Family sues Mackenzie Health after grandmother sexually assaulted at hospital officer and chief nursing executive Susan Kowlek had been made aware of the incident, Eva says. When she asked what the police said, she was told management decided not to call police because sexual assault charges would jeopardize the hospital’s reputation. The hospital said in a later statement its policy at the time was to report allegations to police only with the consent of the patient involved. When Eva suggested calling the police, she said they told her, "There’s no point in you doing it now, because your mother will not tell them anything anyway and it’s been such a long time." They added that because it had been more than two months since the incident, the police would not be able find physical evidence. Another alleged victim’s daughter - who spoke to yorkregion.com for an earlier investigation into how Mackenzie Health handled sexual assault charges would eventually report the incident to police. In the ensuing days, Eva was again inundated with phone calls from the hospital, totalling about 12 messages asking her to call back, she said. This time she did not call back. Instead she spoke to a lawyer and then the police, giving them a videotaped statement of what had occurred. York Regional Police would go on to charge personal support worker Soja

JEREMY GRIMALDI jgrimaldi@yrmg.com Ran Shirdan remembers it clear as day, walking into Mackenzie Health to see his grandmother Sonja Shirdan, 90, and witnessing the state of his best friend, his Savta - the Hebrew word for a particularly cool grandmother. "She had stopped talking entirely," the 30-year-old Maple resident said. "She had clenched fists over her all the time, one over her chest and one over her crotch." But this wasn’t all, Sonja had bruised lips and arms, black, blue and purple and a clenched jaw. She could not fall asleep. For months after the incident, which occurred in September 2015, Ran and his mother Eva Shirdan did their best to help Sonja recuperate, prodding the formerly talkative senior citizen to say something, anything. They had nominal luck. "It felt like we were in the

It wasn’t until two months later they’d find out the ghastly reason why Sonja was so agitated. She’d been raped while in hospital. Yet finding out all the details from Mackenzie Health management proved similarly trying. The process began with a barrage of phone calls, up to seven a day, from one hospital manager who repeatedly failed to leave a message. Finally, after receiving

nearly 20 calls, Eva, who explained she rarely returns calls from unknown numbers, called the number and reached Mackenzie Health’s operation director for emergency, medicine and critical care, Heather Riddell. Eva was told, "We’d like to share what went wrong with your mother." "I was so happy because they usually try and hide (those things)," she said. "I had convinced myself that she took the wrong medication." On Nov. 26, Eva walked into a hospital conference room, where several hospi-

tal representatives were seated: Riddell, Charmaine Ambrose, a patient care manager; Dr. Victoria Chan, chief of medicine; and an administrative assistant. The following is her account of what happened at that meeting. After 30 minutes of talk about her mother’s current condition, she said the women got up and were about to leave, when she interrupted: "Wait ... you still haven’t told me what happened?" To which they responded: "Do you really want to know?" She was eventually told

When they were pulled back, a hospital personal support worker was seen "aggressively sucking" on Sonja’s breasts. When Eva asked what else occurred, she was told "other things ... you don’t want to know, it was horrible." One person present said members of the hospital’s senior leadership team, including president and CEO Altaf Stationwalla and vicepresident, chief operating

Police investigate abuse at support centre for people with disabilities Charges against owners include assault, forcible confinement ALI RAZA aliraza@yrmg.com The owners of an unlicensed day support centre for people with disabilities

in Vaughan have been charged with neglecting and assaulting four people who attended its day programs. York Regional Police launched an investigation in August 2017 into the Hope Centre on Romina Drive, near Jane Street and Langstaff Road, after a concerned family member reported possible abuse.

Police say the investigation identified three additional victims. Officers executed a search warrant Oct. 13 and arrested the owner, her son and her husband, all of whom worked at the centre. The centre has since been shut down by police and attendees have returned to their families. Police say the victims

were physically assaulted and forcibly confined and the owners didn’t provide adequate food, medication or supervision. "People were paying for loved ones to attend the centre and participate in programs, but evidence suggests what they were paying for is not what they were receiving," said Const. Laura Nicolle.

The investigation is ongoing, police say more information might emerge. Rosalina Panetta, 47, of Vaughan, has been charged with failure to provide necessaries of life, assault and fraud. Her husband, 41-yearold Giuseppe Morana, has been charged with assault. Her son, Onofiro DeFina, 27, of Vaughan, has been

charged with failure to provide necessaries of life, forcible confinement and assault. They are slated to appear in a Newmarket courtroom Oct. 17. Anyone with information is asked to contact York Regional Police #4 District Criminal Investigations Bureau at 1-866876-5423 ext. 7441.

United Ways will be stronger together If ever there was proof that there is strength in numbers, it’s the results of the United Way fundraising campaigns in Toronto and York Region after the organizations amalgamated in 2015. Before they merged, the two charities separately raised a total of $97 million. Together, in 2015 they raised $100.2 million. And in 2016, that rose to $102 million. Now the United Way Toronto and York Region hopes to raise $103 million in its annual fundraising campaign, launched last week to fight poverty, build strong communities and help kids. The decision to combine organizations was clearly a good idea in 2015. And it raised the question of why more United Ways across the Greater Toronto Area (GTA) don’t join forces to create one powerhouse charity working to create a better life for everyone in the region. Last week, that idea came a step closer to reality with the announcement that the boards of trustees of United Way Peel (representing Mississauga, Brampton and Caledon) and United Way Toronto and York Region have unanimously agreed to amalgamate. If members of Peel agree to it at a meeting on Oct. 26, the organizations will unite on April 1, 2018. That would be a welcome move, indeed. As Daniele Zanotti, CEO of the United Way Toronto and York Region, noted, the merger will allow those involved in United Way to do more to strengthen communities across the GTA: "Whether it’s giving young people the right start in life or solving local poverty, these issues aren’t contained to one spot on the map." Peel’s interim CEO and president, Anita Stellinga, believes the proposed merger, will strengthen their fundraising while also allowing them to continue to meet the needs of the communities they serve. She said there’s increasing competition for fundraising dollars and joining the world’s largest United Way in the Toronto York organization will give them greater reach. If approved, she feels it will increase her organization’s scope and give it a more impactful voice in the region while also better serving residents and their donors. The ability to raise more funds with a bigger regional agency is happy news for the hundreds of charities that depend on each of these United Ways for support. Indeed, last year, the United Way Toronto and York Region provided ongoing support for 220 local agencies, while Peel supports 53 agencies with a fundraising goal this year of $11.4 million. Whether those agencies house the homeless, feed the hungry or shelter the abused, they all deserve our support. The fall campaigns are now underway at all United Way agencies across the region. Please give generously. The community you build with your donations is ultimately your own.

• LETTERS & COMMENTARY • Situation cited in Thornhill Woods not unique Re: LETTER TO THE EDITOR: Garbage, speeding irksome in Thornhill Woods, Aug. 3. Having read the justified complaint of the writer regarding the mess in the community, I find it remarkable why we need to have these conversations so frequently. Thornhill’s problem is not unique! This is a problem found in almost any community in Vaughan and many should take a bow. In Ward 2, where we live, 85 per cent of the time Wednesday is the windiest day of the week all year long. Guess when they pick up the blue boxes and gar-

bage here? I call it the transferring of assets from neighbours’ overfilled boxes, since we need to pick it up off the lawn. Did you know there is no limit on how many blue boxes you could have? Everything that has been written is exactly what we find here. Must have had no more space to add cutting grass, weeds, parking cars on sidewalks, texting and driving. What we do here is call our councillor in Ward 2. His office, along with him, is very accommodating and he works very hard to fix things. The mail boxes are federal assets. I have lobbied to have a sticker that can be placed in the box asking for no junk mail. Sounds good, huh? Guess what the coupons for free burgers are? Come

Street was closed briefly for the Thornhill Village Festival parade. Now, York Region has decided it cannot be as traffic and buses are more important. Toronto closes major roads for festivals: Danforth Avenue for the Taste of the Danforth, part of King Street West for four days for the Toronto International Film Festival, College for Taste of Little Italy, etc. York Region, revert your position for next year, please. Zadeh with 13 sexual assault charges. The alleged victims totalled six and included patients at Mackenzie Health as well as other locations where Zadeh worked after he was fired from the hospital. According to York Regional Police Information to obtain documents, once police began their probe into the alleged sexual assaults, hospital management refused to give simple information to officers and forced them to seek judicial authorization for information including the names of the other victims. The information and opinions in the court documents have not been tested in court, but are the police’s record of their investigation and interviews. According to those documents, Ambrose refused to admit to the police that Zadeh’s actions were "sexual in nature" instead calling them "inappropriate and rough".

Mackenzie Health’s director of quality and risk management Wendy Hooper denied the hospital had done anything wrong by keeping the alleged sex assaults from the police. "If given the chance to do things over in this incident, Wendy Hooper would not do anything differently and would still not contact police in regards to the sexual assault allegations," York police Const. Stephanie Couture wrote. In May, the Crown dropped all the charges against Zadeh in a deal that had him avoid trial by pleading guilty to one assault charge, involving a slap on the rear end of an anonymous female patient at the hospital. The Shirdans learned of the deal days later and said the Crown told them there was insufficient evidence and the victims had "frailties". At least two families, including the Shirdans, are now suing the hospital.

An explanation by The Crown as to why the charges were dropped "There’s a pattern of negligence when it comes to caring for our elders," he said. "This isn’t about us, it’s about everyone. When you are brought to the hospital you are weak, it’s supposed to be a safe haven. There could be a pedophile in our hospitals too, but we would never know if every situation was treated like this." Despite repeated requests, Health Minister Eric Hoskins refused a chance to be interviewed on the subject. The ministry sent a statement, saying it "upholds a zero-tolerance policy for any sexual abuse of patients and expects all health system partners to do the same." "It is the ministry’s expectation that hospitals will appropriately notify police

of any potential criminal matters involving patients that take place within their facilities, prioritizing the safety and well-being of patients at all times," the statement says. "The ministry is now exploring options for a more rigorous registry that provides PSWs, employers and the public with the information they need to ensure that the care they are receiving from their PSW is competent and safe." Mackenzie Health representatives also declined to be interviewed or comment on this specific incident. The hospital did release a statement, which said it has revised its policies and now requires all allegations of criminal behaviour at the hospital to be immediately reported to police. Sonja died on March 7, 2017. Her physician told the family said her health began to decline after the assault. Despite her family’s best efforts, they never managed to unclench her hands.

Initiated by Vaughan Fire and Rescue, the Emergency Response Vulnerable Persons Registry alerts first responders and firefighters if someone in the home has a mental or physical disability so they know before they arrive to get that person out first. But those with the disability must sign up to the registry so responders are aware when that critical call comes in. Franca Tomasella of Vaughan has signed up. The 53-year-old married professional, who was born with spinal muscular atrophy and is wheelchair-

bound, said she feels the information on the registry is really valuable. Tomasella, who said she "plans for the best but expects the worst," and adds "I’m married and we have a dog who doesn’t communicate well with others," clearly sees the benefits of the registry. "I had a really bad accident in the elevator in our house five years ago. My husband was home, but we had to call 911. If I was unconscious, it would have been good to have the registry then," she said. Vaughan Deputy Fire Chief Deryn Rizzi would like to see anyone who has a disability in Vaughan sign up for the registry. "They can go to our website and identify themselves and where they would most likely be for

sleeping arrangements. That way, if there was a fire, we can enter all the information in our 911 dispatch centre and alert firefighters," she said. The best way to sign up for the registry is to go to the website and sign up at Vaughan.ca/VulnerablePersonsRegistry. The list needs to updated annually and Vaughan Fire and Emergency Services should be notified if an individual no longer resides at the location named on the list. If you can string together what a committee approves as the most appropriate motto, you could come up with the words on Vaughan’s first official Coat of Arms. The city is now taking submissions for the motto for the Coat of Arms. It can be a maximum of 30 characters, and must consist of two or three nouns or adjectives and be in English. Phrases that are literary or historical will also be accepted. Submissions will be reviewed by a committee of senior city staff who will recommend top submissions to Vaughan council for approval. Once council approves the motto, it is submitted to the Canadian Heraldic Authority to be incorporated into the final Coat of Arms design. The new Coat of Arms will be formally presented to the city at a later date. You have until Nov. 13 to submit your entry which is eligible only to those who work in or are residents of Vaughan. Notice of Completion GO Rail Network Electrification Transit Project Assessment Process Metrolinx and Hydro One, as co-proponents, have completed an Environmental Project Report (EPR) in accordance with Ontario Regulation 231/08 for the GO Rail Network Electrification Project. The Project As part of Regional Express Rail, Metrolinx is proposing to electrify GO-owned corridors. She turned to 360Kids knowing they would be able to help. After completing the Base 4 Success program, she found herself with two job offers paying above minimum wage. "It gives you a sense of accomplishment and boosts your self-esteem when you can provide for yourself and your family instead of taking handouts," she said. "This program is the difference between sitting on the couch and having a reason to get up." Now, 360Kids has banked $2.1 million in federal funding to help York Region youth like Sarah gain skills and work experience. Richmond Hill MP Majid Jowhari announced the project that will give youth job skill training and hands-on work experience. Up to 276 youth are expected to participate in the Base 4 Success program, which is delivered by 360Kids. Youth will participate in two

weeks of in-class training. Youth will gain certificates such as WHMIS, first aid and Smart Serve and gain life skills like budgeting and financial planning as well as job preparation skills like resume writing, job interview skills and knowing their legal rights. The following 10 weeks will be spent working in the retail, manufacturing and service industries. There will be seven sessions of the program held throughout the region annually including sites in Richmond Hill, Newmarket and Vaughan, according to 360Kids’ Bonnie Harkness. The program is geared to fit each youth, not the other way around, she added. The program also works alongside the organization’s many other services including the iGrad program that helps youth earn their high school diploma through a partnership with the York Region District School Board. Those between 15 and 29 years are eligible with a referral from a partner organization or self-referrals can be made by filling out a form available on the website. North Maple Regional Park makes it on city’s agenda Fifteen years after the closure of the Keele Valley landfill site, known as "the dump", local campaigners and Maple residents will finally see the reward for years of putting up with the dump’s foul odours. Phase 1 of the North Maple Regional Park has made its way off the drawing board and onto the City of Vaughan’s projects list for 2017. The advertising billboard on the east side of Keele Street, north of Teston Road and the CN tracks, was the meeting place for a poignant photo op for local environment group Vaughan CARES, whose members were instrumental in lobbying Queen’s Park and fought for the closure of the dump. The volunteer members have been directing their efforts for many years to see that the regional park becomes a reality. This heralds a major milestone in Vaughan CARES’ efforts and a long-awaited reward for Vaughan’s expanding demographic of young families. Once the Keele Valley landfill

was finally closed, there were high expectations money would be set aside for redevelopment of the site. When this did not materialize after lengthy delays, the City of Vaughan consulted with Vaughan CARES to explore several funding options, including a public private partnership (PPP) where private investors share some of the cost in return for a share of any profits. This option may be perceived as controversial, with current plans suggesting a percentage of the park area may be set aside for such investment on prime Keele Street frontage. The North Maple Regional Park is sure to become quite the recreational centre. The proposed amenities include all-season soccer pitches, baseball and cricket fields with quiet areas and nature trails designed to connect the existing Toronto Conservation Area land surrounding the site and the Oak Ridges Moraine. This space will reflect the original vision of a positive environmental legacy.

Ten hydro poles came crashing down due to winds of up to 100 km/h on Sunday afternoon as York Region was hit by a fierce storm. More than 35,000 customers lost power in Vaughan and others in Markham, Aurora and Richmond Hill lost power as well. Almost all had their power restored by Monday morning. Wycliffe Avenue is closed due to downed power lines, York Regional Police reported just after 9 a.m.. Hydro outages were felt right across York Region due to the winds. Some 35,000 customers were without power in Vaughan Sun-

day for a number of hours. Small pockets of outages were also felt in Aurora, Markham and Richmond Hill. Power was restored throughout the night to all but a handful of users who, Alectra said, were restored Monday morning.
