Nerry Goodwyn entered corporate America following his discharge from the United States Navy in 1992. Like many people who find themselves in corporate America, Nerry soon looked for a way to get out. Nerry had worked for his father’s cleaning business growing up. ecently we discovered that the answer to Shakespeare’s question is: A lot! Our office verified the employment of one of our debtors with a common name, let’s call him John Smith. We issued a garnishment against him at the place of employment, received payment of the total judgment amount in September, marked the judgment satisfied in October, and in November received a call from the employer informing us that their John Smith was not the same as our John Smith. After verifying that the social security numbers, full legal name and signatures did not match, the money was refunded and a motion is now pending in court to have the judgment reinstated. Since Notices of Default are likely generated by your property management software, it is crucial that the data be entered into that system correctly. This seems like a simple and obvious task, but we often discover name discrepancies when we receive copies of leases after a case has been filed or in connection with a collections turnover. Common errors include omission of a suffix, misspelling of a name or inversion of two letters and failure to use the full legal name. Although you may address your residents by nicknames like “Liz” or “Skipper” when you talk to them informally, the lease and notices generated by your software are legal documents and should be in the correct legal name which matches the resident’s ID.

WHAT’S IN A NAME? owner but also in connection with other credit applications, and having the correct name listed is can be both a blessing and a curse. You can look up cases by court and by name, so it is a great resource for checking on applicants’ tenancy at prior apartments. Information available includes a separate record of each case filing and the type of case (unlawful detainer, warrant in debt, garnishment), the amount of any judgments entered, whether a writ was issued and if the judgment has been marked satisfied. Since this is public information, judgments you have gotten against prior tenants often trigger requests for them to be satisfied, and this is particularly likely to occur if the tenant had a common name. Usually, these former tenants are in a hurry to get the matter resolved in order to qualify for something else, so if you have had a management change and need to locate the tenant file it can be time-consuming. But on the good side, it could be your former residents calling to pay off that unsatisfied judgment, particularly if the case was filed with the correct name. So, what IS in a name? As it turns out, really a lot. Now is the time to train your team on the importance of getting every name right!

Using the correct legal name in your case filings is not only important, but it can also save you time down the road. Lynn Black has an eye for talent. I know this because she is the publisher of Vendor Guide, and she has clearly selected only the best to write for her magazine. But in all fairness, Lynn would argue that anyone has at least some artistic talent. It is her mission to help people find it.
