and has demanded that the North American Specialty Insurance Company honor its obligations under the performance bond to complete the contract, according to interim county manager Marche Pittman. “We are working with the insurance company to ensure the project is completed promptly and correctly,” said Pittman. “Our main objective is to ensure that this facility will serve the needs of the citizens of Polk County for many years.” Commissioners voted on May 20 following a closed session meeting to notify the contractor and North American Specialty Insurance of the county’s declaration of the contractor’s default and termination of the contract. The largest issues with the building include that the heating and air conditioning isn’t working properly and humidity has caused the doors to expand, preventing them from closing properly. In the winter, most employees have a space heater in their office to stay warm and in the summer some rooms are too cold and some hallways and rooms are too warm. The heating and air is not controlled with a thermostat but with a computer system, said DSS Director Lou Parton. There have also been plumbing issues since employees moved into the building in December 2011. The

sewer lines do not drain properly, which causes waste to back up into the showers and floor drains, according to Pittman. County maintenance staff is currently going to the building a few times a week to flush the toilets for about 10 minutes in order to clear the system. Other issues include painting that needs repair in the hallways, Pittman said. County officials met with the bonding company last week to review a plan of action in order to correct the problems. The DSS building, located off Wolverine Trail in Mill Spring, was the county’s first “green” building, with Parton saying the utility costs are much lower than the former building. The county moved the DSS department, as well as all county services, out of the JerveyPalmer building in Tryon, which was the former St. Luke’s Hospital and had become aged and expensive to maintain. During the commissioners’ last meeting held on June 17, resident Rickie McFalls asked commissioners when the issues at DSS were going to be fixed. “When are we going to get the air conditioning and heat fixed in that building?” McFalls asked. “When are we going to get the septic system fixed in that place? It (doesn’t) make any sense to have a $2 million building and you go to the bathroom and flush it and it goes around and around. When is this (Continued on page 6)

because the certificate of occupancy was not granted on time. Some of the delay was that the heating and cooling controls were not correct in the building and the soffit had not been installed on time. Other problems that caused delays were that work on the soffit, or eaves under the roof had to be stopped near the end of construction because there was no insulation. Contractors had to spray in insulation prior to receiving a certificate of occupancy. The approximate 12,000 square foot DSS is the county’s first LEED (Leadership in Energy and Environmental Design) certified building. The county financed approximately $1.85 million for the building with state and federal reimbursements at an estimated 61 percent expected over the building’s 45-year life. The reimbursements over the years should ultimately mean the county spent approximately $750,000 for the building.

Pittman answered McFalls that he had a meeting scheduled later that week with the bond attorney and that the board of commissioners took action to invoke the bond. He said the county is meeting with several contractors who are working on the issues. “So, we’re working on it,” Pittman told McFalls. The county’s budget for the building was $2 million, while the contract with Able Construction amounted to $1,590,755. DSS was scheduled to occupy the building in November 2011 but weren’t able to move in until December 2011 with the county fining the contractors

Foothills Community Chapel youth pick it up On Saturday, June 29, Foothills Community Chapel youth will be cleaning up 100 miles of local county roads, raising money for their annual summer mission. This event serves a dual purpose – to clean up local highways and fund this summer’s youth mission trip. This summer’s trip starts July 14, traveling to Falcon Children’s Home near Fayetteville, N.C. The youth ask for the community’s help in supporting the highway cleanup and their desire to help those children who are less fortunate. Hanson receives North Carolina Environmental Education Certification Foothills Equestrian Nature Center’s Tracie Hanson, the nature director at FENCE in Tryon, recently received North Carolina Environmental Education Certification. The North Carolina Environmental Education Certification Program recognizes professional development in environmental education and acknowledges educators committed to environmental stewardship. This program establishes standards for professional excellence in environmental education for formal and non-formal educators. Hanson has spent more than seven years working with area schools to teach nature-based science to kindergarten through fifth grade students. Her commitment to her students was the incentive to get certified with the state of North Carolina. “I get to work very closely with many students in North and South Carolina school systems,” Hanson said. “Each day is filled with new adventures - whether in the traditional classroom or out in the natural classroom that is provided to us by just walking outside.” The EE certification consists of many components. There are instructional workshops, outdoor instructor led experiences, research regarding environmental education resources and facilities, teaching experiences and a community part-

nership project. Hanson collaborated on the redesign of a live animal disTracie Hanson play room and related displays at the FENCE Center. “These animals were living in the basement of FENCE’s nature center with no natural lighting and it was hard for the public to even know they were there,” Hanson said. “New enclosures and structures were built and lighting became more natural. I believe our FENCE animal friends are happier. The ‘touch feel’ room got a face lift and is now inviting for all to come visit.” The public is welcome at FENCE Center every day of the year from dawn to dusk. The animal exhibit and touchfeel room is open by appointment. Understanding the affordable care act individual mandate Editor’s note: Robin Dixon, a benefits specialist with Main Street Financial Group Inc., will offer a column twice a month explaining the ins and outs of changes related to healthcare reform. by Robin Dixon

Beginning Jan. 1, 2014 all Americans, including men, women and children, will be required to have “qualified” health insurance. Part of PPACA, the Patient Protection and Affordable Care Act (PPACA), passed March 23, 2010, the individual mandate is enforced through reporting on W-2 and annual tax filings. While there are a few exceptions, those who fail to comply will incur a tax penalty, which grows more significant over the next three years. In 2014, this penalty is $95 per adult and $47.50 per child (up to $285 per family) or 1 percent of family income, whichever is greater. In 2015, the penalty rises to $325 per adult and $162.50 per child ($975 per family max) or 2 percent of family income, whichever is greater. In 2016 and beyond, the penalty again increases to $695 per adult and $347.50 per child (up to $2,085 for a family) or 2.5 percent of family income, whichever is greater. To avoid the penalty, health insurance coverage must also be

on a “qualified plan.” Plans will be arranged by “metal” standards, and be platinum, gold, silver or bronze, with the latter being the minimum coverage allowed. Those currently enrolled on plans with North Carolina carriers may have to be rewritten to be compliant. Many carriers are generating these options automatically, and will send notice to the insured with the new plan design and premium cost. All compliant plans will have maternity coverage for all females, regardless of age or status in the family. The plans will also provide richer mental health and substance abuse coverage. Other requirements include free preventive benefits, no maximum lifetime limits, and no annual limits on essential benefits. Other than purchasing a qualifying individual plan, those covered by plans such as Medicare, Medicaid, Health Choice, TriCare and VA benefits all have qualified coverage and avoid the penalty. Those covered by a qualified group plan will also meet the mandate. In some cases, those insured before March 23, 2010 have remained on “grandfathered,” policies and are immune to the definition of quality, and other compliance requirements, at least temporarily. Maintaining both grandfathered and non-grandfathered plans is an increasingly costly and challenging

task to carriers, and some are electing to make all plans compliant. In the past, plans were underwritten with consideration to the person’s health, tobacco use, age, gender and location. With PPACA compliant plans, pricing can consider age, location and tobacco use only. Part of the law forces carriers to limit the price spread between the youngest person and the oldest person to no more than three times. For those currently covered, it is predicted that premiums will remain relatively stable for those in older age brackets, especially those that were considered unhealthy and have already been paying higher premiums. For those who are younger and currently at very healthy tiers, prices can be expected to rise significantly. While on the surface, this pricing scenario doesn’t seem balanced, it should be considered that health insurance companies have a limited profit margin of less than 4 percent. At least 80 percent of all individual policy premiums must be paid out in claims. If claim expenses fall below this mark, then the difference will be distributed to all members as a rebate. The remaining 20 percent or premium must first be used for administration, including sales, marketing and claims processing and more, before the carrier can chalk anything up to profit.

Petty Officer 2 James F. Lynch and AN Michael O’Steen, 2006 Polk County High School graduates, have completed their eight month deployment aboard the USS John C. Stennis, a NIMITZ class aircraft carrier. The USS Stennis deployed to the Persian Gulf region the end of August 2012 and returned to her homeport in Bremerton, Wash. early May 2013. James Lynch (“Jimmy”) enlisted June 2010, while Michael O’Steen (“Mike”) enlisted April 2011. Both went through boot camp at Great Lakes, Ill. Following boot camp, Lynch was assigned to the Nuclear Power Training Command in Goose

Creek, S.C. graduating in April 2012. The Stennis is his first ship assignment. He is an electricians mate in the reactor department. O’Steen went from Great Lakes to Coronado, Calif., San Diego, Calif. and Pensacola, Fla. training to be a rescue swimmer for one of the air wing squadrons attached to the Stennis. He has since cross-trained and become a fuelie. He is an aviation boatswain fuels mate and works on the flight deck. Lynch and O’Steen had been communicating fairly regularly and knew they had both been assigned to the Stennis. However, with their jobs being so different and at opposite sides of

the ship (O’Steen on the flight deck and Lynch down in the bowels of the ship) and with 6,500 people onboard, the odds of seeing each were extremely long. O’Steen found Lynch in the galley early on and they continued to see each other as their schedules permitted. The Stennis is currently in dry dock for maintenance and repairs. Jimmy Lynch is the son of Kim and Debbie Lynch of Columbus and the grandson of Charlie and Marjorie Neff of Hendersonville, N.C., formerly of Columbus. Saluda artist Jim Carson recently won an honorable mention award at Plein Air Richmond 2013, in Richmond, Va. The winning painting is titled “Liberty View,” and was painted on the grounds of St. John’s Church, which gained historical immortality in 1775 as the site of Patrick Henry’s “Give Me Liberty or Give Me Death” speech at Virginia’s second revolutionary convention. The awards’ judge was Stephen Dougherty, the editor in chief of Plein Air magazine. Carson’s next Plein Air workshop in Saluda will be Oct. 24-26. (photo submitted)
