Legislative & Regulatory Updates New State Laws Take Effect on Sept. 1 Including Permitless Carry Over 600 new laws took effect on September 1st including the ability of Texans to carry handguns concealed or openly, without a license. For business owners who have the intention of prohibiting all firearms on their private property, it is recommended that you now place a 30.05 sign at your place of business in addition to the 30.06 and 30.07. There are options for management of your business’ property. The 30.05 sign prohibits carry of a firearm without a License to Carry (LTC), the 30.06 sign prohibits the LTC holders from carrying concealed, and the 30.07 sign prohibits the LTC holders from carrying openly. Any business may want to post all, one, or none of these signs based on their preference. The 30.05 language on the sign must be 1 inch in type, in Spanish and English, and should state the following, “PURSUANT TO SECTION 30.05, PENAL CODE CRIMINAL TRESPASS, A PERSON MAY NOT ENTER THIS PROPERTY WITH A FIREARM.” Spanish – “CONFORME A LA SECCIÓN 30.05 DEL CÓDIGO PENAL ENTRADA ILEGAL, UNA PERSONA NO PUEDE ENTRAR A ESTA PROPIEDAD CON UN ARMA DE FUEGO” TNLA Participates in Farm Tax Roundtable with Congressman Gonzales TNLA President & CEO Amy Graham and Director Ryan Skrobarczyk attended an agriculture tax policy roundtable with Rep. Tony Gonzales in San Antonio. The focus of the event was to communicate the very real negative impact on grower operations of the Biden administration’s proposal to eliminate tax considerations like stepped-up basis, like-kind exchanges, and increases to the capital gains tax. Nurseries in Texas already operate on slim margins with significant startup investments required. TNLA is targeting several key Texas congressional members over the next few months to express the need to keep family operations viable through these tax considerations. TNLA Members Participate in Virtual Meetings with Congressional Offices Over the last two weeks, TNLA has conducted a series of virtual meetings with staff in key congressional offices to encourage the support of Rep. Henry Cuellar’s H-2B Returning Worker Exception Act of 2021. The bill provides for permanent cap relief for the H-2B program and recognizes the benefit of returning workers and better protection for American’s seeking employment. If you are interested in helping in this effort, please visit the TNLA Legislative Action Center to send a email to your member of Congress supporting this bill. Restriction on Rose and Other Plant Imports from Canada The USDA has announced new restrictions on the importation of rose and blackberry plants from Canada as it is a potential host plant for strawberry blossom weevil. Imported plant material will must come with a phytosanitary inspection certificate with additional language as dictated by the USDA. You can find the specific language and more information here.

TNLA Tailgate Topics: Reasons for Pruning Objective: Participants will be able to correctly recognize the four main reasons for pruning and give examples of when, why and how each type of pruning occur. APPLICATION: Pruning is the removal of plant parts to improve the plants form and growth. There are four reasons why we prune: training, to maintain plant heath, to improve the quality of flowers/fruit/foliage/ stems, and to control the growth of the plant. Be sure that participants are able to differentiate between the four reasons. This includes when, why, and how each of the pruning types take place. Training: Training by pruning is done when branch patterns, growth shape, or strength are undesirable. Most young trees and shrubs are pruned in order to remove broken, crossing or weak branches. As these trees become older, they may need to be pruned to improve their shape or for strength. Trees with a central leader (main trunk) should be pruned to eliminate branches that may compete with the central leader. When pruning for growth, branches should be removed that have a small angle of attachment to the trunk (less than 30 degrees). Branches with a wide angle of attachment should be kept (between 60 and 70 degrees) because they have a stronger attachment. Maintaining Plant Health Care: Pruning to maintain the health of a tree or shrub is often done in order to eliminate any dead, dying, or diseased wood. Insects and disease use dying wood as an entry point. It is important that pruning is done correctly and with proper technique. Unhealthy wood should be removed beyond the point of infection. Using a sterile blade a cut should be made in healthy wood and the unhealthy wood should be properly disposed. Improving the Quality of Flowers, Fruit, Foliage, or Stems: Pruning must be timed correctly in order to increase flower or fruit production. By pruning out unwanted wood, the plants energies are diverted in to the production of larger flowers, and ultimately, larger fruits. Restricting Growth: If a plant has been planted wisely its growth should not exceed the space it has been planted in. Unfortunately, not all plants were planted wisely and will need to be pruned in order to fit in their space. This includes pruning for uniformity and to keep plants looking formal.
