Section One: General Information Definitions Complex: The Utah Department of Transportation main office located at the Calvin Rampton Complex, 4501 South, 2700 West, Salt Lake City, Utah 84110 Excess Property: Real property that is owned by the Utah Department of Transportation that has been designated at the Region level as excess to future transportation purposes, of any value, located outside of the current right of way limits. First Right of Refusal: In the disposition of real property at any private sale, first consideration shall be given to the original grantor as per UCA 72-5-111(2)(a). Region: UDOT has designated four geographical regions throughout Utah. To see a map showing the boundaries of each of the UDOT Regions, follow this link, then scroll to the Downloads heading and click on Region Map. The following list identifies the counties that each region serves: Region 1: Serves Box Elder, Cache, Davis, Morgan, Rich & Weber Counties Region 2: Serves Tooele, Salt Lake & Summit Counties Region 3: Serves Daggett, Duchesne, Juab, Uintah, Utah, and Wasatch Counties Region 4: Serves Beaver, Carbon, Emery, Garfield, Grand, Iron, Kane, Millard, Piute, San Juan, Sanpete, Sevier, Washington and Wayne Counties Region Excess Property (Q-Summary) Package: Documentation that the Region Right of Way Engineer/ Consultant prepares for signature authorization from the Traffic, Planning, Environmental, Right of Way Divisions along with the approval of the Region Director to identify the land as excess to future transportation needs. Surplus Land: Real property that has been deemed excess to future transportation needs at the Region level and has been authorized for disposal by the department’s Deputy Director. UDOT–owned property, of any value, located outside of the current operating right of way limits, which has no present transportation purpose and which the Region or authorized designee has determined, in writing, has no future transportation purpose is deemed surplus land. Surplus Land (Complex) Disposal Package: Documentation that is prepared by the Complex Surplus Land Coordinator for review and approval by UDOT’s Executive Leadership’s to declare property as surplus. Vesting Deed: A legal document, by which a person obtains ownership of a property, most commonly in real estate holdings.

Real Property Disposal Authority §72-5-111: 72-5-111. Disposal of real property. (1) (a) If the department determines that any real property or interest in real property, acquired for a highway purpose, is no longer necessary for the purpose, the department may lease, sell, exchange, or otherwise dispose of the real property or interest in the real property. (b) (i) Real property may be sold at private or public sale. (ii) Except as provided in Subsection (1)(c) related to exchanges and Subsection (1)(d) related to the proceeds of any sale of real property from a maintenance facility, proceeds of any sale shall be deposited with the state treasurer and credited to the Transportation Fund. (c) If approved by the commission, real property or an interest in real property may be exchanged by the department for other real property or interest in real property, including improvements, for highway purposes. (d) Proceeds from the sale of real property or an interest in real property from a maintenance facility may be used by the department for the purchase or improvement of another maintenance facility, including real property. (2) (a) In the disposition of real property at any private sale, first consideration shall be given to the original grantor. (b) Notwithstanding the provisions of Section 78B-6-521, if no portion of a parcel of real property acquired by the department is used for transportation purposes, then the original grantor shall be given the opportunity to repurchase the parcel of real property at the department’s original purchase price from the grantor. (c) In accordance with Section 72-5-404, this Subsection (2) does not apply to property rights acquired in proposed transportation corridors using funds from the Marda Dillree Corridor Preservation Fund created in Section 72-2-117. (d) Nothing in this Subsection (2) or Section 78B-6-521 creates an assignable right. (3) (a) Any sale, exchange, or disposal of real property or interest in real property made by the department under this section, is exempt from the mineral reservation provisions of Title 65A, Chapter 6, Mineral Leases. (b) Any deed made and delivered by the department under this section without specific reservations in the deed is a conveyance of all the state’s right, title, and interest in the real property or interest in the real property.

Disposition of Excess Property Rights If the department has aquired property rights in land in proposed transportation corridors, and some or all of that land is eventually not used for the proposed transportation corridors, the department shall dispose of the property rights in accordance with the provision of section 78B-6-521.

Sale of Property Acquired by Eminent Domain (First Right of Refusal) UCA 78B-6-521 (1) As used in this section, “condemnation or threat of condemnation” means: (a) acquisition through an eminent domain proceeding; or (b) an official body of the state or a subdivision of the state, having the power of eminent domain, has specifically authorized the use of eminent domain to acquire the real property. (2) If the state or one of its subdivisions, at its sole discretion, declares real property that is acquired through condemnation or threat of condemnation to be surplus real property, it may not sell the real property on the open market unless: (a) the real property has been offered for sale to the original grantor, at the highest offer made to the state or one of its subdivisions with first right of refusal being given to the original grantor; (b) the original grantor expressly waived in writing the first right of refusal on the offer or failed to accept the offer within 90 days after notification by registered mail to the last-known address; and (c) neither the state nor the subdivision of the state selling the property is involved in the rezoning of the property or the acquisition of additional property to enhance the value of the real property to be sold. (3) This section shall only apply to property acquired after July 1, 1983.

Distinction between “Excess” and “Surplus” Property There are required procedural steps in place both at the Region and Complex (Headquarters) levels that must be followed to declare property surplus, meaning approved for sale. It is important to note here that property owned by the department has to be declared excess and no longer needed for transportation purposes at the Region level before it is declared surplus and can be sold. Region approved excess land is considered surplus land only upon receiving UDOT’s Executive Deputy Director’s signature approval to dispose of the property. Up until such time, and upon Region review and approval, the subject parcel is considered only as excess to future highway transportation needs and not surplus for the purposes of selling the property. Please keep in mind that the time frames listed below are meant to be a guideline and may change significantly depending upon the property complexity and parties involved in the process.

Section Two: Real Property Disposal Process Real Property Disposal Process Workflow There are two distinct workflow processes that a property goes through to be designated for sale. First, the property has to be reviewed at the Region Level Authorization Process (Part I) to determine if there is any future transportation need for the property. If the property is not needed for future transportation purposes, it is deemed excess and forwarded to the Complex for review and processing. Second, the property undergoes a review and approval process at the Complex Level Authorization Process (Part II) to determine if the Region level excess property can be designated as surplus and sold. While there are several steps in the Complex authorization process, the property can only be sold once it is reviewed and authorized to be sold by the Utah Department of Transportation’s Deputy Director. During the Complex Level Authorization Process, the First Right of Refusal Process begins. The Surplus Land Coordinator at the Complex verifies whether or not the original owner retained or waived this right. If the First Right is retained, additional process steps are followed. These steps can be viewed on the Real Property Disposal Process Workflow on the follow page. **NOTICE** The following diagrams and tables detailing process steps are considered general in nature and should not be construed as a commitment to sell real property, as such matters require formal approval by the Utah Department of Transportation’s Executive Management.

Region Excess Property (Q-Summary) Package is received by the Complex Right of Way Design Program Manager and the Complex Right of Way Property Disposal Process Begins. Right of Way Design Program Manager conducts the Conformity Review as specified in the Right of Way Design Manual. Region Excess Property (Q-Summary) Package passes the Conformity Review and moves forward for processing.

5 Day Minimum —

During the Conformity Review errors discovered on the required conveyance documents require correction to be moved forward through the Complex disposal process. The package is returned to the Region Right of Way Engineer to coordinate the correction of the errors for resubmittal.

Right of Way Imaging Specialist conducts quality assurance review on plan sheets and maps. Region Excess Property (Q-Summary) Package passes the Map /Plan Sheet Review and moves forward for processing.

2 – 4 Day Minimum

During the Map/Plan Sheet Review errors discovered on maps/plan sheets require correction to be moved forward through the Complex disposal process. The package is returned to the Region Right of Way Engineer to coordinate the correction of the errors for re-submittal. Complex Right of Way Surplus Land Coordinator prepares the Complex Surplus Land Disposal Package approval documentation. During this step of the process, the Complex Surplus Land Coordinator begins the valuation of the property, verifies whether or not the First Right of Refusal has been waived by the original owner and schedules time with UDOT’s Executive staff to obtain authorization signatures to sell the property. • Right of Way Director • Planning Director • UDOT Deputy Director (Must include Deputy Director’s Signature to declares property as Surplus in order to be sold) • FHWA Program Manager (Signature needed if the property is adjacent to an Interstate and/or acquired with federal funds)

UCA72-5-111(2)(a) The First Right of Refusal has been waived by the original grantor or the original grantor’s heirs. The property continues on to Step 7C of the disposal process. If the First Right of Refusal has been retained by the original grantor or the original grantor’s heirs, the Surplus Land Coordinator sent out a 90 day notification letter informing them that the property is available for sale. Section Three: Documentation Required for Submission As part of the online inquiry, a copy of the vesting deed of the parcel needs to be submitted. The vesting deed provides documentation to the Region that the Utah Department of Transportation owns the parcel, and can be obtained by contacting the County Recorder’s Office in which the parcel is located. Note: The vesting deed can be submitted in one of two ways : (1) The vesting deed document can be scanned and uploaded directly to the online form. Just click on the “Attach a File� link on the form and choose the file to be uploaded from your files, OR (2) Fill out all of the information required on the Real Property Online Inquiry Form, then mail a copy of the vesting deed to the UDOT Region office in which the property is located. When mailing the vesting deed, please add seven (7) days to the processing time frame. If you choose to mail in the vesting deed, select the appropriate Region for mailing information to display.
