Everything you need to know about
Conveyancing and why it’s time for a Change.
The system of conveyancing in Jersey is often called into question and you have to wonder whether our archaic procedure is in fact fit for purpose in modern day terms. Historically, (as far back as medieval times) contracts for property were completed after Sunday service at the relevant parish church, often in the graveyard, before a parish assembly. The parties effectively took a solemn oath “Ouie de paroisse” (in the hearing of the parish) and these transactions were largely merely committed to memory, although some were recorded in manuscript. Sometime in the 14th century it became usual to enter into a formal contract which the parties swore on oath before the Bailiff and a number of Jurats. Often these contracts were merely a record of what had already taken place “Ouie de paroisse” though in some cases the contract was subsequently read aloud in the parish graveyard. In the 16th century it became usual for all transactions to be completed by formal contract and the “Ouie de paroisse” thereafter fell into disuse. During the early part and again in the later part of the 16th century, efforts were made to establish a system of registration for all contracts, but it was not until 24th July 1602 that an Act of the States was passed creating a central Registry. At the time of the Act Sir Walter Raleigh, who was then Governor of Jersey, was making an official visit to the Island and for this reason he is often (incorrectly) credited with the establishment of the Public Registry. The 1602 Act was then reinacted, with some amendments, by the Code of 1771. The Code, as amended, is the legislation upon which we still rely today. The Code of 1771 stipulates that all contracts shall be passed before the Court in accordance with Orders of the Commissioners (now in accordance with the Royal Court Rules), that a competent Registrar be appointed and shall take an oath of office before the Court, that all contracts be passed before the Bailiff (or his Lieutenant) and two or three

Jurats and once passed be registered by the Registrar, that all charges and hypothecs must be registered if required to take precedence over ensuing charges or hypothecs, that all powers of attorney and tutelles (guardianships for minor children) must be registered and that the Registry must remain open to the public. Apart from a switch from French to English in 2006, the form of the contracts and their terminology has changed very little over the centuries. Many people mistakenly believe that the fact that a contract is registered provides some form of guarantee of title, but this is not the case. A purchaser must rely upon title researches carried out by a conveyancing clerk each time a property is conveyed. In a modern society it is quite nonsensical that a contract relating to property can only be completed on a Friday afternoon and perhaps also that the parties must be convened before the Royal Court to conclude it. It would surely be easier and more sensible if the parties attended a completion meeting, perhaps at their lawyers’ office or some other central location at which each could sign the contract in the presence of independent witnesses. Their lawyer could then deliver the contract, along with the requisite stamp duty, to the Public Registry for registration in the normal way. There is no logical reason why this could not be done on any working day. Changes such as these would require some amendment to existing legislation, but this would not be difficult and the result might be welcomed by some as a step into the current century. Food for thought or an unwelcome dilution of a long standing Jersey tradition?

The Jersey property market is steady, with little indication of price rises and with agents finally seeing properties going under offer that have been stagnant for the past twelve months. There appears to be a shortage of property in some categories, particularly the flats and houses that are mainly bought by First Time Buyers. Whilst this sector of the market has been much more active in the past eighteen months, First Time Buyers are now finding they have to compete with investors, some buying with funds from cash deposits that would otherwise be earning very little if left in the bank.
Before the recession, borrowers had access to more lenders than we now have and several of these offered a keenly priced 95% mortgage, which really helped the market. We will only see a return to this type of mortgage when prices start to rise again, so giving lenders the comfort that they need before releasing such a product.
MORTGAGES Across the board mortgage product rates have continued to nudge lower. The trend seems to have stopped in the past few weeks – is this the lowest they will reach? Weaker than expected growth in the UK economy and projections that inflation will remain lower for longer have once again pushed back the prospects of a rate rise, with many economists ruling out a change this year, and some predicting that there may be no move until the end of 2017, or beyond.
