ow that the rollout of vaccinations has allowed us to consider the prospect of a return to normalcy, what is the next obstacle that lies in our future? Bankruptcy clerks and other consumer advocates anticipate that the next wave might be one of consumer bankruptcy filings. Consumers have two options in bankruptcy: Chapter 7 or Chapter 13. Chapter 7 is a relatively fast process, generally lasting 6 months or less from filing to discharge. Often this type of filing by a current resident is a last gasp by the debtor to get more time to move out, and it is rare for any assets to be available for payment to creditors. Chapter 13, on the other hand, is often referred to as a wageearner’s bankruptcy. It requires that the debtor pay all excess income over that required to cover basic living expenses to the Trustee, who distributes the funds according to a court-supervised payment plan. Priority is given to creditors with a secured claim, such as a car loan, with any remaining funds paid to unsecured creditors, usually at a fairly low percentage of the claim amount. In order to receive any payment at all, a creditor must file a Proof of Claim with the bankruptcy court. These cases can continue for up to five years, and unsecured creditors often are not paid until the end of the case.

If the debtor or co-debtor is a current tenant, you may not proceed with an eviction case without first getting permission from the bankruptcy court. This is done by filing a Motion for Relief from the automatic stay or co-debtor stay, which can be filed any time the resident is in default of the terms of the lease and takes 30-45 days. The Order granting relief usually only authorizes you to proceed with the unlawful detainer in state court, but may include the right to recovery of rent depending on the circumstances of the case and the motion filed. Sometimes residents will move out voluntarily after a Motion for Relief is filed. Although Chapter 7 cases are generally shorter, you might be tempted to avoid the expense of a Motion for Relief by waiting it out, but since it is possible for these cases to stretch out for months beyond that time it is safest to file one even in a Chapter 7. Once a bankruptcy discharge has been issued, you are required to file a satisfaction of any judgments, reflecting the satisfaction through bankruptcy, and failing to do so could be deemed a violation of federal bankruptcy law. It is important to remember that bankruptcy courts see their role as protecting the right to file and receive a discharge and tend therefore to be debtor-friendly. Regardless of the type of case filed, a bankruptcy notice requires that an owner put on the brakes and screech to a halt. The filing triggers an Automatic Stay, imposing a stop on any further collection actions. If you receive notice of a bankruptcy filing for a former resident, you are required to cease collection actions immediately, and the bankruptcy information should be passed along to any law firm or collection agency handling the collection. Document this in your property management software as well to avoid a violation in the future, which can carry serious consequences. If the debt is owed by more than one person, the remaining debtors are protected by a co-debtor stay while a Chapter 13 case is pending, so you are unable to pursue collections actions against them without approval from the bankruptcy court.
