Impaired driving: the grey area of pharmaceuticals By Samantha Beattie

hen Robert Phillips got into his car one Tuesday last May he felt fine. Within a few hours, though, he’d come close to falling asleep at the wheel as he swerved into oncoming traffic and forced transport trucks onto the highway’s shoulder, said Crown attorney Ted Carlton in a Muskoka courthouse Dec. 22, 2015. Police eventually stopped the Parry Sound resident in Bracebridge. “The officer found Mr. Phillips had no odour of alcohol on his breath, but a slight slur in his speech,” said Carlton. “He stated he’d taken his medications that morning and simply felt tired.” Later that day, May 6, 2015, a urine test revealed Phillips, then 43, had a number of drugs in his system, including oxycodone – an opioid pain medication. His family doctor had prescribed the drug cocktail after Phillips suffered four concussions in five years, said defence lawyer Peter Ward. Immediately following the incident Phillips went to his family doctor who adjusted his medications and found a solution. Phillips was initially charged with impaired by alcohol, but it was withdrawn. Phillips did plead guilty to another charge – careless driving. “I had just started a new blood pressure pill and I think that’s why this happened,” Phillips told the court. At the time of the incident, he had no criminal record and a very small number of Highway Traffic Act infractions. “It scared me as much as anyone else.” Phillips was sentenced to 12 months probation, a $750 fine and a 45-day licence suspension. He did not respond to multiple requests for comment. Cases like Phillips’ are becoming more common across Ontario. Impaired driving by drugs happens almost as frequently as impaired driving by alcohol, said OPP Sgt. Dave Wallbank of the Highway Safety Division. Marijuana is the leading drug of choice, followed closely by pharmaceuticals, he said.

Impaired driving by drugs happens almost as frequently as impaired driving by alcohol, according to the OPP. The OPP are currently not tracking the number of pharmaceutical-related cases, but it’s “not rare for traffic officers to encounter drugs from the prescription world,” said Wallbank. Prescribed opioids like oxycodone (as Phillips was taking), sedatives like Valium and even stimulants like Ritalin can impact a person’s ability to drive, according to the Canadian Centre on Substance Abuse. Research shows opioids and sedatives can cause drowsiness, impair co-ordination, reduce ability to multitask and increase errors. “Studies of traffic crashes reveal that drivers who test positive for the use of sedatives are two to eight times more likely than alcohol-free and drug-free drivers to be involved in a fatal traffic crash,” said the CCSA’s report. That statistic applies to opioid use as well “The driving behaviour of someone who has used opioids might include noticeably slower driving, weaving, poor vehicle control and delayed reactions,” the report notes. Stimulants can initially reduce feelings of tiredness, but once the effects wear off

drivers might experience intensified fatigue, depression and inattention. “Among drivers stopped by the police, who were subsequently found to have been using stimulants, inattention, speeding, risktaking, poor impulse control and aggressive driving are common,” said the report. When Phillips’ doctor slightly altered his medications, Phillips told court he had no idea it would impact his driving ability so profoundly. But it did and he was held responsible. “He was aware the impact his medication was having on him, but he continued to drive and didn’t have reasonable consideration of others using the roadway,” Carlton said in court. When doctors prescribe medications the College of Physicians and Surgeons of Ontario requires them to advise their patients about the risks and benefits, said spokesperson Tracey Sobers. This includes drug affects and interactions, side effects, precautions and instances when the drugs should not be taken. Pharmacists also have a responsibility.

“It’s absolutely the job of the pharmacist to inform patients of medication risks and if those risks are aggravated because of other medications,” said spokesperson Lori DeCou on behalf of the Ontario College of Pharmacists. “Having said that, patients have a role to play as well in staying informed,” she said. Canadian pharmacists are required under their standards of practice to review each prescription a patient takes to ensure it is the most appropriate and there are no significant interactions with other medications. If a patient is at risk of experiencing problems, the pharmacist is to go through a review process to educate the patient, make changes to therapies, or recommend changes to the patient’s doctor, according to the standards of practice document. When it comes to warning labels, that’s not up to pharmacists, but rather Health Canada and the drug manufacturer, said DeCou. Some prescribed medications, including a handful used to treat anxiety, depression and insomnia, have warning labels, such as, “may cause drowsiness,” “do not operate heavy machinery,” or “do not drive,” reports the Ministry of Transportation. Over-thecounter drugs like Benadryl and Claritin come with similar warnings. Medications without explicit warning labels can also impact driving ability, according to the Canadian Safety Council. “People should be concerned about any drugs that impact their ability to divide attention,” said Wallbank. “If they think there’s any potential, then they should not be driving.”

The province’s Special Investigations Unit was called in after a 49-year-old man was struck by a northbound vehicle in the northbound lanes of Hwy. 400 at Major Mackenzie Drive at 4 a.m. on Monday. The man jumped from the bridge and was pronounced dead at the scene, a police source said. Five investigators and three forensic investigators have been assigned to investigate the incident. The SIU is urging anyone who may have witnessed the incident to contact the lead investigator at 1-800-7878529. The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault.

These include native monitoring for any archeological finds, as well as habitat protection of various wild species. TransCanada, according to the NEB, also accommodated route change requests private landowners made. The Vaughan pipeline section will connect to the 11-kilometre King North Connection pipeline TransCanada is completing.

Company fined $50K A Concord company has been fined $50,000 after a

worker was hurt by a falling post. The worker was dismantling and replacing a steel storage system for Welded Tube of Canada Corp., at 541 Bowes Rd., March 5, 2014, according to a Ministry of Labour news release. The storage system reportedly consisted of sleeper beams, hollow steel tubes laid out on the ground, along with vertical upright posts that were welded onto the beams. A worker cut loose an upright support and the ensuing movement of the beams caused the posts to fall, striking a worker who was injured. The Ministry of Labour, in its investigation of the company, found the sleeper beams were not adequately anchored to prevent their movement. The injured worker has returned to full-time duties. The fine was imposed by Justice of the Peace Karen Walker in Newmarket court. — Tim Kelly

Re: Woodbridge litter embarrassing, letter to the editor from Bartolomeo Parete, Aug. 11. Great statement Mr. Parete. I can see how neighbourhoods are falling apart in Vaughan. You should see my street. I live on David Todd Avenue. What a terrible paving job the city did, little patchup jobs that look like black bandages. When I take my my dog for a walk through the hydro field? Disgusting. April to June, the grass would be 12 inches tall with weeds. You have to call to get get your property’s trees trimmed. My two neighbours’ trees were dead for four years. The trees were finally removed two weeks ago. I wonder if these same situations exist on the streets where our famous politicians live?

I spent much of my free time last weekend escaping all the problems in the world around me and watching the Olympics. Everything was going fine until I came across a beach volleyball match in which Canada was competing. I am — as are many other Canadians — an immigrant, and normally there’s no question for whom I would cheer, since I am a Canadian citizen by choice. In this case, however, because they were playing the motherland, I found myself bewildered, even if but for a split second. Then I thought of how lucky I am, either way one of my favourites is going to win the match. I watched the match and every once in a while cheered out loud: “Let’s go Canada,” knowing full well in different circumstances the cry would surely be “Forza Italia!”

Re: And what about ‘patriot’ love?, column by Bernie O’Neill, July 28. Column spoken like a true white man ignorant/oblivious of his privilege and the systemic sexism and heterosexism still evident every day in Canada. By the way, when the words were amended from “us” to “sons”, it was likely to invoke patriotism for our male troops in the First World War. Of course, women weren’t allowed to vote then. Being anything other than of a binary gender construct was illegal. And 100 years later, our new prime minister had to justify why half of his cabinet was female. If I wrote these words on social media, I would likely be threatened by “our sons” with sexual assault. I am one of the uncool people singing “in all of us command” at the game.

U

ntil Markham phenomenon Andre De Grasse ran into our TV screens and onto the Olympic podium alongside the world’s fastest man, Usain Bolt, all the medals won by Canadians were earned by women. Over and over again, sportscasters — usually male — referred with admiration, but some amazement, to the fact that all the medal winners until Sunday night’s marquee 100-meter event were female. It made me think of a media campaign, which started in Toronto, New York City and Los Angeles just before the Olympic Games began, to “call out” or shine an unfavourable spotlight on media commentary that judges female athletes on their appearance, rather than on their skills. A Dove #MyBeautyMySay campaign holds the premise that all too often, female athletes are featured in sports magazines and news stories in passive poses, glamourized and sexualized, while male athletes are portrayed in action-oriented ways emphasizing their skills. It further hypothesizes that too often media commentators focus on the looks of female athletes and on appearance rather than achievements. An interactive billboard campaign launched July 26 at YongeDundas Square in Toronto, along with other key U.S. cities, asking people to “call out” or aim negative Tweets at media outlets or commentators which belittle women athletes. Campaign organizers do credit Canadian media with being far more positive in their views and commentary on women athletes, but said such is not always the case with other media globally. As part of their rationale for the campaign, Dove and Unilever pointed out that eight in 10 (81 per cent) of Canadian women wish the media did a better job of portraying women with diverse physical appearance, and of varying ages, races, shapes and sizes. But then came the Olympic

Marney Beck Games in Rio. And onto the world stage burst a group of talented, courageous and skilled athletes — swimmers, such as triple-threat Penny Oleksiak and synchro duo Meaghan Benfeito and Roseline Filion, rowers Lindsay Jennerich and Patricia Obee, our bronze team of women pursuit cyclists, the entire women’s rugby team and — of course — our own golden trampolinist Rosie MacLennan. Who would dare write, or Tweet or Facebook about these medalwinning athletes by focusing only on their appearance, their makeup, or their clothing? Sadly, sometimes media representatives in their articles and more often their readers in social media posts do consider appearance or clothing or other superficial factors. We all know that online commentators, especially, can be cruel and cutting — even vicious. Tessa Virtue, Canadian ice dancing champion, is part of the #MyBeautyMySay campaign. She admits that she’s been the target of mean-spirited comments calling out for her to “be thinner” or “don’t eat” to be the best she can be in a sport that combines artistry with athletic skills. “Let’s face it, all women are judged too often on their looks instead of their accomplishments,” states Virtue. So while it’s hard to imagine that any online discussion about our medal-winning athletes would focus on their physical attributes, their swimsuits, hair or overall looks, if you see any derogatory comments aimed at our women Olympians, you’re invited to call them out at #MyBeautyMySay.

A new annual event that organizers hope will prove to be a howling good time is set to kick off in Vaughan this fall. The inaugural Woof-A-Palooza — featuring a fashion show, a talent contest, an Ask the Vet booth plus a microchip clinic, pet photo portraits and a “Pampered Pooch” salon, among other things — is slated to run Saturday, Sept. 17 at Boyd Conservation Area,

150 reasons for city to celebrate our country’s sesquicentennial BY SIMONE JOSEPH

She is turning 150 next year and Vaughan plans to party. The countdown to a year of Canada-wide celebrating is on. The milestone — known as the sesquicentennial — promises opportunities for citizens and visitors. Businesses, community and cultural groups will participate and embrace their civic pride. Ward 4 Vaughan Councillor Sandra Yeung Racco and Ward 5 councillor Alan Shefman have formed a celebration task force, with regional councillor Mario Ferri and regional councillor Gino Rosati also representing council on the team. The task force includes citizens from each ward and representatives from community organizations, including the Vaughan Chamber of Commerce, Heritage Vaughan and Vaughan Public Libraries. The group will consult residents, businesses and community organizations to collect ideas for how Vaughan can make meaningful contributions to help mark the commemorative year. The city has submitted a grant application to the Canada 150 Fund, which aims to support Canadian values, culture, history and pride through commemorative activities and programming. The city will also apply for grants through Ontario150, which provides funding for local celebrations, community partnerships and

improvements to existing infrastructure. The money would go toward innovative programming to reach a diverse audience and make a lasting impression on the community. Community groups and organizations, such as registered charities and athletic associations, interested in organizing local Canada 150 initiatives are encouraged to apply for funding through Community Foundations of Canada, which aims to support local projects through small grants. Eligibility must first be confirmed before the three-part application process can be completed. The CFC offers a fact sheet that explains the funding opportunity. Funding under the Ontario150 Community Capital Program is also available. The Ontario Trillium Foundation is hosting webinars until the end of August to help community organizations understand the program and application process. The city will be using the hashtag #VaughanCAN150 to communicate news, information and updates about Canada 150 in Vaughan on social media. The public is encouraged to start using the hashtag. Follow the City of Vaughan’s Facebook, Twitter, Instagram, YouTube and blog and subscribe to the City Update eNewsletter to see Vaughan’s Canada 150 photos and videos and receive news and alerts. A section of vaughan.ca will be dedicated to Canada 150 in Vaughan and is expected to launch before the end of the year.

Neville-Lake family members remembered at park celebration BY MICHAEL HAYAKAWA

Gary Neville-Lake along with his grandchildren, Harry, 5, Daniel, 9, and Milly, 2, were killed last September when the vehicle in which they were travelling was struck by another vehicle, driven by impaired driver Marco Muzzo. But their memories will live on. As a means of remembering and celebrating their lives, people from all over southern Ontario converged at Wellesley Park in King City on Sunday for the Neville-Lake Family Memorial Day. Four trees were planted and plaques placed on benches bearing each of their names at nearby Kettle Lake Park. In anticipation that a large gathering attending the festivities, the event was moved to Wellesley Park. “The main focus is to honour the kids and to remember them and to support the family and to do something nice for the commu-

nity,” said Jennifer Waxman-Stallman, who organized the special day. Waxman-Stallman said a little over two years ago, she started a Facebook group and blog known as Entertain Kids on a Dime. She had some 60,000 members, one of whom was Jennifer Neville-Lake, mother of Harry, Daniel and Milly. When the incident occurred, WaxmanStallman immediately stepped up to reach out to the family. She also raised funds for the memorial plaques and benches and the four trees were donated by Greenside Gardens N More. As well, the Township of King donated the blown-up photographs and helped cover the cost of labour for the tree planting. During the festivities, a number of youthrelated activities took place and donations were accepted on behalf of the Neville-Lake family. Youngsters had the chance to get their hair coloured to one of four available colours

based on the month each of the Neville-Lake family members that passed away was born. For those who came to the inaugural event, it was a means of showing their love and affection for the Neville-Lake family in a time of need. “I just feel sad,” said Maple resident Georgia Catsoulis, who came with her son, Gabriel. “I just wanted to come out to support the family.”

‘be supportive’ “We want to be supportive because we have young kids of our own,” added Peter Budziak of Maple. “We can’t imagine what they’ve gone through and we want to support them and the community and with our daughter (Delfina) going through a serious health care issue (a liver transplant), we want to lend our support.” While not knowing the Neville-Lake family, Mississauga resident Violet Perdoma felt she should be there. “We heard about the festival and we came out as a way to pay respect,” she said. King City resident Nadia Pascuzzo felt the impact of the incident was one that will last a long time. “Usually stories last a day, but we think of them (Neville-Lake family) every single day.

This is forever. What happened to them will have a lasting effect,” she said. Highlighting the festival was the release of four white doves, with youngsters in attendance having the honour of holding them before they were released. With Waxman-Stallman relaying a message from Jennifer Neville-Lake, who was unable to attend, she thanked those who came out for the festival along with the number of people who showed their support and volunteered their time. “From the bottom of our hearts we want to thank you for the love and support for our family,” she said. “It means so much… thanks for remembering my father and my children.” Waxman-Stallman also said a few words and wanted to make sure an incident that took the lives of the four members of the Neville-Lake family does not happen again. “This tragedy could have been prevented. It’s important to teach youngsters the dangers of drinking and driving,” she said. Reflecting on the day’s festivities, she said: “I think it went really well and it was nice to see lots of families that came out. I hope we can do this again and get more people out next year. We don’t want to forget it. This is a memorial and a celebration.”

Just four years ago, Jon Costa had never heard of the sport of fencing. But after receiving a copy of Sportsnet Magazine and browsing through it one day, he came across an article and pictures about fencing that caught his attention. Costa, now 16, became intrigued by the sport and elected to take it up three years ago at the Swordplayers Fencing Academy in Toronto. The lessons and dedication displayed by Costa ultimately paid off this season when he made his competitive debut in the discipline of epee and eventually earned a spot on the Ontario team that competed at the Ontario Summer Games in Mississauga. In making his competitive debut Friday at the Ontario Summer Games where he finished seventh, Costa was elated but nervous in facing fellow competitors from across the province. Including some who might possess a little more experience. “It was exhilarating,” said Costa, who will enter Grade 11 at Father Bressani Catholic High School. “But the excitement did not come without pre-competition jitters. I wanted to represent both myself, and my club the best that I could. “And I had some fun in the process. It was also a fantastic opportunity to meet other athletes, make new friends, and explore other lesser-known sports that I may not have the chance to see otherwise.” In punching his ticket to the Summer Games, Costa pointed out he was required to compete in a selection of Ontario Fencing Association approved tournaments. Each result led to a corresponding number of points. “By placing second at a competition held at Brock University,

Foremost is the tutledge he’s received from Igor Tikhomirov, an epeeist who has won numerous medals in national, European and world championships, Pan-American, and Olympic events. At the same time, he said much of what he’s aquired thus far in the sport would not be possible without the support of his parents, who arranged a trial fencing lesson for him when he began, and in taking him to various events. Costa hopes participating at the Ontario Summer Games, will lay the foundation to continue up the competitive rank and file and lead him to bigger things in the sport. He was quick to point out the sport has scholarship opportunities south of the border. That is something he’s setting his sights on. For now, though, it’s a case of forging ahead. “I plan to continue fencing well into the future, and hope to secure a spot on the Cadet (under 16) or Junior (under 19) national team,” he said of his short-term goals. “University scholarships also exist for the sport - something that I can set my sights on and strive to acquire. “Other than that, I am unsure of how far I can go with fencing - whether it be at the club, national, or international level. I simply hope to do the best I can, and let my results carry me forward.”

2017 Mazda3 fitted with GVectoring Control Mazda has announced the 2017 Mazda3 with notable improvements in refinement, packaging and handling. The 2017 Mazda3’s exterior tweaks are subtle, but effectively elevate the vehicle’s KODO—Soul of Motion design, adding a bolder grille, available LED headlights and tail lights, and a redesigned rear bumper on five-door models that extends an upscale, monochromatic look to the lower valences. The new Mazda3 will come standard with G-Vectoring Control (GVC), an allnew, Mazda-exclusive technology that uses the engine in conjunction with the steering, throttle inputs and suspension to provide sharper chassis control, leading to a need for fewer steering corrections and greater driver- and passengerconfidence. Much as Mazda3’s already engaging steering has improved with GVC, Mazda’s engineers have upped the ante with improved NVH damping, too. The 2017 Mazda3 is a substantial 3dB quieter going 40 km/h over rough roads, thanks to tighter body gaps, improved sound insulation and redesigned weather stripping versus its 2016 predecessor. With the 2017 updates also comes the adoption of available Advanced Blind Spot Monitoring and Traffic Sign Recognition as well as a new, full-colour Active Driving Display. These safety features complement Mazda3’s i-Activsense suite, which includes Rear Cross-Traffic Alert, Mazda Radar Cruise Control, Smart City Brake Support and Smart Brake Support for highway speeds. Honda Civic Hatchback coming this fall Arriving this fall in Canada, the 2017 Civic Hatchback is the latest addition to the 10th-generation Honda Civic lineup. The 2017 Honda Civic Hatchback combines striking, Euro-inspired styling and five-door versatility with the Civic’s world-class driving dynamics and Honda direct-injected turbo engine technology. The Civic Hatchback will also serve as the basis for the radical new Civic TypeR launching in 2017. Built on the same world-class platform as the 10th-generation Civic Sedan and Coupe, the hatchback offers an appealing combination of sporty styling, efficiency, interior utility and premium features. The Civic Hatchback will be available in LX, Sport and Sport Touring trims, and will feature a single engine for the Canadian market, a 1.5-litre DOHC direct-injected turbocharged in-line 4-cylinder with peak output of 174 hp and 162 lb/

ft of torque in LX trim and 180 hp and 162 lb/ft of torque in the Sport and an all-new Sport Touring grade, which feature a high-flow centre-mounted exhaust. The turbocharged engine will be offered with either a performance-inspired six-speed manual transmission or a sporty CVT. Anticipated NRCan fuel economy ratings of 7.7/6.0/6.9 L/100 km on the LX CVT trim and 7.9/6.6/7.3L/100 km on the Sport and Sport Touring CVT trim. melt away, that normally means its time to put the boards away until next winter. However, the three 32-year-old snowboarding enthusiasts and entrepreneurs came up with an idea to maintain their love of the sport during the offseason.

The trio is bringing the sport indoors. They will be doing it on man-made inclines covered by a custom ordered astroturf surface similar to a soft plastic grass in an indoor snowboarding facility in Vaughan known as Axis Freestyle Academy. The facility is billed as a “year-round indoor dryslope+trampoline ski & snowboard training park to perfect your skills safely”. Located at 356 Four Valley Dr., the academy is housed in a 20,000-sq.-ft. facility. While it might appear their facility caters to the avid snowboarder, that’s not the case, Ching said. They want to encourage beginners with the hope it will translate into more participants taking to the slopes in winter. “We will be fully equipped for beginners to advanced athletes,” he said. “Our goal is to be a place of learning and skills development.” Noting their training facility is the first of its kind in Canada, Ching said their indoor recreational place is the result of exhaustive research on similar facilities in other countries. “We did countless hours of research and based our plans from existing facilities around the world. Mainly in Australia, the United Kingdom and the United States,” Ching said. The facility will be equipped with custom high performance trampolines, a variety of jumps and rails, foam pits, a gym and multipurpose/yoga studio.

Feeling such a facility would work in Canada, the trio elected to locate in Vaughan. Choosing York Region was largely derived from studying demographics. With their facility undergoing development over the last three years, Ching estimated they have invested more than $500,000 to get where they are now. “We really don’t come from wealthy backgrounds, so it’s been lots of hard work and sacrifice to get where we are now,” he said. Once their facility is open for business, which they hope will be before the end of this month, Ching said they intend to have their doors open for snowboarders from 8 a.m. to 11 p.m. each day. “The morning and early afternoons will be for private bookings, camps, parent and toddler time,” he said. They are making plans to conduct afterschool programs and drop-in sessions for the remainder of the evenings. On weekends, they hope to host events for the community. “We have plans to offer classes for all levels of riding and teach the fundamentals of progression,” he said. Loving husband of Jan for 46 years, Maria is survived by loving sons, Jamye and Daryn, daughter-in-law, Noelle, and “bestest” grandchildren; Emma, 12, Patrick, 10, and Sophie, 8, who all loved her dearly. Maria was also a wonderful daughter to Marjorie and Alexander Embling of Brampton and a caring sister. Her hosta garden was a priority but Maria could not be happier attending bingos, casinos, or horse races. She also loved boating, tennis, woodcarving, and music. Maria’s sense of humour carried her through life and she will be forever greatly missed. A cremation service has already been held. Family and friends are invited to a celebration of Maria’s life on Saturday, August 20, 2016 in the barn at 2323 Line 13, Bradford West, Gwillimbury. Social at 2 p.m., service at 3 p.m. and casual dress reception to follow. In lieu of flowers, please consider a donation to ‘Marjorie’s Kids’ at the Pediatric Oncology Group of Ontario (POGO) at Southlake Cancer Centre. Donations will be accepted at the celebration.
