Rodriguez takes reins in La Salle, pledges modernization By Marc Robertson
La Salle County Sheriff Miguel Rodriguez took the oath of office at a crowded ceremony in the Welhausen Auditorium on Monday morning, October 1, moments after being approved for the position by the commissioners' court and a resignation announcement by former officeholder Victor Villarreal. Rodriguez prevailed in the Democratic Party primary elections earlier this year for the nomination to the ballot in the upcoming general election and faces no opposition on November 6, making him the presumptive sheriff-elect. Former Sheriff Villarreal, who did not seek re-election after six years on the job, announced last month that he would hand the job to his successor during the transition period and before the new four-year term in office begins on January 1. Rodriguez becomes the fourth of seven sheriffs in thirty years to be named to the job outside an elected term, a list

Dilley Police Chief: “Starting from the ground up” By Marc Robertson
Hired last week to begin serving full-time as the new police chief for Dilley, Albert DeLeon comes to a department gutted by officer resignations and facing a grim position in public relations but expects his hand-picked crew to reinvigorate law enforcement and revive the people's faith in the service.
DeLeon is a native of Pearsall, graduating from high school there in 1986 and continuing his studies at Sul Ross State University, where he focused on business management. He went on to attend the Alamo Area Council of Governments (AACOG) Police Academy, graduating in 2004 and earning TCLEOSE certification as a peace officer. He began his law enforcement career with Frio County as a sheriff's

TDI to council: Every family can have a free phone By Marc Robertson
In a presentation to Dilley city authorities last week, a representative of the TDI company announced that every family in the community is entitled to a free cell phone with up to 250 minutes of talk time per month, regardless of income or status.
The announcement was made to city councilors Monday, September 24 by Felipe Hernandez, who said the program of distributing free telephones to families in rural communities is aimed at providing everyone with a means of emergency communications as well as "developing the need" for improved telephone
service in South Texas. According to Hernandez, the telephones currently being offered free of charge to any family that files a simple application are donated units. He added that the offer is not being made as a sales pitch for other services, that the telephones do not

When have you tested your water well?
By Jaime Lopez Frio County AgriLife Extension Agent rivate water wells should be tested annually. The Texas Well Owner Network, with support by the Frio and La Salle County offices, the Texas A&M AgriLife Extension Service, the Texas Water Resources Institute and the Texas State Soil and Water Conservation Board, is providing a water well screening day for area residents on November 2, 2012 at the Frio County AgriLife Extension Office, 400 S Pecan Street, Pearsall. Samples must be turned in by 5 p.m. on or before November 1, 2012. Samples from private water wells will be screened for common contaminants including fecal coliform bacteria, nitrates, and high salinity. The cost is $10 per sample. The presence of fecal

coliform bacteria in water indicates that waste from humans or warmblooded animals may have contaminated the water. Water contaminated with fecal coliform bacteria is more likely to also have pathogens present that can cause diarrhea, cramps, nausea or other symptoms. Water with nitrates at levels of 10 parts per million (ppm) is considered unsafe for human consumption. Nitrate levels above 10 ppm can disrupt the blood’s ability to carry oxygen throughout the body, resulting in a condition called methemoglobinemia. Infants less than six months of age and young livestock are most susceptible. Salinity as measured by Total Dissolved Solids (TDS) will also be determined for each sample. Water with high TDS levels may leave deposits and have a salty
taste. Additionally, using water with high TDS for irrigation may damage the soil or plants. Pick up a sample bag and sampling instructions from the Frio or La Salle County AgriLife Extension Office. It is very important that only sampling bags from the Frio or La Salle County Extension Office be used and all instructions for proper sampling followed to ensure accurate results. Appeals court upholds Texas open meetings law
By Ed Sterling case brought by a group of 15 city officials naming the State of Texas and Attorney General Greg Abbott as defendants failed before the New Orleans-based U.S. 5th Circuit Court of Appeals on Sept. 25. In Asgeirsson et al. v. Abbott, plaintiffs sought to have the court declare the Texas open meetings law “unconstitutionally vague” and “overbroad” primarily because of criminal provisions local governmental officials face if accused of knowingly circumventing the law. A violation is a misdemeanor punishable by a fine of $100 to $500, confinement in jail for one to six months, or both. Plaintiffs’ central argument was that the criminal portion of the law abridges their right to free speech under the First Amendment. However, in a unanimous decision by a three-judge panel, the 5th Circuit affirmed a lower court ruling that the law is constitutionally sound. After the court released its decision on Sept. 25, Abbott said the outcome “… is a great victory for democracy and the First Amendment. The

decision further guarantees the public will continue to have access to information about how their government works. Making meetings accessible and allowing the public to see how decisions are made are the foundation of open government. A healthy democracy requires that the public have access to how government operates.” In 2006, again in 20092010 and currently in 2011-2012, sets of more than a dozen city officials from many regions of Texas unsuccessfully brought the same general case and arguments before a federal district court and the 5th Circuit. Originally adopted by the Texas Legislature in 1967, the open meetings law is intended to discourage public officials from meeting in non-public settings to deliberate on public business. According to the Reporters Committee for Freedom of the Press, invalidating the law potentially would allow government corruption to escape public scrutiny. Disclosure: Texas Press Association participated in a friend-of-the-court brief in support of the state’s position in Asgeirsson v. Abbott. Push is on for spending limits Gov. Rick Perry, Lt. Gov. David Dewhurst and other Republicans last week called a stricter constitutional spending limit for the state budget ahead of the
upcoming legislative session. In calling for a spending limiting amendment to the state constitution, Perry said, “Government growth, if any, should be kept to the bare minimum and should be limited … to the rate of our population growth combined with the rate of inflation.” Dewhurst said Texas is “the national model when it comes to keeping state spending to a minimum,” adding, “We take pride in the fact that Texas ranks 47th out of 50th per capita in state spending.” Perry called on lawmakers to commit to the five principals of his Texas Budget Compact: - Practice “Truth in Budgeting”; - Support a constitutional limit of spending to the growth of population and inflation; - Oppose any new taxes or tax increases and make the small business tax exemption permanent; - Preserve a strong Rainy Day Fund; and - Cut unnecessary and duplicative government programs and agencies. In explaining Truth in Budgeting, Perry said, “We owe it to Texans to create a budget process that’s more honest and transparent by making the tough decisions Texans make every day and presenting a truly balanced budget free of IOUs and accounting maneuvers.”

An educational ranch tour will be held at the Baylor Ranch, 21 miles east of Cotulla on FM 624 in La Salle County, from 8:30 a.m. until noon, Thursday, October 4. The tour is hosted by Phil Lyne, operator of the ranch for over 25 years with success in improving wildlife habitat and overall range health with the use of herbicides. Wildlife enthusiasts, cattlemen and all those interested in the ranch operation are welcome to hear presentations. Topics will include "Considerations When Planning any Brush Management Program," "Special Considerations When Planning a Chemical Brush Management Program," "Wildlife Habitat Evaluation and Plant Identification in South Texas," "Where the First Raindrop Falls," "Livestock Grazing" and "Wildlife Do’s and Don’ts." La Salle Health Fair, 5K Walk The La Salle County Coordinated Health Fair will be held on the Cotulla High School campus on Saturday, October 20, beginning at 8:30 a.m. with a 5K walk (or run) for all ages at the Myers Memorial Stadium track (register from 7:30 a.m. onwards), and continuing from 10 a.m. to 2 p.m. with displays, educational programs, informational events, demonstrations, screenings and other special features at the Betty Avant Cafetorium. Care packages to the military The Frio County 4-H Council recently held a contest between the four clubs to come up with an idea for the “One Day” 4-H project, and chose the Claybusters' idea of sending care packages to local military personnel serving overseas. the Council is asking community members to help by contributing playing cards, energy bars, gum, holiday decorations, personal hygiene items, baby wipes, recent magazines and newspapers, pre-paid phone cards, single-use cameras and thank-you cards to the men and women of the US military. Donations must be dropped off at the Frio County Extension Office at 400 South Pecan Street in Pearsall Texas by 10 a.m. Saturday, October 13, when the youths will pack the boxes to ship overseas.

Best Hamburger Contest The city of Pearsall will host a Best Hamburger in the City contest that will run through October or until all restaurants have submitted a burger. The event began on Tuesday, September 18 at noon at Brush Country Steakhouse. The event will be held every Tuesday and Thursday. La Salle pecan sale The Soil & Water Conservation District in Cotulla is holding a fundraising pecan and peanut sale, offering one-pound bags of pecan halves at $10 per bag; pecan pieces at $9.75; and peanuts and walnut halves and pieces suitable for baking. DAAS concert, Oct. 13 The Sentimental Journey orchestra will open the new Devine Area Artists' Series season of concerts at 7 p.m. Saturday, October 13 in the George Woods Community Center in downtown Devine with the sounds of the Big Band era, music from World War II, the Andrews Sisters, Glenn Miller, Count Basie, Duke Ellington and the Dorseys. CattleWomen at the races The South Texas CattleWomen will host their annual fundraising "Day at the Races" at Retama Park in San Antonio on Saturday, October 13. The former Department of Public Safety corporal, who served the Highway Patrol in La Salle County for the majority of his career, has served as the attendance officer for Cotulla schools for the past two years and was one of only two candidates for the sheriff's job in the Democratic Party primaries this year. At Monday's ceremony, Sheriff Rodriguez took the oath administered by his wife, Precinct 1 Justice of the Peace Vicki Rodriguez, and welcomed a number of visiting officers and law enforcement personnel, including deputies, troopers and administrators from departments in neighboring counties as well as Texas Rangers and retired La Salle officers. Among those attending the ceremony were former La Salle Sheriffs Jose T. Garcia (1983-84), Darwin Avant (1984-2000), Rene Benavidez (2000-04) and Victor Villarreal (2006-12). Not present were Jerry Patterson (2000-04) and Robbie Thomas (2004-06). "We are going to upgrade and modernize the sheriff's office," Sheriff Rodriguez said Monday. "We are going to focus on reducing crime and increasing [narcotics] seizures. We are working for the benefit of all those living here or coming here to work." The sheriff said that he expects to hire "the best and brightest officers in the state," thereby putting weight behind a recent county commissioners' decision to increase law enforcement staff levels not only in the sheriff's office but also in Precinct 3, where Constable Hector Ramirez will be given assistant officers. At the same time, the city of Cotulla has budgeted funds for the establishment of its own police department, which will be staffed by sheriff's deputies working for the city. Joining Sheriff Rodriguez on the auditorium stage in the temporary county courthouse was Adolf Thomas, a retired administrator from the Texas Department of Public Safety with a career that includes service as a Highway Patrol trooper
during the late 1960s and early 1970s. Thomas has been hired by the county to serve as a consultant to the new sheriff and to assist Rodriguez in the reorganization of his office and in administration. "La Salle County needs the people's support, and I believe that we will have it," Sheriff Rodriguez said. In a brief statement to the public on Monday, Adolf Thomas said he believes Sheriff Rodriguez' administration will be an open one, with a renewed focus on transparency. "We offer service to the community," the consultant said. "We will give full service to every area of the county. The deputies will be out there, meeting the public. This will be an administration of opportunity. "We have seen a population growth of up to ten thousand people," Thomas said. "We are going to be hiring more deputies, and we will focus on personal achievement. We do not play favorites." Thomas also said on Monday that he expects officers' salaries to increase in La Salle County, bringing incomes to a level comparable to those of others in the area. "Salaries have to increase, to retain the officers that we have and to attract new ones," the consultant said. La Salle County Judge Joel Rodriguez, who presided over the commissioners' court meeting on Monday at which the official handover of duties took place, congratulated the new sheriff on his appointment. "You have a lot of work ahead of you," the county judge said. "I know that you can do it."

"This is a federally backed program," Hernandez told councilors. "Families would apply at City Hall, show that they live here and give their name and the last four digits of a family representative's social security number. That's all. "The city of Dilley qualified in its entirety because of its status as a low-income community," Hernandez said. "This is a program that is coordinated through AT&T, but it is done with government assistance." Hernandez added that the federally supported program of distributing free cell phones to every family in a community also aims to prevent rural residents from "falling victim to anyone charging a fee." "The whole city qualifies," Hernandez said, "no matter what an individual's income may be." Dilley City Administrator Noel Perez said he believes the increase in cell phone usage in Dilley will prompt providers to upgrade their service. "The demand on the system will show that we need more towers," Perez said. Under the plan offered
through TDI, each family will receive a cell phone with 250 minutes of free talk time per month. When the 250 minutes have been used, the telephone will stop working. Families that want to use their free phones more will be able to buy additional minutes if they wish, although Hernandez told councilors last week that he does not recommend increasing the service offered on the free cell phones. "This is granted free, and it is for emergencies," Hernandez said. "If you want more minutes than this, go to another company and get yourself a phone. This is not what the program is intended for." City Administrator Perez said he expects City Hall to make an announcement in the immediate future, setting a date on which local residents can file applications for the free telephones at City Hall. Once the applications have been filed, residents will receive their telephones by package delivery, complete with instructions on how to activate the devices. To date, TDI has provided the same service to residents of Big Wells and Batesville and expects to do the same for Charlotte.

Remaining in the department are Frank Hernandez and Cano Esquivel, patrolmen that the new chief describes as experienced and willing to continue serving in the face of challenge. It is Hernandez and Esquivel who remained on duty at Dilley after others resigned in mid-September. The pair worked alongside deputies of the Frio County Sheriff's Office dispatched by order of the county judge to provide assistance when the city lacked law enforcement coverage. Also joining the department this month and given their badges last week are officers that DeLeon brings from Dimmit County, including Lt. Roy Vallejo and Patrolmen Case Ruiz and Robert Thornsburg. "These men are all well trained," DeLeon said. "We are not coming in here saying we are going to change this town. We are here to provide a service, and that means lowering crime to a minimum. This is a department that is ready to succeed and has the support from City Hall that it needs for the job." DeLeon added that his department has been given the go-ahead to make equipment upgrades and to supply officers with the tools they will need for the job, including mobile cameras and communications devices. "We are taking it one step at a time," the chief said, "and I'm sure there are other things that we will need. The council is very supportive. We get the help we need to get started. "That kind of support is what helped us get the officers we wanted," DeLeon said, referring to the new crew that has been hired during the past week. "I want to bring what's best for this town. With the equipment we have and this caliber of manpower, I believe we are going to do a good job for this community."

Historic courthouse restoration “substantially complete,” architect tells county officers By Marc Robertson The multi-million-dollar restoration of the La Salle County Courthouse in downtown Cotulla is close to complete, according to architect Killis Almond during a commissioners' court appearance last week, at which he described some of the work he has done. The courthouse, built by Henry Phelps in 1931 at a cost of $150,000, closed three years ago when funding for a complete restoration was approved by the Texas Historical Commission, and millions have been spent to date on bringing the building back to its original appearance. Among the jobs undertaken by the architect have been the stripping of all new materials from the building, restoration of all windows, doors and floors, replacement of all air conditioning and heating systems with a concealed geo-thermal system, and refurbishment of many fixtures and fittings that survived eight decades of use. The building's interior, which was never finished in 1931 and large portions of which remained unused, has been gutted and returned to its original appearance, and the addition of benches and other furnishings in the commissioners' court is aligned with Phelps' original plans. Other office spaces have likewise been brought back to their original dimensions, with additions and alterations dating back more than 40 years removed. The exterior of the fourstory courthouse has also been restored, with portions of the terracotta facade repaired, mortar replaced, chipped stone repaired, window frames restored and stucco and plaster replaced. Four sculpted eagles, one on each facade, were found to have once been gilded and have now been returned to their original appearance. Focusing on interior fixtures at last week's meeting, Almond spoke at length with county officials, describing the office furniture they will be given and noting that his staff went to great lengths to either restore or replicate the desks, chairs, cabinets and other fixtures that were part of Phelps' vision for the seat of county government. "The courthouse restoration is substantially complete, but that does not mean everything is done," Almond said of the threeyear job that ends with
the building's re-opening on December 15. "We still need furniture, but a lot of equipment is in storage. "We conducted a study of all the historical furniture that we could find," the architect said. "Some of the furniture in the courthouse is vintage, dating from 1931." Almond responded to recurring myths that the La Salle County Courthouse was furnished with government surplus equipment, including desks and chairs, noting last week that studies have shown the opposite was true. The courthouse, he said, was furnished with office equipment whose plain style was popular in the late 1920s and early 1930s, and the US government bought such furniture when it needed material during the 1930s.

"The jail on the top floor has been cleaned out," Almond said of the lock-up that was last used at the beginning of the 1990s. "It will be painted an appropriate grey, to match the original look. It's a hot place. That's not a nice place up there. It gets hot enough to cook a goat." County officers are expecting to begin returning to the courthouse after a grand re-opening and public viewing of the restored building in mid-December. Since moving out of the
courthouse, county offices have been housed in the older and also historic Welhausen School on the east side of Cotulla. The school, which last saw service
in education in the mid1980s, features a historic marker as the place where future US President Lyndon Johnson served as a teacher in the late 1920s.

Cell phone theft leads to drug arrest
By Manuel Azocar III A stolen cell phone report led to the arrest of a Pearsall man on drug charges at a local motel on Friday, September 21. According to a Pearsall Police report, Officer Jimmy Allen was dispatched to the Rio Frio Motel in response to a call regarding the theft of a cell phone when an investigation into the matter resulted in the arrest of Martin Cuevas, 29, of Pearsall, on drug charges. The cell phone owner told police that his phone was taken from his room during the night and that while he was in the parking lot of the motel, he heard its ringtone coming from another room, according to the report. Police added that during the investigation, another female staying at the motel told officers that Cuevas, who was staying in the room where the cell phone was heard ringing, "sent her a text message asking for her help in getting rid of the phone."
With enough information to question Cuevas on the matter, Officer Allen said he then knocked on the motel room door. The officer said that Cuevas answered, "grabbed something from a nearby dresser and slammed the door shut" when he saw the officer. Officer Allen said he then had a motel employee open the door. “At that time, I was entering the room under exigent circumstances, fearing this subject was going to destroy evidence he took off the dresser,” Allen said. “I pulled my departmentissued pistol and the subject came rushing out of the restroom towards me and I
held him at gunpoint.” The officer ordered Cuevas to the floor and said the suspect kept trying to stand up. “I repeatedly ordered him to remain on the ground and place his hands behind his back,” the officer said. “The subject could not lie still on the ground and made several attempts at getting up even after being cuffed.” With Cuevas in custody, Officer Allen said he questioned the two women in the room and checked them both for weapons. He said he also found a glass pipe with a white, powdery residue inside it and several small baggies scattered about with a white powdery residue
Frio office will collect city, hospital taxes The Frio County Appraisal District ceased collecting ad valorem taxes for the city of Pearsall and the Frio Hospital District as of October 1. Payments for these entities can now be made at the Frio County Tax Office. According to Frio County Tax Assessor/Collector Anna Alaniz, there is also a new website available for looking up property tax information and to pay taxes online; it can be found at friocountytax.org. Payments can be made at the tax office, Monday through Friday from 8 a.m. to noon and 1 to 4:30 p.m. The Dilley annex office will collect payments Monday through Friday from 8:30 to 11:30 a.m. and 12:30 to 4 p.m. Alaniz added that vehicle registrations can be made at txdmv.gov.

A subsequent search of the room also turned up a black digital scale with what the officer described as “bits of white powdery substance all over it inside of a tan bag on the nightstand.” Officer Allen said he discovered a black, felt drawstring bag that contained a medicine bottle wrapped in electrical tape. The bag, he said, was in the motel bathroom. “I opened the bottle and observed approximately 20 little bags of a white powdery substance individually wrapped for sale inside it consistent with cocaine and its packaging,” Allen said. “Also along with it was one single bag containing a clear crystal-like substance consistent with methamphetamines.” During an additional interview with the original victim for information on the cell phone, Officer Allen said the victim and two friends said they were also previously approached by Cuevas, who propositioned them for sex with a 20-yearold female he had in the room. They claimed that they did not know who the girl was and added that "Cuevas was also pacing the parking lot all night with lots of vehicle traffic coming in and out to see him," the officer said. While complaining at the motel office, the victims said that Cuevas was in there and propositioned them again, according to the police department. Cuevas was arrested and taken to the Frio County Jail on charges of possession of a controlled substance for the methamphetamine and the manufacture and delivery of a controlled substance, related to his alleged cocaine possession. Cuevas may also face charges of solicitation, the officer said.

Dilley may fund extra Chamber activities By Marc Robertson Dilley city councilors agreed last week that they believe the Chamber of Commerce would benefit from a staff increase and additional focus on operations to take advantage of the burgeoning oil boom traffic in the region. Although stymied by restrictions on where and how to spend the funds that City Hall earns from the Hotel-Motel Tax it levies on local establishments, councilors concurred at a meeting on Monday, September 24 that a funding boost to the Chamber may increase its functions in the community. Presently, the Dilley Chamber of Commerce is led by president Yogi Davalos and is active in several events throughout the year, including spring- and summertime festivals, charitable activities such as the Christmas Toy Drive and other "fill the boot" fundraisers alongside the Volunteer Fire Department and the Knights of Columbus; and plays a role in neighborhood and community safety-oriented activities such as National Night Out and the Halloween Festival, both of which coordinate the efforts of local law enforcement, civic groups, student clubs and community members in promoting safe and supervised activities for youngsters. Under state law, funds generated by a tax on hotel and motel rooms when they are booked for short-term lodging are to be used by local government entities to promote tourism, primarily by Chambers of Commerce that host public events and festivals designed to attract crowds and thereby boost business at local retailers and hotels. "We cannot use hotel-motel tax funds for staff wages at the Chamber," Dilley Mayor Pro Tem Ray Aranda said last week, referring to research he has conducted on ways in which City Hall may disburse its revenues. "The funds are used to promote economic development and tourism, in other words, to put 'heads in beds.'" Dilley Mayor Mary Ann Obregon told councilors that she hopes the Chamber of Commerce will grow and take advantage of the increase in traffic through the city from the oil and gas play over the Eagle Ford Shale. "I still want the Chamber members to get going," the mayor said, noting that she believes those who have joined the Chamber should play a more active role in supporting community growth. "With the oil boom that we have, the city should be involved. Other cities have very strong Chambers." "We are presently paying the Chamber of Commerce $1,300 per year," Mayor Pro Tem Aranda said. "That's the minimum." "I would like to see the Chamber formed and up and going," Councilor Esme Cano said at last week's meeting. Councilors have tabled further discussion on the topic and will re-address Chamber funding at an upcoming meeting.

Million-dollar grant to UTSA benefits Eagle Ford Shale communities District 28 Congressman Henry Cuellar announced late last week that the Economic Development Administration has awarded the University of Texas at San Antonio (UTSA) a million-dollar grant for its Eagle Ford Shale (EFS) Community Development Program. The project is designed to help diversify the economic base in South Texas to ensure the long-term sustainability of the recent gains as a result of the exploration of the Eagle Ford Shale. As a result of the development of strategic plans using the grant, South Texas communities will receive the tools they need to address issues of long-term economic growth, according to the congressman. “I commend the efforts of UTSA and its vision in making sure that South Texas communities capitalize on every opportunity presented to them as a result of the Eagle Ford Shale,” Rep. Cuellar said. “Most of these
counties in the Eagle Ford Shale are in rural areas and would otherwise not be exposed to this type of outreach assistance, including greater regional cooperation and economic diversification.” “UTSA has created a 21st century vision for Tier One," said Al Salgado of UTSA’s South-West Texas Border Network Small Business Development Center at the Institute for Economic Development. "The Eagle Ford Shale Community Development Program will further help fulfill that vision by driving research, job creation and major economic impact to the EFS region. UTSA’s School of Architecture, Public Policy and the Institute for Economic Development will play a key role in working with public and private partnerships to support growth for rural communities and small businesses impacted by the Shale play.”
The Eagle Ford Shale Community Development Program will include six modules: (1) Collaboration with the Eagle Ford Shale Consortium: UTSA will work closely with the Consortium to increase its capacity to provide outreach assistance to communities in the EFS. (2) Strategic planning assistance: UTSA will engage EFS communities in strategic planning and facilitate the development of at least seven strategic plans specific to community needs. (3) Leadership training: UTSA will identify gaps in leadership experience among EFS communities and provide targeted training based upon UTSA’s existing training modules. UTSA will hold at least six leadership seminars, each consisting of five half-day sessions, and seek participants from all 18
target counties. (4) Regional conference: UTSA, in collaboration with the EFS Consortium, will hold a regional conference. Participants will include all 18 EFS counties and will share case studies of best practices and encourage collaboration among EFS communities. (5) EFS community technical assistance: UTSA will provide technical assistance to communities in the 18 targeted counties, including support for business development, development of public-private partnerships, and sustainable development. (6) Council of Governments/Economic Development Corporations outreach: UTSA will provide information and assistance to regional economic development planning organizations to facilitate updating of the Comprehensive Economic Development Strategy to include post-EFS development.

Smugglers’ cocaine worth over $2M, investigators say
The examination of a vehicle traveling into South Texas from Mexico on Sunday, September 23 revealed a narcotics cache that has been given an estimated street value of at least two million dollars, according to the US Department of Customs and Border Protection (CBP). A report on the drug cargo interception indicates that CBP officers' suspicions were aroused while they were conducting routine traffic examinations and encountered a 2004 Honda Odyssey SUV being driven by a 40-year-old male Mexican citizen from San
Nicolas de los Garza, Nuevo Leon, Mexico. A closer examination of the vehicle revealed 34 bundles of cocaine weighing some 87 lbs. that had been concealed in the Honda. The cocaine has an estimated street value of $2.7 million, according to investigators. CBP officers seized the cocaine and the Honda Odyssey, arrested the driver and turned him and the case over to US Immigration and Customs EnforcementHomeland Security Investigations (ICE-HSI) agents for further investigation.
Agents nab over $1.6M in dope Agents conducting routine examinations of traffic through South Texas from Mexico have intercepted a cargo of marijuana that has been tagged with an estimated street value of over $1.6 million, according to an announcement this week by the US Department of Customs and Border Enforcement. A report on the case
indicates CBP officers snared the dope cargo during an examination on Friday, September 28, discovering more than 740 kilos of marijuana in a single shipment. According to investigators, the officers were conducting an examination of commercial cargo that had entered the US from Mexico when they encountered a shipment of
farm equipment used for soil preparation. A secondary examination of the cargo revealed that it contained 315 packages of marijuana that tipped the scales at 1,632 lbs. CBP officers seized the marijuana and referred the case to Homeland Security Investigations (HSI) agents for further investigation.

Bureau warns against Internet fraud
In the past 12 months, the Better Business Bureau has received close to 200 complaints nationally from consumers who say they have been scammed in some way after responding to a classified advertisement on Craigslist. The Bureau reported last week that it is warning consumers to be cautious when responding to a classified posted on Craigslist, especially a job or home rental posting. Fake job postings and home rental scams are two of the most common issues reported to the Bureau. They typically work like this: 1. The Online Rental Scam: After responding to an online classified for a rental property, victims say the ‘landlord’ asks them to wire the deposit and first month’s rent in order to receive the keys to the rental home. When the victim asks to view the property in-person, the ‘landlord’ often claims to be out of the country and unable to show the house. Typically, scammers use pictures of homes taken from real estate websites in the fake postings.

2. The Fake Job Posting Scam: The goal of this type of scam is to steal money or personal information from job seekers. Scammers usually target those looking to work from home, looking for a second job or looking for part-time employment. There are two common versions of the job scam: 1. The scam artist claims that all paychecks and reimbursements must be made via direct deposit. Therefore, the consumer must provide all of his or her personal information, including Social Security numbers and bank routing numbers. 2. The scammer sends the victim a check to cover job materials or expenses and directs the victim to deposit the money into his or her personal bank account. The scammer will instruct the victim to deposit a portion of the funds to cover his or her salary and then send the remaining funds on to another designated account. The check is usually fake, but the victim’s bank may take some time to discover the fraud. The victim is then liable for the total amount of the original check and may be prosecuted for check fraud. According to the Bureau, the following red flags indicate you
might be dealing with someone using Craigslist to defraud people: · The employer/landlord is from another country. · The employer/landlord will not meet with you and will only communicate electronically. · The employer/landlord overpays and asks you to wire the extra funds back to him/her. The Bureau is offering the following safety tips when using classified sites: · Never wire money. · Consider using an escrow service. Escrow services add additional protection. Make sure to check out the company’s BBB Business Review first at www.bbb.org. · Never give out your Social Security number, personal financial information or any other type of personally identifying information to people you do not know. · Be cautious of jobs that require any kind of up-front payment. · Apartment or home rentals should be thoroughly checked out and inspected in person before a customer puts down any money.

DAR's De Las Encinas Chapter begins new year By Veronica Stich Chapter Member On Saturday, September 15, 2012, The Uvalde de las Encinas Chapter of the National Society of the Daughters of the American Revolution was treated to an informative historical lesson presented by guest speaker Stephen Kerbow at the Kettle Restaurant. Kerbow is a graduate of West Texas State University with a BS and an MA in History and Political Science. He is a member of the American Historical Association, the Texas Historical Association, the Society for Historians of American Foreign Relations, the Academy of Political Sciences, and is a board member of the Garner Museum in Uvalde. He entertained the Uvalde chapter with stories about the lives of three lesser-known signers of the Constitution, George Clammer, George Reed and Richard Bassett. Kerbow informed chapter members not only about the lives of the signers but gave a detailed description of political events of the time and how they influenced the men into signing one of the most famous documents in history. Daughters of the Republic of Texas Caddel-Smith Chapter President Judy Burleson of Barksdale and chapter member Jane Van Hoozer of Pearsall traveled to Fulton to attend the DRT District VII workshop on Friday, September 28 at the Paws and Taws Convention Center on Aransas Bay. The Friday night welcome included entertainment by a mime who went on to present a patriotic message of never forgetting those who helped secure our
freedoms throughout history. At the Saturday business meeting, DRT President General Karen Thompson updated the members on the progress of Republic Village, the changes to the DRT bylaws, and the future of the organization. Executive director of the Alamo, Melinda Navarro, reported that restoration of the Alamo roof has been completed and that important archaeological discoveries by preservationist Pam Rosser have been saved
into a data base to be shared with work done at other locations. After completing the Indiananola Cemetery project, District VII is making plans to undertake the cleaning and restoration of the Fannin Monument located in Goliad, Texas. At the close of the day, President General Karen Thompson presented the District VII chapter presidents with a certificate of appreciation. The Alamo Couriers Chapter will host the 2013 District VII workshop in San Antonio.

‘Race to the Top’ offers funding awards for local schools US Department of Education invites eligible districts to apply for nearly $400 million in awards South Texas school districts will now have the opportunity to compete for federal funding under the Race to the Top program. Race to the Top is a United States Department of Education contest created to encourage innovation in public education. Under guidelines announced last week, the Race to the Top districtlevel competition will offer school districts the opportunity to compete for $400 million in awards by designing plans to use individualized classroom instruction to close achievement gaps and increase the rates at which students graduate from high school prepared for college and careers. Congress approved funding for the Race to the Top district-level competition this budget year. “Education is the great equalizer, so this is good news for Texas schools,” said District 28 Congressman Henry Cuellar. “By expanding the Race to the Top program to allow school districts to apply, the Department of Education is offering South Texas schools their fair shot at a piece of the $400 million pie should they qualify and win. “I am hopeful that eligible schools in our community will take advantage of this opportunity to improve classroom instruction to help close achievement gaps and meet all students’ needs.” Previously, Race to the Top funding was distributed only at the state level. Texas was one of few states that did not apply to the Race to the Top contest, meaning that South Texas schools were not eligible for any Race to the Top funding. The Race to the Top District Program will build on lessons learned from the state-level competitions and award funds to districts that have the leadership and vision to implement a shift beyond a “one-size-fitsall” model of schooling to personalized, studentfocused approaches to teaching and learning. The Department of Education expects to announce awards for a total of 15 to 20 districts of as much as $25 million each in December 2012. “We are inviting districts to show us how they can personalize education for a set of students in their schools,” said Department of Education Secretary Arne Duncan in a written statement. “We need to take classroom learning beyond a one-size-fits-all model and bring it into the 21st century.” The proposed 2012 Race to the Top district-level
competition criteria invites applications from districts or groups of districts serving at least 2,500 students with 40 percent or more qualifying for free or reduced price lunch.

DHS, Red Cord Honor participants host blood drive Dilley High School hosted its first blood drive of the year on Tuesday, October 2. A number of seniors were among the donors who are participating in the Red Cord Honor
High School Program. Each student that donates six or more pints before graduating will be honored by wearing a red cord.
According to the South Texas Blood and Tissue Center, these contributions help save up to 18 lives. This life-saving achievement proves that these young students are becoming adults and demonstrating their commitment to their community and social responsibility, school officials said. The school extended its thanks to the DISD employees, community members and students who came out and donated. “I feel proud of myself because not very many people realize that one person can make a difference! Head Coach Jody Cantu said. “Conditioning was key in the victory as players tend to gain as much as 25 pounds during a wet game in contrast to an average loss in weight during a dry game. “I felt we were better physically conditioned allowing us to maintain focus and execute throughout the entire game. Defensively we caused four turnovers, three interceptions and forced and recovered a fumble.” In a back and forth affair, the Wolves took
the early lead only to see Stockdale tie it up on the ensuing kickoff. Juan Cantu capped a late first quarter Dilley drive by going in from five yards out. The Brahmas tied it up as Josh Vela returned the ensuing kickoff 80 yards for a touchdown. Dilley would reclaim the lead just before the half as Cantu scored his second touchdown from 11 yards early in the second. Stockdale would bounce back, however, scoring twice in the third to claim an 18-12
lead. Dilley tied the game in the fourth as quarterback Will Urban connected on a 60-yard strike to Leo Garcia that made it 18-18. Pearsall surrendered a lead for a second straight week and outgained Poteet but dropped a 13-6 decision last Friday in the final nondistrict outing of the year. The loss was the Mavs' third straight following a 2-0 start. With both teams fighting a constant rain, the only turnover of the night proved costly for Pearsall as it led to the decisive Poteet touchdown. "We're playing hard, so there's that," PHS Head Coach Juan Hinojosa said. "It's just frustrating, there just always seems to be one little thing. If we can get the ball to bounce one way or another. Pearsall fumbled on their ensuing possession, setting up the Aggies on the Mavs' 23-yard line. Poteet would take advantage, scoring with 20 seconds remaining in the third to build a 13-6 lead. Although action this week was cancelled due to weather, Pearsall's cross country team competed at the San Antonio FEAST meet on September 22. Destinee Reyes won the individual girls' title with a first place victory while Kim Rendon was sixth. Christina Torres came in 22nd for the Lady Mavs while Vicky Vargas was 24th. Kim Cantu placed 28th overall while Demaris Garza and Maria Lopez tied for 28th.
Ricky Medrano paced the Mavs as he was 22nd overall. Sammy Cervantes was 27th and Marcus Cuellar placed 29th. In the boys' B Division, Daniel Vasquez was 14th overall, Landry Byrd was 28th, Manuel Barrera finished 21st and Ruben Gonzales finished 40th. The cross country team was scheduled to compete in Hondo last weekend but torrential rain in the area cancelled the event. Pearsall is scheduled to be in Comfort this Saturday, October 6.

Lady Mavs VB drops two in district play By Manuel Azocar III After posting a victory in their league opener, Pearsall dropped to 1-2 in district following losses to Devine and Lytle last week in volleyball action. Showing much improvement from a year ago, Pearsall was still unable to take a game from the Arabians in falling in three games, 14-25, 12-25, 12-25. Alex Cantu led the team with seven kills and 10 assists while Abigail Byrd had eight assists and Breanna Sauseda had 12 digs. Ashley Garcia added 10 digs while Yendi Camacho tallied two blocks. In the loss to Lytle, Pearsall took the Lady Pirates to the limits before going down in four. Lytle earned a tough 25-23, 18-25, 25-21, 25-15 decision over the Lady Mavs. Garcia led Pearsall with eight kills while Byrd scored five aces and had 12 assists. Sauseda added 13 digs and Camacho had a block in the losing effort. In sub-varsity action, Pearsall fell 15-25, 25-22,
20-25 to Lytle's JV. Contributing for Pearsall were Sabrina Maritnez, Lynssi Martinez, Iris Gonzales, Annabelle Rios, Connie Kirkland, Kayla Rosas, Celina Peralta and Maria Lopez. The Lady Mavs' freshmen team improved to 7-3 for the year and 2-0 in district play with a win over Lytle. Pearsall then dropped a narrow decision to rival Devine, falling 18-25, 28-26, 18-25. Larissa Leal led the team with five aces, seven assists, and six kills. Lyric Norman added five kills and six digs while Mireya Moreno added four kills. Catrina Garcia had eight digs while Destiny Perez had 10 digs and four aces while Marissa Gonzales finished with five kills and seven digs. Stefani Gonzales tallied six aces, four digs and three kills while Alexis Gutierrez had four digs, three kills and two aces. With the loss, the team fell to 7-4 overall and 2-1 in district. Pearsall will host Crystal City this Friday.

the Dilley Wolves.” The Wolves tallied 328 yards in the win and eight first downs. Bernal paced the team with 123 rushing yards and a touchdown while Urban added 56 yards. He was also eight of 15 for 127 yards passing and a score. Dilley improved to 2-2 overall with the win and 1-0 in league play. They will look to make it 2-0 this week as they host Nixon-Smiley in the long-awaited Wolves' homeopener. "We're in positions to make things happen but they're just not happening," Hinojosa said. "It's just part of the growing pains of building a program. We've been in position to finish people off and we haven't. We're still real proud because we're fighting to the end trying to make plays." The team rushed for 301 yards and totaled 343 yards of offense with 14 first downs. Pearsall fumbled four times but lost only the one crucial turnover. Five different runners rushed for 40 yards or more for the Mavs and Jerry Chairez paced the team with 93 yards on nine carries. Troy Rios added 64 yards on 14 carries while Jason Wolfe added 49 yards on nine totes. George Brady and Corie Ruiz both rushed for 46 yards on the night. Ruiz also went two of nine passing for 42
yards, hitting Vela twice for 11 yards. He also connected with Emitt Gomez on a 27-yard gain. Pearsall dropped to 2-3 overall with the loss and will have time to regroup as they enter their bye week. Coach Hinojosa added that the team's off week couldn't have come at a better time for his team with the grading period nearing and a chance to players to recover physically from the first five weeks of action. "This gives us some time for the kids to focus on grades, it's coming at a good time," he said. "Physically, we've played some tough people so our bodies are going to get a chance to recover. We've avoided big injuries this year though, so we've been lucky from that standpoint." The team will then open District 29-3A action at Lytle on October 12.

Texas ranchers call on EPA to lift RFS standard The Texas and Southwestern Cattle Raisers Association (TSCRA) called on the Environmental Protection Agency (EPA) last Wednesday to waive the current Renewable Fuels Standard (RFS) in light of corn shortages and soaring feed costs across the US. According to the TSCRA, the government mandates that 40 percent of the US annual corn crop go directly toward ethanol production; however, federal law does allow the EPA administrator to waive this requirement for up to one year if the implementation would severely harm the economy or environment of a state, a region or the US. “As record drought conditions throughout the US continue to push corn yields lower and prices upward, the economic ramifications
for consumers, livestock and animal agriculture producers will become even more severe,” said Joe Parker Jr., rancher and TSCRA president, in comments submitted to EPA Administrator Lisa Jackson. “These ramifications are particularly severe in Texas, the leading cattle producing state in the nation.” Parker says that last year was the first year ever that ethanol production used more corn than all animal agriculture combined. With corn supplies continuing to tighten across the US, the current RFS standard is only compounding the situation by reducing the already extremely limited amount of corn available for feed. TSCRA submitted these comments to the EPA after the association passed policy during its fall meeting
reaffirming the group’s opposition to federal and state subsidies and production mandates for renewable fuels that use feed grains and other feedstuffs used for cattle production. “Ranchers understand wellintentioned efforts to move our nation toward energy independence, but those efforts should not consist of government mandates that artificially give one commodity priority at the expense of another,” Parker said. “The cattle industry supports a free market system, and although a full repeal of the RFS standard in today’s political climate may not be possible, we are hopeful that the EPA will help alleviate the current corn crisis by taking the government mandates out of the equation and put corn back on the same playing field as cattle producers.”

Need winter grazing? Dust it in! Need winter grazing but there’s not enough soil moisture to plant? A Texas A&M AgriLife Extension Service expert said “dusting it in” is worth the risk. “Dusting in” refers to planting when there is not enough soil moisture present to get the crop emerged, but with hope of receiving a rain later. “If they want winter pasture, then I’d go ahead and make that gamble,” said Dr. Larry Redmon, AgriLife Extension state forage specialist, College Station. Typical recommendations are to plant small grains for early winter grazing six to eight weeks before the first frost. “If you’re looking at Central and South Texas, we’re still in good shape as far as the planting date,” Redmon said. “If we’re in the Rolling Plains or the Panhandle, we should have already planted, but it’s not too late.” An El Niño currently developing in the tropical Pacific promises a cool and wet winter for Texas, according to Dr. John Nielsen-Gammon, state climatologist and regents professor at Texas A&M University.

However, the El Niño has yet to deliver on that promise to large parts of the state, particularly the Far West, Panhandle and Rolling Plains, making planting winter pastures chancy, Redmon said. But hay supplies remain short or non-existent in some areas, and according to reports from AgriLife Extension county agents, many producers are going ahead and taking the chance that more rain will come. Redmon noted winter pasture demands good management, including sufficient fertilization. They also must take the winter
grass off in time in the spring for warm-season grasses to develop. “If they didn’t get it off in time (last year), they further injured warm-season grasses already damaged by the drought,”he said. “We had a lot of warm-season grass stands that were actually destroyed because of lack of management. China goes nuts over Texas pecans
By Kathleen Phillips China has gone nuts over pecans, which is great for US growers but might have consumers shelling out more money for the fall food favorite. The Chinese culinary fancy led to increased imports of pecans from 2.9 million pounds in 2005 to 80 million pounds in 2009 where it has hovered since, according to Monte Nesbitt, Texas A&M AgriLife Extension Service. That has moved prices to the grower from less than a dollar a pound in the late 1990s to $2.65 a pound last year – a trend experts are watching as pecan harvest begins. “China had all the ingredients you need to make a new food popular there,” said Nesbitt, a horticulture specialist in College Station. “They have continued to show solid

interest for eight years. So the pecan has not been a flash in the pan there.” Nesbitt credited a trade mission of US pecan growers intent on taking their nut to the world for starting the pecan popularity in China. But he said other factors lined up to cause the surge as well. The Chinese already had
a much-loved native hickory nut, but it has a very hard shell that when cracked breaks the kernel into small pieces, he said. “So imagine that here comes a hickory, which a pecan is, that you can actually crack out very easily and get a nice, big kernel in perfect halves,” Nesbitt said. In setting the initial October 2012 allowables, the Commission used historical production figures from previous months, producers’ demand forecasts for the coming month, and adjusted the figures based on well capability. Well results from Matador Resources’ operations in La Salle, Dimmit, DeWitt, and Karnes counties were release earlier in the week. The company’s average well has a perforated well length of 5,090 ft, was completed with 18 frac stages, and produced 1,103 boe/d initially (859 b/d and 1.5 mmcfd). One well completed in Zavala County was placed on pump immediately and produced 307 b/d of crude oil. Gas was trading at just over $3.30/mmbtu on Friday afternoon. That’s more than a 10% increase from last week at this time. The number of natural gas rigs running fell to 43 this week. That’s another new low for everyone keeping count. Rigs are moving to oily targets for the foreseeable future, but if natural gas prices continue a rise that could very well change. Henry Hub futures were trading at ~$3.30 on Friday afternoon. That’s a $0.40 increase from last week. Spot prices rose considerably, but not quite as much trading at ~$3.00 to end the week. WTI was trading at ~$92/bbl Friday afternoon. That’s the lowest point in the past two months. With elections and international turmoil, I don’t believe many people have conviction about the oil market. Eagle Ford crude priced at $101/bbl on the 27th of September. Light crude and condensate in the area traded at $88.50 and $87.50, respectively. There are 252 horizontal rigs running in the region. The four counties leading development are Karnes with 39 rigs, La Salle with 37, Dimmit with 29, and McMullen with 28. Webb (26), Gonzales (22), DeWitt (18), Atascosa (15), and Frio (10) round out the top Eagle Ford counties.

Livestock producers still had to supplement cattle with protein and hay as grazing was very short. SOUTH: Soil-moisture levels ranged from short to adequate in the northern parts of the region. Most eastern counties reported very short soil moisture conditions, except Frio County, where they were 100 percent adequate. Western and southern counties reported short to very short soil moisture conditions, except for Zavala and Willacy counties. Rangeland and pastures have greened up in counties that received 1 inch to 7 inches of rain last week, which included Atascosa, La Salle, McMullen, Brooks, Duval and Jim Wells counties. Western counties only received light showers and drizzling rain with the exception of Zavala County, where better rains over the past few weeks slightly improved forages. Frio County area, with producers preparing fields for planting next season’s crops. Pecan production in that area was good and with very low insect pressure. In Zavala County, dryland oat and wheat producers were able to plant, thanks to rain. Also in that area, cabbage progressed, though some producers were battling excessive weed-growth caused by heavy rains. Also in Zavala County, spinach and onion producers were preparing seedbeds, and cotton gins were running at full capacity. Land preparations and vegetable planting continued in Cameron and Hidalgo counties. SOUTHWEST: Recent rains improved existing pastures and benefited the fall plantings of legumes, oats and ryegrass for winter pastures. Most cotton was harvested and on the way to the gins. Good yields were reported. Ranchers were taking their last cutting of hay for the year. The pecan harvest was ongoing.

“The Chinese fell in love with pecans.” Along with its ease of cracking and larger pieces, he added, the Chinese were also ready for pecans for other reasons: their large, growing middle class currently has more money to spend on fresh produce and Western, American food is in vogue in China. This significant new market has changed the economic picture for pecan growers, Nesbitt said, and new orchards are being planted across the south to meet what he said seems to be a new level of demand. Prior to the Chinese interest, pecans were a domestic crop dependent on US consumption, he said. Studies in the 1990s proved pecans had key health aspects and they were endorsed by the American Heart Association’s Heart-Check Certification program as promoting healthy cholesterol and being packed with antioxidants. Across the US, they were added to salads, healthy snacks and boxed cereals. But that didn’t move consumption much, Nesbitt said. The per capita consumption in the US is 0.45 pounds as of 2010, according to the latest available figures from the US Department of
Agriculture. “That’s when the US pecan industry realized they needed to get pecans beyond this country and into the hands of the world,” Nesbitt said. “The growers from various states were able to get federal market assistance program funds that allowed a more organized approach to exposing the crop to international food buyers.” China’s purchase of 60 million to 80 million pounds of pecans in the shell annually equals roughly the entire Texas crop in a good year. The US pecan crop fluctuates from 200 million to 300 million pounds a year. The National Pecan Shellers Association recently estimated the US crop will be 287 million pounds. The US Department of Agriculture estimate will be announced Oct. 31. “The effect of the large export market for US pecans is a significant strengthening of prices paid to the US producer,” Nesbitt said. “In 2009, Texas improved (nonnative) pecans in the shell sold for $1.64 per pound on average to the grower. In 2010, the price had inched up to $2.50 per pound. Ten years ago, that would’ve been what you would sell pecans for retail. “And 2012 appears to
be at least starting out in a similar positive pricing structure. All the indicators are that we have a sizable pecan crop in Texas. So our growers have a great opportunity to get in on this high pricing this season.” Texans harvest the nut native trees as well as from about 70,000 acres of improved variety orchards which exist all over the state, Nesbitt said. Though the lack of US growth in consumption led to the pecan going global, Nesbitt said, the industry hopes the high pricing structure doesn’t displace the American consumer. “If they’re not willing to pay more for pecans than they did in the early 2000s, then they may need to plant a tree,” he said. “And we in AgriLife Extension are willing to help people select the right variety.”
