Phosphorus levels are to be improved with the new plant but we need to ensure there is a significant improvement. John Conrad is the consultant for the process. Simon Lake Stewardship and VRS requested phosphorus studies but said it was outside scope of their Class EA o Chelmsford and Azilda WWTF will begin the Class EA process sometime this year o Copper Cliff dumping is being diverted to the Sudbury WWTF o VRS would like clarification of the Vale Inco dumping.  Meeting with Mark Holmes o Agreement to meet but still no Project Descriptions available for 3 of the proposed dams 7. ONTARIO RIVERS ALLIANCE:  Building Alliance – now have 13 Rivers and about 20 organizations represented  Scheduling & Organizing Meeting on 19 February 2011, in North Bay  Team Building XENECA:  Offered position on City Stakeholders Committee – I indicated o I would only accept if I didn’t have to sign any confidentiality agreement o I would be very vocal  Provided the full slide presentation made to City Council in September of last year o Not one mention of “modified peaking” in their whole presentation  Mark Holmes mentioned there are 17 intake sources on this Managed Waterway, and he will provide us with a map showing their locations  I happened to call OEL Hydrosis to see if we could receive Minutes from any Ministry/Proponent Meetings, and it just so happened a meeting was taking place at that very moment in time, in Sudbury. I have requested a copy of those Minutes to show Xeneca has nothing to hide; however, Mr. Holmes hasn’t given me an answer yet. OEL Hydrosis indicated it was up to Xeneca to decide whether to share the Minutes – not the Ministries  I have seen an email from Xeneca indicating a source for their funding of these dams is a pension fund, and it was confirmed by word of mouth by a Xeneca staff member to be OPSEU – we will be pursuing that. VALE INCO:  Talked to Carolyn Hunt, Environmental Group at Inco, to see what their position on the dams are with regard to the Public Water Intake, and they are waiting patiently to see the engineered drawings and Environmental Assessment – they are still a long way off, so they are not concerned at this point. FUNDING:  Stephen Monet indicated funding applications won’t be available until Executive has been chosen for the Lake Planning Advisory Committee

Vermilion River Proposed Hydroelectric Dams Xeneca Development Corporation Ltd.

Further to our recent conversation, I am writing on behalf of the Vermilion River Stewardship, Walden CAN & Copper Cliff CAN to relay our concerns regarding 3 of 4 run-of-river hydroelectric dams proposed for the Vermilion River, by Xeneca Power Development Inc. (Xeneca), at McPherson FaIls, Cascade Falls, Soo Crossing, and Wabagishik Rapids. As you know, the first three of these proposed dams in question, have no Project Descriptions, and are presently going through the Environmental Assessment (EA) approval process. Therefore, we can only refer you to what has been provided to us in the Project Overview (PO) issued by Xeneca, and enclosed for your information. Our concerns are as follows: 1.

The Inco Source Water Intake located relatively close to the bottom of Cascade Falls. We note that your GSSPA Draft Risk Assessment – May 2010, designates the area above the falls as Intake Protection Zone (IPZ) 2 with a Vulnerability Score of 7, and the area below the falls IPZ 1, with a Vulnerability Score of 10, and an Assessed Level of Uncertainty of “High”. McPherson Falls would have a head pond inundation of approximately 100 meters on Crown Land, Cascade Falls a 3.5 km head pond inundation proposed on Crown and private lands, and Soo Crossing a 4.5 km head pond inundation on Crown and private lands. Xeneca’s PO indicates these dams are all slated for “modified peaking”, which means water will be collected in these head ponds until peak demand hours, to be released through the turbines possibly several times each day to take advantage of those peak demand hours. We anticipate this will create several major threats to the Inco Source Water Intake as follows:   

Water rushing through the turbines would create a significant surge of water into the downstream flow, stirring up silt and sediment from the river bottom, creating turbidity, and a risk of releasing heavy metals, such as methyl mercury, and others, into the mix; Erosion of river banks caused by this additional turbidity is another very real possibility; In all 3 dams in question, water flow will be backed up and interrupted for long periods of time in order to fill these head ponds, and left standing until peak demand hours, so water will have an opportunity to increase in temperature. These last few summers we have had lower water levels, and algae has already been an issue on the River, and in wells located along the River, and cyanobacteria may be an additional risk;

Under “modified peaking” there will be an extreme and rapid increase in water levels and current when water is released through these dams, and this could present a major public safety hazard for people swimming at the Centennial Park public beach, located very close to the base of Soo Crossing.

The GSSPA Risk Assessment Report has already placed a high risk assessment to IPZ 1 of 10, and IPZ 2 of 7, so all 3 of these dams would seem to impose a very critical and significant threat to those 13,000 people in Lively, Walden, Whitefish & Copper Cliff receiving drinking water from this source. All three dams are relatively close to one another, and we are very concerned with how this will increase or decrease turbidity, sediment, water levels and water quality in and around this Intake.

We urge NDCA/DWSPP to: 1.

Deny permission to Xeneca, under Section 28(1) of the Conservation Authorities Act, to restrict, regulate or interfere with the use of water from the Vermilion River at these 3 locations; and failing that Require Xeneca to treat McPherson Falls, Cascade Falls and Soo Crossing as one interconnected system within the EA process; and Require Xeneca to undertake an Individual Environmental Risk Assessment on all three of these dams.

Dear Mr. Holmes: Please accept this as a formal request by the Vermilion River Stewardship (VRS) for all documentation pertaining to the Vermilion River Dam Projects, to be made available immediately, and notify VRS when any new documents pertaining to this Project are available! Obtaining documentation, answers to questions, and details of these projects has been a major challenge, and VRS still has not received a Project Description (PD) for McPherson Falls, Cascade Falls, or Soo Crossing, some six months after the Notice of Commencement was apparently issued – it’s hard to tell because no date appears on this document. In “A Citizens Guide to Understanding the EA Process in Waterpower Projects”, it states the very first step in Phase 1 is to have a PD prepared, and the Notice of Commencement begins in Phase 2. We are in Phase 2 and still no PD for 3 of our Projects. VRS only found the Wabagishik Final PD by doing a Google search, and noticed it was available for downloaded from the OEL-Hydrosis website. This PD should have been available on Xeneca’s website for download, or a link to where it could be found. On 8 December 2010 VRS sent an email to Xeneca to inform of our interest in the Vermilion River Proposed Dams, and asked questions for which we have never received a reply. See Addendum 1 for a copy of my message and your reply (a full history of our communications is available on request). It was only after France Gelinas, our local MPP, spoke to you on our behalf that you even acknowledged the interests of the VRS. VRS cannot properly assess nor have meaningful input to these proposed dams when you are not providing the detailed information. Details such as the Inco Public Drinking Water Intake servicing 13,000 people living in Lively, Naughton, Whitefish and Copper Cliff, located within meters of the base of Cascade Falls – see Addendum 2. Attached is a “Notice of Commencement Publish Dates” (NCPD) document, Addendum 3, which I downloaded in December. In this document there was no mention of the Revised Notice of Commencement which was dated 4 November 2010. There was also no indication that the Notice of Commencement for McPherson, Cascade or Soo Crossing was ever published in the local papers. There is an indication that the Notice of Commencement for Wabagishik was published in the Mid North Monitor on 28 July & 4 August 2010, but not in the Sudbury Star. Your website does not have an updated version of this NCPD document, and the old version is now gone. I only became aware of a Revised Notice of Commencement a few days ago when I visited your site and noticed you had more documents available for download. On 17 January 2011, I attended the Wanapitei Public Meeting on behalf of VRS, and at that time asked you for the PDs and for the digital file of the slide presentation made by Xeneca to Sudbury City Council in September 2010. You verbally indicated the PDs wouldn’t be ready for several weeks. On 18 January you emailed the City Council Presentation to us with this message: "By removing some of the generic material not related to the projects, I managed to get the attached presentation to a size I could send you.

I have already been placed on your list of interested parties, however, as a result of this Project, and one other that is a potential threat to the health of the Vermillion River, the Vermillion River Stewardship has come into being. Please consider the Vermillion River Stewardship as an interested party, and place it on your mailing list - vermillionriver@rogers.com! There is an urgency to this situation because approvals have already been granted and the public were not notified, or given a role or say in the process. The whole feeling of being pretty much in the dark, and having it shoved down our throats isn’t a good one!! I would appreciate answers to the following: 1. Why were there no public meetings before the dams were approved? 2. What influence will 4 dams have on the river, its ecosystem and the local inhabitants!!  Public safety – if a dam fails, how will it affect those who live downstream?  Fish spawning  Erosion of habitat and river banks  Water levels – these recent dry summers have already had a negative impact on water levels, will these dams bring water levels even lower? 3. Has there been an Environmental Assessment study completed? 4. How will these dams improve or benefit our local economy – will any share of the profits go back to the local Community? I am a staunch supporter of green energy, and hydro electric is a wonderful source, however, the public have not been involved in the approval process! When the process involves respect and consideration of everyone and everything involved then it’s not so hard to accept, however, in this case any public meeting will be a little after the fact! Vermillion River Dams • What are the daily water fluctuations before the dam is built? What are the water fluctuations after the dam is built? What are the fluctuations from season to season? • How many people are affected by the water backup? • Can all fish species move through the dam? • Have existing fish spawning areas in the impacted zone been identified? What spawning areas are affected by the dam? • How will winter fluctuations impact on ice and winter travel on the river? • Surveys of wildlife appear incomplete. Surveys on birds, reptiles and amphibians were done on two one day visits in one spring period. Insufficient to assess what is truly there. MNR records are old and often based on reports of people ‘s cursery observations. • With respect to reptile surveys, no observations were done for the Woods Turtle which is found in other areas of the upper Vermillion River and is classified as Endangered. Simon Lake Community Stewardship Group (SLCSG) & Vermilion River Stewardship (VRS) Meeting with Sudbury Wastewater Treatment Staff & John Connard, Associate of JL Richards (CITY) 2 February 2011 – 12:00 pm to 1:00 pm At Sudbury Wastewater Treatment Facility, Kelly Lake Road In Attendance: CITY: John Connard, Brad Johns, Dan Miron SLCSG: Perry Sarvas, Lesley Flowers, Dave Furino VRS: Linda Heron Re: Letter to JL Richards & Associates Limited, dated 27 October 2010 from SLCSG Lively/Walden Wastewater Treatment System Schedule C, Class EA SLCSG: Stated desire to partner with the City to help with a Phosphorus Study to determine source/s of phosphorus, and stated some of the challenges:  Need to create a positive impression of our lake  Algae problem is making it difficult for homeowners to sell their homes  Need to consider options for reducing phosphorus loading in lake  Need to be assured that any new Walden facility would not be adding to the problem & instead would be reducing phosphorus levels in effluent VRS: Stated the interests of the VRS:  Vermilion impacted by 9 WWTF, 3 sewage lagoons and 2 lift stations  What upgrades are being considered at other plants within City of Sudbury  If so, which facilities  Would like to see water sampling results from above & below the SWWTF CITY: Since 2009, there has been a significant reduction in the number of bypasses, spills, and mass loading numbers.  Upstream phosphorus levels are not within the scope of this current Walden Wastewater Treatment Class EA process  Normal loading is 1.0, but have reduced to .55, and have a target of .4 mg/3m  June to September .5; and October to May 1.0 mg/3m  Mass loadings have decreased by 25 to 30%  Chelmsford plant has reduced phosphorus levels to .3 mg/3m o Necessary because effluent dumps into Whitson River & not much water in it in summer months o Whitson flows into the Vermilion River o Have to work very hard to keep it at .3 mg/3m  Chelmsford & Azilda plants will be starting a Class EA Process this year  Expressed concern for what Vale Inco are dumping into creek from tailing ponds, and suggested we approach them to investigate  Dan offered to help us facilitate a meeting  Have started a project to divert sewage from Copper Cliff to Sudbury WWTF

There has been no discharge from Garson Sewage Lagoon for 3 years Chelmsford Sewage Lagoon has no discharge now Using no chlorine Asked for a better WWTF that will filter effluent through either  sand filled filter bed, or  marsh/bull rush technology before releasing effluent into the environment.  It is not acceptable in 2011 for a City run WWTF to be dumping effluent into our lakes and rivers any longer Considering tertiary treatment  Bull rushes are only effective in smaller applications – not on this scale  There are tertiary treatment options being considered to filter effluent further before releasing, but costs more  Cost is a factor Our Stewardships and GSWA would help with support at budget time if satisfied with the technology and adequacy of a new or upgraded WWTF. Tertiary treatment is essential. It was agreed that a Partnership between Sudbury WWF, SLCSG & VRS would be formed:  Dan will help our Stewardships engage Vale  John will provide the appropriate contacts in Vale & the City o Suggested sending a letter to the CAO, Doug Nadarozni, City of Sudbury  Desire to partner with Sudbury  expressing our concerns  to find best solutions o Involve MOE o Copy all correspondence to Jacques Barbeau & Mayor o Suggested involving Stephen Monet, Environmental Initiative Group  Questions & Answers from the Public Meeting in October 2010 will be ready in March or April
