Seventeen-year-old James Peek - a funny, popular, athletic young man - confessed to his mom, late one evening 18 years ago, that he was tired of always feeling like he had to strive for perfection. Four months later, the Richmond Hill teen killed himself by suicide. A letter told his close-knit family of the pressure he felt in school, relationships, life. Before he ended his life, he had first completed his homework. What kind of hidden pressure, what kind of inner incessant drive, made him push himself so hard, struggle so unbearably? What stopped him from reaching out for help? These are questions that plague his family and his younger sister, Michelle, in particular. What burdens did he secretly carry, she wonders, and how many more of us, like James, yearn for space to be imperfect, to make mistakes and still feel worthy, to say "I need help" without shame or apology? For 17 years after James’ death, the family held a golf tournament in his memory. Tulloch review would make SIU ’most transparent, accountable’ in the world Metroland asks three former SIU directors to pick and choose the Tulloch recommendations they would most like to see the Ontario Attorney General implement in new legislation due out this fall JEREMY GRIMALDI jgrimaldi@yrmg.com What is the biggest issue with the current Special Investigation Unit model? Is it that cases are taking almost five times as long as they did in 2011? That a Mississauga woman accidentally shot in the back by police while in her home still can’t find out who shot her? That the public is regularly being kept in the dark about SIU investigations? Or that police forces regularly don’t follow rules or don’t report incidents, without punishment including the recent case of a teenager who was beaten up by an off-duty cop and his brother? What is the biggest issue with the current Special Investigation Unit model? Despite the ongoing debate, one thing most can agree on is that the current system is broken and in need of reform. What form that will take is up to Ontario’s Attorney General, who has given little indication so far on which portions of Ontario Court of Appeal Judge Michael Tulloch’s review of the SIU - the provincial police watchdog that investigates when police kill someone, cause injury or are accused of sexual assault - should be instituted. What we do know is the latest public comment has indicated the recommendations are under ’active consideration’ and new legislation involving portions of the report will be ready in the fall. Metroland has interviewed three former SIU directors to find out what they believe are the most pressing issues facing the maligned body.

André Marin, director of the SIU between 1996 and 1998, wants the government to start assigning consequences to police departments who fail to report incidents, disobey guidelines or drag their heels when disclosing records. "(That means) jail, fines or both," he said, insisting that police departments, understand, above all, consequences. He said change has already occurred in the face of Tulloch’s review, citing the Durham police chief’s most recent statement indicating the force will advise the SIU of incidents regardless from which force the officers derive something for which his police force was heavily criticized for failing to do in the case of then 19year-old Defonte Miller’s alleged assault at the hands of an off-duty Toronto police officer. "To me this is a sign that change is imminent and it’s al-
ready started," said Marin. "(When you finally) see consequences (for failure to act) you will see a sea change in behaviour." Ian Scott, the director from 2008 to 2013, said one of his top priorities involves a clear and concise definition of serious injury legislated in Ontario to avoid confusion. "I remember arguing with police about that, they all have different ideas about what serious injury is," he said, explaining these differences often result in incidents going unreported, because they don’t necessarily fit with individual police force’s interpretations. He added that Tulloch’s suggestions that SIU investigators add allegations of corruption, fraud and perjury to their remit is one of the most powerful points in the document. Peter Tinsley served as direc-
tor between 1999 and 2002, during a time of great transition following the Adams review of 1998 conducted by former Justice George Adams. Tinsley said independence for the unit should be considered paramount. Legislating a requirement for an annual report to be tabled, which until this past June had not been published in the previous two years, would go a long way in terms of forging the unit’s autonomy. "It’s a hallmark of the independence of the unit," he said. "The director is not an officer of the legislature, but it provides a mechanism for accountability and transparency directly sourced from the unit to the legislature and community." He agreed with Marin that punishment for police forces that don’t co-operate has long been a point of concern, adding that another body should be the ones to
dole out sanctions. "It should be administered by a third party," Tinsley said. None of the three men took issue with some of the SIU’s most hotly debated issues in the media, including the hiring of former police officers as investigators and the naming of subject officers who are never identified by name prior to charges being laid. As long as there is a mix of civilians and former police investigators, any allegations of prejudice can be dealt with by the agency when they come up, said Tinsley. Scott agreed, saying despite claims about the potential for bias, those with experience in criminal investigations are vital. "If charges are laid, (those charges) can go to trial, you need investigators that can withstand the criminal trial process," he said, explaining few can handle the pressure better than former police. As for the question of whether officers should be identified prior to charges being laid, Marin questioned the motivation behind these requests, as long as reports give appropriate "circumstances, findings and details." "What’s in a name," he questioned. "People want to picket outside officer’s homes? It’s not a deal breaker." Although still a mystery what will come out of the Tulloch review, one thing is for sure in Scott’s mind. "If these recommendations are implemented (in their entirety)," he said. "Ontario will have the most independent, transparent and accountable oversight agency not only in Canada, but (likely) all jurisdictions in the world."

Gary Battaglia and residents of Mountfield Crescent in Thornhill have been complaining to the city about low-hanging trees on their street to the city for a long time but have received no relief. The tree branches block out street lighting and are in the in the way of people walking on the sidewalk.
After years of shouting from the treetops, a leafy problem is about to get pruned for some fed-up Thornhill residents. Mountfield Crescent neighbours Gilbert Manza and Gary Battaglia have had to dodge low-hanging city trees for
what they say are years now, despite complaints to city of Vaughan officials. "You get smacked in the face. I don’t how many times I’ve tried to get the city. We’ve exhausted very opportunity with the city," said Manza recently. "It seems to me that if they make it frustrating enough for you, you’ll just
go away," he said. Manza said he’s not happy that the tree branches hang down, blocking the way for walkers. And he said the issue is so bad the trees on the boulevard prevent street-lighting from shining onto the sidewalk, causing a safety issue. "It’s a community issue. We pay taxes. I’ve been here
for 30 years and I don’t think you can just blow people off," he said. An inquiry with the city received this response: "The City of Vaughan said it has a street tree-pruning process in place and is currently working in this area of the city. We anticipate visiting Mountfield Crescent within the next few weeks."

Province should heed Justice Tulloch Ontario’s police watchdog needs more teeth. The Special Investigations Unit is a civilian agency that was established to maintain public confidence in Ontario’s police forces by providing independent investigations into serious injury, death or sexual assault allegation involving police. The unit is intended to provide transparency and accountability. Yet both seem to be lacking, raising questions about the efficacy of the provincial oversight unit. The onus is on individual police forces to notify the unit if there is a serious injury, death or sexual assault allegation. The SIU cannot invoke their mandate until they are contacted by police. It’s a system built on selfreporting. Self-reporting is only effective if there are incentives to co-operate. Currently, if police don’t call in the unit, there are no real consequences. That concern was brought to the fore when neither Durham nor Toronto called SIU after an alleged assault by an off-duty Toronto officer in Durham. It was only months later SIU was notified by the complainant’s lawyer. There can be no accountability if there is no reporting, and there is arguably insufficient motivation to report if there are no real penalties. The SIU becomes little more than a toothless watchdog if it cannot invoke its mandate. Meanwhile, when the unit is called in, the public is only made aware of about a quarter of the investigations. The SIU isn’t required to report to the public and only does so as a matter of policy, citing lack of resources for its dearth of public notifications. It’s difficult to claim transparency and build trust and confidence in policing if information is being withheld, regardless of the rationale. Justice needs to be seen to be done, and police forces must be held publicly accountable if there is to be any faith in the system. To do otherwise is to nullify the express purpose of the provincial unit and sow the seeds of doubt and suspicion. These problems, and many more, are addressed in Justice Michael Tulloch’s review of the SIU. His report includes 129 recommendations to improve police oversight in Ontario. This includes a recommendation the law require the unit to report to the public on every investigation and more precise requirements regarding notifying SIU. Former SIU director Ian Scott says if Tulloch’s recommendations are implemented it would make the Ontario unit the most transparent and accountable in the world. That’s a goal worth striving to achieve. With the recommendations already on the table, we just need the political will to make our system truly accountable, transparent and independent.

Re: LETTER TO THE EDITOR: Power reports don’t boost conservation, Aug. 17. Fehr can rest assured those notices about household electricity use don’t mean anything. How do I know? The people at Powerstream/Alectra told me. I began receiving these letters a few years ago amid warnings I was using more current than my neighbours. I had my doubts, since I’m single, use timers, and am surrounded by homes filled with families, often with large numbers of kids. That means they’ll likely be using more plugged-in devices such as computers or TVs, and doing more laundry with power-hungry appliances like
washing machines and dryers. So, after getting one that said I used 35 per cent more power than others near me, I called the utility. The woman in charge told me that unless you register to let the company track your power use, their conclusions are based totally on inaccurate estimates. In other words, they make it up. When I pressed her on whether that was a fair interpretation of the notice, she openly admitted it to me. So, rest easy Mr. Fehr and anyone else who gets these bogus updates. NAMING A GUARDIAN WHO WILL RAISE YOUR CHILDREN IF TRAGEDY STRIKES? The Wills Lawyer The following story is from the book “Where There’s An Inheritance”, written by Les Kotzer and Barry Fish. Rebecca and Kevin had two children aged six and eight at the time they made their wills. They decided to name Rebecca’s sister, Pamela and her husband, Herb, as guardians of their children. Rebecca and Kevin trusted Pamela and Herb to the ends of the earth. Less than a year after making their wills and appointing Pamela and Herb as their guardians, an accident claimed the lives of both Rebecca and Kevin. The provisions of their wills now meant that Pamela and Herb were to be guardians of the two young Michelle Kotzer children. As devastating as the loss of their parents was for these two children, there was even more bad news in store for them. A few months after the two children had settled in to live with Pamela and Herb, Pamela caught Herb having an extramarital affair. Now a nasty divorce was placing the children of Rebecca and Kevin right in the heat of the battle between their aunt and their uncle. Herb unexpectedly raised the stakes in his negotiations with Pamela by claiming custody of Rebecca and Kevin’s children. The fight was bitter. Pamela and Herb had no children of their own, and Pamela accused Herb of using his young niece and nephew as pawns in his battle to extort a better settlement from her. For months, the children seemed to be at risk of having to move out from their aunt Pamela’s home. Pamela ultimately obtained custody of her niece and nephew, but the divorce was both expensive and stressful. If only Rebecca and Kevin had named Pamela as sole guardian, and had not mentioned Herb, Pamela’s little niece and nephew would have been spared a great deal of the pain and suffering they had to endure. To Pamela, it was clear that, if her sister Rebecca could have seen how Herb had abused her trust, and used her two young children as pawns, she would have been horrified. In my wills practice, I see many couples with young children. The discussion of who to appoint as guardian in case both spouses are killed in an accident, is a difficult one. As I once mentioned in a previous article, I do not know how parents with young children can sleep at night without a will appointing a guardian. The person you appoint as guardian will raise your children until they reach the age of 18. Deciding who to appoint as guardian of your children if you pass away is a difficult task, and you should give great thought as to who you are appointing. As the story above illustrates, if for example, you are appointing your sister as guardian, it may be prudent to only appoint her and not her husband. Alternatively, if you are appointing your brother, the same thinking applies. Moreover, some people name the same person as both executor and guardian in their wills. This combination could lead to a potential conflict of interest. It may be prudent to appoint a different guardian than executor in your will. By separating your guardian from your executor, you are establishing checks and balances within the administration of your estate. It is important to remember that the guardian you have named in your will may not accept his or her appointment as guardian once you have passed away. It is important to tell your proposed guardian of your intention to appoint him or her in your will. You should also consider appointing a back-up guardian in the event your primary guardian does not accept the appointment when you pass away. Vaughan-Woodbridge, will have a wellknown Michael in his corner over the next nine months. Michael Di Biase, the former deputy mayor of Vaughan who resigned in May after the city’s integrity commissioner found he sexually harassed an employee, is a volunteer on Tibollo’s campaign. Tibollo, asked about Di Biase’s role, said, "I have known Michael and his wife for many years and hope that they will assist me given their experience and involvement in the community." For his part Tibollo, who won the nomination at the end of May and has just set up a campaign office at the corner of Weston and Langstaff roads, is eager to take on the Liberal government. "After 14 years of power, it doesn’t seem like they’ve got anything under control and it seems like a lot of things are getting worse," Tibollo said. "In the area of mental health and addiction, autism, there’s so much more that needs to be done. In the area of seniors, it’s deplorable we’re putting them through all these expenses with higher and higher hydro rates." The provincial election is scheduled for next June.

A reader asks: How is the Region planning to prepare for the increased traffic generated around the new hospital on Major Mackenzie Drive? Th answer from Lloyd Fernandes, senior project manager at Region of York: The potential improvements to Major Mackenzie Drive between Hwy. 400 and Jane Street include
widening the road to provide transit and high occupancy vehicle lanes and enhanced options for cyclists and pedestrians. An environmental assessment (EA) for this project started earlier this year and work is already underway Through the EA process, York Region will work with residents and stakeholders to determine the specific details for improvements along this section and in front of the new hospital Construction is planned to occur in stages, beginning in 2021. The brilliant reds, oranges and yellows that make autumn such a great time to get outdoors and explore the region’s forests will really start popping in the next couple of weeks and this year’s colour show is expected to be spectacular given all the rain we saw this summer. Here are five prime spots in York Region to enjoy the fall splendour:
VAUGHAN HOUSEHOLD HAZARDOUS WASTE (HHW) DEPOT IS MOVING to the McCleary Court Community Environmental Centre (CEC). Construction is currently underway at the McCleary Court CEC to add a HHW depot and weigh-scales. Once construction is complete, the Vaughan HHW Depot (2840 Rutherford Road) will permanently close and the McCleary Court CEC (130 McCleary Court) will become a convenient one-stop shop for residents to drop off a wide assortment of waste materials including: • polystyrene foam • drywall • scrap metal • electronics • tires • garbage • wood • HHW McCleary Court CEC is located 5 km from the Vaughan HHW Depot.

KORTRIGHT CENTRE FOR CONSERVATION The 555-acre park in Vaughan features an expansive trail network through thick, mixed hardwood forest. Sweet spots in fall include Maple Sugar Bush Trail and the Lookout on Forestry Trail, which affords great vistas of the forest and the East Humber River.

NOKIIDAA TRAIL SYSTEM This 20-kilometre trail follows the East Holland River from Aurora north up to Holland Landing and passes through several conservation areas - Rogers Reservoir, Sheppard’s Bush and Mabel Davis, among them - dotted with deciduous trees. It links to other community trails, providing plenty of possibilities for fall colour viewing.

ROUGE PARK Markham is the northern gateway to this sprawling national park, spanning 5,000-hectares of protected woodland and four municipalities, which is considered by some to be the best place in the GTA to get your fill of fall. Parks Canada offers free, guided walking tours from Oct. 3 to 9. THORNTON BALES CONSERVATION AREANicknamed ’The 99 Steps,’ this 20hectare conservation area in King sits atop the Oak Ridges Moraine and is renowned for its steep slopes and dense forest featuring sugar maple and American beech. The drive along 19th Sideroad is also a treat as it’s lined with towering trees. YORK REGIONAL FOREST The Hollidge and Eldred King tracts off Highway 48 in Whitchurch-Stouffville boast a wide array of deciduous trees with leaves that offer an explosion of colour. There is something special about freshly churned sage butter. "It tastes like stuffing," said Lori Woodyatt, chairperson of East Gwillimbury tourism committee. "It’s really delicious." Sage butter is one of several farm-fresh items people can buy for their Thanksgiving dinner during the Farm to Fork tour in East Gwillimbury. It will be available at the Sharon Temple, the first stop of the tour. Other stops include Thompson Potato Farm, AE Breeding Farm and Natural Meats, Rose Family Farm, Brooks Farm, Sharon Mushroom Farm, Queensville Country Store/King Cole Duck Farm and Vince’s Market. "We’re going to have taste testing pretty much at every single stop," said Madyson Taylor, tourism co-ordinator at the East Gwillimbury Chamber of Commerce. People will also learn about local farms and the history of Thanksgiving. "At each stop we are going to have a small educational component," said Taylor, adding there will also be some child-

They raised half a million that way and they are proud to have made a difference. But something was bothering Michelle. The pressure to be perfect was everywhere - in mainstream media, on the internet, scrolling through Facebook or Instagram, the steady stream of photoshopped images of happiness, the needy search for "likes." Perfectionism is a silent epidemic, she says. It’s linked to everything from motherhood to masculinity. It leads to silence, disengagement and isolation. It is a component of addiction, depression, anxiety. And it’s time, she says, to let it go. Michelle was 16 at the time of the first James Peek Memorial Golf tournament. Now, 33, she has completed a PhD dissertation about love and belonging and "what it means to exist alongside one another". She has also created a short film, in honour of her brother, called F--- Perfect. "This film is intensely personal for me; shame comes in many forms, and mine happens to stem from a struggle with perfectionism. Perfectionism is also, in some ways, part of what lay claim to my brother’s life. To me, perfectionism is death." Creativity, on the other hand, is life - full of failure and risk and vulnerability, as well as hope, discovery and joy. Michelle says shame is often what stops us from ac-
cessing our creative selves and from reaching out. "It occurred to me, how beautiful it would be if there were more art and less shame in the world? And how might this contribute to mental well-being?" The idea gave birth to a new initiative her family has embraced called Art Not Shame, co-founded with Liz Jackson and Jamie Ashforth. Last year was the 17th year for the golf tournament, several big donors each gave $17,000. James was 17, his hockey number was 17. It’s been a good, long run, the Peek siblings agree, and it has been part of their lives longer than it hasn’t been. Each year James’ parents addressed the crowd, sharing their pain with others in a way that James could not, and in a way that offered comfort to others. As successful as it was, it seemed an appropriate time to wrap it up - and replace it with this new initiative they hope will reach a wider demographic. The first Art Not Shame workshop will be a pilot run through the CMHA-York and South Simcoe and will provide youth with artmaking workshops - vetted and supervised by mental health professionals - in schools and community health programs. Artists-facilitators will lead participants through collaborative art-making and storytelling workshops in a supportive community. Co-founder Liz Jackson, a teacher and researcher,

It accounts for 24 per cent of all deaths among 15- to 24-year-olds in Canada. Suicide is the second leading cause of death (after motor vehicle accidents) for Canadians between the ages of 10 and 24. The CMHA suggests this high risk may be linked to the challenging times of change during adolescence, when youth transition to adulthood and feel pressure to succeed. At the same time, teens may lack the life experience to know that difficult situations will not last forever, and stigma, guilt or shame makes them reluctant to discuss their struggles or seek the help they need.
