n Dec. 20, with just four days before the recognized end of the holiday shopping crunch, Mount Kisco’s PORCH Home+Gifts has planned “guys’ late night shopping.” An event flyer from PORCH — a new store at 153 E. Main St. — promises “manly refreshments,” complimentary gift wrapping and the assurance that “Gentlemen, you can do better.” “We’re encouraging all the guys who maybe have put their shopping off to the very end to come in and we’ll help them find the right gift,” said Suzanne Grant, a co-owner of the store. PORCH is just one of the thousands of retailers across the country — and in Westchester County — getting creative to bring in customers during what is expected to be a record-setting holiday shopping season. With unemployment at its lowest point since 1969, there are indicators shoppers will spend more this year on gifts than usual. A survey from the National Retail Federation trade group found the average consumer expects to drop about $1,007 on holiday gifts and related purchases. The research firm eMarketer predicted in November that total holiday sales would cross the trillion-dollar mark for the first time ever. » RETAIL

Downtown New Rochelle apartment tower sells for $259 million

A

40-story apartment tower at 40 Memorial Highway in New Rochelle has changed hands for $259 million, more than doubling the county’s previous top 2018 sale price. The Virginia-based Harbor Group International announced Dec. 5 that it has acquired the apartment tower near the city’s

train station, with partner Azure Partners LLC. The seller, DSF Group, bought the 588-unit apartment tower in 2013 for $210 million. Formerly called Halstead New Rochelle Metro North, Harbor Group has rebranded the apartments as Skyline New Rochelle. The tower was built in 2007 by AvalonBay Communities and features about 8,000 square feet of ground-f loor retail space and a parking garage. The

apartments are 95.6 percent occupied as of the sale, according to Harbor Group International. They include a mix of studios and one, two and three bedrooms. The building is less than a quar ter-mile f rom New Rochelle’s Metro-North train station and across the street f rom t he New Rochel le Public Library. Pentegra hits 75: retirement savings strategies may change, but client care remains top priority BY KEVIN ZIMMERMAN kzimmerman@westfairinc.com

T

o say that strategies for saving for retirement have changed over the past 75 years would be a major understatement. But it’s a challenge that Pentegra, the provider of retirement plan, fiduciary outsourcing and institutional investment solutions, has been able to meet since its birth in 1943. “One thing that’s remained constant is the way we cater to our client base,” said John Pinto, CEO and president of the company since 2013. “We’ve always been able to provide innovative products and change with the marketplace to meet the needs of different types of clients.” In 1943, employees in the U.S. could rely on their company pension to see them through their golden years, usually augmented by the Social Security program, then just eight years old. Today, of course, the picture is very different. The employer-funded pension or defined benefit plan has gone by the wayside in most industries, with a shift toward the defined contribution plan like the 401(k), where the employee is largely responsible for building his or her nest egg (augmented in many cases by the employer, which can provide “matching” funds depending on varying formulae and situations). Navigating those and other changes successfully has been key to the success of Pentegra, whose corporate headquarters is in White Plains with another office in Shelton. “We have evolved tremendously,” affirmed First Senior Vice President, General Counsel and Corporate Secretary Robert Alin, who, having joined Pentegra in 1986, is its longest-serving employee. “When I started here we essentially had just two products — a multiple employer-defined benefit pension program (MEP) and a tax-exempt trustee savings plan for employees of financial institutions and organizations,” Alin continued. “We were only allowed to work with financial institutions then because of Department of Labor regulations.” The privately owned firm — which started life with the pithy name Retirement Fund of the Federal Home Loan Bank System — was founded by that system in 1943 to administer a defined benefit pen-

sion trust, the Savings Associations Retirement Fund, for its employees. It took the name Pentegra — a combination of “pensions” and “integrity” — in 1993. The change came about after a concerted effort “that took a couple years to get off the ground” to receive IRS approval to grow its product line to include single-employer retirement plans, Alin said. It also received permission to expand the marketing of its programs and services beyond the financial community to businesses across different industries and sectors on a national basis. “We had a contest” to come up with the new moniker, Alin said. "Originally we thought it would be called ‘Integra,’ but there was an automobile that was popular at the time with that name, so we didn’t want to have to deal with that confusion.” (The Honda Integra was introduced to the U.S. in the mid-1980s, but was discontinued in 2006.) Assets under management (AUM), which had topped $500 million by the end of the 1970s, reached over $2 billion by the end of the ‘90s. With the new millennium, Pentegra grew further with some key acquisitions, including subsidiaries of Retirement System Group Inc.; full-service, third-party retirement plan administration and recordkeeping firm Alliance Benefit Group-Carolinas; and Advanced Pension Solutions Inc., a full-service, third-party retirement plan administration firm based in Ohio.

Those moves, Pinto said, have helped Pentegra diversify both geographically and in terms of the products and services it offers. The firm now has over $13 billion in AUM, nearly double its $7.5 billion in AUM at the end of the last decade, he said. “We’ve expanded our product line significantly, and we’ve built the fiduciary expertise that helps give us a competitive advantage.” The company claims a 98 percent client retention rate, as well as more than 100 clients who have been with it for at least 30 years. Pentegra further bills itself as one of the largest and most experienced MEP providers in the country. Those tax-qualified retirement plans, wherein two or more unrelated employers participate, can be particularly attractive to small businesses that are otherwise unlikely to provide retirement benefits in the face of expensive startup costs and burdensome administrative responsibilities. Pinto said that one thing that has unfortunately not changed is Americans’ failure to save enough for retirement. A report earlier this year by the Harvard Business Review found that, among Americans aged 40 to 45, “the median retirement account balance is $14,500 — less than 4 percent of what the median-income worker will require in savings to meet his retirement needs.” And the Social Security safety net that many assume will see them through their retirement —

never intended to fund all of one’s golden years in the first place — has also been widely reported to be in danger. For the first time since 1982, Social Security’s total costs are expected to exceed its income this year. The latest annual report by Social Security's trustees estimates that, if no changes are made, the system will be paying most but not all promised benefits by 2034, when it essentially will run out of money. “I tell everybody I meet, no matter what business they’re in, to save early and save often” for their retirement, Pinto said. “And they should try to increase their contribution (to a retirement fund) by 1 percent a year, every single year. It doesn’t impact your paycheck that much, and it obviously can add up over time.” Taking full advantage of an employer’s 401(k) matching funds — or, if there is no employer plan, investing in alternative vehicles like IRAs or Roth IRAs — is also of paramount importance, Pinto added. “Retirement comes a lot more quickly than most people think,” he said. As for shepherding Pentegra to its 100th anniversary and beyond, Pinto said the mantra will remain the same: Putting — and servicing — the client’s needs first. “That’s one thing that definitely hasn’t changed,” he said. “Any of our clients can pick up the phone and talk to me or any of our senior team members. It’s a practice that’s embedded in our heritage.”

Port Chester woman sues Latam Airlines for $1M over hot water spill, reminiscent of McDonald’s case

A

Port Chester woman has sued Latam Airlines Group for $1 million claiming that she and her infant were injured when attendants spilled scalding water on them. Susan Hidalgo said the Chilean airline was negligent, in a lawsuit filed Nov. 19 in federal court in White Plains. "Latam Airlines has not been served on this matter," a company spokesman responded, "and is therefore unable to comment on any specifics. Nevertheless, safety and the well-being of our passengers and crew is our utmost priority and the foundation of our service protocols." Her complaint and a similar lawsuit filed nine days later in federal court in Manhattan are reminiscent of the controversial McDonald’s hot coffee lawsuit. The McDonald’s case, in 1994, spurred debate about product liability tort reform. A jury in Albuquerque, New Mexico, awarded Stella Liebeck $2.86 million for injuries she suffered from a 49-cent cup of coffee that spilled on her as she sat as a passenger in her grandson’s parked car. The cup bore a warning that it was hot. Tort reform advocates cited the lawsuit as an example of frivolous litigation and greedy litigants. Late night TV comedians and talk show pundits ridiculed the verdict. Pro litigation advocates argued that the verdict was appropriate. Liebeck, who was 79 when the accident happened, suffered third-degree burns and endured skin grafts and two years of medical treatment. She died in 2004 at age 91. McDonald’s, according to news accounts of the lawsuit, had required its restaurants to serve coffee at a scalding 180 to 190 degrees

Fahrenheit. Documents produced for the lawsuit showed that the company had received more than 700 reports of people burned by coffee from 1982 to 1992. McDonald's had settled some claims for more than $500,000. Liebeck had initially tried to settle for $20,000 for expenses. McDonald’s offered $800. The jury found that McDonald’s was 80 percent responsible for the accident and Liebeck was 20 percent at fault. It awarded her $160,000 for medical bills and other expenses and $2.7 million in punitive damages, based on two days worth of coffee revenues at the fast food chain. The judge reduced the award to $640,000. Liebeck and McDonald’s eventually settled for an undisclosed amount less than $600,000. Hidalgo’s four-page complaint is sparse on details. On July 15, she and her child, identified only as A.M., were traveling on a Latam flight from New York to Lima, Peru. Flight attendants, she claims, served “an excessively hot cup of water” and caused the water to spill on them. They were grievously injured, the complaint states, and “will continue to suffer great physical pain

in the future.” Hidalgo and her child are represented by Arnold I. Bernstein of White Plains. The second lawsuit was filed by Yolanda Arias De Manzo, an Ecuadoran citizen, for an alleged incident on Sept. 12, on a Latam flight from New York to Guayaquil, Ecuador. She claims that a flight attendant offered hot tea, placed the cup in her hands instead of on the seat tray, and told her, “be careful, this is hot.” Arias De Manzo immediately spilled the tea on her upper body, suffering second- and third-degree burns. She alleges that Latam created an unreasonable risk of injury by providing boiling water for tea in a moving aircraft, not using a hot cup sleeve and not securing the lid on the cup. She also claims that the airline failed to provide immediate first aid, ask if any doctors were aboard the plane, quickly notify paramedics of an emergency, request an ambulance for immediate assistance upon landing or allow her to disembark first. She is asking for $175,000 for medical expenses, lost income, property damage and legal fees. She is represented by Michelle Viana of Manhattan.

More than half of tech professionals plan to change jobs BY PHIL HALL

F

ifty-eight percent of technology professionals within this region plan to switch jobs in 2019, according to the report “Top 5 Challenges Facing TriState CIOs Today: Current Trends in Metro New York, Connecticut, and New Jersey” published by Benchmark IT-Technology Talent. The regional number is nearly five times the national average and the new report also pointed out there are more than 135,000 open tech jobs in the tri-state area, not counting Manhattan. “There is definitely a big talent shortage out there,” observed John Bemis, president of Stamford-based Benchmark IT, a staffing firm focused on the high-tech industry, who added that the vibrant economy is encouraging more people to spread their wings. “Since the financial crisis, this is the most robust market we’ve seen — not just in hands-on positions, but also in management positions available, which was not the case a year ago. The perception is that there are a lot more opportunities than there were.” The technology industry leads all employment sectors for annual employee turnover, with a 13.2 percent annual rate. This has become more pronounced following the post-recession years, when minimal opportunities and stagnant wages left a sour taste with many IT professionals. “People had felt sort of stuck in their positions after the economy was not good,” Bemis added. “There wasn’t a lot of job satisfaction and employers had been slow to work on skills development and training. A lot of people we’re talking to are interested in making the change — they just haven’t had the opportunities until the past year.” What is causing the IT professionals to consider pulling up stakes? Much to Bemis’ surprise, the issue is not about money.

“Salary wasn’t the only factor, or even the biggest factor for a lot of people,” he said. “We’ve been sensing a boiling pot under wages, but we found that other aspects of jobs were as much or more important than just salary.” Benchmark IT’s report included a “Candidate Perspective Survey” that found “team environment and direct management” (23 percent) and “learning new skills and technologies” (26 percent) were top factors when considering a job change, rather than salary. The survey also found a combined 42 percent of respondents believed “challenging and rewarding projects” and a sense of “value and recognition” were the most important factors when choosing to remain in their current positions. Filling an IT jobs void is not going to be simple, Bemis warned, and strategies that worked in the recent past will not be successfully reprised. “A lot of companies tried offshore outsourcing and found a lot of friction in getting the projects done efficiently,” he said. “Even though the costs seemed attractive — with maybe a 75 percent reduction in annual costs per employee — if it takes four times as many workers to do the job and it’s only 25 percent as expensive, you’re not really getting any savings. Even the offshore people had problems — there is huge turnover in India. A lot of our clients are starting to bring the projects back.” And another endeavor of the recent past, importing tech workers via the H-1B visa program, is still somewhat viable, despite apprehension within the tech industry that the program would fall victim to the Trump immigration policies. “There was a concern when the new administration came in two years ago that there would be cuts to the program, but that hasn’t happened,” he stated. “It continued on status quo, with small changes in the law that slows down renewals of those visas. The cap on those visas has stayed relatively the same. There has

been a little bit more enforcement on the companies that grab the majority of the visas, and we’re starting to see some clients do visa sponsorship for a full-time job because they’re in demand.” As for hoping that Generation Z would come to the rescue, Bemis glumly noted, “There definitely aren’t enough kids coming out of school. There are a lot of programs to get kids interested from elementary school age in technology, but it’s very slow.” And if there weren’t enough problems, there is also the news of Amazon’s new headquarters coming to Long Island City. Although Bemis noted that was still in the future and it was not clear what types of jobs will be brought to Amazon, he stated Amazon would “attract a certain number of workers and create new openings in a lot of companies.” So, what can companies do to keep their IT professionals from defecting? The answer, Bemis believed, was listening to what their tech staffs were looking for in terms of job satisfaction. Bemis recommended that companies offer their IT employees ongoing skills training as part of their talent acquisition and retention strategies, with particular attention given to developing technologies, including cloud computing and DevOps. “With national tech unemployment at near zero percent, it’s important to consider every means possible to ensure a fully staffed and productive technology team,” Bemis said. If the region has one advantage going for it, Bemis acknowledged, that would be its location — especially for maintaining a local talent pool from being lured to the Big Apple. “People who live in the suburbs would rather not go into New York City,” he said. “They can now get almost a competitive salary out here in the suburban areas. People will commute up to an hour for a little bit higher salary, but people want the quality of life you can get from a more local position.”

The agency voted to approve the sale, along with a mortgage recording tax exception totaling $361,000, at its October meeting. The IDA also collected about $1.2 million in transaction and

investments. By the company’s count, its global assets total more than $8 billion. “This property continues HGI’s strategy of acquiring Class A assets in top-tier markets with great demographics and strong employment drivers,” said T. Richard Litton Jr., president of HGI. “New Rochelle is a New York City metro commuter hub with easy access to multiple

forms of transportation. The property has been maintained to a high standard and has a wide assortment of quality amenities.” HGI said it would spend $5.5 million on interior upgrades to about 375 apartments, including improved cabinets, appliances, lighting, doors and smart thermostats. The Boston-based seller, DSF Group, still owns an

Amazon certainly will soak up its fair share of those sales. The online retail giant said Cyber Monday was the “single-biggest shopping day” in its history, though it did not release revenue data. An NRF survey following Thanksgiving weekend estimated that the majority of shoppers, about 89 million people, shopped both online and in stores, a number up nearly 40 percent from last year. To help draw those customers to their stores, villages and towns are offering free parking, while malls are adding pop-up stores and events. In a first-ever collaboration, Jefferson Valley Mall is hosting a pop-up from Peekskill Brewery, including beers on draft. At The Westchester in White Plains, dogs donning holiday sweaters trotted past Gucci and Tiffany and Co. for the mall’s pet photo night with Santa on Dec. 9. The mall has hosted pet photo night twice each holiday season for nearly a decade, but the event continues to grow in popularity, according to Paula E. Kelliher, The Westchester’s director of marketing. This year even featured the mall’s first pet pig photo. In general, Kelliher said, “business has been thriving. It has really been probably the best-ever second and third quarter this year for us. Traffic and sales are trending upwards and it’s been very brisk since Black Friday.” The promise of a holiday boost comes following another year of bleak headlines for the national retail market. Famous brands such as Sears, Toys “R” Us and JCPenney all announced mass closings. More than 146 million square feet of retail space has closed,

We’re seeing great national tenants, but we’re also seeing retail mom-andpops coming up with creative new concepts.” Westchester has a population just shy of 1 million and average income levels 50 percent higher than the national average, above even Manhattan, according to the report. “I think retailers are starting to see just how much buying power there is when you compare Westchester to New York City,” Gordon said. “Yes, New York City obviously has more density, but Westchester has the sheer income-buying power, paired with the fact that rents are cheaper.” Beth White, a vice president at Harrison-based RM Friedland, also cited Westchester’s strong demographics as the main draw for retailers. “All of the mixed-use construction in White Plains, New Rochelle and Yonkers will only improve the demographics from a density perspective,” she said. Businesses that provide products or services hard to buy online are growing — including food, fitness, urgent care medicine and experiential retail, such as escape rooms or paint bars. But apparel retailers have opened with increasing frequency in the county as well. Gordon points to harry: a Rothmans Project as an example. The boutique men’s clothing store opened in the retail space below his company’s Bronxville office in 2016. “People are looking for a slightly more personal experience or, even more, a curated experience,” Gordon said. “Something where they can

talk to an expert in whatever it is they are purchasing.” That description could include PORCH, which Grant opened with her business partner Jen Gerken in October. Gerken is an interior decorator, while Grant’s background is in marketing and branding. The store’s mix of items include work from local artisans and its original UVO line — for unique, vintage and original. The line includes items found at estate sales and antique shops and then improved or refinished, often referred to as upcycling. “Every person that walks in the door says ‘We needed a store like this,’ ” Grant said. “I think there’s only so much you can buy on the internet. You need to be able to touch things, see them with your own eyes.” After searching in Mount Kisco and surrounding towns, the partners found the East Main location, right on the street’s intersection with Green Street. The space offers a nice splash of sunlight and good visibility from the road, Grant said. A Mount Kisco resident, Grant said the improving state of the village’s real estate market encouraged her and Gerken to open. “We were watching the downtown area and noticed a little bit of a boom,” Grant said. She said the village has adopted friendlier business practices and made working with various departments easier. PORCH may be on to something with its last-minute guy’s night. White Plains approves 127 new apartments for Hale Avenue BY RYAN DEFFENBAUGH rdeffenbaugh@westfairinc.com

he city of White Plains has approved a development that will add 127 apartments on the eastern edge of downtown at Hale and Maple avenues. The Common Council gave site plan approval at its Dec. 3 meeting for an estimated $48 million plan from Hale WP Owner LLC. The company is a joint venture led by Martin G. Berger, principal of Armonk-based Saber Real Estate Advisors LLC, and Jonathan Stein, who is separately a founding partner of the development team behind Edge-on-Hudson developer Diversified Realty Advisors LLC. The plans, drawn by New Jersey architectural firm Minno & Wasko, call for two buildings, split by Hale Avenue. The two lots — 97-111 Hale Ave. and 100-114 Hale Ave. — are paved for parking, though only one is still in operation. The building on the east lot would be seven stories with 70 apartments. The west building would be eight stories with 57 apartments. Each building would have two levels of basement parking, totaling 170 spaces. Six percent of the units would be offered at rates affordable to residents making between 60 percent and 79 percent of the area’s median income. Berger told the Business Journal Dec. 7 that the project will differ slightly from other recent apartment construction in the city. It will offer amenities more appropriate for people downsizing, such as empty nesters, than the millennial demographic, he said. That includes larger overall units than typical apartment sizes, double sink vanities and large closets. Between the two buildings, the development would add 36 two-bedroom and 80 one-bedroom apartments, along with 11 studio apartments. Some units would include balconies. Shared amenities will include a rooftop lounge, fitness center, indoor lounges and a business center. The blocks surrounding this proposal have drawn steady interest from apartment developers. The property is a block over from DeKalb Avenue, where a six-story, 76-unit apartment building is preparing to open, and the five-story, 56-unit La Gianna opened in 2014. Across Maple Avenue, Lennar Multifamily Communities is seeking approval for the reworking of its mixed-use development plans on the former Westchester Pavilion property. If approved and built, the project would add two 24-story residential towers with 707 rental apartments and 93,840 square feet of retail near this Hale proposal. Berger said his firm “believes that the more multifamily you have in a downtown, that equates to a more vibrant city. It brings restaurants and shops busy with people walking around in the evening hours.”

The two lots his firm’s proposal targets have sat vacant for decades. The city approved a 12-story apartment tower 15 years ago for a developer, which was never built. The apartments offer a chance to “finish off the street,” Berger said. The proposal brings together two developers who have led other recent major real estate projects in Westchester County. Berger’s Saber was the co-developer of Rivertowns Square in Dobbs Ferry, a 450,000-square-foot development that includes a movie theater, apartments, restaurants and retail. The property was bought for $69 million in April by Regency Centers, a Florida retail manager. Saber developed the project with Chauncey Station Partners. Saber and Chauncey also teamed up for The Collection, a mixed-use project the city of White Plains approved in the spring that will add shops and apartments along Westchester Avenue. Berger said that his company hopes to start construction on The Collection early next year. And while Stein’s interest in the project is through a separate entity, he is a founding partner in Diversified Realty. told the city Planning Board in August, “this is a real team, they have their financing ready and are very excited about getting this project underway.” As part of the city approval, the developers will pay the city a $393,500 fee in lieu of providing adequate land for park and recreation space. The city charges the fees on a sliding scale, based on units and bedrooms, to residential developments

that do not provide what the city deems enough open public space to mitigate the increase in residents. The team still plans to bring the project before the county Industrial Development Agency, Berger said, for potential tax incentives. The plan is to start construction early in 2019, with an 18- to 24-month time frame to build and lease the building.


Public access outweighs privacy in The Tuxedo Club case BY BILL HELTZEL bheltzel@westfairinc.com

ublic access to court documents involving The Tuxedo Club and a fired general manager outweighs the possible harm the records could have on the ex-employee looking for a job, a federal judge has ruled. Martin A. Badinelli of Brookfield, Connecticut, sued The Tuxedo Club in 2015, claiming that the Orange County country club wrongfully fired him. Last month, he asked federal court in White Plains to seal records in the lawsuit he filed against the club, to protect his privacy, reputation and earnings potential. “Protection against the possibility of future adverse impact on employment,” U.S. District Judge Vincent L. Briccetti said in a Dec. 6 opinion, “does not overcome the presumption of public access.” The Tuxedo Club hired Badinelli as general manager in 2009. But after Badinelli questioned the club’s liquor practices, he claimed in his 2015 lawsuit, he was fired. He alleged, for instance, that the club routinely served liquor to nonmembers at weddings it hosted, even though it did not have a catering license or a liquor license to sell to nonmembers. Badinelli sued The Tuxedo Club for $750,000, alleging retaliation, age discrimination and breach of contract. Briccetti ordered the parties to arbitrate the dispute. In April, they notified him that the dispute had been settled. The federal case was closed. Last month, Badinelli asked the court to seal the case records. Any potential employer, his lawyer, William D. Frumkin, wrote, would check on him with an internet search and find the records. “The existence of this litigation appears frequently” in internet search results, according to the motion to seal, “including as the very first search result in a Google search.” “I have encountered a significant lack of response that can only be explained by potential employers learning of my litigation,” Badinelli declared in a separate filing. “My reputation and earning potential have been severely damaged by the record of this litigation on the internet.” His lawyer also argued that the presumption of public access to court documents is strongest when the documents play a substantial role in determining the litigant’s substantial rights. Here, Frumkin said, the federal court records are minimal because the dispute was handled mostly in private arbitration. Badinelli and The Tuxedo Club also agreed to keep the arbitration documents confidential, and the club has

not opposed the motion to seal the federal records. Briccetti noted that there is a presumption of immediate public access to judicial documents, under common law and the First Amendment, but courts may consider competing factors such as privacy or the danger of impairing law enforcement. But Badinelli chose federal court,

Briccetti said. He should have considered the possibility of future impact when he filed the case, and since he had an arbitration agreement with the club he could have bypassed the court and taken the case directly to arbitration. The motion to seal, he said, “is largely based on a desire to remove information from the internet.” But the fact that Briccetti compelled

arbitration is already a matter of public record that appears on the court docket, internet search engine results and in published law reports. It would be pointless, he said, to seal the records. Badinelli argues that his interests in privacy, reputation and earning capacity outweigh the interest of public access to the court records, Briccetti summarized. “The court,” he ruled, “is not persuaded.”

White Plains woman gets court OK to continue Lyft lawsuit BY BILL HELTZEL bheltzel@westfairinc.com

A

federal judge has ruled that a lawsuit by a White Plains resident demanding that Lyft Inc. provide wheelchair access may move forward. District Judge Nelson S. Roman denied Lyft’s motion to dismiss the 2017 class-action lawsuit under the federal Americans with Disabilities Act in a Nov. 29 opinion. The lawsuit was brought by Harriet Lowell who relies on a motorized scooter for travel, and Westchester Disabled on the Move Inc., a Yonkers organization that works to remove barriers to people with disabilities. “Without reliable transportation options,” they argued in an amended complaint, “people cannot maintain employment, obtain health care, visit friends and family,

or otherwise be full and regular participants in civil life.” They want the court to require San Francisco-based Lyft to ensure full and equal access for disabled riders. Roman, however, dismissed their claims under the New York City human relations law and he dismissed Westchester Disabled’s claim under the state human relations law. The gist of their case is that smartphone, ride-hailing applications offer convenient, quick and cheap transportation options, but Lyft’s services “are only available to able-bodied consumers.” Lyft does not offer wheelchair access vehicles in Westchester and many other locations, the complaint states. It does require New York City drivers to register with the Taxi and Limousine Commission, but it is not subject to regulations there that require cab companies to provide wheelchair access

to half of their fleets. Disabled people who try to use the service get a text message about alternatives. But subways and buses are inaccessible or agonizingly slow to use, the complaint states. Registering for a paratransit service can take several weeks and many operators require trips to be booked at least 24 hours in advance. And most taxis do not allow payments from smartphones. Lowell makes two trips a month to New York City

for health care and other services. She gets there in a van equipped for her scooter when her husband is able to make the trip. A ride-hailing service would enable her to go to the city more often and travel short distances from her downtown White Plains home when rain or snow make her scooter inoperable. Lyft argued that Lowell and Westchester Disabled lack legal standing. Lowell, for instance, has not signed up for the service, so she had failed

to identify a concrete injury. But Roman noted that she had heard from other disabled people that using the service was futile, therefore she had a plausible claim for injury. Westchester Disabled claimed it has standing because it diverted resources from its mission to file the lawsuit. But the organization cited no examples of using its resources, such as conducting an investigation, so Roman granted Lyft’s motion to dismiss claims under the state and New York City laws, but not under the federal law. Lyft also argued that, under its terms of service, Lowell and Westchester Disabled had to file federal discrimination claims with an arbitrator, not with a court. “It seems supremely unjust,” Roman said, “to hold individuals to an arbitration clause buried in the verbiage of a terms-of-service agreement for a service that they

did not sign up for, particularly when those individuals have not received any benefits from the agreement.” Lyft also disputed that it is a “public accommodation in the business of transportation” under the Americans with Disabilities Act. It is premature at this phase in the lawsuit to decide that question, Roman ruled. But for now, he found, Lowell and Westchester Disabled have made plausible claims that Lyft operates a “public accommodation” and has discriminated against Lowell by “denying her a full and equal opportunity to enjoy the defendant’s services.” Lowell and Westchester Disabled are represented by White Plains attorneys Jeremiah Frei-Pearson, Chantal Khalil and Andrew C. ‘Gridlock Sam’ says driverless cars could impact sprawl

riverless cars, known by the more scientific-sounding name autonomous vehicles, may change the shape of suburban development, according to Sam Schwartz, aka “Gridlock Sam” and a former New York City traffic commissioner. Schwartz, who also is known as “Gridlock Sam” by virtue of his column with that title appearing in the New York Daily News, was the luncheon keynote speaker Dec. 6 when Pace University’s Land Use Center presented its 17th Annual Alfred B. DelBello Land Use and Sustainable Development Conference. Schwartz addressed about 250 developers, consultants, local leaders, attorneys and other professionals gathered at the Pace campus in White Plains. His firm, Sam Schwartz Transportation Consulting, specializes in transportation planning and engineering. Schwartz owns a house in Somers and is quite familiar with suburban driving, commuting patterns and traffic jams. His new book, “No One at

the Wheel: Driverless Cars and the Road of the Future,” looks at the inevitability of autonomous vehicles, the problems they may cause and the benefits they might provide. In an interview with the Business Journal, Schwartz said, “Imagine someone from Westchester who works in Manhattan. The autonomous vehicle takes that person there. That person is at work at 9 o’clock and tells the autonomous vehicle ‘you know it costs $80 to park here for the day, why don’t you just drive back home to Westchester and wait until I tell you that I’m ready to leave.’ ” In addition to doubling the number of miles traveled on the area’s roads as a result of cars making one leg of a round trip empty, Schwartz suggests driverless cars may encourage people to live farther away from urban centers. “Suddenly the car becomes much more comfortable and you can get lots of things done, even sleep done in your car.” Schwartz was only half joking when he said that we’ve got to watch out for empty “zombie cars” taking over. “The traffic could very

well get much worse because there will be more vehicle miles traveled, more cars on the road than ever before.” The current interest among developers and municipalities in transit-oriented developments may help keep cars off the roads, Schwartz suggested. “Building town centers where you can walk and you have greater accessibility to local stores, that’s terrific, but there is going to be a tension out there if we rely on the autonomous vehicle to drive us further and further out and encourage sprawl.” He said there is a definite positive trend taking shape right now regarding traffic levels. “Younger people, millennials, are driving far less than previous generations. There’s a 20 percent drop in the amount of driving that millennials do compared to any other generation that came of age,” he told the Business Journal. Getting to the train station is an area where Schwartz believes autonomous vehicles could have a big impact on life in the suburbs. They could “…take you that last mile or two or five miles to a train station to drop you off and pick you up when you come back.”

BUT I’M HEARING MORE COMPLAINTS AND QUESTIONS ABOUT WHY SOME PEOPLE GET TO LEAVE EARLY AND OTHERS HAVE TO STAY LATE. WHAT SHOULD I DO? THOUGHTS OF THE DAY: Having a standard set of work hours can make it easier to monitor, but may not give your employees the flexibility they need. Whatever you do, make things fair for everyone. Not everyone needs to work a 40-hour week. Just make sure that pay matches the hours worked. Be open about the choices you’re making so that everyone understands how you arrived at your decisions. Being flexible about work hours is a perk that you can offer your employees. Use

it to your advantage. Take into account things like commuting time, getting kids to school, taking care of family members outside work, personal commitments and pursuits, etc. Decide on basic policies such as time off for lunch — is it an hour or less? Same for breaks in the morning and afternoon — 15 minutes each? Set up some standard work hours: 8 a.m. to 5 p.m.; 8:30 a.m. to 5:30 p.m.; 9 a.m. to 6 p.m.; or 9:30 a.m. to 6:30 p.m. Discuss with all employ-

ees what block of work hours might work best for them. For new hires, give them 30 days from hire to experiment and find out what works, taking into account traffic and commitments outside work. During the first month, closely monitor arrival and departure times to make sure new employees are putting in a full day of work each day. After 30 days ask new hires to select a work block that they plan to stick with. Some employees may find it hard to work a full 40 hours, while others may want to work more than 40 hours in order to pick up overtime. Check on rules regarding eligibility for health insurance — most policies require a minimum number of hours be worked each week. Verify that employees working under the minimum are OK not having access to

health insurance. For employees who want to work more than 40 hours in order to increase their pay, decide if they are eligible for overtime or if they should be on a salary that takes into account the increased commitment to working until things are wrapped up for the day. Employees on salary should meet several tests, including: minimum amount of pay; job duties that classify them as exempt including supervising two or more other employees; management responsibility; input into hiring/firing/promotions and assignments of others; control over their workflow; and determining quality and quantity of work to be produced. Check with your labor attorney on FLSA requirements. Talk with employees

about how you arrived at work rules. In general the more open you can be about the process, the better the acceptance. Instead of hiding why you’re allowing one employee a different set of hours, explain why and be willing to offer similar accommodations to others if they ask. Consistent standards will go a long way to keeping the peace. If there are issues of needing to arrive early or work late to get work out, ask the team to solve the problem. They can rotate early or late hours, allow some members of the team to come in earlier/later and leave earlier/ later. Some team members may be more able to work longer hours than others. Giving the team the flexibility and responsibility to work it out keeps you out of the headlights of being the bad

Twelve students recently completed a Rapid Response Customized Training program conducted by Westchester Community College (WCC) in Valhalla in partnership with the Westchester/ Putnam Workforce Development Board. The program itself was developed by the Westchester County Office of Economic Development (WCOED). They received training, which qualifies them for jobs as culinary workers for FLIK Hospitality

Group’s operations at General Electric’s Management Development Institute. It was the first of several rapid response training programs that the county plans to roll out as it works with area businesses to address labor shortages due to low unemployment rates. Bridget Gibbons, director of the WCOED, said, “When GE approached us looking for food-service workers, we designed a customized program to address

They received a tour of the bank, got to see a demonstration of the latest interactive teller machines and participated in mock career interviews and a financial literacy presentation led by Patriot Bank Vice President/Branch Manager Kathleen M. Reilly. Patriot Bank’s President Richard Muskus Jr.; Fred Staudmyer, executive vice president and chief administrative officer; Judith Corprew, chief compliance and risk officer; and Chris Johnson, senior vice

president and director of branch banking, participated in a panel discussion and question-and-answer session with the students. Muskus said, “In years past if you taught children to save their dollars and cents, the rest would follow, but now we are in a more complex world of debit and credit cards, spending on iTunes and Apple Pay, Venmo and costly annual cellphone plans. This program is about opening their eyes about how to successfully manage their financial lives and help create a fiscally strong future.”

FRIEDLAND LAUNCHES INVESTMENT SALES DIVISION

Commercial real estate brokerage company RM Friedland, based in Harrison, has opened a new division specializing in the sale of investment properties. John Barrett has been named managing director of the new division. Marco Lala has been named its senior vice president, bringing with him a sales team, which has been active in The Bronx and Northern Manhattan. Sarah Jones-Maturo, president of RM Friedland, said, “The expansion into investment sales is an organic next step for our company.” Barrett has specialized in the sale of income-producing assets in Westchester and Rockland counties. Previously, he had been with Massey Knakal and Admiral Real Estate. Since 2005, he has been involved in representing more than $950 million worth of investment real estate in the New York metro area. He will be responsible for growing the new division and spearheading new business activities in Westchester County. Lala has personally handled the sale of more than 450 buildings worth more than $1.5 billion in the New York metro area. Previously, Lala was with Massey Knakal and Marcus & Millichap. David Raciti, Jack Lala and Michelle Lala are on his sales team. RM Friedland says the new division is already exclusively representing properties with an aggregate value more than $70 million in the Bronx, White Plains and Connecticut.

The Touro College of Dental Medicine (TCDM), which is located in Valhalla, held its 2018 gala at The Ritz-Carlton in White Plains recently. More than 300 attended the event, which was designed to raise funds that will support both student scholarships and patient care at Touro Dental Health, the school’s 32,000-squarefoot dental clinical teaching facility. The gala committee was chaired by Drs. Evan and Jill Chafitz of Scarsdale Oral Surgery. Ronnie Myers, dean of TCDM, said, “The opening of our clinical training facility

this past year has enabled us to fulfill our mission of training the next generation of dentists and oral health care providers while providing access to affordable dental care for underserved populations throughout the Hudson Valley, and we’ve seen this support grow along with us.” During the event, Touro’s Innovation in Dentistry Award went to Scott Parrish, president and CEO of A-dec Inc., a manufacturer of dental equipment. Guillaume Daniellot, executive vice president of Straumann Group, received the

Distinguished Corporate Leadership Award. The Creative Dental Technology Award was presented posthumously to Adrian Jurim, an innovator in restorative dental technology. The award was accepted by his widow, Bianca, and his children Drs. Barbara and Alan Jurim, both faculty members at TCDM. The Community Partnership Award went to the Ninth District Dental Association, a regional association with more than 1,600 members. The dictionary defines “visiting firemen” as important visitors who get special treatment. On Nov. 30, there were some visiting firemen and women who had the opportunity to visit the Rye Brook Fire Station. Boy Scout Troop No. 535 and Girl Scout Troop No. 1902 from Cerebral Palsy of Westchester’s (CPW) Adaptive Scouts Program were taken on a tour of the fire station led by firemen Chris Calamari and John Giordano. They were joined by

These included emergency lift air bags and the Jaw of Life hydraulic spreader used to pry open collapsed objects to free victims who otherwise would be trapped. The visitors had plenty of questions,

ranging from how high a truck’s ladder would reach (75 feet) to why the fire department doesn’t want things to be on fire (because fire can hurt people and destroy property). CPW’s Adaptive Scouts Program allows youngsters with developmental disabilities of all kinds to participate in activities comparable with those enjoyed by any Boy Scout or Girl Scout.
