materials shortages and labour pressures,” he said. CoreLogic construction cost estimation manager John Bennett said rapid recent cost growth has impacted a range of different trade categories and components in residential construction. He said metal prices continue to be affected with further rises to reinforcing, fixings and fittings. The cost of metal also has an impact on fencing and garage doors, as well as the aluminium window industry, with substantial increases for those products too. “The effect of higher timber costs also continues to flow through the market. We are seeing knock-on effects into different industries such as landscaping supplies and kitchen cabinetry. Imported products, particularly metal based items and tiles, are rising as well as cost hikes from consultancies, affecting preliminary costs,” Bennett said. “It is important to note that other pressures are at play on the industry with labour availability and overheads impacting costs. Labour availability can also affect build times and can leave builders more exposed to market changes and holding costs. It really is a perfect storm.”

Bennett also stressed that the CCCI is based on detailed cost surveys. “It’s important to note that with about 40 per cent of the index/model representing labour costs – which have been rising, but not as quickly as some materials – this is one reason why the CCCI is showing slower overall building cost inflation than might be the popular perception.” The CCCI indicates that new dwelling consents have continued to hover around 50,000 on an annual basis, driven by smaller dwellings such as townhouses which now equate to more than half (51 per cent) of all new consents nationally - a record high. In Auckland, that proportion has surged above 70 per cent. Davidson said while smaller dwellings may require fewer materials, the volume in the pipeline indicates there will likely be no respite for the stretched materials supply chain - nor for labour capacity. He said, in turn, this is showing up as continued pressure on construction costs, especially when accounting for alterations/ renovation work and non-consented activity too.

oreLogic NZ’s Cordell Construction Cost Index (CCCI) for Q2 2022 showed national residential construction cost pressures have continued to escalate, with both quarterly and annual rates of indexed growth reaching new record highs. The CCCI indicates the cost to build a ‘standard’ 200 sqm three-bedroom, twobathroom single storey brick and tile house in Aotearoa rose 2.6 per cent over the quarter, lifting annual growth to 7.7 per cent, the largest increase since the CCCI commenced in late 2012. CoreLogic chief property economist Kelvin Davidson said the CCCI figures further support the evidence that the industry is under immense cost pressures, with no reprieve expected in the short term. This indexed model of construction costs allowed for standard build times, Davidson said, acknowledging that completion timeframes had lengthened lately as some materials remain hard to procure. “This is the swiftest rise in the NZ CCCI we’ve seen in a decade and I don’t expect these price pressures to ease for at least another couple of quarters, given ongoing

ooking back innumerable years, I am still satisfied with my very first completed project – a boatshed with a jetty onto the Waitemata Harbour. In this project we sought to create an authentic design, true to the heritage of rustic sheds and baches that were previously dotted along the Auckland coastline, too many of which have now been removed. At PDA we believe that design should maximise architecture’s experiential quality – its dynamism and serenity, the stillness or movement created within space, and importantly generate a sense of memory and place. With regards to the boatshed, we enhanced its sense of place by opening up the front wall to embrace the natural elements and clad the walls and roof in scoria red corrugated metal, a nod to the Rawene Wharf, while complementing the pohutukawa backdrop. The central post with knee braces pays homage to the structural vernacular of classic Kiwi sheds. Its walls and roof were left unlined to avoid any trapped moisture and ensure the longevity of the structure, leaving plenty of space for my client’s artistic imagination. A strong sense of personal memory was added to the milieu, with the client’s eclectic interior assemblage that includes an anchor, a lifebuoy, horse collar, candles, rope, rods, sieve, signage, numberplates, oil can, the old outboard, and a myriad of corks from multiple occasions. In pride of place however is the family heirloom McCulloch chainsaw which awaits the next zombie apocalypse.

After completing the boatshed, we went on to design the main home on the property. Now, many years later we have been given the opportunity to design another new dwelling on the site. Taking a similar design approach to that of the boatshed but with quite different results, we sought to create a modern Kiwi classic in one of our current Clevedon projects (refer to the above image). Here, we have designed a pair of floating mono-pitched roofs that hover above natural stone feature walls. This expansive roof blurs the definition between inside and outside with lounges transitioning into sundecks and BBQ areas, with fireplaces inside and outside. The architecture of this in-between living space with its straight modern lines is

contrasted to the outdoor living landscape and its biomorphic shapes that utilises ellipsoidal decks, curvaceous paving, mounded planting, and a kidney shaped swimming pool at its heart. Supply shortages – be prepared Wynyard Wood senior associate, WINCY CHEUNG, talks about the need to be prepared for supply shortages.

T

he words on everyone’s lips in 2021 was “Supply Shortage”. We are experiencing New Zealand’s biggest building boom since the 1970s and for the construction industry the shortage in materials and labour has been the focus of many discussions. Whether it be timber, steel, concrete or plasterboard – we simply can’t get our hands on certain materials fast enough or at all. So what happens now – particularly if you are planning on building. In the current climate, many builders will be looking to ensure that any cost increases can be passed onto their client. The responsibility for cost increases will therefore depend on the terms of your contract. “My builder has offered me a fixed contract price” – I hear you say and my response will be “ a fixed contract price is never a fixed price”. Many contracts used in the construction sector will allow builders to recover any cost increases from the client. The most commonly used contracts used for residential developments are the NZ Certified Builders Association (NZCBA) – Fixed Price Building Contract and the Registered Master Builders Association RBC1-2018 (New Build) contract. Both these contracts contain mechanisms which allow the builder to recover the cost of any increase in materials and/or labour.

NZ CERTIFIED BUILDERS ASSOCIATION – FIXED PRICE+ BUILDING CONTRACT The NZCBA contract allows the builder to make adjustments to the original fixed price for a number of reasons, one of which is if there is an increase in the cost of subcontractors or materials (clause 5 – Cost Fluctuations). There are a number of provisos to such recovery: • the increase must not have been reasonably been foreseen by the builder; • the increase must have eroded the 8 — Design and Build South East — 2022-2023

builder’s profit margin; • quotations and invoices must be provided as proof of increase. In the real world at present, builders are facing monthly price increases so homeowners can argue that builders should not be able to recover such cost fluctuations. However if this approach is taken then homeowners will often find that the builder is then required to factor such increases into its original price. This results in homeowners ultimately bearing this additional cost and rather than negotiating the increase if and when it arises, homeowners have in actual fact crystallised the increase from the outset. There will inevitably be a winner and loser and the approach that a homeowner chooses to take will often depend on each person’s view of the risk and whether they can manage that risk.

REGISTERED MASTER BUILDERS ASSOCIATION – RBC1-2018 (NEW BUILD)

The RBC1 contract also allows the builder to adjust the fixed price (clause 46 – Cost fluctuations). Unlike the NZCBA contract, there is no requirement to provide any evidence of price increases or that the builder’s margin has been eroded. This doesn’t mean that the builder has a carte blanche to inflate those cost increases. There is some degree of protection for homeowners under clause 22, that any adjustments will need to be agreed and if not agreed then the increase will be based on the actual and reasonable cost to the builder plus the builder’s margin.

NZS3902:2004 This form of contract is often used by clients for minor building works or small buildings (such as an extension or garden shed). That is not to say that this contract cannot be used for larger projects. NZS3902 does not include any express

right for the builder to recover any increase in the cost of materials although it does contain a right to recover any increase in costs should the builder be unable to procure certain specified materials and uses alternative materials as a substitute. However homeowners will find that many costs at risk of price increases, will be included as “Allowances”. Allowances are used in a similar manner to provisional sums or prime costs (terms used in both the NZCBA and RBC1 contracts). These are a best guess for work that cannot be priced by the builder at the time of entering into the contract for example, site works, services connections or not yet designed structural elements (a pergola where the size or materials has not yet been finalised). The actual cost will then be substituted in at a later date.

PLAN AHEAD Planning ahead may help homeowners to manage cost increases. We can provide advice on the contract to assist homeowners and builders to clearly set out their respective expectations and responsibilities. However the build contract will not resolve the supply shortage. In today’s environment, it is always important to have a good line of communication with the builder. Discuss the builder’s supply chain and whether supplies can be ordered early with a view to reducing the risk of cost increases and delays in lead times. If certain materials are in short supply, consider what alternatives you could use (just in case). Always include a buffer in your budget for cost fluctuations. These steps will not be a silver bullet to solving the supply shortage but they may be key to you finishing your project on time and within your expected budget. MANAGING BUILD COSTS IN A VOLATILE MARKET

The last couple of years have been extremely challenging for the building sector, with material prices rises, labour shortages, and a supply chain that has struggled to keep up with demand.

H

owick-based Faulkner Construction have been building architecturally designed new homes and renovations since 1981. They have “seen it all before” – and still believe there will never be a cheaper time to build your home. Faulkner General Manager Ross McConnell gives his advice on how to manage build costs in a volatile market: 1. Decide how much you can and want to spend – and commit to it. “I can resist everything except temptation,” said Oscar Wilde. The building process will send a thousand temptations your way, and you will spend more than you want to unless you are truly committed to your budget. 2. Tell your architect what you have to spend and make sure they design to your budget. Your architect will have more influence on the home you want to build than anyone else. Make sure they’re committed to designing a home that you are committed to paying for. 3. Get an independent budget estimate

from a professional quantity surveyor (QS). When your architect has completed your “Concept Plans”, pause the design process and get an independent QS to price those plans to make sure you’re designing to budget. 4. Find a reputable builder who agrees with your QS. If you haven’t done this already, take your concept plans and budget to a reputable builder and make sure they’re in general agreement with your QS. 5. Complete your building consent plans. Now that everyone is aligned with your budget, it’s time for your architect to “press on” with the design process and apply for Building Consent. 6. Get a detailed budget estimate from your builder. “If you can’t measure it, you can’t manage it,” according to management guru Peter Drucker. If your builder can’t provide a detailed budget from your building consent plans, they’re not going to be able to manage your budget when you start building.

7. Plan and protect your contingency. Every project has contingencies, but not every owner remembers to allow for them. Your QS should have included a contingency budget at step 3 – don’t forget about it. 8. Ask your builder to provide regular updates on actual vs budgeted costs. And make sure they have the ability to do this before you start building. 9. Try to avoid changing your mind and causing delays. Just kidding – everyone makes changes. Just make sure your builder can quantify the impact of these changes and delays as you go, or you may be surprised how they’ve added up at the end of the project 10. Enjoy your new home. You’ve earned it!

Auckland Unitary Plan MAJORITY SUPPORT FOR PROPOSED APPROACHES TO CHANGE A majority of submitters have supported Auckland Council’s proposed approaches for changing the Auckland Unitary Plan – the city’s planning rulebook, according to the results of public consultation.

T

he proposed changes are part of the council’s response to the government’s National Policy Statement on Urban Development (NPS-UD) and changes to the Resource Management Act requiring greater housing density across the city. The council consulted with Aucklanders from 19 April–9 May to understand whether some initial approaches to changing the Auckland Unitary Plan achieved the right balance between the requirements to enable more building height and density and protecting the things many Aucklanders value. From a total of 7,860 submissions, there was majority support for the proposed walking distances around Auckland’s city centre, 10 large metropolitan centres and rapid transit stops where apartments of 6 storeys or more must be enabled and for the council’s proposed

approach to identifying special character areas. Submitters also gave strong backing (70 per cent) for having a qualifying matter, or an exemption, to limit required intensification in areas with long-term and significant infrastructure constraints, such as for transport, water, or wastewater. Megan Tyler, Chief of Strategy, says the council wanted to hear people’s thoughts on how it was approaching the limited decisions it can make under government legislation, prior to publicly notifying changes to the Auckland Unitary Plan in August 2022. “The consultation results show a majority of submitters support the council’s proposed approach to enabling more housing density close to public transport, jobs, shops, and services and for there to be a qualifying matter to limit building height and density in some identified special character areas. “Over the coming weeks, we will be reviewing this feedback and working through options for changes to the Auckland Unitary Plan to be put before our elected members for approval,” she says. “In doing so, the council must work within the framework set out by central government, which allows the council to propose exemptions for further intensification where there is strong evidence to support it. “However, this still means there must be changes made to allow for more housing density than we currently do, with fewer blanket protections rather than more. “There is a

long way to go before final changes are decided, and there is another important opportunity for all Aucklanders to make their views heard by making a submission when the proposed plan change is publicly notified. “This gives people a say in what will ultimately be decided. An independent hearings panel will consider submissions and make recommendations to the council on the changes it thinks should be made to the Auckland Unitary Plan,” says Megan Tyler. An independent, and demographically representative, survey of over 2000 people was also carried out for the council by Kantar Public to ensure the views of a cross-section of Aucklanders were heard.

KEY FEEDBACK RESULTS FROM THE CONSULTATION AND SURVEY INCLUDE:

• Individual submitters supported the proposed 15-minute walking distance to the city centre (43%) and a 10-minute walking distance to large metropolitan centres (43%) and around rapid transit stops (38%). Results of the independent survey showed 50% supporting a 15-minute walking distance to the city centre with the proposed 10-minute walking distance to large metropolitan centres and rapid transit stops supported by 49% and 52% respectively. • Support for enabling more apartment and terrace housing around 400 metres from large town centres with good public transport access, 34% of individual submitters and 49% of survey respondents. • Support for the council’s proposal to identify some special character areas as a qualifying matter to limit building height and density in those areas, 42% of individual submitters and 66% of survey respondents. • Support from individual submitters (70%) for including areas with long-term significant infrastructure constraints as a qualifying matter to limit required intensification. Results of the independent survey showed 65% support.


DEJANA MANIC HOWICK’S STAR PROPERTY LAWYER

Council scaling up to meet growing resource consent demands Efficiency improvements and additional resource has resulted in Auckland Council processing the highest monthly number of resource consents in the past six years.

I

n March, Auckland Council completed a record 1662 resource consent applications. In April, council also completed more applications than were lodged, reducing a backlog of new consent applications that built up because of extremely high volumes at the end of 2021. In the year ending April 2022, a record 19,481 resource consents were lodged, a 12 per cent increase on the previous year (17,414). November 2021 saw the highest number of applications lodged per month (1798) since the Auckland Unitary Plan was implemented in 2016. Chairperson of council’s regulatory committee, Councillor Linda Cooper, says the team has been working hard to improve its operational performance to meet growing demand for resource consents. “Meeting the unprecedented demands for resource consent applications is a priority for Auckland Council and it’s great to see we’re moving in the right direction to get on top of the record consent applications from the end of 2021. “We are committed to making ongoing operational improvements throughout 2022,

including actively recruiting staff and working smarter to process consent applications faster.” Auckland Council is currently implementing a pipeline of work and initiatives to improve performance and efficiency. These include improvements to IT systems and an important focus on proportionate decision-making, which sees staff processing the simpler applications more quickly, reducing the overall workload and allowing more time for complex applications. Auckland Council general manager of resource consents, Ian Smallburn, says the work programme will not only help to reduce the current workload, but also better prepare council for any increased demand on its regulatory services expected later this year when new central government housing rules start coming into force. “With central government’s new rules allowing for greater housing density starting to take effect in August this year, we are anticipating a period of flux and increase in demand on our services as property owners and all those in the development sector navigate the changes.

“We want to reassure Aucklanders we are sharply focused on improving our resource consent processes to meet growing demand and will continue to do so.” The suite of new higher density housing rules requires Auckland Council to allow for more height and density to be built across the region – that means more apartments, terrace housing and townhouses, especially in places close to jobs, public transport, and services. The rules are significant and complex and will be coming into effect in stages over the next 12-18 months. The first to come into legal effect are the government’s medium density residential standard (MDRS) housing rules, which could allow a property owner to build up to three homes of up to three storeys without a land use resource consent. Whether the new rules apply immediately to an individual property owner will depend on a number of factors still being determined through the ongoing decision-making process expected to be completed mid-August 2023. Auckland Council will provide up-to-date information on the rule changes as soon as they become available.

ROAD CONNECTION SLASHES

commuting time A new one kilometre stretch of road has opened at Bremner Ridge.

T

empleton Group has opened the short stretch of new road which links Flat Bush School Road to Redoubt Road via Michael Bosher Way, saving around 12 minutes of drive time each trip. It also connects Tuscany Estate to the amenities of Flat Bush, including Ormiston Town Centre, a number of schools, public transportation and Barry Curtis Park. By taking on this traffic, the road will also relieve congestion in adjoining suburbs. The new road was built on the back of a massive earthmoving and engineering project which included a number of shear keys – a steep terrain construction methodology where densely packed earth is engineered to resist the force created by the lateral load from the soil. One shear key, which supports the new road, is 156m wide and 200m deep and has a maximum height of 42m from road level to base. A quarter of a million cubic metres of earth was excavated – around 25,000 truck movements, and construction required 175,000m3 of engineered fill at a cost of around $20m. “This section of new road, though short, was critical to unlocking the potential of the Bremner Ridge site,” says Templeton founder Nigel McKenna. “Successful developments are based on location, access amenity and community.

Templeton recognised that, at a time when Auckland is desperate for additional housing land within the developed city, zoning the entire area for very low-density housing represented a significant underutilisation of a scarce land resource. Accordingly, it applied for and was granted an integrated land use and subdivision consent to intensify the development so that it now yields 360 total sections with 60 lifestyle lots and 300 standard sections. Templeton’s total development of Bremner Ridge and the adjacent project, Fairburn, represent more than 500 lots in total.

WILL ADDITIONAL PLASTERBOARD BE DISTRIBUTED TO WHERE IT IS ACTUALLY REQUIRED? The Association of Wall & Ceiling Industries (AWCI) has welcomed the additional supply capacity of plasterboard into the industry providing that merchants can allocate fairly to all customers – not simply larger clients.

D

aniel Pepperell, president of AWCI, said, “Retail merchants have significant control over distribution of plasterboard. Large national accounts will receive their board from the merchants however we need to ensure plasterboard is fairly distributed to all levels of the industry. Previously, we have seen many contractors, who simply are not experts or qualified in interior construction, grabbing and storing product where they could which leads to significant supply issues for the specialists.” The Association of Wall and Ceiling Industries has been vocal around the current plasterboard supply challenges, leaving suppliers in a situation where they have to introduce new allocation models to manage demand. “There are other options of supply for

plasterboard. Different retail merchants stock different branded product. We are encouraging our members to talk to their local merchant representative, talk to different merchants and then follow the allocation process,” Pepperell said. “AWCI was pleased to see that MBIE revised and issued new guidance on product substitution which allows other brands of plasterboard to be used in conjunction with the Building Consent Authority and the head contractor. If the product is recognised and comes with a product technical sheet (PTS), then substitution can be made. “Winstone and other suppliers in the market such as Elephant Plasterboard or Gyprock have been as proactive and working as fast as they can to produce more product. We just want to ensure that plasterboard gets to those who need it, when they need it.”

The acquisition last year comprises around 250 hectares and consolidates the Formosa Golf Course land (170.5 hectares at 110 Jack Lachlan Drive), as well as a property of 80 hectares at 620 Whitford-Maraetai Road. Beachlands South Ltd Partnership is jointly owned by the Russell Property Group and its partners the NZ Super Fund, local iwi Ngāi Tai ki Tāmaki and Hāpai Development Property LP. Russell Property Group managing director Brett Russell said they are providing modern sustainable, high quality housing choices and lifestyles with linkages to improved public transport services. Hapai is an iwi-owned property fund that currently has 20 iwi investors. These entities recently acquired a collective 5 per cent equity stake in the Beachlands South Limited Partnership. he Flat Bush Ratepayers and Residents Association is led by president Lloyd Ratnaraja, vice president Yuva Adhikary, and secretary April Aryal. The officially incorporated group also has a treasurer and several members and recently held its inaugural meeting at Ormiston Town Centre. “We want to make the local community safer, make our environment cleaner ... and engage with people and raise awareness about how they can play a role so everyone is collaborating,” Ratnaraja says. “We advocate for the community but we also play a role in empowering people to work with the association, the Howick Local Board, Auckland Council, and police to take ownership of local issues and not just say this is a problem someone else needs to fix.” He says increasing safety in the suburb is a major focus for the group. “We’ve seen a lot of posts on the Grapevine [Facebook page] around breaking into cars and people stealing little stuff like

pot plants sitting outside driveways, people hanging around construction areas and breaking into them, and retail shops being broken into. “We want to create an awareness programme and set up a community watch in people’s streets and neighbourhoods and connect through simple things such as [messaging service] WhatsApp and work with local police. It’s about playing an active role.” Adhikary says he’s seen many changes in Flat Bush including it transforming from farmland to a “lovely, beautiful town”. “People from different backgrounds live in this area and some may not be aware of local issues and connections and how they can report crime or dumped rubbish. We can be the people on the ground, taking with the community and helping to pick up those issues.” The group has written to the Howick Local Board detailing what it says are the main issues in Flat Bush that need to be addressed. It told the board while it appreciates its efforts to address local issues, residents “feel more

needs to be done to improve road safety, clean streets and streams, plant more trees, create awareness among young people to prevent illegal garbage dumping, and involve communities in the journey towards better living”. The association says it will advocate for construction timeframes of the delayed Flat Bush Aquatic and Leisure Centre, as well as the Flat Bush Community Centre and Library, to be brought forward. While the suburb is expected to be a planned township with modern facilities and lifestyles, the works in most new subdivisions have not occurred in sequential order, inconveniencing the public, it says. The group says 5000 residents living east of Te Uho o te Nikau Primary School in Flat Bush School Road are without access to public transport bus services and that’s an example of the problems that need to be rectified. STICKING POINTS: Tricky decorations are quite the treat when it comes to Halloween, but they can prove a fright if they’re still hanging around by Christmas, for example. Although Wallsauce’s murals help set the atmosphere for any occasion, they are ‘peel and stick’ so they can be quickly applied then, just as easily, removed and stored. What’s more, we can let our imaginations run wild as Wallsauce can create murals to order based on any high quality image, even our own photos, making them ideal for birthdays too. Call them Laengsel... WHALE WAYS: Laengsel (from Denmark) has landed quite the catch with its Orka (aka orca) desk and chair. Based on a Scandinavian concept, ‘orka’ means having the drive, determination and physical or mental energy to take on a task. So, although it’d be rather hard to land an actual white whale from a desk, one could write a great novel at such a novel perch. Whether this desk (and matching chair) can encourage us to be more productive or not, it is an aesthetically pleasing, striking piece of furniture which plays with light and shade. Dogged (not dog-eared) design PET PROJECTS: French poodles woof ‘ooh la la’, princely King Charles spaniels have a throne of their own and even weary old English sheepdogs in need of a well-earned rest are flocking home to Hommes! Pretty as a fixture CRAIC-ING ON: The luck of the Irish is well known, but the light of the Irish shines (somewhat) less bright. Mullan Ceramics’ range appears to be worth its weight in (pots of) gold. And yet, they are not produced at an emerald city somewhere over the rainbow – or even at the end of one. Instead, these stylish lamps have been devised, designed and created in the Emerald Isle.
