HISTORY The City of Indian Wells was named for an old Cahuilla Indian water hole that was a major water source for local area tribes. The well appears to have been built around 1850 and shows up on early state and railroad maps. After gold was discovered in the Colorado River in 1863, the well served as a watering point for prospectors, pioneers and stage line passengers along the famous Bradshaw Trail. There are recorded references to stopping for water at the “Indian Well.” The Southern Pacific Railroad line that traveled through Coachella Valley also passed through the future site of Indian Wells. In 1870, as both rail and state traffic grew, a more efficient well was constructed by the County of Riverside. The new well was located approximately 100 feet south of the abandoned Native American village that had grown up around the original well. Through the early twentieth century, the new well served thousands of travelers in addition to the area’s first permanent residents. Those first settlers began residing in the area in the late 1800s and a post office was soon established. By the late 1910s, Indian Wells was becoming known as a residential area. The date growing industry was also established around this same time, and by the 1920s Indian Wells was a thriving community. The town saw another growth spurt in the 1950s when Eldorado Country Club and the Indian Wells Country Club and Golf Course opened their doors. In 1957 the first property owners association was established and ten years later, a petition was filed with the state by the Citizens for the Incorporation of Indian Wells. Approximately 285 voters registered for the first city election in June of 1967. The voters overwhelmingly voted to incorporate the area, creating California’s 400th city. Around this time the city also became a lure for celebrities and other famous personalities. For example, Hollywood entertainer and Indian Wells hotel owner Desi Arnaz was one of the developers of Indian Wells Country Club and Golf Course, and President
Dwight D. Eisenhower so appreciated the area that he designated it as his winter residence. Indian Wells’ prestigious golf and tennis tournaments were also a magnet for some of the biggest names in the country. Elected officials, including early developer and mayor Pete Peterson, established policies to maintain the city primarily as a residential community. Over the next few years, infrastructure was built to support the thriving town and its growing population. In the 1970s and 1980s, Indian Wells welcomed the Balboa Bay Club/Indian Wells, Desert Horizons Country Club and the city-owned Golf Resort at Indian Wells. Other developments included the conversion of the former Eldorado Polo Grounds into world-famous golf courses at the Vintage Club, the establishment of the Living Desert Botanical Gardens and Zoo and the construction of the Civic Center. The 1990s and 2000s saw concentration on infrastructure including construction of walking and bicycling paths, the under grounding of utilities and the construction of the over-crossing on Fred Waring Drive at the Whitewater Channel. Continued expansion during this time resulted in the transformation of the former Erawan Garden Hotel into the charming Miramonte Resort and Spa. The four major hotel properties in Indian Wells, the Miramonte, the Hyatt
Grand Champions, the Renaissance Esmeralda and Indian Wells Resort Hotel, generate more than 60 percent of the Indian Wells operating budget. The Indian Wells Golf Resort currently sports two newly designed 18-hole championship courses and a magnificent new 55,000-square-foot clubhouse, the IW Club, for the enjoyment of both residents and visitors. In the late 1990s, the city annexed 387 acres of land in its sphere of influence and the Indian Wells Tennis Garden was constructed. A world renowned tennis tournament, currently known as the BNP Paribas Open, is held during the month of March and attracts large crowds who flock to Indian Wells to watch the best players in the world. The community has been recognized as one of the U.S. cities with the highest national incomes and is well known for its philanthropy and support of important causes in the desert. The population in Indian Wells has grown to approximately 5,200 residents and nearly doubles in size during the winter months. d

HOMES & RESIDENTIAL LIVING Existing single-family home prices in Indian Wells range from a half million dollars to well into the millions. The Indian Wells home market encompasses both contemporary and traditional housing styles, with many properties offering scenic views of the desert, golf courses and the beautiful Santa Rosa mountain range. The community also has a number of condominium properties. New housing developments in the early 2000s helped drive up the price of homes throughout the Coachella Valley. During that time, according to city figures, the assessed valuation of Indian Wells real estate reached more than $3.1 billion, a jump of more than one hundred percent from 1990. The current economy has affected real estate values nationwide but Indian Wells has been less affected by the current market than most American cities. The 5,200 residents of Indian Wells share some 15 square miles of soil. Each winter, they are joined by as many as 6,000 parttime residents who spend three to six months in the community.
The permanent resident figure has jumped 36.3 percent* since the 2000 Census. Indian Wells, in fact, experienced the same population growth as other cities in the Coachella Valley and Riverside County. The cost of living index for Indian Wells is at 186 percent of the national index. Other census data shows that the median family income is nearly $126,650, one of the highest figures for any Riverside County community. The average age of residents is 63.4 years and nearly 40 percent of the town’s residents have a college degree. Southern California Edison provides electricity in the western region of Coachella Valley, while the Imperial Irrigation District does the same in the eastern region. Natural gas is provided by Southern California Gas Company. Water for local residences is provided by the Coachella Valley Water District. Meanwhile, Burrtec Waste and Recycling handles residential trash pickup and recycling throughout most of the Coachella Valley.
Along with the year-round recreational activities of swimming, golf and tennis that Indian Wells residents have come to expect, residents can take advantage of certain incentives and amenities through the city’s Residential Benefit Program. To receive their Resident ID Card, residents must present proof of home ownership at City Hall. Some of the amenities available include discounts at the Indian Wells Golf Resort, BNP Paribas Open and all four Indian Wells hotel properties. The city and its partners also host several exclusive resident events throughout the year including Coffee and Conversation, Patio Parties, summer socials and annual State of the City evening. Residents are also able to take advantage of the IW Club, Satellite Library, Community Garden, extensive GO GREEN sustainability program, Housing Stimulus Plan and top-rated medical and academic institutions. Coverage area includes the cities of Indian Wells, Palm Desert and La Quinta. The Gerald Ford Elementary School is staffed with more than 30 teachers, a resource specialist, a counselor and several shared or part-time staff such as paraprofessionals, a physical education teacher/computer technician, a speech therapist, a psychologist and a nurse. An active Parents Club conducts numerous programs and activities throughout the school year and also publishes a newsletter. The Desert Sands Unified School District is one of three districts in Coachella Valley. The other two are the Palm Springs Unified School District and the Coachella Unified
School District. All three districts are expanding with new and remodeled schools to meet a growing population. In 2005, Palm Desert High School was named one of the 192 California Distinguished High Schools in the state. The area also offers a number of private schools: the Marywood-Palm Valley, Christian School of the Desert, Palm Springs Christian School, St. Margaret’s Episcopal School, the Indio Christian Academy and Xavier College Prep. There are also a number of local higher education institutions offering opportunities for bachelor’s and master’s degrees in business, education and other disciplines, as well as workforce skills in numerous disciplines: the new California State University, San Bernardino-Palm Desert campus; the University of California, Riverside’s Richard J. Heckmann International
Center for Entrepreneurial Management campus; and the College of the Desert. Chapman University and University of Phoenix also offer campus-oriented and online courses in the Coachella Valley. Residents can also utilize the Rancho Mirage Public Library, which offers services and resources focusing on the informational, educational and cultural needs of Indian Wells. A cooperative agreement with the City of Indian Wells allows residents to use the library and its services at no cost simply by obtaining a valid library card. The card also allows residents to utilize all libraries in the Coachella Valley, as well as libraries in the State Public Library System. d

Real Estate
Theft
How to Protect Your Assets in the United States and Mexico By Lucille J. Boston, Esq. here is an old warning, “We do not want to get to the top of the ladder and realize we’re against the wrong wall.”
T
In purchasing real estate both in the United States and in Mexico, there are two ladders you can climb: (1) to secure your property from theft and hold it in privacy and peace of mind or (2) to proudly hold it in your personal name or corporate name for the world to see. With the escalating crime of identity theft, which now is targeting lucrative real property, and the abundance of frivolous lawsuits against doctors and others in high-risk occupations, it is urgent that one climb up a ladder to security and privacy rather than holding assets in his own name or unsecured corporation. The ladder to security is inscribed with the words “A thief cannot steal what he cannot find.” Identity theft has no cure or vaccination to prevent it except using self-help to keep the epidemic from infecting you and spreading to your assets. Imagine returning from vacation to find someone else living in your home. Imagine trying to open an escrow to sell your home only to find out that someone else had just sold it. Imagine the living nightmare of having your personal and professional relationships destroyed by a new type of “fatal attraction” identity thief who when discovered does not flee but goes on the attack with blackmail, smear tactics, and threats against you and your family’s and supporter’s lives and does a new form of dirty harassment every day, such as changing your addresses and airline flights, making nightly vile telephone calls to keep you awake, and even killing your dog.
I do not have to imagine any of this. I have been living it for seven years. I wrote this book, Preventing Real Estate Theft, so that you and your loved ones never have to experience the horror of having your property and lives stolen. The first part of the book describes how the dirty game of real property theft is played and orchestrated and used in the United States and in foreign countries with Mexico as an example. It is a prologue to the rest of the chapters, which illustrate how to prevent this nightmare from happening to you. Once such a villainous identity thief gets his claws into his victim, he is like a tiger with a piece of meat between his teeth, never letting go. The victim’s life can never be the same. The second part of the book builds on the elements in the true story that could have gone differently and details the legal skills to adapt in real property matters in the United States and abroad. The book also covers steps to take in protecting your identity, personal and corporate, as well as advice on keeping your personal information private without hindering your social life or freedom to travel. You will learn:
n How a thief targets his victim and gathers information
n What steps to take when purchasing property in the United States and in foreign countries
n Insider advice on the greatest tool of protecting real estate in the United States – Land Trusts – including a large appendix of sample legal documents.

Author
Attorney Lucille Boston is founder and president of a law firm practicing primarily real estate and asset protection law. As a member of the American Bar Association International Division, she studied Mexico’s new foreign investment law under NAFTA and traveled with the U.S. Justice Department to China and Japan to secure trade relationships. As an inheritance tax referee, appointed by the governor of California, she has delivered more than 500 speeches on estate planning and asset protection to civic organizations as well as to the California Army National Guard, who appreciated her advice so much that they made her an honorary colonel. She has served on the condominium association board of governors, often as president, for several properties throughout the United States and in Mexico, and she is the founder of a rail-car company, hailed by the Wall Street Journal as a success story in the article “Developing a Unique Investment Program.” She is still a rail-industry executive, and has served on the California Governor’s Council on Economic Development. Ms. Boston has been named Woman of the Year by several organizations, listed in Who’s Who in California, and featured in many newspapers and other publications, in articles titled “Profile in Commitment,” “She Didn’t Rest on One Success,” and “Is It Really a Man’s World?” Ms. Boston holds a Juris Doctor of Law degree, and in addition to her license to practice law in California, including before the Supreme Court of California, she is licensed to practice before the U.S. Central District Court of California, the U.S. Court of Appeals, and the U.S. Supreme Court. To bolster area business, the Coachella Valley also offers a Foreign Trade Zone, with more than 900 acres at the Palm Springs International Airport and 14 acres at the Palm Springs Rail Station. The zone can provide a number of benefits for companies that import or export goods, such as customs duties and federal excise taxes which are deferred for improving cash flow, a lack of duties on goods exported from the zone, an exemption of state and local inventory taxes on foreign and domestic goods held for export and possible lower duties for finished products assembled in the zone.

of Indian Wells is not only prosperous but also benefits from being one of California’s wealthiest and financially wellmanaged communities, thanks to reliable accounting practices, with a major emphasis on solid fiscal plans for the next several decades. In Indian Wells, big business is found in the form of the community’s hospitality industry and its four hotels. A majority of the tax base in the community is a bed tax, provided by the 1,460 hotel rooms at the four major hotels: The Hyatt Grand Champions Resort, Renaissance Esmeralda Resort, Miramonte Resort and spa and the Indian Wells Resort Hotel. Each of the five-star resorts puts a strong emphasis on hospitality and customer service. As a result, in recent years hotel room sales have reached more than $50 million and the Transient Occupancy Tax (TOT) has increased by 17 percent. In addition to the resort properties, Indian Wells boasts several high-end commercial and retail establishments, guided by a strong Chamber of Commerce focused on economic vitality and

committed business strategies. The Chamber supports both the Fortune 500 companies that flock to Indian Wells for business conferences, as well as the growing number of banks, stock brokerage firms and accounting offices that have set up shop in the area. Taxable retail sales in Indian Wells’ resorts and retail centers along the Highway 111 corridor have dramatically increased in the last decade, and as of 2003, total taxable sales in Indian Wells reached more than $67 million while per capita spending amounted to more than $14,000. Some of the strongest growth has been witnessed in the community’s non-hotel-affiliated restaurants, which reached some $12 million in annual sales during 2001 and 2002.
In addition to Indian Wells’ affluent residential base and a strong economic environment, businesses can also prosper from the Coachella Valley’s healthy economy. In recent years, thousands of new housing permits have been issued, the majority for the eastern half of Coachella Valley. The Coachella Valley has also been labeled a “hotbed” for entrepreneurial types by Palm Springs Life Magazine, as the area is known for its devotion to green energy and healthcare, among other healthy business sectors. With nearly eternal sunshine at 350 days per year, a climate bordering on perfection with an average temperature of 74 degrees and a small-town resort atmosphere that leaves you feeling as if you’re on a perpetual vacation, many have found that the landscape is ideal for not only play, but work as well. d

JFK Memorial also offers emergency care 24/7, ambulatory surgery center, imaging services and an outpatient rehabilitation center. Part of Tenet HealthSystem, the Desert Regional Medical Center in Palm Springs not only provides a number of medical services including cancer care, cardiovascular care, women’s health services, bariatrics and orthopedics, among many others, but it also offers a variety of community programs, classes and events. Recognized for its Center of Excellence in oncology, cardiovascular and orthopedic services, the Eisenhower Medical Center is equipped with a 253bed hospital, the Annenberg Center for Health Sciences, the Barbara Sinatra Children’s Center and the acclaimed Betty Ford Center. The medical center is currently expanding its Emergency Department, slated for completion in 2008, and is building a new inpatient pavilion to meet the growing needs of its patient-base. In 2005, Eisenhower Medical Center was recognized as one of the 100 Top Hospitals by Solucient—making it only one of six hospitals in the State of California to receive such an honor.
JFK Memorial Hospital was founded in 1966 by a group of physicians; the original 112-bed Indio Community Hospital has grown to the 158-bed hospital JFK Memorial is today. On April 15, 2009, the hospital received the American Heart Association’s Get-With-TheGuidelines Gold Performance Achievement Award for both coronary artery disease and heart failure. The medical center has received a five-star rating for its clinical excellence in joint replacement surgery and stroke care by HealthGrades, too, thus

Tours are held on Thursday evenings; for further information, call 760-775-8174. Sweet Success is another class that may interest pregnant patients who find themselves afflicted by gestational diabetes. For information about this program, call 760775-2607. And for those needing services at home, Vitas Innovative Hospice Care, and Home Instead Senior Care are available. Additionally, several retirement communities are located in nearby communities with popular choices including SoCal Housing: Mountain View Villas in Indian Wells and Prowatch
Homecare and Fountains Retirement Communities. Indian Wells is also home to one location of a three-facility network of diagnostic imaging centers, Desert Medical Imaging (DMI). DMI provides services in high field and open magnetic resonance imaging (MRI), spiral computed tomography imaging (CT), ultrasound and positron emission tomography imaging (PET/CT). DMI sets itself apart as a center that is committed to same-day appointments and speedy results. The staff is largely bilingual and includes licensed technologists and board-certified radiologists who report to Medical Director Dr. John F. Feller. On-site transcription and billing as well as patient transportation upon request are just a few of the perks of utilizing DMI for your imaging needs. d
