CONSTRUCTION TO LEAD WHEN THE RECOVERY BEGINS

C

onstruction has been selected to be in phase one of the four phases established in New York state for the reopening of businesses in the recovery from the COVID-19 pandemic.

Even during the height of the forced economic slowdown and social distancing aimed at slowing the spread of the virus, some construction activity was allowed to continue. Public works projects, including road, water, sewer and other infrastructure repairs and enhancements were on the approved list as were developments that would provide affordable housing and construction projects associated with health care.

With the NY PAUSE plan on which the shutdown was based due to expire on May 15, there has been speculation that a region-by-region phased reopening of commerce in the state would begin as soon after that date as specified criteria are met.

In addition to construction, manufacturing was slated to be in the first phase of reopening.

Phase two would incorporate professional services, including finance and insurance, retail, administrative support and real estate businesses including rentals and leasing.

Phase three would include restaurants and other food service operators and hotels and other providers of accommodations. Âť IRON

Leadership in a time of crisis: Fairfield U. President Mark Nemec liked: ‘I don’t care about what anything was designed to do, I care about what it can do.’ Let’s not just talk about how the organization is structured and how we delivered education before. Let’s think about how it can take place in the current environment.

“Keep in mind that this is a period where a lot of people are struggling and suffering, and in a lot of pain. Being mindful of that contributes to having a long-term sense of purpose.”

This is a limited series of Q&A’s by Fairfield County Business Journal Bureau Chief Kevin Zimmerman with leaders in various business sectors and industries. It is designed to illustrate how they’re navigating the COVID-19 era, what past experiences they’ve drawn upon, and suggestions they have for those planning for a career in leadership.

ith the conclusion of his third academic year as president of Fairfield University just a couple of months away, Mark Nemec found himself in a then-unusual position: Announcing on March 11 that he was basically closing the school and moving all of its programs and courses online, effective March 16.

(Coincidentally, Gov. Ned Lamont ordered all of the state’s schools to close on the 16th as well.)

With the future “fluid,” in Nemec’s words, the university is planning on returning to on-campus teaching and instruction in the fall — depending on ensuring the safety of everyone, and on governmental guidelines of course.

Here he discusses how he has steered the Fairfield University ship during this unprecedented time; what lessons he has learned; and how important faith has been during the crisis.

What does it mean to be a leader in the current environment?

“There’s an accountability that’s necessary — there always is — to help give our young men and women a continued sense of motivation.

Leadership and mobilizing folks is a large component of the whole. With faculty and staff, everyone has an assigned position but they all know that they can be called upon to do anything.

“I’m always cognizant of that this is a very collaborative effort and this crisis certainly reinforces that. And I also try to keep people focused on the long term — especially for us as an institution, you need to keep people mindful of that.

“There are very, very immediate challenges, but at the same time we are a university that was founded in the shadow of the Great Depression (in 1942) and the shadow of World War II. Resilience is in our DNA.” How much time do you personally have to gauge your responses

to day-to-day developments — or is it more a matter of putting your head down and “just doing it”?

“Both. We’ve effectively had to take some of what we were planning for the next seven years and transpose it to what’s happening in the next seven months. There was already a move toward more modular learning — a hybrid of classroom and online — that we had been talking about and now has been thrust upon us.”

I know some schools have been hearing complaints, particularly from students’ parents, about paying full tuition for online learning — the idea apparently being that since you can do that basically anywhere, why should you be paying thousands of dollars per semester? How do you respond to such objections? “(On April 29) we addressed the room and board aspect by making equitable adjustments. (Housing adjustments are based on room type and are modified for fixed and direct costs associated with managing the university’s housing program, while credits for meal plans based in part on departure date will be issued.)

But online teaching is very similar to what students receive in a physical classroom.

“We are dedicated to providing the same education and innovation to our pedagogy. In the past about 50% of our students have taken one or more online course — this is not the first time we’ve offered that. And I don’t know if every university has been able to stand up the kind of vir-

tual support system that we have. In addition to classes, we have online tutoring, online advising — all part of our experiential approach to teaching and learning.

“And we’re already seeing a nice uptick in students taking summer courses online. We have at least 100 online courses this summer because of the demand — we thought we’d need 50. That speaks to the fact that not everyone has as robust an experience at their home institution.

“Plus we have online career services and we’re offering mental health and other health services across state lines. Even students who are not in Connecticut can still attend a virtual counseling session.”

What past experiences have you drawn upon during the crisis?

“I learned while I was at Forrester Research, and later at Eduventures, to emphasize the impact that tight communications and specificity can have. As stressful as this time has been, it’s really important to be as precise as possible. There can be slight misunderstandings that can throw everything off. At the same time, we are all dedicated to animating our teams to look at the longer term horizon.

“It’s also been important to learn to tolerate ambiguity in some situations. You can just say you don’t know. You can plan for multiple scenarios, but it’s ultimately out of your hands. And admitting that you’re not fully in control is not easy (laughs).

“This is and should be an occasion for creativity. There’s a line in the movie ‘Apollo 13’ that I’ve always

How has your team responded during this situation?

“I’d say everyone has blossomed.

Everyone has been stepping up, no one has been frozen or paralyzed.

The way they have responded to the call, the extent to which folks have been able to sustain that after months of fatigue, has been quite remarkable.

“And that has been a key of leadership at a time like this — maintaining an appropriate sense of pacing.

This is a marathon, not a sprint.”

Fairfield is a Jesuit university.

How important is faith at a time like this?

“The fine line is that we are a faith-based institution of higher learning, but we are also an institute of higher learning. And we have done a very good job of doing what universities do. Scholarship, research — these are things that continue.

“But as a community we have remained strong as well. We had 750 independent log-ins for our Easter Mass from all around the country.

As a Jesuit Catholic institution, we educate folks about how we truly believe that what we are called to do is in the service of humanity. There’s no doubt that that’s a motivating principle that’s needed now more than ever.”

What advice do you have for others in leadership positions, or who are seeking such a position in the future?

“Always recognize that one is a steward, that you’re responsible for the collective and common purpose.

Think historically, and plan on how you can leave your institutions or companies better than you found them. My major responsibility at this moment of crisis is to make sure that Fairfield comes out of it even stronger in the long run.”

New Rochelle IDA grants developer bonus tax break for public plaza

A

New Rochelle apartment project is getting a bonus tax subsidy for renovations to an off-site street and plaza.

The New Rochelle Industrial Development Agency approved a $140,674 sales tax exemption for WBLM 25 Maple Owner LLC, April 30, bringing the developer’s total tax subsidies to $24.3 million.

The subsidy was added to the developer’s proposed 25 Maple Ave. project, but the extra work will be done about six zigzag

No-shows at trade shows, survey finds

rganizers of trade shows who are planning events after the COVID-19 pandemic abates may find themselves with few attendees at their offerings.

According to a new IBM Institute for Business Value survey of 25,000 adults, more than half of respondents said they were unwilling to be exposed to gatherings with large crowds for the remainder of this year — with 75% saying they would not be attending any trade shows and business conferences that will be held this year.

But that’s not to say the survey’s respondents will continue to self-quarantine after the all-clear message goes out. One-third of respondents said they were willing to return to their favorite restaurants and bars, another one-third were eager to visit outdoor parks again, 25% were ready to return to the beaches, and one in five were ready to hit the malls and shopping centers once they reopen.

As for getting to their destinations, more than half of people surveyed who used ridesharing apps and services said they would either stop using these services or use them with much less frequency, while 20% who relied on mass transit said they will stay off the buses and trains.

Instead, 1 in 4 respondents predicted they will use their own automobiles exclusively for their transportation needs — although one-third of respondents said that constraints on their personal finances as a result of the pandemic will “greatly” influence their decision to buy a vehicle.

“The study provides further evidence that COVID-19 is permanently altering U.S. consumer behavior,” said Jesus Mantas, senior managing partner at IBM Services. “There are long-term implications of the new consumer behaviors for industries like retail, transportation and travel among others. These organizations need to quickly adapt their business models to serve the new consumer behaviors in order to survive and thrive.”

WBLM is a joint venture of Wilder Balter Partners Inc. of Chappaqua and L+M Development Partners Inc. of Larchmont.

The IDA previously granted approval to the developer for property, sales and mortgage tax exemptions for a the $70.6 million, seven-story, 184-unit apartment building on a city parking lot at 25 Maple Ave. Anderson Street is a one-way, oneblock connection between North Avenue and LeCount Place, aimed at New Roc City Mall. It is also adjacent to WBLM’s 14 LeCount Place project.

The plaza is a mostly inaccessible island of overgrown trees and under-

growth, bordered by parking on one side and by a walkway, eight storefronts and a Key Bank branch on the other side.

The developer’s plan is to enliven the streetscape with bubble fountains, a variety of seating and less dense landscaping.

The hope is to make the plaza more inviting and to put it to use for public events such as festivals, a farmers market and performances.

WBLM has begun construction of 14 LeCount Place, a $190 million, 27-story, 380-apartment and ground floor retail complex. The IDA previously approved $38.8 million in tax subsidies for that project.

Scott Acheychek, president of REX Shares LLC we launched a subsidiary called Osprey Funds. Osprey is currently focused on private funds linked to cryptocurrencies.

“Our first product under Osprey is the Osprey Bitcoin Trust, which was launched in early 2019. It’s a little too early to gauge the investor reaction as the product is in its seed stage but we are really excited about it.”

cott Acheychek is president of REX Shares LLC, a Fairfield-headquartered independent sponsor of exchange-traded funds (ETFs). In this edition of Suite Talk, Business Journal Senior Enterprise Editor Phil Hall speaks with Acheychek about REX Shares’ distinctive niche within the financial markets.

How did you get connected with REX Shares and why did you want to join this company?

“I joined REX about four years ago. I’ve known the founder, Greg King, for a very long time. Greg is a pioneer in the ETF industry and has launched over 100 different exchange traded products. While I’ve spent most of my career at big financial companies such as AIG and Citi, part of me always wanted to start my own company or be very early days at a startup. I joined REX shortly after Greg launched his first couple funds. It was a no-brainer to join Greg, an entrepreneur I knew well and respected, at a brand-new company in an industry that I believe in and have sheer passion for.

“Obviously, there are tradeoffs in joining a start-up, mostly financial, but there are also some incredible perks especially when the company is local. I can put my kids on the school bus every day, I’m able to volunteer as a youth sports coach, I go to intraday school events for my kids, etc. I was unable to do any of this previously while traveling quite a bit and working by day in New York City. This created even more fire in my belly to do everything I possibly can to help this firm grow and succeed.”

One the REX Shares LinkedIn page, the company is described as: “We help make the investing world flat by democratizing access to compelling investment strategies.” What exactly do you mean by that?

“We are structurers and traders at heart who constantly survey the market, all markets, to see if there are opportunities to create new products or better access vehicles across all asset classes. We created the MicroSectors brand with sophisticated investors and traders in mind, and a goal of providing specific equity exposures to slices

of the market that people know and follow.

“A great example of this is our Big Bank index. We created an index that is just the 10 biggest banks in the U.S. — that’s it, nothing more, nothing less. Why? Most people judge the overall financial sector by looking at big banks like JP Morgan’s, Goldman Sachs, etc. However, most financial indices and subsequently ETFs or ETPs linked to financials contain exposures to REITs, insurance companies, exchanges, lenders, credit card companies, regional banks, which may or may not trade in line with big banks.

“Again, our goal is to create products where people know the stocks in our indices and not be surprised when they look under the hood. So, when we think of big banks, we think of it as a minisector or microsector within financials.

Hence the name MicroSectors.

“In addition, we launched suites of products related to FANG (Facebook Amazon Netflix Alphabet), big tech, U.S. oil companies, cannabis and master limited partnerships.”

In August 2017, you launched the subsidiary REX Capital Management to develop investment products and strategies related to bitcoin and other digital assets. What products have been created by this subsidiary and how has investor reaction been?

“We’ve tried several different unsuccessful paths to creating funds linked to cryptocurrencies.

How has the ETF market behaved since the COVID-19 pandemic began to impact the global economies?

“I think the ETF market has behaved as expected. As a liquidity tool, ETFs provide exposure, both long and short, to a variety of sectors in many asset classes. Many sectors are being dramatically affected by the COVID-19 pandemic. These transformational shifts are being reflected in the markets in a big way.

“I hope people use this time to really analyze their portfolios and gain a deep understanding on what they hold. Just owning a thematic or some kind of index fund isn’t enough. Everyone would be better off if they had a basic understanding of what is under the hood of the mutual funds and ETFs they own and how they work.

“The ETF industry is amazing and continuously evolving. I believe these events will continue to push this innovative industry forward in terms of product construction and structures.”

What do you see as the growth industries that will arise when the COVID-19 pandemic is behind us?

“I see growth in areas that assist in working from home, telehealth and remote education. When the dust settles, I think this generation will not forget this event and behaviors will permanently change.

“Efficiency tools in this workfrom-home era are key to the success of any organization, large or small. These tools are fascinating as they are industry agnostic and can be applied to many different problems. It is the same for the videoconferencing phenomenon for business, schools and even for doctors. Telehealth is a great example as we are seeing many technologies emerge to allow for easy access

to doctors and care, all from the home.”

What are your future goals for your company?

“I have massive goals for REX Shares. I think we can become a leader in alternative investments.

“We have just begun to scratch the surface of our potential with MicroSectors, and there are numerous investing verticals that I believe we can disrupt. With our MicroSectors products, our goal is to provide access to a more targeted or precise equity exposure to popular areas of the market. I mentioned big banks before, but the first product we launched is related to FANG. There are many investors who want access to the FANG names as these big-tech companies impact all facets of our lives.

“We worked with the New York Stock Exchange on a series of products linked to the NYSE FANG+ index. It’s simply 10 of the biggest and notable names in tech; Facebook, Amazon, Apple, Netflix, Alphabet (Google) and a few others. Our goal is to create that MicroSector for just big tech.

“When you look at popular technology indices like the Nasdaq 100, I don’t think they provide the exposures people think they do.

Therefore, I beg people to read the fine print when it comes to their investments. The Nasdaq has matured as an exchange, which alters the makeup of the Nasdaq 100 Index and its related ETF, QQQ. The index is basically the 100 largest companies on their exchange.

As the exchange has evolved and matured, it went from mostly a tech exchange to adding companies like Pepsi, Starbucks, Costco, Monster Beverage, American Airlines, Marriott, which all then found their way into their Nasdaq 100 index.

I personally don’t think of tech when I think about Pepsi or Starbucks, both of which are top 25 holdings. That’s why we focus our time on the FANG index, to allow people access to just the big tech stocks they know and follow.

We are starting with these equity products, but we have a healthy pipeline of product ideas for other asset classes as well. We have big plans for the future.”

The fourth phase would include businesses related to the arts and entertainment and education.

The parameters that would have to be met in a given geographic region in order for reopening to begin include: • a 14-day decline in COVID-19 hospitalizations, or fewer than 15 new hospitalizations a day for the virus; • a 14-day decline in virus-related hospital deaths, or fewer than five deaths a day; • new hospitalizations remaining below two per day for each 100,000 residents; • local hospitals having a vacancy rate of at least 30%; • at least 30% of intensive care unit beds being vacant; • at least 30 virus tests conducted each month for every 1,000 residents in the region; and • at least 30 people doing contact tracing for each 100,000 residents in a region.

Each region would have a “control room” where decisions would be made by county executives, chairs of boards of legislators, town supervisors, hospital officials, state leaders and others.

In White Plains, some activity was observed recently at a construction site in the heart of downtown where The Mitchell, a 434-unit development running from the corner of Mamaroneck Avenue and East Post Road to Mitchell Place is being built.

Not far away, construction activity continued at the site of White Plains Hospital’s 252,000-squarefoot outpatient center at Maple and Longview Avenues.

Projects that were shut down as the epidemic grew will be waiting to restart. Also in the pipeline are developments that were approved just before the crisis hit and some projects that received approvals from municipalities as the pandemic continued. In most cases, the municipalities shifted the project reviews and public hearing processes from hearing rooms to online meetings.

The White Plains Common Council on May 4, while holding a virtual meeting, added a project to the city’s “active” column with unanimous site plan, special permit and environmental findings approvals for the adaptive reuse of the former AT&T building at 440 Hamilton Ave. Rose Associates had originally received one-year approvals for the project on Sept. 4, 2018. It acquired the project from a previous develop-

er, American Equity Partners, which had received approval for a residential conversion in March 2017.

Rose’s approvals expired and in February the developer submitted a new application to the city. There were no substantive changes in the proposal. The plans call for converting the existing 339,000-square-foot office building at 440 Hamilton Ave. into a residential development with 255 apartments and 3,400 square feet of ground floor retail space fronting on Hamilton Avenue.

The applicant proposes to construct a penthouse level on top of the existing 12-story building, increasing the overall height of the building by 12 feet. There would be another 213 apartments in a building to rise at the intersection of Barker

and Broadway. There would be a total of 468 apartments with 8% in the affordable category.

A six-level parking garage with 575 spaces would replace the current parking lot. There would be on-site open space for residents, including a dog park. The land and recreation facilities were not deemed adequate for the anticipated 835 new residents and the developer is to pay a fee-in-lieu of $1,433,500.

White Plains is most certainly not the only municipality with a lineup of developments that has gotten longer during the outbreak. Yonkers’ projects include the Lionsgate movie studio along with a number of proposed apartment, including Rose Associates’ plan for 440 units on the Altman Lighting site along the

Hudson River.

Port Chester has the proposal for the long shuttered United Hospital Site, also involving Rose Associates, under consideration along with smaller downtown developments.

And numerous other municipalities have projects in various stages, just not yet under construction.

“Because of these backlogs, we’ll have a good positive effect on the economy fairly quickly,” John Cooney Jr., executive director of the Construction Industry Council of Westchester & Hudson Valley Inc. told the Business Journal.

“There’s been some disassembly of the labor but it can be reassembled quickly and they can get started again quickly. Some staffs have been laid off, but those that have not are operating and the back offices have been operating remotely and they can continue to function that way.”

Cooney noted that the construction industry was not entirely shut down because public works, health care and affordable housing projects were deemed essential and allowed to continue. If 20% of the units in a residential development were priced in the affordable category, then the entire project was classified as affordable housing.

“Transportation infrastructure, water, sewer, state, municipal infrastructure has remained an essential business and our contractors for the most part have continued to operate,” Cooney said.

“There’s been some softening but that group has learned how to operate with COVID-19 and operate safely. So, there’s been a lot of innovation done there. The activity level on the private side, building construction for the most part, has been diminished. That group is anxious to get started and is willing to incorporate all of the best practices that the civil side of our industry, the infrastructure side, has adopted.”

Cooney said that there’s hope that idle construction sites represent just a temporary gap in work flows.

“There are truly some revenue losses. What hasn’t been done cannot be made up in this year, probably,” Cooney said.

“We work off of backlogs and our backlogs for the most part were very healthy so that will start up quickly so our impact on the economy will be felt right away. What happens to that pipeline going forward will predicate how sustainable our start will be. But our start will be, because of these backlogs, felt by the economy. We’ll have a good positive effect on the economy right away.

Westchester County Association forms group for post-pandemic recovery

A

lthough there still is no definitive time line for the reopening of Westchester County businesses, an effort to help lay the groundwork for economic recovery has been launched by the Westchester County Association (WCA).

The Post-Pandemic Working Group (PPWG) is a committee of business, nonprofit and academic leaders. Michael Romita, president and CEO of the WCA, told the Business Journal that preliminary discussions have already taken place with members.

“Everybody is hyper-focused on the next week, two weeks, three months just trying to survive what’s going on right now. But once we get through the worst of the current situation with the pandemic and people start slowly getting back to work that’s going to be the end of it; that’s going to be the end of the beginning,” Romita said.

“And, from there, we’re going to have a regional economy where the businesses have been shuttered, the health care system has been strained and our public budgets are stretched thin, not to mention what’s happening to our educational institutions and our nonprofits.”

Romita said the business, nonprofit and educational communities need to start thinking now about how to advance the recovery and maintain it over the coming months and years.

“There are going to be some challenges, but there probably are going to be some opportunities as well as we kind of rethink and reevaluate the projects and priorities that are going to be important for the county and the region to try and rebuild the economy and make it more resilient,” Romita said.

are going to show up. There’s a consumer confidence element here, making people feel safe about when they make their own personal decisions about their safety and their own well-being and the safety of their families.”

Romita said the PPWG will be looking at what the development priorities are going to be for Westchester and the things for which businesses, nonprofits and educational institutions will need to advocate to make sure the economy can bounce back. He identified one issue that the pandemic has highlighted as something the WCA had focused on long before the virus appeared: the need for countywide ultra-high-speed internet service.

“Telecommuting is becoming more important and there is a lot of remote learning going on and that’s placing underprivileged or areas of the county where you don’t have this kind of digital technology at a tremendous disadvantage,” Romita said. “It not only disadvantages the folks at home but disadvantages the local business community.”

Romita said with the PPWG effort the WCA is trying to bring a large group of stakeholders together.

“It’s not just the business community that has a say in this but the nonprofit community that has a big role to play as well, so we want to include all of these folks from the beginning,” Romita said.

He said that the PPWG should be able to do more than just paint in broad conceptual brush strokes and come up with practical ways to help businesses and organizations enter the post-pandemic world.

“If you think about how the general project structure might work, you’d have an advocacy agenda piece, you’d have a piece that deals with developmental priorities and then you’d have a communications strategy which includes messaging but also stakeholder engagement,” Romita said.

“There will be a bunch of ideas that will be developed about what best practices are for getting these places up and running again. The folks that we’re working with on the real estate side have already started developing these things for their clients. We can package and share this information and hopefully work with the politicians to try and get these businesses back up on their feet as

quickly as possible.”

Romita hopes that the PPWG will grow to reflect a complete cross-section of the WCA’s membership.

“We’re very fortunate at the WCA to have very high-profile influential people involved. Everybody who we have listed has already participated in scoping meetings and I’ve had personal discussions with them. But that’s just the start. We’ve got to reach out beyond just that core group and involve as many stakeholders as is practically possible.”

Romita said that would involve setting up various working groups as part of a stakeholder-involvement strategy.

“The pandemic has really hijacked prior discussions of what’s happening with business in the county and this is now in the front of the queue of things that we have to deal with,” Romita said. “I think that in the next several weeks we will start to coalesce around strategies and ideas and start rolling out a stakeholder engagement strategy for getting other people involved.”

Romita said that based on discussions he had with WCA members, people are holding their collective breath in anticipating what might happen next.

“I think it’s pretty bad. I think that there’s on the one hand a little bit of magical thinking to think that things just get back to normal in a couple of weeks, and on the other hand you’ve got folks who are very concerned not just about getting through the summer but also surviving the summer, but also what’s going to be the complexion of their businesses for the foreseeable future,” Romita said.

He said he has heard anecdotes regarding the frustration people have experienced trying to obtain aid from the Small Business Administration.

“It’s particularly hard on small businesses. It’s particularly hard on the hospitality industry, on restaurants, on movie theaters, so there is concern about some of these establishments being unable to bounce back. But I don’t sense depression. I sense people trying to do what they have to do to just get through the next several months and then very much looking forward to getting back to some semblance of normalcy, whatever that may be,” Romita said.

Survey: Most Westchester businesses expect 75%-100% revenue losses

A

substantial majority of Westchester businesses responding to a county survey say they are in trouble because of the COVID-19 pandemic.

“The results of this survey clearly show that the Westchester business community is struggling to survive during this crippling economic downturn and needs help,” Westchester County Executive George Latimer said. “This survey provides the county with valuable information on what services and assistance these companies need to remain in business as our economy recovers from the pandemic.”

The results of the survey were released by the county’s Office of Economic Development.

A questionnaire was sent to lists of businesses. Bridget Gibbons, the county’s economic director, said that more than 700 responses were received.

“Fifty-eight percent of the business that responded said they probably will lose between 75% and 100% of their revenues given the shutdown. Another 17% said that they’d lose 50% to 75%,” Gibbons told the Business Journal.

Gibbons said that businesses reported being affected in different ways, such as being forced to close their doors by state order, having illnesses among employees and being unable to institute work-from-home because of the nature of the business.

“We asked how could we be helpful and 85% of the businesses said they needed financial assistance, they were applying to the SBA (the federal government’s Small Business Administration) for loans and they needed help with those applications,” Gibbons said. “We quickly organized a volunteer pool. We had 400 people respond and we trained those folks on how to help businesses apply for those SBA loans and then we launched the volunteer application assistance program.”

More than half of the businesses that responded to the survey were from the retail and personal services sectors along with administrative and professional services. The majority of the respondents reported having some part-time employees and 60% of them had either fewer than five employees or were sole proprietors.

When it came to a description of their revenues before the business shutdown, 29% said they had annual gross revenues of more than $1 million and 25% said their receipts were under $100,000. In terms of longevity, 65% reported being in business in Westchester for more than 10 years. About 70% said they needed help in marketing or adjusting their business model in order to keep customers.

In Court APPAREL MAKER GRETCHEN SCOTT SUED FOR $1.85M OVER ALLEGED DISCRIMINATION

A former production director of Gretchen Scott LLC has sued the Pelham women’s apparel maker for $1.85 million for firing her.

Olivia Marino-Myers, of Nutley, New Jersey, accuses the company and founder-owner Gretchen Scott of harassment and discrimination, in an April 21 complaint filed in U.S. District Court in White Plains.

She was induced to join the company, Marino-Myers claims, and “bring valuable manufacturing contacts and know-how,” and then the company “violated their promises” and fired her.

“This is a crazy lawsuit,” Scott, of

Bronxville, said in a brief telephone interview. “The big problem was she didn’t come to work. She had a 14% absentee rate.”

Gretchen Scott LLC’s clothing and accessories employ vibrant colors and complex patterns, and the words of its mantra — laugh more, gripe less, ignore critics, say yes, order dessert, love life — are sewn into its products.

The company states that it donates all of its sales to charities, such as the Children’s Brain Tumor Project at Weill Cornell Medicine.

Marino-Myers claims she rejected two other job offers to join the company in January 2019 as senior production director at $150,000 a year. She brought 15 years of experience, including contacts with factories and mills in China and India and an under-

standing of how overseas apparel manufacturing works.

She was recently divorced and was raising two young children. Part of the deal, according to the complaint, was “commutetime flexibility,” so she could drop her children off at school and make the 90-minute drive to work.

Marino-Myers claims she excelled at her job but faced a hostile work environment.

Scott allegedly belittled her marital status in front of colleagues, asking, for instance, “What went wrong with your ex-husband,” and probing her financial support.

Marino-Myers says she was forced to model the company’s clothing and then criticized in front of the staff as having “back fat.”

She claims that Scott directed her to use graphic sexual terms with male vendors, for instance, telling one that he did not have “big enough balls,” and another that he was lousy in bed.

In February 2019 her pay was docked for a full day, according to the lawsuit, because schools were closed due to a heavy snowstorm and she worked from home. She was allegedly criticized for arriving at the office after 9 a.m., despite the promise of commute-time flexibility and even though another senior manager was allowed to come and go as he pleased.

In April 2019, the complaint states, she was pressured to return to work after two days off for nasal surgery and recovery. She contracted an infection and had to take off another day.

Days later and less than three months after she was hired, she was fired for missing too much work. Scott allegedly told her that the company “needs someone healthy.”

Marino-Myers claims she was fired because she had complained about the work environment.

She filed a discrimination complaint with the U.S. Equal Employment Opportunity Commission, and this past January the agency issued a Notice of Right to Sue. Marino-Myers accuses the company of retaliation on the basis of sex, by discriminating against her as a divorced woman caring for young children; discrimination on the basis of disability because of health issues; and fraudulent inducement. She charges the company and Scott with discrimination and retaliation under the New York human rights law.

“She’s a disgruntled employee,” Scott said.

“I don’t think we want to settle this in public. We’ll let the courts decide. That makes more sense, especially when the facts are so clear and we have all the records and she’s making up stuff.”

In Court CHAPPAQUA BEHAVIORAL MEDICINE FILES FOR BANKRUPTCY

Chappaqua Behavioral Medicine, where revenues have plummeted to $166,567 this year, from more than $1.1 million in 2018, has petitioned U.S. Bankruptcy Court in White Plains to reorganize the psychiatry practice under Chapter 11.

On the same day, Dr. Aziz A. Soomro, the owner and medical director, filed for personal Chapter 7 liquidation.

The Chappaqua practice, formed in 2008, declared $308,023 in assets and $242,761 in liabilities.

It lists business debts of $288,895, most of which are characterized as disputed loans, from Amex, Dedicated Commercial Recovery, IOU Financial, Lending Club Corp., M&T Bank, Marlin Capital Solutions and Quarter Spot Inc. The same claims are listed on Soomro’s personal bankruptcy petition.

He declared $732,920 in assets and $890,506 in liabilities. His largest debt, $661,432, is to SunTrust Bank for a loan on his house in Pleasantville, valued at $729,000. Consumer debts total $38,164.

His income was $309,892 in 2018, $35,000 last year and zero dollars this year.

Neither bankruptcy case explains the declining finances.

Soomro graduated from Sindh Medical College in Karachi, Pakistan, in 1986. He trained in adult psychiatry at North Shore University Hospital in Manhasset, according to his business’ website, and in child and adolescent psychiatry at Dartmouth Medical School.

He is a clinical instructor at New York Medical College and an attending psychiatrist with Westchester Medical Center.

Soomro is represented by Harrison attorney H. Bruce Bronson.

Feldman, a spokeswoman for the Englewood Cliffs, New Jersey company, responded in an email. “We are confident we will prevail in court.”

E.T. Browne has been in the skin care business for more than 175 years, according to its website. The Palmer’s brand boasts a “What’s Real” motto: “real high-quality, natural ingredients in formulas that really work, for real people at real affordable prices.”

Tummy butter, massage cream and massage lotion formulas include cocoa butter, Vitamin E, collagen, elastin, argan oil and shea butter that purportedly improve skin elasticity and reduce the appearance of stretch marks during and

after pregnancy and weight fluctuation.

But according to the complaint, several studies from 2008 to 2016, of Palmer’s products or of the active ingredients, concluded that they did not prevent or reduce the appearance of stretch marks.

One of the studies included products provided by E.T. Browne, the complaint states, thus the company “was wellaware that its product flunked testing as far back as 2008.”

Booker bought the massage lotion at a CVS store in Yonkers in January for $8.

Nelson paid $7 for the tummy butter last year at a Walgreens in the Bronx.

They claim they used the products

as directed but saw no difference in their stretch marks.

The complaint posits that enough people have bought Palmer’s stretch mark products to amount to a dispute worth more than $5 million in damages.

The women accuse E.T. Browne of deceptive practices, false advertising, unjust enrichment, breach of express warranty and fraud.

E.T. Browne, the complaint states, “continues to sell its ineffective and worthless Palmer’s to unsuspecting consumers.”

WOMEN SUE TUMMY BUTTER MAKER FOR $5M SAYING RESULTS STRETCH THE CLAIMS

Palmer’s Tummy Butter for Stretch Marks, and other cocoa butter products that claim to reduce the telltale signs of pregnancy and obesity, do not work, according to two women.

Chezaree Booker of Yonkers and Qwonjit Nelson of the Bronx filed a $5 million class action lawsuit against the manufacturer, E.T. Browne Drug Co. on April 21 in U.S. District Court in White Plains.

“Unfortunately for consumers,” the complaint states, “the products are a sham. Scientific evidence shows the products do not prevent or reduce the appearance of stretch marks. The products are ineffective for their stated purpose.”

lthough the residential real estate market is predicted to take a dive this year in the midst of the COVID-19 pandemic, business is actually picking up for home improvement contractors, according to Andrew Prchal, co-owner of Greenwich’s Gunner Roofing.

“Fortunately, more and more people are looking to do work to their houses,” Prchal said. “I think with so many people staying at home and working from home, they’re looking around and saying, ‘Maybe it’s time for new siding’ or ‘I never really liked that window.’ After all this ends, they’re starting to wonder if they still want the same old house or if they see a new vision.”

Nonetheless, Prchal, who co-owns Gunner with his brother Eddie, said that supply chain disruptions — thanks to the variance of shutdown orders state-by-state — are definitely having an effect.

“We’ve seen a roughly 8% increase in supplies like nails and screws,” he said. “Every single year, the prices go up, but this is on the higher end. It’s definitely interesting to see how the supply companies are navigating this.”

A recent conversation with one of Gunner’s distributors held a surprise, Prchal said. “They said they were trying not to accept orders,” he marveled. “Instead they’re moving supplies from warehouse to warehouse to keep up with demand on a local basis.

“It’s pretty crazy,” he added. “It’s got to be a logistics nightmare.”

While before the pandemic, special orders could take three to four weeks to arrive, “Now we don’t even get a date,” Prchal said.

It is for that reason that Gunner is encouraging both existing customers and prospects to start planning now.

“We have two crews, and we offer ‘no contact’ visits,” he said. “Everything can be done virtually ahead of the actual work — we

can put up a model showing new siding or a new roof and show them what it will look like.

“And we’re strongly suggesting they move as quickly as possible,” he continued. “You want things completed before winter rolls in.”

Jobs that once took one to two weeks can now take four or longer, Prchal said.

“Finding and receiving the materials, especially if a special order is required, is all dependent on your being one of the supply drops,” he said. “People have been pretty understanding about that, but it can also be difficult trying to fit everyone in.”

It’s been a learning curve for the Prchals, who relocated from Arizona to Greenwich to establish Gunner about three years ago.

“We’d been working in construction for several years,” he said. “Then we came to New Jersey to partner with a solar company, working to get roof replacements in place before the houses got solared, and then the business began to shift towards New York and Connecticut.”

The fact that “We’ve always gotten along” has helped, he said. “That made it easier to do this together. And we can be as tough on each other as possible — there’s no sugarcoating things.”

Gunner also operates a sales office in Parsippany, New Jersey, Prchal said.

“New Jersey and New York are tough right now, because they have tight restrictions on construction,” he said. “Once they open back up, it’s going to be hard to find someone to get something done if you’re not already looking for materials now.”

The situation in Connecticut has been less difficult, he said, “besides things being a little slower. There are not very many people in a town hall now, so what used to be a quick phone call can now be 10, 15, 20 emails.”

Gunner has not had to lay anyone off, Prchal added.

“We’ve been lucky. And we’re here to help whenever someone needs it,” he said.

“As things start coming back, we’re confident that everyone will be taken care of. We’re not stopping anytime soon.”

The Next Big Thing?: Soil Connect solves a dirty construction problem

liff Fetner never intended to become a high-tech entrepreneur when he created his startup company Soil Connect. The company came about only because he had a problem that no one else could fix.

“I’m a third-generation builder and developer,” Fetner said. “And Soil Connect was formed because of a problem I had in one of my job sites. I’m based out of Long Island and I got a permit to dig a foundation and build a house for a couple in the middle of winter.”

But Fetner’s work came to a halt because he was stuck with the soil dug up from the foundation.

“And, so, the excavation guy says to me, and I quote, ‘Cliff, it’s the middle of winter, nobody needs it, nobody wants it,’” he continued. “And quite frankly, I didn’t know what to do with it. And it was kind of right there in that very second that I thought, ‘There has to be a better way of moving material.’ And Soil Connect was born right there and then.”

Soil Connect is a platform that unites excavators, contractors, builders, landscapers and other construction industry professionals who work with soil on a regular basis. The platform’s concept is relatively simple: by using a matching technology, it connects those who have soil with those who need soil.

But if Soil Connect is such a simple idea, why wasn’t this done before? Fetner noted that the operational process used in his father’s construction company has been the industry protocol for too many years.

“I have memories of my father at nighttime calling around to his builder buddies and developers asking who needs material, when they need it, how much, who’s moving and how much it’s going to cost,” he recalled.

“And so here it is, 30 years later, and nothing has really changed. That’s kind of how they continue to do business. They have their little circle of friends, their little network and that’s how they move material. Well, maybe it’s not entirely true — what has changed in 30 years is now we have cellphones. Thirty years ago, we didn’t have cellphones — we had to do it at night, but nowadays the guys have the luxury of doing it during the day.”

Fetner soft-launched Soil Connect in May 2018 and tapped into a market that was eager for this type of solution.

“Apparently, we did something right,” he said. “Within six to eight months, we had a couple of thousand users and we had posted over 20 million yards in material.”

Fetner estimated that Soil Connect’s biggest category of users are the excavation and drainage contractors, followed by builders, developers and general contractors.

“Then after that, it’s pretty evenly split between landscapers and pool guys and asphalt guys and concrete guys,” he said. “We

also have a couple of quarries now on our platform. We also have what I like to call recycling centers on our platform — they bring what we call mixed material, maybe it has some dirt in it and concrete or brick, and they sift it and sort it in screen and then they resell it. So, we have a whole bunch of those types of uses as well.”

Fetner added that he was “bootstrapping this thing together” during the early stretch, but assistance came from his son — who did not follow him into construction, but instead found a career in venture capital.

“We went into the VC world and we raised some money,” he continued. “And we took the majority of that money and then we created version two, which was released in November 2019.”

Fetner has promoted his platform via social media, email marketing and the 811 directory, also known as the national call-before-you-dig phone number that enables construction professionals to access local utility location services.

As of today, Soil Connect has more than 4,000 users on its platform and has posted more than 82 million yards of materials. The platform is available at no cost on a national level and has received several postings from the Toronto area.

“Right now, we’re free,” Fetner said. “We’re trying to get as many users on the platform as humanly possible. And then at a point in time, we will turn on several different monetization schedules. So, there’s no downside to try and use right now.”

The good news is that our banking system is more solvent and more resilient than in 2008. Additionally, aggressive containment measures, coupled with powerful monetary and fiscal stimulus, will help to mitigate the economic and market impact of this biologic crisis.

Fear is palpable and sticking to long-held investment plans is difficult for many during these uncertain times. We’ll get through this, though, and removing emotion by concentrating on fundamental analysis is a good way to approach things.

There will come a day when we will see a reduction in new COVID-19 cases, consumer confidence will rise, jobless claims will diminish, market selling will bottom, restaurants will reopen and economic indicators will recover. At that point, the market will turn aggressively positive.

Market recovery predictions have been similar in nature to alphabet soup. Will the trajectory be V-, U-, L- or W-shaped?

Recessionary recoveries have historically been W-shaped, bouncing from the bottom, retesting lows and finally ascending over the longer-term. Markets dislike uncertainty, but foundations for establishing a bottom have been constructed.

Average peak-to-trough market drops in a recession are -35%, a number the S&P 500 Index reached on March 23. Since then, monetary stimulus, fiscal relief and improved economic and virus data have emerged, measures the market clearly likes. If, however,

events do not play out as expected, additional downward momentum is likely.

After a decade of unprecedented growth, a trigger was the only thing missing for a major market pullback. The COVID-19 crisis has been the primary cause, and the oil crisis has certainly been a secondary factor, responsible for much of the early crisis credit market issues. Low interest rates have enabled weak businesses to continue leveraging operations and much of the recent sell-off has been forced deleveraging by businesses affected by a halting economy.

Owning the second- and third-best companies in an industry will probably not be the optimal strategy for managing through this downturn.

Public housing authorities across the region are receiving a new wave of funding from the U.S. Department of Housing and Urban Development to finance their COVID-19 relief endeavors.

The funding, which totals $685 million for a nationwide allocation, is a second wave of federal assistance and is tied to the CARES Act provision to help the housing authorities prepare and execute COVID-19 prevention and mitigation strategies.

The funds can also be used to cover the salaries of housing authority staff unable to work because of current public health restrictions and to cover the expenses of caring for staff and residents who have tested positive but do not require immediate hospitalization.

Fly-through real estate presentations take off during pandemic

W

hile social distancing and business shutdowns designed to combat the spread of COVID-19 brought a lot of economic activity to a screeching halt, some businesses have been able to somewhat adapt by relying more heavily on technological tools to take the place of in-person contacts. Case in point is the luxury housing development in Rye, St. Regis The Residences, that had to close its on-site sales office.

When ground was broken for the project in May 2018, the cost was estimated at $100 million. While the financial effect the pandemic is having on construction and sales is yet to be determined, the virus has not forced a shutdown of the project’s sales effort.

The project is to include 95 one-bedroom to four-bedroom condominiums in five buildings situated on seven acres with underground parking. It will feature 25,000 square feet of amenities ranging from a fitness center, pool, movie screening room and pet spa to two St. Regis Hotel rooms for use by guests of residents.

At least one person living in each unit at St. Regis The Residences will have to be 55 years old, and none can be under 18. The Business Journal had initially been given typical unit

prices of a one-bedroom at $1.03 million, a two-bedroom, two-and-ahalf-bath unit with 1,602 square feet at $1.7 million and a four-bedroom, three-and-a-half-bath condo with 2,775 square feet at $3.7 million.

Susie Joyce, director of sales at the project for developer Alfred Weissman Real Estate along with Angela Ferrara, executive vice president of sales and leasing of The Marketing Directors, which has been involved with the sales effort, explained that computer software has suddenly assumed new importance for them.

“We were very lucky because pre-COVID we used this as our main pre-selling tool and now that we are here where we are it becomes even more important,” Ferrara said. “We can use this technology from home.”

At the core of the technology is Aeon Virtual software that has been customized to allow prospects watching on their own devices at home to be taken on a fly-over virtual tour of the project. The salesperson originating the presentation at a remote location, such as their home, can take the prospects soaring through the property as well as giving them a virtual view looking out the windows of whatever unit they’d like to visit.

and the project’s various amenities.

“It’s been up and running since we opened the sales effort last April, so about a year,” Ferrara said. “We adapted both this as well as our other tools into a virtual presentation. We did videography, a movie in essence, starring Susie Joyce, and that is something we can send out to people and because of our 55-plus demographic sometimes the video is just something you can play; it will just click and play.”

She said that the virtual material can be personalized for each prospect and thus help them absorb a lot of detail about the options being offered.

“It gives you an overview of the lifestyle and the branding,” Ferrara said. “This is where we home in on the actual sale.” She said that The Marketing Directors’ Project Manager Denham Apperley is in the process of building out some dimensional floor plans that will have furniture.

“Because we have such good tools and we were so used to using them in the sales gallery, once we brought them home it really wasn’t that hard to transition,” Joyce said.

“It took a little bit of time but we feel like if we send some of the video to prospects it gives them a quick walkthrough and then if we really want to get into the nuts and bolts of it that’s when we come to the Aeon.”

in the sales gallery,” Joyce said. “We really don’t have them here but we bring them as close to everything as we can.”

“This itself takes months to build out,” Ferrara said. “We would never have been in a position to have done this if we were just being alarmed now — ‘You’ve got to pack up and leave in the next week or two.’ This would have never been possible to create. It takes months and it costs tens of thousands of dollars so it’s a big investment that we made up front and we’re so happy that we did for obvious reasons.”

The cost for the fly-over and virtual view software was in excess of $75,000.

Joyce said that prospects have accepted the idea of remote presentations.

“We’ve even had revisits, where someone’s been in already and I’ll take them through the fly-over and sort of remind them and all of that so they’re probably a little closer to moving forward,” Joyce said.

She described a couple who received a presentation, selected a home that they want and plan to take another online tour.

“We’re going to go through, show them exactly where it is. I’ll fly them through and we’ll revisit the whole thing because that first visit can be a bit overwhelming,” Joyce said. “There are some who will say, ‘I’m coming up from Florida. I’ll be

there in a few weeks.’”

Ferrara said that The Marketing Directors has been using technology in its various forms for a long time and she expects it to become more and more pervasive in real estate sales. She pointed out that the system in use for St. Regis The Residences is not intended to be a self-guided tour and must be operated by a salesperson.

“If somebody were to come in and try to use this system they would not be able to. It is not a self-guided tour by any means,” Ferrara said, “Susie is trained on how to use it.

It is very sensitive to the touch and I’ve used it a few times. Once you get it, you get it, but it is not meant at all to be self-guided. It will always be a salesperson leading through the presentation,” she said, whether that’s remotely as now or in-person once there’s been a recovery from the COVID-19 outbreak.

“I will tell you, though, there’s no substitute for an in-person presentation, period. You know, Susie jumps off the page at you potentially here but so much more in person and you connect more from a consultative and a trust perspective,” Ferrara said.

“The minute we can go back to one-on-one in-person presentations we will. But we will keep this as a tool until the time that we are physically in the building, which is not for a couple of months.”

the need for this kind of approach, especially for those who didn’t have caregivers all day helping them out,” said Nick D’Aquila, the firm’s chief information officer. “We wanted, and still want, to get them the help they need, including medications and providing the ability for other family members to check in with them, while still allowing them to continue living independently.”

Defined by the federal Centers for Disease Control and Prevention as “The ability to live in one’s own home and community safely, independently and comfortably, regardless of age, income, or ability level,” the trend toward aging in place has been growing. According to a Kaiser Health News report, some 47 million Americans are aging in place, compared with 1.4 million seniors in nursing homes and 812,000 in assisted living facilities.

Those ratios seem unlikely to change in the near future, and not just because of pandemics. (Last week, Connecticut Department of Public Health Commissioner Renee Coleman-Mitchell said that 57 of the state’s 215 nursing homes have reported virus-related infections among their populations. Besides separating COVID-19 positive persons from the rest of the residents, the state is looking into possible relocation sites for those who have tested positive.)

An AARP survey found 76% of Americans age 50 and older saying they preferred to remain in their current residence, and 77% saying they hoped to live in their community as long as possible. In addition, 59% said they thought they would be able to stay in their community, either in their current home (46%) or a different home still within their community (13%).

Assisted Living Technologies — based in Cheshire, with an office in Fairfield — is the first company of its kind in Connecticut to provide high-tech products designed to protect at-home seniors through a variety of approaches, D’Aquila said.

Its offerings include a telehealth tablet that seniors use to monitor such vital signs as blood pressure, weight and blood oxygen saturation levels, which are then transmitted to a physician and/or family members via Bluetooth.

D’Aquila noted that the product only began to be offered about a month ago — timing he said was particularly fortuitous.

Other products include: Wellness Remote Monitoring System, which tracks a senior’s activities through wireless sensors that can be placed on beds, chairs, wheelchairs, etc. and throughout the home on doors, windows and in bathrooms without drilling. A private web dashboard allows caregivers to stay in touch, set reminders and track wellness.

Medication management: Electronic, pre-filled dispensers alert seniors when to take meds, automatically opens correct compartment and alerts caregiver if a dose is missed; a second model includes a lock feature to prevent unauthorized or erroneous opening.

Fire prevention: Sensors automatically turn off a stove if an unattended pot is left cooking or smoke is detected, and can perform similar functions with microwave ovens.

Fall prevention: The wall-mounted Walabot HOME — about the size of an iPad, D’Aquila said — continuously monitors for a fall using radio frequency sensors without pushing a button or wearing a device.

Emergency Response: Solo and Smart Watch are alternative emergency response systems that don’t require a pendant. The cellular systems work without a landline and are intended for use outside of the home.

“We have virtual tours and video chat on our website as well, for people thinking about our products but are hesitant to come visit us in the current situation,” D’Aquila said. “Our whole approach is about inspiring safety.”

Hackers secret weapon: The psychological attack

o you suffer from the Hollywood Syndrome? No, I’m not referring to your obsession with stardom, or even the postmortem feelings of having already lived your 15 minutes of fame.

Hollywood Syndrome sufferers get their “knowledge” of how the world works from watching movies or TV shows. Most IT experts agree that the Hollywood version of how hackers operate is a bit off the mark from reality.

Despite what you see on TV, the stereotypical hacker is not wearing a hoodie in an isolated dark room, tapping away at his keyboard at a fever pitch. He is much more calm, ordinary and boring than you think — and this is what makes him far more dangerous than a James Bond villain. Of the many tools and techniques employed by hackers, the most dangerous weapon he leverages is the psychological attack.

Hackers prey first and foremost on four fundamental human mental weaknesses: 1. Gullibility. We each have personal biases, likes, dislikes, causes we support and causes we’re against. Hackers prey on these preferences because anything written about them is almost credible and believable from the start. They know you already want to believe, and so you will.

2. Ignorance. The dictionary defines ignorance as the lack of knowledge or information. Let’s face it, unless your name is Ken Jennings, all of us are ignorant about something. Hackers attempt to exploit those that possess just enough information to be dangerous to themselves or those that will act even though they don’t have enough information.

3. Fear. Fear is a powerful motivator.

Those with fear can be easily manipulated into action. This typically stems from the spread of misinformation or the exploitation of our ignorance or gullibility (see above). It’s an effective one-two punch.

4. Mental Fatigue. With current stress levels of COVID-19, many people are either overworked or overly worried. This fatigue can erode our ability to think clearly and discern when something or someone is attempting to prey on our gullibility, ignorance or fear.

Put yourself now in a hypothetical — yet alarmingly familiar — situation for a moment.

• Maybe your business has received more bad news this week about sales.

• Perhaps you’re on your 6th week in a row of clocking 70-plus hours.

• Maybe you just received your PPP funds and still trying to process the surrealness.

• Perhaps you just read one too many political articles today and are in a complete frenzy.

Then here it comes: the sneak attack. A hacker just dropped an email in your inbox with a headline grabbing statement that could look anything like this: • Your PPP funds are awaiting verification — respond before they expire.

• President orders IRS to force taxpayers to sign exemption waiver by today or be fined.

• Transfer $300K to this account now.

• Someone signed into your bank account — click here to change PIN asap!

While you may intellectualize all the

just mildly hints at a sense of urgency — or conveys an immediacy to “act now or else” — then STOP and VERIFY. Use healthy skepticism. Understand your gaps in knowledge. Don’t react based on fear. Never make decisions under duress. Above all else, be self-aware at all times.

LMMM TO PARTICIPATE IN COLLECTIONS PRESERVATION ASSESSMENT PROGRAM The Lockwood-Mathews Mansion Museum in Norwalk is one of 75 institutions in the United States selected to participate in the Collections Assessment for Preservation (CAP) program, which helps museums improve the care of their collections by providing support for a general conservation assessment of the museum’s collections and buildings. The museum will work with a team of preservation professionals to identify preventive conservation priorities. The final assessment report will help the museum prioritize its collections care efforts in the coming years.

LMMM Chairman of the Board of Trustees Patsy Brescia said, “ I am very pleased that we have received this CAP grant as it will be very helpful with the planning and implementation of the upcoming mechanical improvement project scheduled over the next few years.”

ENTERGY GIVES $50,000 TO NONPROFITS Entergy’s Indian Point Energy Center in Buchanan granted a total of $50,000 to four local nonprofits in direct support of Covid-19 relief efforts.

“The pandemic has hit some of the most vulnerable in this region the hardest,” said Indian Point’s site top official and Vice President Tony Vitale.

“We are pleased to be able to assist some of the organizations, which play a critical role helping those most affected during this crisis.”

In addition to the four grant awards, Entergy’s shareholders agreed to match employees’ contributions to United Way relief efforts dollar for dollar up to $100,000.

“For many people in Westchester, the crisis has left them food insecure.

That’s not something we can fix with a vaccine and we won’t need a test to know that it’s there,” said Matt Honeycutt, vice president of development for Feeding Westchester.

LAND TRUST ACQUIRES GILBERTIE’S FARM Aspetuck Land Trust recently announced the acquisition of Gilbertie’s Farm, a picturesque 34-acre working organic farm adjacent to the land trust’s Randall’s Farm Preserve on Sport Hill Road in Easton. Gilbertie’s Farm will anchor Aspetuck Land Trust’s (ALT) larger vision to create a multitown Green Corridor involving a 40,000acre belt of land in Easton, Weston, Redding, Wilton, Westport and Fairfield.

Gilbertie’s Farm is the largest certified organic greenhouse operation in the Northeast and a staple in the Fairfield County food system for many decades. The land trust intends to keep this property as a working farm in perpetuity and is exploring ways the farm can be more accessible to the community.

In a closing on April 24, ALT was able to acquire the farm for $2 million from its owner, Dan Levinson of Westport, and his partners. In 2013, Levinson organized a group to purchase the farm when its bank threatened foreclosure and development.

Levinson has given the land trust a mortgage on the farm and made a generous financial gift that reduced the purchase price significantly. In addition, thanks to donations by land trust members, Aspetuck Land Trust was able to contribute significant funds to complete the transaction.

“Our intent from the outset was to support Sal Gilbertie and save his farm from development and we are thrilled to now put it in ALT’s hands for the long term. We strongly

support ALT’S vision of the farm as a transformational open space centerpiece for their Green Corridor Initiative,” Levinson added.

Sal Gilbertie will continue to farm the land and will lease the property from ALT. “There is still much to do,” said David Brant, executive director of the land trust.

happy to share this positive news. Our mission is protecting open space. Land doesn’t save itself. Saving a working farm today will have benefits for many generations to come.”

The law firm of Cohen and Wolf provided pro bono support advising ALT and creating necessary legal documents.

Clearview Capital Fund III LP announced the acquisition of IHP-Med-Psych-Solutions Inc., d.b.a.

Restorative Health and Recovery (“RHR”), by its portfolio company, Community Medical Services (CMS). The transaction closed April 13.

CMS is a leading provider of medication-assisted treatment programs for patients suffering from opioid use disorder (OUD), operating 40 treatment facilities in nine states. Excluding RHR, all CMS locations are licensed as opioid treatment programs (OTP), which provide individual and group counseling and peer-support programs concurrent with regularly scheduled dispensing of FDA-approved medications to aid in the recovery journey.

COOKING UP A BOOK TO HELP Susanna Sussman of Meals-on-Wheels, White Plains; Johnny Livanos of Moderne Barn and City Limits; joined Jessica Rosen Klein to create “Westchester Cooks,” an online cookbook filled with recipes from chefs, restaurateurs, writers and area-cookbook authors. All proceeds (a suggested donation of $10) will be donated to Lifting Up Westchester, an organization that provides food, shelter and support to county residents in need.

After watching so many restaurants start funds for their employees and/or donate food to health care workers, the team of three wanted to do something a little different to help during this nightmare pandemic. Their efforts culminated in the online cookbook, which was created by Honest Creative, free of charge.

Chefs from all over Westchester, including X20 in Yonkers, Sonora in Portchester, The Cookery in Dobbs Ferry, Maria’s in New Rochelle, Sam’s of Gedney Way in White Plains, Moderne Barn in Armonk, Lulu’s in Scarsdale, and more contributed recipes for the cookbook.

Sponsored by Traditional Building Conference, the award celebrates techniques developed through 2,500 years of Western architectural tradition, with a focus on design elements that enhance the beauty and humane qualities of the structures.

David Scott Parker, lead designer of the campus, which was completed in fall 2018, said: “Our entry featured the restoration of a remodeled structure to its historic Italianate appearance; the addition and integration of new state-of-the-art galleries and archives, and the re-establishment of the integrity of the exterior green space. The project doubled the size of the historic institutional complex and was completed on budget and one year ahead of schedule.”

WALKWAY LIGHTS UP FOR FRONTLINE WORKERS

The Peekskill Industrial Development Agency (PIDA) has announced the election of Deborah Post as chairperson. Post joined the organization in 2010 and previously served as secretary and vice chairperson of the board.

Post’s career has spanned the nonprofit, public and private sectors for more than 30 years. Since 2009, she has been director of housing development and finance for Community Housing Innovations Inc., a nonprofit housing agency that operates in Westchester County and the surrounding region.

A 24-year Peekskill resident, Post was employed by the city of Peekskill in the 1990s as director of economic development and deputy director of planning as well as the assistant director of the PIDA. She graduated from the Yale School of Management and holds a Bachelor of Science degree in economics from the University of Pennsylvania’s Wharton School of Business.

The PIDA, a corporate governmental agency constituting a public benefit corporation, was created to assist the city of Peekskill in financing projects within the city limits that would enhance the social and economic fabric of the community.

HILLTOP HANOVER FARM HELPING TO MEET DEMAND FOR FOOD Spring harvest is underway for Westchester County farmers at Hilltop Hanover Farm and Environmental Center in Yorktown Heights while taking extra precautions to prevent the spread of Covid-19.

This season, the farm has introduced an online ordering and curbside pick-up service. Customers can place orders Tuesdays through Thursdays while supplies las, and pick up during regular farm-stand hours on Fridays and Saturdays. Customers will see designated curbside pick-up parking spots and stay in their cars while an employee retrieves their packed produce.

On Tuesday, April 21, Hilltop sold out of produce within two hours of launching the service.

Hilltop Hanover Farm and Environmental Center Director Shanyn Siegel said, “Despite uncertainty, we are working hard to grow fresh, nutritious produce for you, your families and over 20 community partners. Million Air at Westchester County Airport has been recognized as the “Most Improved” Fixed-Based Operation in North America, according to a survey by Aviation International News.

The survey, conducted by the major trade publication covering the aviation industry, also placed Million Air Westchester in the top 20 % of fixed-based operators worldwide, coming in number 45 out of 4,500 operators reviewed.

“This is fantastic news for Million Air Westchester and yet more proof that we are among the best when it comes to customer service,’’ said Million Air CEO Roger Woolsey. “Congratulations on this well-de-

Woolsey noted that Million Air has made an enormous investment at Westchester with both a new hangar

and high-amenity passenger services terminal. “These state-of-the-art facilities are not only making a tremendous difference for our clients and passengers but set a new standard for the airport,” he said. “We are demonstrating that facilities at Westchester Airport can be significantly upgraded while reducing the impacts on the surrounding community. The new passenger terminal and hangar are part of an $80 million investment by Million Air at the airport.

With the struggle to obtain personal protective equipment (PPE) for the frontline, essential workers in New York, private aviation aircraft have become essential in moving supplies fast. Local company, Million Air Westchester, helped by donating 8,000 3-ply surgical respiratory masks and 1,100 KN95 protective face masks to White Plains Hospital, using its aircraft to get them there quickly.

“Private jets and the aviation industry as a whole are the most underrealized

disaster relief tools,” said Roger Woolsey, CEO of Million Air. “The aviation community has played a crucial role in transporting desperately needed medical supplies to communities hard-hit by the coronavirus….”

The aircraft Million Air used to transport the masks are in the life-saving business. On a daily basis, the company flies about 10 organ procurement missions, moving doctors and organs when timing is critical.

“The outpouring of support that we have received from our community has been incredible,” said Dawn French, senior vice president, community relations and marketing at White Plains Hospital.

“Personal Protective Equipment (PPE) is so important for keeping our staff safe during this pandemic. For an organization like Million Air to think of us and to go above and beyond to help protect our frontline workers, is moving. We truly are all in this together.”

Mid-Hudson Valley nonprofit organizations are reeling financially because of the COVID-19 economic shutdown. For many, this has driven up the need for services while simultaneously causing a dramatic drop in revenue due to plummeting donations, fees for services and canceled fundraising activities. For others, it has meant a temporary halt to income-generating programs and activities.

According to a recent survey of 215 nonprofits conducted by the Center for Effective Philanthropy, more than half of the nonprofits surveyed throughout Columbia, Dutchess, Greene, Orange, Putnam, Sullivan and Ulster counties described their financial circumstances as so difficult they may have to make significant changes — from laying off staff to ceasing operations — within four months or less.

WLS LAUNCHES VIRTUAL AND ONLINE PROGRAMMING Westchester Library System (WLS) has initiated a “Virtual Library Events in Westchester” program featuring a complete resource of online programs created by member libraries across Westchester County in response to the COVID-19 crisis.

“Like all community institutions, local libraries were forced to close their physical locations to keep everyone safe during this time of social distancing,” said Terry Kirchner, WLS executive director. “It required that our members quickly adapt in order to engage residents — and they did so in fun and tech-forward ways.”

The combined calendar located at burbio.westchesterlibraries.org features dozens of events a week hosted across WLS member libraries and highlights a variety of activities, some in various languages.

The aggregated calendar was created in partnership with Burbio, a Pelham-based digital media platform that pulls in local community calendar events and dynamically keeps them up to date for broadcasters and digital media partners nationwide. “As shutdown orders forced residents indoors, we could see how quickly the library community pivoted to a different way of serving residents,” said Burbio co-founder Julie Roche.
