Does the Virginia Landlord and Tenant Act protect the property manager, owner and tenant from liabilities associated with Carbon Monoxide leaks?

Carbon Monoxide (CO) is an odorless, colorless and tasteless gas which is produced by incomplete combustion of fuels (Natural Gas, Propane, fuel oils, etc.). CO replaces oxygen in the body and accounts for approximately 500 deaths and 20,000 ER visits annually. Often confused with Natural gas and a “rotten egg” smell, CO cannot be detected by any of our senses, which is why it has been nicknamed “The Silent Killer”. Often building up in the body over time, the signs and symptoms of CO poisoning are gradual and can go undetected until it is too late. There is only one way to detect the presence of this dangerous gas and that is with atmospheric monitoring by a properly installed CO alarm. The VRLTA clearly states the property manager or owner’s responsibility for providing CO alarms to tenants in Virginia. The VRLTA requires that you must provide a properly installed CO Alarm in residences with a source of gas only after a tenant request. The installation must be completed within 90 days of request and you may charge the tenant for the service. This protects all parties from the liability and dangers associated with CO leaks; Right? Wrong!

CO is produced by gas appliances in the residence such as furnaces, gas water heaters, car exhaust, gas stoves & ranges, fireplaces and many other fuel burning appliances in the residence. Who is responsible for these appliances? If a hot water heater exhaust vent pipe becomes clogged and forces CO into the residence and no alarm is present to alert the occupants who will be held liable? Is that the tenant’s fault? If a gas stove has clogged jets and fills the residence with lethal levels of CO that goes undetected and results in injury or death who will be responsible? How do we prevent loss of life and liability from injuries associated with CO leaks in the residence? DON’T WAIT, MANDATE!!! Mandating CO alarms in any residence you manage helps to prevent catastrophic emergencies from occurring and protects everyone involved. Do not wait for a tenant’s request to protect you and your owner from liability.

HOW CAN YOU IMPROVE YOUR RESIDENT COLLECTIONS? It is 5:55 PM on the 5th of the month, and Karen is cleaning up her desk in preparation for the office’s 6:00 closing. The door opens, and Mike stops in on his way home from work. He tells her apologetically that he and his wife will have to pay their rent late this month because her mother had surgery and she had to take time off work to help her with the recovery. They should be able to pay the rent and late fee in full with their next paychecks at the middle of the month. Karen thanks him for letting her know, wishes his mother-in-law well, and as he walks out the door she sits back down at her desk and adds this note to his tenant account: “Mike came in to advise rent won’t be paid until mid-month. Driving a van from Amazon.” Resident collections are notoriously low. It therefore becomes vital that you activate your most potent collection resource: your staff. Leasing consultants and maintenance technicians are on the front lines working with your residents to resolve problems. In our example above, Karen has been trained to look for and document new work information when communicating with residents and scheduling work orders. Maintenance workers can be trained to look for new uniforms or work vehicles when completing work orders, and staff can verify and update work information when scheduling maintenance repairs. Perhaps most important, verifying current information which might have changed since the lease was signed can be added as a form in your renewal packet. This information can be invaluable if the account is referred for collection later.

It is helpful to know more about collection procedures in Virginia. Enforcement of a debt arising out of a written contract such as a lease begins by obtaining

a judgment against the former residents. This must be done within five years from the time that the debt arose, which is generally the moveout date. The General District Court can hear cases of up to $25,000.00 for residential moveout charges. Once a judgment has been entered it remains valid for ten years, and can be renewed for an additional ten years. A lot can happen to your former residents in twenty years! The easiest way to collect a judgment is by garnishment, either of wages or bank accounts. We have recently been able to process garnishments for judgments entered between 2011-2013. A wage garnishment can last up to six months, and payments are generally not released until the court return date. Garnishment of a bank account usually lasts only 30-45 days, because once the account is attached and the bank freezes the money the resident is unlikely to put anything more into it! A judgment creditor is also allowed to require the debtor to appear in court and answer questions under oath about his or her resources and general ability to pay the money due. Effective collections should be a vital part of your income strategy. Training your staff to look for helpful information and developing the habit of updating information whenever the opportunity presents itself can help you offset current delinquencies. I was once told by a manager that her team had qualified for a bonus based on the check, we had sent her for collections from prior residents. So to help maintain a healthy bottom line, train your staff to be on the lookout for information from everyday resident interactions that can bring payoffs in the future!
