Safety first when stringing holiday lights

Holiday decorations help make a special time of year even more memorable. Whether you’re hanging mistletoe above a doorway or decking the halls, safety must be a priority when decorating a home for the holidays.

Accidents can happen no matter what type of holiday decorating you’re doing, but stringing holiday lights around your home may be especially dangerous. This season, keep the following safety tips in mind when stringing lights so this season of celebration starts off safe and sound.

• Work with at least one partner. Never go it alone when stringing holiday lights. Make sure someone is there to hold the ladder steady as you climb up and down. Partnering up when stringing holiday lights allows decorators to use both of their hands to climb up ladders instead of using one of their hands to carry lights. Once they reach a point where it’s safe to hang lights, they can then have a helper hand them the lights. If possible, work in groups of three so someone can hold the ladder steady at all times.

• Inspect lights before hanging them. Lights are not built to last forever, and over time holiday lights can suffer damage that has the potential to be dangerous. Wires can fray, and sockets can crack or break. Inspect lights and wires before hanging them, replacing any that pose a hazard.

When replacing bulbs, be sure to replace them with bulbs of equal wattage.

• Use an extension cord of adequate length. Exterior holiday lights are often plugged into extension cords that extend to a shed or garage. Do not connect several extension cords to power holiday lights; instead, use just a single cord that’s lengthy enough to reach the outlet. Connecting extension cords is a fire hazard. In addition, make sure the amperage of the decorations matches the amperage rating of the extension cord, which can be found on the product label or possibly on the manufacturer’s website. Make sure the extension cord is not plugged into the power source while you are hanging the lights.

• Make sure lights do not pose a safety hazard inside. Some people string holiday lights indoors as well. Lights might be hung on Christmas trees or along hallways. Such lights and the cords connecting them to power sources should never pose safety hazards, so make sure they are not lying on the floor. Staple lights to the wall and never place them beneath furniture or rugs. Lights can overheat when placed beneath rugs, and lights that are not properly secured to a wall can pose certain dangers, including being potential tripping hazards.

• Hang the correct lights. When stringing lights, make sure you hang lights designated as exterior lights on the exterior of your home and those designated as interior lights inside your home. Hanging lights in the wrong places poses a fire hazard and creates additional safety concerns, so adhere to manufacturer instructions when stringing lights.

What to do after incurring storm damage The 2017 hurricane season proved especially devastating for millions of people in both Texas and Florida. Upon making landfall in Texas in late August, Hurricane Harvey became the first Category 3 or higher hurricane in the United States since Hurricane Wilma in 2005. In its wake, Harvey left damage that Texas governor Greg Abbott estimated could cost as much as $180 billion to repair.

Just a couple of weeks after Hurricane Harvey touched down, Hurricane Irma hit Florida as a Category 4 storm, knocking out power to nearly seven million people.

Severe storms like hurricanes do not discriminate, and when such storms finally dissipate, people from all walks of life are left to deal with the often devastating consequences. Property damage is one such consequence, and the following are some things people can do in the aftermath of storms that caused damage to their property.

• Contact your insurance provider. Not all damage resulting from storms will necessarily be covered by insurance policies, but it’s still imperative that people contact their insurance companies as soon as possible after their homes or vehicles have been damaged. Agents can help policy holders learn if their policies cover the damage done to their property and to what extent their coverage will help them recover. Many people will likely be making similar calls, so policy holders should try to be as patient as possible.

• Document the damage. People whose property has been damaged should use their smartphones and cameras to document the damage as extensively as possible. Take photos from various angles before you begin cleaning up. Providers may require visual evidence of the damage before they begin processing your claim, so ask about those requirements when contacting your insurance agent.

• Avoid downed power lines. In addition to protecting the investments you have made in your property and your possessions, it’s important to remember to protect yourself. Avoid downed power lines, reporting any to your local power company as soon as you see them.

• Let the professionals do the work. It can be tempting for homeowners to try to do some electrical work around their homes after their homes have been damaged by storms. Electricians are likely busy and might not be able to assess or repair damage for days, if not weeks. But it’s still best to wait and allow professionals to do the work. Experienced professionals recognize potentially harmful, if not deadly, issues that may be lurking beneath the damage, so it’s always best to leave the work to private electricians or local power company work crews.

• Revisit insurance policies. After suffering damage to their homes or vehicles, men and women may benefit by revisiting their coverage and increasing that coverage in anticipation of future disasters.

Storm damage can turn individuals’ lives upside down. But remaining calm and working in harmony with insurance agencies and power companies can help storm victims recover quickly.

Preserve carved pumpkins in various ways Jack-o’-lanterns and other carved pumpkin designs are frequently the centerpieces of Halloween festivities. The twinkling lights and orange glow of jack-o’-lanterns can add ambiance to any autumn event. The trouble with carving pumpkins is that most people want to do it right away, only to discover their pumpkins wilt and decay long before Halloween.

Nothing ruins Halloween more than visiting a home to trick-or-treat and not getting candy. Equally disappointing is a sad pumpkin display withering away on a front porch. Even though all pumpkins will eventually rot, certain tips can keep carvings from collapsing too soon.

• Choose a sturdy pumpkin. Inspect the pumpkin of your choosing carefully, looking for gouges, spots and holes. Even a small blemish can quickly expand into a mushy mess. Select pumpkins with even color and firm flesh, and make sure that the pumpkin doesn’t feel tender when you push on the skin.

• Visit local pumpkin stands. Pumpkins that have been shipped miles and miles in hot cargo trucks may be overly ripened or battered. Pumpkins that were grown nearby may be fresher. Plus, buying pumpkins locally supports local farmers.

• Scrape the insides of the pumpkin thoroughly. Any moist bits inside the pumpkin will mold quickly. The pumpkin carving experts at Pumpkin Masters recommend scraping as much of the “guts” out as possible, leaving about a one-inch thickness of the wall of the pumpkin.

• Coat the pumpkin. Preservation methods may aim to keep the pumpkin hydrated and inhibit mold and other microbial growth. Commercially sold pumpkin preservation products, such as Pumpkin Fresh®, hold up well. Soaking and spraying carved pumpkins with a bleach-and-water solution also seems to preserve designs.

• Keep it out of the elements. Store carved pumpkins in a cool, dry place. This will help slow down the rotting process for pumpkins exposed to outdoor fungi, other microbes and warm sunlight.

• Use an artificial light source. Reduce the heat inside of the pumpkin and encourage hydration by selecting a battery-powered light instead of a lit candle to illuminate the carving.

• Skip the carving. Once pumpkin skin is compromised, microbes can enter. In lieu of carving, paint or decorate pumpkins in other ways if you want them to stay fresh for a long time. Glow in the dark paint can help pumpkins stand out at night.

Carved pumpkins may last a week or two, while uncut pumpkins can last for a month or more. Keeping pumpkins hydrated and mold-free will prolong your designs.

To Disclose or Not Disclose… is Not the Question!

Seller Beware: Failure to use a licensed contractor is a material fact affecting the value of property

In a recent court case, the seller of residential property failed to disclose to the buyer that an unlicensed contractor performed renovations on the property. The buyer moved in and discovered several defects. The court found the use of an unlicensed contractor was a material fact affecting the value or desirability of the property which should have been disclosed prior to completing the sale. At trial, the buyer was awarded approximately $50,000 monetary damages based on the cost to repair all defects on the property.

In Posada v. Stone Steps Properties, LLC, the seller renovated a house as an “ownerbuilder” but utilized the services of an unlicensed contractor to do the work. Under California law, a seller is required to provide the buyer a Transfer Disclosure Statement indicating all known defects, repairs and other conditions of the property. Here, the seller indicated on the form that he was not aware of any significant defects in any of listed areas, including roofs and windows. He marked that he was not

aware of any alterations or repairs having been made without necessary permits or not in compliance with building codes, and that he was not aware of any flooding, drainage or grading problems.

After living in the property a few months, the buyer discovered leaking windows, numerous roof leaks throughout the house, an improperly installed flue pipe (venting in the wrong direction into the house), as well as defective heating, air conditioning and roofing, among other calamities.

Curiously, the property passed inspection by the County. However, in the words of the court, “ The use of unlicensed contractors to perform substantial renovations affected the value and desirability of the property.

That the work was permitted, inspected, and approved by a County inspector did not eliminate the duty to disclose that the work was performed by unlicensed contractors.” (One can’t help but wonder how the property passed inspection, but County inspectors generally are protected from suit due to their negligence.)

The transfer disclosure also requires disclosure of “Any lawsuits by or against

the Seller threatening to or affecting the Property, including any lawsuits alleging a defect or deficiency,” if such knowledge of the prior lawsuit would have affected the buyer’s decision to complete the purchase of the property.

In Calemine v. Samuelson, the seller disclosed a prior problem with water intrusion, but did not disclose the fact that two separate lawsuits involving that issue had been filed in court. When the buyer discovered the non-disclosure, the buyer filed suit. The Court of Appeal ruled that had the buyers known of the prior lawsuits, they could have obtained the court records and conducted a further investigation. For condos or townhouses, this includes defects in the common areas, as well.

The elements of a cause of action for fraud based on concealment are: “(1) the defendant must have concealed or suppressed a material fact, (2) the defendant must have been under a duty to disclose the fact to the plaintiff, (3) the defendant must have intentionally concealed or suppressed the fact with the intent to defraud the plaintiff, (4) the plaintiff must have been unaware of the fact and would not have acted as he did if he had known of the concealed or suppressed fact, and (5) as a result of the concealment or suppression of the fact, the plaintiff must have sustained damage.” [Bank of America Corp. v. Superior Court (2011)] “A real estate seller has both a common law and statutory duty of disclosure. . . . ‘In

the context of a real estate transaction, “it is now settled in California that where the seller knows of facts materially affecting the value or desirability of the property . . . and also knows that such facts are not known to, or within the reach of the diligent attention and observation of the buyer, the seller is under a duty to disclose them to the buyer.”

Undisclosed facts are material if they would have a significant and measurable effect on market value’.… Where a seller fails to disclose a material fact, he may be subject to liability ‘for mere non-disclosure since his conduct in the transaction amounts to a representation of the nonexistence of the facts which he has failed to disclose.’” [Calemine v. Samuelson (2009)] Bottom Line Sellers – If your home has a few defects, be aware of the basic disclosure requirements. Sellers of real property in California have a general duty to disclose all material facts that may adversely affect the value of the property, and which the seller knows are unknown to the buyer or within the buyer’s diligent attention and observation. A failure to fulfill that duty may subject the seller to a possible lawsuit arising out of the failure to fully disclose.

Buyers – obtain a qualified inspection before closing the deal.

When in doubt – disclose – and avoid the headache of litigation!

Cold weather outdoor entertaining

Fire pits can keep hosts and their guests warm during outdoor parties in late fall and early winter.

Outdoor entertaining has never been more popular. As more and more homeowners turn their homes into their own personal oases, extending the party outdoors has become a bigger priority.

According to the American Home Furnishings Alliance’s 2015 Outdoor Furniture Trend Report, out-of-doors areas on a property are the favored venues for celebrations with family and friends. While outdoor entertaining was once relegated to the warm weather seasons, advancements in technology have now made it more comfortable and enjoyable to entertain outdoors for much of the year. But hosts who want to extend the outdoor party after summer has come and gone should consider a few important entertaining tips.

• Start the party early. Summertime backyard barbecues and pool parties benefit from late-evening sunsets that illuminate patios and pool areas well into the evening. In addition, many hosts prefer to start such parties later in the day to avoid the sun during the early afternoon when it is at its most blazing. However, start the party earlier in the day when hosting in fall or early winter.

Temperatures can drop considerably once the sun begins to set, so starting early can save hosts and their guests from cold air.

• Heat things up. Summertime hosts might employ canopies to protect themselves and their guests from the heat, and it’s impor-

tant for hosts to take similar steps when the weather is chillier. The AHFA report found that 38 percent of homeowners intended to purchase fire pits for their outdoor entertaining areas, and such fire pits can keep guests warm as the sun goes down and the night air gets chilly. Fire pits have become must-have items for outdoor entertaining areas, and hosts can surely find one that suits their needs.

• Change the menu. Grilling hot dogs and hamburgers might still work when entertaining outdoors in fall and winter, but hosts may want to stray from other summertime fare like watermelon or pasta salad. Embrace the cold weather by roasting some nuts and making s’mores over an open fire. In lieu of summertime beverages like lemonade and beer, serve hot chocolate or wine to keep guests warm.

• Ensure there is adequate lighting. Mother Nature won’t offer much lighting when you host a party outdoors in late fall and early winter, so make sure your patios and sidewalks are well lit.

Guests will want to see one another and what they’re eating, and well-lit walkways will reduce the risk that guests take a tumble or turn their ankles when walking to and from the house.

Outdoor entertaining need not end because summer has come and gone. But hosts must take a different approach to hosting when throwing outdoor gatherings in late fall and early winter.

Coping with fewer hours of daylight Daylight saving time comes to an end each fall, at a time when the hours of available sunlight already are beginning to decline.

Some people are more accustomed to darkness than others.

Norwegians, Swedes and people living in Alaska and the upper reaches of Canada near or above the Arctic Circle may go through a period when winters can be especially dark. Fairbanks, Alaska, gets just three hours and 42 minutes of sunlight on the winter solstice. Those in Barrow, Alaska, will endure a period of 67 days of darkness, according to Alaska.org.

Residents of Seattle, which is even further north than cities such as Fargo, North Dakota, or Portland, Maine, deal with more darkness than those living outside the city may know.

Although much of the rest of North America doesn’t experience such profound periods of darkness, when the darkness of fall and winter arrives, it can be difficult to maintain a positive outlook. Borrowing some of the coping mechanisms relied on in northern latitudes can help many people to see the dark in a different light.

• Be aware of SAD. Seasonal affective disorder, or SAD, is defined by the Mayo Clinic as a type of depression that’s related to changes in seasons, beginning and ending at about the same times each year. Symptoms tend to start in the fall and continue into the winter, sapping energy and making a person feel moody. As with other types of depression, SAD can get worse and lead to severe problems if left untreated. Light treatment, talk therapy and medication can help people who are susceptible to SAD. • Make daylight hours count. Spend time outdoors while the sun is bright in the sky. Make an effort to switch your schedule if work interferes with getting outdoors, even if all that can be managed is an outdoor walk at lunch. Sit by a bright window and soak up rays whenever possible.

• Celebrate winter activities. Go skiing, snowboarding, outdoor ice skating, or snowshoeing. Look forward to winter for what can be done, rather than what can’t.

• Socialize more often. Instead of holing up indoors alone, frequent the places that become indoor gathering spots for locals. These can include coffee houses, breweries, restaurants, or even the local church. Plan more social occasions with friends and families so everyone can collectively shoo away the winter blues.

• Exercise more. Use the darker hours as an excuse to exercise more, be it at the gym or outside. The Mayo Clinic says that

exercise and other types of physical activity can relieve anxiety and depression, lifting an individual’s mood as a result.

• Light a fire. Set the kindling ablaze in a fire pit, fireplace or woodburning stove, or just light a handful of candles.

Flames can be soothing and less harsh on the eyes than artificial light.

Fall and winter darkness does not have to send a person into the doldrums if he or she embraces the right attitude.

Improve indoor air quality in advance of winter Upon the arrival of winter, people in regions where winter is marked by cold weather tend to spend significantly more time indoors. Because windows tend to be closed during winter, indoor air quality can suffer, making conditions inside a home less than desirable.

According to the American Lung Association, poor air circulation in a home can promote the spread of bacteria and viruses. Once such bacteria or viruses are inhaled, coughs, colds and flu can spread. In addition, asthma and allergy sufferers may experience worsening symptoms thanks to the presence of endotoxins, which are substances that come from the broken-down cells of dead bacteria.

Because many people spend significantly more time indoors during winter than other times of the year, it’s essential that they take measures to improve indoor air quality in the months ahead.

• Cut back on chemicals. It’s ideal to avoid heavy chemical usage inside a home throughout the year, but it’s especially important to do so during winter. Solvent-based cleaners or cleaning products with strong fragrances can negatively affect indoor air quality and potentially trigger allergic reactions. In lieu of chemically-enhanced cleaning products, use natural products that get the job done without sacrificing indoor air quality.

• Stop smoking indoors. Tobacco smoke can affect smokers and nonsmokers alike. The Centers for Disease Control and Prevention note that secondhand smoke causes numerous health problems in infants and children. Those include more frequent and severe asthma attacks and respiratory infections. In addition, reports from the U.S. Department of Health and Human Services have linked secondhand smoke to an increased risk of sudden infant death syndrome.

Adults exposed to secondhand smoke are at greater risk for coronary heart disease, stroke and lung cancer. Tobacco smoke contains thousands of pollutants that can greatly diminish indoor air quality, so make sure smokers limit their smoking to outside the home throughout the year, but especially during winter.

• Take off your shoes when entering the home. Snowy conditions often require a home’s inhabitants and guests to remove their footwear upon entering a home, but it helps to remove footwear in a mudroom or just inside the front door when entering a home even when it’s not snowing. Shoes can pick up dirt, dust and a host of other particles during winter, and if tracked inside those unwanted guests can negatively affect indoor air quality.

• Routinely inspect bathrooms for mold. During winter, mold can grow in rooms that are exposed to moisture but not properly ventilated. In many homes, that’s the bathroom. Even if a bathroom has a ventilation fan, routinely inspect the ceiling and shower for mold growth.

Exposure to mold can cause a host of negative side effects, including nasal and sinus congestion and sore throat. Mold also can exacerbate asthma symptoms.

Improving and maintaining indoor air quality in winter can help a home’s inhabitants stay healthy during the colder months.
