SALW Control Strategy for BiH 2013 - 2016

Pursuant to Article 17 of the Law on the Council of Ministers of Bosnia and Herzegovina (BiH Official Gazette, issues no. 30/03, 42/03, 81/06, 76/07, 81/07, 94/07, 24/08) and following recommendation made by the BiH Ministry of Security, the Council of Ministers of Bosnia and Herzegovina, at its 58th session held on 24th July 2013 hereby issues the following

BiH SALW Control Strategy 2013-2016

I. GENERAL

The Strategy is a comprehensive document that aims to enhance efficiency of all stakeholders in the area of SALW control in Bosnia and Herzegovina. The document particularly focuses on bringing the legislations in line with international standards, improving control over internal and external trade in weapons, decreasing the rate of incidents involving illegal weapons and as well as the numbers of illegal weapons owned by the population, boosting of citizens’ confidence in BiH bodies at all levels, and reducing surplus SALW in the possession of BiH Ministry of Defence. By implementing the set strategic objectives, as well as by building on the international and regional cooperation in this field, Bosnia and Herzegovina contributes not only to advancing of general security locally, but also regionally and globally.

Pursuant to requirements, the 2001 UN Programme of Action1 and the OSCE Document

on SALW passed initially in 2000 and re-issued in 20122, as well as other international documents concerning the issue, Bosnia and Herzegovina approached the problem systematically by adopting and implementing the 2006-2012 SALW Strategy. The 20132016 Strategy is a continued effort by the BiH institutions to reduce the safety and security risks that arise from SALW.

BACKGROUND

Presence of illegal weapons enables organised crime and terrorism to thrive, thus representing key security risk that slows down the economic growth and development of Bosnia and Herzegovina. The number of incidents involving illegal weapons is the matter of great concern. Recognition and acknowledgment of International Community’s recommendations concerning curbing of the aforementioned negative repercussions of illegal weapons entails a requirement to act in an efficient and coordinated manner in order to suppress illegal manufacture, procurement, possession, trading and smuggling of SALW, and its other negative effects.

An inter-institutional panel of experts founded by the Council of Ministers, BiH SALW Control Coordination Board, initiated the process of developing and adopting of the Strategy.

COORDINATION BOARD FOR SALW CONTROL

Coordination Board for SALW Control was founded by Bosnia and Herzegovina Council of Ministers’ Decision (BiH Official Gazette, issue no. 72/05, 58/07) mandated to plan, coordinate, direct and supervise activities aimed to implement SALW Control Strategy and, consequently, provide safe environment.

The Coordination Board is tasked with identifying and assessing SALW impact on the society, population’s safety and security, and economic and social development. In addition, the Coordination Board observes closely the process of implementation of the Strategy and communicates activities envisaged in the Strategy document to the public, supports the institutions in mobilising resources required for conducting of those activities envisaged, and coordinates activities among stakeholders in the Strategy implementation process.

Another task of the Coordination Board is to review and update the Strategy document in response to operational changes resulting from the implementation process. In addition, the Coordination Board is obligated to report to the BiH Council of Ministers regularly on the progress in achieving the Strategy goals, to report to the UN in line with the UN Program of Action, and to OSCE in line with the OSCE SALW Document.

In the course of its work, the Coordination Board has become aware of the clear interconnection between SALW control mechanisms defined under the UN Program of Action and the activities aimed at prevention of armed violence as described in the Geneva

Declaration on Prevention of Armed Violence and Development, signed by Bosnia and Herzegovina in 2006. The Coordination Board is responsible for implementation of the Geneva Declaration and reporting on the progress made in its implementation.

DEFINITION OF SMALL ARMS AND LIGHT WEAPONS (SALW) At present, there is no internationally agreed definition of the term small arms and light weapons (SALW). As a rule, the Strategy uses the following definition:

For the purpose of the implementation of this Strategy, taking into consideration the risks that SALW entail for Bosnia and Herzegovina, the Strategy also includes weapons and ammunition beyond those in the above definition. By taking this approach, the Strategy contributes to the adequate treatment of all aspects of SALW control.

„Small arms and light weapons are man-portable weapons made or modified to military specifications for use as lethal instruments of war. Small arms are broadly categorised as those arms intended for use of individual members of armed or security forces. They include revolvers and self-loading pistols; rifles and carbines; semiautomatic rifles; assault rifles; and light machine guns. Light weapons are broadly categorised as those weapons intended for use by several members of armed or security forces serving as a crew. The category includes heavy machine guns; hand-held and mounted grenade launchers; portable anti-aircraft guns; portable anti-tank guns; recoilless rifles; portable launchers of anti-tank missile and rocket systems; portable launchers of anti-aircraft missile systems; and mortars under 100 mm calibre.“

2008 - 2012 SALW STRATEGY IMPLEMENTATION RESULTS During the 2008-2012 implementation period, the relevant BiH institutions achieved evident results in advancing SALW control. Results have been achieved in the field of legal framework improvements, setting up of SALW electronic registers, enhancing of internal and foreign trade in weapons, destruction of surplus weapons and ammunition, harvesting and destroying of weapons possessed by civilians, conducting awareness campaigns, as well as meeting the requirements for regular reporting to international organisations, i.e. UN and OSCE. Aiming to enhance the control mechanisms of foreign trade, Bosnia and Herzegovina has enacted the Law on Control of Foreign Trade in Goods and Services of Strategic Importance for BiH Security (BiH Official Gazette, issue no. 103/09).

There are twelve laws on weapons and ammunition in Bosnia and Herzegovina. These laws

are neither harmonized among themselves nor in the relation to international standards, which often results in different treatments and actions concerning the issue. However, there have been numerous legislative initiatives to harmonize laws on possession and carrying of weapons in BiH with the relevant EU regulations. Those initiatives resulted in the enactment of the Law on Weapons of Brčko District of BiH (Brčko District of BiH Official Gazette, issue no. 02/10). This Law has been brought in line with the aforementioned international regulations. Initiatives also resulted in passing of the RS Law on Weapons and Ammunition (RS Official Gazette, issue no. 070/07), as well as the Law Amending the RS Law on Weapons and Ammunition (RS Official Gazette, issue no. 24/09), and cantonal laws on

weapons in the BiH Federation that are partially harmonized with international regulations.

A significant progress has been achieved in digitisation of data referring to weapons possessed by civilians. Based on Article 4 of the Agreement on establishment of electronic data exchange system for data in police and prosecutors’ records, the exchange of weapons related data is made possible. The electronic system, i.e. data exchange server is situated at the BiH Police Agencies Coordination Directorate. Also, entity and cantonal ministries of internal affairs and Brčko District Police all have electronic records of weapons. The BiH Law on Movement Control of Weapons and Military Equipment has been enacted (BiH Official Gazette, issue no. 53/09), and the electronic system has been set up to track weapons and military equipment movements in Bosnia and Herzegovina.

From 2009 until October 2012, a total of 4,522.70 tonnes of surplus ammunition and explosive ordnance was destroyed along with 30,081 pieces of surplus SALW on BiH Ministry of Defence and Armed Forces stock. The decreasing trend in weapons and ammunition destruction – as shown in diagram 1.1 – is a result of limitations concerning infrastructure, technology, personnel and budget.

In the observed period, over 5,000 pieces of weapons illegally possessed by the population were destroyed.

In 2010, a campaign to raise awareness of negative aspects of possessing illegal weapons was implemented. The campaign focused on various cities in Bosnia and Herzegovina aiming to raise awareness in population, NGO sector and media as to the dangers and repercussions of illegal weapons possession.

The Coordination Board for SALW Control in Bosnia and Herzegovina has been reporting regularly to the UN and OSCE on the progress in the area of small arms control in Bosnia and Herzegovina. These reports largely contribute to the transparency of relevant processes, but also to Bosnia and Herzegovina’s international standing. In the latest report on small

arms (Small Arms Survey 2012)3, Bosnia and Herzegovina was rated 18th out of 159 countries which presented reports on implementation of commitments stipulated in the UN Programme of Action and International Tracing Instrument.

PRINCIPLES USED IN STRATEGY DEVELOPMENT The Coordination Board for SALW Control in Bosnia and Herzegovina developed the 2013-2016 Strategy for SALW Control in Bosnia and Herzegovina. In the development of the Draft Strategy, UN Development Programme methodology for strategic planning was applied.

This document was developed through comprehensive process of consulting of all stakeholders in SALW control and is based on the BiH international commitments, experience gained through implementation of previous Strategy documents, realistic requirements of BiH institutions, identified problems that BiH is facing in this field, and defining of projects and activities to improve SALW control.

The Strategy incorporates international SALW standards. In addition, all activities, including development of the Strategy, of the Coordination Board for SALW Control in BiH use guidelines contained in the following documents:

• UN Convention against Transnational Organised Crime; • UN Protocol Against the Illicit Manufacturing of and Trafficking in Firearms, Their

Parts and Components, and Ammunition;

• UN Programme of Action; • Geneva Declaration on Armed Violence and Development; • OSCE Document on SALW; • EU Common Position on Arms Exports; • EU Strategy to combat illicit accumulation and trafficking of SALW and their Ammunition.

Moreover, this strategic document points to the issue of support and assistance to victims of SALW, the importance of an even-handed approach to males and females in the process of implementing relevant control mechanisms, as well as Bosnia and Herzegovina’s clear commitment to implement adequate measures in environment protection where control processes could have a negative impact on the environment.

The Strategy includes specific projects to facilitate activities defined by Strategic Goals.

In determining projects’ costs and identifying fund sources, the analog method was used to estimate costs by comparing the costs of similar projects in past to future ones; the bottomup method was used to identify required resources and estimate the costs of individual activities; and the parameters assessment – a method based on standardised parameters indicating unit cost of an activity.

The Strategy will not cause additional burden upon BiH Institutions’ budgets but it will direct relevant bodies to acknowledge the need for planning and allocating budget funds for carrying out of SALW control activities. Projects described in the Strategy that require additional funds will be funded through international assistance programs and donations.

In order to improve security in Bosnia and Herzegovina, the region, and globally, institutions of Bosnia and Herzegovina take measures and actions to improve all aspects of SALW control based upon the principles of efficiency, transparency, merit and professionalism – in

SIGNIFICANT FACTORS AND RISKS IN STRATEGY IMPLEMENTATION Successful implementation of the Strategy will largely depend on timely identification of risks and application of risk management measures. For the purpose of this Strategy, risk is defined as the likelihood of developments that could have negative impact on achievement of strategic goals. Identified risks to the implementation of the Strategy can be divided in three main groups of aspects:

• Security • Financial, and • Political Security aspect. The growing complexity of resolving SALW issue owned both legally and illegally requires focusing primarily on security aspects. SALW and their ammunition, in themselves, pose a security risk. There is no absolute security and, therefore, a certain degree of risk is always present. The intention behind the implementation of the Strategy is to

reduce risks to admissible level.

Security risk in the Strategy implementation refers especially to the strategic goals that stipulate SALW and ammunition disposal, and illegal weapons harvest campaign implementation. Furthermore, the risks include: a) health hazard and threat to lives of individuals in illegal possession of weapons and those who guard or handle stores weapons and ammunition, or are involved in surplus weapons disposal; b) risks of illegal use and illegal trade in weapons; c) risks related to weapons and ammunition storing and stock management.

The risk of explosion accidents at ammunition storage sites are particularly worth considering, given the amount of dated and chemically unstable ammunition.

Also, the Strategy acknowledges the risks effecting the environment and, therefore, envisages development of environment study and implementation of all activities related to management and final treatment of SALW on environmentally acceptable manner and in line with EU standards. In implementing of campaign to harvest illegal weapons, it is necessary to apply measures to prevent illegal trade in weapons and similar negative effects that can occur during amnesty period.

The Strategy underlines the importance of ensuring that adequate protective equipment is available and the highest safety standards are adhered to in the process of implementing strategic goals in order to reduce the potential for accidents.

Financial aspect. Implementation of the Strategy will significantly depend on availability of funds for realisation of strategic goals/programs/projects. This method of strategy development will provide a clear insight to the donors into Bosnia and Herzegovina’s commitment to improve specific areas defined by the Strategy.

Political aspect. For a successful implementation of the Strategy, commitment and effort are required from BiH authorities at all levels in order to attain the strategic goals prescribed in the document as well as political stability in Bosnia and Herzegovina. In the process of developing of the Strategy, distribution of BiH constitutional competencies relevant to the issue, has been carefully considered. Therefore, the Strategy aims to advance coordination of activities and SALW control.

In developing of Project Proposals in the Strategy’s Appendix, identifying, measuring and control of risks pertaining to all three aspects detailed above were considered.

STRATEGY IMPLEMENTATION MONITORING AND EVALUATION PROCESS

Continued monitoring of implementation will be conducted by the Coordination Board for SALW Control. Project realisation success rate will be measured against previously defined indexes.

Strategy evaluation will be lead by the Coordination Board for SALW Control in cooperation with other governmental, nongovernmental and international organisations.

OBJECTIVES AND PROGRAMS The Strategy recognises areas of strategic importance for SALW control improvement in Bosnia and Herzegovina and defines them through four strategic goals as follows:

Accomplishment in SALW Control Strategy implementation will be rated through continued monitoring of project implementation and periodic evaluation of results achieved.

Improvement of control of internal and external trading of SALW

Legal framework brought in line with international standards is the basis for quality SALW control practiced by relevant authorities of Bosnia and Herzegovina. Existing laws on weapons and ammunition in BiH are all put in place on the basis of constitutional competencies of the Republika Srpska entity; the ten cantons of the Federation BiH; and BrÄ?ko District of Bosnia and Herzegovina, respectively. Those laws are not coordinated among them. The Coordination Board for SALW Control in Bosnia and Herzegovina will work on bringing about conditions for synchronisation of BiH laws on weapons both internally and in relation to international standards. Recognising the importance of the role that both legislation initiators and lawmakers have in the process, its focus will be on entity and cantonal ministries of interior, as well as the entity/cantonal parliaments in order to promote basic requirements for coordinating the laws on weapons with the relevant international standards.

Prevention of illegal trade in SALW is an important segment of SALW control. Illegal trade prevention not only contributes to BiH security but also to security in the region and beyond.

Relevant BiH institutions will continue to strengthen human resources capacities through training programs and procurement of equipment needed for illegal trade prevention.

Additionally, the Strategy underlines the importance of continued improvements to the legal framework and complementary mechanisms that serve as measures of control in

prevention of illegal trade in weapons that BiH is committed to.

The Strategy acknowledges the requirement for closer inter-agency cooperation in implementing of the legislations concerning internal and foreign trade in weapons in order to facilitate adequate information and position exchange among different bodies involved in weapons trade control and their respective competencies.

In order to keep up with the pace of contemporary trends in information technology application, BiH institutions will advance data registries and IT systems required by the relevant implementation regulations. This especially applies to ballistic and mechanoscopic analysis systems, movement control of weapons and military equipment, and IT system for foreign trade in weapons.

Objective 2: Reduction of illegal SALW presence will be introduced through implementation of the following strategic programs:

Collection and disposal of illegal SALW

Raising awareness on SALW risks

Improvement of capacities for keeping, storage and disposal of SALW

In order to establish proper mechanisms for SALW control, it is necessary to have accurate statistical data. As statistical data are collected at different levels of government and there is no unique methodology for their collection, this Strategy underlines the importance of defining the minimum requirements for the same approach in collection of data. For that purpose, it is necessary to develop a single form for collection and monitoring of statistical data pertaining to SALW in Bosnia and Herzegovina.

Illegal weapons pose a security threat in Bosnia and Herzegovina, and there is an increase in number of incidents involving the use of illegal weapons. Competent police agencies in Bosnia and Herzegovina have recognized the need to act on this issue, and are ready to put in the procedure laws/acts on amnesty. Amnesty for voluntary submission of weapons is a prerequisite for weapons collection campaign. This Strategy underlines BiH’s commitment to launch a comprehensive campaign for collection, registration and disposal of illegal weapons in the forthcoming period.

Raising the awareness on risks of keeping the small arms and light weapons is as equally important aspect of this Strategy. The Coordination Board for Control of Small Weapons shall coordinate implementation of such campaign through cooperation with media and non-governmental sector.

It is necessary to improve capacities for safe keeping, storage and disposal of small arms and light weapons. Police agencies, judicial bodies and civil protection units have limited capabilities for storage and safe keeping of weapons. There will be a comprehensive analysis of their current capacities and requirements in order to improve safety standards in the field of storage of weapons.

Objective 3: Management over small arms and light weapons in possession of competent institutions and agencies in Bosnia and Herzegovina shall be carried out through implementation of the following strategic programs:

One of the greatest security challenges that Bosnia and Herzegovina is facing is a threat of uncontrolled explosions of ammunition and explosive ordnance stored in military storages.

It is necessary to act urgently on resolving surplus weapons and ammunition in accordance with principles adopted by the BiH Presidency (through sale, donation or destruction).

Disposal of surplus weapons and ammunition shall be carried out employing civilian and military capacities for disposal of ammunition in Bosnia and Herzegovina, through implementation of national and international contracts and agreements and application of strict regulations of control and supervision over the disposal process. The Ministry of Defence of Bosnia and Herzegovina shall conduct control, supervision and verification of disposal of ammunition and explosive ordnance. As additional mechanism, nongovernmental sector or other parties shall be given a chance to independently monitor the disposal process, in order to improve the transparency of the process.

The required safety standards for storage of ammunition and prevention of theft of ammunition from storages shall be improved. In order to ensure safe keeping and storage of ammunition and weapons, it is necessary to improve the safety of infrastructure in accordance with international standards.

For accurate keeping of records and lists of weapons, ammunition and explosive ordnance, there will be a comprehensive IT system for stockpiles management at the Ministry of Defence of Bosnia and Herzegovina.

Objective 4: International and regional cooperation and cooperation with NGOs shall be

RACVIAC) and international organizations shall continue for the purpose of exchanging experiences, improving standards and meeting international obligations.

Non-governmental sector has its share in strengthening the control mechanisms over small arms and light weapons. The Strategy recognizes a category of “victims of small arms and light weapons”, and foresees implementation of activities regarding identification of victims of small arms and light weapons and of their needs. Special emphasis shall be given to the use of weapons in cases of domestic violence, and on different influence that weapons have

on men and women.

Project aim:

Laws on weapons in Bosnia and Herzegovina that are harmonised internally and with international standards.

End users:

Entity and cantonal ministries of internal affairs and BrÄ?ko District police.

Project relevance:

Bosnia and Herzegovina, as signatory to the Agreement on Stabilisation and Association Agreement, is obliged to harmonise its legislation with the acquis communautaire.

There are currently twelve laws on weapons in Bosnia and Herzegovina that regulate this area in different ways, which results in different practices within the territory of Bosnia and Herzegovina.

Project description:

Conferences and workshops on topics pertaining to the harmonisation of laws on weapons and ammunition in Bosnia and Herzegovina shall strengthen the awareness of decision makers as to the importance of harmonising the laws on weapons with international standards.

This project is based on an assessment by experts and professionals concerning the basic provisions of laws on weapons that ought to be harmonised with international standards, such as Directive 91/477/EEC and 2008/51/EC, as well as with the UN Protocol on Weapons.

Based on the assessment and analysis of the conformity of laws on weapons with international standards, produced by

the United Nations Development Programme, a series of thematic workshops with representatives from entity, cantonal and BrÄ?ko District judicial and executive bodies will be held. Thematic workshops shall serve as a platform for discussion aimed at strengthening the awareness of authorities concerning the importance of harmonising the laws.

A draft law on weapons and ammunition that is harmonised with the above international standards shall be developed and shall serve as a foundation for the adoption of harmonised draft laws at the entity, cantonal and BrÄ?ko District level.

Expected results:

A proposal of the draft law on weapons and ammunition harmonised internally and with international standards, bearing in mind the constitutional competencies in Bosnia and Herzegovina.

Representatives of the ministries of internal affairs, governments and parliaments at the entity, cantonal and BrÄ?ko District level will become familiar with the need for harmonisation of the laws on weapons and ammunition internally and with EU Directives.

Draft laws put into procedure.

Organise conferences and thematic workshops on the minimum requirements necessary for harmonisation of the laws on weapons in Bosnia and Herzegovina with relevant EU Directives and the UN Protocol on Weapons.

Police agencies in Bosnia and Herzegovina, Intelligence-Security Agency, Indirect Taxation Authority and the prosecutors’ offices.

Project relevance:

In order to achieve their goals, criminal organisations are coming up with new ways to conduct the illicit trade in small arms and light weapons. It is necessary to ensure permanent training and education for law enforcement agencies in this field, provide equipment for their work and more efficient cooperation on preventing and fighting the illicit trade in small arms and light weapons.

Project description:

Organise interactive training, courses and workshops aimed at familiarisation with the specificities of research and processing of this aspect of organised crime, with a focus on education on the applicability of special investigative enquiries.

The project should meet the actual and most urgent needs of the competent institutions in BiH in their fight against the illicit trade in small arms and light weapons. There will be a list of required equipment for this purpose.

Expected results:

Improved efficiency amongst competent agencies and institutions in BiH to combat the illicit trade in small arms and light weapons, which will be reflected in greater numbers of investigations and prosecutions.

Project implementation activities:

1. Organise training, courses and workshops for familiarisation with the specificities of research and the processing of this aspect of organised crime.

Project relevance:

In addition to meeting its international obligations Bosnia and Herzegovina will achieve a better position in the region and ensure closer cooperation within the region through the tracking of marked weapons and ammunition; this will result in a strengthening of institutions and the overall system for the removal of weapons that find their way into communities through the illicit trade and provide for easier and more simple monitoring of the trade in weapons and their components.

Project description:

“In its main intention, the Protocol is designed in such a way as to assist member countries to promote and strengthen cooperation in their fight against the illicit trade in weapons and their components and ammunition.�

The Ministry of Foreign Trade and Economic Relations of BiH, which is responsible for regulation of the area of manufacturing of weapons and military equipment and their external trade, is responsible for implementation of the Protocol. The Ministry is currently in the process of submitting a proposal to the Council of Ministers for adoption of a legal act that will enable implementation of obligations from the Protocol. Since the Protocol stipulates as basic guidelines the establishment of closer cooperation amongst country signatories to the Protocol in the fight against the illicit manufacturing of and trade in weapons, its components and ammunition this can be taken as a good foundation for its implementation. In regard to compliance with the guidelines defined under Article 8 of the Protocol and in accordance with Article 5, paragraph (3), both of which regulate the marking of weapons, it is clear that this issue should be quite high on the priority list for our country.

The project will rest on legislation that has yet to be developed, which is an obligation from the Protocol, and on supporting instruments still to be created, i.e. regulations that will enable that the obligation from the Protocol referring to the marking and tracking of weapons be implemented.

Bosnia and Herzegovina ratified the Protocol against the illegal manufacturing of and trade in small arms, their components and ammunition (hereinafter the Protocol) on 1 April 2008, seven years after the Protocol was adopted by the UN General Assembly on 8 June 2001.

In addition, the legal framework, when adopted, must contain appropriate instruments that will make implementation on the ground possible.

Within further activities it will be necessary to establish a functional filing/archive system created in such a way that it is easy to consult and simple to access information. Furthermore, being guided by the framework introduced earlier and guidelines from the Protocol, it is necessary to procure equipment that will facilitate the implementation of the Law. Upon obtaining expert advice through coordination with the appropriate authorities, modalities for the conduct of training should be identified so that appropriate bodies can achieve a working capability within the newly established legal framework as well as be able to use the archive and equipment for tracking marked weapons. Then the process of implementation of the obligation to the operational level will follow i.e., oversight of companies that are obliged to do the marking. Thus, once the training has been completed the marking of items and their tracking will start both within the national territory and internationally if exported.

The Protocol also contains the guideline that whatever is done must rest on a simple system which will be easy to put into operational use. This is a clear provision that has to be adhered to within the implementation of project activities.

In view of the above stated, the below stages of the project can be identified.

Expected result:

The legal framework for the implementation will be established, which is the main obligation from the Protocol, and the following obligations will be fulfilled:

Organisations and individuals gain an increased capability to implement the Protocol, which is primarily the responsibility of the Ministry, namely MoFTER, and all services that deal with the supervision of production. Authorised personnel in the police agencies and border police are introduced to the modalities of implementation of the Protocol and the use of available instruments.

Increased cooperation on the issue of weapons and component tracking in the region will be achieved through the establishment of contact and joint activities in a field that is new to BiH. This will be built up in a complementary way to the existing models of cooperation with neighbouring countries on the issues of arms smuggling and border security. At the same time, the practice of marking weapons and components will contribute to an easier way of identifying weapons within the territories of the neighbouring countries and thus facilitate a more efficient effort to have illegal weapons removed from communities.

Brokering services for the trade, import and export of weapons is an area of business that requires restriction. It is necessary to additionally strengthen the capacities of institutions in Bosnia and Herzegovina in control mechanisms for the monitoring of brokering services and in the international standards and obligations of Bosnia and Herzegovina in this area.

Project description:

This project will provide support to the responsible institutions in Bosnia and Herzegovina in acquiring new knowledge in the area of arms brokering. It will ensure that they participate in regional training programmes, with training also taking place in Bosnia and Herzegovina.

Special attention during the training will be placed on the obligations of Bosnia and Herzegovina towards international organisations in this area and the standards laid down in international documents that Bosnia and Herzegovina has joined.

Expected results:

Establish modern and compatible capacities that will improve the investigative capacities of BiH institutions and enable an efficient exchange of information between similar institutions in Bosnia and Herzegovina, the region and wider.

Project description:

The project should meet the actual requirements of the ballistic laboratories in order to contribute to the improvement of the investigative capability of judicial authorities in BiH, thus also increasing the percentage of identified perpetrators of crimes and offences committed with firearms. To this end it is necessary to make a list of equipment required by the existing ballistic laboratories in Bosnia and Herzegovina.

When making this list and also later when procuring the required equipment special attention will be paid to the compatibility of equipment amongst the responsible institutions as well as with the neighbouring countries, namely in the region. Thus, the equipment must facilitate an exchange of information and best practice between cooperating institutions and also provide mutual services amongst institutions.

Furthermore, possibilities will be sought for using the existing resources and those yet to be procured across Bosnia and Herzegovina, based on submitted requests for services; this would contribute towards compatibility and would also reduce the resources required for the procurement of equipment for each institution individually. It is also necessary to ensure that the procurement of each item of equipment is accompanied by training provided by the supplier/manufacturer; this will be given special consideration when conducting the bidding process.

Expected results:

Equipment for ballistic and mechanoscopic analyses will be procured and it will be compatible with that in the responsible institutions in Bosnia and Herzegovina, thus enabling the mutual provision of services and information exchange.

The registry for the control of the movement of weapons and military equipment is an important segment of maintaining records on the movement of weapons and equipment in Bosnia and Herzegovina as well as across its borders.

Although the electronic registry has already been developed it requires intervention in terms of additional improvement of the information base software. In addition, some of the institutions in charge of monitoring such movements do not possess adequate equipment for this purpose.

The system of information exchange and cooperation between agencies needs to be improved to allow for more frequent direct contact and discussion on various subject areas. Cooperation and the flow of information will be improved through the organisation of thematic meetings.

Project description:

Ensure exchange of information and close cooperation between the responsible agencies for the control of the domestic and foreign trade in small arms and light weapons by means of organising periodically thematic meetings. At present there is no mechanism for the systematic organisation of cooperation between the agencies monitoring the trade in small arms and light weapons. By organising meetings the system of information exchange will be improved and this will ensure that relevant decisions are made in a coherent manner and that they are in line with polices and plans of the agencies involved in this process.

Expected results:

The information exchange system is improved and clearances and approvals for the domestic and foreign trade in SALW based on information that is immediately available and exchanged amongst the responsible agencies.

This fact makes the monitoring of the area and the creation of policies that will improve the prevention of incidents involving SALW more difficult.

Project description:

The project adopts an analytical approach towards the current statistical indicators for SALW so that an insight can be gained into the ways in which statistical data is kept in the field of SALW. Based on an analysis, a single form will be developed which will represent a single methodology for the collection of data in this area. Once the form has been developed it will be launched and the adoption of this method of data collection advocated for in order that trends in this area can be more easily monitored and as a result reporting to the responsible international institutions improved.

Project description:

With support from the non-governmental sector in Bosnia and Herzegovina the independent monitoring of statistical data on SALW incidents will be ensured as well as activities by the police agencies on the prevention and sanctioning of perpetrators. Through detailed reports on statistics and the operation of police agencies an independent picture will be gained as to the situation in the area of SALW and their prevention and or sanctioning.

Reports will be sent to the relevant media in Bosnia and Herzegovina so that they can inform the public.

Expected results:

Semi-annual reports on the situation concerning SALW, presentation of statistical indicators to the public and an independent evaluation of the work of the responsible institutions in this area.

Drafting reports on media reporting represents an additional mechanism to the official statistics compiled by the police agencies for monitoring the statistical indicators on SALW. In this way a complete overview of the situation in this field, necessary for creating future policies for action, would be ensured.

Project description:

A Media Monitoring Report on SALW is made on the basis of the RMDS methodology for monitoring media reporting. The methodology includes categories related to SALW incidents. In order for the analysis to be comprehensive a report is based on the monitoring of at least three dailies situated in different geographic areas of Bosnia and Herzegovina. An analysis of data collected on the basis of monitoring is carried out and published semi-annually and annually.

The report is in addition to the official reports issued by the authorised bodies.

Expected results:

Completed semi-annual and annual Media Monitoring Reports on SALW containing clear indicators as to the situation in this regard.

Programme 2.2: Raising awareness on SALW risks Project 2.2.1: Promotion of teaching aids and implementation of educational programs in schools on SALW risks Project aim:

To raise awareness amongst children, parents and teachers on SALW risks.

End users:

Pupils, parents and teachers in primary schools in BiH.

Project relevance:

With the raising of awareness amongst young people and children on SALW risks it is to be expected that they will influence their elders (parents and elderly persons) to turn over and illegal weapons they possess to the authorised institutions and thus reduce the danger they pose.

Project description:

Within this project a survey will be carried out in all primary schools in BiH with the aim of gathering information in connection with the implementation of the curriculum (the part that pertains to mine awareness and SALW awareness) and the availability of teaching aid sets. Workshops for headmasters and pedagogues of primary schools in BiH will be organised in each canton/region/BrÄ?ko District in order to promote teaching material and the importance of implementing educational programmes on the risks associated with SALW; this will be followed by the distribution of teaching aids sets to all primary schools in BiH. School pedagogues will organise meetings with teachers in their respective schools to inform them that teaching material for classes on the risks associated with SALW, as foreseen in the curriculum, have been made available to schools, while teachers will give lectures on the negative impact and dangers of landmines and SALW during the class consultations.

This project will achieve a reduction in the use of weapons primarily amongst children and young people. The project will raise awareness amongst the said population about the dangers associated with SALW and influence a reduction in the number of casualties of SALW.

Primary schools in BiH will possess sets of teaching aids and material for education on mine awareness and SALW awareness.

Education is carried out in primary schools in accordance with the current curriculum and using the sets of teaching aids and material.

1. Identification of the availability of teaching material sets that are already included in the curriculum in primary schools in BiH. 2. Organisation of meetings with the ministries of education with the aim of informing them about the planned activities.

3. Organisation of meetings at the regional/cantonal level with headmasters and pedagogues of primary schools with the aim to promote and distribute the educational sets.

4. In their respective schools the school pedagogues will organise meetings with teachers in order to present the project and the teaching sets. Teachers will then implement activities on SALW awareness using the educational sets in accordance with the curriculum.

Through school competitions, at all levels, children adopt knowledge, exchange experiences and accept safe practices with regard to the dangers of SALW.

Project relevance:

Sports activities present an excellent opportunity for raising awareness amongst children and young people. Sports competitions will be organised under slogans that point to the risks that SALW pose to society. This will be a preventive action aimed at children and young people, while the contest will have an educational character in the form of additional education for children and young people on this specific issue.

Project description:

The project will be led by an Organising Board for competitions which will prepare the material for competitions (rules and tasks). This material will be submitted to the ministries of education for approval and agreement upon implementation of the project. Once approved the promotional material will be prepared and printed.

During the competitions school children will be tested and competing teams will be formed to participate in other levels of competition (municipal, regional/cantonal, entity, BrÄ?ko District and state). By involving the media in the promotion of competitions this problem will be placed in the public eye.

Monitoring will be carried out at all levels of competition by the Organising Board, which will carry out an analysis and prepare a report at the end.

Expected results:

During one year 3,200 pupils will be directly involved in competitions, while over 100,000 children will be involved indirectly through testing.

This project is based on a training programme that contains different topics related to SALW. The project will gather media and journalists from the whole of BiH and ensure that the media is informed about the manner of reporting SALW incidents, but also on the activities carried out by authorised institutions in BiH.

It will increase the capacities of law enforcement agencies and authorities to prevent future incidents and conflicts involving the use of weapons and to reduce violence. The aim of this initiative on collecting weapons is not simply to transfer the illegal weapons from the hands of citizens to the hands of official bodies but is intended to contribute to the overall objective of reducing the damaging influence that SALW have on society. This will be achieved by reducing the number of SALW, better prevention of their misuse and through reconciliation and trust building measures. Thus, the collection of weapons will be a development programme striving to achieve the aforesaid goals.

Project description:

A successful weapons collection programme consists of five main elements: understanding the factor of demand, use of appropriate incentives, raising awareness and changing attitudes concerning ownership of weapons, the timing and duration of weapons collection and destruction campaigns.

A successful weapons collection campaign requires a preliminary assessment of the problem that needs to be resolved. Otherwise it would be impossible to set clear standards for success. The factor of demand will be approached through a comprehensive assessment aimed at determining the attitude and perceptions of weapons owners. This assessment will be made before collecting weapons begins.

In order for the collection of weapons to be successful the security of citizens needs to be maintained. Over the past two years measures for improving the perception of security through building better relations between citizens and the police, such as police community work, have had positive results throughout BiH. Consequently, the campaign to collect weapons will be tied to the broader theme of security and reform of the justice system, in particular to the work of the police in the community and community security programmes.

This programme is an initiative based on amnesty. At present owning an unregistered weapon is a criminal offence and is punishable by law in most of BiH. With the aim of establishing an appropriate legal framework, government in BiH will adopt decisions on amnesty for a predetermined period of time during which citizens will be able to voluntarily turn in weapons without sanction. After the period of amnesty has expired there will be a period of strict implementation of the law, which will in turn be followed by another decisive period of amnesty.

The concept of a balanced collection of weapons will be applied. The balance will be achieved between individual and collective motivation. Individuals will be motivated through a lottery system through which individuals will receive lottery tickets for turning in weapons. Individual motivation to turn in weapons will also have a social aspect. The choice of lottery prizes will be based on a prior assessment of the needs of the people. Collective motivation will also be based on offering development programmes in exchange for weapons.

This project will provide an overview of the situation in this regard with the aim of providing detailed recommendations for the improvement of security standards at storage facilities.

Project description:

The state of SALW storage facilities will be assessed in accordance with the standards for security, fire safety and the capacity to store B materials. At the same time the study needs to determine practical proposals and ways as well as proposed equipment to clearly, on the basis of structural proposals, state what is necessary to be invested in order to bring the said facilities up to the required level. The study should also contain a detailed financial plan for the modernisation of these facilities.

The teams that will work on the study should carry out the below tasks.

A risk assessment of ammunition and landmines and explosive ordnance possessed by the Ministry of Defence of BiH will be based on the age of the ammunition and the probability of an uncontrolled explosion. The inhabited areas in the vicinity of military ammunition storage sites will be taken into consideration and the impact that an uncontrolled explosion would have on such areas.

In addition, a risk assessment of the weapons possessed by citizens and data on SALW incidents will provide a picture indicating how these phenomena affect the development, economic prosperity and international reputation of BiH. The study will not only be useful for those stakeholders in BiH that make policies for the fight against the negative effects that SALW have on the population and development but also for those NGOs that suggest directions that these institutions should take in order to improve the situation in this field.

Destruction of high risk and conventional ammunition and complex weapons systems aimed at preventing uncontrolled explosions at ammunition and explosive ordnance storage sites.

Project relevance:

The Ministry of Defence of BiH possesses over 17,000 tons of surplus ammunition. The average age of this ammunition is in excess of 30 years. The risk of an uncontrolled explosion of the ammunition is very high. Uncontrolled explosions take lives and cause considerable material damage to both military and civilian facilities.

Project description:

Destruction of surplus ammunition and explosive ordnance prevents the uncontrolled explosion of chemically unstable ammunition. Considering the large amount of such ammunition in Bosnia and Herzegovina it is necessary to expedite the process of ammunition destruction by using all available military and civilian capacities for ammunition destruction in BiH. The primary methods of destruction will be decommissioning and the methods of open detonation and open incineration as required.

Although approximately 1,000 tons of ammunition is destroyed each year in BiH the estimated optimum capacity for ammunition destruction is between 2,000 and 2,500 tons per year. In this regard, this project will ensure the use of all available capacities and expedite the process of ammunition and explosive ordnance destruction.

During ammunition destruction the risks that can have a negative impact on the environment shall be minimised and strict control and oversight by the Ministry of Defence, civilian parliamentary authorities, international institutions and the NGO sector shall be ensured as will full transparency during the process.

Quantity of destroyed ammunition amounting to approximately 6,000 tons

The verifiers shall certify the amounts of destroyed SALW and monitor compliance with SALW destruction standards.

The reports on SALW destruction, which shall be made on a daily, weekly and monthly basis, shall include all necessary details on the destroyed quantities. The reports will be used as a supplementary mechanism for monitoring and verification, in addition to the official reports of the responsible institutions in BiH.

Project relevance:

SALW storage sites need to be refurbished and the infrastructure improved. The conditions for the storage of SALW are not appropriate for the quantities of ammunition and weapons held by the Ministry of Defence of BiH. Improvement of storage conditions will reduce the risk of the uncontrolled explosion of unstable ammunition.

Project description:

In 2010 and 2011, the Ministry of Defence of BiH in cooperation with international organisations prepared three studies on the current conditions at ammunition and weapons storage sites. This project will improve storage conditions by means of construction works on the infrastructure of ammunition storage sites, the purchase and installation of equipment for regulating moisture, air temperature and other elements.

Expected results:

Improved conditions of SALW storage at the two prospective ammunition storage sites and two weapons storage sites.

Project aim:

To train and certify Ministry of Defence personnel in managing SALW stockpiles.

Ministry of Defence of BiH.

Project relevance:

SALW management requires well trained personnel and these personnel must be certified to carry out this activity.

Currently, there is a need for additional training and certification of about 60 officers of the Ministry of Defence and Armed Forces of BiH.

Project description:

Implementation of training programmes covering SALW inspections, SALW storage, storage facility management, transportation, SALW destruction and other related topics for personnel of the Ministry of Defence and Armed Forces of BiH. The training, which will aim to educate and certify cadre in this field, will be conducted in cooperation with a certified institution from within the academic community or international organisations. The training will be conducted through three different training modules on the above topics. Training activities will be focused on both high level management within the Ministry of Defence and the Armed Forces and personnel at the operational and tactical level. The training will include both theoretical and practical programmes. At the end of the training there will be a test on the topics covered and certificates will be issued to those students who successfully pass.

The training will attempt to include as many female personnel from the Ministry of Defence of BiH as possible in order to contribute to the balanced inclusion of female and male personnel in the training process.

Expected results:

Up to 60 employees of the Ministry of Defence and Armed Forces of BiH trained and certified for SALW stockpile management.

Project relevance:

The Ministry of Defence does not have an electronic system for SALW management. The SALW quantities are recorded in several stock lists. This project will integrate computer centres and enable the digitalisation of data with the aim of improving SALW stockpile control.

Project description:

Software for electronic SALW stockpile management will be procured through this project. In this way, SALW stockpile data will be digitalised and SALW management done electronically. This will further improve control over SALW stockpile management and the accuracy of the SALW stock lists of the Ministry of Defence.

The project will ensure that personnel of the Ministry of Defence are trained in using the software. Hardware required to use the software for the electronic management of SALW stockpiles will be procured.

In view of the fact that in some cases legally exported weapons end up on the illegal market there is a need for verification of end user certificates and to obtain a receipt for the goods delivery to the final destination as well as for screening of all those involved in the weapons trade. Therefore, it is necessary to establish a network of institutions that deal with these issues both within the region and globally.

Improvement of regional and international cooperation will strengthen the capacities of institutions in BiH and make them more capable of providing an adequate response to the challenges inherent to the control of small arms and light weapons at the state and regional level.

Project relevance:

At present the number of non-governmental organisations that deal with issues related to SALW is limited. Institutions in BiH should have credible partners from within the non-governmental sector working in this field. The nongovernmental sector should be strengthened to be better able to advocate certain policies. Therefore, it is necessary to strengthen the capacity of the non-governmental sector so that it can take a more active role in the field of SALW control.

Project description:

The project will make the non-governmental sector stronger by means of the active participation of NGOs in the work of the SALW Control Coordination Board. There will also be programmes to present the Strategy with the aim of encouraging the non-governmental sector to become more actively involved in this field.

The project will present a Guide to Advocacy of SALW Policy. The guide will be made available to the non-governmental sector for its use and will contain all the tools required for the active inclusion of organisations interested in this field. The guide will be presented through various training activities and at Coordination Board meetings.

In addition, the project will aim to establish a network of trainers in specific fields pertaining to small arms and light weapons control in order to strengthen the human capacities of the non-governmental sector.

The municipalities will be selected based on pre-determined criteria. Data on the victims will be obtained by going directly to the competent institutions.

Project description:

Within the project, a standardised form for the collection of basic information on victims as well as their basic needs will be developed. The form will be used by workers gathering information in the field. These field workers will have received training on information gathering.

Based on the results of the field work and information gathered in this way, a report describing a precise methodology for the identification of SALW victims and their needs will be developed. While developing the methodology different needs of female and male victims will be taken into account and an equal approach to and treatment of females and males will be ensured.

Expected results:

SALW victims in selected municipalities will be identified.

Using statistical data on victims attention will be drawn to the problem of the presence of large quantities of SALW in BiH.
