Each year, many member businesses are nominated by their peers, but after voting by the entire membership and panel judging, only a select few win. Background Tom moved with his parents from the Midwest to California when he was 10, growing up in Torrance, California, graduating with a Bachelors degree in History from Pomona College in Claremont, California and a Masters in International Relations with an International Economics specialization at Columbia University in New York. During his business career, Tom pioneered opportunities for US companies in the emerging markets of Eastern Europe, and as entrepreneur started successful businesses in Austria and Russia. In 2008, the Papkes purchased Potamus Press from the original owners, Tom and Mona Strong. They were attracted to the business because of the passion that the Strongs had for providing products and services that produce results. Tony volunteers as a counselor for Happy Hearts Kids Camp, where children find happiness after grieving the death of a loved one. The camp is provided by the Hemet Hospice Volunteers & Community Hospice Services. In addition to their personal service, Tracey and Tony are members of the Temecula Valley, Murrieta and Menifee Chambers of Commerce. After winning “Sterling Business of the Year” through the Temecula Valley Chamber of Commerce this year, the couple has vowed to continue supporting organizations and causes close to their hearts. For example, three months after signing on as an Advisory Board Member for Michelle’s Place, Tracey’s mother was diagnosed with breast cancer. After two surgeries and radiation therapy, her mom is cancer free. Her devotion to helping organizations raise funds for breast cancer research is as fierce as ever. The future for the Papkes and Potamus Press are bright. Tony will continue to hold his position as Controller for Kinder Morgan in Orange County, while Tracey runs the day-to-day operations of the business. Both look forward to getting more involved with the Temecula Valley business and nonprofit communities. He has been married for almost 10 years to his beautiful wife Yvonne, and has 2 children, Alejandro and Yesenia. Adam generously gives his time to many local charities and enjoys coaching both soccer and basketball. He is also a black belt in Shaolin Kempo, which he earned while visiting the Shaolin Temple in China. He recently expanded his business by adding a Real Estate division called 1st Action Real Estate. Adam received the Temecula Valley Chamber of Commerce’s Ambassador of the Year Award in 2006. The Inland Empire Affiliate was incorporated in 1998 and hosted its inaugural Race for the Cure® in 1999. The Inland Empire Affiliate service area covers more than 27,000 square miles, serving a population of over 4 million residing throughout San Bernardino County and Riverside County. Our Affiliate office is located in Temecula; however we also have a Breast Cancer Resource Center located in the city of Rancho Mirage in the Coachella Valley. Each year the Komen Inland Empire Race for the Cure® and other Affiliate events raise significant funds while increasing awareness for breast cancer, celebrating survivorship, and honoring those who have lost their battle with the disease. Up
to 75 percent of our net proceeds remain in the Inland Empire to support breast health education, outreach programs, as well as diagnostic and treatment support services for those in need within our local communities. The remaining 25 percent supports the Susan G. Komen for the Cure® Award and Research Grant Program to fund innovative breast cancer research. The Inland Empire Affiliate has awarded nearly $5.5 million dollars in community grants to local non-profit organizations since 1999. Temecula McDonald’s really does care about the service provided to the community. Nicole Albrecht, 2011 Citizen of the Year Financial Accounting Services TVCC Member Since: 1999 Nicole Albrecht, of Canyon Lake, is a partner in Financial Accounting Services in Temecula. At 32, Albrecht, is an enrolled agent, a designation that allows her to represent clients before the Internal Revenue Service. In addition to her full-time job, Nicole participates in about 20 organizations and causes… Professionally, she is vice president of the Temecula chapter of the American Business Women’s Association; treasurer and executive board member of the Murrieta Chamber of Commerce; a volunteer with the Valley Young Professionals; board member of the Southwest California Legislative Council; an organizer of the Business Network International Chapter of the Temecula Wine Country Business Growers and more. She has also written articles on tax planning for two local business publications. In the community, just to name a few of her volunteer activities, Albrecht is a Bible study, boot camp and child care leader at Cornerstone Community Church, and a volunteer at Oak Grove Center for Education Treatment and the Arts and at the Assistance League of Temecula. She has provided Thanksgiving meals for the homeless by gathering items to stock the local food pantry. She led a fundraising drive for Give2thetroops to collect supplies for the military overseas. At Christmas, she “adopted” a single mom and her two special-needs children. While her present day schedule is that of a busy professional working mother, 15 years ago Nicole was in a completely different line of work… UFC Fighting.
Nicole worked at a pizza place back then and they were putting flyers for an upcoming UFC fight on top of the pizza boxes. One of the fight promoters stopped by to drop off more flyers and asked if she wanted to fight. Albrecht is 6 feet tall and athletic. She had played on the varsity high school basketball team as a freshman. “I was promised a month with a trainer and $800 to jump in the ring,” Albrecht recalled. “I was excited and I needed the extra cash to help pay for college books and groceries, so I accepted. In the first minute of the fight, I knocked out the other fighter,” she said. “Before I could get into the changing room, I had a manager, trainer and promoters signing me up.” Over the next five years, Albrecht trained and fought in seven bouts, winning four and drawing one. Jeff Kurtz, 2011 Chairman’s Choice Award, Promenade Temecula TVCC Member Since: 1997 On any given day, you might see Jeff Kurtz, General Manager of Promenade Temecula in and around the center, walking the mall, looking at details. He’s walking the mall because, it’s not just the store names, the service from retailers or the parking accessibility that makes a class A regional shopping center successful – it’s the details. Kurtz has a long history of shopping center management. Prior to his stewardship of Promenade Temecula, Kurtz was instrumental in the opening of Victoria Gardens and was the primary point person over every operational detail at other class A shopping centers in Southern California and Las Vegas. Each center presents its own set of unique features, challenges and opportunities and Kurtz thrives in meeting new challenges and making the most of every opportunity. Kurtz shares his unique skills and talents with a variety of Temecula non-profits including serving on the Board of Directors at the Boys and Girls Clubs of Southwest Riverside County, the Board of Directors of The Temecula Valley Chamber of Commerce as First Vice Chair, and is currently the

shopping experience, then I know I am making a difference both to my community and to my employer.”

Currently Kurtz is working on new center enhancements that will add to the overall shopping enjoyment at the property. For instance, a new full set of high-end restroom facilities was just opened at Promenade Temecula to meet the increased demand guests have for convenient restrooms at the Macy’s Women’s wing of the center. In addition to beautifully appointed men’s and women’s facilities, the new restrooms include a second family restroom and lounge area. This family restroom offers private facilities where fathers can accompany children to the restroom and new mothers will enjoy the privacy of nursing rooms where babies can nurse and fall into a quiet slumber away from the bustle of shopping activity. “These facilities are the result of well thought through design that meets a young family’s needs when shopping,” commented Kurtz. “Our hope is that guests find their way to these areas and appreciate the level of service we are striving to provide, each and every day.” Another detail Kurtz is working on is a plan to add another interactive water feature to the expansion area. Kurtz is very “hands-on” in these projects and will be working with fountain designers over the summer to design and fabricate a water feature that will enhance and compliment the newly installed “Wine Walk” that Kurtz developed to help bring the essence of Wine Country to their guests while at the center. Kurtz enthusiastically supports the Temecula community and takes a great deal of pride in the idea that his attention to detail helps the entire community enjoy a higher standard of living. “Everyone at Forest City is proud to be a part of the Temecula Valley, and it’s a pleasure to be a part of this team. If my involvement can help enhance a guest’s overall

he Southwest California Legislative Council has had a busy couple months as our legislators in Sacramento started their 2012 session with a flurry of activity — some of it good, much of it not so good. In a normal 2 year session in Sacramento, you might expect to see some 3,000 – 3,300 new bills introduced. In the 2011-2012 session that number exploded to 4,234 new bills. That’s 4,234 pieces of legislation designed to impact some area of your business or personal life that our legislators thought you couldn’t live without. As if that’s not enough, since the cut-off date for new bill on February 24, there have been at least 200 more bills that have been subject to what they euphemistically refer to as ‘gut-and-amend’. These are bills that didn’t make it through the process last year so they simply rip the innards out and present it as an amended bill that bears no resemblance to its previous incarnation. These bills are often the most deceptive and bear the closest scrutiny because in some cases they have already passed through the committee process but have been stalled or pulled by the author prior to full floor votes. Defenders of the gut-and-amend process claim it is necessary to allow legislators to bring up new topics of concern after the original deadline has passed. It provides a way for the legislature to stay current with emerging events. But far too often these bills are used for last minute maneuvers designed to circumvent the system rather than work through it. Innocuous bills that have wended their way through the committee approval process and are approved for a floor vote suddenly end up saying or doing something totally foreign to the original intent. Yet when it gets dropped on a legislator’s desk at the end of a 16 hour day, with 100+ other bills scheduled for a vote in 5 minutes, nobody knows what was in it until the smoke has died down and somebody actually takes the time to read what they passed. Frightening – yet the Legislature is rife with stories about bills that snuck through exactly that way. The increased pace of legislation in Sacramento is reflected in the actions of the SWCLC. Last year we took action on just 30 bills — we opposed 20 and supported 10. This year we have already taken position on 26 state bills, one federal bill and have supported

Working Hard for Your Business business efforts to return the Ontario airport to local control and to keep some 70 state parks open, including Mt. Palomar State Park. Last month we took a ‘SUPPORT’ position on a bill by local Senator Bill Emmerson (SB 1566) that would authorize the state to re-allocate the funds they had promised new cities that were subsequently filched by the state during last year’s budget crisis. California’s four newest cities are all located in Riverside County but the fact that they are all in districts held by Republican legislators who had not signed on the Governors proposed tax increase is probably just a coincidence. Wildomar lost 22% of its annual budget to this pilferage, Menifee nearly 18%. Jurupa Valley faces one of two unpleasant alternatives — either disincorporate as a city or cut public services, including public safety, to the bone. It was wrong to do this after promising the funds as a projection of their start-up costs. We are hopeful that SB 1566 will be passed and that these cities, including SWCLC partner Wildomar, will be made whole again. We also supported SB 1374 (Harman), a bill which allows businesses to rely on good faith advice by a state agency. There are literally hundreds of state agencies, commissions, committees and task forces with regulatory power in this state, many of them overlapping, some of them contradictory. This bill says if you rely on the advice of a state agency to comply with whatever regulation they are charged with, you are not liable for damages if another agency comes back to you down the road because you didn’t comply with what they think the regulation says. A big help for businesses to simplify the process and control your costs of compliance. A full description of issues we have supported or opposed will soon be available on our website, which is currently undergoing a long delayed upgrade. news California Supreme Court rules employers not required to enforce meal breaks
R
ecently the California Supreme Court issued its ruling in Brinker Restaurant Corporation v. Superior Ct. The ruling ends the wait endured by California employers since October 2008 for clarification regarding their responsibilities and duties when providing meal and rest periods to their nonexempt employees, but raises additional issues concerning class procedure. Brinker Restaurant Corporation, which operates Chili’s Restaurants and other casual dining restaurants in California, was sued in 2004 in a putative class action in which Plaintiff claimed that Brinker had failed to provide meal and rest periods, or had provided them at the wrong time in the shift. At issue was whether an employer must ensure that employees take meal and rest periods, or merely authorize employees to take them and not dissuade them from doing so (leaving the employee to freely choose to take, or not take, a break). The Court concluded that an employer must relieve the employee of all duty for the designated period, but need not ensure that the employee does no work.” “The employer satisfies this obligation if it relieves its employees of all duty, relinquishes control over their activities and permits them a reasonable opportunity to take an uninterrupted 30-minute break, and does not impede or discourage them from doing so. What will suffice may vary from industry to industry, and we cannot in the context of this class certification proceeding delineate the full range of approaches that in each instance might be sufficient to satisfy the law.” Labor Code states that an employee is entitled to one meal period if he/she works a shift of five hours, and a second if he/ she works a shift of ten hours or more. The Court held that “no such timing obligation is imposed, and an employer satisfies

its meal period obligations by providing one meal period for shifts over five hours and two meal periods for shifts over 10 hours.” However, the Court held that the first meal period must be authorized to commence by no later than the beginning of the sixth hour, and that any second meal period must be authorized to commence by no later than the beginning of the eleventh hour. The Court rejected Plaintiff’s attempt to further circumscribe the timing of the authorization to commence the first meal period, and rejected Plaintiff’s argument that providing the meal period before the employee’s first rest break is per se illegal. Rather, the Court held, the order of rest and meal periods may be determined by business practicalities as long as all applicable breaks are timely provided. In a nutshell, the Court concluded that “employees are entitled to 10 minutes rest for shifts from three and one-half to six hours in length, 20 minutes for shifts of more than six hours up to 10 hours, 30 minutes for shifts of more than 10 hours up to 14 hours, and so on.” On the whole, the Brinker decision is a positive development for California employers, but raises additional and interesting issues concerning the amenability of claims with disputed elements to class treatment. That Prevent Us From Losing Weight • Skipping Breakfast- We all know that breakfast is the most important meal of the day. Many people think that if you skip breakfast you will save calories and you will shed more pounds, but quite the contrary. In fact, this bad habit adds pounds. A recent study found that those who ate ready to eat breakfast cereal or even muffins had significantly lower BMI (body mass indexes) than those who skipped breakfast. • Clean Your Plate Syndrome- Serving sizes are much smaller than we place on our plates and what we visualize. Portion sizes at restaurants or even what we serve ourselves on an average size dinner plate are far greater than one serving. This packs on numerous uncounted calories and ultimately packs on the bulge. Check the label and stick to the portion size, even if you have to put the rest in the refrigerator or take home a doggie bag. • Eating at your desk- Everyone is busy. We eat when we can fit a few bites in our mouth between jobs, picking up kids and keeping our families together. This is why you need to take time to eat a well balance meal with small snacks in between. Make time for meals as often as you can. When you designate only the dining room, kitchen and restaurants as your eating area, you are less likely to be distracted and overeat. • Eating Late Nights- This is one of the most common ways people sabotage their weight loss goals. They have been good all day and had a reasonable dinner. Then they sit on the couch and they get a sudden urge to eat. Others eat late nights because they work long hours and do not have time to eat during the day. Which brings us back to snacking at your desk. Make sure to eat a well balance meal for breakfast and lunch with a small snack in between to prevent hunger or boredom binging late at night. • Fat-Free Everything- Eating fat free everything is not the best way to balance your diet. Many people believe that the way to lose weight to is lose the fat from your diet. In addition to making food taste good, fat also makes you feel satisfied. If you cut out all fat from your diet, you will feel the need to eat more calorie-full foods like cookies and pretzels. Keep your calories to about 20-30 percent of good fats such as olive oil, peanuts, avocados and fish oils. • Alcohol- Beer, wine or spirits pack calories mercilessly. Not only does alcohol contribute seven calories per gram, but it has the effect of making you eat more during a meal. If you are going to drink, space each drink you have with a glass of water and avoid any high sugar and calorie packed tropical and frozen drinks. Also, do not head out for a wild night on the town without eating something first.
• Skipping the Gym- Many dieters think that cutting calories back will be the solution to weight loss and a healthy lifestyle. This may work initially to drop a few pounds, but it will not help you with your muscle tone, your lean body mass and its function to increase your metabolism. It may even cause loss of muscle mass as well as yo-yo dieting. • Sleeplessness- Everyone needs their sleep. Our bodies recover during sleep, burn fat during sleep, reduce our stress levels and insulin levels and restore our cells for the following day. Lack of sleep causes your body to shut down and to perform at a less productive rate. Just one extra hour of sleep a night will help you be more alert and have more energy to make your workouts better. • Negative Attitude- If you want it, you can achieve it if you work hard. This applies to anything in life. Use this motto. A positive attitude and constant affirmations will keep your mind clear of negative energy and you will stay focused on your goals. • Lack of Support- Everyone needs a support group. Your support group may be your family, your friends, your trainer, your co-workers or your dog. Everyone needs someone to turn to. It is alright to use your support group to talk to and to be accountable to. Most people work better and accomplish more goals knowing that their loved ones are watching out for them. Workout with a partner and push each other. If one of you does not want to come to the gym or wants to eat a Ding Dong, the other one should encourage them to stay of track. Fit Tips 5 ways to stay on track 1. Take a multi-vitamin each day 2. Make small attainable goals and track your progress. 3. Start a walking group during your lunch hour. 4. Log all your meals 5. Drink at least 64 ounces of water. Personal Challenge Eat 6 meals a day. Break up all of your meals into smaller parts with breakfast, lunch and dinner to have a ratio of 40% carbohydrates, 35% protein and 25% fat. Snack in between with a fruit, vegetable and a protein. D
o you remember anxiously counting down the seconds on the clock, filled with anticipation for the moment recess begins to be unleashed onto the playground? Sprinting out to the monkey bars, swings, or handball courts isa glorious childhood memory for most of us of a time when life was simpler. Now, imagine laboring to squeeze out from behind your desk, self-consciously bumping into your classmates, becoming out of breath and being left behind again because you can’t keep up. Sadly, for nearly one in three children this is the new reality in America. According to the Center for Disease Control and Prevention, the percentage of adolescents aged 12-19 years who are obese has more than tripled in the past 30 years. We are already seeing chronic diseases such as high blood pressure, high cholesterol, diabetes, sleep apnea, cardiovascular disease, in addition to psychological problems and poor self-esteem. More commonly found in heavy adults, these problems are being diagnosed in teens and pre-teens that are overweight and obese. What is causing this epidemic? Some experts blame video games and inactivity caused by advancing technology while others claim fast food advertising campaigns are the culprit. Parents are constantly managing influences in the child’s environment, but ultimately parents are the best example and strongest influence to which children are exposed. There’s hope childhood obesity can be prevented, even reversed. It is our responsibility as leaders to ensure this next generation doesn’t, in fact, live fewer years than their parents by setting a better example. Recently discussed at the 28th Annual Obesity Society Conference in San Diego, proven effective behavioral approaches for weight management

Healthy Parents, Healthy Kids include weekly sessions with a health professional, physical activity, portion control and use of meal replacements. Consider a weight management program like, Medifast Weight Control Centers, which offer one-on-one support, meal replacements and portion control guidelines. To increase exercise, get the family involved in community activities. Temecula is full of local hiking trails and neighborhood bike paths the whole family can enjoy free of cost. Participate in a 5K race or local youth sports league such as National or American Little Leagues, Murrieta Mesa High School’s Women’s Soccer Team, Temecula Valley High School’s Men’s Wrestling Team, and North County Edge Volleyball Club to name a few. Ultimately, making a healthy environment the default increases your odds for an optimal life with your loved ones today and for generations to come.
