The Mortgage Scene. by Paul Winteridge, The Mortgage Shop - June 2014 With increased confidence in the Jersey market, we have seen a steady increase in activity since October last year, with many more buyers taking advantage of rock bottom house prices and low interest rates. There is however a little cloud on the horizon, MMR. New UK legislation, The Mortgage Market Review, was introduced on 26th April, with the intention of ensuring that lenders take a more responsible approach to granting mortgages. Borne out of the financial crisis, strictly speaking the new regulations do not directly apply to the Channel Islands. However, most of the local mortgage lenders will be adopting the principles of MMR.

AFFORDABILITY In a nutshell, lenders will be looking more at client affordability, requesting much more information on an applicant’s income and expenditure, assets and liabilities. In addition, each case will be “stress-tested” to see if an applicant’s income can cope with any future increase in interest rates.

SPENDING HABITS The process is likely to focus on spending habits over an extended period, along with future plans, such as starting a family, career and business aspirations, etc…. More information will be requested on other borrowings, such as credit cards and personal loans, as well as details on how much each month is being spent on food, energy bills, pension contributions, childcare and school fees, holidays and entertainment. In reality, some of the new requirements have already been incorporated by some Jersey lenders and who have spent time adapting their systems ready for these changes. Others admit that the changes are only just now being

introduced, resulting in delays in the processing of mortgages.

What has already become apparent is that some lenders seem to be going beyond the minimum requirements, whilst others are adopting a more commercial attitude.

USING A MORTGAGE BROKER

SOME BASIC RULES If you are thinking of applying for a mortgage, there a few basic rules that you will need take into consideration: • Zero hours employment contracts will generally not be considered • Overdrafts will be regarded with suspicion, especially if they are used to the max every month • Exceeding an agreed overdraft limit/ bounced payments/rejected direct debits, etc. will result in an automatic decline • Living with parents, paying a nominal rent and not making contributions to a gifted deposit could cause a problem • On-line gambling or excessive mail order activity will be scrutinised • Any regular payments to cover a personal loan or similar debt will reduce the amount you are able to borrow.

REDUCING FUTURE RISK Whilst these new requirements might seem tedious and will undoubtedly add to some processing delays the upturn in the market is already experiencing, generally they should be welcomed, as they are specifically intended to reduce the risk of another credit crisis, caused by what has been

It is unlikely that the mass mortgage rejections predicted in the UK media will occur in Jersey. However, it does highlight the need to know what your goals are and to seek advice in order to find a combination of an affordable mortgage coupled to a correct product. BASE RATE INCREASES AND RECOMMENDEDTIONS It was announced on 10th May that base rate will likely increase from 0.5% to 3.00% within three years. With this in mind and with the spectre of inflation also a concern, the advice for the majority of our clients is to fix their mortgage rate, preferably for the longest term available - currently five years. Those fortunate clients who are locking in to the present low interest rates will become the envy of the many borrowers who decide to stay with their low cost trackers for a few months more, as today’s fixed rates will probably have been replaced with products at a much higher level within a few months.

It would certainly seem to be the case, but how long will it last? From the broad spectrum of professionals - agents, IFAs, lending institutions and lawyers - the word is that, yes, we are open for business again and this purple patch is here for the foreseeable future. There is an undoubted confidence and optimism across the board. Purchasers are willing to buy, whether it is a first time home or moving up the property ladder, and lenders are willing to lend. The first half of this year has seen a marked increase in the number of contracts passed before the Royal Court and of registrations of loans to assist those purchasers. The main lender has been Skipton, who have been very proactive in the Island and provide very attractive packages to would-be purchasers, but they are not the only lending institution to find an upturn in mortgage enquiries and who also offer competitive packages. The higher end of the market certainly appears to have seen a great increase in property transactions, with a number of high

net worth individuals deciding to make Jersey their home, no doubt down to the excellent work by Kevin Lemasney and his team at Locate Jersey. It is interesting to note that, with the year not yet half way through, this year’s permitted number of incoming HNWIs has almost been met; good news for the Island. Collas Crill has had a number of higher end property transactions already completed this year and a number of others waiting to complete. The firm is also very busy across the board. The lower end of the market has been doing well, in particular with the shared equity developments that have taken place. The latest of these was undertaken by the Parish of Trinity and has been fully allocated. These types of developments are essential to allow first-time buyers a step up on the ladder and will hopefully be continued. Turning to the middle market, this has also improved but may still be a little sluggish. I do feel, however, with the upturn in confidence and optimism, that this will also show an upward trend with buyers wanting to ascend the property ladder. Let us hope that this is the case, as a healthy property market can only be good for one and all.
