Ombudsman’s recommendations require response

The last place in the world you ever want to see a loved one is in the hospital. Nobody likes being there, but we’re ever so grateful we have use of them. We all would hope a hospital stay would be short, that what ails you would be fixed, that you would be on the mend and on your way with nothing but positive thoughts about your care. But that’s not always the outcome. Some patients leave hospital with less than stellar reviews of the care they received. That’s why the patient ombudsman role was created by the provincial government in Dec. 2015. Christine Elliott earned the job so she would act as a bridge, connecting and working with patients, caregivers and health-sector organizations to improve care and the patient experience. It would also help bring the patient voice to the attention of public policy and decision-makers. To say Elliott is busy would be an understatement. To date, her office has received nearly 1,500 complaints from various geographic locations and across each of the different health sectors. Elliott said her staff strives to respond to each and every complaint. "By the time people come to our office, they’re pretty angry. "They’re frustrated; they feel as if nobody’s been listening to them, that they haven’t had an opportunity to tell their true story and they want to connect with someone who can help process their complaint." One of the biggest complaints Elliott’s come across is the inability to discharge patients into long-term care because there aren’t enough spaces. As the population ages, this problem will only become worse unless more long-term care homes come on stream. As part of Elliott’s mandate, it’s within her purview to investigate a health-sector organization and make recommendations. Elliott’s first report to the minister of health and long-term care will be released in September. We hope the provincial government takes Elliott’s recommendations seriously and acts upon them. Elliott was put into this critical role because she’s shown herself to be a tireless advocate for people. Given the number of complaints her office has dealt with so far, she’s been kept very busy. It will be in the province’s best interest that Elliott not remain this busy. The government has a duty to act on her recommendations, whatever they may be, and to fix what’s wrong. It will be interesting to hear what Elliott has to say in September, but also how the province responds to what she says.

• LETTERS & COMMENTARY • Minimum wage hike puts party before province Re: Wage increase could mean job losses, higher consumer costs: chamber, May 31. The recent announcement by the Wynne government that the minimum wage will be raised to $15 dollars per hour in Ontario demonstrates the Ontario Liberals are more interested in buying votes than in creating effective public policy. The Ontario Liberals are trailing in the polls and the premier has an absolutely dismal approval rating of just 12 per cent. Given this, it should come as no surprise that the Ontario Liberals would push forward with a $15 minimum wage in an attempt to sway voters into their camp.
In March 2016 the Fraser Institute put out a report on the effects of raising the minimum wage in Canada. It examined research done in Canada and the United States and concludes that not only does an increase to the minimum wage not boost the wages of poorer workers, but the findings also indicate a boost in the minimum wage by 10 per cent would cut employment for young workers (age 15-24) by 3 to 6 per cent. An examination of the demographics in the wage study in Canada conclude 87.5 per cent of minimum wage earners live in households that were above the Low Income Cut-Off (LICO), which is used as a measure for relative poverty. Furthermore, the study indicates that 83.4 per cent of workers who fall below LICO earn more than mini-

The wage demographics for Ontario are telling: 60.3 per cent of minimum wage earners are between the ages of 15-24; 59.8 per cent are either a son, daughter, or relative living with family, and 19 per cent were living with a spouse who was employed. The study found that only 2.1 per cent of Ontarians earning minimum wage had at least one child under the age of 18 and were the sole family breadwinner. The Ontario Liberals know this. A report by the Ontario Minimum Wage Advisory Panel in 2014 stated that the benefactors of an increase to the minimum wage are not low-income earners who are trying support their families, but young people who are working their first jobs, who live at home with their families.
The proposed wage hike could negatively impact low skilled workers who are looking to gain experience at the low end of the job market. Possible consequences of a forced minimum wage hike include loss of employment, reduction of hours and benefits, or the replacement of human labour by artificial intelligence. Someone is going to pay for the increased costs of a wage hike, and it is going to be the consumer. The majority of workers who fall below LICO make more than minimum wage, which means they won’t necessarily be seeing an increase to their pay, but will see an increase to the goods and services they purchase, a regressive tax on the working poor. It was around 5 a.m. that York police officers working in the area of Weston Road and Hwy. 7 found a male in rough shape, claiming to have been beaten up. He had at least one broken limb and complained to officers about his injuries, a source close to the investigation told yorkregion.com. When officers noticed the man also had burn marks, he was arrested in relation to a suspicious explosion that ripped through the side of Caffe Corretto, on Winges Road, near Hwy. 7 and Ainsley Grove. It was only two streets away on Caster Avenue that Mila Barberi was gunned down in a hail of bullets in March 2017. The scene is a dramatic one, three of the cafe’s rooms are exposed and the side wall is blown out. A black, four-door BMW is buried under the rubble. Inside, everything is charred by flames: a television, tables and what appears to be multiple gaming machines. York police have said officially that a male has been arrested and is in hospital being treated for non-life threatening injuries. None of the multiple groups of people surveying the scene wanted to speak on the record, but a few spoke on the condition of anonymity. "It’s an Italian cafe in the area, they have a couple slots, card playing, you can see a board, some sort of point system," one young man told yorkregion.com while surveying the scene. "They play Italian cards in there like Brisk (Briscola). It’s a respectable cafe and I’m surprised to see this happen. I’m just glad it wasn’t full at the time." However, not everyone referred to the cafe as respectable. An employee from a neighbouring said his company has been in the area for decades and knows most business owners in the area, but not that of Caffe Corretto. "It’s been there for about eight years," he said. "We have seen a lot of cafes here, you just wonder how they pay the rent. It’s unfortunate, but I’m not surprised." He added that another cafe in the neighbouring building was blown up about 14 years ago. Another person said one window had been covered with newspaper weeks prior to the explosion. Vaughan has seen a string of incidents with possible links to organized crime. There were four shootings resulting in three deaths just months ago, prompting Mayor Maurizio Bevilacqua to release a statement. However, looking back, the problem is much wider spread. There have been 12 murders in Vaughan since 2013.

WILLS AND ESTATES FREQUENTLY ASKED QUESTIONS The Wills Lawyer 1. Dad died and I am positive that my brother had borrowed money from him and never paid it back. How do I prove it? Is it deducted from his share? Proving that this debt is still outstanding may be difficult, especially if the matter has to go to court. Without hard proof, it will be your word against his. Hopefully, Dad kept a record of the money he lent him, supported by a promissory note or other evidence of debt. If there is evidence of the debt, the court might look to your brother to prove that he paid the money back to your Dad. Generally, debts owing by a beneficiary to the deceased have to be repaid or else they can be deducted from the share of the estate going to that beneficiary. Les Kotzer 2. I am co-executor of Dad’s estate with my uncle. leskotzer.com We cannot agree on what to do with the estate, and in the meantime, the estate assets are declining in value. What do I do? Executors must act together, unless the Will says otherwise. If there truly is a deadlock, you may each need your own lawyer. If the matter is incapable of being resolved and court proceedings are initiated by one or the other of you, the court may have to decide the matter. The court may order that one or both of you be removed and might even order that you or your uncle be replaced by a neutral person or financial institution. 3. My Mom appointed me and my brother as “joint and several” powers of attorney. I don’t trust my brother. How do I make sure that he can’t do something with Mom’s money behind my back? Being appointed “severally” means that each of the “attorneys” appointed in the Power of Attorney can act on his or her own without the consent of the other. It would be a good idea to notify the banks and request that they advise you of any transactions made by your brother. As an “attorney”, you are entitled to have information about the account. Writing to your brother suggesting mutual co-operation is also a good idea. With this documentation, you will be able to show the court that you were trying to be reasonable. 4. Aside from receiving a copy of my sister’s Will, I have not heard what’s happening with the estate. When is it appropriate for me to contact the executor to find out the status of the estate? You have the right to contact the executor at any time. As a beneficiary, you are entitled to know the status of the administration of the estate and your sister’s assets. However, you must be realistic in your expectations. As a rule of thumb, you would be acting reasonably if you asked for a status report every three months or so, unless there is a situation that clearly makes this estate a special case. 5. My Dad left a note to me that he wants me to get his house. Is that valid? If the note was entirely in your Dad’s handwriting, dated and signed by him, it may be valid as a “Holograph” Will. If it was not signed, it is not a valid will. 6. Mom left instructions in her Will that she wanted to be cremated. My brother is the executor and he refuses to cremate her. Can he do that? Funeral or burial directions in a Will are not binding on an executor. As a result, your brother will have the final say on how to deal with Mom’s burial. 7. I am 65 and my new husband is 83. His kids think that I am a gold digger. How do I protect myself from his children when he dies? You better be ready for a fight. Children who are upset at their parent’s subsequent marriage, and whose inheritance may be substantially diminished because of that marriage, will often attack the new spouse on as many fronts as they can. They might even attack the validity of the marriage itself. You should be arming yourself with as much evidence as you can find to confirm that your husband knew what he was doing, including getting a mental capacity assessment, if possible. Documenting your life together is also a good idea. Pictures, cards and other tangible evidence of your relationship may help you. Anti-Semitic graffiti sprayed on Vaughan school called ’appalling’ TIM KELLY tkelly@yrmg.com The York Regional Police hate crimes unit is investigating after anti-Semitic graffiti and slogans including "Jews caused 911" was sprayed on a Vaughan high school last week. Another image, including a swastika painted in the middle of what appears to be a Canadian flag, was found Thursday morning at Woodbridge College High School just ahead of a graduation ceremony. The images were scrubbed away before the ceremony. Jewish advocacy group B’nai Brith, in a press release by Friday, July 4 the organization called the messages "appalling." "This disgusting act of anitsemitism and racism could have spoiled a graduation ceremony at the school, right before Canada’s 150th birthday," Michael Mostyn

Vacant Unit Rebate Program Public Consultations But Hurry the Party Ends July15th!
In 2001, the Province of Ontario introduced the Vacant Unit Rebate Program to owners of vacant commercial and industrial buildings. The program provides a property tax rebate for commercial or industrial buildings that are entirely or partially vacant during the taxation year. In November 2016, the Province released its Fall Economic Statement which provided municipalities with broader flexibility to tailor the Vacant Unit Rebate program to reflect community needs and circumstances. The City of Vaughan, the City of Markham and the Town of Richmond Hill are evaluating the Vacant Unit Rebate Program and soliciting program feedback from local commercial, industrial and residential property owners.
