injury upon a domestic animal when not on the owners’ real property.’” Owner’s real property is defined in the county’s ordinance as “any real property owned or leased by the owner of the dog, but does not include any public right-of-way or a common area of a condominium, apartment complex or townhouse development.” Specifically, the county’s animal control ordinance defines a potentially dangerous animal as one that “inflicted a bite on a person for which the person sought or obtained medical treatment; killed or inflicted severe injury upon a domestic animal when not on the owner’s real property; or approached a person when not on the owner’s property in a vicious or terrorizing manner in an apparent attitude of attack.” Board of adjustment members asked Nesbitt why the dogs are on the Hannon’s property. Nesbitt said it was an agreement to keep the dogs there in exchange for one of the female pit bulls and a litter. Herman said he deemed the other pit bull, Ieshia, as also potentially dangerous due to Nesbitt telling him a third female pit bull was no longer on the property because Ieshia and the other female pit bull named Layla were both pregnant at the same time during the summer. The dogs got into a fight and Layla’s jaw was broken and she had to be put down, Nesbitt said. Nesbitt argued that due to the female dog incident being on the dog’s property that Ieshia should not be deemed potentially dangerous either. The county’s animal control ordinance says deeming an animal dangerous can only be done by the county health director, according to Herman. The county’s ordinance references state statutes for deeming an animal potentially dangerous, which Herman can do. Board of adjustment chair Paul Weidman asked Nesbitt if the Keith Lane property where the dogs are housed is his property.

Nesbitt answered that it is not. If the board upholds the potentially dangerous status of the dogs, the dogs will have to be kept in a kennel or fenced area with a lock, according to Herman as well as “beware of dog” signs placed at the property. Potentially dangerous dogs are also required to be leashed and muzzled when off the property, such as walks. Herman

also said if a potentially dangerous dog is sold, he has to be notified and has to be informed of where the dog is going to be located. The board of adjustment is a quasi-judicial board in place to uphold the county’s ordinances. The board does not make the rules but hears appeals to decisions made regarding county ordinances.

The board decided to hold another meeting on Jan. 2 at 5 p.m. to make its decision whether to uphold Herman’s decision or overturn his decision. It takes four out of five members in order to overturn the decision. One board of adjustment member was absent on Tuesday, leaving only four available, so the decision will have to be unanimous to overturn.

He was given a $100,000 bond for the Polk County charges last week. Case’s attorney, Roy Neill, told Judge Powell that the new charges stemmed from a family squabble. Neill said Case was

asked by his mother to get the generator from his grandfather’s property. According to the sheriff report, Case and Amanda Maybin were arrested after they cut pad locks off a trailer at 719 Laurel Drive, Saluda, which is the home of Case’s grandfather. Did you know that 852 Polk County children – under age 5 – are living in poverty? This is equal to 26.5 percent of Polk County’s population or almost 4 ½ school busses full of children. Across North Carolina, 25.5 percent of children under age 5 suffer from the effects of poverty.* There were a total of 3,767 children in Polk County in 2010, under the age of 18, according to the census. Now in 2010 950 of those children were living in poverty. At the end of the 2012 school year 58.6% of Polk County school children were on free or reduced lunch. Poverty is directly linked to hunger. Hunger prevents so many people from living h ealth y, pr o du ctiv e liv es . Children who live in households affected by hunger are negatively affected in both their physical and mental development. This threatens their ability to become productive, contributing members of society when they grow up, which in turn threatens future American prosperity and the pros-

perity of Polk County. Every day, families are forced to make the difficult decision between buying food and paying bills and rent. Hundreds of Polk County residents rely on emergency food assistance – and other emergency assistance – from Thermal Belt Outreach Ministry (Outreach) in order to make ends meet. Since 1991, Thermal Belt Outreach Ministry has served Polk County residents and strives to meet the multiple needs of individuals, children and families living in crisis. Thermal Belt Outreach Ministry services include providing food through their food pantry and Feed-A-Kid program and helping families facing the loss of their home or utilities being cut off. This time of year, through the holiday program, Outreach purchases grocery store gift cards and distributes them to eligible individuals and families in need of a special meal. While I am sure we are all suffering from compassion fatigue over the tragedy that took place at Sandy Hook School in Newtown, Conn. this past week, I feel compelled to comment in the wake of such a horrific event. We are all saddened and scarred by the senseless murder of innocent children and their teachers and protectors. It is one of those culture-changing moments in American history and I hope we are able to fathom a way to prevent the recurrence of such appalling incidences. If you follow the news you will know that in the past year vigilant citizens and law enforcement have averted several other planned or attempted mass killings at schools and businesses. You will also have heard that there is currently a groundswell of

sentiment toward exacting gun control in our country. As odd as you may think it to be for a priest, I possess a concealed carry license that is good in almost every state in the union. I was raised with guns since my dad was an avid hunter and so I learned from an early age how to safely and sanely use both long guns and hand guns, and all modesty aside I am quite good with both. I am also an advocate of strict gun control. Just as we have to be trained and licensed to operate an automobile after a certain age of maturity, so we should all be taught how to safely and appropriately handle firearms. We should also then have to pass a skill test and a psychological screening in order to be allowed to own and (continued on page 9)

chartreuse for muddier water. Crankbaits can be used for a lot of different applications and they are designed to fish specific depths so more of them are needed, but you can still keep it simple as possible. Generally speaking, the colder water is the more subtle the action, and the warmer the water is the more erratic the action. The tried and true old school Shad Rap by Rapala is a good cold water bait. Just about everyone has at least one in his or her tackle box. It has a tight swimming action, but the downside is they don’t dive very deep. Some very good colors are: black/silver, crawdad, chartreuse/white, and perch. I like a No. 7- No. 9. The smaller baits catch fish, but are very hard to throw. My old school theme continues with Norman crankbaits.

These baits can dive a lot deeper than the Shad Rap, but they have a little more wiggle. I really like a suspending Deep Little N. Chartreuse/blue is my favorite color, this color seems to work in clear or muddy water. Lavender shad, Tennessee shad or chartreuse are good choices too. The Norman DD22 is a very good crankbait when fish are deep. Deep water crankin’ isn’t my specialty, but it works for lots of folks. We will continue this breakdown of lure selection in upcoming columns. Hope you check back then. Rob McComas is a licensed North Carolina fishing guide on Lake Lure and Lake Jocassee in S.C.
