Number of incidents in York Region on the rise in recent years By Jeremy Grimaldi

Marco Muzzo was sentenced to 10 years in prison for wiping out an entire generation of the NevilleLake family, but if such sentences don’t help reduce drinking and driving numbers, then what is the point? This is the conversation that many members of Canada’s judicial community are having in the wake of the sentence Muzzo received Tuesday. Although this is the longest sentence handed down to an impaired driver without a history of offences in Ontario, police and lawyers are wondering what needs to change outside the courtroom to make a dent in the numbers. The reality is, the numbers make

for ugly reading. A statistician with York Regional Police found that between 2013 and 2015, the number of drunk drivers caught by the service rose 43 per cent, from 795 to 1,140. More recently, just as Muzzo’s sentence was being handed down on Tuesday, York Regional Police reported a “disappointing” long weekend of impaired driving on our roads. Thirteen drivers were arrested and charged with alcohol and drugrelated criminal offences between March 24 at 11 p.m. and March 28 at 1:40 a.m. Criminal defence lawyer Ari Goldkind, who often works in York Region, said Muzzo is not his main concern. He’d rather focus on the countless drunk drivers who walk into Newmarket courthouse daily before having their “wrists slapped” with a $1,000 fine and a one-year driving ban. “What happened to Marco Muzzo was the equivalent of a public lynching,” he said. “We all point

our fingers at Marco Muzzo as if he woke up in bed and decided to go out to be Paul Bernardo. But, in reality, the only difference between him and another drunk driver is he had the misfortune of ploughing into the beautiful Neville-Lake family.” He said rather than engage in a public show court, like he contends occurred with Muzzo in the media and on “anti-social media”, the public need to shame the “10,000 other drunk drivers” in our court system. To do this, Goldkind says two things need to happen. The first is that the government needs to lower the drinking level from 0.8 per cent blood alcohol level, which drivers are currently allowed in their systems, to zero. Goldkind is not the only one who thinks this is the obvious next step for the provincial government. York police Const. Andy Pattenden said removing the decision about whether to have “one or two” drinks before getting behind the

wheel would go a long way toward lowering drinking and driving numbers. “If you could remove that decision, it would make it an easier choice for people,” he said. “As it stands, the law gives some people the ability to have some, but others too much.” Const. Pattenden said the system we currently have is often left up to doubt, relying on citizens to decide whether they have had to much to drink. But, he said, the reality is there are so many factors that go into deciding — including whether someone has eaten, is hydrated, their weight and height – it’s difficult for anyone to do so. He said the reality is if hearing and watching the details of Jennifer Neville-Lake’s story doesn’t stop people from drinking and driving, which it clearly hasn’t, in York Region at least, then what will? “Every person in York Region knows this story,” he added. “And still every weekend in York Region

a significant number of impaired people continue to make that decision knowing the worst possible outcome. Then what will it take? The second suggestion by Goldkind is to threaten each and every impaired driver with incarceration. “The message is not getting through and police don’t have the resources,” he said. “As crude an instrument as jail is, I would say prison is on the table until behaviour changes.” Muzzo is expected to spend upwards of three years behind bars when time served and parole are factored in to the sentence. Muzzo, who pleaded guilty last month, is also banned from driving for 12 years after his time in custody. The collision killed Daniel Neville-Lake, 9, his brother Harrison, 5, their sister Milly, 2, and their grandfather, Gary Neville, 65.

Marco Muzzo’s 10-year prison sentence was due, in part, because of previous driving convictions and a seemingly “irresponsible” attitude toward the “privilege” of driving, court heard Tuesday morning. Muzzo stood looking straight ahead as Justice Michelle Fuerst read out her judgment. “I am acutely aware the NevilleLake and Frias families will...continue to serve the form of life sentence that Mr. Muzzo inflicted on them by his decision to drink and drive,” she told the court before advising him of his sentence, minus eight months for time served. Jennifer Neville-Lake and her husband, Edward Lake, who were holding hands throughout the trial, removed their glasses and cried and

After the trial, Jennifer stood in front of reporters and showed them a collage displaying pictures, including one of two of her children holding hands before they died. She also said she has been hearing people have contacted the media in hopes of selling pictures of her deceased children and asked the assembled hordes not to buy them. “The sentence was 10 years,” she said. “None of my children saw 10

years.” Prior to delivering the sentence, Fuerst told the court just how illequipped it is to deliver reparations to victims of a tragedy such as this. “While the criminal justice system can deter and denounce, it is ill-suited to make reparations for harm of the magnitude involved in this case,” she said. Muzzo, who pled guilty last month, is also banned from driving for 12 years after his time in custody. After the decision, Crown attorney Paul Tait said he found the decision “eminently fair” and said this is the highest sentence for any drunk driver without a previous record in the criminal justice system. Defence attorney Brian Greenspan said his client has displayed his remorse about his actions from the beginning.

They don’t know what we are, we creatures huddled in our metal capsules, wheeling past at breakneck speeds. They just know they need to get to their breeding ground, or to the roadside gravel so soft for nesting, or they want to bask on the sunwarmed pavement. And in horrifying numbers, reptiles and amphibians end up smushed under our tires. It’s an increasing problem in our suburban communities where development is destroying habitats, leaving wildlife in shrinking, isolated patches with no way to escape. But the Toronto and Region Conservation Authority (TRCA) says there is something you can do to help. It is launching a new initiative — the Road Ecology Citizen Science Project — using volunteers to help gather data on wildlife “road interaction”. The conservation authority is looking for citizens with an interest in ecology and biology to conduct field surveys and walk the roadside of pre-

determined monitoring sites, recording all signs of wildlife crossing, basking, feeding, nesting, injured and deceased on and around roadways. The TRCA is also launching a new Road Ecology application to gather the data; it will be available for download to the “citizen scientists” who register to participate. “The work by volunteers will support the work we are doing on assessing connectivity of habitats,” said Kasey Livingston, a project manager. Terrestrial and aquatic creatures are being harmed by the GTA’s growing transportation infrastructure, she said. Habitat fragmentation and vehicles striking and killing wildlife have made roadways “one of the greatest threats to the persistence of wildlife populations in urban and urbanizing areas,” she said. Amphibians and reptiles face danger when they mass migrate between wetlands, for example. Frogs or salamanders often try to cross roads to move from one breeding pond to an older one that has been ingrained in them over generations, she said.

If the Citizen Scientist project can validate where hot spot priorities are, the TRCA can take steps to protect that wildlife, said Vince D’Elia, project manager. The conservation authority has identified four sites across the GTA where wildlife is particularly vulnerable, including areas in Brampton, Caledon, Oak Ridges and Richmond Hill. Volunteers aged 18 or over (or over 14 years of age if accompanied by a legal guardian) will be required to attend at least one field training session to learn about safety, species identification and data collection protocol. They will be asked to commit to eight hours a month (in two-hour morning segments) from April to October. The project orientation session is Thursday, April 7, from 7 to 8:30 p.m. at the TRCA offices in Vaughan. Field training will be held throughout the month at Heart Lake Conservation Area in Brampton. Five York Region writers make book a reality

ome writers might not think it auspicious that a new book be published on April Fool’s Day, but five writers from York Region are thrilled their book, As The Ink Flows, will be a reality on April 1. The aim of the book is to “inspire writers” according to one of the five, Melony Teague of Oak Ridges. “It is a rare thing to have writers work together on a project in such harmony,” noted Teague, who has also written columns for York Region Media newspapers. “We are from different backgrounds and age groups, but have formed a strong bond both as friends and as writers. We all have such different styles, but blend together well.” The book began life in the home of Newmarket’s Carol Ford back in the fall of 2012, where she started a writers’ group. One member, Stouffville’s Glenda Dekkema, asked if anyone wanted to join her in a writing contest. Teague agreed, and as the two started working on their creation, they discussed it with the other group members. Marguerite Cummings of Richmond Hill was inspired to write several poems, and Ford and Claudia Loopstra of King Township added some of their creativity to the mix. And as fate would have it, the women decided not to enter the original writing contest after all, but to make their collaboration into a book and attempt to find a publisher. That was a lengthy and challenging quest. “Our collaboration on the book has given us insight into the multiple stages and challenges of getting a book published. We sent out our book proposal to over 30 publishers listed in a writer’s marketing guide and from that we were offered a publishing agreement from Judson Press,” said Ford. So, no easy task to write a book

The secondary headline of the book is “Devotions to Inspire Christian Writers & Speakers” and that is a key aim of the group. “The talents, perseverance and faith of my friends in our writers’ group inspire me to become a better writer,” wrote Dekkema, or as Cummings wrote in a similar vein: “To me, this book is all about the power of partnership: partnering with one another at each stage of the book...” The creative process inspired group members in other ways, as well. “Being part of a writers’ group spurred me on to complete my memoir. The experience of being with like-minded women expanded my knowledge with respect to the craft of writing,” wrote Loopstra. If all this hasn’t piqued your interest yet, consider this glowing statement by Laura Alden, publisher of Judson Press: “This book is a testament to the skill of these authors — five of them! — who committed to work together to help others navigate the spiritual ups and downs of becoming and being a writer. I’m a retired RN and write this letter to raise awareness on how neighbours can help avoid elderly caregiver burnout. “It takes a village to raise a child” is a familiar saying to many parents. It recognizes that parents need the help of other parents to raise a healthy young villager. The same holds true at the other end of life’s spectrum. It takes a village to help look after aging villagers — or in other words, families need the help of their neighbours to look after their aging parents who wish to remain in their homes. Often parents have jobs, children and houses to look after alongside their inhome elder family member. Eldercare at home is a 24/7 labour of love. Families can’t effectively do it alone and government respite assistance simply isn’t enough. So what can we do to help our neighbour who is looking after their aging parents?

Simply lend them a hand and an ear. Offer to sit with their aging parents, while they take a break. Pop over a casserole “just because”. Offer to pick up groceries when doing your errands. Shovel their snow, rake their leaves, collect their mail/garbage bins from their driveway, etc. Or you could offer to go with your neighbour to their aging parents’ long appointments. This way you can assist with wheelchairs/walkers etc. and provide a much-needed coffee break and a listening ear. Let’s recognize in practical ways the value of a village working together for the benefit of young and old. After all, there’s another saying: “many hands make light work” and contribute to a vibrant, healthy village.

An 80-year-old Vaughan man died after a vehicle collision March 24. Police are seeking witnesses to the collision, which took place just before 9 p.m. on Martin Grove Road, south of Forest Drive in Vaughan. A grey Nissan Sentra car and white Ford F-150 pickup truck collided and the Sentra then struck an unoccupied

Honda Civic, police said. The 80-year-old man, who was driving the Sentra, was taken to hospital with life-threatening injuries, and later succumbed. The driver of the Ford, a 17-year-old Vaughan boy, was taken to hospital with non-life-threatening injuries. Anyone with information

York Region dancers performed at a Toronto Raptors game Wednesday to promote autism awareness. These dancers, from southern York Region dance studios, performed in the Autism Acceptance show. Dancers, including students from Dance Zone Dance Studio and, Evolutions Dance Studio, performed centre court at the Raptors game. They will include people of all abilities. Performers at centre court danceed to an original song, co-written by Thornhill resident Brianne Buckman-Kalechstein, called ‘Unstoppable’. BuckmanKalechstein, a mother of two, spearheaded an Autism Acceptance flash mob event last year before the autism awareness night at the Toronto Raptors basketball game. About 150 volunteers descended on Maple Leaf Square in Toronto for that flash mob. Buckman-Kalechstein has a son with autism. “I do this to erase negative stigma associated with autism,” she said via e-mail. Wednesday’s event is Buckman-Kalechstein’s fourth annual Autism Acceptance project. In the first year, BuckmanKalechstein, who grew up in Richmond Hill, asked dance

Since then, she has started her own charity, Cookies 4 Tough Cookies, and helped to raise almost $25,000 for pediatric brain tumour research.

on a hearing for the proposed seven-storey, 119-unit building at the corner of Woodbridge Avenue and Wallace Street — an area designated for heritage protection where two historic homes currently stand. And councillors are hoping, in the meantime, that the developers, Cityzen Development Group and Fernbrook Homes. will work with planning staff and a heritage consultant hired by the municipality “to improve” the proposal. It’s unclear, at this point, if the developers are willing to make changes to the proposal. Calls and emails to the developers’ representative were not returned by publication deadline. Depending on what unfolds, council is slated to render a decision on the rezoning application and site plan by June, at the latest. Regardless, in all likelihood, there will still be a seven-storey building on the site. That’s because council, back in January, signed off on a settlement agreement with the developers to resolve an appeal of the city’s official plan, The agreement allows for a seven-storey building on the properties, instead of only four-storeys as permitted under the official plan. In return, the developers agreed to make a $100,000 contribution toward streetscape improvements along Woodbridge Avenue. “It (a seven-storey building) is a given so we can’t do anything about that,” Regional Councillor Michael Di Biase said. “But the concerns from the ratepayers, all the letters they’ve sent in and

I think we can deal, still, with the (concerns) through the zoning and the site plan.” Council’s move to postpone a decision on a rezoning application and site plan comes a few weeks after a group of angry residents flocked to city hall to object to the developer’s proposal. That proposal includes levelling the hilly site, removing several large trees and relocating portions of Dr. Peter McLean House (built in 1893) and Thomas Frazier Wallace House (built in 1875) to the edge of the property to accommodate a 119-unit condominium building. At that meeting, residents argued the building, described by many as institutional-looking, would overshadow the historic homes. They also opposed the destruction of several mature trees on the property and raised concerns about adding more traffic in an already congested area, among other things. Christopher Tanzola, law-

yer for the developer, said, at the time, his client held five community meetings to get input from residents and made changes in response to their concerns including reducing the height of the building from eight storeys to seven storeys and reducing the number of units from 146 to 119. But the local ratepayers group is “cautiously optimistic” that through further discussions more can be done to address, at least, some of the remaining concerns. “The Village of Woodbridge Ratepayers Association is cautiously optimistic that the deferral will allow productive dialogue between the applicant and the residents as previous meetings failed to bring about a satisfactory resolution to this situation,” Maria Verna, president of the ratepayers association, wrote in an email. “Throughout the process we have been consistent with both City Staff and the Applicant, we do not oppose development but any development needs to be sympathetic and appropriate for the Heritage District.”

As convicted drunk driver Marco Muzzo awaited his sentencing Tuesday in the tragic collision in Vaughan last September that killed three young children and their grandfather, York Regional Police reported a “disappointing” Easter long weekend of impaired driving on York’s roads. Thirteen drivers were arrested and charged with alcohol and drug-related criminal offences between March 24 at 11 p.m. and

March 28 at 1:40 a.m. “Despite the significant tragedies we have experienced on York Region roads and ongoing police efforts to stop drivers from drinking or using drugs and driving, motorists are continuing to put their lives and the lives of innocent people at risk by driving while impaired,” police said in a statement. Four of the 13 arrests over the long weekend came as a result of collisions. Six drivers were charged after being pulled over at RIDE spot checks and another three were charged after concerned residents called 911. “Impaired driving is the No. 1 criminal cause of death in Canada,” police said. “When you drink or

use drugs and drive you not only risk your life and those of your passengers, but the lives of every other driver and pedestrian on the road.” Muzzo was sentenced to 10 years in prison and a 12-year driving ban in Newmarket court Tuesday morning. He had pleaded guilty to impaired driving causing death in the Sept. 27 collision that killed the Neville-Lake children, nine-year-old Daniel, Harrison, 5, and Milly 2, and their grandfather, Gary Neville, 65. Court heard Muzzo got into his Jeep Cherokee to drive to his home in King after returning on a private jet from his bachelor party in Miami.

Recently I was having my regular meeting over a cup of coffee with my friend and colleague, the Minister of Transportation and Vaughan MPP Steven Del Duca. We meet regularly to assess the challenges and opportunities we face in our city, province and country. We spoke about how fortunate we are to have the support of the citizens of Vaughan to help us achieve positive results in key areas, such as job creation, economic growth, environmental sustainability and community safety. On this day we spoke about how we were both looking forward to the imminent ground breaking of the new Mackenzie Vaughan Hospital, as well as the recently announced Hwy. 427 extension. These are important milestones for our community and our partnership as elected officials who share in the common agenda of improving the quality of life and standard of living of our residents. The Mayor’s Desk we take stock of our community’s collective accomplishments but very quickly our conversation turns to the issues that require our continued attention. I told Steven that at the recent Mayor’s Luncheon organized by the Vaughan Chamber of Commerce where 700 people were present, the topic of transit often came up. I could safely say that it was a top-of-mind issue. Specifically, I heard a great deal about the need to extend the Yonge subway - a cause I promoted and highlighted during my speech. After our conversation on my drive back to the office, I felt confident that

our Minister of Transportation is a strong supporter of the Yonge subway extension. We were both on the same page. Engineering and design work should start now. Demand for the extension is self-evident and supported by reliable statistics. A GTHA transit strategy includes York Region. Traffic congestion does not see municipal boundaries. The Yonge extension will improve the environment by eliminating the 2,500 daily bus trips, promote intensification, reduce urban sprawl and drive economic growth. I am sure that like Vaughan Council, York Region Council and York Region residents, the minister appreciates the importance of this issue. If past behaviour is a good indicator of future behaviour, then I am confident we will soon hear good news from this minister soon on this file, one which he fully understands and cares about. NOTICE OF PUBLIC INFORMATION CENTRE NO. 1 Municipal Class Environmental Assessment King-Vaughan Road Bridge Replacement The Study The City of Vaughan has initiated a Municipal Class Environmental Assessment (Class EA) for the replacement of the King-Vaughan Road Bridge, located approximately 1,500 metres east of Highway 27 in the City of Vaughan (ref. Key Plan). The bridge was constructed in 1920 and carries one lane of traffic over the Humber River. The project will assess the need for the replacement of the existing structure and recommend an appropriate replacement strategy. Amec Foster Wheeler has been retained by the City of Vaughan to complete the study.

or anglers carrying unusual equipment such as snares or a large number of buckets. We encourage people to get involved and help prevent the trafficking of our wildlife.” Wildlife poaching is a massive money-making crime worldwide, said David Forster, president of the Ontario Association of Crime Stoppers and the Canadian representative on Crime Stoppers International.

“The illegal trade of wildlife is the fourth most lucrative criminal activity worldwide, only exceeded by the trade of narcotics, counterfeiting and human trafficking,” he said. The crime is estimated to be worth about $30 billion a year worldwide. Animals targeted by illegal traffickers include rare species prized by collectors and endangered animals killed for food, Crime Stoppers said.

Residents who suspect poaching near their homes or farms can anonymously call Crime Stoppers anonymously toll-free at 1-800222-TIPS (8477) or the Ministry of Natural Resources and Forestry tip line at 1-877847-7667. 2013, after two-decades working at the city, was Vaughan’s top earner on the so-called Sunshine List for 2014 with pay of $262,400. Harris isn’t the only one-time occupant of the city manager’s chair to land on the list for 2015. Former interim city manager Barbara Cribbett took the helm after Harris departed and stayed in the post until her retirement last spring. She pulled down just more than $187,000 in 2015. Her replacement, current City Manager Steve

Kanellakos, was paid nearly $196,000 for the eight months he worked in Vaughan last year. Kanellakos is vacating the corner office at the end of April to take the top job at the City of Ottawa, where he worked for nearly 15 years before coming to Vaughan. Not surprisingly, given the rash of senior staff departures in recent years, several other former City of Vaughan employees landed on the 2015 Sunshine list. Former commissioner of community services Marlon Kallideen, who suddenly departed in

January 2014, was paid $214,218 last year. Former finance commissioner John Henry, who quietly parted ways with the city in 2015, topped last year’s list, racking up nearly $280,600 in salary and benefits. Vaughan’s former solicitor MaryLee Farrugia and Joe Pittari, former commissioner of strategic and corporate services, both of whom abruptly “resigned” in Feb. 2015, were paid $244,000 and $265,000 respectively. City officials declined to discuss the presence of former staff members, and Harris specifically, on the

Statement of Cultural Heritage Value The Gallanough Resource Centre meets the criteria of Regulation 9/06 of the Act and contains architectural, historical, and contextual significance as a community facility that was made possible by donations from Frederick Gallanough and Joe Tanenbaum, becoming a focal point for the nearby community. The building was designed by an architect well respected in the heritage conservation field, Bruce Napier Simpson Jr., in a Prairie and Arts and Crafts architectural style that draws the building into the nearby park and relates to the rural nature of historic Thornhill. The increase was driven, in part, by a jump in the number of firefighters climbing up the six-figure salary ladder, which rose to 146 from 105. Fire Chief Larry Bentley chalked that up to a couple of factors. First off, he said, 2015 was a so-called payroll leap year, meaning for those collecting a paycheque every two weeks there were 27 pay periods

instead of 26 — something that happens roughly every 11 years. Secondly, he said, the force racked up some overtime last year in order to “maintain service levels.” If you take firefighters out of the equation and there were 170 employees in the Sunshine club, up from 131 from 2014. In response to an additional question, directed to the mayor, about the rising number of employees on the list, the city issued the following statement: “A number of factors contributed to the increase in employees on the Sunshine List including overtime, acting pay, vacation payouts and retroactive payments. As well, there was a pay anomaly in 2015 that resulted in staff receiving one additional paycheque. … This additional pay pushed some staff over the $100,000 threshold.” When pressed by

NOTICE OF TRANSPORTATION ENVIRONMENTAL STUDY REPORT REVIEW Highway 427 Extension, Realignment of McGillivray Road at Rutherford Road Preliminary Design and Class Environmental Assessment Study THE PROJECT AECOM Canada Ltd. (AECOM) has been retained by the Ministry of Transportation (MTO) to undertake a Preliminary Design and Class Environmental Assessment (Class EA) Study for the proposed realignment of McGillivray Road at Rutherford Road in the City of Vaughan. The project is being undertaken as part of MTO’s plans for the Highway 427 Extension from Highway 7 to Major Mackenzie Drive as documented in the Highway 427 Transportation Corridor Environmental Assessment (EA) Report (January 2010) which was approved November 2010. The Recommended Plan documented in the Highway 427 Transportation Corridor EA Report included a realignment of McGillivray Road at Rutherford Road. Subsequent to EA completion, and in response to the need for integration with municipal land use plans, MTO has reviewed the EA approved realignment and examined the feasibility of a revised alignment. The proposed alignment for McGillivray Road at Rutherford Road identified as part of this study is shown on the adjacent key map. THE PROCESS The study has followed the approved environmental planning process for Group ‘B’ projects under the Class Environmental Assessment for Provincial Transportation Facilities (2000) with agency and public consultation throughout. A Transportation Environmental Study Report (TESR) has been prepared to document the proposed modifications for the realignment of McGillivray Road. The TESR provides a description of the recommended design changes, consultation, associated environmental impacts and proposed mitigation measures. The TESR has been placed on the public record for a 30-day review period beginning March 31, 2016.
