appy Birthday, America And Americans! This month, we’ll be celebrating the Fourth of July in our country, in a variety of ways, participating in any number of various activities, and hopefully remembering what the day is known for and why we celebrate it the way we do. Some will go see a parade, some will take part in Backyard Barbecues, some will spend the day at the lake, and some will take in Fireworks Displays. Many will be wearing Red, White, and Blue, or articles of clothing displaying the American Flag. Some may watch a movie with a patriotic theme, some may choose to visit a cemetery, or a historical park or museum. Whatever we choose to do, or whatever we choose to wear in the name of the day, the Fourth of July in this country should bring to mind significances that gave this country its start and brought special meaning to this date. So why do we celebrate the Fourth of July? Or, to put it another way, what are we remembering and memorializing on the Fourth of July? Remember that another name for this day is Independence Day. That means we are celebrating our country’s independence from England’s rule and our becoming a separate nation with our own government. Yes, that is a major aspect of what we celebrate, but we also celebrate this country which has grown and developed into a nation which has brought together people with different looks, different feelings, different opinions, different tastes, different needs, different wants, different lifestyles and different ideas. This country was founded under the premises of Give and Take, and of Respect for everyone’s ideas whether they agree with our own, or are on the other side of the aisle. It was founded under the principles of Equality, Non-Discrimination, Fairness, and Justice for All. It seems that many in this country have somewhat lost sight of those ideals and precepts, evidenced by most of the bickering, and the “schoolyard” spat–like behavior we see and hear often in the news today. This country was also created under the premises of life, liberty and the opportunities to pursue happiness in our lifetime. It was built under the blanket of Color Blindness, Creed Blindness, Race Blindness, and Religion Blindness. It was established with all people in mind and offered the same rights to each and every person protected by the Constitution of the United States of America. So as we get ready for those Fourth of July parades, picnics, and fireworks celebrations, let us make sure we don’t just do things that look good on the surface. Let’s make sure all the parades, the songs, and the colors, don’t just look good, or sound good, or give others false impressions of us, but that they reach all of us in the depths of our hearts and souls, and bring out the true meanings of our celebrations, in the ways our forefathers intended when the true importance of the Fourth of July was initiated. I bought Alice in 1996 from Bob Appleton at his shop in Nashville. When I got it home, I started adding my touch. I have every nut and bolt chrome, Vance & Hine Longshot Pipes, and a twisted spoke chrome wheel. I think I cleaned the shelves in custom chrome in the Harley shops all over Tennessee. It also has LED purple accent lights. This bike will be with me until I die. I dedicated it to my Mom and Pop by engraving in memory to them on the carburetor cover. I also have a tattoo of the motor on my shoulder. Oh, Alice loves Daytona. Thank you, Thunder Roads Magazine of Tennessee for this opportunity. PRINCIPLES OF SELF-DEFENSE CLAIM – INNOCENCE

H

ere we are in July! And boy, has it been a weird 2020. Between going through quarantine due to COVID-19 and the Black Lives Matter riots going on right now, it seems like the world has tilted on its axis. Hopefully you have been getting some serious riding in and maybe even attending a rally or two. I have ridden a lot over the last several months and the Grey Ghost, purchased last September, has nearly 12,000 miles on it. This month’s column deals with what to expect if the unimaginable happens you find yourself in a terrible situation where you need to defend yourself - with your firearm. You may be at home, you may be out on a dinner date or you may be at the gas station filling your bike with high-test gasoline. And things go quickly out of control. You pull your pistol from its holster and command the thug to halt what he’s doing. Maybe he’s pummeling your friend, holding you at knifepoint or charging at you with a pipe. Whatever he’s doing, you are in serious danger. You pull the trigger, hitting the scumbag square in the chest. He’s still coming so you put two more shots into center mass before your assailant goes to the ground. Your life has now changed forever. At this point you need to call 9-1-1 immediately. When the police arrive they will inevitably approach you with their service pistols drawn and command you to the ground. You may will be thinking, “But I’m the good guy.” Unfortunately they have no idea what has happened up to this point. The only thing they know is that there is a guy on the ground and you have a gun. Follow all instructions they give you. Explain that you feared for your life and you commanded the thug to cease what he was doing. You also have to understand that even if you did everything correctly, the police are going to consider you a criminal suspect at this time. Pretty scary, isn’t it? If it can be demonstrated that you acted purely in self-defense, you should have nothing to fear. But what factors are considered by the police, and more importantly, the prosecuting attorney’s office, on whether you are charged as a criminal or are quickly sent home with no threat of criminal prosecution? 1. Innocence 2. Imminence 3. Proportionality 4. Avoidance 5. Reasonableness For each of these five items, you must be able to demonstrate, and prove, that you were in the right. If you fail to prove any single one of them, your argument for self-defense may well fail. The consequences of failure are immense - up to a very long incarceration in prison. This is why I always refer to firearms ownership as an immense responsibility. Over the next several monthly columns, I will elaborate on each of these five components in detail. But here follows a brief summary of each of these critical components to a successful self-defense claim. Innocence: Innocence seems pretty simple and straightforward. You were minding your own business and the scumbag came at you with a knife. But in order to be

innocent, you cannot be viewed as the aggressor. More than likely, there will be witnesses to the event. Will they corroborate what you said happened? Were you somewhere you were not legally allowed to be? Did you pursue the altercation? Did you take actions which sustained the incident? Was it a case of mutual combat (legal term)? Did any actions you take cause a small altercation to escalate? Imminence: Simply put, in order for your self-defense claim to be considered there has to be an imminent threat of severe physical harm or death to you or a third party you are protecting. If the dirtbag is 100 feet away from you threatening to beat you up - that would not be considered imminent enough to result in you using deadly force. If he is threatening to go home and get all of his brothers, and come after you, that is not an imminent threat. If he is 18 feet away from you and has a knife pulled - that could well be an imminent threat that would allow you to use lethal force. Proportionality: Proportionality is key to a self-defense claim. If you find yourself in a fist fight with a smaller guy, a proportional reaction would be to fight back with your fists. If you pull your sidearm and shoot the attacker, it would not be a proportional response. However, if you are brutally attacked by a much larger man, and you are laying on your back being pummeled by his huge fists, you may well be able to use your gun to end the attack. Avoidance: Could you have avoided using lethal force? While Tennessee is a “Stand Your Ground” state, could you have simply turned around and headed out the side door? Why allow a situation to deteriorate into a life changing event if it is not necessary? Reasonableness: If the police believe your actions were reasonable, given all of the circumstances, you are most likely going to be cut loose quickly. However, if they have any questions regarding whether your actions were reasonable you may very well find yourself in legal jeopardy. If it escalates to the district attorney, there will be an entire set of litmus tests regarding whether you acted as a reasonable person would have, given all of the circumstances. “LOOKING BACK” Gen. 19: 17 “And it came to pass, when they had brought them forth abroad, that he (the angel) said, Escape for thy life; look not behind thee, neither stay thou in all the plain; escape to the mountain, least thou be consumed.’ Vs. 26 “But his wife looked back from behind him, and she became a pillar of salt.” Today this Coronavirus, the economy, and all the riots have changed our lives forever. We have all entered into a new season of life that will never be what it once was. There are many changes and decisions that we must now make. When we look back at the past, it appeared to be a safer place, it’s comfortable to think about the past, but to focus on the future, and the unknown can be very threatening. God told Abraham; “Get thee out of thy country and from thy kindred.” God had made many promises to Abraham, promises that seemed to be impossible at the time. Gen. 12:2 “I will make of thee a great nation.” He received a revelation from God not knowing the how or when of it. He gave up certainty for an uncertainty and went out not knowing where he was going. Willing he surrendered the seen for the unseen. Faith has trials, the greater the faith, the greater the trial. Faith must be tried in order for faith to grow. Rom.4:19-20 “And being not weak in faith, he considered not his own body now dead, when he was one hundred years old, neither yet the deadness of Sarah’s womb.” God’s promise seemed to be impossible according to what he could see. Heb. 11:15 “and truly, if they had been mindful (thoughts) of that country from whence they came out, they might have had opportunity to have returned.’ If they had focused on what their five senses was telling them rather than what God was telling them, they might have gone back to where they started. Temptation is linked to what you think, you can’t be tempted by what you don’t think about. If all we think about is what the news media is telling us about the medical issues, the economy, and the riots, we won’t move into the future but be bound by our past, we must be ready to leave 8

the past behind and move into our future. Abraham believed God as he waited on God, his soul fed on the promises of God in the face of a long delay. Heb.5:14 “But strong meat belongs to them that are of full age, even those who by reason of use have their senses exercised to discern both good and evil.’ “Strong meat” is revelation knowledge from the Word of God that is intended for believers who are “of full age,” adult believers who have learned to trust God in difficult times rather than their five “senses.” Their experiences have taught them how to “discern both good and evil.” Until next time, keep your face in the wind and your kickstand up. Dear Fellow Veterans and Patriots of Tennessee: As we celebrate Independence Day and the separation from England that founded the first nation in the world to guarantee individual freedom and liberty, we see the ramping up of a revolution to undercut our freedom and take us to dictatorial dominance by tyrants and big government. This day has been coming for decades. Democrats, liberals, communists and socialists have worked to undermine every aspect of our society since before the Wilson administration in the early 1900’s. We’ve seen how this movement went through periods of recession during times of high patriotism like WWII, the Cuban missile crisis, the economic revival under President Reagan and the fall of the Berlin wall. Patriotism soared again after 9/11 and the historic economic recovery under President Trump. During each of these periods of pro-American sentiment the anti-constitution revolution has taken steps to advance their preparation to totally overthrow our personal freedoms and subvert us to dominance by a government based on socialism. President Clinton worked to bring our country closer to China and Mexico in support of one world government. President George W Bush allowed heightened intrusion into personal privacy after 9/11 and active government eaves dropping on individual Americans. His father, President Herbert Walker Bush supported one world government as do George W and Jeb which is one reason, they support the 43 PAC organized by Bush swamp alumni to support Joe Biden. Barack Obama assembled an administration of “former” terrorists, anarchists, socialists and one world government zealots. Over his eight years in office he changed out the upper levels of all key government agencies to undermine our constitution. The IRS, CIA, NSA, EPA and all other government agencies were weaponized and sunk deep into what Donald Trump calls the swamp. Since the end of WWII our media has turned into a one-sided propaganda machine to support the revolution. The media supported the communists during the Vietnam War, worked to undercut President Reagan, worked to mold public opinion against every move to protect individual freedoms and has worked to mold public opinion that liberal subversion is

protected by the constitution while trashing God and religion. All of this was close to completing the overthrow of our constitution until Donald Trump was elected President. Now the anti-American confederation has to pull out all the stops or risk being set back fifty years by a President and administration that adheres to personal freedom and the American constitution. President Trump is not on the socialist revolution train. The Obama administration and the deep state took unconstitutional action to undermine him and Democrats in combination with the media have done everything in their power to drive him out of office to save their revolution. They have whipped up the coronavirus from a flu to a national emergency with unconstitutional commandments. They are devastating the national economy and supporting anarchist groups trying to tear apart the fabric of our nation. All of this is being funded and supported by Democrats and powerful socialist forces to undermine a President who lives by our constitution and believes in America. They have activated Antifa, Black Lives Matter and a bunch of other anti-American groups to take over peaceful protests and spark violent revolution in the streets. This violence is being supported by Democrat mayors, governors and the media. Much of the energy is coming from young college age students revolutionized by public schools and universities. This anti-American chaos will grow and destroy our nation if we don’t eradicate liberal propaganda and political correctness from the public forum. Everything you see is engineered to the national election in November. The socialists know that Donald Trump is likely to be elected but what they are really after is keeping the Democrats in control of Congress so they can continue to push the revolution and save the swamp. The socialists need to weaken law enforcement and the second amendment so they can rule our society. The revolution is right in front of our face. Will we lay down and submit??? Keep the faith. Thank a vet for the freedoms we still enjoy and support politicians who will bring back the ones we’ve lost. Fly the flag of the people and be proud you’re an American. Hug the families of those still missing because their quest for closure has not ended. Live the good life and ride for those who can’t. IN LOVING MEMORY

Eric “Ed” ”The Sheriff” McClure

August 10, 1952 – May 28, 2020

B

eauty isn’t always in a place or in a girls face, in a rare case, it’s in a soul. Ed had a beautiful soul. He met 1,000’s of people and greeted them with his brilliant smile without leaving the Boswell’s Harley-Davidson campus. Ed served as custodian, guard, and greeter, his duties growing since he basically hired himself 48 years ago. He was almost as much the face of Boswell’s as Bubba Boswell, in his own way. When Lannie Boswell built the store on Fesslers Lane in 1972, Ed was living in a house near the back of the store. Bubba says that at first Ed would walk to the property and watch, fascinated as the bike business operated. Then he became mesmerized by the then wooden and cardboard crates, and began perfectly sorting the pieces he disposed in the bin. Thereby, he began his long relationship with Boswell’s. Ed had limitations, but he functioned to the maximum of his abilities. Yes, he had a paranoia that Sky 5 was spying on him and an ongoing feud with the dumpster company, but in Bubba Boswell’s words, he was PERFECTION. He was 100% sincere, a fervent believer in God, did what was right, cared about people and duties, and used all of his abilities to be perfect. He always had a story. I remember how mad he got when he received permission to ask a beggar at the interstate to help him. The man told him he didn’t want to work, he hated work. Ed couldn’t believe a man would take people’s money rather than take offered work. That was Ed’s ethics. He took his guard duties seriously. Day and night, Ed prowled the campus. When someone brought him a badge from out west, he became the sheriff. Over the years his hard hat became decorated with various police markings. You better not mess with any of it! As with everything, he took it serious. Though never riding a motorcycle, Ed loved Boswell’s HarleyDavidson, and the customers. In Tina Bouldin’s opinion, something is obviously missing at Boswell’s. Kelly Dishman who has taken care of Ed’s and his surviving brother’s finances and other needs, expressed sorrow at his passing, as did Boswell’s employees and customers. He was always there and now he’s not. An “Ed, White & Blue” ride is planned to raise money for a prominent marker on his grave at Greenwood Cemetery. Ed loved the 4th of July and that is the planned date. The ride will leave from Boswell’s Ring of Fire Harley-Davidson at 2200 Gallatin Rd. in Madison with KSU at 10am sharp. Bubba will lead a gorgeous backroads ride and end up Boswell’s HarleyDavidson on Fesslers Lane at 12 noon for a free cookout in honor of Ed “The Sheriff”. Ride Safe, Have Fun, and seek Perfection!! A Scotsman was drinking in a bar in London when he gets a call on his cell. He hangs up the call and immediately orders a round of drinks for the entire bar, as he proudly announced his wife has just given birth to a handsome and up to par Scottish boy weighing in at 25 pounds. Everyone applauds and yells out their congratulations comments but all are in awe that a newly born baby can weigh in at 25 pounds! The proud Father just shrugs, “That’s about average up our way, folks....like I said, my boy’s a typical Highland baby boy.” Two weeks later than man returns to the bar. The Bartender says, “Hey, you’re the Father of that typical Scottish baby that weighed 25 pounds at birth, aren’t you? Everybody’s been making bets about how big he’d be in two weeks, so how much does your boy weigh now?” The Scotsman proudly replies, “17 pounds.” The Bartender is puzzled and a tad concerned. “What happened? He was 25 pounds the day he was born. POST-COVID: MOTORCYCLES WILL BE THE LOGICAL CHOICE If we are to believe the so-called “experts,” travelling will never be the same again. Even when the Coronavirus itself is under control, we have to take into account the risk of contamination or a new wave of the pandemic for a long time, if not forever. Already politicians and medical experts speak of a socially-distanced society in which we have to keep away from one another in the public space, including public transport, schools, restaurants, et cetera. “Assuming that we will be able to travel freely soon, there will probably, at least for a period of time, be limitations to our freedom,” states the head of the Federation of European Motorcyclists’ Associations (FEMA), “Not in distance or direction, but in the way we travel as a result of the need to keep distance from each other.” FEMA’s General Secretary Dolf Willigers concludes that the capacity of public transport, buses, trains, airplanes and the such will be limited, and we will have to switch to more individual ways. At the same time, he notes that city councils allocate more road space to pedestrians and cyclists instead of cars and commercial vehicles. This calls for vehicles that are smaller than cars and trucks, so “for personal transport and partly for goods transport, powered two-wheelers (motorcycles, mopeds, e-bikes, etc.) will be the logical choice.” Road authorities and city councils should keep the use of motorcycles possible and facilitate the use of them by keeping roads open for them, says Willigers in calling for the creation of dedicated parking spaces and safe charging infrastructure for electric powered two-wheelers (PTW). ”The use of small individual motorized transport -- as powered twowheelers are -- allow people to travel into the cities while maintaining the needed social distance and leaving room for pedestrians, cyclists and users of other kinds of micro-mobility.” Attorneys for the bikers remain confident the plaintiffs will win on appeal.

HIS YEAR marked the 20th anniversary of Smoky Mountain Thunder Memorial Ride. Because of the COVID-19 virus, we almost had to postpone the event. One thing was certain, we never considered cancelling. As time grew closer to the event it became increasingly clear how important it was to do the event on Memorial Weekend. There were so many contacts on our Facebook page, website, emails and phone calls wanting to know if it was still going to happen. All we could do at the time, was ask everyone to hang tough with us and we would let everyone know as soon as we could so they could plan to attend. We were finally able to get an answer, and on May 24th motorcycles started rolling into

downtown Sevierville. Even with the project to beautify downtown and some street closers, we worked with the Sevierville Police Dept. to figure it out. Due to the construction in downtown Sevierville and the virus, we could not hold the opening ceremony at the Courthouse. So we had to come up with a way to let everyone know when it was time to leave. We told as many as we could that when the wreath was placed at the Veteran’s Memorial in front of the Courthouse and they heard Taps being played, that would be the signal to get ready to ride. Liz Loar, local performer did great playing Taps at the Courthouse and at the Veteran’s Overlook in Grainger County. The Police escorted 65 mile long ride crossed five counties. All along the route from city to city, from county to county, law enforcement were out to block intersections and crossings to keep us safe as we passed. City and County Fire Departments were out showing support with their ladder trucks holding the American Flag raised high over the route. There were CONTINUED...

also large groups of people out waving flags in support of the event as we rode by. The purpose of Smoky Mountain Thunder Memorial Ride has always been and will always be to pay tribute to our fallen military killed in combat. Our Mission Statement is “To reach as many people as we can with this event. In doing so, we hope to instill and renew the true meaning of Memorial Day.” This year was focused on just that reason. The feeling was that it was time to remember why Smoky Mountain Thunder started. Because we were unable to do an opening ceremony, we put everything on at the closing ceremony on top of Clinch Mountain, beginning with the Pledge of Allegiance, followed by the National Anthem sung by Kaleb Wright. After a few thank you’s to those who helped with some of the needs of this year’s event, from face masks to hand sanitizer, T.C. Barnette sang “The Ones Who Didn’t Make It Back Home”, a song that certainly fit the purpose of the day. Another wreath was placed followed by a 21 Gun Salute and Taps. The Honor Guard this year was from 3 different V.F.W. Posts. Post 9543, Post 9683 and Post 9754. So, thank you to the Post members and those who sang making the event special to all those who attended. Thanks also to all who hung tough waiting until the last minute to ride in this year’s event and a big thank you to all our sponsors without whom this event would not be possible. This year was certainly met with challenges but they were dealt with and with everyone’s help we pulled it off and had a great turnout. Plans for next year are well under way.
