A Message from the President Michael E. Esmond

Election Time at the TCBA

The last few months have been busy at the TCBA and TCBF. From the Judicial Dinner in February, to the golf tournament in March, to Law Week in April, we’ve run the gauntlet. Thanks to all of you who supported and volunteered to make these events fun and successful. But before you think it’s time for a break, we’ve got more to do.

First, if you’ve followed the efforts of TCBA and the Tulsa County District Court Judges to raise awareness about and identify solutions to the increasingly common and potentially fraught intersection between artificial intelligence and the practice of law, you’ll be interested in attending the premier of the Oklahoma Chief Justice Colloquium on Civility and Ethics on May 7, 2024. It will feature two federal district court judges and their personal experiences with AI in their courts. The presentation will take place at the Oklahoma Judicial Center and will be streamed for Bar participants. It promises to include a lively discussion on the need for or against AI rules for lawyers – an issue the Tulsa County legal community has been leaning into for months.

Second, I hope you received the TCBA email and have taken the opportunity to participate in the online survey about our Tulsa Lawyer Magazine. With many people increasingly consuming information digitally and the cost of printing and mailing always

increasing, TCBA, striving to stay on the cutting edge of content delivery and be good stewards of members’ dues, is weighing the cost, benefits, and member preferences to determine whether it would make sense to offer the opportunity to have an opt-in or opt-out election to receive print copies of the magazine. The survey will also provide us with information about preferred content that will shape the types of articles and information included in the magazine. If you didn’t take the survey but have opinions you’d like to share, feel free to contact me or the TCBA staff.

Finally, and most importantly, it’s election time at the TCBA! This issue includes profiles of several attorneys who are ready, willing and able to serve as future leaders of our organization. You’ll see in their profiles that the candidates for officers, directors, and OBA delegates have demonstrated strong leadership skills and made generous contributions of their time and talent to the TCBA and TCBF. As Philip Hixon wrote in his President’s message around this time last year: “We should all thank them for showing up. Our Association wouldn’t be the same without them.”

Since there’s no contested races this year, I feel confident giving my full endorsement to all the candidates. I’m especially excited about Stephanie Jackson’s installation as president. She is already well underway with planning for the 2024-2025 fiscal year

and recruiting members to fill important positions on committees and sections. If you’re interested in volunteering for a role, now is the time to reach out.

As for me, it will be an honor to serve as Past President under Stephanie’s leadership. If, like me, you’re curious what the role of Past President involves, the bylaws describe the job as follows:

6.4 Past President. The immediate past president of the Association shall serve as Past President, shall chair the Nominations and Awards Committee, and perform such other duties as may be assigned by the President or by the Board of Directors.

It kind of reminds me of a quote attributed to Mark Twain: “Some people bring joy wherever they go, and some people bring joy whenever they go.” I look forward to the opportunity to do both - spread joy by helping to recognize members with awards for the hard work and efforts they put into making the Association a great organization, and spread more joy by eventually clearing out and making room for the more-talented, up-and-coming leaders that will follow.

If elected my goals are to work cohesively with the other elected members of the board, and to perform the duties of President in accordance with the TCBA bylaws by ensuring a strong relationship with the board, bar staff to stay connected with our programs during this upcoming fiscal year to make meaningful selections of standing committee chairs to support and advance committee efforts. I will continue to maintain a pulse on TCBA and TCBF programs, projects, and committee efforts to develop meaningful relationships to support committee efforts, and CLEs.

In addition, my goal is to continue to enhance an inclusive culture that embraces, promotes, and facilitates diversity and inclusiveness where every member has the opportunity to fully participate at all levels of leadership and succeed professionally. I believe we will continue to build upon their legacies through our member programs, investing in our YLD, and bridging relationships with other local and national bar organizations. I look forward to working with President Stephanie Jackson and the other members of TCBA and TCBF to continue the future growth and recognition of our organization and its membership.

Which qualities that you bring to this office do you want members to consider when voting for you:

My qualifications for President-Elect in terms of our Bylaws are demonstrated by my several roles and years of service with our committees and the Boards of TCBA and TCBF. It has been my privilege to serve the TCBA and TCBF in several offices and on our committees since becoming a member in 2004. I am committed to advancing our organization’s status and recognition both within our State and among other bar associations around the Nation. As your President-Elect, I look forward to reviewing and progressing our long-range plans to prepare for the future. My institutional knowledge and collaboration with you, the stakeholders, across our membership will provide a solid foundation to lead and grow this organization into the future.

Lawyers Helping Lawyers

Monthly meetings led by a Lawyers Helping Lawyers Committee member. The small group discussions are intended to give group leaders and participants the opportunity to ask questions, provide support and share information with fellow bar members to improve their lives –professionally and personally.

I would like to serve the TCBA and its leadership to help the organization achieve its important goals. I would like to help the TCBA increase its revenue sources, so it can do more.

Which qualities that you bring to this office do you want members to consider when voting for you:

Thus far, nearly every organization and project that I have been privileged to lead has achieved or exceeded its expectations. To give one example, when I was part of the leadership of the Litigation Section, our goal was to make the section a compelling platform for serious litigators in Tulsa and beyond. We hoped to do this by significantly increasing our membership and putting on marquee events that would attract the whole the TCBA membership. We exceeded our goals in December 2023. Our membership nearly doubled; and for the first time ever, the TCBA hosted a sold-out event featuring all the available new federal magistrate judges in the Northern and Eastern Districts of Oklahoma. I hope to bring the same industry and creativity to this position to help the TCBA meet its goals.

Kalan Chapman

Lloyd has been a member of the Oklahoma Bar since 2008. She graduated from Oklahoma State University in 2005 and the University of Tulsa College of Law in 2007, where she was the Candidates Editor for the Tulsa Journal of Comparative and International Law and earned her certificate in Alternative Dispute Resolution. Before being named the Executive Director of Tulsa Lawyers for Children, Kalan was in private practice in Tahlequah with her husband, Grant Lloyd of Lloyd Legal, PLLC.

Qualified as a domestic violence court expert, Kalan has represented children and parents in deprived

cases in rural counties as well as prospective adoptive parents in high-risk adoptions. Before joining Lloyd Legal PLLC in private practice, she worked for international accounting firms KPMG and BDO and regional firm HoganTaylor, representing clients in high-dollar tax issues before going in-house with one of her clients, Laredo Petroleum, Inc.

During law school, Kalan interned for the Tulsa County Public Defender’s Office, Civil Division, representing children. It was there that she found her legal passion. She was nominated for the Oklahoma Family Law Student of the Year award and received the CALI Award for Excellence in Intellectual Property. Meet your TCBA Business & Corporate Law Section Chair - Spencer C. Pittman

Spencer C. Pittman is a shareholder with the law firm of Winters & King, Inc., and practices in the areas of business litigation and transactions. He received his B.A. from the University of Oklahoma and his law degree from the University of Tulsa College of Law. Mr. Pittman is an author and presenter on the issue of generative artificial intelligence (GenAI), and has advised members of the bar and judiciary on the best practices in the use, limitations, and risks of GenAI in the legal profession. He enjoys

writing and is a frequent publisher in the Oklahoma Bar Journal in a wide variety of legal topics.

He is currently on the Board of Adjustment for the City of Jenks, serves as a Jenks Chamber Ambassador, and is a graduate of Leadership Jenks (Class 34). By The Numbers

In 2022, the Oklahoma Bar Association (OBA) conducted a Member Survey for the purposes of obtaining feedback from the membership about the services it provides and to gather input on the future direction of the organization. The Survey included a section of questions regarding social issues, including race and diversity efforts in the legal profession. The overall results showed an overwhelming support for the OBA to become a leader on the topic of diversity, equity and inclusion (DEI). But do the numbers accurately reflect the reality of the rate of growth of diversity of the legal profession? Yes.

• 18,588. There are more than18,588 lawyers in Oklahoma. The majority of the OBA membership identifies as White/Caucasian.

• 12%. The percentage of non-White lawyers in Oklahoma is approximately 12%. According to data from the 2020 Census Bureau, non-Whites in Oklahoma make up about 27% of the total State population.

The OBA Survey was limited in its breath and depth of analysis of the diversity of lawyers in Oklahoma: it failed to include questions related to gender identification or the make up of the LGBTQ+ lawyers in Oklahoma. The Survey did provide a clear picture that the legal profession in Oklahoma is mostly male, mostly white, and aging. New, younger lawyers,

comprise the minority of Oklahoma lawyers. According to the OBA Survey, almost 50% of all OBA members have been members for over 30 years. Only about 14% have been members for less than 10 years. Moreover, the OBA reported in April 2023 that Oklahoma has more practicing attorneys over the age of 70 than we have practicing attorneys under the age of 30.

Over the past ten years, there has been a 5% increase in the number of lawyers in the United States. That number pales in comparison when viewed in light of the fact that during the 1970’s, the number of lawyers grew by 76%. Let’s take a closer look at what the American Bar Association’s data from 2023 reveals about the make up of lawyers nationwide.

• 1.3 Million. According to 2023 statistics from the American Bar Association, there are more than 1.3 million lawyers in the United States.

• 61% of lawyers identify as men.

• 39% of lawyers identify as women.

• 21%. The percentage of lawyers who are nonWhite increased over the past decade from 11% in 2013 to 21% in 2023.

• 5.5%. The number of lawyers of Asian descent increased from 2.5% in 2013, to 5.5% in 2023.

• 6%. The number of lawyers of Latin American descent (Hispanic) rose from 3.7% in 2013, to 6% in 2023.

• 5%. The number of Black lawyers barely increased from 4.8% in 2013, to 5% in 2023.

• 3%. The number of mixed-race lawyers currently practicing law.

• 1%. The number of Native Americans, Native Hawaiians or Pacific Islander descent practicing law. This is the smallest racial or ethnic group of practicing lawyers nationwide.

Unfortunately, there are no reliable statistics on the total or percentage of LGBTQ+ lawyers. Some of the data gathered by the ABA from roughly 800 law offices across the country show there is an increase in lawyers who identify themselves as LGBTQ+, but the data seems to suggest that less than 4.2% of lawyers identify as LGBTQ+.

Despite these gains over the past ten years, the number of Black, Hispanic, and Native American lawyers continues to be an underrepresented amount among lawyers compared to their share of the U.S. population: Hispanics account for 19.1%, Blacks account for 13.6%, Asians account for 6%, and Native Americans account for roughly 3% of the U.S. population.

To put this into context for our Tulsa County justice system, we can look at the current make up

of the Tulsa County District Court. There is 1 Black elected District Judge, Judge Sharon Holmes, among the 14 elected Tulsa County Judges. There are 3 appointed Black Special District Court Judges: Judge Wilma Palmer, Judge Loretta Radford, and Judge Tanya Wilson, among the 18 Special District Court Judges.

These numbers may be subject to interpretation, but the statistical analysis is directly affected by the fact that in 2023 only 21 States reported the race and ethnicity of members of the bench and bar. We must also acknowledge that whether we take a state or national approach, the numbers across the board seem to mirror two things: one, the overwhelming majority of the lawyers identify as White, and two, there is a slow, but steady increase in the number of non-White lawyers every year. As our population becomes more diverse, we should be mindful that our justice system reflects the diversity of the community it serves.

Lynn Miller Law Day Book Club Hosts Program with Author on Tuesday, March 19, 2024

Attorney Mark Darrah spoke about his book of essays, A Catalogue of Common People, in conversation with Law Day Committee member, Martha Rupp Carter. His name is familiar because he is a Studio Tulsa Commentator for Public Radio Tulsa and a number of his stories have appeared on The Back Page feature of the Oklahoma Bar Journal. Darrah entertained a sizeable group of interested readers at the Bar Center on March 19, sharing the background of some of his essays, providing readings of several, and exchanging in a lively series of questions and answers with attendees. His book was offered for sale at the event and is available on Amazon. Darrah's essays are in turn hilarious, heart-warming, and touching, with a little something for everyone. The diverse topics range from the benefits dogs provide at celebrations with cooking, fishing with grandfather, the feud between Bob Willis and "Pass the Biscuits Pappy" O'Daniel, a Yugoslavian college roommate, a vacation on speed, and rumors that go viral. Attendees are eager for Darrah to publish his next book of essays. They hope one story will detail his involvement in the first performance mystery specifically written and staged for a nudist colony. We are staying tuned for Mark Darrah's next writing adventure.
