WEEKLY NEWSLETTER What is the National Constituent Assembly convened by President Maduro? On 1st May 1, 2017, the President of the Bolivarian Republic of Venezuela, Nicolás Maduro signed the decree of convocation to begin the process of N IAN O I forming a National AR UT TIT LIV NS E BO O Constituent AssemC TH IC LA OF PUBL ZUE E E bly, as a democratic, R VEN OF participatory and protagonist alternative to guarantee the peace of the country, against the violent threats of sectors of the opposition and of some international hegemonic powers. Where is its legal and political foundation? The call to Constituent Assembly is embodied and specified in the current Constitution approved in the year 1999. It is in the 347, 348 and 349 articles that we will quote next: Article 347: The people of Venezuela are the depository of the original constituent power. In the exercise of this power, a National Constituent Assembly may be convened with the purpose of transforming the State, creating a new legal order and drafting a new Constitution. Article 348: The initiative of convening the National Constituent Assembly may be taken by the President of

the Republic in the Council of Ministers; The National Assembly, by agreement of the two thirds of its members; The Municipal Councils in town hall, by the vote of two thirds of them; Or fifteen percent of the voters registered in the civil and electoral registry. Article 349: The President of the Republic cannot object to the new Constitution. The constituted powers may in no way impede the decisions of the National Constituent Assembly. Once the new Constitution has been promulgated, it will be published in the Official Gazette of the Bolivarian Republic of Venezuela or in the Gazette of the National Constituent Assembly. How will it be chosen? The convocation to the National Constituent Assembly is a popular, democratic process. It will be formed by universal, secret and direct vote. It will take into account the sectoral and territorial representation. Example 1: Entrepreneurs, indigenous people, trade union movements and students can choose their own representatives. Example 2: it will be possible for each municipality to choose nominally their representatives. According to the decree signed by President Nicolás Maduro, the Assembly will consist of 500 constituents.
