Former football player sues Tech for Title IX violations By ALEXA BOUTWELL Sports Editor

There are animal shelters and care programs spread throughout the Lubbock area that members of the community can volunteer with. Brenda Wilbanks, founder and executive director of the Haven Animal Care Shelter, said the shelter began in her and her husband’s house on one and a half acres of land before it expanded to seven and a half acres and multiple buildings. “When we built that house,” Wilbanks said, “a little fuzzy dog named

Snooty came and moved in there before we were even through building it, and she had puppies. So, that was our start.” The shelter focuses on quality over quantity, Wilbanks said. The purpose of the center is to find dogs and cats good homes in order to take in more. The shelter has a no-kill policy when it comes to its animals. Christine Carter, a volunteer at the shelter, said the policy does, however, limit the number of animals it can take in, but many are adopted regardless.

A Texas Tech football player, who chose to remain anonymous, is requesting a reverse of decision by a Title IX hearing panel that found him guilty of violating the university’s code, according to the Lubbock Avalanche-Journal. The student was found guilty of violating the university’s code on sexual conduct by having sex with an incapacitated woman who could not consent, according to the AJ. Tech defines sexual assault as non-consensual sexual intercourse, according to the AJ. The university defines consent as mutually understandable words or actions, actively communicated both knowingly and voluntarily, that clearly convey permission for a specific activity. The African-American freshman football player, who is under the pseudonym “John Doe,” filed an appeal after the Sept. 15 hearing that resulted in a two-semester suspension, according to the AJ. According to the lawsuit, Doe is suing the university as well as Tech President Lawrence Schovanec, declaring his rights to due process were violated as well as stating procedural and substantive errors significantly impacted the outcome, according to the AJ. The guilty verdict was appealed by the student on Nov. 4, but the lawsuit was filed Nov. 30, according to the document provided to the AJ. “This is the first time we’ve been sued on one where they weren’t happy with the resolution, and they’ve actually taken that step. So, it’s really new for us,” Ronny H. Wall, associate general counsel for the Texas Tech System, said last month, according to the AJ. “That’s probably going to make us even more guarded (than) normal because we don’t really know what we’re in for.”

Police search for hit-and-run culprit Tech looks to break losing streak, hosts Baylor today The Lubbock Police Department is still searching for the person responsible for killing 21-year-old Alcadio Estrada Barron in a hit-and-run incident near the Marsha Sharp Freeway at around 12:30 a.m. Friday. Early Friday morning, a motorist flagged down a Lubbock police officer near the Marsha Sharp Freeway and Avenue Q and said he saw a man walking in the middle of the eastbound access road, according to a LPD news release. The officer began to drive around the area, and as he approached the 1900 block, he saw Barron lying dead on the road. LPD was able to identify Barron as the victim around noon Friday, according to the release. Investigations into the incident are still ongoing, but Barron was hit, possibly more than once, with a vehicle, according to the release. The driver of the vehicle did not stay on the scene or render aid,

even though the driver was required by law to render aid to the victim. Investigators are still uncertain as to what type of vehicle struck Barron, but there was a Chevrolet emblem on the street near Barron when the investigation started, according to the release. The vehicle that struck Barron was possibly a Chevrolet, but the police cannot confirm that at this time. The Texas Tech men’s basketball team is coming off a two-game losing streak in which both games were decided by one possession. The Red Raiders fell to TCU on Tuesday, 62-61, and No. 3 Kansas on Saturday, 80-79. After being handed two losses in a row, Tech’s overall record for the season stands at 16-9. In the Big 12 Conference, the Red Raiders have a 4-8 record, keeping them at No. 8 in the conference, according to Big 12 Sports. The Red Raiders will attempt to capitalize at home as they host No. 5 Baylor at 6 p.m. today in the United Supermarkets Arena. In the loss to the Jayhawks, junior guard Niem Stevenson went

8-17 from the floor to put up 22 points for the Red Raiders. Junior forward Zach Smith was third in points with 21. He trailed junior guard Keenan Evans, who had 25 points, according to Tech Athletics. “I think it was great,” Evans said. “I think it’s really awesome that Niem (Stevenson) worked on picking it up in the Big 12 play. We just want that to continue for him. Zach and I, it’s a given that we have to play well every game to get the win, and next time, we want to have the same stats but just come out with the (win).” Tech grabbed a 12-9 lead over Kansas early in the first half. The game was back and forth until Kansas made the free throw to grab the win.
