Mediation: Apowerfultoolfor resolvingcommercialproperty andconstructiondisputes

Appleexpects$10bnhitto earningsafterEUtax ruling

Apple ha s declar ed thatit will take a $10b n earnings hit init s four th fscal quarter, af ter the Europ ean cour t’s ruling thatit mu stpay €13b n in bac k ta xe s to Ireland .

In a fling to the stock market, Apple said : “O n September 10, theECJ announced that it had set aside the 2020 judgment of the General Cour t and confrmed the European Commission’s 2016 state aid de cision

“A sa result, the company ex pec ts to re cord a one -time income ta x charge in it s four th fs cal quar ter ending September 28 , of up to approximately $10bn, which willincrease the company ’s ef fe ctive ta x rate for the quar ter.”

In a separate statement the company said it was “dis appointed” withthe de cision, and that the European Commission was tr ying to retroactively chang e the rules and ignore the fact that Apple’s income was alread ysubjec t to ta xes in the US However withthe cour t’s de cisionnow fnal – it will not besent back to

a lower cour t fora retrial – the Department of Finance, in conjunction withRevenue and the National Treasur y Management Agenc y (N TMA) , is planning to windupthe escrow account in which the Apple ta x moneyhas been held for the last six year s.

While there remains a possibility that other EU countries might make a legal bid for some of the proceeds, the Cour t of Justice ruling implies that the ta x was legally owed in Ireland. There may be a deduction from the fund based on ta x that Apple, whos e chief executiveis Tim Co ok, has since paid in America on profts that wererepatriated from subsidiaries here

Asked if other states might look fora slice of the revenue, Ireland’s Finance Minis ter Jack Chambers saidit was not possible tocomment on the likelihoodofsuchclaims

“T here have been some third -country adjus tments alread y made in the contex t of the escrow fundthatwas es tablished,”

said “W hat we’re going to do now, over the next number of months, [is] bringa fnal determinationon what amount will transfer from the escrow fund to the Irish exchequer.”

The Government initially put €14.3bn into the escrow account in 2018 , but the value of the fund has since fuctuated, eventhough it was mos tly invested in shor t- to medium-term sovereignandquasi- sovereign bonds, with investment permit ted only inhigh -rate eurodenominated fxed income securities.

The value of the fund was also reduced when €246m was taken out in 2021 to allow Apple pay ta x in anotherjurisdiction.

The investment policy for the fund was initially agre ed by the Minis ter for Finance and Apple. An investmentcommitteewith an equalnumber of member s appointed by the NT MA and by Apple was responsible for oversight and for monitoring the performance of the investment managers It met four times last year ■
