Opinion: Mayor Kennedy Stewart caught stealing intellectual property

when someone posted a photo of one of the posters online. I then learned that thousands of the attack ads are plastered up and down Main Street, along Broadway to Kitsilano. When they get tattered or covered with other posters, the mayor's team replaces them. If you've been walking the streets lately, you've definitely seen them.
So what's the big deal? As a publisher and politics columnist, I understand attack ads and, in fact, I have no issue with the mayor taking shots at his competitors in this fashion. They're going to do the same and worse to him leading up to the election this coming October. It is what it is.

hile most elections end with cries of them being "stolen" by at least one disgruntled candidate after the ballots have been counted, Vancouver Mayor Kennedy Stewart got the jump on everyone by stealing something months before the door knocking has even begun. The mayor has stolen our intellectual property. Over the past couple of weeks posters showing mayoral hopefuls Ken Sim and John Coupar (who are running for A Better Vancouver and The NPA, respectively) shaking hands have popped up all over the city. The posters say voters can stop these two from "killing the empty homes tax," along with a QR code that leads to the mayor's re-election campaign website. The photo on the posters belongs to Vancouver Is Awesome and has appeared in multiple articles of ours after our company paid a photographer to go and shoot it. It's being used illegally, and the first I learned of its improper usage was
What I take serious issue with is the fact that the mayor stole our photo and used it without our consent, without providing compensation or credit. Had his team reached out to us to ask if we would license the
image to them they would have learned that we don't condone the weaponizing of our photos for political gain and we would never accept their money if they were CONTINUED ON PAGE 5

going to use it for that purpose. But they didn't contact us. They simply downloaded our photo from our website, removed the credit and background, and splashed it on their attack ads. So I picked up the phone and called the mayor's campaign manager, Mark Hosak, hoping to ask him why he didn't approach us before using the photo. He didn't take my call. His response to the email I sent shortly thereafter was curt, and I don't doubt it went through their legal counsel. He replied, "It is our understanding that our usage of this photo is covered by fair dealing under criticism, review, and news reporting provisions. You expect that this election, like all elections, we will see more and more of this kind of usage by all electoral parties in line with copyright law." There is some merit to their "fair dealing" response, in that a precedent was set in the 2021 ruling in CBC v. Conservative Party of Canada. In that case, the CBC essentially wanted to prevent the federal Conservatives from using excerpts from their interviews in attack ads for TV and radio. The ruling was that the party could use them, on the condition that they offer proper credit to where the clips came from. Stewart's team is most certainly familiar
with this case, and I would bet they have a PDF of the ruling on file. They were likely betting on the fact that even if we did take it to our lawyers we wouldn't have much of a case, and that the most we'd get out of it would be a reprint of the posters, with a photo credit. What to do about it? Instead of attempting to make a meal out of this with our lawyers, I'm taking the fact that the mayor stole our intellectual property to the readers of this newspaper, and of course our website. 112,000 copies of our paper are printed every week, and I hope two things happen as a result: 1. Our readers who recognize the photo that they're seeing in attack ads know that we didn't approve of its usage, and we never would, regardless of who was in the photograph. Even if we owned the rights to a photo of Mayor Kennedy Stewart dry humping an orca (we don't, sadly), we would never approve

of it being weaponized by his political opposition. 2. Political parties and candidates learn that maybe they shouldn't do this sort of thing, that some copyright owners are absolutely not having it, and some of us are churlish enough to put people who do this sort of thing on blast. The municipal election is scheduled for October 15, 2022, and you can expect coverage of where all of the candidates stand on the issues here on our website and in our newspaper. 90-year-old film developed into a picture-perfect mystery
I
n the digital age, most photos are seen by human eyes quickly, sometimes within seconds of being shot. Sometimes it's longer. With film it always is, often days if not weeks before a captured image sees the light of day. In this case it's a bit longer. Likely more than nine decades. Jim Sollows is a photographer with a serious interest in old cameras and film. For example, he recently rebuilt a camera from the 1870s, fitting it with some more modern pieces to shoot on film (instead of glass plates) so he can use it. This isn't that story. Like an unsuccessful bakery, he had an old roll The Fort Langley resident and his wife often pop into antique shops while out and about, and on a trip to Vancouver a little while ago they stopped in at Stepback in Kitsilano. "I ended up getting into a discussion with the proprietor. When I mentioned I do darkroom work and occasionally come across old film and develop it, he reached under the counter," Sollows says. What he produced was a roll of film. A very old roll of film. "He asked 'You ever seen this before?'" says Sollows. "I said 'I've heard of it, but I've never seen it.'" It's a roll of 130 film, a format that produces postcard-sized negatives. It hasn't been produced since the 1960s. The specific film Sollows was given is Verichrome, a type of
film that was discontinued in the early 1930s due to its flammability (it was replaced in the market with Verichrome 10). Sollows has developed old film before, but mostly from the 1950s or later. While he doesn't know exactly how old it is, it's definitely older than anything he'd tried developing before. He took the roll home, where—as a serious hobbyist—he has his own darkroom, a 10 ft. by 10 ft. windowless space to bring film to life. "I have everything necessary for processing film and printing it," he says. "And also have the capacity to take film and digitize it."
With film resurging as of late (he notes two new films just hit the market) there's lots to try with processing negatives; he even teaches a course in it. But film nowadays comes in smaller formats: 35 mm or 120. "One of the complications is this old format is it's larger than any rolled film that we have today," he says. Another complication is that if you leave a roll of film lying around for nearly 100 years, it always wants to curl up again. So in his pitch-black darkroom, fighting with the extralong roll trying to recoil itself "like an anaconda of film" Sollows seesawed the antique plastic through his chemicals.

"I literally stood there, fighting with it, trying to get it into the developer," he says. Eventually, he was satisfied with his efforts and exposed the photos to light to urge the images out. Of the six frames, three turned into pictures. "My heart skipped a beat; these pictures were old, very old," Sollows says. What's the opposite of a Polaroid? The three photos he was able to coax out show what appears to be a family gathering, but other details are hard to pick out. "The first one I saw—there's an older gentleman and a very young
girl, maybe two years old, sitting on maybe the stoop of a house or a bucket," Sollows says. "He looks like a farmer out of the depression and he's sitting there with this young girl." A second photo shows a similar scene, with a middle-aged man and the same child. The third is a group shot, with five people in it; there's the older man and the child again, and this time they're joined by two women and a young man. There are no clues on the roll, so Sollows has tried to learn more from the images themselves. CONTINUED ON PAGE7

"To me it's so awesome to know that back, maybe 100 years ago, some photographer, who we'll never know who that was, took those pictures and never finished," Sollows says. "Normally with photos like this I look for things like street signs or business signs or license plates," Sollows says. "We don't have anything like that in these photos." His best guess is that they're from B.C., because of where he got the film from. He's spoken to Stepback, but they're not sure where the roll came to them from. As for when, with the film being discontinued in the early-30s and the age of the truck and washing machine, he's guessing they were shot in the

Vancouver WAS Awesome 5 things you (probably) didn't know about Kitsilano Beach and Pool
K
itsilano Pool and the adjacent beach are one of Vancouver's iconic locations, but that doesn't mean everyone knows much about them. The beach is regularly rated one of the best in Canada and sometimes the world, though locals still often debate if it's the best in or near the city. Meanwhile, the pool is considered a sexy one, at least according to Red Bull (when did we let them decide that?). Its popularity, though, is undoubted. Vancouver archives have photos of people hanging out at the beach from the 1890s as it was already drawing crowds then.
(aka Safeco Field). But when it was opened in 1931 thousands of people showed up to see an even bigger pool running 200 m long and 60 m wide at its widest. It was billed as America's largest swimming pool and seawater was let in to fill it (with creatures sometimes getting in as well). 4. It was used as a military training site
In the 1940s more than a few men went full commando on Kitsilano Beach. It was a training ground for soldiers to practice attacking a beach from the ocean, with the army charging off of transport ships and up the beach. There are photos of the pseudo-assault, which covered a section of the beach with smoke for a time.
2. It's salty When it was first opened it was filled with seawater with the tide, which led to a few sea creatures making it into the pool. Nowadays it's still filled with saltwater, but the process is a little different. "The pool is filled at the beginning of each season with seawater from English Bay and then filtered, treated and heated. As the season progresses, the saltwater is

1. It used to be called... Before Kitsilano Beach carried a name derived from a local Squamish chief it had a couple of different names. Most recently it was called Greer's Beach, after Sam Greer, who get into a spot of trouble over the land. A homesteader who had worked the land for years, Greer thought he owned the land, and the Canadian Pacific Railway considered him a squatter. Without getting into all the details and court cases and chasing officials with an ax, we'll fast forward to the end when he wounded a deputy sheriff with a round of buckshot before being arrested and imprisoned. The beach was still known as Greer's Beach for a time though, but over a few years the name Kitsilano became more common for the area and the beach. But before all that, it had another name: Xepxpáy̓em. That's the Squamish name for the beach, which translates to 'having red cedar.' Nearby was the village of Senákw. replenished with freshwater," the City says in an email to Vancouver Is Awesome. 3. It holds a size record in Canada, but used to be bigger There are lots of records people claim Kitsilano Pool, but the one the city is claiming is the longest saltwater swimming pool in North America. At 137 metres it's a very long pool, no matter
how you slice it. Many pools are 25 m, with Olympic-sized pools exactly 50 m. This is well over double that, and longer than most fields of play. In fact, if you hit a baseball at Nat Bailey Stadium 137 m it would (probably, depending on the angle) clear the center field fence with plenty of extra distance. It'd even (likely) make it out of the park at Rogers Centre (aka the Skydome) or T-Mobile Park
5. It has a cool piece of art The Kitsilano Wind Swimmer doesn't make her way through the water, but instead appears to paddle through the air. It's a unique mixture of art and engineering which sits atop a perch over the pool. When the winds come in, the figure, powered by the breeze via a propeller, begins to swim through the air. If winds get too high, there's a mechanism to help protect it. It was installed in 1996, but was removed for a few years recently to repair the mechanism after a windstorm managed to cause some damage. However, in 2018 she returned to her watch. BONUS! Since there's a chance you knew one of those, how about this: a sea monster was once found on Kitsilano Beach. Ok, this is more an urban legend than a verified sea monster, but it is 100 per cent true that the body of some sort of animal was found in 1941 on the beach and named Sarah the Sea Hag. One expert at the time suggested it was the remains of a 12-foot-long shark. On that note, there are small dog sharks off Kitsilano Beach sometimes. Citizen recognized for saving woman from jumping off Lions Gate Bridge a crime or assisted police catch an offender. “Honestly, I didn't even know that this was something that could happen,” she told Vancouver Is Awesome after the ceremony. “I am very grateful.” She said she never did meet the woman she helped on her birthday. She would be open to it, if the woman was so inclined. For now, she added, it's important that people look out for each other. "Just keeping an eye out," Boisvert said. arah Boisvert will never forget her 25th birthday. The memory of that day has nothing to do with getting older, or a gift she received. Instead, it is the gift she gave to a stranger in a crisis that will stick with her. In the early afternoon of March 2, 2021, Boisvert was driving across the Lions Gate Bridge when she noticed a woman start to climb over the railing. She slammed on her car’s brakes and decided to act. “I hopped over a railing, and I grabbed the arm and the leg of someone who was half over the railing,” said Boisvert, who was on her way back to her North Shore home in anticipation of a birthday dinner. “I've been in my own bad place with mental health and tried to talk her down. But I think the line that actually stuck with her is I told her it was my birthday, and it was my 25th birthday. She said, ‘Oh, really, I'm so sorry.’ And then I just held her until police officers arrived.” The B.C. Institute of Technology environmental sciences student was among citizens and Vancouver police officers recognized last week for bravery, courage and a commitment to excellence via the department’s annual commendation awards, held at the Roundhouse Community Centre in Yaletown. Police Chief Adam Palmer and Mayor Kennedy Stewart presented Boisvert with the Award of Merit, which is given to citizens who helped or attempted to save a life, helped prevent

I
t was a season full of uncertainty for Brandon Sutter. The offseason is even less certain. Sutter hasn’t played a single game for the Vancouver Canucks in over a year, missing the entire 2021-22 season with post-COVID conditions, colloquially referred to as long COVID. A year removed from when Sutter initially tested positive for COVID-19 as part of the Canucks’ outbreak in April, 2021, the veteran centre is still feeling its effects. Not only is Sutter dealing with the uncertainty of when he’ll get back on the ice, he’s doing it with the added uncertainty of not having a contract for next season. Sutter signed a one-year deal with the Canucks last July. Shortly after is when the first signs of long COVID appeared. “A few things started creeping up in July, and then in August when he started cranking it up, it got so bad he couldn’t really walk around the block,” said Brandon’s father, Brent Sutter, to Eric Francis of Sportsnet. “His heart was racing on him this summer. He said he felt dizzy and had a hard time getting air.” When Sutter got back on the ice during the season, the symptoms returned. “I was getting better after Christmas and started training again, started skating again, and was kind of optimistic about returning at some point this season,” said Sutter in an interview with Dan Murphy. “When I started skating more and ramping up my training at the level you have to be at to be an athlete in this league, I just went backwards a little bit. Haven’t been on the ice since.” Still, Sutter is optimistic that he will get healthy again and be able to resume his career, noting that he’s working with the right people to sort out what has turned into a complex issue. “You have a broken leg or a knee problem or a shoulder or something, you go, okay, we’ve got 6 weeks, 8 weeks, 10 weeks, then we’re back to normal,” said Sutter. “This just keeps dragging on, dragging on, dragging on, but we’re getting there and hopefully soon we’ll get back at it.” Sutter deserves a lot of credit for how he handled a season that was as difficult mentally
as it was physically. Even as he was unable to contribute to the Canucks on the ice, his contributions off the ice continued, resulting in him being selected as the winner of the team’s Daniel & Henrik Sedin Award for Community Leadership. Sutter has been an ambassador for Special Olympics BC for years. Two people close to him are Special Olympics athletes — his cousin, Christopher Sutter, and Mikel McIver, who is a dressing room attendant for the Red Deer Rebels, owned by Brandon’s father, Brent. “I’ve been close to those two guys pretty much my whole life,” said Sutter, so being able to connect with and support other Special Olympics athletes was a natural fit. “Thank you, Brandon, for your support of Special Olympics,” said Ashley Adie, a multisport athlete with Special Olympics BC, to congratulate Sutter on his award. “It really means a lot to all of us athletes and coaches.” For Sutter to continue to provide so much support for others while going through such a difficult time, to the point that he was recognized with the team’s community leadership award, speaks volumes about his character. It also means that the Canucks should give him another shot. It’s not just that he’s made so many connections with the community — the Canucks still need a right-handed, penaltykilling centre on their fourth line — but the character and leadership don’t hurt. Grammy winners OneRepublic to play BC Lions home opener
T
he BC Lions will be launching their 2022 campaign with a big-name musical act this June. OneRepublic, whose 2007 megahit won them accolades around the world, will be the opening act for the Lions' game against the Edmonton Elks when the team returns to BC Place June 11. “They have so many different great hits, and we were very fortunate to get them," says team owner Amar Doman in a press release. “We didn’t want to go too hard rock or too rappy. We just want to be something that everybody knows. It won’t be painful for everybody. It’s gonna be very enjoyable.” Along with the opening show, which will start at 6:30 p.m., before kickoff at 7 p.m., there'll be a pregame party on Robson Street. Health Canada seizes sex enhancement products from local stores

ealth Canada is warning residents of British Columbia and Alberta that multiple unauthorized sex enhancement and workout products have been seized from stores because they pose serious health
risks. The federal health department issued the safety advisory on May 6 for several retail and warehouse locations across the Lower Mainland and Alberta. Several of the outlets are located in the Metro Vancouver region, including multiple Fantasy Factory stores, a Fuel Supplements & Food Bar in Coquitlam, and a Muscle Complex Supplements in International Village Mall in Vancouver. Dear Editor, Accidents can happen in the blink of an eye. When I was four years old, I was playing outside when I slipped on the grass and fell underneath a riding lawn mower. I lost my left leg below the knee. I grew up in The War Amps Child Amputee (CHAMP) Program, and today, I help pass on the Association’s PLAYSAFE message. With lawn cutting season here, I want every kid across the country to know they should never be around lawn mowers. I accept who I am today, but I wouldn’t want anyone else to go through what I did. I hope that by sharing my story, it will prevent even just one child from being injured. Woman self publishes book of hand painted local homes

As an animator Alaas was always working on a screen and missed her personal sketch time, working with physical things. That's when she began sketching houses. She would go out into Metro Vancouver, often travelling via transit from her home in Coquitlam to other cities. She'd walk through residential streets, racking up 10 or 15 km as she went, taking photos of the homes that intrigued her. "I walked a lot. I like walking, so I didn't mind it at all," she says. "It was a lot of fun because this way you learn a lot and find interesting places that nobody has heard of." There were visits to a couple famous homes, like the Hobbit House, but she focused on the unsung heroes of the real estate world. Then she went home, pick the ones she wanted to paint for the book and got to work sketching. To colour the black ink lines she used gouache paint. In total, she painted more than 120 houses, but the book only includes 85 due to budget constraints (she self-published). "I wanted to apply for a grant or get some support but didn't get it," she says. "The book was considered a bit too experimental because no one has published a book like that before." It's not a history book, a photo book, or a book of a famous place, so she was told it wasn't worth the risk. "I really believed in this project," she says. Building. A new book has none of them. No Place Like Home: Houses of Metro Vancouver is the work of Kerel Alaas. Alaas wanted to be an architect growing up in Yakutsk, a city in Russia's Republic of Sakha, but decided it would be a difficult path. Instead, she decided to follow her artistic nature, attending Emily Carr University after her family moved to Metro Vancouver, graduating as a 2D animator. "I think it's equally difficult," she says. However, her interest in architecture didn't wane. On trips into Emily Carr, she'd sketch buildings along the way. The idea of turning her work into a book came to her a few years ago when she spotted Mateusz Urbanowicz's Tokyo Storefronts. The beautifully illustrated book captured the street-level architecture of the Japanese Capital. "When I saw it I was like 'what a great idea, why not make a similar book about architecture in Vancouver, since Vancouver is such a beautiful place,'" she says. Urbanowicz didn't just inspire the book, but also how Alaas created art. "He uses watercolour: I was doing black ink sketches, never colour," she explains. "I was so impressed and wanted to do colour as well." After spending so much time sketching structures for herself, she felt confident she could pull off a book.
