Schools (the military equivalent of a university presidency). She was honorably retired as a General Officer in 2008. Today, Halstead sees a great lack of leadership in the world, in part due to a strange sense of accountability. “When there are no consequences,” she said, “that’s not accountability.”

erty tax reduction, the commission recommended that manufacturers receive a state credit against corporate income taxes that would amount to 20 percent of their annual property taxes. Commission members also suggested a larger credit be considered for upstate manufacturers. The proposed credit to offset property taxes would provide $136 million in annual tax relief to more than 21,000 manufacturing facilities statewide, the commission estimated. Commission members also recommended lowering New York’s “largely outdated and extremely complex” corporate franchise tax and merging it with the banking franchise tax that businesses pay. Chief among its proposals for corporate tax reform, the commission recommended the corporate income tax rate be lowered from the current 7.1 percent, in effect since 2007, to 6.5 percent, the lowest level for corporate franchise tax rates since 1968. The proposed reduction would take effect in 2015. When fully implemented in the state’s 2016- 2017 fiscal year, it would reduce corporate tax revenue for the state by $346 million annually, according to the report. To “kick-start” upstate manufacturing, the commission recommended a historically low corporate income tax rate of 2.5 percent for manufacturers outside the Metropolitan

compared with approximately 13 percent last year. The region also received an approximately 8 percent share of state funding in 2011. The state’s funding pot was reduced this year from $738 million in 2012 and from $785 million in 2011, the first year of Cuomo’s competitive regional council initiative. In the seven-county mid-Hudson region, 84 projects last year were awarded a total of $92.8 million. The region was awarded $67 million for 61 projects in 2011. Marsha Gordon, president and CEO of The Business Council of Westchester and a Mid-Hudson Regional Economic Development Council member, said a “positive thing” from the awards announcement is $1 million in funding for the White Plains Multimodal Transportation Center, an approximately $1.7 million planning project led by the city of White Plains to redevelop the city’s Metro-North Railroad station and

Transportation Authority commuter region. That would additionally reduce taxes by an estimated $24 million among more than 4,300 upstate businesses, according to the report. The commission also recommended accelerating a scheduled phase-out by 20172018 of a temporary state surcharge on home and business utility bills. The energy assessment would be eliminated in 2014 for industrial customers, while all other customers would benefit from an accelerated end to the program. The proposed measure would bring about $200 million in additional tax relief. “This will immediately improve the business climate for industrial customers where electric power is a significant cost of production,” the commission reported. To ease the property tax burden on homeowners, the commission recommended a two-year program that ties state rebates for residents to their local government’s performance in keeping their annual budget within the state’s 2 percent property tax cap and in sharing and consolidating public services with other municipalities. The commission recommended an effective freeze on residential property taxes in the form of rebates from the state equal to the increase in a homeowner’s tax bill. The rebates would only be given to taxpayers whose school districts and local governments have kept any increase in their annual tax levy at or below the 2 percent cap. tax bills if their local governments or school districts again stay within the tax cap and also develop a plan for shared services and administrative consolidations with other districts or municipalities. The commission said the two-year rebate program when fully phased in would provide $976 million in tax relief to nearly 2.8 million homeowners. Addressing estate tax reform, the commission recommended raising the exemption level for taxation from New York’s current $1 million estate value to the current federal level of $5.25 million and indexing it for inflation. Commission members also recommended lowering the state’s highest estate tax rate from its current 16 percent to

10 percent. The commission said those changes “would exempt nearly 90 percent of all estates from the imposition of the estate tax, protect family farms and small businesses and eliminate the incentive for middle-class and wealthy New Yorkers to leave the state to avoid the tax.” Pataki in a statement accompanying the release of the report said, “Governor Cuomo asked us to focus on real property taxes and we did, delivering a robust program that will provide real relief to middle class taxpayers and especially those on fixed incomes …The Commission worked overtime to deliver our recommendations today and I’m proud of the package we’ve assembled.”

The regional council selected the White Plains application as a priority project related to the council’s strategy to revitalize the region’s infrastructure. That includes $250,000 in private investments from businessman Sean Eldridge, a founding partner this year of the Hudson Valley Advanced Manufacturing Center, $250,000 from Central Hudson Gas & Electric, the regional utility, and a commitment of $500,000 in venture capital to help launch new 3-D printing enterprises in the region from Hudson River Ventures L.L.C., a regionally focused small business investment fund in Kingston founded by Eldridge in 2011. HVEDC has focused this year on coordinating the creation of a 3-D manufacturing industry in the region. Laurence P. Gottlieb, president and CEO of HVEDC, called the state award “a major step forward for both SUNY New Paltz and the business community across our region.” “3-D printing is one of the most exciting technologies to be developed over the past decade, and the Hudson Valley has a tremendous opportunity to become a hub for this new industry sector,” Gottlieb said in a prepared statement.

The state also awarded $1.5 million for the Kingston Connectivity Project, an infrastructure improvements project by the city of Kingston to design and build a rail trail network for bicyclists, pedestrians and other non-motorists. The project is expected to reduce tragic congestion and fossil fuel emissions in the city. Long Island and three upstate regions received the largest shares of state funding as top performers in this year’s awards competition. Long Island, focused this year on recovery from Hurricane Sandy, was awarded $83 million. The Capital region, whose economic development council has helped make the Albany area a global leader in nanotechnology research and development, was awarded $82.8 million. The Mohawk Valley was awarded $82.4 million and projects in the North Country region stand to receive $81.3 million from Albany. Most business owners concentrate on learning how to use the profit and loss statement, but overlook how the balance sheet can help them. The balance sheet helps to set goals for how you, as a business owner, want things to change over time. There are three parts to the balance sheet: assets, liabilities and equity. Assets are broken into two or three major categories. Current assets are items that are already in cash, such as a checking account, and items that can be converted to cash within 12 months, such as accounts receivable. Liabilities represent the debts of the company. Like assets, short term liabilities are liabilities you expect to pay off within 12 months. This includes credit lines and the current year’s portion of any term loans. Long-term liabilities are debts that are expected to take more than a year to pay off. Multiyear term loans and multiyear equipment loans are two examples of long-term loans. With long-term loans, ideally the amount of principal to be paid off during the year is moved from longterm liabilities to current liabilities. Each month, as you make payments on your loans, part of that payment goes to reduce principal. This shows up on the balance sheet as a reduction in the current portion of the long-term loan. This is a little bit of extra accounting paperwork, but gives the business owner a much more accurate picture of what’s happening to liabilities throughout the year. Equity is what is left over when liabilities are deducted from assets. The equity section of the balance sheet is the sum of several items, including shares issued in exchange for investments made in the business, goodwill and retained earnings among others. Goodwill is meant to represent intangible values, for example the value of proprietary systems and brand equity. Setting its value is tricky, complicated and requires outside expertise. Retained earnings represents the sum of all the net income that has been reinvested all the years. It doesn’t have to be cash. It can show up as cash, inventory, fixed assets, property, etc. Business owners have a choice to make at the end of each year. They can remove net income from the business and take it home or

equity. One of the ways to measure progress in a business is to monitor ratios. Debt to equity and current assets to current liabilities are two key ratios to keep on top of. A good rule of thumb is to keep debt-to-equity ratio below 250 percent, meaning that for every dollar of equity, the company has no more than $2.50 of loans and other debts. A good rule of thumb for current assets-to-current liabilities ratio is to keep above 200 percent. In other words, for every dollar owed that must be paid off in the next 12 months, the company has $2 or more in current assets. Companies with high inventory and concerns about

Iona College last month closed on the purchase of a North Avenue pizzeria popular with students in New Rochelle for more than 35 years. The college paid $935,000 for the 1,200-square-foot Cannone’s Pizza and Chicken Wings at 654 North Ave. With

the deal, Iona controls all of the frontage on that North Avenue block adjoining its New Rochelle campus. College officials are exploring options to develop student housing and other college facilities both on campus and along North Avenue. The sale of the recently closed pizzeria, whose longtime owner died in August after 36 years in business at that location, was brokered by Goldschmidt & Associates in Scarsdale. GHP inks sale, lease deals

A Larchmont investor, Polaris Properties L.L.C., last month paid $2.55 million to acquire 313 Central Ave. in Greenburgh, an 18,799-square-foot office/flex/medical building that had been repositioned and fully leased by the seller, GHP Office Realty L.L.C. in Harrison. GHP’s investment sales division was led in the deal by Jamie Schwartz, GHP executive vice

GHP Office Realty in 2012 sold an 8,800-square-foot retail building on the same Central Avenue property to another buyer for $1.4 million. A wireless cell tower on the property last year sold for $1.76 million to AP Wireless Investments. “The result of those sales and the sale of 313 (Central Ave.) maximized the investors return,” Schwartz said in a press release. In the White Plains central business district, GHP Office Realty reported a total of nearly 7,700 square feet of space leased this fall at 170 Hamilton Ave. The 60,000-square-foot office building, where GHP recently completed capital improvements that included new elevator cabs and mechanicals and lobby and common area renovations, is 96 percent leased, Schwartz said. The Great American Title Agency Inc. leased 4,050 square feet at 170 Hamilton. The real estate title agency was represented in-house by John Hughes, while GHP leasing associates Brendan Hickey, Meghan McEvoy and Kelly Houlihan Buckley brokered the deal for the landlord. Havkins Rosenfeld Ritzert & Varriale L.L.P., an insurance defense law firm, renewed and expanded its lease for 3,636 square feet of space at 170 Hamilton. A 19th century landmark in Poughkeepsie, the long-vacant Hudson River State Hospital has been acquired by a New Jersey developer for $4 million. Affiliates of Montefiore Health System this fall paid approximately $38.6 million for the New Rochelle hospital, nursing home and housing properties acquired from the bankrupt Sound Shore Health System, according to deed filings at the Westchester County Clerk’s Office. The Bronx-based hospital paid $25,353,900 for Sound Shore Medical Center of Westchester, since renamed Montefiore New Rochelle. Montefiore paid $10,060,458 for Sound Shore’s nursing home facility, Schaffer Extended Care Center, and $3,214,727 for the Sound Shore housing complex at 5-29 Glover Johnson Place in New Rochelle.

The bipartisan support for the budget represents a turnaround from last year’s approval process, which ended with most of the Democratic caucus storming out before the vote and later calling into question its legality. Legislator Michael Kaplowitz, one of two Democrats who formed a coalition with Republicans during last year’s budget vote, said he was happy with the support from both sides this time around. “We didn’t get everything we wanted in the process, nor did the county executive, but we worked together to put forward a plan that best serves the people of Westchester County,” Kaplowitz said. One aspect that did not change from Astorino’s proposal was the use of a pension amortization program, in which the county essentially defers part of its anticipated $96 million contribution to the state pension fund. Under a state plan, municipalities can essentially borrow from Albany for its obligation to the fund, then pay back the borrowed amount with 3 percent interest over a 10-year period. When Moody’s Investors Services downgraded the county’s bond rating last month – from its highest rating, AAA, to AA1 – it cited “structural imbalances” in budgets from the amortization as a factor in its decision. Some lawmakers during budget negotiations had proposed reducing the deferment by $650,000, but the board did not support the measure. Large scale layoffs were not part of

One point of contention in the contract process has been Westchester seeking larger employee contributions to health care premium costs. Until recently, county employees did not contribute to their health care coverage. The other unions agreed after negotiations to contribute to their plans, with employees in 2014 expected to pay $4 million of a projected $95 million health care bill for Westchester. When Astorino held a press conference last month announcing his proposal, he said the average salary of a county worker is $76,414, higher than the average Westchester private-sector salary of $65,185. In addition to base salary, Astorino said, Westchester pays as much as $45,000 more per employee each year due to health care and other “fringe costs.” “Our county workers do a terrific job,” Astorino said at the time. “The problem is they are very expensive. So together, labor and management sat down to work out contracts that are fair to our workers and fair to our taxpayers.” Although the county tax levy will remain flat, the impact on individual tax bills can vary by municipality based on assessed property values and equalization rates. County taxes make up about 20 percent of a Westchester property owner’s tax bill. School districts account for about 60 percent of a total property tax bill.

Sustainable housing slow to gain traction in Westchester BY CRYSTAL KANG ckang@westfairinc.com

eraldine Angel, a White Plains resident and real estate agent at Keller Williams Realty, decided to go green and retrofit her ranch-style single family home with the idea of saving on her energy bills. She wanted to create a sustainable home design that would appeal to her clients and neighbors. Her home would be only the third home in Westchester certified by LEED, the U.S. Green Building Council’s Leadership in Energy and Environmental Design program. Angel went to a public showing of the county’s first LEED-certified home, River Town House, a two-family market rate condominium in Hastings-on-Hudson. There she met architect Christina Griffin, whom Angel later hired for the work to her home. Despite the popularity of commercial projects centered on sustainability, few residential homeowners in Westchester have jumped on the green bandwagon. Some would-be green homeowners may be turned off by the large initial cost of installing solar panels or double-paned windows. But some contractors, architects and realtors are seeing what has been missing in Westchester homeowners’ understanding of sustainable housing: more resources and guidelines that give them incentives to go green. The initial cost of retrofitting a home with equipment using energy-efficient material as opposed to non-green material is 10 percent higher, whereas the initial cost of installing energy-efficient equipment in a new home versus non-green material is 5 percent more, Griffin said. That doesn’t include miscellaneous costs such as paying for a permit from the municipal government that make it all the more challenging to renovate a home. Griffin designed two of the three Westchester homes that have been LEEDcertified since 2009. Seventeen Westchester homes are LEED-registered, according to the U.S. Green Building Council. For her part, Angel decided to go all in when going green – doubling her budget.

Despite the multimillion dollar cost, she said it was worth it. “Having a LEED certification adds to the credibility of what I did to retrofit my house green and gets the attention of others even if they themselves are not interested in pursuing a LEED certification,” Angel said. She said she wanted her home to serve as a model for her clients who might be curious to learn more about LEED and ways to go green. Angel’s sustainable home, which has 32 solar panels, a wood-burning fireplace, a geothermal heating system and low pressure faucets, showerheads and toilets, has cut her energy bills by more than half. She said she used to pay $150 to $435 a month on her electricity bills, but now pays between $47 and $95 a month. She no longer pays monthly heating and gas bills because she no longer uses fossil fuels. Griffin, principal of Christina Griffin Architects P.C., in Hastings-on-Hudson is one of the few LEED-accredited architects in Westchester to incorporate green design work into her projects. LEED is a national certification system developed by the nonprofit U.S. Green Building Council to encourage the construction of energy-efficient buildings. It uses a ranking system to rate buildings as meeting silver, gold or platinum standards. Angel’s home has gold certification. Griffin said one goal of her project when designing the condominium at Hastings-onHudson was to completely remove dependency on fossil fuels by using an underground geothermal system to heat and cool the home. But for most homeowners, this green strategy isn’t practical because of the high initial costs. “When people looked at the cost of the building, not many were willing to invest in a geothermal envelope because they don’t initially see how much they’ll save,” Griffin said. But some local municipalities are giving homeowners an incentive to go green, Griffin said. In Hastings-on-Hudson, Griffin helped create a green building code that aims to minimize the short-term and long-term negative impacts on the environment, reduce greenhouse gas emissions and provides own-

ers with economic benefits if they use renewable resources to supply their energy and water. “I helped update the Hastings-onHudson green code, which was a three-year process,” Griffin said. “We did case studies, and it was approved in October.” She said Greenburgh, White Plains, Harrison and Scarsdale are also interested in adopting a green code. The American Institute of Architects (AIA) Westchester Hudson Valley launched a sustainable design database in 2011 to give homeowners more resources and tools. The database includes information about sustainable projects and design strategies. William Pfaff, principal of Pfaff Architects in Upper Nyack and former president of the AIA chapter, said the goal next year is to populate the database with existing sustainable housing project ideas. “We have several projects in there, and we’re in the process of refining it and reaching out to architects and other entities to bring more projects into the database,” Pfaff said. The challenge of filling out the database is there aren’t many projects that use sustainable models just yet, Pfaff said. “Projects are very much client-driven,” he added. But there’s an even greater push to create more dialogue around sustainable housing. Griffin, who founded the Green Building Professional Consortium with her husband, said she is working with her organization to create a center for sustainable development that will bring together architects, engineers, nonprofits, plumbers, electricians and real-

tors and serve as a resource and learning hub for green strategies and technologies. Griffin has been meeting with government officials in local municipalities to talk about housing the center. She said Yonkers looks very promising. “There is certainly awareness about sustainability, and local municipalities are developing the green codes now,” Pfaff said. “We’ll get there eventually.” The New York State Energy Research and Development Authority (NYSERDA) covers the cost of energy audits and provides a database of contractors who provide the services. The federal and state governments also offer a 30 percent tax credit to help homeowners pay for alternative energy equipment, including solar hot water heaters, solar electricity equipment and wind turbines, and labor costs. “The majority of younger people are very interested,” Angel said. “But a lot is curtailed by the initial expenses. They’re more likely to get energy-efficient appliances and LED light bulbs than geothermal heating and double-paned windows.” But homeowners who are environmentally conscious will make energy efficiency a priority no matter what the financial costs. “I was able to help a woman phase a big project,” Griffin said. “She wasn’t going to renovate the whole house, but I helped her figure out how to get the insulation, increase the thermal envelope and seal up the gaps in her windows. Even if they don’t renovate everything, if they have a heating system that is 10 years old, at the very least, they update it and get a high efficient oil or gas boiler.” WCBJ • December 16, 2013

here is a slump in general whitecollar crime prosecutions nationwide. But at the FBI’s White Plains agency, Special Agent Carl Cartuaro says he’s seeing an uptick in employee theft, especially from those in upper management. “It’s been interesting lately,” Cartuaro said. “It’s a trend we see an increase in, perhaps because of the economic times.” Whether it’s a chief financial officer sending checks to fake vendors or an employee taking advantage of a one-signature payment system, Cartuaro said busi-

ness leaders should be examining their internal controls. Often employee theft only comes to light after there’s a fresh set of eyes on the books, he said. During a seminar Dec. 6, several fraud and law experts said businesses can best avoid fraudulent activity by separating financial duties, limiting access and performing periodic reviews. The seminar was hosted by Citrin Cooperman & Co. L.L.P., an accounting, tax and consulting firm with offices in White Plains and Norwalk, Conn. “Do a little due diligence,” Cartuaro said. “Everyone works hard for their money.” The most common white-collar crime nationally is fraud by wire, radio or television, followed by mail fraud and bank fraud, according to the U.S. Department of Justice. It can be devastating if a thief is one of your own, but it won’t happen unless the opportunity to steal exists in the first place, said John Matula, a licensed and bonded private investigator. Transactions should be spot-checked for dollar amount and payee regularly, in addition to occasional outside audits, said Matula, who has owned his practice since 1981. There could be a big difference between the payees, Superior Cleaning Services and Superior Janitorial. Additionally, Matula said to be wary of employees who refuse to take vacations and work excessively. No one has the opportunity to sit at those employees’ desks to see what they’re up to, he said. They could be hiding something. Matula urged employers to perform rigorous background checks on new employees and set up anonymous hotlines for employees to report suspicious behavior, even within small companies. Once an employer has reason to believe an employee has stolen, he or she should proceed with caution and determine what the scope of the investigation will be, said Susan Corcoran, an attorney at Jackson Lewis P.C. in White Plains. Company officials will need to decide whether or not to get the FBI involved or press charges. They’ll also need to be discreet and respectful when asking the employee to leave, to avoid an emotional distress lawsuit. “We have to think about what our game plan is,” Corcoran said. “Despite the fact that you may be upset, careful planning and communication is very important.”
